Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Quốc hội ban hành Luật an toàn thực phẩm.
Luật này quy định về quyền và nghĩa vụ của tổ chức, cá nhân trong bảo đảm an toàn thực phẩm; điều kiện bảo đảm an toàn đối với thực phẩm, sản xuất, kinh doanh thực phẩm và nhập khẩu, xuất khẩu thực phẩm; quảng cáo, ghi nhãn thực phẩm; kiểm nghiệm thực phẩm; phân tích nguy cơ đối với an toàn thực phẩm; phòng ngừa, ngăn chặn và khắc phục sự cố về an toàn thực phẩm; thông tin, giáo dục, truyền thông về an toàn thực phẩm; trách nhiệm quản lý nhà nước về an toàn thực phẩm.
Điều 2. Giải thích từ ngữTrong luật này, các từ ngữ dưới đây được hiểu như sau:
1. An toàn thực phẩm là việc bảo đảm để thực phẩm không gây hại đến sức khỏe, tính mạng con người.
2. Bệnh truyền qua thực phẩm là bệnh do ăn, uống thực phẩm bị nhiễm tác nhân gây bệnh.
3. Chất hỗ trợ chế biến thực phẩm là chất được chủ định sử dụng trong quá trình chế biến nguyên liệu thực phẩm hay các thành phần của thực phẩm nhằm thực hiện mục đích công nghệ, có thể được tách ra hoặc còn lại trong thực phẩm.
4. Chế biến thực phẩm là quá trình xử lý thực phẩm đã qua sơ chế hoặc thực phẩm tươi sống theo phương pháp công nghiệp hoặc thủ công để tạo thành nguyên liệu thực phẩm hoặc sản phẩm thực phẩm.
5. Cơ sở kinh doanh dịch vụ ăn uống là cơ sở chế biến thức ăn bao gồm cửa hàng, quầy hàng kinh doanh thức ăn ngay, thực phẩm chín, nhà hàng ăn uống, cơ sở chế biến suất ăn sẵn, căng-tin và bếp ăn tập thể.
6. Điều kiện bảo đảm an toàn thực phẩm là những quy chuẩn kỹ thuật và những quy định khác đối với thực phẩm, cơ sở sản xuất, kinh doanh thực phẩm và hoạt động sản xuất, kinh doanh thực phẩm do cơ quan quản lý nhà nước có thẩm quyền ban hành nhằm mục đích bảo đảm thực phẩm an toàn đối với sức khoẻ, tính mạng con người.
7. Kiểm nghiệm thực phẩm là việc thực hiện một hoặc các hoạt động thử nghiệm, đánh giá sự phù hợp với quy chuẩn kỹ thuật và tiêu chuẩn tương ứng đối với thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, chất bổ sung vào thực phẩm, bao gói, dụng cụ, vật liệu chứa đựng thực phẩm.
8. Kinh doanh thực phẩm là việc thực hiện một, một số hoặc tất cả các hoạt động giới thiệu, dịch vụ bảo quản, dịch vụ vận chuyển hoặc buôn bán thực phẩm.
9. Lô sản phẩm thực phẩm là một số lượng xác định của một loại sản phẩm cùng tên, chất lượng, nguyên liệu, thời hạn sử dụng và cùng được sản xuất tại một cơ sở.
10. Ngộ độc thực phẩm là tình trạng bệnh lý do hấp thụ thực phẩm bị ô nhiễm hoặc có chứa chất độc.
11. Nguy cơ ô nhiễm thực phẩm là khả năng các tác nhân gây ô nhiễm xâm nhập vào thực phẩm trong quá trình sản xuất, kinh doanh.
12. Ô nhiễm thực phẩm là sự xuất hiện tác nhân làm ô nhiễm thực phẩm gây hại đến sức khỏe, tính mạng con người.
13. Phụ gia thực phẩm là chất được chủ định đưa vào thực phẩm trong quá trình sản xuất, có hoặc không có giá trị dinh dưỡng, nhằm giữ hoặc cải thiện đặc tính của thực phẩm.
14. Sản xuất thực phẩm là việc thực hiện một, một số hoặc tất cả các hoạt động trồng trọt, chăn nuôi, thu hái, đánh bắt, khai thác, sơ chế, chế biến, bao gói, bảo quản để tạo ra thực phẩm.
15. Sản xuất ban đầu là việc thực hiện một, một số hoặc tất cả các hoạt động trồng trọt, chăn nuôi, thu hái, đánh bắt, khai thác.
16. Sơ chế thực phẩm là việc xử lý sản phẩm trồng trọt, chăn nuôi, thu hái, đánh bắt, khai thác nhằm tạo ra thực phẩm tươi sống có thể ăn ngay hoặc tạo ra nguyên liệu thực phẩm hoặc bán thành phẩm cho khâu chế biến thực phẩm.
17. Sự cố về an toàn thực phẩm là tình huống xảy ra do ngộ độc thực phẩm, bệnh truyền qua thực phẩm hoặc các tình huống khác phát sinh từ thực phẩm gây hại trực tiếp đến sức khỏe, tính mạng con người.
18. Tác nhân gây ô nhiễm là yếu tố không mong muốn, không được chủ động cho thêm vào thực phẩm, có nguy cơ ảnh hưởng xấu đến an toàn thực phẩm.
19. Thời hạn sử dụng thực phẩm là thời hạn mà thực phẩm vẫn giữ được giá trị dinh dưỡng và bảo đảm an toàn trong điều kiện bảo quản được ghi trên nhãn theo hướng dẫn của nhà sản xuất.
20. Thực phẩm là sản phẩm mà con người ăn, uống ở dạng tươi sống hoặc đã qua sơ chế, chế biến, bảo quản. Thực phẩm không bao gồm mỹ phẩm, thuốc lá và các chất sử dụng như dược phẩm.
21. Thực phẩm tươi sống là thực phẩm chưa qua chế biến bao gồm thịt, trứng, cá, thuỷ hải sản, rau, củ, quả tươi và các thực phẩm khác chưa qua chế biến.
22. Thực phẩm tăng cường vi chất dinh dưỡng là thực phẩm được bổ sung vitamin, chất khoáng, chất vi lượng nhằm phòng ngừa, khắc phục sự thiếu hụt các chất đó đối với sức khỏe cộng đồng hay nhóm đối tượng cụ thể trong cộng đồng.
23. Thực phẩm chức năng là thực phẩm dùng để hỗ trợ chức năng của cơ thể con người, tạo cho cơ thể tình trạng thoải mái, tăng sức đề kháng, giảm bớt nguy cơ mắc bệnh, bao gồm thực phẩm bổ sung, thực phẩm bảo vệ sức khoẻ, thực phẩm dinh dưỡng y học.
24. Thực phẩm biến đổi gen là thực phẩm có một hoặc nhiều thành phần nguyên liệu có gen bị biến đổi bằng công nghệ gen.
25. Thực phẩm đã qua chiếu xạ là thực phẩm đã được chiếu xạ bằng nguồn phóng xạ để xử lý, ngăn ngừa sự biến chất của thực phẩm.
26. Thức ăn đường phố là thực phẩm được chế biến dùng để ăn, uống ngay, trong thực tế được thực hiện thông qua hình thức bán rong, bày bán trên đường phố, nơi công cộng hoặc những nơi tương tự.
27. Thực phẩm bao gói sẵn là thực phẩm được bao gói và ghi nhãn hoàn chỉnh, sẵn sàng để bán trực tiếp cho mục đích chế biến tiếp hoặc sử dụng để ăn ngay.
28. Truy xuất nguồn gốc thực phẩm là việc truy tìm quá trình hình thành và lưu thông thực phẩm.
Điều 3. Nguyên tắc quản lý an toàn thực phẩm1. Bảo đảm an toàn thực phẩm là trách nhiệm của mọi tổ chức, cá nhân sản xuất, kinh doanh thực phẩm.
2. Sản xuất, kinh doanh thực phẩm là hoạt động có điều kiện; tổ chức, cá nhân sản xuất, kinh doanh thực phẩm phải chịu trách nhiệm về an toàn đối với thực phẩm do mình sản xuất, kinh doanh.
3. Quản lý an toàn thực phẩm phải trên cơ sở quy chuẩn kỹ thuật tương ứng, quy định do cơ quan quản lý nhà nước có thẩm quyền ban hành và tiêu chuẩn do tổ chức, cá nhân sản xuất công bố áp dụng.
4. Quản lý an toàn thực phẩm phải được thực hiện trong suốt quá trình sản xuất, kinh doanh thực phẩm trên cơ sở phân tích nguy cơ đối với an toàn thực phẩm.
5. Quản lý an toàn thực phẩm phải bảo đảm phân công, phân cấp rõ ràng và phối hợp liên ngành.
6. Quản lý an toàn thực phẩm phải đáp ứng yêu cầu phát triển kinh tế - xã hội.
Điều 4. Chính sách của Nhà nước về an toàn thực phẩm1. Xây dựng chiến lược, quy hoạch tổng thể về bảo đảm an toàn thực phẩm, quy hoạch vùng sản xuất thực phẩm an toàn theo chuỗi cung cấp thực phẩm được xác định là nhiệm vụ trọng tâm ưu tiên.
2. Sử dụng nguồn lực nhà nước và các nguồn lực khác đầu tư nghiên cứu khoa học và ứng dụng công nghệ phục vụ việc phân tích nguy cơ đối với an toàn thực phẩm; xây dựng mới, nâng cấp một số phòng thí nghiệm đạt tiêu chuẩn khu vực, quốc tế; nâng cao năng lực các phòng thí nghiệm phân tích hiện có; hỗ trợ đầu tư xây dựng các vùng sản xuất nguyên liệu thực phẩm an toàn, chợ đầu mối nông sản thực phẩm, cơ sở giết mổ gia súc, gia cầm quy mô công nghiệp.
3. Khuyến khích các cơ sở sản xuất, kinh doanh thực phẩm đổi mới công nghệ, mở rộng quy mô sản xuất; sản xuất thực phẩm chất lượng cao, bảo đảm an toàn; bổ sung vi chất dinh dưỡng thiết yếu trong thực phẩm; xây dựng thương hiệu và phát triển hệ thống cung cấp thực phẩm an toàn.
4. Thiết lập khuôn khổ pháp lý và tổ chức thực hiện lộ trình bắt buộc áp dụng hệ thống Thực hành sản xuất tốt (GMP), Thực hành nông nghiệp tốt (GAP), Thực hành vệ sinh tốt (GHP), Phân tích nguy cơ và kiểm soát điểm tới hạn (HACCP) và các hệ thống quản lý an toàn thực phẩm tiên tiến khác trong quá trình sản xuất, kinh doanh thực phẩm.
5. Mở rộng hợp tác quốc tế, đẩy mạnh ký kết điều ước, thoả thuận quốc tế về công nhận, thừa nhận lẫn nhau trong lĩnh vực thực phẩm.
6. Khen thưởng kịp thời tổ chức, cá nhân sản xuất, kinh doanh thực phẩm an toàn.
7. Khuyến khích, tạo điều kiện cho hội, hiệp hội, tổ chức, cá nhân trong nước, tổ chức, cá nhân nước ngoài đầu tư, tham gia vào các hoạt động xây dựng tiêu chuẩn, quy chuẩn kỹ thuật, kiểm nghiệm an toàn thực phẩm.
8. Tăng đầu tư, đa dạng các hình thức, phương thức tuyên truyền, giáo dục nâng cao nhận thức người dân về tiêu dùng thực phẩm an toàn, ý thức trách nhiệm và đạo đức kinh doanh của tổ chức, cá nhân sản xuất, kinh doanh thực phẩm đối với cộng đồng.
Điều 5. Những hành vi bị cấm1. Sử dụng nguyên liệu không thuộc loại dùng cho thực phẩm để chế biến thực phẩm.
2. Sử dụng nguyên liệu thực phẩm đã quá thời hạn sử dụng, không rõ nguồn gốc, xuất xứ hoặc không bảo đảm an toàn để sản xuất, chế biến thực phẩm.
3. Sử dụng phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm đã quá thời hạn sử dụng, ngoài danh mục được phép sử dụng hoặc trong danh mục được phép sử dụng nhưng vượt quá giới hạn cho phép; sử dụng hóa chất không rõ nguồn gốc, hóa chất bị cấm sử dụng trong hoạt động sản xuất, kinh doanh thực phẩm.
4. Sử dụng động vật chết do bệnh, dịch bệnh hoặc chết không rõ nguyên nhân, bị tiêu hủy để sản xuất, kinh doanh thực phẩm.
5. Sản xuất, kinh doanh:
a) Thực phẩm vi phạm quy định của pháp luật về nhãn hàng hóa;
b) Thực phẩm không phù hợp với quy chuẩn kỹ thuật tương ứng;
c) Thực phẩm bị biến chất;
d) Thực phẩm có chứa chất độc hại hoặc nhiễm chất độc, tác nhân gây ô nhiễm vượt quá giới hạn cho phép;
đ) Thực phẩm có bao gói, đồ chứa đựng không bảo đảm an toàn hoặc bị vỡ, rách, biến dạng trong quá trình vận chuyển gây ô nhiễm thực phẩm;
e) Thịt hoặc sản phẩm được chế biến từ thịt chưa qua kiểm tra thú y hoặc đã qua kiểm tra nhưng không đạt yêu cầu;
g) Thực phẩm không được phép sản xuất, kinh doanh để phòng, chống dịch bệnh;
h) Thực phẩm chưa được đăng ký bản công bố hợp quy tại cơ quan nhà nước có thẩm quyền trong trường hợp thực phẩm đó thuộc diện phải được đăng ký bản công bố hợp quy;
i) Thực phẩm không rõ nguồn gốc, xuất xứ hoặc quá thời hạn sử dụng.
6. Sử dụng phương tiện gây ô nhiễm thực phẩm, phương tiện đã vận chuyển chất độc hại chưa được tẩy rửa sạch để vận chuyển nguyên liệu thực phẩm, thực phẩm.
7. Cung cấp sai hoặc giả mạo kết quả kiểm nghiệm thực phẩm.
8. Che dấu, làm sai lệch, xóa bỏ hiện trường, bằng chứng về sự cố an toàn thực phẩm hoặc các hành vi cố ý khác cản trở việc phát hiện, khắc phục sự cố về an toàn thực phẩm.
9. Người mắc bệnh truyền nhiễm tham gia sản xuất, kinh doanh thực phẩm.
10. Sản xuất, kinh doanh thực phẩm tại cơ sở không có giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm theo quy định của pháp luật.
11. Quảng cáo thực phẩm sai sự thật, gây nhầm lẫn đối với người tiêu dùng.
12. Đăng tải, công bố thông tin sai lệch về an toàn thực phẩm gây bức xúc cho xã hội hoặc thiệt hại cho sản xuất, kinh doanh.
13. Sử dụng trái phép lòng đường, vỉa hè, hành lang, sân chung, lối đi chung, diện tích phụ chung để chế biến, sản xuất, kinh doanh thức ăn đường phố.
Điều 6. Xử lý vi phạm pháp luật về an toàn thực phẩm1. Tổ chức, cá nhân sản xuất, kinh doanh thực phẩm vi phạm pháp luật về an toàn thực phẩm thì tùy theo tính chất, mức độ vi phạm mà bị xử lý vi phạm hành chính hoặc bị truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường và khắc phục hậu quả theo quy định của pháp luật.
2. Người lợi dụng chức vụ, quyền hạn vi phạm quy định của Luật này hoặc các quy định khác của pháp luật về an toàn thực phẩm thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật hoặc bị truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.
3. Mức phạt tiền đối với vi phạm hành chính quy định tại khoản 1 Điều này được thực hiện theo quy định của pháp luật về xử lý vi phạm hành chính; trường hợp áp dụng mức phạt cao nhất theo quy định của pháp luật về xử lý vi phạm hành chính mà vẫn còn thấp hơn 07 lần giá trị thực phẩm vi phạm thì mức phạt được áp dụng không quá 07 lần giá trị thực phẩm vi phạm; tiền thu được do vi phạm mà có bị tịch thu theo quy định của pháp luật.
4. Chính phủ quy định cụ thể về hành vi, hình thức và mức xử phạt các hành vi vi phạm hành chính trong lĩnh vực an toàn thực phẩm quy định tại Điều này.
1. Tổ chức, cá nhân sản xuất thực phẩm có các quyền sau đây:
a) Quyết định và công bố các tiêu chuẩn sản phẩm do mình sản xuất, cung cấp; quyết định áp dụng các biện pháp kiểm soát nội bộ để bảo đảm an toàn thực phẩm;
b) Yêu cầu tổ chức, cá nhân kinh doanh thực phẩm hợp tác trong việc thu hồi và xử lý thực phẩm không bảo đảm an toàn;
c) Lựa chọn tổ chức đánh giá sự phù hợp, cơ sở kiểm nghiệm đã được chỉ định để chứng nhận hợp quy;
d) Sử dụng dấu hợp chuẩn, dấu hợp quy và các dấu hiệu khác cho sản phẩm theo quy định của pháp luật;
đ) Khiếu nại, tố cáo, khởi kiện theo quy định của pháp luật;
e) Được bồi thường thiệt hại theo quy định của pháp luật.
2. Tổ chức, cá nhân sản xuất thực phẩm có các nghĩa vụ sau đây:
a) Tuân thủ các điều kiện bảo đảm an toàn đối với thực phẩm, bảo đảm an toàn thực phẩm trong quá trình sản xuất và chịu trách nhiệm về an toàn thực phẩm do mình sản xuất;
b) Tuân thủ quy định của Chính phủ về tăng cường vi chất dinh dưỡng mà thiếu hụt sẽ ảnh hưởng đến sức khỏe cộng đồng;
c) Thông tin đầy đủ, chính xác về sản phẩm trên nhãn, bao bì, trong tài liệu kèm theo thực phẩm theo quy định của pháp luật về nhãn hàng hóa;
d) Thiết lập quy trình tự kiểm tra trong quá trình sản xuất thực phẩm;
đ) Thông tin trung thực về an toàn thực phẩm; cảnh báo kịp thời, đầy đủ, chính xác về nguy
cơ gây mất an toàn của thực phẩm, cách phòng ngừa cho người bán hàng và người tiêu dùng; thông báo yêu cầu về vận chuyển, lưu giữ, bảo quản, sử dụng thực phẩm;
e) Kịp thời ngừng sản xuất, thông báo cho các bên liên quan và có biện pháp khắc phục hậu quả khi phát hiện thực phẩm không an toàn hoặc không phù hợp tiêu chuẩn đã công bố áp dụng, quy chuẩn kỹ thuật tương ứng;
g) Lưu giữ hồ sơ, mẫu thực phẩm, các thông tin cần thiết theo quy định về truy xuất nguồn gốc thực phẩm; thực hiện quy định về truy xuất nguồn gốc thực phẩm không bảo đảm an toàn theo quy định tại Điều 54 của Luật này;
h) Thu hồi, xử lý thực phẩm quá thời hạn sử dụng, không bảo đảm an toàn. Trong trường hợp xử lý bằng hình thức tiêu hủy thì việc tiêu hủy thực phẩm phải tuân theo quy định của pháp luật
về bảo vệ môi trường, quy định khác của pháp luật có liên quan và phải chịu toàn bộ chi phí cho việc tiêu hủy đó;
i) Tuân thủ quy định pháp luật, quyết định về thanh tra, kiểm tra của cơ quan nhà nước có thẩm quyền;
k) Chi trả chi phí lấy mẫu và kiểm nghiệm theo quy định tại Điều 48 của Luật này;
l) Bồi thường thiệt hại theo quy định của pháp luật khi thực phẩm không an toàn do mình sản xuất gây ra.
Điều 8. Quyền và nghĩa vụ của tổ chức, cá nhân kinh doanh thực phẩm1. Tổ chức, cá nhân kinh doanh thực phẩm có các quyền sau đây:
a) Quyết định các biện pháp kiểm soát nội bộ để duy trì chất lượng vệ sinh an toàn thực phẩm;
b) Yêu cầu tổ chức, cá nhân sản xuất, nhập khẩu thực phẩm hợp tác trong việc thu hồi và xử lý thực phẩm không bảo đảm an toàn;
c) Lựa chọn cơ sở kiểm nghiệm để kiểm tra an toàn thực phẩm; lựa chọn cơ sở kiểm nghiệm đã được chỉ định để chứng nhận hợp quy đối với thực phẩm nhập khẩu;
d) Khiếu nại, tố cáo, khởi kiện theo quy định của pháp luật;
đ) Được bồi thường thiệt hại theo quy định của pháp luật.
2. Tổ chức, cá nhân kinh doanh thực phẩm có các nghĩa vụ sau đây:
a) Tuân thủ các điều kiện bảo đảm an toàn đối với thực phẩm trong quá trình kinh doanh và chịu trách nhiệm về an toàn thực phẩm do mình kinh doanh;
b) Kiểm tra nguồn gốc, xuất xứ thực phẩm, nhãn thực phẩm và các tài liệu liên quan đến an toàn thực phẩm; lưu giữ hồ sơ về thực phẩm; thực hiện quy định về truy xuất nguồn gốc thực phẩm không bảo đảm an toàn theo quy định tại Điều 54 của Luật này;
c) Thông tin trung thực về an toàn thực phẩm; thông báo cho người tiêu dùng điều kiện bảo đảm an toàn khi vận chuyển, lưu giữ, bảo quản và sử dụng thực phẩm;
d) Kịp thời cung cấp thông tin về nguy cơ gây mất an toàn của thực phẩm và cách phòng ngừa cho người tiêu dùng khi nhận được thông tin cảnh báo của tổ chức, cá nhân sản xuất, nhập khẩu;
đ) Kịp thời ngừng kinh doanh, thông tin cho tổ chức, cá nhân sản xuất, nhập khẩu và người tiêu dùng khi phát hiện thực phẩm không bảo đảm an toàn;
e) Báo cáo ngay với cơ quan có thẩm quyền và khắc phục ngay hậu quả khi phát hiện ngộ độc thực phẩm hoặc bệnh truyền qua thực phẩm do mình kinh doanh gây ra;
g) Hợp tác với tổ chức, cá nhân sản xuất, nhập khẩu, cơ quan nhà nước có thẩm quyền trong việc điều tra ngộ độc thực phẩm để khắc phục hậu quả, thu hồi hoặc xử lý thực phẩm không bảo đảm an toàn;
h) Tuân thủ quy định của pháp luật, quyết định về thanh tra, kiểm tra của cơ quan nhà nước có thẩm quyền;
k) Chi trả chi phí lấy mẫu và kiểm nghiệm theo quy định tại Điều 48 của Luật này;
l) Bồi thường thiệt hại theo quy định của pháp luật khi thực phẩm mất an toàn do mình kinh doanh gây ra.
Điều 9. Quyền và nghĩa vụ của người tiêu dùng thực phẩm1. Người tiêu dùng thực phẩm có các quyền sau đây:
a) Được cung cấp thông tin trung thực về an toàn thực phẩm, hướng dẫn sử dụng, vận chuyển, lưu giữ, bảo quản, lựa chọn, sử dụng thực phẩm phù hợp; được cung cấp thông tin về nguy
cơ gây mất an toàn, cách phòng ngừa khi nhận được thông tin cảnh báo đối với thực phẩm;
b) Yêu cầu tổ chức, cá nhân sản xuất, kinh doanh thực phẩm bảo vệ quyền lợi của mình theo quy định của pháp luật;
c) Yêu cầu tổ chức bảo vệ quyền lợi người tiêu dùng bảo vệ quyền và lợi ích hợp pháp của mình theo quy định của pháp luật về bảo vệ quyền lợi người tiêu dùng;
d) Khiếu nại, tố cáo, khởi kiện theo quy định của pháp luật;
đ) Được bồi thường thiệt hại theo quy định của pháp luật do sử dụng thực phẩm không an toàn gây ra.
2. Người tiêu dùng thực phẩm có các nghĩa vụ sau đây:
a) Tuân thủ đầy đủ các quy định, hướng dẫn về an toàn thực phẩm của tổ chức, cá nhân sản xuất, kinh doanh trong vận chuyển, lưu giữ, bảo quản và sử dụng thực phẩm;
b) Kịp thời cung cấp thông tin khi phát hiện nguy cơ gây mất an toàn thực phẩm, khai báo ngộ độc thực phẩm, bệnh truyền qua thực phẩm với Ủy ban nhân dân nơi gần nhất, cơ sở khám bệnh, chữa bệnh, cơ quan nhà nước có thẩm quyền, tổ chức, cá nhân sản xuất, kinh doanh thực phẩm;
c) Tuân thủ quy định của pháp luật về bảo vệ môi trường trong quá trình sử dụng thực phẩm.
1. Đáp ứng quy chuẩn kỹ thuật tương ứng, tuân thủ quy định về giới hạn vi sinh vật gây bệnh, dư lượng thuốc bảo vệ thực vật, dư lượng thuốc thú y, kim loại nặng, tác nhân gây ô nhiễm và các chất khác trong thực phẩm có thể gây hại đến sức khỏe, tính mạng con người.
2. Tùy từng loại thực phẩm, ngoài các quy định tại khoản 1 Điều này, thực phẩm còn phải đáp ứng một hoặc một số quy định sau đây:
a) Quy định về sử dụng phụ gia thực phẩm, chất hỗ trợ chế biến trong sản xuất, kinh doanh thực phẩm;
b) Quy định về bao gói và ghi nhãn thực phẩm;
c) Quy định về bảo quản thực phẩm.
Điều 11. Điều kiện bảo đảm an toàn đối với thực phẩm tươi sống1. Tuân thủ các điều kiện quy định tại Điều 10 của Luật này.
2. Bảo đảm truy xuất được nguồn gốc theo quy định tại Điều 54 của Luật này.
3. Có chứng nhận vệ sinh thú y của cơ quan thú y có thẩm quyền đối với thực phẩm tươi sống có nguồn gốc từ động vật theo quy định của pháp luật về thú y.
Điều 12. Điều kiện bảo đảm an toàn đối với thực phẩm đã qua chế biến1. Tuân thủ các điều kiện quy định tại Điều 10 của Luật này.
2. Nguyên liệu ban đầu tạo nên thực phẩm phải bảo đảm an toàn và giữ nguyên các thuộc tính vốn có của nó; các nguyên liệu tạo thành thực phẩm không được tương tác với nhau để tạo ra các sản phẩm gây hại đến sức khoẻ, tính mạng con người.
3. Thực phẩm đã qua chế biến bao gói sẵn phải đăng ký bản công bố hợp quy với cơ quan nhà nước có thẩm quyền trước khi lưu thông trên thị trường.
Chính phủ quy định cụ thể việc đăng ký bản công bố hợp quy và thời hạn của bản đăng ký công bố hợp quy đối với thực phẩm đã qua chế biến bao gói sẵn.
Điều 13. Điều kiện bảo đảm an toàn đối với thực phẩm tăng cường vi chất dinh dưỡng1. Tuân thủ các điều kiện quy định tại Điều 10 của Luật này.
2. Nguyên liệu ban đầu tạo nên thực phẩm phải bảo đảm an toàn và giữ nguyên các thuộc tính vốn có của nó; các nguyên liệu tạo thành thực phẩm không được tương tác với nhau để tạo ra các sản phẩm gây hại đến sức khoẻ, tính mạng con người.
3. Chỉ được tăng cường vi chất dinh dưỡng là vitamin, chất khoáng, chất vi lượng vào thực phẩm với hàm lượng bảo đảm không gây hại đến sức khoẻ, tính mạng con người và thuộc Danh mục theo quy định của Bộ trưởng Bộ Y tế.
Điều 14. Điều kiện bảo đảm an toàn đối với thực phẩm chức năng1. Tuân thủ các điều kiện quy định tại Điều 10 của Luật này.
2. Có thông tin, tài liệu khoa học chứng minh về tác dụng của thành phần tạo nên chức năng đã công bố.
3. Thực phẩm chức năng lần đầu tiên đưa ra lưu thông trên thị trường phải có báo cáo thử nghiệm hiệu quả về công dụng của sản phẩm.
4. Bộ trưởng Bộ Y tế quy định cụ thể về quản lý thực phẩm chức năng.
Điều 15. Điều kiện bảo đảm an toàn đối với thực phẩm biến đổi gen1. Tuân thủ các điều kiện quy định tại Điều 10 của Luật này.
2. Tuân thủ các quy định về bảo đảm an toàn đối với sức khỏe con người và môi trường theo quy định của Chính phủ.
Điều 16. Điều kiện bảo đảm an toàn đối với thực phẩm đã qua chiếu xạ1. Tuân thủ các điều kiện quy định tại Điều 10 của Luật này.
2. Thuộc Danh mục nhóm thực phẩm được phép chiếu xạ.
3. Tuân thủ quy định về liều lượng chiếu xạ.
4. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương ban hành Danh mục nhóm thực phẩm được phép chiếu xạ và liều lượng được phép chiếu xạ đối với thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 17. Điều kiện bảo đảm an toàn đối với phụ gia thực phẩm và chất hỗ trợ chế biến thực phẩm1. Đáp ứng quy chuẩn kỹ thuật tương ứng, tuân thủ quy định về phụ gia thực phẩm và chất hỗ trợ chế biến thực phẩm.
2. Có hướng dẫn sử dụng ghi trên nhãn hoặc tài liệu đính kèm trong mỗi đơn vị sản phẩm bằng tiếng Việt và ngôn ngữ khác theo xuất xứ sản phẩm.
3. Thuộc Danh mục phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm được phép sử dụng trong sản xuất, kinh doanh thực phẩm do Bộ trưởng Bộ Y tế quy định.
4. Đăng ký bản công bố hợp quy với cơ quan nhà nước có thẩm quyền trước khi lưu thông trên thị trường.
Chính phủ quy định cụ thể việc đăng ký bản công bố hợp quy và thời hạn của bản đăng ký công bố hợp quy đối với phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm.
Điều 18. Điều kiện bảo đảm an toàn đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm1. Sản xuất từ nguyên vật liệu an toàn, bảo đảm không thôi nhiễm các chất độc hại, mùi vị lạ vào thực phẩm, bảo đảm chất lượng thực phẩm trong thời hạn sử dụng.
2. Đáp ứng quy chuẩn kỹ thuật tương ứng, tuân thủ quy định đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm do Bộ trưởng Bộ Y tế ban hành.
3. Đăng ký bản công bố hợp quy với cơ quan nhà nước có thẩm quyền trước khi lưu thông trên thị trường.
Chính phủ quy định cụ thể việc đăng ký bản công bố hợp quy và thời hạn của bản đăng ký công bố hợp quy đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm.
Điều 19. Điều kiện bảo đảm an toàn thực phẩm đối với cơ sở sản xuất, kinh doanh thực phẩm
1. Cơ sở sản xuất, kinh doanh thực phẩm phải bảo đảm các điều kiện sau đây:
a) Có địa điểm, diện tích thích hợp, có khoảng cách an toàn đối với nguồn gây độc hại, nguồn gây ô nhiễm và các yếu tố gây hại khác;
b) Có đủ nước đạt quy chuẩn kỹ thuật phục vụ sản xuất, kinh doanh thực phẩm;
c) Có đủ trang thiết bị phù hợp để xử lý nguyên liệu, chế biến, đóng gói, bảo quản và vận chuyển các loại thực phẩm khác nhau; có đủ trang thiết bị, dụng cụ, phương tiện rửa và khử trùng, nước sát trùng, thiết bị phòng, chống côn trùng và động vật gây hại;
d) Có hệ thống xử lý chất thải và được vận hành thường xuyên theo quy định của pháp luật về bảo vệ môi trường;
đ) Duy trì các điều kiện bảo đảm an toàn thực phẩm và lưu giữ hồ sơ về nguồn gốc, xuất xứ nguyên liệu thực phẩm và các tài liệu khác về toàn bộ quá trình sản xuất, kinh doanh thực phẩm;
e) Tuân thủ quy định về sức khoẻ, kiến thức và thực hành của người trực tiếp sản xuất, kinh doanh thực phẩm.
2. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương ban hành quy chuẩn kỹ thuật quốc gia và quy định cụ thể về điều kiện bảo đảm an toàn thực phẩm đối với cơ sở sản xuất, kinh doanh thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 20. Điều kiện bảo đảm an toàn thực phẩm trong bảo quản thực phẩm1. Cơ sở sản xuất, kinh doanh thực phẩm phải bảo đảm các điều kiện về bảo quản thực phẩm sau đây:
a) Nơi bảo quản và phương tiện bảo quản phải có diện tích đủ rộng để bảo quản từng loại thực phẩm riêng biệt, có thể thực hiện kỹ thuật xếp dỡ an toàn và chính xác, bảo đảm vệ sinh trong quá trình bảo quản;
b) Ngăn ngừa được ảnh hưởng của nhiệt độ, độ ẩm, côn trùng, động vật, bụi bẩn, mùi lạ và các tác động xấu của môi trường; bảo đảm đủ ánh sáng; có thiết bị chuyên dụng điều chỉnh nhiệt độ, độ ẩm và các điều kiện khí hậu khác, thiết bị thông gió và các điều kiện bảo quản đặc biệt khác theo yêu cầu của từng loại thực phẩm;
c) Tuân thủ các quy định về bảo quản của tổ chức, cá nhân sản xuất, kinh doanh thực phẩm.
2. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương ban hành quy chuẩn kỹ thuật quốc gia và quy định cụ thể về điều kiện bảo đảm an toàn thực phẩm trong bảo quản thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 21. Điều kiện bảo đảm an toàn thực phẩm trong vận chuyển thực phẩm1. Tổ chức, cá nhân vận chuyển thực phẩm phải bảo đảm các điều kiện sau đây:
a) Phương tiện vận chuyển thực phẩm được chế tạo bằng vật liệu không làm ô nhiễm thực phẩm hoặc bao gói thực phẩm, dễ làm sạch;
b) Bảo đảm điều kiện bảo quản thực phẩm trong suốt quá trình vận chuyển theo hướng dẫn của tổ chức, cá nhân sản xuất, kinh doanh;
c) Không vận chuyển thực phẩm cùng hàng hoá độc hại hoặc có thể gây nhiễm chéo ảnh hưởng đến chất lượng thực phẩm.
2. Cơ quan quản lý nhà nước có thẩm quyền quy định về phương tiện vận chuyển thực phẩm; đường vận chuyển thực phẩm đối với một số loại thực phẩm tươi sống tại các đô thị.
Điều 22. Điều kiện bảo đảm an toàn thực phẩm trong sản xuất, kinh doanh thực phẩm nhỏ lẻ1. Cơ sở sản xuất, kinh doanh thực phẩm nhỏ lẻ phải tuân thủ các điều kiện bảo đảm an toàn thực phẩm sau đây:
a) Có khoảng cách an toàn đối với nguồn gây độc hại, nguồn gây ô nhiễm;
b) Có đủ nước đạt quy chuẩn kỹ thuật phục vụ sản xuất, kinh doanh thực phẩm;
c) Có trang thiết bị phù hợp để sản xuất, kinh doanh thực phẩm không gây độc hại, gây ô nhiễm cho thực phẩm;
d) Sử dụng nguyên liệu, hóa chất, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm trong sơ chế, chế biến, bảo quản thực phẩm;
đ) Tuân thủ quy định về sức khỏe, kiến thức và thực hành của người trực tiếp tham gia sản xuất, kinh doanh thực phẩm;
e) Thu gom, xử lý chất thải theo đúng quy định của pháp luật về bảo vệ môi trường;
h) Duy trì các điều kiện bảo đảm an toàn thực phẩm và lưu giữ thông tin liên quan đến việc mua bán bảo đảm truy xuất được nguồn gốc thực phẩm.
2. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương ban hành quy chuẩn kỹ thuật quốc gia và quy định cụ thể về điều kiện bảo đảm an toàn thực phẩm trong sản xuất, kinh doanh thực phẩm nhỏ lẻ thuộc lĩnh vực được phân công quản lý.
3. Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương (sau đây gọi chung là Ủy ban nhân dân cấp tỉnh) ban hành quy chuẩn kỹ thuật địa phương, quy định cụ thể điều kiện bảo đảm an toàn thực phẩm trong sản xuất, kinh doanh thực phẩm nhỏ lẻ đối với thực phẩm đặc thù trên địa bàn tỉnh.
Mục 2. ĐIỀU KIỆN BẢO ĐẢM AN TOÀN THỰC PHẨM TRONG SẢN XUẤT, KINH DOANH THỰC PHẨM TƯƠI SỐNGĐiều 23. Điều kiện bảo đảm an toàn thực phẩm đối với cơ sở sản xuất thực phẩm tươi sống
1. Cơ sở sản xuất thực phẩm tươi sống phải bảo đảm các điều kiện sau đây:
a) Bảo đảm các điều kiện về đất canh tác, nguồn nước, địa điểm sản xuất để sản xuất thực phẩm an toàn;
b) Tuân thủ các quy định của pháp luật về sử dụng giống cây trồng, giống vật nuôi; phân bón, thức ăn chăn nuôi, thuốc bảo vệ thực vật, thuốc thú y, chất kích thích tăng trưởng, chất tăng trọng, chất phát dục, chất bảo quản thực phẩm và các chất khác có liên quan đến an toàn thực phẩm;
c) Tuân thủ quy định về kiểm dịch, vệ sinh thú y trong giết mổ động vật; về kiểm dịch thực vật đối với sản phẩm trồng trọt;
d) Thực hiện việc xử lý chất thải theo quy định của pháp luật về bảo vệ môi trường;
đ) Chất tẩy rửa, chất diệt khuẩn, chất khử độc khi sử dụng phải bảo đảm an toàn cho con người và môi trường;
e) Duy trì các điều kiện bảo đảm an toàn thực phẩm, lưu giữ hồ sơ về nguồn gốc, xuất xứ nguyên liệu thực phẩm và các tài liệu khác về toàn bộ quá trình sản xuất thực phẩm tươi sống.
2. Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn quy định cụ thể điều kiện bảo đảm an toàn thực phẩm đối với cơ sở sản xuất thực phẩm tươi sống.
Điều 24. Điều kiện bảo đảm an toàn thực phẩm đối với cơ sở kinh doanh thực phẩm tươi sống1. Cơ sở kinh doanh thực phẩm tươi sống phải bảo đảm các điều kiện sau đây:
a) Tuân thủ các điều kiện về bảo đảm an toàn đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm, điều kiện về bảo đảm an toàn trong bảo quản, vận chuyển thực phẩm quy định tại các điều 18, 20 và 21 của Luật này;
b) Bảo đảm và duy trì vệ sinh nơi kinh doanh.
2. Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn quy định cụ thể điều kiện bảo đảm an toàn thực phẩm đối với cơ sở kinh doanh thực phẩm tươi sống.
Mục 3. ĐIỀU KIỆN BẢO ĐẢM AN TOÀN THỰC PHẨM TRONG SƠ CHẾ, CHẾ BIẾN THỰC PHẨM, KINH DOANH THỰC PHẨM ĐÃ QUA CHẾ BIẾNĐiều 25. Điều kiện bảo đảm an toàn thực phẩm đối với cơ sở sơ chế, chế biến thực phẩm
1. Bảo đảm các điều kiện quy định tại Điều 19 của Luật này.
2. Quy trình sơ chế, chế biến phải bảo đảm thực phẩm không bị ô nhiễm chéo, tiếp xúc với các yếu tố gây ô nhiễm hoặc độc hại.
Điều 26. Điều kiện bảo đảm an toàn thực phẩm đối với nguyên liệu, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, vi chất dinh dưỡng dùng để chế biến thực phẩm1. Nguyên liệu dùng để chế biến thực phẩm phải còn thời hạn sử dụng, có nguồn gốc, xuất xứ rõ ràng, bảo đảm an toàn và giữ nguyên các thuộc tính vốn có của nó; các nguyên liệu tạo thành thực phẩm không được tương tác với nhau để tạo ra các sản phẩm gây hại đến sức khoẻ, tính mạng con người.
2. Vi chất dinh dưỡng, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm được sử dụng phải tuân thủ quy định tại Điều 13 và Điều 17 của Luật này.
Điều 27. Điều kiện bảo đảm an toàn thực phẩm đối với cơ sở kinh doanh thực phẩm đã qua chế biến1. Cơ sở kinh doanh thực phẩm đã qua chế biến bao gói sẵn phải bảo đảm các điều kiện sau đây:
a) Tuân thủ quy định về ghi nhãn thực phẩm;
b) Tuân thủ các điều kiện về bảo đảm an toàn đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm, điều kiện về bảo đảm an toàn thực phẩm trong bảo quản thực phẩm quy định tại Điều 18 và Điều 20 của Luật này;
c) Bảo đảm và duy trì vệ sinh nơi kinh doanh;
d) Bảo quản thực phẩm theo đúng hướng dẫn của tổ chức, cá nhân sản xuất.
2. Cơ sở kinh doanh thực phẩm đã qua chế biến không bao gói sẵn phải bảo đảm các điều kiện sau đây:
a) Có biện pháp bảo đảm cho thực phẩm không bị hỏng, mốc, tiếp xúc với côn trùng, động vật, bụi bẩn và các yếu tố gây ô nhiễm khác;
b) Rửa sạch hoặc khử trùng các dụng cụ ăn uống, chứa đựng thực phẩm trước khi sử dụng đối với thực phẩm ăn ngay;
c) Có thông tin về xuất xứ và ngày sản xuất của thực phẩm.
Mục 4. ĐIỀU KIỆN BẢO ĐẢM AN TOÀN THỰC PHẨM TRONG KINH DOANH DỊCH VỤ ĂN UỐNGĐiều 28. Điều kiện bảo đảm an toàn thực phẩm đối với nơi chế biến, kinh doanh dịch vụ ăn uống
1. Bếp ăn được bố trí bảo đảm không nhiễm chéo giữa thực phẩm chưa qua chế biến và thực phẩm đã qua chế biến.
2. Có đủ nước đạt quy chuẩn kỹ thuật phục vụ việc chế biến, kinh doanh.
3. Có dụng cụ thu gom, chứa đựng rác thải, chất thải bảo đảm vệ sinh.
4. Cống rãnh ở khu vực cửa hàng, nhà bếp phải thông thoát, không ứ đọng.
5. Nhà ăn phải thoáng, mát, đủ ánh sáng, duy trì chế độ vệ sinh sạch sẽ, có biện pháp để ngăn ngừa côn trùng và động vật gây hại.
6. Có thiết bị bảo quản thực phẩm, nhà vệ sinh, rửa tay và thu dọn chất thải, rác thải hàng ngày sạch sẽ.
7. Người đứng đầu đơn vị có bếp ăn tập thể có trách nhiệm bảo đảm an toàn thực phẩm.
Điều 29. Điều kiện bảo đảm an toàn thực phẩm đối với cơ sở chế biến, kinh doanh dịch vụ ăn uống1. Có dụng cụ, đồ chứa đựng riêng cho thực phẩm sống và thực phẩm chín.
2. Dụng cụ nấu nướng, chế biến phải bảo đảm an toàn vệ sinh.
3. Dụng cụ ăn uống phải được làm bằng vật liệu an toàn, rửa sạch, giữ khô.
4. Tuân thủ quy định về sức khoẻ, kiến thức và thực hành của người trực tiếp sản xuất, kinh doanh thực phẩm.
Điều 30. Điều kiện bảo đảm an toàn thực phẩm trong chế biến và bảo quản thực phẩm1. Sử dụng thực phẩm, nguyên liệu thực phẩm phải rõ nguồn gốc và bảo đảm an toàn, lưu mẫu thức ăn.
2. Thực phẩm phải được chế biến bảo đảm an toàn, hợp vệ sinh.
3. Thực phẩm bày bán phải để trong tủ kính hoặc thiết bị bảo quản hợp vệ sinh, chống được bụi, mưa, nắng và sự xâm nhập của côn trùng và động vật gây hại; được bày bán trên bàn hoặc giá cao hơn mặt đất.
Mục 5. ĐIỀU KIỆN BẢO ĐẢM AN TOÀN THỰC PHẨM TRONG KINH DOANH THỨC ĂN ĐƯỜNG PHỐĐiều 31. Điều kiện bảo đảm an toàn thực phẩm đối với nơi bày bán thức ăn đường phố
1. Phải cách biệt nguồn gây độc hại, nguồn gây ô nhiễm.
2. Phải được bày bán trên bàn, giá, kệ, phương tiện bảo đảm vệ sinh an toàn thực phẩm, mỹ quan đường phố.
Điều 32. Điều kiện bảo đảm an toàn thực phẩm đối với nguyên liệu, dụng cụ ăn uống, chứa đựng thực phẩm và người kinh doanh thức ăn đường phố1. Nguyên liệu để chế biến thức ăn đường phố phải bảo đảm an toàn thực phẩm, có nguồn gốc, xuất xứ rõ ràng.
2. Dụng cụ ăn uống, chứa đựng thực phẩm phải bảo đảm an toàn vệ sinh.
3. Bao gói và các vật liệu tiếp xúc trực tiếp với thực phẩm không được gây ô nhiễm và thôi nhiễm vào thực phẩm.
4. Có dụng cụ che nắng, mưa, bụi bẩn, côn trùng và động vật gây hại.
5. Có đủ nước đạt quy chuẩn kỹ thuật phục vụ việc chế biến, kinh doanh.
6. Tuân thủ quy định về sức khoẻ, kiến thức và thực hành đối với người trực tiếp sản xuất, kinh doanh thực phẩm.
Điều 33. Trách nhiệm quản lý kinh doanh thức ăn đường phố1. Bộ trưởng Bộ Y tế quy định cụ thể điều kiện bảo đảm an toàn thực phẩm trong kinh doanh thức ăn đường phố.
2. Ủy ban nhân dân các cấp có trách nhiệm quản lý hoạt động kinh doanh thức ăn đường phố trên địa bàn.
1. Cơ sở được cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm khi có đủ các điều kiện sau đây:
a) Có đủ điều kiện bảo đảm an toàn thực phẩm phù hợp với từng loại hình sản xuất, kinh doanh thực phẩm theo quy định tại Chương IV của Luật này;
b) Có đăng ký ngành, nghề kinh doanh thực phẩm trong Giấy chứng nhận đăng ký kinh doanh.
2. Tổ chức, cá nhân bị thu hồi Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm khi không đủ điều kiện quy định tại khoản 1 Điều này.
3. Chính phủ quy định cụ thể đối tượng không thuộc diện cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm.
Điều 35. Thẩm quyền cấp, thu hồi Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩmBộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn, Bộ trưởng Bộ Công thương quy định cụ thể thẩm quyền cấp, thu hồi Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 36. Hồ sơ, trình tự, thủ tục cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm1. Hồ sơ xin cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm gồm có:
a) Đơn đề nghị cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm;
b) Bản sao Giấy chứng nhận đăng ký kinh doanh;
c) Bản thuyết minh về cơ sở vật chất, trang thiết bị, dụng cụ bảo đảm điều kiện vệ sinh an toàn thực phẩm theo quy định của cơ quan quản lý nhà nước có thẩm quyền;
d) Giấy xác nhận đủ sức khoẻ của chủ cơ sở và người trực tiếp sản xuất, kinh doanh thực phẩm do cơ sở y tế cấp huyện trở lên cấp;
đ) Giấy xác nhận đã được tập huấn kiến thức về an toàn vệ sinh thực phẩm của chủ cơ sở và của người trực tiếp sản xuất, kinh doanh thực phẩm theo quy định của Bộ trưởng Bộ quản lý ngành.
2. Trình tự, thủ tục cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm được quy định như sau:
a) Tổ chức, cá nhân sản xuất, kinh doanh thực phẩm nộp hồ sơ xin cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm cho cơ quan nhà nước có thẩm quyền quy định tại Điều 35 của Luật này;
b) Trong thời hạn 15 ngày, kể từ ngày nhận đủ hồ sơ hợp lệ, cơ quan nhà nước có thẩm quyền kiểm tra thực tế điều kiện bảo đảm an toàn thực phẩm tại cơ sở sản xuất, kinh doanh thực phẩm; nếu đủ điều kiện thì phải cấp Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm; trường hợp từ chối thì phải trả lời bằng văn bản và nêu rõ lý do.
Điều 37. Thời hạn hiệu lực của Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm1. Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm có hiệu lực trong thời gian 03 năm.
2. Trước 06 tháng tính đến ngày Giấy chứng nhận cơ sở đủ điều kiện an toàn thực phẩm hết hạn, tổ chức, cá nhân sản xuất, kinh doanh thực phẩm phải nộp hồ sơ xin cấp lại Giấy chứng nhận trong trường hợp tiếp tục sản xuất, kinh doanh. Hồ sơ, trình tự, thủ tục cấp lại được thực hiện theo quy định tại Điều 36 của Luật này.
Điều 38. Điều kiện bảo đảm an toàn đối với thực phẩm nhập khẩu
1. Thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm nhập khẩu phải tuân thủ các điều kiện tương ứng quy định tại Chương III của Luật này và các điều kiện sau đây:
a) Phải được đăng ký bản công bố hợp quy tại cơ quan nhà nước có thẩm quyền trước khi nhập khẩu;
b) Phải được cấp “Thông báo kết quả xác nhận thực phẩm đạt yêu cầu nhập khẩu” đối với từng lô hàng của cơ quan kiểm tra được chỉ định theo quy định của Bộ trưởng Bộ quản lý ngành.
2. Ngoài các điều kiện quy định tại khoản 1 Điều này, thực phẩm chức năng, thực phẩm tăng cường vi chất dinh dưỡng, thực phẩm biến đổi gen, thực phẩm đã qua chiếu xạ phải có giấy chứng nhận lưu hành tự do hoặc giấy chứng nhận y tế theo quy định của Chính phủ.
3. Trong trường hợp Việt Nam chưa có quy chuẩn kỹ thuật tương ứng đối với thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm nhập khẩu thì áp dụng theo thỏa thuận quốc tế, điều ước quốc tế mà Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên.
Điều 39. Kiểm tra nhà nước về an toàn thực phẩm đối với thực phẩm nhập khẩu1. Thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm nhập khẩu phải được kiểm tra nhà nước về an toàn thực phẩm, trừ một số thực phẩm được miễn kiểm tra nhà nước về an toàn thực phẩm theo quy định của Chính phủ.
2. Thực phẩm nhập khẩu từ nước có ký kết điều ước quốc tế với Việt Nam về thừa nhận lẫn nhau đối với hoạt động chứng nhận an toàn thực phẩm được áp dụng chế độ kiểm tra giảm, trừ trường hợp có cảnh báo hoặc phát hiện có dấu hiệu vi phạm các quy định của pháp luật Việt Nam về an toàn thực phẩm.
3. Chính phủ quy định cụ thể việc miễn kiểm tra nhà nước về an toàn thực phẩm đối với một số thực phẩm nhập khẩu; trình tự, thủ tục kiểm tra nhà nước về an toàn thực phẩm tại nước sẽ xuất khẩu thực phẩm vào Việt Nam theo điều ước quốc tế mà Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên.
Điều 40. Trình tự, thủ tục và phương thức kiểm tra nhà nước về an toàn thực phẩm đối với thực phẩm nhập khẩu1. Trình tự, thủ tục kiểm tra nhà nước về an toàn thực phẩm đối với thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm nhập khẩu được thực hiện theo quy định của pháp luật về chất lượng sản phẩm, hàng hóa và các quy định sau đây:
a) Chỉ được đưa về kho bảo quản chờ hoàn thành việc thông quan khi có giấy đăng ký kiểm tra an toàn thực phẩm;
b) Chỉ được thông quan khi có xác nhận kết quả kiểm tra thực phẩm đạt yêu cầu nhập khẩu.
2. Phương thức kiểm tra nhà nước về an toàn thực phẩm đối với thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm nhập khẩu bao gồm:
3. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương quy định cụ thể cơ quan kiểm tra nhà nước về an toàn thực phẩm, việc áp dụng phương thức kiểm tra nhà nước về an toàn thực phẩm đối với thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, dụng cụ, vật liệu bao gói, chứa đựng thực phẩm nhập khẩu thuộc lĩnh vực được phân công quản lý.
Mục 2. ĐIỀU KIỆN BẢO ĐẢM AN TOÀN ĐỐI VỚI THỰC PHẨM XUẤT KHẨUĐiều 41. Điều kiện bảo đảm an toàn đối với thực phẩm xuất khẩu
1. Đáp ứng các điều kiện bảo đảm an toàn thực phẩm của Việt Nam.
2. Phù hợp với quy định về an toàn thực phẩm của nước nhập khẩu theo hợp đồng hoặc điều ước quốc tế, thỏa thuận quốc tế thừa nhận lẫn nhau về kết quả đánh giá sự phù hợp với quốc gia, vùng lãnh thổ có liên quan.
Điều 42. Chứng nhận đối với thực phẩm xuất khẩu1. Cơ quan nhà nước có thẩm quyền của Việt Nam cấp giấy chứng nhận lưu hành tự do, chứng nhận y tế, chứng nhận nguồn gốc, xuất xứ hoặc giấy chứng nhận khác có liên quan đối với thực phẩm xuất khẩu trong trường hợp có yêu cầu của nước nhập khẩu.
2. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương quy định hồ sơ, thủ tục cấp các loại giấy chứng nhận quy định tại khoản 1 Điều này thuộc lĩnh vực được phân công quản lý.
1. Việc quảng cáo thực phẩm do tổ chức, cá nhân sản xuất, kinh doanh thực phẩm hoặc người kinh doanh dịch vụ quảng cáo thực hiện theo quy định của pháp luật về quảng cáo.
2. Trước khi đăng ký quảng cáo, tổ chức, cá nhân có thực phẩm cần quảng cáo phải gửi hồ sơ tới cơ quan quản lý nhà nước có thẩm quyền để xác nhận nội dung quảng cáo.
3. Người phát hành quảng cáo, người kinh doanh dịch vụ quảng cáo, tổ chức, cá nhân có thực phẩm quảng cáo chỉ được tiến hành quảng cáo khi đã được thẩm định nội dung và chỉ được quảng cáo đúng nội dung đã được xác nhận.
Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương quy định cụ thể loại thực phẩm phải đăng ký quảng cáo, thẩm quyền, trình tự, thủ tục xác nhận nội dung quảng cáo thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 44. Ghi nhãn thực phẩm1. Tổ chức, cá nhân sản xuất, nhập khẩu thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm tại Việt Nam phải thực hiện việc ghi nhãn thực phẩm theo quy định của pháp luật về nhãn hàng hóa.
Đối với thời hạn sử dụng thực phẩm thể hiện trên nhãn thì tùy theo loại sản phẩm được ghi là “hạn sử dụng”, “sử dụng đến ngày” hoặc “sử dụng tốt nhất trước ngày”.
2. Đối với thực phẩm chức năng, phụ gia thực phẩm, thực phẩm đã qua chiếu xạ, thực phẩm biến đổi gen, ngoài các quy định tại khoản 1 Điều này còn phải tuân thủ các quy định sau đây:
a) Đối với thực phẩm chức năng phải ghi cụm từ “thực phẩm chức năng” và không được thể hiện dưới bất kỳ hình thức nào về tác dụng thay thế thuốc chữa bệnh;
b) Đối với phụ gia thực phẩm phải ghi cụm từ “phụ gia thực phẩm” và các thông tin về phạm vi, liều lượng, cách sử dụng;
c) Đối với thực phẩm đã qua chiếu xạ phải ghi cụm từ “thực phẩm đã qua chiếu xạ”;
d) Đối với một số thực phẩm biến đổi gen phải ghi cụm từ “thực phẩm biến đổi gen”.
3. Căn cứ điều kiện kinh tế - xã hội trong từng thời kỳ, Chính phủ quy định cụ thể về ghi nhãn thực phẩm, thời hạn sử dụng thực phẩm; quy định cụ thể thực phẩm biến đổi gen phải ghi nhãn, mức tỷ lệ thành phần thực phẩm có gen biến đổi phải ghi nhãn.
Điều 45. Yêu cầu đối với việc kiểm nghiệm thực phẩm
1. Kiểm nghiệm thực phẩm được thực hiện trong các trường hợp sau đây:
a) Theo yêu cầu của tổ chức, cá nhân sản xuất, kinh doanh thực phẩm hoặc tổ chức, cá nhân khác có liên quan;
b) Phục vụ hoạt động quản lý nhà nước về an toàn thực phẩm.
Việc kiểm nghiệm thực phẩm phục vụ hoạt động quản lý nhà nước được thực hiện tại cơ sở kiểm nghiệm thực phẩm do Bộ trưởng Bộ quản lý ngành chỉ định.
2. Việc kiểm nghiệm thực phẩm phải bảo đảm các yêu cầu sau đây:
a) Khách quan, chính xác;
b) Tuân thủ các quy định về chuyên môn kỹ thuật.
Điều 46. Cơ sở kiểm nghiệm thực phẩm1. Cơ sở kiểm nghiệm thực phẩm phải đáp ứng các điều kiện sau đây:
a) Có bộ máy tổ chức và năng lực kỹ thuật đáp ứng yêu cầu của tiêu chuẩn quốc gia, tiêu chuẩn quốc tế đối với cơ sở kiểm nghiệm;
b) Thiết lập và duy trì hệ thống quản lý phù hợp với yêu cầu của tiêu chuẩn quốc gia, tiêu chuẩn quốc tế;
c) Đăng ký hoạt động đánh giá sự phù hợp với tiêu chuẩn, quy chuẩn kỹ thuật với cơ quan nhà nước có thẩm quyền trong trường hợp thực hiện hoạt động chứng nhận hợp chuẩn, hợp quy.
2. Cơ sở kiểm nghiệm thực phẩm được cung cấp dịch vụ kiểm nghiệm, thu phí kiểm nghiệm và phải chịu trách nhiệm trước pháp luật về kết quả kiểm nghiệm do mình thực hiện.
3. Bộ trưởng Bộ quản lý ngành quy định cụ thể điều kiện của cơ sở kiểm nghiệm quy định tại khoản 1 Điều này.
Điều 47. Kiểm nghiệm phục vụ giải quyết tranh chấp về an toàn thực phẩm1. Cơ quan có thẩm quyền giải quyết tranh chấp chỉ định cơ sở kiểm nghiệm kiểm chứng để thực hiện kiểm nghiệm thực phẩm về nội dung tranh chấp. Kết quả kiểm nghiệm của cơ sở kiểm nghiệm kiểm chứng được sử dụng làm căn cứ giải quyết tranh chấp về an toàn thực phẩm.
2. Cơ sở kiểm nghiệm được chỉ định làm kiểm chứng là cơ sở kiểm nghiệm của Nhà nước, có đủ điều kiện theo quy định tại khoản 1 Điều 46 của Luật này.
3. Bộ trưởng Bộ quản lý ngành quy định điều kiện đối với cơ sở kiểm nghiệm kiểm chứng, Danh mục cơ sở kiểm nghiệm kiểm chứng đủ điều kiện hoạt động.
Điều 48. Chi phí lấy mẫu và kiểm nghiệm thực phẩm1. Chi phí lấy mẫu và kiểm nghiệm thực phẩm để kiểm tra, thanh tra an toàn thực phẩm do cơ quan quyết định việc kiểm tra, thanh tra chi trả.
2. Căn cứ kết quả kiểm nghiệm, cơ quan ra quyết định kiểm tra, thanh tra an toàn thực phẩm kết luận tổ chức, cá nhân sản xuất, kinh doanh thực phẩm vi phạm quy định của pháp luật về an toàn thực phẩm thì tổ chức, cá nhân đó phải hoàn trả chi phí lấy mẫu và kiểm nghiệm cho cơ quan kiểm tra, thanh tra.
3. Tổ chức, cá nhân có yêu cầu lấy mẫu và kiểm nghiệm thực phẩm phải tự chi trả chi phí lấy mẫu và kiểm nghiệm.
4. Chi phí lấy mẫu và kiểm nghiệm trong tranh chấp, khiếu nại về an toàn thực phẩm do người khởi kiện, khiếu nại chi trả. Trường hợp kết quả kiểm nghiệm khẳng định tổ chức, cá nhân sản xuất, kinh doanh thực phẩm vi phạm quy định về an toàn thực phẩm thì tổ chức, cá nhân đó phải hoàn trả chi phí lấy mẫu và kiểm nghiệm an toàn thực phẩm tranh chấp cho người khởi kiện, khiếu nại.
Mục 2. PHÂN TÍCH NGUY CƠ ĐỐI VỚI AN TOÀN THỰC PHẨMĐiều 49. Đối tượng phải được phân tích nguy cơ đối với an toàn thực phẩm
1. Thực phẩm có tỷ lệ gây ngộ độc cao.
2. Thực phẩm có kết quả lấy mẫu để giám sát cho thấy tỷ lệ vi phạm các quy chuẩn kỹ thuật về an toàn thực phẩm ở mức cao.
3. Môi trường, cơ sở sản xuất, kinh doanh thực phẩm bị nghi ngờ gây ô nhiễm.
4. Thực phẩm, cơ sở sản xuất, kinh doanh thực phẩm được phân tích nguy cơ theo yêu cầu quản lý.
Điều 50. Hoạt động phân tích nguy cơ đối với an toàn thực phẩm1. Việc phân tích nguy cơ đối với an toàn thực phẩm bao gồm các hoạt động về đánh giá, quản lý và truyền thông về nguy cơ đối với an toàn thực phẩm.
2. Việc đánh giá nguy cơ đối với an toàn thực phẩm bao gồm:
a) Điều tra, xét nghiệm xác định các mối nguy đối với an toàn thực phẩm thuộc các nhóm tác nhân về vi sinh, hoá học và vật lý;
b) Xác định nguy cơ của các mối nguy đối với an toàn thực phẩm ảnh hưởng đến sức khoẻ, mức độ và phạm vi ảnh hưởng của các mối nguy đối với sức khoẻ cộng đồng.
3. Việc quản lý nguy cơ đối với an toàn thực phẩm bao gồm:
a) Thực hiện các giải pháp hạn chế nguy cơ an toàn thực phẩm trong từng công đoạn của chuỗi cung cấp thực phẩm;
b) Kiểm soát, phối hợp nhằm hạn chế nguy cơ đối với an toàn thực phẩm trong kinh doanh dịch vụ ăn uống và các hoạt động sản xuất, kinh doanh thực phẩm khác.
4. Việc truyền thông về nguy cơ đối với an toàn thực phẩm bao gồm:
a) Cung cấp thông tin về các biện pháp phòng tránh khi xảy ra các vụ ngộ độc thực phẩm, bệnh truyền qua thực phẩm do thực phẩm mất an toàn gây ra nhằm nâng cao nhận thức và ý thức trách nhiệm của người dân về nguy cơ đối với an toàn thực phẩm;
b) Thông báo, dự báo nguy cơ đối với an toàn thực phẩm; xây dựng hệ thống thông tin cảnh báo nguy cơ đối với an toàn thực phẩm, các bệnh truyền qua thực phẩm.
Điều 51. Trách nhiệm thực hiện phân tích nguy cơ đối với an toàn thực phẩmBộ Y tế, Bộ Nông nghiệp và Phát triển Nông thôn, Bộ Công thương tổ chức việc phân tích nguy cơ đối với an toàn thực phẩm thuộc lĩnh vực được phân công quản lý theo quy định tại Điều 49 và Điều 50 của Luật này.
Mục 3. PHÒNG NGỪA, NGĂN CHẶN VÀ KHẮC PHỤC SỰ CỐ VỀ AN TOÀN THỰC PHẨMĐiều 52. Phòng ngừa, ngăn chặn sự cố về an toàn thực phẩm
1. Tổ chức, cá nhân phát hiện dấu hiệu liên quan đến sự cố về an toàn thực phẩm có trách nhiệm thông báo ngay cho cơ sở khám bệnh, chữa bệnh, Ủy ban nhân dân địa phương nơi gần nhất hoặc cơ quan nhà nước có thẩm quyền để có biện pháp ngăn chặn kịp thời.
2. Các biện pháp phòng ngừa, ngăn chặn sự cố về an toàn thực phẩm bao gồm:
a) Bảo đảm an toàn trong quá trình sản xuất, kinh doanh và sử dụng thực phẩm;
b) Giáo dục, tuyên truyền, phổ biến kiến thức và thực hành về an toàn thực phẩm cho tổ chức, cá nhân sản xuất, kinh doanh và người tiêu dùng;
c) Kiểm tra, thanh tra an toàn thực phẩm trong sản xuất, kinh doanh thực phẩm;
d) Phân tích nguy cơ ô nhiễm thực phẩm;
đ) Điều tra, khảo sát và lưu trữ các số liệu về an toàn thực phẩm;
e) Lưu mẫu thực phẩm.
3. Ủy ban nhân dân các cấp có trách nhiệm tổ chức thực hiện các biện pháp phòng ngừa, ngăn chặn sự cố về an toàn thực phẩm trong phạm vi địa phương.
4. Bộ Y tế, Bộ Nông nghiệp và Phát triển Nông thôn, Bộ Công thương tổ chức thực hiện chương trình giám sát, phòng ngừa, ngăn chặn sự cố an toàn thực phẩm; tổ chức thực hiện các biện pháp phòng ngừa, ngăn chặn đối với những sự cố về an toàn thực phẩm ở nước ngoài có nguy cơ ảnh hưởng đến Việt Nam thuộc lĩnh vực được phân công quản lý.
5. Bộ Y tế chủ trì, phối hợp với các bộ, ngành có liên quan xây dựng hệ thống cảnh báo sự cố an toàn thực phẩm.
Điều 53. Khắc phục sự cố về an toàn thực phẩm1. Tổ chức, cá nhân phát hiện sự cố về an toàn thực phẩm xảy ra trong nước hoặc nước ngoài nhưng có ảnh hưởng tới Việt Nam phải khai báo với cơ sở y tế, Ủy ban nhân dân địa phương nơi gần nhất hoặc Bộ Y tế, Bộ Nông nghiệp và Phát triển Nông thôn, Bộ Công thương để có biện pháp khắc phục kịp thời.
2. Các biện pháp khắc phục sự cố về an toàn thực phẩm bao gồm:
a) Phát hiện, cấp cứu, điều trị kịp thời cho người bị ngộ độc thực phẩm, bệnh truyền qua thực phẩm hoặc các tình huống khác phát sinh từ thực phẩm gây hại đến sức khỏe, tính mạng con người;
b) Điều tra vụ ngộ độc thực phẩm, xác định nguyên nhân gây ngộ độc, bệnh truyền qua thực phẩm và truy xuất nguồn gốc thực phẩm gây ngộ độc, truyền bệnh;
c) Đình chỉ sản xuất, kinh doanh; thu hồi và xử lý thực phẩm gây ngộ độc, truyền bệnh đang lưu thông trên thị trường;
d) Thông báo ngộ độc thực phẩm và bệnh truyền qua thực phẩm cho các tổ chức, cá nhân có liên quan;
đ) Thực hiện các biện pháp phòng ngừa nguy cơ gây ngộ độc thực phẩm, bệnh truyền qua thực phẩm.
3. Ủy ban nhân dân các cấp có trách nhiệm tổ chức thực hiện các biện pháp khắc phục sự cố về an toàn thực phẩm trong phạm vi địa phương.
4. Bộ trưởng Bộ Y tế có trách nhiệm:
a) Quy định cụ thể việc khai báo sự cố về an toàn thực phẩm;
b) Chủ trì, phối hợp với các bộ, ngành có liên quan tổ chức thực hiện các biện pháp ngăn chặn sự cố về an toàn thực phẩm xảy ra ở nước ngoài có nguy cơ ảnh hưởng tới Việt Nam.
5. Tổ chức, cá nhân cung cấp thực phẩm mà gây ngộ độc phải chịu toàn bộ chi phí điều trị cho người bị ngộ độc và bồi thường thiệt hại theo quy định của pháp luật về dân sự.
Mục 4. TRUY XUẤT NGUỒN GỐC THỰC PHẨM, THU HỒI VÀ XỬ LÝ ĐỐI VỚI THỰC PHẨM KHÔNG BẢO ĐẢM AN TOÀNĐiều 54. Truy xuất nguồn gốc thực phẩm đối với thực phẩm không bảo đảm an toàn
1. Việc truy xuất nguồn gốc thực phẩm đối với thực phẩm không bảo đảm an toàn do tổ chức, cá nhân sản xuất, kinh doanh thực phẩm thực hiện trong các trường hợp sau đây:
a) Khi cơ quan nhà nước có thẩm quyền yêu cầu;
b) Khi phát hiện thực phẩm do mình sản xuất, kinh doanh không bảo đảm an toàn.
2. Tổ chức, cá nhân sản xuất, kinh doanh thực phẩm thực hiện việc truy xuất nguồn gốc thực phẩm đối với thực phẩm không bảo đảm an toàn phải thực hiện các việc sau đây:
a) Xác định, thông báo lô sản phẩm thực phẩm không bảo đảm an toàn;
b) Yêu cầu các đại lý kinh doanh thực phẩm báo cáo số lượng sản phẩm của lô sản phẩm thực phẩm không bảo đảm an toàn, tồn kho thực tế và đang lưu thông trên thị trường;
c) Tổng hợp, báo cáo cơ quan nhà nước có thẩm quyền về kế hoạch thu hồi và biện pháp xử lý.
3. Cơ quan nhà nước có thẩm quyền có trách nhiệm kiểm tra, giám sát việc thực hiện truy xuất nguồn gốc thực phẩm đối với thực phẩm không bảo đảm an toàn.
Điều 55. Thu hồi và xử lý đối với thực phẩm không bảo đảm an toàn1. Thực phẩm phải được thu hồi trong các trường hợp sau đây:
a) Thực phẩm hết thời hạn sử dụng mà vẫn bán trên thị trường;
b) Thực phẩm không phù hợp với quy chuẩn kỹ thuật tương ứng;
c) Thực phẩm là sản phẩm công nghệ mới chưa được phép lưu hành;
d) Thực phẩm bị hư hỏng trong quá trình bảo quản, vận chuyển, kinh doanh;
đ) Thực phẩm có chất cấm sử dụng hoặc xuất hiện tác nhân gây ô nhiễm vượt mức giới hạn quy định;
e) Thực phẩm nhập khẩu bị cơ quan có thẩm quyền nước xuất khẩu, nước khác hoặc tổ chức quốc tế thông báo có chứa tác nhân gây ô nhiễm gây hại đến sức khoẻ, tính mạng con người.
2. Thực phẩm không bảo đảm an toàn bị thu hồi theo các hình thức sau đây:
a) Thu hồi tự nguyện do tổ chức, cá nhân sản xuất, kinh doanh thực phẩm tự thực hiện;
b) Thu hồi bắt buộc do cơ quan nhà nước có thẩm quyền yêu cầu đối với tổ chức, cá nhân sản xuất, kinh doanh thực phẩm không bảo đảm an toàn.
3. Các hình thức xử lý thực phẩm không bảo đảm an toàn bao gồm:
a) Khắc phục lỗi của sản phẩm, lỗi ghi nhãn;
c) Tái xuất;
d) Tiêu hủy.
4. Tổ chức, cá nhân sản xuất, kinh doanh thực phẩm không bảo đảm an toàn có trách nhiệm công bố thông tin về sản phẩm bị thu hồi và chịu trách nhiệm thu hồi, xử lý thực phẩm không bảo đảm an toàn trong thời hạn do cơ quan nhà nước có thẩm quyền quyết định; chịu mọi chi phí cho việc thu hồi, xử lý thực phẩm không bảo đảm an toàn.
Trong trường hợp quá thời hạn thu hồi mà tổ chức, cá nhân sản xuất, kinh doanh thực phẩm không thực hiện việc thu hồi thì bị cưỡng chế thu hồi theo quy định của pháp luật.
5. Cơ quan nhà nước có thẩm quyền có trách nhiệm:
a) Căn cứ vào mức độ vi phạm về điều kiện bảo đảm an toàn, quyết định việc thu hồi, xử lý thực phẩm không bảo đảm an toàn, thời hạn hoàn thành việc thu hồi, xử lý thực phẩm không bảo đảm an toàn;
b) Kiểm tra việc thu hồi thực phẩm không bảo đảm an toàn;
c) Xử lý vi phạm pháp luật về an toàn thực phẩm theo thẩm quyền do pháp luật quy định;
d) Trong trường hợp thực phẩm có nguy cơ gây ảnh hưởng nghiêm trọng đối với sức khỏe cộng đồng hoặc các trường hợp khẩn cấp khác, cơ quan nhà nước có thẩm quyền trực tiếp tổ chức thu hồi, xử lý thực phẩm và yêu cầu tổ chức, cá nhân sản xuất, kinh doanh thực phẩm không bảo đảm an toàn thanh toán chi phí cho việc thu hồi, xử lý thực phẩm.
6. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Nông nghiệp và Phát triển Nông thôn, Bộ trưởng Bộ Công thương quy định cụ thể việc thu hồi và xử lý đối với thực phẩm không bảo đảm an toàn thuộc lĩnh vực được phân công quản lý.
1. Thông tin, giáo dục, truyền thông về an toàn thực phẩm nhằm nâng cao nhận thức về an toàn thực phẩm, thay đổi hành vi, phong tục, tập quán sản xuất, kinh doanh, sinh hoạt, ăn uống lạc hậu, gây mất an toàn thực phẩm, góp phần bảo vệ sức khỏe, tính mạng con người; đạo đức kinh doanh, ý thức trách nhiệm của tổ chức, cá nhân sản xuất, kinh doanh với sức khỏe, tính mạng của người tiêu dùng thực phẩm.
2. Việc cung cấp thông tin, giáo dục, truyền thông về an toàn thực phẩm phải bảo đảm các yêu cầu sau đây:
a) Chính xác, kịp thời, rõ ràng, đơn giản, thiết thực;
b) Phù hợp với truyền thống, văn hoá, bản sắc dân tộc, tôn giáo, đạo đức xã hội, tín ngưỡng và phong tục tập quán;
c) Phù hợp với từng loại đối tượng được tuyên truyền.
Điều 57. Nội dung thông tin, giáo dục, truyền thông về an toàn thực phẩm1. Thông tin, tuyên truyền, phổ biến kiến thức, pháp luật về an toàn thực phẩm.
2. Nguyên nhân, cách nhận biết nguy cơ gây ngộ độc thực phẩm, bệnh truyền qua thực phẩm và các biện pháp phòng, chống sự cố về an toàn thực phẩm.
3. Thông tin về các điển hình sản xuất, kinh doanh thực phẩm bảo đảm an toàn; việc thu hồi thực phẩm không bảo đảm an toàn, xử lý đối với cơ sở vi phạm nghiêm trọng pháp luật về an toàn thực phẩm.
Điều 58. Đối tượng tiếp cận thông tin, giáo dục, truyền thông về an toàn thực phẩm1. Tổ chức, cá nhân được quyền tiếp cận thông tin, giáo dục, truyền thông về an toàn thực phẩm.
2. Ưu tiên tiếp cận thông tin, giáo dục, truyền thông về an toàn thực phẩm cho các đối tượng sau đây:
a) Người tiêu dùng thực phẩm;
b) Người quản lý, điều hành các cơ sở sản xuất, kinh doanh thực phẩm; người trực tiếp sản xuất, kinh doanh thực phẩm;
c) Tổ chức, cá nhân sản xuất, kinh doanh thực phẩm tươi sống, sản xuất, kinh doanh thực phẩm nhỏ lẻ; người dân khu vực có điều kiện kinh tế - xã hội đặc biệt khó khăn.
Điều 59. Hình thức thông tin, giáo dục, truyền thông về an toàn thực phẩm1. Thực hiện thông qua các cơ quan nhà nước có thẩm quyền về an toàn thực phẩm.
2. Thông qua các phương tiện thông tin đại chúng.
3. Lồng ghép trong việc giảng dạy, học tập tại các cơ sở giáo dục thuộc hệ thống giáo dục quốc dân.
4. Thông qua hoạt động văn hóa, sinh hoạt cộng đồng, sinh hoạt của các đoàn thể, tổ chức xã hội và các loại hình văn hoá quần chúng khác.
5. Thông qua điểm hỏi đáp về an toàn thực phẩm tại các Bộ quản lý ngành.
Điều 60. Trách nhiệm trong thông tin, giáo dục, truyền thông về an toàn thực phẩm1. Cơ quan, tổ chức, đơn vị trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm thông tin, giáo dục, truyền thông về an toàn thực phẩm.
2. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ quản lý ngành và Thủ trưởng cơ quan ngang bộ có liên quan có trách nhiệm chỉ đạo các cơ quan hữu quan cung cấp chính xác và khoa học các thông tin về an toàn thực phẩm; kịp thời phản hồi thông tin không đúng sự thật về an toàn thực phẩm.
3. Bộ trưởng Bộ Thông tin và Truyền thông có trách nhiệm chỉ đạo các cơ quan thông tin đại chúng thường xuyên thông tin, truyền thông về an toàn thực phẩm, lồng ghép chương trình thông tin, truyền thông về an toàn thực phẩm với các chương trình thông tin, truyền thông khác.
4. Bộ trưởng Bộ Giáo dục và Đào tạo có trách nhiệm chủ trì, phối hợp với Bộ trưởng Bộ Y tế, Bộ trưởng Bộ quản lý ngành và Thủ trưởng cơ quan ngang bộ có liên quan xây dựng nội dung giáo dục an toàn thực phẩm kết hợp với các nội dung giáo dục khác.
5. Ủy ban nhân dân các cấp có trách nhiệm tổ chức thực hiện công tác thông tin, giáo dục, truyền thông về an toàn thực phẩm cho nhân dân trên địa bàn.
6. Các cơ quan thông tin đại chúng có trách nhiệm ưu tiên về thời điểm, thời lượng phát sóng để thông tin, giáo dục, truyền thông về an toàn thực phẩm trên đài phát thanh, đài truyền hình; dung lượng và vị trí đăng trên báo in, báo hình, báo điện tử theo quy định của Bộ trưởng Bộ Thông tin và Truyền thông. Việc thông tin, giáo dục, truyền thông về an toàn thực phẩm trên các phương tiện thông tin đại chúng không thu phí, trừ trường hợp thực hiện theo hợp đồng riêng với chương trình, dự án hoặc do tổ chức, cá nhân trong nước, tổ chức, cá nhân nước ngoài tài trợ.
7. Mặt trận Tổ quốc Việt Nam, các đoàn thể, tổ chức xã hội có trách nhiệm thông tin, giáo dục, truyền thông về an toàn thực phẩm thuộc phạm vi trách nhiệm của mình.
Điều 61. Trách nhiệm quản lý nhà nước về an toàn thực phẩm
1. Chính phủ thống nhất quản lý nhà nước về an toàn thực phẩm.
2. Bộ Y tế chịu trách nhiệm trước Chính phủ thực hiện quản lý nhà nước về an toàn thực phẩm.
3. Các bộ, cơ quan ngang bộ trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm phối hợp với Bộ Y tế thực hiện quản lý nhà nước về an toàn thực phẩm.
4. Ủy ban nhân dân các cấp thực hiện quản lý nhà nước về an toàn thực phẩm trong phạm vi địa phương.
Điều 62. Trách nhiệm quản lý nhà nước về an toàn thực phẩm của Bộ Y tế1. Trách nhiệm chung:
a) Chủ trì xây dựng, trình cơ quan nhà nước có thẩm quyền ban hành và tổ chức thực hiện chiến lược quốc gia, quy hoạch tổng thể về an toàn thực phẩm;
b) Ban hành quy chuẩn kỹ thuật quốc gia về chỉ tiêu và mức giới hạn an toàn đối với sản phẩm thực phẩm; dụng cụ, vật liệu bao gói, chứa đựng thực phẩm;
c) Yêu cầu các bộ, ngành, Ủy ban nhân dân cấp tỉnh báo cáo định kỳ, đột xuất về công tác quản lý an toàn thực phẩm;
d) Quy định về điều kiện chung bảo đảm an toàn thực phẩm đối với cơ sở sản xuất, kinh doanh thực phẩm;
đ) Chủ trì tổ chức thực hiện công tác tuyên truyền, giáo dục pháp luật về an toàn thực phẩm; cảnh báo sự cố ngộ độc thực phẩm;
e) Thanh tra, kiểm tra đột xuất đối với toàn bộ quá trình sản xuất, nhập khẩu, kinh doanh thực phẩm thuộc phạm vi quản lý của các bộ khác khi cần thiết.
2. Trách nhiệm trong quản lý ngành:
a) Chủ trì xây dựng, ban hành hoặc trình cơ quan nhà nước có thẩm quyền ban hành và tổ chức thực hiện chiến lược, chính sách, quy hoạch, kế hoạch và văn bản quy phạm pháp luật về an toàn thực phẩm thuộc lĩnh vực được phân công quản lý;
b) Quản lý an toàn thực phẩm trong suốt quá trình sản xuất, sơ chế, chế biến, bảo quản, vận chuyển, xuất khẩu, nhập khẩu, kinh doanh đối với phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, nước uống đóng chai, nước khoáng thiên nhiên, thực phẩm chức năng và các thực phẩm khác theo quy định của Chính phủ;
c) Quản lý an toàn thực phẩm đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm trong quá trình sản xuất, chế biến, kinh doanh thực phẩm thuộc lĩnh vực được phân công quản lý;
d) Thanh tra, kiểm tra, xử lý vi phạm pháp luật về an toàn thực phẩm trong quá trình sản xuất, xuất khẩu, nhập khẩu, kinh doanh thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 63. Trách nhiệm của Bộ Nông nghiệp và Phát triển Nông thôn1. Chủ trì xây dựng, ban hành hoặc trình cơ quan nhà nước có thẩm quyền ban hành và tổ chức thực hiện các chính sách, chiến lược, quy hoạch, kế hoạch, văn bản quy phạm pháp luật về an toàn thực phẩm thuộc lĩnh vực được phân công quản lý.
2. Quản lý an toàn thực phẩm đối với sản xuất ban đầu nông, lâm, thủy sản, muối.
3. Quản lý an toàn thực phẩm trong suốt quá trình sản xuất, thu gom, giết mổ, sơ chế, chế biến, bảo quản, vận chuyển, xuất khẩu, nhập khẩu, kinh doanh đối với ngũ cốc, thịt và các sản phẩm từ thịt, thủy sản và sản phẩm thủy sản, rau, củ, quả và sản phẩm rau, củ, quả, trứng và các sản phẩm từ trứng, sữa tươi nguyên liệu, mật ong và các sản phẩm từ mật ong, thực phẩm biến đổi gen, muối và các nông sản thực phẩm khác theo quy định của Chính phủ.
4. Quản lý an toàn thực phẩm đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm trong quá trình sản xuất, chế biến, kinh doanh thực phẩm thuộc lĩnh vực được phân công quản lý.
5. Báo cáo định kỳ, đột xuất về công tác quản lý an toàn thực phẩm thuộc lĩnh vực được phân công quản lý.
6. Thanh tra, kiểm tra, xử lý vi phạm pháp luật về an toàn thực phẩm trong quá trình sản xuất, xuất khẩu, nhập khẩu, kinh doanh thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 64. Trách nhiệm của Bộ Công thương1. Chủ trì xây dựng, ban hành hoặc trình cơ quan nhà nước có thẩm quyền ban hành và tổ chức thực hiện các chính sách, chiến lược, quy hoạch, kế hoạch, văn bản quy phạm pháp luật về an toàn thực phẩm thuộc lĩnh vực được phân công quản lý.
2. Quản lý an toàn thực phẩm trong suốt quá trình sản xuất, chế biến, bảo quản, vận chuyển, xuất khẩu, nhập khẩu, kinh doanh đối với các loại rượu, bia, nước giải khát, sữa chế biến, dầu thực vật, sản phẩm chế biến bột và tinh bột và các thực phẩm khác theo quy định của Chính phủ.
3. Quản lý an toàn thực phẩm đối với dụng cụ, vật liệu bao gói, chứa đựng thực phẩm trong quá trình sản xuất, chế biến, kinh doanh thực phẩm thuộc lĩnh vực được phân công quản lý.
4. Ban hành chính sách, quy hoạch về chợ, siêu thị, quy định điều kiện kinh doanh thực phẩm tại các chợ, siêu thị.
5. Chủ trì việc phòng chống thực phẩm giả, gian lận thương mại trong lưu thông, kinh doanh thực phẩm.
6. Báo cáo định kỳ, đột xuất về công tác quản lý an toàn thực phẩm thuộc lĩnh vực được phân công quản lý.
7. Thanh tra, kiểm tra, xử lý vi phạm pháp luật về an toàn thực phẩm trong quá trình sản xuất, xuất khẩu, nhập khẩu, kinh doanh thực phẩm thuộc lĩnh vực được phân công quản lý.
Điều 65. Trách nhiệm quản lý nhà nước của Ủy ban nhân dân các cấp1. Ban hành theo thẩm quyền hoặc trình cơ quan nhà nước có thẩm quyền ban hành văn bản quy phạm pháp luật, quy chuẩn kỹ thuật địa phương; xây dựng và tổ chức thực hiện quy hoạch vùng, cơ sở sản xuất thực phẩm an toàn để bảo đảm việc quản lý được thực hiện trong toàn bộ chuỗi cung cấp thực phẩm.
2. Chịu trách nhiệm quản lý an toàn thực phẩm trên địa bàn; quản lý điều kiện bảo đảm an toàn thực phẩm đối với cơ sở sản xuất, kinh doanh thực phẩm nhỏ lẻ, thức ăn đường phố, cơ sở kinh doanh, dịch vụ ăn uống, an toàn thực phẩm tại các chợ trên địa bàn và các đối tượng theo phân cấp quản lý.
3. Báo cáo định kỳ, đột xuất về công tác quản lý an toàn thực phẩm trên địa bàn.
4. Bố trí nguồn lực, tổ chức bồi dưỡng nâng cao chất lượng nhân lực cho công tác bảo đảm an toàn thực phẩm trên địa bàn.
5. Tổ chức tuyên truyền, giáo dục, truyền thông, nâng cao nhận thức về an toàn thực phẩm, ý thức chấp hành pháp luật về quản lý an toàn thực phẩm, ý thức trách nhiệm của tổ chức, cá nhân sản xuất, kinh doanh thực phẩm đối với cộng đồng, ý thức của người tiêu dùng thực phẩm.
6. Thanh tra, kiểm tra, xử lý vi phạm pháp luật về an toàn thực phẩm trên địa bàn quản lý.
Mục 2. THANH TRA AN TOÀN THỰC PHẨMĐiều 66. Thanh tra về an toàn thực phẩm
1. Thanh tra về an toàn thực phẩm là thanh tra chuyên ngành. Thanh tra an toàn thực phẩm do ngành y tế, ngành nông nghiệp và phát triển nông thôn, ngành công thương thực hiện theo quy định của pháp luật về thanh tra.
2. Chính phủ quy định việc phối hợp giữa các lực lượng thanh tra an toàn thực phẩm của các bộ, cơ quan ngang bộ với một số lực lượng khác trong việc bảo đảm an toàn thực phẩm.
Điều 67. Nội dung thanh tra về an toàn thực phẩm1. Việc thực hiện các quy chuẩn kỹ thuật, quy định về an toàn thực phẩm đối với sản xuất, kinh doanh thực phẩm và sản phẩm thực phẩm do cơ quan quản lý nhà nước có thẩm quyền ban hành.
2. Việc thực hiện các tiêu chuẩn có liên quan đến an toàn thực phẩm do tổ chức, cá nhân sản xuất công bố áp dụng đối với sản xuất, kinh doanh thực phẩm và sản phẩm thực phẩm.
3. Hoạt động quảng cáo, ghi nhãn đối với thực phẩm thuộc phạm vi quản lý.
4. Hoạt động chứng nhận hợp quy, kiểm nghiệm an toàn thực phẩm.
5. Việc thực hiện các quy định khác của pháp luật về an toàn thực phẩm.
Mục 3. KIỂM TRA AN TOÀN THỰC PHẨMĐiều 68. Trách nhiệm kiểm tra an toàn thực phẩm
1. Cơ quan quản lý an toàn thực phẩm thuộc Bộ quản lý ngành thực hiện việc kiểm tra an toàn thực phẩm trong sản xuất, kinh doanh thực phẩm theo quy định tại các điều 61, 62, 63 và 64 của Luật này.
2. Cơ quan quản lý an toàn thực phẩm thuộc Ủy ban nhân dân cấp tỉnh thực hiện việc kiểm tra an toàn thực phẩm trong phạm vi địa phương theo quy định của Bộ quản lý ngành và sự phân công của Ủy ban nhân dân cấp tỉnh.
3. Trong trường hợp kiểm tra liên ngành về an toàn thực phẩm có liên quan đến phạm vi quản lý của nhiều ngành hoặc địa phương, cơ quan chủ trì thực hiện kiểm tra có trách nhiệm phối hợp với cơ quan hữu quan thuộc các bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh có liên quan để thực hiện.
4. Hoạt động kiểm tra an toàn thực phẩm phải bảo đảm nguyên tắc:
a) Khách quan, chính xác, công khai, minh bạch, không phân biệt đối xử;
b) Bảo vệ bí mật thông tin, tài liệu, kết quả kiểm tra liên quan đến cơ quan, tổ chức, cá nhân sản xuất, kinh doanh thực phẩm được kiểm tra khi chưa có kết luận chính thức;
c) Không được sách nhiễu, gây phiền hà cho tổ chức, cá nhân sản xuất, kinh doanh thực phẩm;
d) Chịu trách nhiệm trước pháp luật về kết quả kiểm tra, kết luận có liên quan.
5. Bộ trưởng Bộ quản lý ngành quy định cụ thể về hoạt động kiểm tra an toàn thực phẩm trong phạm vi quản lý nhà nước được phân công.
Điều 69. Quyền hạn và nhiệm vụ của cơ quan quản lý an toàn thực phẩm trong kiểm tra an toàn thực phẩm1. Trong phạm vi nhiệm vụ, quyền hạn của mình, cơ quan quản lý an toàn thực phẩm có các quyền sau đây trong kiểm tra an toàn thực phẩm:
a) Quyết định thành lập đoàn kiểm tra thực hiện công tác kiểm tra theo kế hoạch hoặc đột xuất;
b) Cảnh báo nguy cơ không bảo đảm an toàn thực phẩm;
c) Xử lý vi phạm trong quá trình kiểm tra an toàn thực phẩm theo quy định tại các điều 30, 36 và 40 của Luật chất lượng sản phẩm, hàng hóa;
d) Giải quyết khiếu nại, tố cáo về quyết định của đoàn kiểm tra, hành vi của thành viên đoàn kiểm tra theo quy định của pháp luật về khiếu nại, tố cáo.
2. Trong phạm vi nhiệm vụ, quyền hạn của mình, cơ quan quản lý an toàn thực phẩm có nhiệm vụ sau đây:
a) Xây dựng kế hoạch kiểm tra hằng năm trình cơ quan nhà nước có thẩm quyền quyết định;
b) Tiếp nhận hồ sơ đăng ký kiểm tra an toàn thực phẩm nhập khẩu; xác nhận điều kiện bảo đảm an toàn thực phẩm đối với thực phẩm nhập khẩu;
c) Ra quyết định xử lý chậm nhất trong thời hạn 03 ngày làm việc, kể từ ngày nhận được báo cáo của đoàn kiểm tra về việc tạm đình chỉ hoạt động sản xuất, kinh doanh, niêm phong thực phẩm, tạm dừng việc quảng cáo đối với thực phẩm không bảo đảm an toàn.
Điều 70. Đoàn kiểm tra1. Đoàn kiểm tra do Thủ trưởng cơ quan quản lý an toàn thực phẩm quyết định thành lập trên cơ sở chương trình, kế hoạch kiểm tra đã được cơ quan nhà nước có thẩm quyền phê duyệt hoặc trong trường hợp có yêu cầu kiểm tra đột xuất.
2. Trong quá trình kiểm tra an toàn thực phẩm, đoàn kiểm tra có những nhiệm vụ, quyền hạn sau đây:
a) Yêu cầu tổ chức, cá nhân sản xuất, kinh doanh thực phẩm xuất trình các tài liệu liên quan và xử lý vi phạm trong quá trình kiểm tra theo quy định tại Điều 30 và Điều 40 của Luật chất lượng sản phẩm, hàng hóa; cung cấp bản sao các tài liệu quy định tại khoản này khi cần thiết;
b) Lấy mẫu để kiểm nghiệm khi cần thiết;
c) Niêm phong thực phẩm, tạm dừng bán thực phẩm không phù hợp, tạm dừng quảng cáo thực phẩm có nội dung không phù hợp trong quá trình kiểm tra trên thị trường và phải báo cáo cơ quan quản lý an toàn thực phẩm trong thời hạn không quá 24 giờ, kể từ khi niêm phong thực phẩm, tạm dừng bán thực phẩm không phù hợp, tạm dừng quảng cáo;
d) Yêu cầu tổ chức, cá nhân sản xuất, kinh doanh thực phẩm không phù hợp với tiêu chuẩn
đã công bố áp dụng, quy chuẩn kỹ thuật, quy định về điều kiện tương ứng có biện pháp khắc phục, sửa chữa;
đ) Kiến nghị cơ quan quản lý an toàn thực phẩm xử lý theo thẩm quyền quy định tại Điều 69 của Luật này;
e) Bảo đảm nguyên tắc kiểm tra quy định tại khoản 4 Điều 68 của Luật này khi tiến hành kiểm tra;
g) Báo cáo chính xác và kịp thời kết quả kiểm tra cho cơ quan quản lý an toàn thực phẩm.
Luật này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2011.
Pháp lệnh vệ sinh an toàn thực phẩm số 12/2003/PL-UBTVQH11 hết hiệu lực kể từ ngày Luật này có hiệu lực.
Điều 72. Quy định chi tiết và hướng dẫn thi hànhChính phủ quy định chi tiết và hướng dẫn thi hành các điều, khoản được giao trong Luật; hướng dẫn những nội dung cần thiết khác của Luật này để đáp ứng yêu cầu quản lý nhà nước.
Luật này đã được Quốc hội nước Cộng hoà xã hội chủ nghĩa Việt Nam khoá XII, kỳ họp thứ 7 thông qua ngày 17 tháng 6 năm 2010.

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No.
The National Assembly promulgates the Law on Food Safety.
Article 1. Scope of regulation
This Law provides for rights and obligations of organizations and individuals in assuring food safety: conditions for assuring safety of foods and food production, trading, import and export; food advertisement and labeling; food testing; food safety risk analysis: prevention, stopping and remedying of food safety incidents; food safety information, education and communication; and responsibilities for state management of food safety.
Article 2. Interpretation of terms
In this Law. the terms below are construed as follows:
1. Food safety means the assurance that food does not cause harm to human health and life.
2. Food-borne disease means a disease caused by eating or drinking a food contaminated with pathogens.
3. Food processing aid means a substance which is intentionally used in the processing of food materials or food ingredients in order to achieve a technological purpose and can be removed from or remains in foods.
4. Food processing means a process of preparing preliminarily processed food or fresh and raw food by an industrial or manual method to create food materials or food products.
5. Catering service establishment means a food-preparing facility, such as shop or stall trading in ready-to-eat food and cooked food restaurant, facility preparing ready-to-eat food portions, canteen or collective kitchen.
6. Conditions for food safety assurance means technical regulations and other regulations applicable to food, food producers and traders and food production and trading activities promulgated by competent state agencies for the purpose of assuring food safety for human health and life.
7. Food testing means the conduct of one or several tests and assessments of the conformity with relevant technical regulations and standards of food, food additives, food processing aids, food fortifiers, packages, tools and food containers.
8. Food trading means the conduct of one, several or all activities of food display, preservation service, transportation service or trading.
8. Food product lot means a specified quantity of a type of products bearing the same name, of the same quality, ingredients and shelf life, and produced by the same producer.
10. Food poisoning means a pathological state caused by absorbing contaminated or poisonous food.
11. Food contamination risk means the possibility that contaminants infiltrate into a food in the course of production or trading.
12. Food contamination means the presence of contaminants in food which are harmful to human health or life.
13. Food additive means a substance with or without nutritious value, which is intentionally added to food in the process of production in order to retain or improve particular characteristics of food.
14. Food production means the conduct of one. several or all activities of cultivation rearing, harvest, fishing, exploitation, preliminary processing, processing, packaging and preservation in order to make food.
15. Primary production means the conduct of one, several or all activities of cultivation, rearing, harvest, fishing and exploitation.
16. Preliminary processing of food means the treatment of cultivated, reared, collected, harvested, fished or exploited products in order to make ready-to-eat fresh and raw food or a food material or semi-finished products for the food processing stage.
17. Food safety incident means a circumstance occurring due to food poisoning, a food-borne disease or another food-induced circumstance which is directly harmful to human health or life.
18. Contaminant means an element which is unwanted and unintentionally added to food and likely to adversely affect food safety.
19. Shelf life means the period before the end of which a food still retains its nutritious value and remains safe under the preservation conditions indicated on its label under the producer's guidance.
20. Food means a product eaten or drunk by humans in fresh and raw, preliminarily processed, processed or preserved form. Food excludes cosmetics, cigarettes and substances used as pharmaceuticals.
21. Fresh and raw food means unprocessed food, including fresh meat, eggs, fish, aquatic products, vegetables, tubers and fruits and other unprocessed foods.
22. Micronutrient-fortified food means food supplemented with vitamins, minerals and trace elements in order to prevent or remedy the harm caused by the deficiency of these substances or elements to the health of the community or a particular group in the community.
23. Functional food means a food used to support a function of the human body, relax the body, boost the immunity against diseases, including supplements, health protection food and medical nutritious food.
24. Genetically modified food means a food containing one or several ingredients which have been genetically engineered.
25. Irradiated food means a food which has been irradiated by a radioactive source to treat the food, preventing it from degeneration.
26. Street food means a food processed for instant consumption and sold by vendors on streets or in public or similar places.
27. Prepackaged food means a food completely packaged and labeled, ready for sale for further processing or instant consumption.
28. Tracing of food origin means the tracking down of the creation and circulation of food.
Article 3. Principles of food safety management
1. To assure food safety is the responsibility of all food producers and traders.
2. Food production and trading are conditional activities; and food producers and traders shall bear responsibility for the safety of food they produce or trade in.
3. Food safety management must be based on relevant technical regulations and regulations promulgated by competent state management agencies and applicable standards announced by producers.
4. Food safety management must be conducted throughout the course of food production and trading on the basis of food safety risk analysis.
5. Food safety management must ensure a clear division of responsibilities and powers and inter-sector coordination.
6. Food safety management must meet requirements of socio-economic development.
Article 4. State policies on food safety
1. To elaborate strategies and master plans on food safety assurance, regarding the planning of zones for safe food production according to the food supply chain as a priority key task.
2. To use state resources and other resources to invest in scientific research and technological application to serve food safety risk analysis; to build new laboratories and upgrade some existing ones up to regional or international standards; to raise the capacity of existing analysis laboratories; to support investment in building zones producing safe food materials, wholesale markets for farm produce and food, and industrial-scale cattle and poultry slaughterhouses.
3. To encourage food producers and traders to renew technologies and expand their production: to produce high-quality and safe food; to fortify food with essential micronutrients: to build their brands and develop their safe food supply systems.
4. To establish a legal framework and realize a roadmap for compulsory application of good manufacturing practices (GMP), good agricultural practices (GAP), good hygiene practices (GHP) and hazard analysis and critical control points (HACCP) and other advanced food safety management systems in food production and trading.
5. To undertake international cooperation, step up the conclusion of treaties and international agreements on accreditation and mutual recognition in the field of food.
6. To promptly commend and reward organizations and individuals that produce or trade in safe foods.
7. To encourage and create conditions for domestic societies, associations, organizations and individuals and foreign organizations and individuals to invest or participate in the elaboration of standards, technical regulations and testing of food safety.
8. To increase investment in and diversify forms and methods of public information and education to raise public awareness about the consumption of safe food, sense of responsibility and business ethics of food producers and traders towards the community.
1. Using for food processing purposes materials other than those permitted for use in food.
2. Using food materials which have passed their shelf life, arc of unclear origin or unsafe for food production and processing.
3. Using food additives or food processing aids which have passed their shelf life or are outside the list of those permitted for use or using permitted additives or food processing aids in excess of allowable dosages: using chemicals of unclear origins or banned chemicals in food production or trading.
4. Using animals which died of diseases, epidemics or unidentified causes or animal carcasses subject to destruction for food production or trading.
5. Producing or trading in:
a/ Food breaching regulations on goods labeling;
b/ Food unconformable with relevant technical regulations:
c/ Degenerated food;
d/ Food containing toxic or hazardous substances or contaminated with toxins or contaminants in excess of allowable limits;
e/ Food which is contaminated for the reason that their packages or containers are unsafe, broken, torn or deformed in the course of transportation;
f/ Meat or meat products which have not yet gone through veterinary inspection or have gone through veterinary inspection but fail to meet requirements;
g/ Food banned from production or trading for the purpose of epidemic prevention and combat;
h/ Food for which regulation conformity declarations have not yet been registered with competent state agencies in case such food subject to regulation conformity declaration registration;
i/ Food which is of unclear origin or has passed its shelf life.
6. Using vehicles which can cause food contamination or vehicles which have transported toxic or hazardous substances but not yet been cleaned up for transporting food materials or foods.
7. Supplying untruthful or forging food testing results.
8. Covering up. falsifying or obliterating scenes or evidence of food safety incidents or committing other acts of intentionally obstructing the detection and remedy of food safety incidents.
9. Employing persons infected with contagious diseases in food production or trading.
10. Producing or trading in food at establishments without certificates of satisfaction of food safety conditions prescribed by law.
11. Advertising food untruthfully or confusingly to consumers.
12. Publishing or publicly notifying misleading information on food safety, thus causing public disparagement or damage to food production and trading.
13. Using illegally roadbeds, pavements. corridors or common yards, passageways and auxiliary spaces for street food processing, producing or trading.
Article 6. Handling of violations of the law on food safety
1. Food producers and traders that violate the law on food safely shall, depending on the nature and severity of their violations, be administratively handled or examined for penal liability. If causing damage, they shall pay compensations and remedy consequences under law.
2. Persons who abuse their positions and powers to violate this Law or other regulations on food safety shall, depending on the nature and severity of their violations, be disciplined or examined for penal liability. If causing damage, they shall pay compensations under law.
3. Fines for administrative violations specified in Clause 1 of this Article comply with the law on handling of administrative violations In case the highest fine prescribed by the law on handling of administrative violations is lower than 7 times the value of the violating food, a higher fine not exceeding 7 times the value of the violating food may be imposed. Money amounts earned from violations shall be confiscated under law.
4. The Government shall specify administrative violations in the field of food safely mentioned in this Article, and forms and levels of sanctioning of these violations.
RIGHTS AND OBLIGATIONS OF ORGANIZATIONS AND INDIVIDUALS IN ASSURING FOOD SAFETY
Article 7. Rights and obligations of food producers
1. Food producers have the following rights:
a/ To decide on and announce standards of products they produce and supply; to decide on application of internal control measures to assure food safety;
b/ To request food traders to cooperate in recalling and disposing of unsafe food;
c/ To select conformity assessment organizations and testing establishments already designated to certify regulation conformity;
d/ To use standard conformity stamps and regulation conformity stamps and other marks for their products under law;
e/ To lodge complaints and denunciations and file lawsuits under law;
f/ To get compensations for damage under law.
2. Food producers have the following obligations:
a/ To comply with conditions for food safety assurance, assure food safety in the process of production, and take responsibility for the safety of food they produce;
b/ To comply with the Government's regulations on fortification of micronutrients the deficiency of which will affect community health;
c/ To provide adequate and accurate information on products on their labels and packages or in documents accompanying food under the law on goods labeling;
d/ To establish a self-inspection process in the course of food production:
e/ To provide truthful information on food safety: to give timely, adequate and accurate warnings about the risk of food to become unsafe and provide preventive methods for sellers and consumers; to notify requirements on the transportation, storage, preservation and use of food:
f/ To promptly suspend food production, notify concerned parties of and take consequence remedies upon detecting unsafe food or food unconformable with announced standards or relevant technical regulations:
g/ To keep dossiers, food samples and necessary information under regulations on tracing of food origin; to comply with regulations on tracing of origins of unsafe foods under Article 54 of this Law;
h/ To recall and dispose of food which has passed their shelf life or are unsafe. In case foods are to be destroyed, the food destruction must comply with the law on environmental protection and other relevant laws and food producers shall bear all expenses for destruction;
i/ To comply with law as well as. inspection or examination decisions of competent state agencies;
j/ To pay sampling and testing expenses as prescribed in Article 48 of this Law;
k/ To pay compensations under law for damage caused by unsafe food they produce.
Article 8. Rights and obligations of food traders
1. Foods traders have the following rights:
a/ To decide on internal control measures to maintain food quality, hygiene and safety;
b/ To request food producers and importers to cooperate in recalling and disposing of unsafe food:
c/ To select testing establishments to inspect food safety; to select testing establishments already designated for certification of regulation conformity for imported food;
d/ To lodge complaints and denunciations and file lawsuits under law;
e/ To get compensations for damage under law.
2. Foods traders have the following obligations:
a/ To comply with conditions for food safety assurance in the course of trading and take responsibility for the safety of food they trade in;
b/ To inspect food origins and labels and documents related to food safety; to keep dossiers on food; to comply with regulations on tracing of origins of unsafe food under Article 54 of this Law;
c/ To supply truthful information of food safety; to notify consumers of safety assurance conditions in the course of food transportation, storage, preservation and use:
d/ To promptly provide information on risks of food to become unsafe and methods of risk prevention to consumers upon receiving warnings of food producers or importers;
e/ To promptly suspend their trading operation and inform food producers or importers and consumers of unsafe food upon detecting such food:
f/ To promptly report to a competent agency on a food poisoning or a disease borne by foods they trade in and promptly remedy its consequences upon detecting it;
g/ To cooperate with food producers and importers and competent state agencies in investigating food poisoning cases in order to remedy consequences, recall or dispose of unsafe food;
h/ To comply with law as well as inspection or examination decisions of competent state agencies;
i/ To pay food sampling and testing expenses as specified in Article 48 of this Law;
j/ To pay compensations under law for damage caused by unsafe food they trade in.
Article 9. Rights and obligations of food consumers
1. Food consumers have the following rights:
a/ To be provided with truthful information on food safety, and appropriate instructions for food use. transportation, storage, preservation, selection and use; to be informed of risks of food to become unsafe and methods of risk prevention upon receiving warnings;
b/ To request food producers and traders to protect their interests under law;
c/ To request consumer interest protection organizations to protect their lawful rights and interests under the law on consumer interest protection:
d/To lodge complaints and denunciations and file lawsuits under law;
e/ To get compensations under law for their damage caused by consumption of unsafe food.
2. Food consumers have the following obligations:
a/ To fully comply with regulations and guidance of food producers and traders on food safety in transportation, storage, preservation and use:
b/ To promptly provide information on risks of food to become unsafe upon detecting these risks, and report food poisonings and food-home diseases to the nearest People's Committee, medical examination and treatment establishments, competent state agencies and food producers and traders:
c/ To comply with the law on environmental protection in the course of food consumption.
FOOD SAFETY ASSURANCE CONDITIONS
Article 10. General conditions on food safety assurance
1. To conform with relevant technical regulations, to meet limit requirements for pathogenic microorganisms, residues of plant protection drugs or veterinary drugs, heavy metals, contaminants and other substances in food that may cause harm to human health and life.
2. Depending on each type of food, in addition to the conditions specified in Clause 1 of this Article, food must comply with one or more of the following regulations:
a/ Regulations on use of food additives and processing aids in food production and trading:
b/ Regulations on food packaging and labeling;
c/ Regulations on food preservation.
Article 11. Safety assurance conditions for fresh and raw food
1. To meet the conditions specified in Article 10 of this Law.
2. To guarantee the origin tracing under Article 54 of this Law.
3. To have veterinary hygiene certificates issued by competent veterinary agencies for fresh and raw food of animal origin under the animal health law.
Article 12. Safety assurance conditions for processed food
1. To meet the conditions specified in Article 10 of this Law.
2. Original materials of food must be safe and retain their inherent properties. Materials forming a food must not interact with one another to create products harmful to human health and life.
3. Prepackaged processed food must have regulation conformity announcements registered with competent state agencies prior to market sale.
The Government shall specify the registration of regulation conformity announcements of prepackaged processed food and their validity term.
Article 13. Safety assurance conditions for micronutrient-fortified food
1. To meet the conditions specified in Article 10 of this Law.
2. Original materials of food must be safe and retain their inherent properties. Materials forming a food must not interact with one another to create products harmful to human health and life.
3. Only micronutrients being vitamins, minerals and trace elements on the Minister of Health's list may be added to food with a content unharmful to human health and life.
Article 14. Safety assurance conditions for functional foods
1. To meet the conditions specified in Article 10 of this Law.
2. To have scientific information and documents proving the effects of their ingredients that create the announced functions.
3. Functional foods which are first put on market sale must have a report on testing of their effect.
4. The Minister of Health shall specify the management of functional foods.
Article 15. Safety assurance conditions for genetically modified food
1. To meet the conditions specified in Article 10 of this Law.
2. To comply with the Government's regulations on safety assurance for human health and the environment.
Article 16. Safety assurance conditions for irradiated food
1. To meet the conditions specified in Article 10 of this Law.
2. To be on the list of food permitted for irradiation.
3. To meet regulations on irradiation doses.
4. The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall promulgate lists of food permitted for irradiation and allowable irradiation doses for food in their assigned management domains.
Article 17. Safety assurance conditions for food additives and processing aids
1. To conform with relevant technical regulations, to comply with regulations on food additives and processing aids.
2. To have use instructions written on their labels or inserts in each product unit in Vietnamese and another language depending on the origin of products.
3. To be on the Minister of Health's list of food additives and processing aids permitted for use in food production and trading.
4. To register regulation conformity announcements with competent state agencies prior to market sale.
The Government shall specify the registration of regulation conformity announcements and their validity term for food additives and processing aids.
Article 18. Safety assurance conditions for food-packaging tools and food packages and containers
1. To be made of safe materials, guaranteeing that they do not release toxic substances, strange smell or taste into food, and they preserve food quality within the shelf life.
2. To conform with relevant technical regulations, to meet the Ministry of Health's regulations on food-packaging tools and food packages and containers.
3. To register regulation conformity announcements with competent state agencies prior to market sale.
The Government shall specify the registration of regulation conformity announcements and their validity term for food-packaging tools and food packages and containers.
FOOD SAFETY ASSURANCE CONDITIONS FOR FOOD PRODUCTION AND TRADING
Section I. GENERAL CONDITIONS ON FOOD SAFETY ASSURANCE FOR FOOD PRODUCTION AND TRADING
Article 19. Food safety assurance conditions for food producers and traders
1. Food producers and traders must meet the following conditions:
a/ Having suitable venues with appropriate areas and safety distance from toxic and contaminating sources and other harmful factors;
b/ Having sufficient technically qualified water for food production and trading:
c/ Having adequate appropriate equipment to process materials and process, package, preserve and transport different types of food: having adequate washing and sterilization equipment and tools, disinfecting fluid, and equipment for preventing and controlling insects and harmful animals;
d/ Having a waste treatment system which operates regularly under the law on environmental protection:
e/ Maintaining food safety assurance conditions and keeping records of source and origin of food materials and other documents on the entire food production and trading process;
f/ Complying with regulations on health, knowledge and practices of persons directly engaged in food production and trading.
2. The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall promulgate national technical regulations and specify food safely assurance conditions for food producers and traders in their assigned management domains.
Article 20. Food safety assurance conditions for food preservation
1. Food producers and traders must meet the following conditions for food preservation:
a/ Having preservation places and means which are large enough to preserve each type of food separately, allow technically safe and precise loading and unloading and guarantee preservation hygiene:
b/ Preventing the effects of temperature, humidity, insects, animals, dust, strange smell and negative environmental effects: guaranteeing sufficient light: having special-use equipment for adjusting temperature, humidity and other climate conditions, ventilation equipment and other special preservation conditions required by each type of food;
c/ Complying with preservation regulations of food producers and traders.
2. The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall promulgate national technical regulations and specify food safely assurance conditions for food preservation in their assigned management domains.
Article 21. Food safety assurance conditions for food transportation
1. Organizations and individuals transporting food must meet the following conditions:
a/ Means for transporting foods are made of materials which do not contaminate food and food packages and are easy to clean;
b/ Food preservation conditions as required by food producers and traders are maintained throughout the course of transportation;
c/ Food is not transported together with toxic goods or goods which may cause cross-contamination and affect food quality.
2. Competent state management agencies shall provide means for transporting food and routes for transporting fresh and raw food in urban areas.
Article 22. Food safety assurance conditions for small-scale food production and trading
1. Small-scale food producers and traders must meet the following food safety assurance conditions:
a/ Ensuring safely distance from toxic and contaminating sources:
b/ Having sufficient technically qualified water for food production and trading:
c/ Having appropriate equipment for food production and trading which neither harm nor contaminate food;
d/ Using materials, chemicals, food additives, processing aids, food-packaging tools and food packages and containers in preliminary processing, processing and preservation of food;
e/ Complying with regulations on health, knowledge and practices of persons directly engaged in food production and trading:
f/ Collecting and treating waste under the law on environmental protection;
g/ Maintaining food safety assurance conditions and storing trading-related information to ensure the tracing of food origin.
2. The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall promulgate national technical regulations and specify food safety assurance conditions for small-scale food production and trading in their assigned management domains.
3. People's Committees of provinces and centrally run cities (below referred to as provincial-level People's Committees) shall promulgate local technical regulations and specify food safety assurance conditions for small-scale food production and trading for local particular food.
Section 2. FOOD SAFETY ASSURANCE CONDITIONS FOR PRODUCTION AND TRADING IN FRESH AND RAW FOOD
Article 23. Food safety assurance conditions for producers of fresh and raw food
1. Producers of fresh and raw food must meet the following conditions:
a/ Meeting requirements on cultivation land, water sources and production places for producing safe food;
b/ Complying with the laws on use of plant varieties and livestock breeds; fertilizer, animal feed, plant protection drugs, veterinary drugs, growth, weight and sexual maturity stimulants, food preservatives and other food safety-related substances;
c/ Complying with regulations on animal quarantine and hygiene in animal slaughtering; and plant quarantine for crop products;
d/ Treating waste under the law on environmental protection:
e/ Using detergents, disinfectants and antidotes which are safe for humans and the environment;
f/ Maintaining food safety assurance conditions, keeping records of source and origin of food materials and other documents on the entire process to produce fresh and raw food.
2. The Minister of Agriculture and Rural Development shall provide specific food safety assurance conditions for producers of fresh and raw food.
Article 24. Food safety assurance conditions for traders of fresh and raw food
1. Traders of fresh and raw food must meet the following conditions:
a/ Meeting safety assurance conditions for food-packaging tools and food packages and containers and for food preservation and transportation specified in Articles 18. 20 and 21 of this Law;
b/ Ensuring and maintaining hygiene in business places.
2. The Minister of Agriculture and Rural Development shall provide specific food safety assurance conditions for traders of fresh and raw food.
Section 3. FOOD SAFETY ASSURANCE CONDITIONS FOR PRELIMINARY PROCESSING AND PROCESSING OF FOOD AND TRADING IN PROCESSED FOOD
Article 25. Food safety assurance conditions for preliminary processors and processors of food
1. To meet the conditions specified in Article 19 of this Law.
2. The preliminary processing or processing of food must ensure that food is neither contaminated nor in contact with contaminants or toxic elements.
Article 26. Food safety assurance conditions for food materials and additives, processing aids and micronutrients for food processing
1. Materials used for food processing must be within their shelf life, of clear origin and safe and retain their inherent properties. Materials forming a food must not interact with one another to create products harmful to human health and life.
2. The use of micronutrients. food additives and processing aids must comply with Articles 13 and 17 of this Law.
Article 27. Food safety assurance conditions for traders of processed food
1. Traders of prepackaged processed food must meet the following conditions:
a/ Complying with regulations on food labeling:
b/ Meeting the safety assurance conditions for food-packaging tools and food packages and containers and for food preservation specified in Articles 18 and 20 of this Law:
c/ Ensuring and maintaining hygiene in business places;
d/ Preserving food as required by producers.
2. Traders of non-prepackaged processed food must meet the following conditions:
a/ Adopting measures to ensure that food is neither spoiled, moldy nor in contact with insects, animals, dust and other contaminants;
b/ Washing or sterilizing the tableware and food containers before use of instant food;
c/ Obtaining information on the origin and production date of food.
Section 4. FOOD SAFETY ASSURANCE CONDITIONS FOR COMMERCIAL PROVISION OF CATERING SERVICES
Article 28. Food safety assurance conditions for food processing places and commercial provision of catering services
1. Kitchens are arranged in a way to ensure that unprocessed and processed food is not cross-contaminated.
2. Having sufficient technically qualified water for food processing and trading.
3. Having hygienic devices for collecting and containing garbage and waste.
4. Sewers in the areas of shops and kitchens must be drained without any stagnancy.
5. Eating rooms must be airy. cool, sufficiently lit and kept clean and have equipment to prevent insects and harmful animals.
6. Having food preservation equipment and toilets and collecting waste and garbage daily.
7. Heads of units having collective kitchens shall take responsibility for food safety.
Article 29. Food safety assurance conditions for food processors and catering services providers
1. To have separate utensils and containers for raw and cooked food.
2. To ensure safety and hygiene of cooking and processing utensils.
3. The tableware must be made of safe materials and kept clean and dry.
4. To comply with regulations on health, knowledge and practices of persons directly engaged in food production and trading.
Article 30. Food safety assurance conditions for food processing and preservation
1. To use safe food and food materials of clear origin and keep food samples.
2. To process food safely and hygienically.
3. Food on sale must be placed in glass showcases or hygienic preservation containers on tables or shelves above the ground, which can prevent dust, rain, sunshine, insects and harmful animals.
Section 5. FOOD SAFETY ASSURANCE CONDITIONS FOR STREET FOOD SALE
Article 31. Food safety assurance conditions for street food display places
1. To be separated from toxic and contaminating sources.
2. To display food on tables, shelves or means which meet requirements on food hygiene and safety and street landscape.
Article 32. Food safety assurance conditions for food materials and containers, eating utensils, food containers and street vendors
1. Materials for processing street food must meet food safety requirements and have clear source and origin.
2. Eating utensils and food containers must be hygienically safe.
3. Packages and materials in direct contact with food must neither contaminate nor release contaminants into food.
4. To have devices to prevent sunshine, rain, dust, insects and harmful animals.
5. To sufficiently have technically qualified water for food processing and trading.
6. To comply with regulations on health, knowledge and practices of persons directly engaged in food production and trading.
Article 33. Responsibilities for management of street food sale
1. The Minister of Health shall specify food safety assurance conditions for street food sale.
2. People's Committees at all levels shall manage street food sale in their localities.
CERTIFICATION OF FOOD SAFETY ELIGIBILITY FOR ESTABLISHMENTS IN FOOD PRODUCTION AND TRADING
Article 34. Establishments and conditions for the grant and withdrawal of certificates of food safety eligibility
1. An establishment shall be granted a certificate of food safety eligibility when it fully meets the following conditions:
a/ Having adequate conditions for assuring food safety suitable to each type of food production and trading as prescribed in Chapter IV of this Law;
b/ Having registered for food production and trading as indicated in its business registration certificate.
2. An organization or individual shall have its/his/her certificate of food safety eligibility withdrawn when it/he/she no longer satisfies all conditions prescribed in Clause 1 of this Article.
3. The Government shall specify establishments not subject to the grant of certificates of food safety eligibility.
Article 35. Competence to grant and withdraw certificates of food safety eligibility
The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall specify the competence to grant and withdraw certificates of food safety eligibility in their assigned management domains.
Article 36. Dossiers, order and procedures for the grant of certificates of food safety eligibility
1. A dossier of application for a certificate of food safety eligibility comprises:
a/ An application for a certificate of food safety eligibility:
b/ A copy of the business registration certificate:
c/ Written explanations about the satisfaction of food safety and hygiene conditions of physical foundations, equipment and tools as prescribed by competent state management agencies:
d/ Health certificates of the establishments owner and persons directly engaged in food production and trading, issued by a district- or higher-level health establishment:
e/ Certificates of training in knowledge about food safety and hygiene of the establishment's owner and persons directly engaged in food production and trading as prescribed by line ministers.
2. The order of and procedures for the grant of certificates of food safety eligibility
a/ Food producers and traders shall submit dossiers of application for certificates of food safety eligibility to a competent state management agency defined in Article 35 of this Law;
b/ Within 15 days after the receipt of a complete and valid dossier, the competent state agency shall conduct field inspection of food safety assurance conditions at the producer's or trader's establishment. If all conditions are met. it shall grant a certificate of food safety eligibility; in case of refusing to grant a certificate, it shall issue a written reply clearly stating the reason.
Article 37. Validity duration of certificates of food safety eligibility
1. A certificate of food safety eligibility is valid for 3 years.
2. At least 6 months before the expiration date of a certificate of food safety eligibility, if the food producer or trader wishes to continue its/ his/her production or trading activities, it/he/she shall submit a dossier of application for the re-grant of a certificate of food safety eligibility. Dossiers of application and the order of and procedures for re-grant of certificates comply with Article 36 of this Law.
Section I. SAFETY ASSURANCE CONDITIONS FOR IMPORTED FOOD
Article 38. Safety assurance conditions for imported food
1. Imported food, food additives, processing aids and imported food-packaging tools, food packages and containers must satisfy relevant conditions prescribed in Chapter III of this Law and the following conditions:
a/ Having their technical regulation-conformity announcements registered at a competent state agency before import;
b/ Having obtained a notice of satisfaction of import requirements issued by a designated inspection agency for each goods lot as prescribed by line ministers.
2. In addition to the conditions prescribed in Clause 1 of this Article, functional food, micronutrient-fortified food, genetically modified food and irradiated food must obtain a certificate of free sale or health certificate as prescribed by the Government.
3. In case Vietnam has not yet promulgated relevant technical regulations applicable to imported food, food additives and processing aids and imported food- packaging tools, food packages and containers, international agreements or treaties to which the Socialist Republic of Vietnam is a contracting party will apply.
Article 39. State inspection of food safety with regard to imported food
1. Imported food, food additives and processing aids and imported food-packaging tools, food packages and containers arc subject to state inspection of food safety, except for some kinds of food which are exempted from state inspection of food safety as prescribed by the Government.
2. Food imported from countries which have concluded with Vietnam treaties on mutual recognition of food safety certification is eligible for reduced inspection, except for cases in which signs of violation of Vietnam's law on food safely are warned or have been detected.
3. The Government shall specify the exemption from state inspection of food safety for some kinds of imported food; the order of and procedures for state inspection of food safety in countries from which food will be exported to Vietnam under treaties to which Vietnam is a contracting party.
Article 40. Order, procedures and methods of state inspection of food safety with regard to imported food
1. The order of and procedures for state inspection of food safety with regard to imported food, food additives, processing aids, food-packaging tools, food packages and containers comply with the law on product and goods quality and the following provisions:
a/ Food may be transported to warehouses for preservation pending customs clearance only when they have a registration for food safety inspection:
b/ Customs clearance shall only be effected when there is a written certification of satisfaction of import requirements.
2. Modes of state inspection of food safety for imported food, food additives, processing aids, food-packaging tools, food packages and containers:
a/ Tightened inspection:
b/ Normal inspection;
c/ Reduced inspection.
3. The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall specify agencies in charge of conducting state inspection of food safety and the application of modes of slate inspection of food safety with regard to imported food, food additives, processing aids, food-packaging tools, food packages and containers.
Section 2. SAFETY ASSURANCE CONDITIONS FOR EXPORTED FOOD
Article 41. Safety assurance conditions for exported food
1. Meeting Vietnam's food assurance safety conditions.
2. Being conformable with food safety regulations of countries of importation as provided in contracts or treaties and international agreements on mutual recognition of results of conformity evaluation signed with concerned countries or territories.
Article 42. Certification of exported food
1. Competent Vietnamese state agencies shall grant certificates of free sale, health certificates, certificates of origin or other certificates for exported food, if so requested by countries of importation.
2. The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall provide for dossiers and procedures for the grant of certificates specified in Clause 1 of this Article in their assigned management domains.
FOOD ADVERTISEMENT AND LABELING
Article 43. Food advertisement
1. Food advertisement shall be carried out by food producers and traders or advertisement service providers under the law on advertisement.
2. Before registering for food advertisement, organizations and individuals that have food to be advertised shall send dossiers to competent state management agencies for certification of advertisement contents.
3. Advertisement makers, advertisement service providers and organizations and individuals with to-be-advertised food may only make advertisement after the advertisement contents are appraised, and must strictly comply with certified contents.
The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall specify kinds of food of which advertisement must be registered: and the competence, order and procedures for certification of contents of food advertisements under their assigned management domains.
1. Producers and importers of food, food additives and processing aids in Vietnam shall label food under the law on goods labeling.
The shelf life of food shown on their labels shall, depending on the type of food, be written as "expiry date", "use by” or "best before".
2. For functional food, food additives, irradiated food and genetically modified food.in addition to the provisions of Clause 1 of this Article, the following provisions must be complied with:
a/ For functional food, the phrase "thucpham chucnang" (functional food) must be shown and the effect of substituting curative medicines must not be expressed in any form;
b/ For food additives, the phrase "pint gia thuc pham" (food additives) and information on the scope of use. dosage and use instructions must be shown;
c/ For irradiated food, the phrase "time pham da qua chieu xa" (irradiated food) must be shown:
d/ For certain kinds of genetically modified food, the phrase "thuc pham bien dot gen'' (genetically modified food) must be shown.
3. Based on socio-economic conditions in each period, the Government shall issue specific regulations on food labeling and shelf life: and kinds of genetically modified foods and the composition percentage of food with modified genes to be indicated on their labels.
FOOD TESTING. ANALYSIS OF FOOD SAFETY RISKS, PREVENTION AND REMEDY OF FOOD SAFETY INCIDENTS
Article 45. Requirements on food testing
1. Food testing shall be conducted in the following cases:
a/ At the request of food producers and traders or other concerned organizations and individuals:
b/ For the state management of food safety.
Food testing for state management work shall be conducted by food testing establishments designated by line ministers.
2. Food testing must:
a/ Ensure objectivity and accuracy:
b/ Observe professional and technical regulations.
Article 46. Food testing establishments
1. A food testing establishment must satisfy the following conditions:
a/ Having an organizational apparatus and technical capacity meeting the requirements of national or international standards applicable to testing establishments;
b/ Establishing and maintaining a managerial system meeting the requirements of national or international standards:
c/ Registering the operation of assessment of conformity with standards or technical regulations with a competent state agency when engaged in certification of standard or regulation conformity.
2. Food testing establishments may provide testing services, collect testing charges and take responsibility before law for the results of tests they perform.
3. Line ministers shall specify conditions for testing establishments defined in Clause 1 of this Article.
Article 47. Testing for the settlement of food safety-related disputes
1. Agencies with dispute settlement competence shall designate testing-verification establishments to test foods involved in disputes. Testing results of these establishments shall be used as a basis for the settlement of food safety-related disputes.
2. Testing establishments designated to conduct verification are state-run ones which satisfy all the conditions specified in Clause 1. Article 46 of this Law.
3. Line ministers shall specify conditions for testing-verification establishments and a list of eligible testing-verification establishments.
Article 48. Expenses for food sampling and testing
1. Expenses for food sampling and testing to serve food safety examination and inspection shall be paid by agencies that decide on such examination and inspection.
2. Based on testing results, if agencies that decide on food safety examination and inspection conclude that food producers or traders violate the law on food safety, the violators shall refund food sampling and testing expenses to the examination and inspection agencies.
3. Organizations and individuals that request food sampling and testing shall themselves pay expenses for food sampling and testing.
4. Expenses for food sampling and testing in food safety-related disputes or complaints shall be paid by petitioners or complainants. When testing results affirm that food producers or traders violate regulations on food safety, the violators shall refund expenses for sampling and testing of foods involved in disputes to the petitioners or complainants.
Section 2. ANALYSIS OF FOOD SAFETY RISKS
Article 49. Objects subject to analysis of food safety risks
1. Foods of high poisoning rate.
2. Foods with samples taken for surveillance showing high rate of violating technical regulations on food safety.
3. Food production or trading environment or establishments which are suspected of causing pollution.
4. Foods or food production or trading establishments which are subject to risk analysis to meet management requirements.
Article 50. Analysis of food safety risks
1. Analysis of food safety risks covers assessment, management and communication of risks to food safety.
2. Assessment of food safety risks covers:
a/ Investigating and testing to identify hazards to food safety which belong to groups of microbiological, chemical and physical agents;
b/ Identifying risks of health hazards to food safety, extent and scope of impacts of hazards on the community health.
3. Management of food safety risks covers:
a/ Implementing solutions to limiting food safety risks in each stage of the food supply chain;
b/ Controlling and coordinating to limit food safety risks in providing catering services and conducting other food production or trading activities.
4. Communication on food safety risks covers:
a/ Providing information on preventive measures in cases of food poisoning or unsafe food-borne diseases to raise public awareness about and responsibility for food safety risks;
b/ Notifying or forecasting food safety risks; building an information system for warning food safety risks and food-borne diseases.
Article 51. Responsibility to analyze food safety risks
The Ministry of Health, the Ministry of Agriculture and Rural Development and the Ministry of Industry and Trade shall analyze food safety risks in their assigned management domains under Articles 49 and 50 of this Law.
Section 3. PREVENTION AND REMEDY OF FOOD SAFETY INCIDENTS
Article 52. Prevention of food safety incidents
1. Organizations and individuals that detect signs of a food safety incident shall immediately notify it to the nearest health establishment or People's Committee or a competent state agency for taking prompt preventive measures.
2. Measures to prevent food safety incidents include:
a/ Ensuring safety in the process of food production, trading and consumption;
b/ Educating, propagating and disseminating food safety-related knowledge and practices to producers, traders and consumers;
c/ Examining and inspecting food safety in food production and trading;
d/ Analyzing food contamination risks;
e/ Investigating, surveying and storing data on food safety:
f/ Storing food samples.
3. People's Committees at all levels shall implement measures to prevent food safety incidents in their localities.
4. The Ministry of Health, the Ministry of Agriculture and Rural Development and the Ministry of Industry and Trade shall organize the implementation of programs on surveillance and prevention of food safety incidents and the application of measures to prevent food safety incidents occurring overseas which are likely to affect Vietnam in their assigned management domains.
5. The Ministry of Health shall assume the prime responsibility for. and coordinate with concerned ministries and sectors in. establishing a system for warning food safety incidents.
Article 53. Remedy of food safety incidents
1. Organizations and individuals that detect a food safety incident occurring at home or overseas which affects Vietnam shall declare it to the nearest health establishment or People's Committee or to the Ministry of Health, the Ministry of Agriculture and Rural Development or the Ministry of Industry and Trade for taking prompt remedies.
2. Remedies for food safety incidents include:
a/ Promptly detecting, and giving first aid and medical treatment to. poisoned persons or persons infected with food-borne diseases or in other food-induced circumstances harmful to human health or life:
b/ Investigating cases of food poisoning, identifying causes of poisoning and food-borne diseases and tracing the origin of poisoning or disease-transmitting food;
c/ Suspending production or trading activities:
recalling and disposing of poisoning or disease-transmitting food being marketed;
d/ Notifying food poisoning and food-borne diseases to concerned organizations and individuals:
e/ Taking measures to prevent risks of food poisoning and food-borne diseases.
3. People’s Committees at all levels shall take remedies for food safety incidents in their localities.
4. The Minister of Health shall:
a/ Specify the declaration of food safety incidents:
b/ Assume the prime responsibility for. and coordinate with concerned ministries and sectors in. taking measures to prevent food safety incidents occurring overseas which are likely to affect Vietnam.
5. Suppliers of poisoning foods shall pay all medical treatment expenses for poisoned persons and pay compensations under the civil law.
Section 4. TRACING OF THE ORIGIN AND RECALL AND DISPOSAL OF UNSAFE FOODS
Article 54. Tracing of the origin of unsafe foods
1. Food producers and traders shall trace the origin of unsafe foods in the following cases:
a/ At the request of competent state agencies;
b/ When detecting that food products they produce or trade in are unsafe.
2. Food producers and traders that trace the origin of unsafe foods shall:
a/ Identify and notify lots of unsafe food products:
b/ Request food trading agents to report on the quantity of products of unsafe food lots, actual quantities of products left in stock and being marketed:
c/ Summarize, and report to competent state agencies on. recall plans and disposal measures.
3. Competent state agencies shall inspect and supervise the tracing of the origin of unsafe foods.
Article 55. Recall and disposal of unsafe foods
1. The following foods shall be recalled:
a/ Foods which are still marketed after their shelf life:
b/ Foods unconformable with relevant technical regulations;
c/ Foods being new technological products not yet been permitted for circulation;
d/ Foods which are degenerated during preservation, transportation or trading;
e/ Foods which contain substances banned from use or in which appear contaminants in excess of allowable limits;
f/ Imported foods which are notified by a competent authority of the exporting country or another country or an international organization to contain contaminants harmful to human health and life.
2. Recall of unsafe foods takes the following forms:
a/ Voluntary recall by food producers or traders themselves:
b/ Compulsory recall by food producers and traders at the request of competent state agencies.
3. Unsafe foods shall be disposed of through:
a/ Correction of product flaws or labeling errors:
b/ Change of use purposes;
c/ Re-ex port:
d/ Destruction.
4. Unsafe food producers and traders shall publish information on recalled products, recall and dispose of unsafe foods within the time limit decided by a competent state agency, and pay all recall and disposal expenses.
Past the prescribed time limit, food producers and traders that fail to recall foods shall be coerced to do so under law.
5. Competent state agencies shall:
a/ Based on the severity of violations of safety assurance conditions, decide on the recall and disposal of unsafe foods as well as the time limit for completing such recall and disposal;
b/ Inspect the recall of unsafe foods:
c/ Handle violations of the law on food safety according to their competence as defined by law:
d/ For food products which are likely to seriously affect the community health or in other emergency cases, directly recall and dispose of them and request their producers and traders to pay recall and disposal expenses.
6. The Minister of Health, the Minister of Agriculture and Rural Development and the Minister of Industry and Trade shall specify the recall and disposal of unsafe foods in their assigned management domains.
INFORMATION, EDUCATION AND COMMUNICATION ON FOOD SAFETY
Article 56. Purposes and requirements of information, education and communication on food safety
1. Information, education and communication on food safety aims to raise public awareness about food safety, and change backward behaviors, customs and practices in production, trading and living which cause food unsafely, contributing to protecting human health and life; and about business ethics and responsibility of food producers and traders towards consumer health and life.
2. Information, education and communication on food safety must be:
a/ Accurate, prompt, explicit, simple and practical;
b/ Suitable to the nation's traditions, culture and identity, religions, social ethics, beliefs, customs and practices;
c/ Suitable to each category of targeted subjects.
Article 57. Contents of information, education and communication on food safety
1. Providing, propagating and disseminating knowledge and law on food safety.
2. Providing information on causes and ways of identifying food poisoning risks, food-borne diseases and measures to prevent and remedy food safety incidents.
3. Providing information on exemplary models of safe food production or trading; recall of unsafe foods, and handling of establishments that seriously violate the law on food safety.
Article 58. Entities eligible to access information, education and communication on food safety
1. All organizations and individuals have the right to access information, education and communication on food safety.
2. Priority will be given to the following entities in accessing information, education and communication on food safety:
a/ Food consumers;
b/ Managers and executive officers of food production or trading establishments; food producers and traders;
c/ Fresh and raw food producers and traders and small-scale food producers and traders; inhabitants in extreme socio-economic difficulty-hit areas.
Article 59. Forms of information, education and communication on food safety
1. Through competent state agencies in charge of food safety.
2. In the mass media.
3. Integration in teaching and learning activities at educational institutions of the national education system.
4. Through cultural and community activities and activities of mass organizations and social organizations, and other forms of public cultural activities.
5. Through food safety-related inquiry points at line ministries.
Article 60. Responsibilities in information, education and communication on food safety
1. Agencies, organizations and units shall, within the ambit of their tasks and powers, conduct information, education and communication on food safety.
2. The Minister of Health, line ministers and heads of concerned ministerial-level agencies shall direct concerned agencies in providing accurate and scientific information on food safety; and promptly give responses to untruthful information on food safety.
3. The Minister of Information and Communications shall direct mass media agencies in regularly providing information and communication on food safety and integrating programs on information and communication on food safety into other information and communication programs.
4. The Minister of Education and Training shall assume the prime responsibility for, and coordinate with the Minister of Health, line ministers and heads of concerned ministerial-level agencies in. combining education about food safety with other educational contents.
5. People's Committees at all levels shall organize the provision of information, education and communication on food safety to local people.
6. Mass media agencies shall prioritize in terms of schedule and length of broadcasts to provide information, education and communication on food safety on radios and televisions: and reserve appropriate spaces for articles and broadcasts on food safety in printed newspapers, televisions or online newspapers under regulations of the Minister of Information and Communications. Information, education and communication on food safety in the mass media is free of charge, unless it is provided under separate contracts with programs or projects or financed by domestic or foreign organizations or individuals.
7. The Vietnam Fatherland Front, mass organizations and social organizations shall, within the ambit of their responsibilities, conduct the work of information, education and communication on food safety.
STATE MANAGEMENT OF FOOD SAFETY
Section I. RESPONSIBILITIES FOR STATE MANAGEMENT OF FOOD SAFETY
Article 61. Responsibilities for state management of food safety
1. The Government shall perform the unified state management of food safety.
2. The Ministry of Health is answerable to the Government for performing the state management of food safety.
3. Ministries and ministerial-level agencies shall, within the ambit of their respective tasks and powers, coordinate with the Ministry of Health in performing the stale management of food safety.
4. People's Committees at all levels shall perform the sate management of food safety in their respective localities-
Article 62. Responsibilities of the Ministry of Health for state management of food safety
1. General responsibilities:
a/ To assume the prime responsibility for formulating and submitting national strategies and master plans on food safety to competent state agencies for promulgation, and organize the implementation thereof
b/ To promulgate national technical regulations on safety criteria and limits on food products; food-packaging tools and food packages and containers.
c/ To request ministries, sectors and provincial-level People's Committees to make regular and irregular reports on food safety management;
d/ To prescribe general conditions on food safety assurance for food producers and traders;
e/ To assume the prime responsibility for organizing the propagation and education about the taw on food safety: to warn food poisoning incidents.
f/ To unexpectedly inspect and examine all stages in the process of food production, import and trading under the scope of management of other ministries when necessary.
2. Responsibilities in sectoral management:
a/ To assume the prime responsibility for formulating and promulgating or submitting strategies, policies, master plans, plans and legal documents on food safety to competent state agencies for promulgation, and organize the implementation thereof in its assigned management domain;
b/ To manage food safety throughout the process of production, preliminary processing, processing, preservation, transportation, export, import and trading of food additives, food processing aids, bottled drinking water, natural mineral water, functional food and other foods under the Government's regulations:
c/ To manage food safety with regard to food-packaging tools and food packages and containers in the process of food production, processing and trading in its assigned management domain;
d/ To inspect, examine, and handle violations of the law on food safety in the process of food production, export, import and trading in its assigned management domains.
Article 63. Responsibilities of the Ministry of Agriculture and Rural Development
1. To assume the prime responsibility for formulating and promulgating or submitting policies, strategies, master plans, plans and legal documents on food safety in its assigned management domain to competent state agencies for promulgation, and organize the implementation thereof.
2. To manage food safely in the primary production of agricultural, forest, aquatic and salt products.
3. To manage food safety throughout the process of production, collection, slaughter, preliminary processing, processing, preservation. transportation, import, export and trading of cereals, meat and products thereof, aquatic animals and products thereof, vegetables, tubers and fruits and products thereof, eggs and products thereof, fresh milk, honey and products thereof, genetically modified food, salt and other farm products under the Government's regulations.
4. To manage food safety with regard to food-packaging tools and food packages and containers in the process of food production, processing and trading in its assigned management domain.
5. To make regular and irregular reports on the management of food safety in its assigned management domain.
6. To inspect, examine, and handle violations of the law on food safety in the process of food production, export, import and trading in its assigned management domain.
Article 64. Responsibilities of the Ministry of Industry and Trade
1. To assume the prime responsibility for formulating, promulgating or submitting policies, strategies, master plans, plans and legal documents on food safety in its assigned management domain to competent stale agencies for promulgation and organize the implementation thereof.
2. To manage food safety in the process of production, processing, preservation, transportation, import, export and trading of liquor, beer, beverage, processed milk, vegetable oil, powder and starch processed products and other products under the Government's regulations.
3. To manage food safety with regard to food-packaging tools and food packages and containers in the process of food production, processing and trading in its assigned management domain.
4. To promulgate policies and master plans on markets and supermarkets and regulations on food trading at markets and supermarkets.
5. To assume the prime responsibility for preventing and controlling fake food, and trade fraud in food circulation and trading.
6. To make regular and irregular reports on the management of food safety in its assigned management domain.
7. To inspect, examine, and handle violations of the law on food safety in the process of food production, import, export, and trading in its assigned management domain.
Article 65. State management responsibilities of People's Committees at all levels
1. To promulgate according to their competence or submit local legal documents and technical regulations to competent state agencies for promulgation; to formulate and implement master plans on safe food production zones and establishments so as to ensure management in the entire food supply chain.
2. To be responsible for managing food safety in their respective localities: to manage food safety assurance conditions for small-scale food production and trading establishments, street food, catering establishments, and food safety at local markets and subjects in their assigned management domain.
3. To make regular and irregular reports on the management of food safety in their respective localities.
4. To arrange human resources, train and improve qualifications of human resources for the work of food safety assurance in their respective localities.
5. To organize the work of information, education and communication to raise awareness about food safety, the sense of observing the law on food safety management, the sense of responsibility of food producers and traders toward the community and the awareness of consumers about food safety.
6. To inspect, examine and handle violations of the law on food safety in their respective localities.
Section 2. FOOD SAFETY INSPECTION
Article 66. Food safety inspection
1. Food safety inspection is specialized inspection. Food safety inspection shall be conducted by the health; agriculture and rural development; and industry and trade sectors under the law on inspection.
2. The Government shall specify the coordination among food safety inspectorates of ministries and ministerial-level agencies with other forces in ensuring food safety.
Article 67, Contents of food safety inspection
1. Compliance with technical standards and regulations on food safety applicable to food production and trading and food products promulgated by competent state agencies.
2. Compliance with relevant food safety standards announced by food producers for application to food production and trading and food products.
3. Advertising and labeling of food within the scope of management.
4. Regulation conformity certification and food safety testing.
5. Compliance with other legal provisions on food safety.
Section 3. FOOD SAFETY EXAMINATION
Article 68. Responsibilities for food safety examination
1. Food safety management agencies under line ministries shall conduct food safety examination in food production and trading under Articles 61 thru 64 of this Law.
2. Food safety management agencies under provincial-level People's Committees shall conduct food safety examination in their respective localities under regulations of line ministries and the assignment by provincial-level People's Committees.
3. In case an inter-sector examination of food safety is related to the management scopes of many sectors or localities, the agency in charge of the examination shall coordinate with concerned agencies under related ministries, ministerial-level agencies and provincial-level People's Committees in conducting the examination.
4. Food safety examination must ensure the following principles:
a/ Objectivity, accuracy, publicity, transparency and non-discrimination.
b/ Keeping confidential information, documents and results of examination related to inspected agencies and food producers and traders pending the availability of official conclusions;
c/ Causing no troubles to food producers and traders.
d/ Taking responsibility before law for relevant examination results and conclusions.
5. Line ministers shall specify food safety examination activities in their assigned management domains.
Article 69. Powers and tasks of food safety management agencies in food safety examination
I. Within the ambit of their respective tasks and powers, food safety management agencies have following powers in food safety examination:
a/ To decide to form examination teams to conduct planned or unexpected examinations.
b/ To warn food unsafely risks:
c/ To handle violations in the course of examination under Articles 30, 36 and 40 of the Law on Product and Goods Quality:
d/ To settle complaints and denunciations about decisions of examination teams, and acts of inspection team members under the Law on complaints and denunciations.
2. The food safety management agencies, within the ambit of their tasks and powers, have the following tasks:
a/ To draw up annual examination plans and submit them to competent state agencies for decision;
b/ To receive registration dossiers of registration for testing of the safety of imported food: to certify food safety assurance conditions for imported food;
c/ To issue handling decisions within 3 working days from the date of receiving reports of inspection teams regarding suspending food production, and trading activities, scaling up food and suspending advertisement of unsafe food.
1. An examination team shall be formed under a decision of the head of a food safety management agency on the basis of an examination program or plan approved by a competent state agency or in case of unexpected examination.
2. In the course of food safety examination, examination teams has the following powers and tasks:
a/ To request food producers and traders to present related documents, and handle violations in the course of examination under Articles 30 and 40 of the Law on Products and Goods Quality, to supply copies of the documents mentioned in this Clause, when necessary;
b/ To take samples for testing when necessary;
c/ To seal food, suspend the sale of unsuitable food, suspend food advertisements containing improper contents in the course of market examination and report to the food safety management agency within 24 hours after so doing:
d/ To request organizations and individuals producing and trading in food which is unconformable with announced applicable standards, technical regulations and regulations or relevant conditions to take remedies;
e/ To propose the food safety management agency to handle violations according to its competence specified in Article 69 of this Law;
f/ To ensure the examination principles provided in Clause 4. Article 68 of this Law during examination;
g/ To accurately and timely report examination results to the food safety management agency.
This Law takes effect on July 1., 2011.
The Ordinance No. 12/2003/PL-UBTVQH11 on Food Hygiene and Safety ceases to be effective on the effective date of this Law.
Article 72. Implementation detailing and guidance
The Government shall detail and guide the implementation of articles and clauses as assigned in this Law; and guide other necessary provisions of this Law to meet state management requirements.
This Law was passed on June 17, 2010, by the XIVth National Assembly of the Socialist Republic of Vietnam at its 7th session. -
