Luật này quy định về hoạt động hóa chất, an toàn trong hoạt động hóa chất, quyền và nghĩa vụ của tổ chức, cá nhân tham gia hoạt động hóa chất, quản lý nhà nước về hoạt động hóa chất.
Luật này áp dụng đối với tổ chức, cá nhân tham gia hoạt động hóa chất; tổ chức, cá nhân liên quan đến hoạt động hóa chất trên lãnh thổ nước Cộng hoà xã hội chủ nghĩa Việt Nam.
1. Hoạt động hóa chất phải tuân theo quy định của Luật này và các quy định khác của pháp luật có liên quan.
2. Hoạt động liên quan đến chất phóng xạ, chất thải phóng xạ tuân theo quy định của pháp luật về an toàn bức xạ, năng lượng nguyên tử.
3. Trường hợp quy định của Luật này khác với quy định của điều ước quốc tế liên quan đến hóa chất và hoạt động hóa chất mà Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên thì thực hiện theo quy định của điều ước quốc tế đó.
Trong Luật này, các từ ngữ dưới đây được hiểu như sau:
1. Hóa chất là đơn chất, hợp chất, hỗn hợp chất được con người khai thác hoặc tạo ra từ nguồn nguyên liệu tự nhiên, nguyên liệu nhân tạo.
2. Chất là đơn chất, hợp chất kể cả tạp chất sinh ra trong quá trình chế biến, những phụ gia cần thiết để bảo đảm đặc tính lý, hóa ổn định, không bao gồm các dung môi mà khi tách ra thì tính chất của chất đó không thay đổi.
3. Hỗn hợp chất là tập hợp của hai hoặc nhiều chất mà giữa chúng không xảy ra phản ứng hóa học trong điều kiện bình thường.
4. Hóa chất nguy hiểm là hóa chất có một hoặc một số đặc tính nguy hiểm sau đây theo nguyên tắc phân loại của Hệ thống hài hòa toàn cầu về phân loại và ghi nhãn hóa chất:
a) Dễ nổ;
b) Ôxy hóa mạnh;
c) Ăn mòn mạnh;
d) Dễ cháy;
đ) Độc cấp tính;
e) Độc mãn tính;
g) Gây kích ứng với con người;
h) Gây ung thư hoặc có nguy cơ gây ung thư;
i) Gây biến đổi gen;
k) Độc đối với sinh sản;
l) Tích luỹ sinh học;
m) Ô nhiễm hữu cơ khó phân huỷ;
n) Độc hại đến môi trường.
5. Hoá chất độc là hóa chất nguy hiểm có ít nhất một trong những đặc tính nguy hiểm quy định từ điểm đ đến điểm n khoản 4 Điều này.
6. Hoá chất mới là hóa chất chưa có trong danh mục hóa chất quốc gia, danh mục hóa chất nước ngoài được cơ quan nhà nước có thẩm quyền của Việt Nam thừa nhận.
7. Hoạt động hóa chất là hoạt động đầu tư, sản xuất, sang chai, đóng gói, mua bán, xuất khẩu, nhập khẩu, vận chuyển, cất giữ, bảo quản, sử dụng, nghiên cứu, thử nghiệm hóa chất, xử lý hóa chất thải bỏ, xử lý chất thải hóa chất.
8. Sự cố hóa chất là tình trạng cháy, nổ, rò rỉ, phát tán hóa chất gây hại hoặc có nguy cơ gây hại cho người, tài sản và môi trường.
9. Sự cố hóa chất nghiêm trọng là sự cố hóa chất gây hại hoặc có nguy cơ gây hại lớn, trên diện rộng cho người, tài sản, môi trường và vượt ra khỏi khả năng kiểm soát của cơ sở hóa chất.
10. Đặc tính nguy hiểm mới là đặc tính nguy hiểm được phát hiện nhưng chưa được ghi trong phiếu an toàn hóa chất.
1. Bảo đảm an toàn cho người, tài sản, hệ sinh thái và môi trường; trật tự, an toàn xã hội.
2. Kiểm soát chặt chẽ hoạt động hóa chất, đặc biệt đối với hóa chất mới, hóa chất nguy hiểm, hóa chất hạn chế kinh doanh, hóa chất cấm.
3. Thông tin đầy đủ, chính xác, kịp thời về đặc tính nguy hiểm của hóa chất và các biện pháp phòng ngừa cần thiết.
1. Xây dựng ngành công nghiệp hóa chất hiện đại, bền vững, sử dụng hiệu quả tài nguyên thiên nhiên; chú trọng phát triển các hóa chất cơ bản, hóa chất thân thiện với môi trường, hóa chất có giá trị kinh tế cao phục vụ phát triển kinh tế - xã hội.
2. Nhà nước đầu tư xây dựng quy hoạch phát triển công nghiệp hóa chất, xây dựng hệ thống kiểm soát an toàn hóa chất quốc gia, cơ sở dữ liệu thông tin an toàn hóa chất.
3. Nhà nước khuyến khích các tổ chức, cá nhân đầu tư phát triển công nghiệp hóa chất; ứng dụng công nghệ hiện đại, công nghệ thân thiện với môi trường; giảm dần việc sử dụng hóa chất nguy hiểm, thay thế các hóa chất độc bằng các hóa chất ít độc và không độc trong sản xuất và sử dụng; khuyến khích việc tái chế, tái sử dụng và giảm thiểu chất thải hóa chất.
4. Tổ chức, cá nhân đầu tư dự án sản xuất hóa chất thuộc lĩnh vực, địa bàn mà Nhà nước khuyến khích được hưởng chính sách ưu đãi theo quy định của pháp luật về đầu tư, đất đai, thuế và các quy định khác của pháp luật có liên quan.
1. Sản xuất, kinh doanh, vận chuyển, cất giữ, sử dụng, gửi, cho, tặng hóa chất nguy hiểm trái quy định của Luật này và các quy định khác của pháp luật có liên quan.
2. Không công bố thông tin cần thiết, cung cấp thông tin không đầy đủ, thông tin sai lệch, che giấu thông tin về đặc tính nguy hiểm của hóa chất, sản phẩm chứa hóa chất nguy hiểm.
3. Sử dụng hóa chất không thuộc danh mục được phép sử dụng, hóa chất không bảo đảm tiêu chuẩn, chất lượng, vượt quá hàm lượng cho phép để sản xuất và bảo quản thực phẩm, thuốc chữa bệnh, thức ăn gia súc, thuốc thú y, thuốc bảo vệ thực vật, phân bón, sản phẩm hóa chất tiêu dùng.
4. Sử dụng hóa chất độc để săn bắt động vật, thực hiện các hành vi xâm hại đến sức khoẻ con người, tài sản và môi trường.
1. Quy hoạch công nghiệp hóa chất phải phù hợp với nguyên tắc và chính sách của Nhà nước về hoạt động hóa chất, quy định của Luật này và các quy định khác của pháp luật có liên quan.
2. Quy hoạch công nghiệp hóa chất được xây dựng trên cơ sở chiến lược phát triển kinh tế - xã hội của cả nước, chiến lược phát triển các ngành công nghiệp và được lập cho từng giai đoạn mười năm, định hướng cho mười năm tiếp theo.
3. Quy hoạch công nghiệp hóa chất phải định hướng hình thành các khu công nghiệp hóa chất tập trung.
4. Địa điểm bố trí khu công nghiệp, cơ sở sản xuất hóa chất phải phù hợp với đặc điểm, tính chất của hóa chất và công nghệ sản xuất, bảo quản hóa chất, điều kiện tự nhiên, điều kiện kinh tế - xã hội nhằm đáp ứng yêu cầu an toàn hóa chất.
1. Bộ Công thương chủ trì, phối hợp với các bộ, ngành, địa phương tổ chức lập quy hoạch công nghiệp hóa chất quốc gia trình Thủ tướng Chính phủ phê duyệt; hướng dẫn và kiểm tra việc thực hiện quy hoạch.
2. Căn cứ quy hoạch công nghiệp hóa chất quốc gia đã được Thủ tướng Chính phủ phê duyệt và mục tiêu phát triển kinh tế - xã hội địa phương, Uỷ ban nhân dân tỉnh, thành phố trực thuộc trung ương (sau đây gọi chung là Ủy ban nhân dân cấp tỉnh) lập, phê duyệt kế hoạch phát triển công nghiệp hóa chất phù hợp với quy hoạch phát triển công nghiệp địa phương.
3. Nhà nước bảo đảm kinh phí cho công tác quy hoạch công nghiệp hóa chất theo quy định của Luật ngân sách nhà nước.
1. Dự án sản xuất, kinh doanh hóa chất phải tuân thủ quy định của Luật này, pháp luật về đầu tư, bảo vệ môi trường và các quy định khác của pháp luật có liên quan.
2. Dự án sản xuất, kinh doanh hóa chất phải sử dụng công nghệ bảo đảm tiêu chuẩn môi trường, giảm thiểu việc sử dụng hóa chất nguy hiểm và giảm thiểu chất thải hóa chất.
3. Chủ đầu tư dự án sản xuất, kinh doanh hóa chất phải xây dựng Biện pháp phòng ngừa, ứng phó sự cố hóa chất hoặc Kế hoạch phòng ngừa, ứng phó sự cố hóa chất theo quy định tại Chương VI của Luật này.
4. Chủ đầu tư dự án sản xuất, kinh doanh hóa chất có trách nhiệm phối hợp với chính quyền địa phương tổ chức lấy ý kiến của cộng đồng dân cư nơi thực hiện dự án về biện pháp bảo vệ môi trường theo quy định của pháp luật về bảo vệ môi trường.Bổ sung
1. Tổ chức, cá nhân sản xuất, kinh doanh hóa chất phải thực hiện các quy định về quản lý và an toàn hóa chất theo quy định của Luật này, các quy định khác của pháp luật có liên quan để bảo đảm an toàn cho người lao động, sức khoẻ cộng đồng và môi trường.
2. Tổ chức, cá nhân sản xuất, kinh doanh hóa chất phải thường xuyên kiểm tra, bảo dưỡng, vận hành hệ thống an toàn và xử lý chất thải.
3. Cơ quan quản lý nhà nước trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm thường xuyên tổ chức hướng dẫn, kiểm tra, thanh tra việc bảo đảm an toàn trong sản xuất, kinh doanh hóa chất.
1. Tổ chức, cá nhân sản xuất, kinh doanh hóa chất phải bảo đảm các điều kiện cơ sở vật chất - kỹ thuật phù hợp với quy mô hoạt động và đặc tính của hóa chất, bao gồm:
a) Nhà xưởng, kho tàng và thiết bị công nghệ;
b) Trang thiết bị an toàn, phòng, chống cháy nổ, phòng, chống sét, phòng, chống rò rỉ, phát tán hóa chất và các sự cố hóa chất khác;
c) Trang thiết bị bảo hộ lao động;
d) Trang thiết bị bảo vệ môi trường, hệ thống xử lý chất thải;
đ) Phương tiện vận chuyển;
e) Bảng nội quy về an toàn hóa chất; hệ thống báo hiệu phù hợp với mức độ nguy hiểm của hóa chất tại khu vực sản xuất, kinh doanh hóa chất nguy hiểm. Trường hợp hóa chất có nhiều đặc tính nguy hiểm khác nhau thì biểu trưng cảnh báo phải thể hiện đầy đủ các đặc tính nguy hiểm đó.
2. Bộ quản lý ngành, lĩnh vực quy định cụ thể điều kiện cơ sở vật chất - kỹ thuật bảo đảm an toàn trong sản xuất, kinh doanh hóa chất thuộc phạm vi quản lý.
1. Tổ chức, cá nhân sản xuất, kinh doanh hóa chất phải có người chuyên trách về an toàn hóa chất có trình độ chuyên môn phù hợp với quy mô và loại hình sản xuất, kinh doanh hóa chất, nắm vững công nghệ, phương án và các biện pháp bảo đảm an toàn hóa chất.
2. Người lao động trực tiếp sản xuất, kinh doanh hóa chất phải có trình độ chuyên môn phù hợp với nhiệm vụ được phân công.
3. Người trực tiếp điều hành sản xuất của cơ sở sản xuất hóa chất nguy hiểm phải có trình độ đại học trở lên về chuyên ngành hóa chất.
1. Hóa chất thuộc Danh mục hóa chất sản xuất, kinh doanh có điều kiện là hóa chất nguy hiểm có yêu cầu kiểm soát chặt chẽ về kỹ thuật an toàn trong sản xuất, kinh doanh.
2. Yêu cầu đối với hoạt động sản xuất, kinh doanh hóa chất thuộc Danh mục hóa chất sản xuất, kinh doanh có điều kiện được quy định như sau:
a) Thực hiện quy định tại các điều 11, 12 và 13 của Luật này;
b) Có cơ sở vật chất - kỹ thuật, năng lực chuyên môn đáp ứng quy chuẩn kỹ thuật áp dụng đối với sản xuất, kinh doanh hóa chất thuộc Danh mục hóa chất sản xuất, kinh doanh có điều kiện;
c) Có Giấy chứng nhận đủ điều kiện sản xuất, kinh doanh hóa chất thuộc Danh mục hóa chất sản xuất, kinh doanh có điều kiện (sau đây gọi là Giấy chứng nhận) trong trường hợp pháp luật quy định phải có Giấy chứng nhận.
3. Bộ Công thương và các bộ, ngành có liên quan phối hợp xây dựng điều kiện sản xuất, kinh doanh và Danh mục hóa chất sản xuất, kinh doanh có điều kiện trình Chính phủ ban hành.
4. Bộ quản lý ngành, lĩnh vực trong phạm vi nhiệm vụ, quyền hạn của mình quy định quy chuẩn kỹ thuật và tổ chức cấp Giấy chứng nhận đủ điều kiện sản xuất, kinh doanh hóa chất quy định tại Điều này.
1. Hóa chất thuộc Danh mục hóa chất hạn chế sản xuất, kinh doanh là hóa chất nguy hiểm được kiểm soát đặc biệt về kỹ thuật an toàn, phạm vi, loại hình, quy mô, thời hạn sản xuất, kinh doanh để bảo đảm không gây phương hại đến quốc phòng, an ninh, sức khỏe con người, tài sản, môi trường.
2. Yêu cầu đối với hoạt động sản xuất, kinh doanh hóa chất thuộc Danh mục hóa chất hạn chế sản xuất, kinh doanh được quy định như sau:
a) Thực hiện quy định tại điểm a và điểm b khoản 2 Điều 14 của Luật này;
b) Có Giấy phép sản xuất, kinh doanh hóa chất thuộc Danh mục hóa chất hạn chế sản xuất, kinh doanh (sau đây gọi là Giấy phép).
3. Bộ Công thương và các bộ, ngành có liên quan phối hợp xây dựng điều kiện sản xuất, kinh doanh và Danh mục hóa chất hạn chế sản xuất, kinh doanh trình Chính phủ ban hành.
4. Bộ quản lý ngành, lĩnh vực là cơ quan có thẩm quyền cấp Giấy phép và tổ chức cấp Giấy phép sản xuất, kinh doanh hóa chất thuộc Danh mục hóa chất hạn chế sản xuất, kinh doanh trong phạm vi quản lý của mình.
1. Tổ chức, cá nhân đề nghị cấp Giấy chứng nhận, Giấy phép lập hồ sơ gửi cơ quan nhà nước có thẩm quyền cấp Giấy chứng nhận, Giấy phép.
2. Hồ sơ đề nghị cấp Giấy chứng nhận, Giấy phép bao gồm:
a) Đơn đề nghị cấp Giấy chứng nhận, Giấy phép theo mẫu quy định;
b) Bản sao Giấy chứng nhận đăng ký kinh doanh;
c) Giấy tờ chứng minh đáp ứng yêu cầu quy định tại điểm a và điểm b khoản 2 Điều 14 hoặc điểm a khoản 2 Điều 15 của Luật này.
3. Trong thời hạn hai mươi ngày, kể từ ngày nhận đủ hồ sơ hợp lệ quy định tại khoản 2 Điều này, cơ quan nhà nước có thẩm quyền có trách nhiệm cấp Giấy chứng nhận, Giấy phép cho tổ chức, cá nhân; trường hợp không cấp thì phải trả lời bằng văn bản và nêu rõ lý do.
4. Tổ chức, cá nhân đề nghị cấp Giấy chứng nhận, Giấy phép phải nộp lệ phí theo quy định của pháp luật.
1. Giấy chứng nhận, Giấy phép gồm các nội dung chủ yếu sau đây:
a) Tên, địa chỉ cơ sở sản xuất, kinh doanh hóa chất;
b) Địa điểm sản xuất, kinh doanh hóa chất;
c) Loại hình, quy mô, chủng loại hóa chất sản xuất, kinh doanh;
d) Nghĩa vụ của cơ sở được cấp Giấy chứng nhận, Giấy phép;
đ) Đối với Giấy phép còn phải có quy định về thời hạn của Giấy phép.
2. Thời hạn của Giấy phép do bộ quản lý ngành, lĩnh vực quy định phù hợp với loại hình, quy mô và đặc thù của hóa chất thuộc Danh mục hóa chất hạn chế sản xuất, kinh doanh.
1. Trường hợp mở rộng sản xuất, kinh doanh hóa chất vượt quá điều kiện của Giấy chứng nhận, quy định của Giấy phép đã được cấp thì trước khi thực hiện, tổ chức, cá nhân phải làm thủ tục bổ sung Giấy chứng nhận, Giấy phép cho phù hợp với quy mô mới. Thủ tục bổ sung Giấy chứng nhận, Giấy phép được thực hiện như thủ tục đề nghị cấp mới Giấy chứng nhận, Giấy phép.
2. Tổ chức, cá nhân bị thu hồi Giấy chứng nhận, Giấy phép trong các trường hợp sau đây:
a) Giả mạo hồ sơ đề nghị cấp phép;
b) Không còn đáp ứng đủ các điều kiện để được cấp phép;
c) Vi phạm quy định trong Giấy chứng nhận, Giấy phép mà không khắc phục trong thời hạn quy định của cơ quan có thẩm quyền;
d) Cho thuê, mượn Giấy phép; tự ý sửa đổi nội dung Giấy chứng nhận, Giấy phép;
đ) Vi phạm nghiêm trọng các quy định của Luật này;
e) Chấm dứt hoạt động sản xuất, kinh doanh hóa chất.
3. Tổ chức, cá nhân đề nghị bổ sung Giấy chứng nhận, Giấy phép phải nộp lệ phí theo quy định của pháp luật.
1. Hóa chất cấm là hóa chất đặc biệt nguy hiểm thuộc Danh mục hóa chất cấm do Chính phủ quy định.
2. Tổ chức, cá nhân không được phép sản xuất, kinh doanh, vận chuyển, cất giữ, sử dụng hóa chất thuộc Danh mục hóa chất cấm, trừ trường hợp quy định tại khoản 3 Điều này.
3. Trong trường hợp đặc biệt để phục vụ mục đích nghiên cứu khoa học, bảo đảm quốc phòng, an ninh, phòng, chống dịch bệnh, việc sản xuất, nhập khẩu, sử dụng hóa chất thuộc Danh mục hóa chất cấm phải được Thủ tướng Chính phủ cho phép.
4. Tổ chức, cá nhân được phép sản xuất, nhập khẩu, sử dụng hóa chất thuộc Danh mục hóa chất cấm phải quản lý nghiêm ngặt số lượng; bảo đảm không để xảy ra thất thoát, sự cố; báo cáo định kỳ theo quy định tại Điều 52 của Luật này.
5. Bộ Công thương chủ trì, phối hợp với các bộ, ngành lập Danh mục hóa chất cấm trình Chính phủ ban hành.
1. Tổ chức, cá nhân vận chuyển hóa chất nguy hiểm phải tuân thủ các quy định về vận chuyển hàng nguy hiểm của pháp luật về giao thông đường bộ, đường thủy nội địa, đường sắt, hàng không, hàng hải và các quy định khác của pháp luật có liên quan.
2. Trường hợp xảy ra sự cố trong quá trình vận chuyển, người điều khiển phương tiện, chủ hàng, chủ phương tiện có trách nhiệm áp dụng các biện pháp cần thiết để hạn chế hậu quả, khắc phục sự cố, đồng thời thông báo cho Ủy ban nhân dân và cơ quan có liên quan nơi gần nhất.
Tổ chức, cá nhân sản xuất, kinh doanh cất giữ, bảo quản hóa chất nguy hiểm phải bảo đảm các yêu cầu sau đây:
1. Điều kiện về khoảng cách an toàn, yêu cầu kỹ thuật an toàn trong cất giữ, bảo quản hoá chất;
2. Có các cảnh báo cần thiết tại nơi cất giữ, bảo quản hóa chất nguy hiểm theo quy định tại điểm e khoản 1 Điều 12 của Luật này;
3. Có trang thiết bị, phương tiện ứng cứu sự cố phù hợp với các đặc tính nguy hiểm của hóa chất;
4. Có Biện pháp phòng ngừa, ứng phó sự cố hóa chất hoặc Kế hoạch phòng ngừa, ứng phó sự cố hóa chất theo quy định tại Chương VI của Luật này.
1. Địa điểm sản xuất, kho chứa hóa chất nguy hiểm của cơ sở sản xuất, kinh doanh hóa chất thuộc Danh mục quy định tại khoản 1 Điều 38 của Luật này phải bảo đảm khoảng cách an toàn đối với khu dân cư, công trình công cộng, di tích lịch sử, văn hóa, danh lam thắng cảnh, khu bảo tồn đa dạng sinh học, nguồn nước sinh hoạt.
2. Tổ chức, cá nhân không được xây dựng nhà ở và công trình khác trong phạm vi khoảng cách an toàn, trừ công trình chuyên dụng được cơ quan nhà nước có thẩm quyền cho phép.
3. Chính phủ quy định cụ thể về khoảng cách an toàn quy định tại Điều này.
1. Việc mua, bán hóa chất độc phải có phiếu kiểm soát, có xác nhận của bên mua, bên bán để làm cơ sở cho việc kiểm soát hóa chất độc lưu thông trên thị trường.
2. Phiếu kiểm soát mua, bán hóa chất độc bao gồm các thông tin về tên hóa chất, số lượng hóa chất, mục đích sử dụng; tên, chữ ký của người mua, người bán; địa chỉ, số Giấy chứng minh nhân dân của người đại diện bên mua và bên bán; ngày giao hàng.
3. Phiếu kiểm soát mua, bán hóa chất độc phải được lưu giữ tại bên bán, bên mua ít nhất năm năm và phải xuất trình khi cơ quan có thẩm quyền yêu cầu.
4. Bộ Công thương quy định mẫu phiếu kiểm soát mua, bán hóa chất độc.
Việc xuất khẩu, nhập khẩu, tạm nhập tái xuất, vận chuyển quá cảnh hóa chất phải tuân thủ các quy định của Luật này, các quy định khác của pháp luật có liên quan và điều ước quốc tế mà Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên.
1. Tổ chức, cá nhân sản xuất, kinh doanh hóa chất phải xử lý, thải bỏ hóa chất tồn dư, chất thải và dụng cụ chứa hóa chất theo quy định của pháp luật về bảo vệ môi trường.
2. Bộ Tài nguyên và Môi trường chủ trì, phối hợp với các bộ, ngành quy định việc xử lý, thải bỏ hóa chất tồn dư, chất thải và dụng cụ chứa hóa chất theo quy định của pháp luật về bảo vệ môi trường.
1. Quảng cáo hóa chất phải tuân thủ các quy định của pháp luật về quảng cáo.
2. Việc quảng cáo sản phẩm, hàng hóa có chứa hóa chất độc, hóa chất nguy hiểm phải kèm theo cảnh báo về đặc tính nguy hiểm, độc hại của hóa chất và chỉ dẫn phòng ngừa tác hại của sản phẩm, hàng hóa đó.
1. Tổ chức, cá nhân sản xuất, nhập khẩu hóa chất có nghĩa vụ phân loại, ghi nhãn hóa chất trước khi đưa hóa chất vào sử dụng, lưu thông trên thị trường.
2. Việc phân loại hóa chất được thực hiện theo quy tắc, hướng dẫn kỹ thuật của Hệ thống hài hoà toàn cầu về phân loại và ghi nhãn hóa chất.
3. Việc ghi nhãn đối với các hóa chất được thực hiện theo quy định của pháp luật về nhãn hàng hoá.
4. Việc ghi nhãn đối với hoá chất nguy hiểm được thực hiện theo quy định của pháp luật về nhãn hàng hóa và hướng dẫn của Hệ thống hài hoà toàn cầu về phân loại và ghi nhãn hóa chất.
5. Bộ Công thương hướng dẫn, quản lý việc phân loại, ghi nhãn hóa chất theo Hệ thống hài hoà toàn cầu về phân loại và ghi nhãn hóa chất và xác định lộ trình áp dụng các quy định về phân loại và ghi nhãn đối với chất, hỗn hợp chất.
1. Bao gói hóa chất lưu thông trên thị trường phải bảo đảm các yêu cầu sau đây:
a) Đáp ứng yêu cầu về phân loại, ghi nhãn hóa chất quy định tại Điều 27 của Luật này;
b) Không rò rỉ, phát tán hóa chất ra ngoài trong vận chuyển, bảo quản, cất giữ;
c) Không bị hóa chất chứa bên trong ăn mòn, phá huỷ;
d) Tuân thủ các quy chuẩn kỹ thuật về bao gói do cơ quan có thẩm quyền ban hành hoặc tiêu chuẩn quốc tế được cơ quan nhà nước có thẩm quyền công bố áp dụng.
2. Bộ quản lý ngành, lĩnh vực quy định về quy cách, vật liệu và các yêu cầu kiểm tra, kiểm định bao gói cho từng loại hóa chất.
1. Hoá chất nguy hiểm bao gồm chất nguy hiểm, hỗn hợp chất có hàm lượng chất nguy hiểm trên mức quy định. Hoá chất nguy hiểm phải được lập phiếu an toàn hóa chất.
2. Tổ chức, cá nhân sản xuất, nhập khẩu hóa chất nguy hiểm trước khi đưa vào sử dụng, lưu thông trên thị trường phải lập phiếu an toàn hóa chất.
3. Phiếu an toàn hóa chất bao gồm các nội dung sau đây:
a) Nhận dạng hóa chất;
b) Nhận dạng đặc tính nguy hiểm của hóa chất;
c) Thông tin về thành phần các chất;
d) Đặc tính lý, hóa của hóa chất;
đ) Mức độ ổn định và khả năng hoạt động của hóa chất;
e) Thông tin về độc tính;
g) Thông tin về sinh thái;
h) Biện pháp sơ cứu về y tế;
i) Biện pháp xử lý khi có hoả hoạn;
k) Biện pháp phòng ngừa, ứng phó khi có sự cố;
l) Yêu cầu về cất giữ;
m) Tác động lên người và yêu cầu về thiết bị bảo vệ cá nhân;
n) Yêu cầu trong việc thải bỏ;
o) Yêu cầu trong vận chuyển;
p) Quy chuẩn kỹ thuật và quy định pháp luật phải tuân thủ;
q) Các thông tin cần thiết khác.
4. Chính phủ quy định hàm lượng chất nguy hiểm trong hỗn hợp chất phải lập phiếu an toàn hóa chất quy định tại khoản 1 Điều này.
1. Tổ chức, cá nhân sử dụng hóa chất để sản xuất sản phẩm, hàng hóa khác có quyền yêu cầu bên cung cấp hóa chất cung cấp đầy đủ, chính xác thông tin liên quan đến đặc điểm, tính chất, thông tin phân loại, ghi nhãn và phiếu an toàn hóa chất đối với hóa chất nguy hiểm.
2. Tổ chức, cá nhân sử dụng hóa chất để sản xuất sản phẩm, hàng hóa khác có các nghĩa vụ sau đây:
a) Tuân thủ các quy định về quản lý an toàn hóa chất;
b) Có người chuyên trách về an toàn hóa chất; đáp ứng yêu cầu về cơ sở vật chất - kỹ thuật, năng lực chuyên môn về an toàn hóa chất, phù hợp với khối lượng, đặc tính của hóa chất;
c) Định kỳ đào tạo, huấn luyện an toàn hóa chất cho người lao động;
d) Cung cấp đầy đủ, kịp thời, chính xác thông tin, hướng dẫn thực hiện an toàn hóa chất cho người lao động, người quản lý trực tiếp;
đ) Xây dựng Biện pháp phòng ngừa, ứng phó sự cố hóa chất, Kế hoạch phòng ngừa, ứng phó sự cố hóa chất theo quy định tại Chương VI của Luật này;
e) Cập nhập, lưu trữ thông tin về các hóa chất sử dụng theo quy định tại Điều 53 của Luật này;
g) Thông báo kịp thời cho tổ chức, cá nhân cung cấp hóa chất, cơ quan quản lý hóa chất khi phát hiện các biểu hiện về đặc tính nguy hiểm mới của hóa chất sử dụng;
h) Chấp hành các yêu cầu kiểm tra của cơ quan nhà nước có thẩm quyền trong việc thực hiện các quy định về an toàn hóa chất.
1. Tổ chức, cá nhân sử dụng hóa chất nguy hiểm để sản xuất sản phẩm, hàng hóa khác, ngoài quyền và nghĩa vụ quy định tại Điều 30 của Luật này, còn phải thực hiện các nghĩa vụ sau đây:
a) Bảo đảm các điều kiện an toàn cho con người và môi trường trong quá trình sử dụng, bảo quản hóa chất nguy hiểm;
b) Tuân thủ các quy chuẩn kỹ thuật về hàm lượng, tiêu chuẩn chất lượng của hóa chất nguy hiểm trong sản xuất sản phẩm, hàng hóa khác;
c) Không được sử dụng các hóa chất độc có đặc tính quy định tại các điểm h, i, k hoặc l khoản 4 Điều 4 của Luật này trong các sản phẩm thực phẩm, mỹ phẩm, phụ gia thực phẩm, chất bảo quản thực phẩm;
d) Bố trí hệ thống báo hiệu phù hợp với mức độ nguy hiểm của hóa chất tại khu vực sử dụng, cất giữ hóa chất nguy hiểm; trường hợp hóa chất có nhiều đặc tính nguy hiểm khác nhau thì biểu trưng cảnh báo phải thể hiện đầy đủ các đặc tính nguy hiểm đó;
đ) Cung cấp đầy đủ, kịp thời, chính xác thông tin, hướng dẫn thực hiện an toàn hóa chất cho người trực tiếp sử dụng, bảo quản, vận chuyển hóa chất, người quản lý sản xuất hóa chất;
e) Thực hiện các quy định của pháp luật về xử lý, thải bỏ hóa chất nguy hiểm và dụng cụ chứa hóa chất đó;
2. Bộ quản lý ngành, lĩnh vực ban hành và quản lý hoạt động hóa chất thuộc Danh mục hóa chất không được sử dụng để sản xuất sản phẩm, hàng hóa thuộc lĩnh vực quản lý của mình theo quy định của Luật này và các quy định khác của pháp luật có liên quan.
1. Tổ chức, cá nhân sử dụng hóa chất cho mục đích tiêu dùng có quyền yêu cầu cung cấp đầy đủ thông tin về các đặc tính nguy hiểm của hóa chất và các yêu cầu bảo đảm an toàn; được nhà cung cấp bồi thường thiệt hại trong quá trình sử dụng hóa chất do các thông tin sai lệch của nhà cung cấp.
2. Tổ chức, cá nhân sử dụng hóa chất cho mục đích tiêu dùng có nghĩa vụ thực hiện đúng chỉ dẫn kỹ thuật đi kèm với hóa chất hoặc thể hiện trên nhãn hóa chất; bảo đảm an toàn cho bản thân và cộng đồng.
1. Người đứng đầu cơ sở thí nghiệm, nghiên cứu khoa học và người trực tiếp sử dụng hóa chất để thực hiện thí nghiệm, nghiên cứu khoa học phải thực hiện đầy đủ các quy định về an toàn hóa chất theo quy định của Luật này và các quy định khác của pháp luật có liên quan.
2. Phòng thí nghiệm phải có trang thiết bị an toàn và trang thiết bị bảo hộ lao động phù hợp với tính chất nguy hiểm của hóa chất.
3. Dụng cụ chứa hóa chất trong phòng thí nghiệm và trong kho chứa phải có nhãn phù hợp yêu cầu về nhãn hóa chất theo quy định của pháp luật.
4. Phòng thí nghiệm phải lập hồ sơ theo dõi hóa chất để cập nhật định kỳ tình hình sử dụng hóa chất; lưu giữ phiếu an toàn hóa chất.
5. Bộ Khoa học và Công nghệ quy định về việc sử dụng hóa chất để thực hiện thí nghiệm, nghiên cứu khoa học.
1. Tổ chức, cá nhân sử dụng hóa chất nguy hiểm để sản xuất sản phẩm, hàng hóa phải tuân thủ các quy định về cất giữ, bảo quản hóa chất nguy hiểm tại Điều 21 của Luật này.
2. Tổ chức, cá nhân sử dụng hóa chất nguy hiểm cho mục đích tiêu dùng phải tuân thủ hướng dẫn của nhà sản xuất thể hiện trên nhãn, bao bì hoặc trong hướng dẫn sử dụng kèm theo sản phẩm hóa chất.
1. Tổ chức, cá nhân sử dụng hóa chất để sản xuất sản phẩm, hàng hóa, sử dụng hóa chất trong thí nghiệm, nghiên cứu khoa học, tiêu dùng phải xử lý, thải bỏ hóa chất tồn dư, chất thải và dụng cụ chứa hóa chất theo quy định của pháp luật về bảo vệ môi trường.
2. Hoá chất bị thải bỏ phải được xử lý bằng công nghệ phù hợp, đáp ứng tiêu chuẩn bảo vệ môi trường.
3. Hóa chất được sử dụng cho mục đích tiêu dùng trong hộ gia đình, cá nhân phải được thải bỏ theo khuyến nghị của nhà sản xuất, quy định pháp luật về bảo vệ môi trường, bảo đảm an toàn cho người và môi trường.
1. Tổ chức, cá nhân hoạt động hóa chất phải tuân thủ các quy chuẩn kỹ thuật về an toàn; định kỳ đào tạo, huấn luyện về an toàn hóa chất cho người lao động.
2. Chủ đầu tư dự án hoạt động hóa chất không thuộc Danh mục quy định tại khoản 1 Điều 38 của Luật này phải xây dựng Biện pháp phòng ngừa, ứng phó sự cố hóa chất phù hợp với quy mô, điều kiện sản xuất và đặc tính của hóa chất.
3. Biện pháp phòng ngừa, ứng phó sự cố hóa chất bao gồm các nội dung cơ bản sau đây:
a) Xác định, khoanh vùng và lập kế hoạch kiểm tra thường xuyên các điểm có nguy cơ xảy ra sự cố hóa chất cao;
b) Các biện pháp, trang thiết bị và lực lượng ứng phó tại chỗ;
c) Phương án phối hợp với các lực lượng bên ngoài để ứng phó sự cố hóa chất.
4. Chủ đầu tư dự án hoạt động hóa chất thuộc Danh mục quy định tại khoản 1 Điều 38 của Luật này phải xây dựng Kế hoạch phòng ngừa, ứng phó sự cố hóa chất và trình cơ quan quản lý nhà nước có thẩm quyền phê duyệt; chỉ được đưa dự án vào hoạt động sau khi Kế hoạch phòng ngừa, ứng phó sự cố hóa chất đã được phê duyệt. Trường hợp mở rộng quy mô, thay đổi phạm vi hoạt động phải sửa đổi, bổ sung Kế hoạch phòng ngừa, ứng phó sự cố hóa chất và trình cơ quan có thẩm quyền phê duyệt.
1. Tổ chức, cá nhân hoạt động hóa chất có trách nhiệm xây dựng năng lực ứng phó tại chỗ, có trang thiết bị phù hợp với quy mô và đặc tính của hóa chất.
2. Lực lượng ứng phó tại chỗ phải được thường xuyên huấn luyện, thực hành các phương án ứng phó sự cố hóa chất.
3. Lực lượng phòng cháy, chữa cháy, lực lượng khác và cơ quan quản lý nhà nước có liên quan có trách nhiệm tăng cường năng lực, trang thiết bị để ứng phó sự cố hóa chất.
1. Căn cứ vào đặc tính nguy hiểm của hóa chất, quy mô sản xuất, kinh doanh, sử dụng hóa chất, Chính phủ ban hành Danh mục hóa chất nguy hiểm phải xây dựng Kế hoạch phòng ngừa, ứng phó sự cố hóa chất.
2. Bộ Công thương chủ trì, phối hợp với các bộ, ngành có liên quan xây dựng Danh mục quy định tại khoản 1 Điều này trình Chính phủ ban hành.
1. Thông tin về đặc tính, khối lượng, công nghệ sản xuất, sử dụng hóa chất, đặc điểm điều kiện địa lý, dân cư, môi trường nơi có hoạt động hóa chất.
2. Dự báo các nguy cơ gây ra sự cố và kế hoạch kiểm tra, giám sát các nguồn nguy cơ sự cố hóa chất.
3. Dự báo tình huống xảy ra sự cố hóa chất và các giải pháp phòng ngừa.
4. Năng lực ứng phó sự cố hóa chất bao gồm trang thiết bị, nhân lực, kế hoạch phối hợp với các lực lượng tại địa phương, kế hoạch sơ tán người, tài sản.
5. Phương án khắc phục hậu quả sự cố hóa chất theo quy định của pháp luật về bảo vệ môi trường và các quy định khác của pháp luật có liên quan.
1. Tổ chức, cá nhân đề nghị phê duyệt Kế hoạch phòng ngừa, ứng phó sự cố hóa chất nộp hồ sơ cho cơ quan có thẩm quyền để phê duyệt.
2. Hồ sơ đề nghị phê duyệt Kế hoạch phòng ngừa, ứng phó sự cố hóa chất bao gồm:
a) Đơn đề nghị phê duyệt theo mẫu quy định;
b) Kế hoạch phòng ngừa, ứng phó sự cố hóa chất quy định tại Điều 39 của Luật này.
3. Cơ quan có thẩm quyền phê duyệt Kế hoạch phòng ngừa, ứng phó sự cố hóa chất có trách nhiệm tổ chức thẩm định, phê duyệt trong thời hạn ba mươi ngày, kể từ ngày nhận đủ hồ sơ hợp lệ.
4. Tổ chức, cá nhân đề nghị phê duyệt Kế hoạch phòng ngừa, ứng phó sự cố hóa chất phải nộp phí theo quy định của pháp luật.
Bộ quản lý ngành, lĩnh vực chủ trì, phối hợp với cơ quan quản lý nhà nước về phòng cháy, chữa cháy, Bộ Công thương và cơ quan quản lý nhà nước có liên quan tổ chức thẩm định, phê duyệt Kế hoạch phòng ngừa, ứng phó sự cố hóa chất.
1. Tổ chức, cá nhân hoạt động hóa chất thuộc Danh mục quy định tại khoản 1 Điều 38 của Luật này phải cung cấp cho Ủy ban nhân dân các cấp và cơ quan phòng cháy, chữa cháy địa phương nội dung quy định tại các khoản 3, 4 và 5 Điều 39 của Luật này để phối hợp ứng phó khi xảy ra sự cố hóa chất; trường hợp cơ sở hoạt động hóa chất nằm trong khu công nghiệp, khu chế xuất, khu kinh tế thì còn phải cung cấp nội dung nêu trên cho Ban quản lý khu công nghiệp, khu chế xuất, khu kinh tế.
2. Khi xảy ra sự cố hóa chất, tổ chức, cá nhân hoạt động hóa chất phải áp dụng kịp thời Biện pháp phòng ngừa, ứng phó sự cố hóa chất, Kế hoạch phòng ngừa, ứng phó sự cố hóa chất và kịp thời thông báo cho lực lượng phòng cháy, chữa cháy, cơ quan, đơn vị có liên quan, chính quyền địa phương nơi gần nhất để phối hợp ứng phó và khắc phục sự cố.
3. Khi xảy ra sự cố hóa chất nghiêm trọng, trách nhiệm phối hợp ứng phó được quy định như sau:
a) Cơ sở hoạt động hóa chất phải kịp thời thực hiện các biện pháp ứng phó quy định tại khoản 2 Điều này;
b) Ủy ban nhân dân xã, phường, thị trấn nơi xảy ra sự cố hóa chất có trách nhiệm kịp thời huy động lực lượng tại chỗ và áp dụng các biện pháp cần thiết khác, đồng thời báo cáo Ủy ban nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh để điều động lực lượng thực hiện các biện pháp ứng cứu, sơ tán người, tài sản và báo cáo ngay Chủ tịch Ủy ban nhân dân cấp tỉnh;
c) Chủ tịch Ủy ban nhân dân cấp tỉnh trực tiếp chỉ đạo ứng phó, khắc phục hậu quả sự cố hóa chất;
d) Bộ quản lý ngành, lĩnh vực và Bộ Công thương có trách nhiệm kịp thời phối hợp với Uỷ ban nhân dân cấp tỉnh nơi xảy sự cố để ứng phó, khắc phục hậu quả sự cố hóa chất;
đ) Tổ chức, cá nhân có trách nhiệm chấp hành sự huy động người, tài sản của cơ quan nhà nước có thẩm quyền để ứng phó, khắc phục hậu quả sự cố hóa chất theo quy định của pháp luật;
e) Chủ tịch Ủy ban nhân dân cấp tỉnh nơi xảy ra sự cố phải thông báo ngay cho Ủy ban cứu hộ, cứu nạn quốc gia và các cơ quan hữu quan để phối hợp xử lý theo quy định của pháp luật.
1. Tổ chức, cá nhân nhập khẩu hóa chất phải khai báo hóa chất với Bộ Công thương; tổ chức, cá nhân sản xuất hóa chất phải khai báo hóa chất với cơ quan chuyên môn quản lý hoạt động hóa chất của Uỷ ban nhân dân cấp tỉnh.
2. Nội dung khai báo hóa chất bao gồm:
a) Tên, địa chỉ tổ chức, cá nhân sản xuất, nhập khẩu hóa chất;
b) Tên, số lượng và nguồn gốc xuất xứ hóa chất.
3. Hằng năm, cơ quan chuyên môn quản lý hoạt động hóa chất của Uỷ ban nhân dân cấp tỉnh có trách nhiệm báo cáo Bộ Công thương về các thông tin khai báo hóa chất tại địa phương.
4. Chính phủ quy định Danh mục hóa chất phải khai báo. Bộ Công thương quy định biểu mẫu khai báo hóa chất quy định tại Điều này.
1. Hoá chất mới chỉ được đưa vào sử dụng, lưu thông trên thị trường sau khi được đăng ký tại cơ quan nhà nước có thẩm quyền.
2. Hồ sơ đăng ký hóa chất mới, trừ trường hợp quy định tại khoản 3 Điều này bao gồm:
a) Đơn đăng ký hóa chất mới;
b) Tên gọi hóa chất mới theo hướng dẫn của Hiệp hội hóa học cơ bản và ứng dụng quốc tế (IUPAC), công thức hóa học của hóa chất;
c) Thông tin về tính chất lý, hoá và đặc tính nguy hiểm của hóa chất được tổ chức đánh giá hóa chất mới quy định tại Điều 45 của Luật này xác nhận.
3. Hồ sơ đăng ký hóa chất mới sử dụng cho mục đích nghiên cứu khoa học, bảo vệ an ninh, trật tự an toàn xã hội bao gồm:
a) Các tài liệu quy định tại điểm a và điểm b khoản 2 Điều này;
b) Thông tin về mục đích sử dụng, thời gian sử dụng hóa chất.
4. Bộ Công thương quy định trình tự, thủ tục và tổ chức thực hiện việc đăng ký hóa chất mới.
1. Tổ chức đánh giá hóa chất mới là tổ chức có đủ năng lực để đánh giá hóa chất mới, được cơ quan nhà nước có thẩm quyền chỉ định hoặc các tổ chức thử nghiệm hợp chuẩn của nước ngoài được Tổ chức hợp tác và phát triển kinh tế (OECD) thừa nhận về đánh giá hóa chất.
2. Bộ trưởng Bộ Công thương quy định điều kiện và chỉ định tổ chức đánh giá hóa chất mới tại Việt Nam.
1. Bộ Công thương có trách nhiệm theo dõi, quản lý hoạt động liên quan đến hóa chất mới.
2. Trong thời hạn năm năm, kể từ ngày hóa chất mới được đăng ký, hằng năm, trước ngày 31 tháng 01 của năm tiếp theo, tổ chức, cá nhân có hoạt động hóa chất liên quan đến hóa chất mới phải báo cáo bộ quản lý ngành, lĩnh vực và Bộ Công thương.
3. Bộ Công thương quy định cụ thể về nội dung, biểu mẫu báo cáo.
1. Bộ quản lý ngành, lĩnh vực có trách nhiệm cung cấp các thông tin về hóa chất độc, hóa chất nguy hiểm thuộc phạm vi quản lý của mình theo yêu cầu để phục vụ cứu chữa, điều trị cho người, động vật, thực vật chịu ảnh hưởng của sự cố hóa chất.
2. Bộ Công thương phối hợp với Bộ Y tế, Bộ Tài nguyên và Môi trường tổ chức tuyên truyền phòng, chống ảnh hưởng của hóa chất độc, hóa chất nguy hiểm.
1. Khi phát hiện dấu hiệu đặc tính nguy hiểm mới của hóa chất, tổ chức, cá nhân hoạt động hóa chất có trách nhiệm kịp thời báo cáo Bộ Công thương và thông báo cho tổ chức, cá nhân sản xuất, nhập khẩu hóa chất đó biết.
2. Tổ chức, cá nhân sản xuất, nhập khẩu hóa chất có dấu hiệu đặc tính nguy hiểm mới phải báo cáo Bộ Công thương để xem xét, thu thập thêm bằng chứng khoa học về đặc tính nguy hiểm mới.
3. Bộ Công thương có trách nhiệm lập hồ sơ về hóa chất có dấu hiệu đặc tính nguy hiểm mới để tiến hành các biện pháp thu thập bằng chứng khoa học, thử nghiệm bổ sung để xác định đặc tính nguy hiểm mới của hóa chất.
4. Khi có đủ bằng chứng xác định đặc tính nguy hiểm mới của hóa chất, Bộ Công thương quyết định áp dụng biện pháp quản lý thích hợp đối với hóa chất đó.
5. Khi đã có kết luận chính thức của cơ quan nhà nước có thẩm quyền về đặc tính nguy hiểm mới của hóa chất, tổ chức, cá nhân sản xuất, nhập khẩu hóa chất đó có trách nhiệm sửa đổi, bổ sung nhãn và phiếu an toàn hóa chất phù hợp với các đặc tính nguy hiểm mới.
Tổ chức, cá nhân hoạt động hóa chất có nghĩa vụ cung cấp đầy đủ, kịp thời, chính xác thông tin theo yêu cầu của cơ quan có thẩm quyền trong các trường hợp sau đây:
1. Sự cố hóa chất xảy ra trong cơ sở hoạt động hóa chất;
2. Phục vụ yêu cầu phòng ngừa thảm họa tự nhiên có khả năng gây ra sự cố hóa chất của cơ sở hoạt động hóa chất;
3. Phục vụ điều tra, khảo sát để xây dựng chiến lược, quy hoạch, kế hoạch phát triển vùng, ngành công nghiệp hóa chất;
4. Phục vụ công tác thanh tra, kiểm tra trong hoạt động hóa chất.
1. Cơ quan, người tiếp nhận khai báo, đăng ký, báo cáo hóa chất có trách nhiệm giữ bí mật thông tin bảo mật theo yêu cầu của bên khai báo, đăng ký, báo cáo, trừ trường hợp quy định tại khoản 1 Điều 51 của Luật này.
2. Thông tin bảo mật của bên khai báo, đăng ký, báo cáo bao gồm:
a) Tên và số lượng hóa chất được sản xuất, nhập khẩu, kinh doanh;
b) Thông tin có liên quan đến bí quyết công nghệ, bí mật thương mại.
1. Cơ quan, người tiếp nhận khai báo, đăng ký, báo cáo hóa chất có trách nhiệm cung cấp thông tin bảo mật quy định tại Điều 50 của Luật này khi có yêu cầu của cơ quan nhà nước có thẩm quyền.
2. Cơ quan, người tiếp nhận khai báo, đăng ký, báo cáo hóa chất có trách nhiệm giữ bí mật thông tin bảo mật theo quy định của pháp luật.
1. Hằng năm, trước ngày 31 tháng 01, tổ chức, cá nhân sản xuất, nhập khẩu, sử dụng hóa chất thuộc Danh mục hóa chất cấm có trách nhiệm gửi báo cáo sản xuất, nhập khẩu, sử dụng hóa chất thuộc Danh mục hóa chất cấm của năm trước đến bộ quản lý ngành, lĩnh vực và Bộ Công thương.
2. Báo cáo sản xuất, nhập khẩu, sử dụng hóa chất thuộc Danh mục hóa chất cấm phải có các nội dung chủ yếu sau đây:
a) Tên hóa chất, mục đích sử dụng, khối lượng hóa chất được sản xuất, nhập khẩu, sử dụng;
b) Lượng nhập, xuất, tồn kho và vị trí cất giữ;
c) Việc thực hiện các biện pháp an toàn hóa chất;
d) Các thông tin khác nếu được yêu cầu.
1. Tổ chức, cá nhân hoạt động hóa chất phải thiết lập, thường xuyên cập nhật và lưu trữ thông tin về hóa chất nguy hiểm trong hoạt động hóa chất của mình trong thời hạn ít nhất ba năm, kể từ ngày kết thúc hoạt động với hóa chất đó.
2. Nội dung thông tin cần lưu trữ bao gồm tên khoa học, tên thương mại của hóa chất; khối lượng sản xuất, nhập khẩu, sử dụng, thải bỏ; mục đích sử dụng, phân nhóm nguy hiểm theo Hệ thống hài hoà toàn cầu về phân loại và ghi nhãn hóa chất; thông tin liên quan đến sự cố hóa chất, an toàn hóa chất tại cơ sở.
3. Trong trường hợp cơ sở hoạt động hóa chất có nhiều chi nhánh thì dữ liệu thông tin hóa chất nguy hiểm phải bao gồm tất cả các thông tin có liên quan của cơ sở, các chi nhánh.
Tổ chức, cá nhân hoạt động hóa chất, liên quan đến hoạt động hóa chất có trách nhiệm thực hiện đầy đủ các quy định về an toàn hóa chất theo quy định của Luật này, pháp luật về bảo vệ môi trường, bảo vệ sức khỏe nhân dân, an toàn lao động và các quy định khác của pháp luật có liên quan.
1. Tổ chức, cá nhân nơi có cơ sở hoạt động hóa chất có các quyền sau đây:
a) Được cung cấp các thông tin liên quan đến an toàn hóa chất của cơ sở;
b) Yêu cầu thực hiện các biện pháp bảo vệ môi trường, bảo vệ sức khỏe cộng đồng;
c) Được bồi thường thiệt hại về sức khoẻ, tính mạng, tài sản do hoạt động hóa chất gây ra theo quy định của pháp luật;
d) Kiến nghị cơ quan nhà nước có thẩm quyền đình chỉ hoạt động của tổ chức, cá nhân có hành vi vi phạm các quy định của pháp luật về an toàn hóa chất;
đ) Tham gia ý kiến về biện pháp bảo vệ môi trường và Kế hoạch phòng ngừa, ứng phó sự cố hóa chất đối với các dự án đầu tư cơ sở sản xuất, cất giữ hóa chất nguy hiểm tại địa phương.
2. Tổ chức, cá nhân nơi có cơ sở hoạt động hóa chất có các nghĩa vụ sau đây:
a) Báo cáo kịp thời với cơ quan nhà nước có thẩm quyền khi phát hiện hành vi vi phạm quy định của pháp luật về an toàn hóa chất;
b) Tạo điều kiện thuận lợi để cơ quan, tổ chức hữu quan khắc phục sự cố hóa chất.
Tổ chức, cá nhân hoạt động hóa chất có trách nhiệm phối hợp với chính quyền địa phương phổ biến công khai cho cộng đồng dân cư nơi có cơ sở hoạt động hóa chất thông tin về an toàn hóa chất sau đây:
1. Biện pháp bảo đảm an toàn, bảo vệ sức khoẻ con người và môi trường theo quy định của Luật này và pháp luật về bảo vệ môi trường;
2. Nội dung cơ bản của Kế hoạch phòng ngừa, ứng phó sự cố hóa chất quy định tại Điều 39, trừ các thông tin bảo mật quy định tại Điều 50 của Luật này.
1. Uỷ ban nhân dân cấp tỉnh có trách nhiệm thống kê, phát hiện và thông báo cho Bộ Tài nguyên và Môi trường về địa điểm, số lượng hóa chất độc tồn dư không rõ nguồn gốc, hóa chất, sản phẩm chứa hóa chất độc bị tịch thu tại địa phương mình.
2. Bộ Tài nguyên và Môi trường phối hợp với Bộ Công thương và các cơ quan có liên quan, Uỷ ban nhân dân cấp tỉnh xây dựng phương án xử lý hóa chất độc tồn dư không rõ nguồn gốc, hóa chất, sản phẩm chứa hóa chất độc bị tịch thu.
3. Uỷ ban nhân dân cấp tỉnh tổ chức thực hiện phương án xử lý hóa chất độc tồn dư không rõ nguồn gốc, hóa chất, sản phẩm chứa hóa chất độc bị tịch thu; Bộ Tài nguyên và Môi trường kiểm tra, theo dõi việc xử lý theo quy định của Luật này và pháp luật về bảo vệ môi trường.
4. Tổ chức, cá nhân có hóa chất độc tồn dư, sản phẩm chứa hóa chất độc bị tịch thu chịu toàn bộ chi phí xử lý.
5. Trường hợp hóa chất độc không rõ nguồn gốc, hóa chất độc không xác định được chủ sở hữu hoặc hóa chất độc bị tịch thu nhưng chủ sở hữu không có khả năng tài chính để xử lý thì chi phí xử lý được lấy từ ngân sách nhà nước.
1. Bộ Tài nguyên và Môi trường chủ trì, phối hợp với Bộ Quốc phòng và các bộ, ngành, địa phương có liên quan xác định nguồn, phạm vi tác động của hóa chất độc tồn dư của chiến tranh; xây dựng kế hoạch xử lý trình Thủ tướng Chính phủ phê duyệt.
2. Thủ tướng Chính phủ chỉ đạo các bộ, ngành, địa phương có liên quan thực hiện kế hoạch xử lý hóa chất độc tồn dư của chiến tranh.
1. Nhà nước khuyến khích các doanh nghiệp kinh doanh bảo hiểm thực hiện hoạt động bảo hiểm đối với trách nhiệm bồi thường thiệt hại do hoạt động hóa chất gây ra.
2. Nhà nước khuyến khích tổ chức, cá nhân hoạt động sản xuất, kinh doanh hóa chất mua bảo hiểm trách nhiệm bồi thường thiệt hại trong hoạt động hóa chất.
3. Căn cứ vào tình hình phát triển kinh tế - xã hội, yêu cầu bảo đảm an toàn hoạt động hóa chất theo quy định của Luật kinh doanh bảo hiểm, Chính phủ trình Ủy ban thường vụ Quốc hội xem xét, quy định bảo hiểm bắt buộc đối với hoạt động hóa chất nguy hiểm, hóa chất độc.
1. Chính phủ thống nhất quản lý nhà nước về hoạt động hóa chất trong phạm vi cả nước.
2. Bộ Công thương chịu trách nhiệm trước Chính phủ thực hiện quản lý nhà nước về hoạt động hóa chất.
3. Các bộ, cơ quan ngang bộ trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm phối hợp với Bộ Công thương thực hiện nhiệm vụ quản lý nhà nước về hoạt động hóa chất theo sự phân công của Chính phủ.
4. Ủy ban nhân dân các cấp thực hiện việc quản lý nhà nước về hoạt động hóa chất trong phạm vi địa phương mình theo phân cấp của Chính phủ.
1. Bộ Công thương trong phạm vi nhiệm vụ, quyền hạn của mình thực hiện các nội dung quản lý nhà nước về hoạt động hóa chất sau đây:
a) Ban hành theo thẩm quyền hoặc trình Chính phủ ban hành các văn bản quy phạm pháp luật, chiến lược, quy hoạch, kế hoạch phát triển công nghiệp hóa chất; quy chuẩn kỹ thuật về an toàn hóa chất;
b) Chủ trì, phối hợp với các bộ, ngành xây dựng và trình Chính phủ ban hành Danh mục hóa chất quốc gia; Danh mục hóa chất sản xuất, kinh doanh có điều kiện; Danh mục hóa chất hạn chế sản xuất, kinh doanh; Danh mục hóa chất cấm; Danh mục hóa chất phải khai báo; Danh mục hóa chất nguy hiểm phải xây dựng Kế hoạch phòng ngừa, ứng phó sự cố hóa chất;
c) Quản lý hóa chất sử dụng trong công nghiệp, hóa chất là tiền chất sử dụng trong công nghiệp và hóa chất thuộc Công ước cấm phát triển, sản xuất, tàng trữ, sử dụng và phá hủy vũ khí hóa học; quản lý hóa chất sử dụng trong các sản phẩm công nghiệp tiêu dùng; ban hành Danh mục các hóa chất không được sử dụng trong các sản phẩm gia dụng, sản phẩm tiêu dùng, trừ các sản phẩm do Bộ Y tế, Bộ Nông nghiệp và Phát triển nông thôn quản lý;
d) Xây dựng Cơ sở dữ liệu hóa chất quốc gia;
đ) Thống nhất quản lý hoạt động phân loại, ghi nhãn hóa chất nguy hiểm; đăng ký, khai báo hóa chất; thông tin an toàn hóa chất;
e) Tổng hợp, thống kê tình hình thực hiện an toàn hóa chất trong phạm vi cả nước;
g) Hướng dẫn xây dựng, tổ chức việc thẩm định Kế hoạch phòng ngừa, ứng phó sự cố hóa chất; phối hợp với các cơ quan hữu quan trong việc phòng ngừa, ứng phó, khắc phục sự cố hóa chất;
h) Thực hiện hợp tác quốc tế trong hoạt động hóa chất và an toàn hóa chất;
i) Quy định cụ thể về điều kiện cơ sở vật chất - kỹ thuật, chuyên môn nghề nghiệp của các cơ sở hoạt động hóa chất thuộc phạm vi quản lý của Bộ Công thương;
k) Tham gia tuyên truyền, phổ biến, giáo dục pháp luật về hóa chất;
l) Thanh tra về hoạt động hóa chất; giải quyết khiếu nại, tố cáo liên quan đến hoạt động hóa chất;
m) Các nhiệm vụ khác liên quan đến hoạt động hóa chất được Chính phủ phân công.
2. Chính phủ quyết định thành lập và quy định chức năng, nhiệm vụ, cơ cấu tổ chức của cơ quan nhà nước quản lý về hoạt động hóa chất thuộc Bộ Công thương để giúp Bộ trưởng thực hiện nhiệm vụ quản lý nhà nước về hoạt động hóa chất.
1. Bộ Tài nguyên và Môi trường ban hành theo thẩm quyền hoặc trình cơ quan có thẩm quyền ban hành các quy định về bảo vệ môi trường liên quan đến hoạt động hóa chất; xử lý, thải bỏ hóa chất độc tồn dư, hóa chất độc tồn dư của chiến tranh, hóa chất độc không rõ nguồn gốc và hóa chất độc bị tịch thu.
2. Bộ Khoa học và Công nghệ ban hành, công bố tiêu chuẩn, quy chuẩn kỹ thuật về an toàn hóa chất theo thẩm quyền; trình cơ quan có thẩm quyền ban hành chính sách nghiên cứu, phát triển, áp dụng công nghệ phù hợp với việc sử dụng hóa chất ít nguy hiểm.
3. Bộ Giao thông Vận tải ban hành theo thẩm quyền hoặc trình cơ quan có thẩm quyền ban hành các quy định về vận chuyển hóa chất nguy hiểm bằng đường bộ, đường thuỷ nội địa, đường sắt, hàng không, hàng hải; xây dựng, bổ sung các quy chuẩn kỹ thuật về vận chuyển hóa chất nguy hiểm.
4. Bộ Y tế quản lý các hóa chất sử dụng để bào chế dược phẩm cho người, hóa chất sử dụng trong chất diệt khuẩn, diệt côn trùng trong gia dụng và y tế; phối hợp với các bộ, ngành quy định về vệ sinh an toàn lao động trong hoạt động hóa chất; phối hợp với Bộ Công thương xây dựng Danh mục hóa chất cấm, Danh mục hóa chất hạn chế sản xuất, kinh doanh trong lĩnh vực y tế trình Chính phủ ban hành; ban hành Danh mục hóa chất không được sử dụng, hạn chế sử dụng và được sử dụng trong lĩnh vực y tế, hóa chất sử dụng trong chất diệt khuẩn, diệt côn trùng trong gia dụng và y tế, dược phẩm và phụ gia thực phẩm.
5. Bộ Nông nghiệp và Phát triển nông thôn quản lý hóa chất sử dụng trong trồng trọt, chăn nuôi, nuôi trồng thuỷ sản, thú y, bảo vệ thực vật, bảo quản, chế biến nông sản, lâm sản, hải sản và thực phẩm; phối hợp với Bộ Công thương và các bộ, ngành có liên quan xây dựng Danh mục hóa chất cấm, Danh mục hóa chất hạn chế sản xuất, kinh doanh; ban hành Danh mục hóa chất không được sử dụng, hạn chế sử dụng và được sử dụng trong lĩnh vực nông nghiệp; hướng dẫn phân loại, ghi nhãn và xây dựng phiếu an toàn hóa chất đối với các loại thuốc bảo vệ thực vật.
6. Bộ Công an, Bộ Quốc phòng quản lý hóa chất, sản phẩm hóa chất trong lĩnh vực quốc phòng, an ninh.
7. Bộ Lao động, Thương binh và Xã hội ban hành theo thẩm quyền hoặc trình cơ quan có thẩm quyền ban hành các quy định về an toàn lao động, vệ sinh lao động cho người lao động tham gia hoạt động hóa chất; quản lý việc sử dụng hóa chất trong các cơ sở dạy nghề.
8. Bộ Giáo dục và Đào tạo quản lý việc sử dụng hóa chất trong nhà trường, cơ sở giáo dục khác thuộc hệ thống giáo dục quốc dân.
1. Uỷ ban nhân dân các cấp trong phạm vi nhiệm vụ, quyền hạn của mình thực hiện quản lý, thanh tra, kiểm tra, giải quyết khiếu nại, tố cáo, xử phạt vi phạm hành chính về hoạt động hóa chất tại địa phương theo phân cấp của Chính phủ, quy định của Luật này và các quy định khác của pháp luật có liên quan.
2. Uỷ ban nhân dân cấp tỉnh có cơ quan chuyên môn làm cơ quan đầu mối giúp Ủy ban thực hiện quản lý hoạt động hóa chất tại địa phương theo quy định của Chính phủ.
1. Bộ Công thương, các bộ, cơ quan ngang bộ có liên quan và Uỷ ban nhân dân các cấp thực hiện nhiệm vụ thanh tra về hoạt động hóa chất thuộc phạm vi quản lý được phân công, phân cấp.
2. Tổ chức, nhiệm vụ, quyền hạn của thanh tra về hóa chất thực hiện theo quy định của pháp luật về thanh tra.
1. Cơ quan, tổ chức, cá nhân có hành vi vi phạm các quy định của Luật này và các quy định khác của pháp luật có liên quan về hoạt động hóa chất thì tùy theo đối tượng, tính chất, mức độ vi phạm mà bị xử lý hành chính hoặc bị truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.
2. Cá nhân lợi dụng chức vụ, quyền hạn cửa quyền, hách dịch, gây khó khăn, phiền hà cho tổ chức, cá nhân hoạt động hóa chất; bao che cho người vi phạm pháp luật về hoạt động hóa chất hoặc thiếu trách nhiệm để xảy ra ô nhiễm, sự cố hóa chất thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật hoặc bị truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.
Giải quyết tranh chấp trong hoạt động hóa chất được thực hiện bằng những hình thức sau đây:
1. Thương lượng giữa các bên;
2. Hòa giải giữa các bên do một tổ chức hoặc cá nhân được các bên thỏa thuận làm trung gian hòa giải;
3. Giải quyết tại trọng tài thương mại hoặc Tòa án.
1. Tổ chức, cá nhân đang hoạt động hóa chất phải thực hiện các quy định về khai báo, phân loại, ghi nhãn, xây dựng phiếu an toàn hóa chất theo quy định của Luật này trong thời hạn một năm, kể từ ngày Luật này có hiệu lực.
2. Tổ chức, cá nhân đang hoạt động hóa chất phải xây dựng Biện pháp phòng ngừa, ứng phó sự cố hóa chất, Kế hoạch phòng ngừa, ứng phó sự cố hóa chất theo quy định của Luật này trong thời hạn sáu tháng, kể từ ngày Luật này có hiệu lực.
Luật này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2008.

ON CHEMICALS
(No. 06/2007/QH12)
Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10;
The National Assembly passes the Law on Chemicals.
Article 1. Scope of regulation
This Law provides for chemical-related activities, safety in chemical-related activities, rights and obligations of organizations and individuals engaged in chemical-related activities, and state management of chemical-related activities.
Article 2. Subjects of application
This Law applies to organizations and individuals engaged in chemical-related activities and organizations and individuals related to chemical-related activities in the territory of the Socialist Republic of Vietnam.
Article 3. Application of laws
1. Chemical-related activities must comply with the provisions of this Law and other relevant laws.
2. Activities related to radioactive substances and radioactive wastes comply with the laws on radiation safety and atomic energy.
3. In case the provisions of this Law are different from those of a treaty on chemicals and chemical-related activities to which the Socialist Republic of Vietnam is a contracting party, the provisions of that treaty prevail.
Article 4. Interpretation of terms
In this Law, the terms below are construed as follows:
1. Chemical means an element, a compound or a mixture which is exploited or created by humans from natural or artificial raw materials.
2. Substance means an element or a compound, including any impurities deriving from the processing process and any additives necessary to preserve the stability of physical and chemical properties, excluding any solvents which may be separated without changing the characters of the substance.
3. Mixture means a combination of two or more substances which do not react under normal conditions.
4. Hazardous chemical means a chemical having one or several of the following hazardous properties according to classification principles of the Globally Harmonized System of Classification and Labeling of Chemicals:
a/ Explosive;
b/ Strongly oxidative;
c/ Strongly corrosive;
d/ Flammable;
dd/ Acutely toxic;
e/ Chronically toxic;
g/ Causing irritation to humans;
h/ Causing cancer or posing threats of causing cancer;
i/ Causing genetic mutation;
k/ Reproductively toxic;
l/ Bio-accumulative;
m/ Organically polluting and hard to decay;
n/ Environmentally toxic.
5. Toxic chemical means a hazardous chemical having at least one of the hazardous properties defined from Points e thru m, Clause 4, of this Article.
6. New chemical means a chemical not yet listed in the national chemical inventory or foreign chemical inventories recognized by Vietnamese competent state agencies.
7. Chemical-related activities means investing in, producing, bottling, packaging, selling and purchasing, importing, exporting, transporting, storing, preserving, using, researching into and testing chemicals, disposing of discarded chemicals and disposing of chemical waste.
8. Chemical incident means the state of chemical fire, explosion, leakage or dispersion which causes or threatens to cause harm to humans, properties and the environment
9. Serious chemical incident means a chemical incident which causes or threatens to cause great harm to humans, properties and the environment and falls beyond the controlling capacity of chemical facilities.
10. New hazard properties means hazardous properties which have been found but not yet recorded in safety data sheets.
Article 5. Principles of chemical-related activities
1. Assuring safety for humans, properties, ecosystems and the environment; and social order and safety.
2. Strictly controlling chemical-related activities, especially those related to new chemicals, hazardous chemicals, chemicals restricted from trading and banned chemicals.
3. Supplying sufficient, accurate and timely information on hazardous properties of chemicals and necessary preventive measures.
Article 6. State policies on chemical-related activities
1. To build a modern and sustainable chemical industry efficiently using natural resources; to attach importance to the development of base chemicals, environmentally friendly chemicals and chemicals of high economic value for socioeconomic development.
2. The State invests in the formulation of a planning on development of the chemical industry and build a national system for chemical safety control and a chemical safety database.
3. The State encourages organizations and individuals to invest in the development of the chemical industry, apply new technologies and environmentally friendly technologies, gradually reduce the use of hazardous chemicals and replace toxic chemicals with less toxic and non-toxic chemicals and encourage the recycling, re-use and minimization of chemical wastes.
4. Organizations and individuals investing in chemical production projects in the domains or geographical areas in which investment is encouraged by the State are entitled to incentive policies in accordance with the laws on investment, land, tax and other relevant laws.
Article 7. Prohibited acts in chemical-related activities
1. Producing, trading in, transporting, storing, using, sending or donating hazardous chemicals in contravention of this Law and other relevant legal provisions.
2. Failing to disclose necessary information, supplying inadequate or false information or concealing information on hazardous properties of chemicals or hazardous chemical-containing products.
3. Using chemicals outside the list of those permitted for use, chemicals not up to quality standards or chemicals in excessive concentrations to produce or preserve food, curative medicines, animal feed, veterinary drugs, plant protection drugs, fertilizers or consumer chemical products.
4. Using toxic chemicals to catch or hunt animals or committing acts of infringing upon human health, properties or the environment.
DEVELOPMENT OF THE CHEMICAL INDUSTRY
Article 8. Requirements on chemical industry plannings
1. Chemical industry plannings must be in line with the States principles and policies on chemical-related activities, this Law and other relevant legal provisions.
2. Chemical industry plannings must be formulated on the basis of national socio-economic development strategies and industrial development strategies for every 10-year period, with orientations for subsequent 10 years taken into consideration.
3. Chemical industry plannings must set forth orientations for the formation of chemical industrial parks.
4. Locations of chemical industrial parks and chemical facilities must be suitable to properties and characteristics of chemicals, chemical-producing and -preserving technologies and natural and socio-economic conditions aiming to meet chemical safety requirements.
Article 9. Responsibilities for elaborating chemical industry plannings
1. The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with ministries, branches and localities in, elaborating the a national chemical industry planning for submission to the Prime Minister for approval; guide and inspect the implementation of the planning.
2. Based on the national chemical industry planning approved by the Prime Minister and local socio-economic development objectives, provincial/municipal Peoples Committees (bellow referred to as provincial-level Peoples Committees) shall elaborate and approve chemical industry development plans in conformity with the local industrial development planning.
3. The State shall ensure funds for the chemical industry planning in accordance with the Law on State Budget.
Article 10. Requirements for chemical production and trading projects
1. Chemical production or trading projects must comply with this Law, the law on investment and environmental protection and other relevant laws.
2. Chemical production or trading projects must use technologies up to environmental standards, reduce the use of hazardous chemicals and minimize chemical wastes.
3. Investors in chemical production or trading projects shall work out chemical-incident prevention and response measures or plans as prescribed in Chapter VI of this Law.
4. Investors in chemical production and trading projects shall coordinate with local administrations in collecting opinions of the communities in the localities where the projects are to be executed on environmental protection measures in accordance with the law on environmental protection.
CHEMICAL PRODUCTION AND TRADING
Article 11. Responsibilities for assuring safety in chemical production and trading
1. Organizations and individuals engaged in chemical production and trading shall abide by the chemical management and safety provisions of this Law and other relevant laws so as to ensure safety for laborers, community health and the environment.
2. Organizations and individuals engaged in chemical production and trading shall regularly inspect, maintain and operate waste treatment systems safely.
3. State management agencies shall, within the scope of their tasks and powers, regularly guide, inspect and examine the assurance of safety in chemical production and trading.
Article 12. Requirements on material-technical foundations in chemical production and trading
1. Organizations and individuals engaged in chemical production or trading must have the following material-technical foundations suitable to their operation scope and properties of chemicals:
a/ Workshops, storehouses and technological equipment;
b/ Safety equipment and devices, equipment and devices for prevention and fighting of fire, explosion, lightning, chemical leakage or dispersal and other chemical incidents;
c/ Labor protection equipment and devices;
d/ Environmental protection equipment and devices, waste treatment systems;
dd/ Vehicles of transportation;
e/ Rules on chemical safety; signaling system suitable to the hazard degree of chemicals in the places of hazardous chemical production and trading. In case chemicals have different hazardous properties, warning signs must fully show these hazardous properties.
2. Line ministries shall specify conditions on material-technical foundations to ensure safety in chemical production and trading activities under their management.
Article 13. Professional requirements on chemical production and trading
1. Organizations and individuals engaged in chemical production and trading shall arrange person in charge of chemical safety who possess professional qualifications relevant to the scope and type of chemical production and trading and thorough knowledge about technologies and chemical safety plans and measures.
2. Laborers directly engaged in chemical production and trading must possess professional qualifications relevant to their assigned tasks.
3. Persons directly administering production activities of hazardous chemical-producing facilities must have a university or higher degree in chemistry.
Article 14. Production of and trading in chemicals on the list of those subject to conditional production and trading
1. Chemicals on the list of those subject to conditional production or trading are hazardous chemicals with strict requirements on technical safety in production and trading.
2. Requirements on production of and trading in chemicals on the list of those subject to conditional production or trading are stipulated as follows:
a/ Complying with the provisions of Articles 11, 12 and 13 of this Law;
b/ Having material-technical foundations and professional capacity satisfying the technical regulations applicable to the production of and trading in chemicals on the list of those subject to conditional production and trading;
c/ Having a certificate of qualification for production of and trading in chemicals on the list of those subject to conditional production and trading (referred to as certificate), if such a certificate, is required by law.
3. The Ministry of Industry and Trade and concerned ministries and branches shall coordinate with one another in providing for production and trading conditions and formulating a list of chemicals subject to conditional production and trading before submitting it to the Government for promulgation.
4. Line ministries shall, within the scope of their tasks and powers, issue technical regulations and grant certificates of qualification for chemical production and trading specified in this Article.
Article 15. Production of and trading in chemicals on the list of those restricted from production and trading
1. Chemicals on the list of those restricted from production and trading are hazardous chemicals which are subject to special control of safety techniques as well as production and trading scope, type, scale and duration in order to ensure that no harms are caused to national defense, security, human health, property and the environment.
2. Requirements on production of and trading in chemicals on the list of those restricted from production and trading are stipulated as follows:
a/ Complying with the provisions at Points a and b, Clause 2, Article 14, of this Law;
b/ Having a permit for production of and trading in chemicals on the list of those restricted from production and trading (referred to as permit).
3. The Ministry of Industry and Trade and concerned ministries and branches shall coordinate with one another in providing for production and trading conditions and elaborating a list of chemicals restricted from production and trading before submitting it to the Government for promulgation.
4. Line ministries are competent to grant permits and shall organize the grant of permits for production of and trading in chemicals on the list of those restricted from production and trading falling under their management scope.
Article 16. Order of and procedures for grant of certificates and permits
1. Organizations and individuals applying for certificates or permits shall compile and send dossiers to state agencies competent to grant certificates or permits.
2. A dossier of application for a certificate or permit comprises:
a/ An application for a certificate or permit, made according to a set form;
b/ A copy of the business registration certificate;
c/ Papers evidencing the satisfaction of requirements specified at Points a and b, Clause 2, Article 14, or Point a, Clause 2, Article 15, of this Law.
3. Within 20 days after receiving a valid and complete dossier as prescribed in Clause 2 of this Article, the competent state agency shall grant a certificate or permit to the applicant. In case of refusal, it shall issue a written reply stating the reason.
4. Organizations and individuals applying for certificates or permits shall pay charges as prescribed by law.
Article 17. Contents of certificates or permits
1. A certificate or permit has the following principal contents:
a/ Name and address of the chemical facility;
b/ Place of chemical production or trading;
c/ Form and scope of chemical production or trading and categories of chemicals to be produced or traded in;
d/ Obligations of the facility which is granted a certificate or permit;
dd/ Validity duration, for permits.
2. The validity of permits shall be prescribed by line ministries suitable to the category and characteristics of chemicals on the list of those restricted from production and business.
Article 18. Supplementation or withdrawal of certificates and permits
1. In case of expanding the scope of chemical production or trading beyond the conditions prescribed in the granted certificate or the provisions of the granted permit, before conducting the expansion, the concerned organization or individual shall carry out procedures for supplementation of the certificate or permit so as to suit the new scope of production or trading. The procedures for the supplementation of certificates and permits are similar to those for the grant of new certificates or permits.
2. An organization or individual may have its/his/her certificate or permit withdrawn in the following cases:
a/ Having forged the dossier of application for a permit;
b/ No longer satisfying the conditions for grant of a permit;
c/ Violating the provisions of the certificate or permit but failing to remedy consequences within the time limit prescribed by a competent agency;
d/ Leasing or borrowing the permit or modifying the contents of the certificate or permit;
dd/ Seriously violating the provisions of this Law;
e/ Terminating activities of chemical production or trading.
3. Organizations and individuals applying for supplementation of certificates or permits shall pay a fee as prescribed by law.
Article 19. Chemicals on the list of banned chemicals
1. Banned chemicals are extremely hazardous chemicals on the list of banned chemicals promulgated by the Government.
2. Organizations and individuals may not produce, trade in, transport, store and use chemicals on the list of banned chemicals, except for cases prescribed in Clause 3 of this Article.
3. In special cases for the purposes of scientific research, defense and security assurance or epidemic prevention and control, the production, import and use of chemicals on the list of banned chemicals must be permitted by the Prime Minister.
4. Organizations and individuals permitted to produce, import or use chemicals on the list of banned chemicals shall strictly manage these chemicals in terms of quantity, not let any loss or incident occur and make periodical reports as prescribed in Article 52 of this Law.
5. The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with other ministries and branches in, elaborating a list of banned chemicals for submission to the Government for promulgation.
Article 20. Transportation of hazardous chemicals
1. Organizations and individuals that transport hazardous chemicals shall abide by the provisions on the transportation of dangerous cargoes in the laws on road, inland waterway, railway, air and sea transport and other relevant laws.
2. If an incident occurs en route, vehicle operators, goods owners and vehicle owners shall take necessary measures to minimize and remedy consequences and, at the same time, notify the incident to the nearest Peoples Committee and concerned agencies.
Article 21. Storage and preservation of hazardous chemicals in chemical production or trading
Production or business organizations and individuals that store or preserve hazardous chemicals must satisfy the following requirements:
1. Satisfying the conditions on safety distance and safety techniques in chemical storage and preservation;
2. Displaying necessary warnings at places of storage and preservation of hazardous chemicals as prescribed at Point f, Clause 1, Article 12, of this Law;
3. Having equipment and vehicles in response to incidents, which are suitable to hazardous properties of chemicals;
4. Adopting chemical incident prevention and response measures or plans as prescribed in Chapter VI of this Law.
Article 22. Safety distances of hazardous chemical production and trading facilities
1. Production places and warehouses of facilities producing or trading in chemicals on the list prescribed in Clause 1, Article 38, of this Law must ensure safety distances from residential quarters, public works, historical and cultural relics, beauty spots, bio-diversity conservation zones and daily-life water sources.
2. Organizations and individuals may not build dwelling houses and other works in the safety distances, except special-use works permitted by competent state agencies.
3. The Government shall specify safety distances prescribed in this Article.
Article 23. Control of the sale and purchase of toxic chemicals
1. The sale and purchase of toxic chemicals require control cards certified by the seller and the purchaser as a basis for the control of toxic chemicals circulated in the market.
2. A toxic chemical sale and purchase control card contains information on the name, quantity and use purpose of the chemical; names and signatures of the seller and the purchaser; addresses and identity card serial numbers of representatives of the seller and the purchaser; and the date of delivery.
3. Toxic chemical sale and purchase control cards must be preserved by the seller and the purchaser for at least five years and produced at the request of competent state agencies.
4. The Ministry of Industry and Trade shall set the form of toxic chemical sale and purchase control card.
Article 24. Import, export, temporary import for re-export and transit of chemicals
The import, export, temporary import for re-export and transit of chemicals must comply with the provisions of this Law, other relevant laws and treaties to which the Socialist Republic of Vietnam is a contracting party.
Article 25. Disposal and discard of residual chemicals and chemical wastes and containers
1. Organizations and individuals producing or trading in chemicals shall dispose of and discard residual chemicals and chemical wastes and containers in accordance with the law on environmental protection.
2. The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with ministries and branches in, providing for the disposal and discard of residual chemicals and chemical wastes and containers in accordance with the law on environmental protection.
Article 26. Advertisements on chemicals
1. Advertisements on chemicals must comply with the law on advertisement.
2. Advertisements on products and goods containing toxic or hazardous chemicals must be accompanied with warnings on hazardous or toxic properties of chemicals and instructions on prevention of harms caused by these products and goods.
CHEMICAL CLASSIFICATION, LABELING AND PACKAGING AND CHEMICAL SAFETY DATA SHEETS
Article 27. Classification and labeling of chemicals
1. Organizations and individuals producing or importing chemicals are obliged to classify and label chemicals before using or marketing these chemicals are used or marketed.
2. Chemicals are classified in accordance with technical principles and guidance of the Globally Harmonized System of Classification and Labeling of Chemicals.
3. Chemicals are labeled in accordance with the law on goods labeling.
4. Hazardous chemicals are labeled in accordance with the law on goods labeling and guidance of the Globally Harmonized System of Classification and Labeling of Chemicals.
5. The Ministry of Industry and Trade shall guide the classification and labeling of chemicals according to the Globally Harmonized System of Classification and Labeling of Chemicals and determine a roadmap for application of regulations on classification and labeling of substances and mixtures of substances.
Article 28. Packaging of chemicals
1. Packages of marketed chemicals must meet the following requirements:
a/ Satisfying requirements on classification and labeling of chemicals specified in Article 27 of this Law;
b/ Preventing leakage and dispersal of chemicals in the process of transportation, preservation or storage;
c/ Not being corroded or destroyed by contained chemicals;
d/ Complying with technical regulations on packaging promulgated by competent agencies or with international standards announced by competent state agencies for application.
2. Line ministries shall provide for specifications, materials and requirements on the examination and evaluation of packages of each kind of chemical.
Article 29. Chemical safety data sheets
1. Hazardous chemicals include hazardous substances or mixtures with the content of hazardous substances exceeding the prescribed limit. For hazardous chemicals, chemical safety data sheers must be made.
2. Organizations and individuals producing or importing hazardous chemicals, before using or marketing these chemicals, shall make chemical safety data sheets.
3. A chemical safety data sheet contains the following contents:
a/ Identification of the chemical;
b/ Identification of hazardous properties of the chemical;
c/ Information on the composition of substances;
d/ Physical and chemical properties of the chemical-
dd/ Stability and activity of the chemical;
e/ Information on toxicity;
g/ Ecological information;
h/ First-aid measures;
i/ Fire-fighting measures;
k/ Incident prevention and response measures;
l/ Storage requirements;
m/ Effects on humans and requirements for personal protection devices;
n/ Requirements on disposal of the chemical;
o/ Requirements on transportation:
p/ Applicable technical regulations and laws;
q/ Other necessary information.
4. The Government shall specify the contents of hazardous substances in mixtures for which chemical safety data sheets prescribed in Clause 1 of this Article are required.
Article 30. Rights and obligations of organizations and individuals using chemicals for production of other products and goods
1. Organizations and individuals using chemicals for production of other products and goods may request suppliers of hazardous chemicals to provide adequate and accurate information on their properties and characteristics, information on their classification and labeling and their chemical safety data sheets.
2. Organizations and individuals using chemicals for production of other products and goods have the following obligations:
a/ To abide by regulations on chemical safety management;
b/ To have persons in charge of chemical safety; to satisfy requirements on material-technical foundations and professional capacity regarding chemical safety suitable to the quantity and properties of chemicals;
c/ To provide periodical training and re-training in chemical safety to their laborers;
d/ To provide sufficient, accurate and timely information and guidance on chemical safety to laborers and managers;
dd/ To work out chemical incident prevention and response measures or plans as prescribed in Chapter VI of this Law;
e/ To update and store information on used chemicals as prescribed in Article 53 of this Law;
g/ To promptly notify chemical suppliers and chemical management agencies upon detection of signs of new hazardous properties of used chemicals;
h/ To abide by inspection requests of competent state management agencies in the implementation of regulations on chemical safety.
Article 31. Rights and obligations of organizations and individuals using hazardous chemicals for production of other products and goods
1. Organizations and individuals using hazardous chemicals for production of other products and goods, apart from having the rights and obligations defined in Article 30 of this Law, shall perform the following obligations:
a/ To ensure safety conditions for humans and the environment in the process of using and preserving hazardous chemicals;
b/ To abide by technical regulations on the contents and quality standards of hazardous chemicals in the production of other products and goods;
c/ Not to use toxic chemicals having properties specified at Points h, i, j or k, Clause 4, Article 4, of this Law in food, cosmetics, food additives or food preservatives;
d/ To install a signaling system in the places where hazardous chemicals are used or stored which is suitable to the hazard of chemicals; if the chemicals have different hazardous properties, the warning signs must fully display these properties;
dd/ To supply sufficient, accurate and timely information and guidance on chemical safety to persons who directly use, preserve or transport chemicals and persons who manage chemical production;
e/ To observe legal provisions on disposal and discard of hazardous chemicals and their containers.
2. Line agencies shall promulgate a list of, and manage activities related to, chemicals which are prohibited from use in the production of other products and goods falling under their management scope in accordance with this Law and other relevant laws.
Article 32. Rights and obligations of organizations and individuals using chemicals for consumption purposes
1. Organizations and individuals using chemicals for consumption purposes may request suppliers to provide sufficient information on hazardous properties of chemicals and safety requirements and pay compensation for damage caused in the process of using chemicals due to incorrect information provided by suppliers.
2. Organizations and individuals using chemicals for consumption purposes are obliged to strictly comply with technical instructions accompanied with chemicals or displayed in chemical labels and ensure safety for themselves and the community.
Article 33. Use of chemicals for scientific experimentation and research
1. Heads of testing laboratories and scientific research establishments and persons directly using chemicals for scientific experimentation or research shall fully abide by the provisions on chemical safety in this Law and other relevant laws.
2. Testing laboratories must have safety equipment and devices and labor protection equipment and devices suitable to hazardous properties of chemicals.
3. Chemical containers in testing laboratories and warehouses must be labeled in accordance with requirements on chemical labeling as prescribed by law.
4. Testing laboratories shall make dossiers for supervision of chemicals in order to periodically update the situation of the use of chemicals; and preserve chemical safety data sheets.
5. The Ministry of Science and Technology shall provide for the use of chemicals for scientific experimentation and research.
Article 34. Storage and preservation of hazardous chemicals in use
1. Organizations and individuals using hazardous chemicals for production of products and goods shall abide by the provisions of Article 21 of this Law on storage and preservation of hazardous chemicals.
2. Organizations and individuals using hazardous chemicals for consumption purposes shall abide by manufacturer instructions which are displayed on labels or packages of, or in the use instruction sheets accompanied with, chemical products.
Article 35. Disposal of discarded chemicals
1. Organizations and individuals using chemicals for production of products and goods or using chemicals for scientific experimentation or research or consumption shall dispose of and discard residual chemicals and chemical wastes and containers according to the law on environmental protection.
2. Discarded chemicals must be disposed of by appropriate technologies up to environmental protection standards.
3. Chemicals consumed by households and individuals must be discarded according to manufacturer recommendations and legal provisions on environmental protection so as to ensure safety for humans and the environment.
PREVENTION OF AND RESPONSE TO CHEMICAL INCIDENTS
Article 36. Prevention of chemical incidents
1. Organizations and individuals engaged in chemical-related activities shall abide by technical regulations on safety; and provide periodical training in chemical safety to laborers.
2. Investors of projects related to chemicals outside the list specified in Clause 1, Article 38, of this Law shall work out chemical incident prevention and response measures suitable to the production scope and conditions and properties of chemicals.
3. Chemical incident prevention and response measures contain the following principal contents:
a/ Determining, zoning off and elaborating plans on regular inspection of, spots highly prone to chemical incidents;
b/ Measures, equipment, devices and forces for on-site response;
c/ Plans on coordination with outside forces in responding to chemical incidents.
4. Investors of projects related to chemicals on the list specified in Clause 1, Article 38, of this
Law shall elaborate chemical incident prevention and response plans and submit them to competent state management agencies for approval and may only commence their projects after these plans are approved. In case of expanding or changing the scope of operation, they shall amend and supplement their chemical incident prevention, and response plans, and submit them to competent agencies for approval.
Article 37. Chemical incident-response equipment, devices and forces
1. Organizations and individuals engaged in chemical-related activities shall build their capacity for on-site response to chemical incidents and have equipment and devices suitable to the scope of chemical-related activities and properties of chemicals.
2. On-site response forces must be trained regularly and drilled in chemical incident response plans
3. Fire brigades, other forces and related state management agencies shall enhance their capacity and have equipment and devices to respond to chemical incidents.
Article 38. List of hazardous chemicals requiring elaboration of chemical incident prevention and response plans
1. Based on hazardous properties of chemicals and the scope of chemical production, trading or use, the Government shall promulgate a list of hazardous chemicals requiring chemical incident prevention and response plans.
2. The Ministry of Industry and Trade shall assume the prime responsibility for, and coordinate with concerned ministries and branches in, elaborating and submitting the list specified in Clause 1 of this Article to the Government for promulgation.
Article 39. Contents of chemical incident prevention and response plans
1. Information on properties, quantities, production technologies and use of chemicals, geographical, population and environmental conditions in the places where chemical-related activities are carried out.
2. Forecasts about incident-causing dangers and plans on inspection and supervision of sources of chemical incidents.
3. Forecasts about circumstances leading to chemical incidents and preventive measures.
4. Capacity of responding to chemical incidents, including equipment devices, manpower and plans on coordination with local forces and plans on evacuation of people and properties.
5. Plans on remedying of consequences of chemical incidents in accordance with the law on environmental protection and other relevant laws.
Article 40. Dossiers, order and procedures for approval of chemical incident prevention and
response plans
1. Organizations and individuals applying for approval of chemical incident prevention and response plans shall submit their dossiers to competent agencies.
2. A dossier of application for approval of a chemical incident prevention and response plan comprises:
a/ An application for approval, made according to a set form;
b/ The chemical incident prevention and response plan prescribed in Article 39 of this Law.
3. Agencies competent to approve chemical incident prevention and response plans shall appraise and approve the plan within 30 days after receiving a valid and complete dossier
4. Organizations and individuals applying for approval of chemical incident prevention and response plans shall pay charges as prescribed by law.
Article 41. Competence to approve chemical incident prevention and response plans
Line ministries shall assume the prime responsibility for, and coordinate with state management agencies in charge of fire prevention and fighting, the Ministry of Industry and Trade and concerned state management agencies in, appraising and approving chemical incident prevention and response plans.
Article 42. Responsibilities for coordination in chemical incident prevention and response
1. Organizations and individuals engaged in chemical-related activities concerning chemicals on the list specified in Clause 1, Article 38, of this Law shall supply Peoples Committees at various levels and local fire brigades with information specified in Clauses 3, 4 and 5, Article 39, of this Law for coordination in responding to chemical incidents; for chemical facilities located in industrial parks, export-processing zones or economic zones, they must also supply such information to the management boards of the industrial parks, export-processing zones or economic zones.
2. Upon occurrence of chemical incidents, organizations and individuals engaged in chemical-related activities shall promptly apply chemical incident prevention and response measures or plans and promptly notify the incidents to the nearest fire brigades, concerned agencies and units and local administrations for coordination in responding to and remedying chemical incidents.
3. Upon occurrence of serious chemical incidents, the responsibilities for coordination in incident response are prescribed as follows:
a/ Chemical facilities shall promptly take response measures specified in Clause 2 of this Article;
b/ Peoples Committees of communes, wards or townships where the incidents occur shall mobilize local forces, take other necessary measures and, at the same time, notify the incidents to the Peoples Committees of districts, provincial capitals or cities for arranging forces to implement response measures, rescue or evacuate people and properties and immediately report the cases to the presidents of the provincial-level Peoples Committees;
c/ Presidents of provincial-level Peoples Committees shall direct the response to and remedying of chemical incidents;
d/ Line ministries and the Ministry of Industry and Trade shall promptly coordinate with the provincial-level Peoples Committees of the localities where the incidents occur in responding to and remedying chemical incidents;
dd/ Organizations and individuals shall abide by competent state management agencies orders on the mobilization of people and properties to respond to and remedy chemical incidents in accordance with law;
e/ Presidents of provincial-level Peoples Committees of localities where chemical incidents occur shall immediately notify the National Search and Rescue Committee and concerned agencies for coordination in handling these incidents in accordance with law.
DECLARATION, REGISTRATION AND SUPPLY OF INFORMATION ON CHEMICALS
Article 43. Declaration of chemicals
1. Chemical-importing organizations and individuals shall declare chemicals to the Ministry of Industry and Trade; chemical-producing organizations and individuals shall declare chemicals to professional agencies managing chemical-related activities under provincial-level Peoples Committees.
2. A chemical declaration contains:
a/ Name and address of the chemical-producing or -importing organization or individual;
b/ Name, quantity and origin of the chemical.
3. Annually, professional agencies managing chemical-related activities under provincial-level Peoples Committees shall report to the Ministry of Industry and Trade declared information on chemicals in their localities.
4. The Government shall promulgate a list of chemicals subject to declaration. The Ministry of Industry and Trade shall specify the form of chemical declaration prescribed in this Article.
Article 44. Registration of new chemicals
1. New chemicals may be used or marketed only after they are registered with competent state agencies.
2. A dossier of registration of a new chemical, except cases specified in Clause 3 of this Article, comprises:
a/ An application for registration of a new chemical;
b/ The name of the new chemical under the guidance of the International Union of Pure and Applied Chemistry and the chemical formula of the chemical;
c/ Information on physical and chemical properties and hazardous properties of the chemical, certified by a new chemical-assessing organization prescribed in Article 45 of this Law.
3. A dossier of registration of a new chemical used for scientific research or protection of security and social order and safety comprises:
a/ Documents specified at Points a and b, Clause 2 of this Article;
b/ Information on the use purpose and duration of the chemical.
4. The Ministry of Industry and Trade shall specify the order of, and procedures for, and organize the registration of new chemicals.
Article 45. New chemical-assessing organizations
1. New chemical-assessing organizations are organizations capable of assessing new chemicals and designated by competent state agencies or foreign standard conformity testing organizations accredited by the Organization for Economic Cooperation and Development (OECD) regarding chemical assessment.
2. The Minister of Industry and Trade shall specify conditions on and designate new chemical-assessing organizations in Vietnam.
Article 46. Management of activities related to new chemicals
1. The Ministry of Industry and Trade shall oversee and manage activities related to new chemicals.
2. During five years from the date new chemicals are registered, annually, before January 31 of the subsequent year, organizations and individuals engaged in activities related to new chemicals shall send reports to line ministries and the Ministry of Industry and Trade.
3. The Ministry of Industry and Trade shall specify the contents and forms of reports.
Article 47. Supply of information on toxic chemicals and hazardous chemicals
1. When requested, line ministries shall supply information on toxic chemicals and hazardous chemicals under their management for curing and treatment of humans, animals and plants affected by chemical incidents.
2. The Ministry of Industry and Trade shall coordinate with the Ministry of Health and the Ministry of Natural Resources and Environment in organizing communication on prevention and treatment of effects caused by toxic chemicals and hazardous chemicals.
Article 48. Information on new hazardous properties of chemicals
1. Upon detection of signs of new hazardous properties of chemicals, organizations and individuals engaged in chemical-related activities shall promptly report these properties to the Ministry of Industry and Trade and notify these properties to organizations or individuals that have produced or imported these chemicals.
2. Organizations and individuals producing or importing chemicals which show signs of new hazardous properties shall report to the Ministry of Industry and Trade for consideration and collection of additional scientific grounds on these new hazardous properties.
3. The Ministry of Industry and Trade shall compile dossiers of chemicals which show signs of new hazardous properties in order to take measures to collect more scientific grounds and conduct additional testing to affirm new hazardous properties of chemicals.
4. After obtaining adequate proofs for determination of new hazardous properties of chemicals, the Ministry of Industry and Trade shall decide to apply appropriate measures to manage these chemicals.
5. After obtaining official conclusions of competent state agencies on new hazardous properties of chemicals, organizations and individuals that have produced or imported these chemicals shall modify and supplement chemical labels and chemical safety data sheets to suit new hazardous properties.
Article 49. Obligations to supply information
Organizations and individuals engaged in chemical-related activities are obliged to supply sufficient accurate and timely information at the request of competent agencies:
1. Upon occurrence of chemical incidents in chemical facilities;
2. For the prevention of natural disasters which may cause chemical incidents in chemical facilities
3. For the investigation and survey in service of the elaboration of strategies, plannings and plans on regional or chemical industry development;
4. For the examination and inspection of chemical-related activities.
Article 50. Confidentiality of information
1. Agencies and persons that receive declaration and registration papers and reports on chemicals shall keep information confidential at the request of the declarants, registrants and reporters, except for cases prescribed in Clause 1, Article 51, of this Law.
2. Confidential information of declarants, registrants and reporters includes:
a/ Names and quantities of chemicals to be produced, imported or traded;
b/ Information relating to technological know-how and trade secrets.
Article 51. Use of confidential information
1. Agencies and persons receiving declaration and registration papers and reports on chemicals shall supply confidential information specified in Article 50 of this Law at the request of competent state agencies.
2. Agencies and persons receiving declaration and registration papers and reports on chemicals shall preserve confidential information in accordance with law.
Article 52. Reports on production, import or use of chemicals on the list of banned chemicals
1. Annually, before January 31, organizations and individuals producing, importing or using chemicals on the list of banned chemicals shall send reports on the production, import or use of these chemicals to line ministries and the Ministry of Industry and Trade.
2. A report on production, import or use of chemicals on the list of banned chemicals must have the following principal contents:
a/ Names, use purposes and quantities of produced, imported or used chemicals;
b/ Quantities of warehoused, ex-warehoused and in-stock chemicals and the storage locations;
c/ Chemical safety measures already taken;
d/ Other information, if requested.
Article 53. Preservation of information on hazardous chemicals
1. Organizations and individuals engaged in chemical-related activities shall formulate, regularly update and preserve information on hazardous chemicals in their chemical-related activities for at least three years from the date of ending activities involving these chemicals.
2. Information to be preserved covers scientific names and trade names of chemicals; quantities of chemicals produced, imported, used or discarded; use purposes and classification of hazard categories according to the Globally Harmonized System of Classification and Labeling of Chemicals; and information relating to chemical incidents and chemical safety in the facilities.
3. If a chemical facility has several branches, hazardous chemical data must cover all information relating to the facility and its branches.
Article 54. Time limit of preservation of reports
Agencies or organizations receiving reports on chemicals specified in Articles 46 and 52 of this Law shall preserve them for at least 10 years.
Article 55. National chemical inventory and national chemical database
1. The Government shall formulate and promulgate a national chemical inventory and a national chemical database.
2. The national chemical inventory and the national chemical database must be formulated and modernized in conformity with international practice and be publicized and regularly updated.
ENVIRONMENTAL PROTECTION AND SAFETY FOR THE COMMUNITY
Article 56. Responsibilities for protection of the environment and safety for the community
Organizations and individuals engaged or involved in chemical-related activities shall strictly abide by the chemical safety provisions in this Law, the laws on environmental protection, protection of peoples health and labor safety and other relevant laws.
Article 57. Rights and obligations of organizations and individuals in the protection of the environment and safety for the community
1. Organizations and individuals in localities where exist chemical facilities have the following rights:
a/ To be supplied with information related to the facilities chemical safety;
b/ To request the application of measures to protect the environment and community health;
c/ To be compensated for damage to their health, life or properties caused by chemical-related activities as prescribed by law;
d/To propose competent state agencies to terminate the operation of organizations and individuals that violate legal provisions on chemical safety;
dd/ To give opinions on environmental protection measures and chemical incident prevention and response plans of investment projects on building of hazardous chemical production or storage establishments in their localities.
2. Organizations and individuals in localities where exist chemical facilities have the following obligations:
a/ To promptly report to competent state agencies violations of the law on chemical safety when detecting them;
b/ To create favorable conditions for concerned agencies and organizations to remedy chemical incidents.
Article 58. Publicization of information on chemical safety
Organizations and individuals engaged in chemical-related activities shall coordinate with local administrations in publicizing the following information on chemical safety among the population in localities where exist chemical facilities:
1. Measures for ensuring safety and protecting human health and the environment in accordance with this Law and the law on environmental protection;
2. Principal contents of chemical incident prevention and response plans specified in Article 39, except for confidential information specified in Article 50 of this Law.
Article 59. Responsibilities for disposal of residual toxic chemicals and confiscated toxic chemicals and toxic chemical-containing products
1. Provincial-level Peoples Committees shall inventory, detect and notify the Ministry of Natural Resources and Environment of locations and quantities, of residual toxic chemicals of unclear origin and confiscated toxic chemicals and toxic chemical-containing products in their localities.
2. The Ministry of Natural Resources and Environment shall coordinate with the Ministry of Industry and Trade and concerned agencies and provincial-level Peoples Committees in formulating plans on disposal of residual toxic chemicals of unclear origin and confiscated toxic chemicals and toxic chemical-containing products.
3. Provincial-level Peoples Committees shall organize the implementation of plans on disposal of residual toxic chemicals of unclear origin and confiscated toxic chemicals and toxic chemical-containing products; the Ministry of Natural Resources and Environment shall inspect and supervise the disposal as prescribed in this Law and the law on environmental protection.
4. Organizations and individuals having residual toxic chemicals and toxic chemical-containing products confiscated shall bear all expenses for the disposal.
5. In case residual toxic chemicals are of unclear origin, it is impossible to identify owners of toxic chemicals or owners of confiscated toxic chemicals are financially incapable, expenses for the disposal shall be paid from the state budget.
Article 60. Responsibilities to dispose of residual toxic chemicals of wars
1. The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with the Ministry of Defense and concerned ministries, branches and localities in, identifying sources and scope of influence of residual toxic chemicals of wars and elaborating plans on disposal of these chemicals for submission to the Prime Minister for approval.
2. The Prime Minister shall direct concerned ministries, branches and localities to implement plans on disposal of residual toxic chemicals of wars.
Article 61. Insurance for the liability to pay compensation for damage in chemical-related activities
1. The Suite encourages insurance business enterprises to provide insurance for the liability to pay compensation for damage caused by chemical-related activities.
2. The State encourages organizations and individuals engaged in chemical production and trading to purchase insurance for the liability to pay compensation for damage in chemical-related activities.
3. Based on the socio-economic development situation and requirements for assurance of safety in chemical-related activities in accordance with the Law on Insurance Business, the Government shall propose the National-Assembly Standing Committee to consider and provide for compulsory insurance applicable to activities related to hazardous and toxic chemicals.
STATE MANAGEMENT RESPONSIBILITIES FOR CHEMICAL-RELATED ACTIVITIES
Article 62. State management responsibilities for chemical-related activities
1. The Government shall perform uniform state management of chemical-related activities nationwide.
2. The Ministry of Industry and Trade shall take responsibility before the Government for the performance of state management of chemical-related activities.
3. Ministries and ministerial-level agencies shall, within the scope of their task and powers, coordinate with the Ministry of Industry and Trade in performing the state management of chemical-related activities under the Governments assignment.
4. Peoples Committees at various levels shall perform the state management of chemical-related activities in their localities under the Governments decentralization.
Article 63. State management responsibilities of the Ministry of Industry and Trade for chemical-related activities
1. The Ministry of Industry and Trade shall, within the scope of its tasks and powers, perform the following contents of state management of chemical-related activities:
a/ To promulgate according to its competence or submit to the Government for promulgation legal documents, strategies, plannings and plans on development of the chemical industry and technical regulations on chemical safety;
b/ To assume the prime responsibility for, and coordinate with ministries and branches in, formulating and submitting to the Government for promulgation a national chemical database, a list of chemicals subject to conditional production and trading, a list of chemicals restricted from production and trading, a list of banned chemicals; a list of chemicals subject to declaration and the list of chemicals requiring chemical incident prevention and response plans;
c/ To manage chemicals for industrial use, chemicals which are pre-substances for industrial use and chemicals under the Convention on the Prohibition of the Development, Production, Stockpiling, Use of Chemical Weapons and on their Destruction; to manage chemicals used in consumer industrial products; to promulgate a list of chemicals banned from use in domestic products and consumer products, except those managed by the Ministry of Health and the Ministry of Agriculture and Rural Development;
d/ To develop a national chemical database;
dd/ To perform the uniform management of the classification and labeling of hazardous chemicals; chemical registration and declaration and chemical safety information;
e/ To synthesize and produce statistics on the chemical safety situation nationwide;
g/ To guide the elaboration and organize the appraisal of chemical incident prevention and response plans; to coordinate with concerned agencies in preventing, responding to and remedying chemical incidents;
h/ To enter into international cooperation in chemical-related activities and chemicals safety;
i/ To specify technical-material foundations and professional conditions on chemical facilities under its management;
k/ To participate in the dissemination of and education about the law on chemicals;
l/ To inspect chemical-related activities; to settle complaints and denunciations concerning chemical-related activities;
m/ To perform other tasks concerning chemical-related activities as assigned by the Government.
2. The Government shall decide to set up, and define the functions, tasks and organizational structure of, an agency under the Ministry of Industry and Trade, which shall perform the state management of chemical-related activities to assist the Minister in performing the state management of chemical-related activities.
Article 64. Management responsibilities of ministries and ministerial-level agencies directly concerning chemical-related activities
1. The Ministry of Natural Resources and Environment shall promulgate according to its competence or submit to competent agencies for promulgation regulations on environmental protection concerning chemical-related activities, the disposal and discard of residual toxic chemicals, residual toxic chemicals of the past wars, toxic chemicals of unclear origin and confiscated toxic chemicals.
2. The Ministry of Science and Technology shall promulgate and announce according to its competence standards and technical regulations on chemical safety; to submit to competent agencies for promulgation policies on research into, development and application of technologies suitable to the use of less hazardous chemicals.
3. The Ministry of Transport shall promulgate according to its competence to submit competent agencies for promulgation regulations on the transportation of hazardous chemicals by road, inland waterway, railway, airway or sea; and formulate additional technical regulations on transportation of hazardous chemicals.
4. The Ministry of Health shall manage chemicals used for preparation of pharmaceuticals for humans, germicidal and insecticidal substances for domestic and medical use; coordinate with ministries and branches in providing for labor safety and sanitation in chemical-related activities; coordinate with the Ministry of Industry and Trade in formulating a list of banned chemicals and a list of chemicals restricted from production or trading in the health domain for submission to the Government for promulgation; promulgate a list of chemicals banned from use, restricted from use or permitted for use in the health domain, and a list of germicidal and insecticidal substances for household and medical use, pharmaceuticals and food additives.
5. The Ministry of Agriculture and Rural Development shall manage chemicals used in cultivation, husbandry, aquaculture, animal health, plant protection and preservation and processing of agricultural, forest and aquatic products and food; coordinate with the Ministry of Industry and Trade and concerned ministries and branches in formulating a list of banned chemicals and a list of chemicals restricted from production and trading; promulgate a list of chemicals banned from use, restricted from use or permitted for use in the agricultural domain; guide the classification, labeling and making of chemical safety data sheets for plant protection drugs.
6. The Ministry of Public Security and the Ministry of Defense shall manage chemicals and chemical products in the defense and security domains.
7. The Ministry of Labor, War Invalids and Social Affairs shall promulgate according to its competence or submit to competent agencies for promulgation regulations on labor safety and sanitation for laborers engaged in chemical-related activities; manage the use of chemicals in job-training establishments.
8. The Ministry of Education and Training shall manage the use of chemicals in schools and other educational establishments within the national educational system.
Article 65. State management responsibilities for chemical-related activities of Peoples Committees at various levels
1. Peoples Committees at various levels shall, within the scope of their tasks and powers, manage, inspect and settle complaints and denunciations, and sanction administrative violations in chemical-related activities in their localities under the Governments decentralization, this Law and other relevant laws.
2. Provincial-level Peoples Committees have professional agencies assisting them the Committees in managing chemical-related activities in localities as prescribed by the Government.
Article 66. Inspection of chemical-related activities
1. The Ministry of Industry and Trade, concerned ministries and branches and Peoples Committees at all levels shall inspect chemical-related activities within the management scope assigned or decentralized to them.
2. The organization, tasks and powers of chemical inspectorates comply with law on inspection.
Article 67. Handling of violations
1. Agencies, organizations and individuals that violate the provisions of this Law and other legal provisions on chemical-related activities shall, depending on subject, nature and severity of their violations, be administratively sanctioned or examined for penal liability; if causing damage, they shall pay compensations in accordance with law.
2. Individuals who abuse their tasks and powers to harass or cause troubles to organizations or individuals engaged in chemical-related activities; cover violators of the law on chemical- related activities or let chemical pollution or incidents occur due to their irresponsibility shall, depending on the nature and severity of their violations, be disciplined or examined for penal liability; if causing damage, they shall pay compensations in accordance with law.
Article 68. Settlement of disputes in chemical-related activities
Disputes in chemical-related activities shall be settled in one of the following forms:
1. Negotiation between the involved parties;
2. Conciliation between the involved parities by an intermediary conciliation organization or individual agreed upon by the involved parties.
3. Settlement at a commercial arbitration or a court.
Article 69. Transition provisions
1. Organizations and individuals that are conducting chemical-related activities shall comply with this Laws provisions on declaration, classification, labeling of chemicals and making of chemical safety data sheets Law within one year from the effective date of this Law
2. Organizations and individuals that are conducting chemical-related activities shall formulate chemical incident prevention and response measures or plans as prescribed by this Law within six months from the effective date of this Law.
Article 70. Implementation effect
This Law takes effect on July 1, 2008.
Article 71. Implementation guidance
The Government shall detail and guide the implementation of this Law.
This Law was passed on November 21, 2007, by the XIIth National Assembly of the Socialist Republic of Vietnam at its 2nd session.
