Điều 57. Sửa đổi, bổ sung một số điều của các luật có liên quan đến hoạt động quy hoạch

1. Sửa đổi, bổ sung khoản 2 Điều 50 của Luật Công nghệ thông tin số 67/2006/QH11 như sau:

“2. Bộ Thông tin và Truyền thông công bố danh mục và xây dựng chương trình phát triển các sản phẩm công nghệ thông tin trọng điểm trong từng thời kỳ phù hợp với chiến lược phát triển công nghiệp công nghệ thông tin.”.

2. Sửa đổi, bổ sung một số điều của Luật Tổ chức chính quyền địa phương số 77/2015/QH13 như sau:

a) Bãi bỏ điểm g khoản 3 Điều 19;

b) Sửa đổi, bổ sung điểm a khoản 2 Điều 128 như sau:

“a) Phù hợp với các quy hoạch có liên quan đã được cấp có thẩm quyền quyết định hoặc phê duyệt;”.

3. Sửa đổi, bổ sung một số điều của Luật Thú y số 79/2015/QH13 như sau:

a) Sửa đổi, bổ sung điểm b khoản 1 Điều 5 như sau:

“b) Xây dựng hệ thống truy xuất nguồn gốc động vật, sản phẩm động vật; xây dựng mạng lưới cơ sở giết mổ, sơ chế, chế biến sản phẩm động vật theo hướng công nghiệp gắn với vùng chăn nuôi;”;

b) Sửa đổi, bổ sung điểm b khoản 1 Điều 9 như sau:

“b) Xây dựng quy hoạch vùng và cơ sở an toàn dịch bệnh động vật, tích hợp vào quy hoạch tỉnh và tổ chức thực hiện; xây dựng, ban hành và tổ chức thực hiện kế hoạch phòng, chống dịch bệnh động vật, chương trình giám sát, khống chế, thanh toán dịch bệnh động vật;”;

c) Sửa đổi, bổ sung khoản 3 và khoản 4 Điều 40 như sau:

“3. Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn quy định việc lập trạm kiểm dịch động vật tại đầu mối giao thông trên phạm vi cả nước.

4. Ủy ban nhân dân cấp tỉnh căn cứ quy định của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn tại khoản 3 Điều này quyết định thành lập và tổ chức thực hiện việc kiểm dịch động vật, sản phẩm động vật của các trạm kiểm dịch động vật tại đầu mối giao thông trên địa bàn.”;

d) Sửa đổi, bổ sung điểm b khoản 1 Điều 76 như sau:

“b) Chỉ đạo xây dựng mạng lưới cơ sở giết mổ động vật tập trung và lập kế hoạch thực hiện việc giết mổ động vật tập trung;”;

đ) Sửa đổi, bổ sung điểm a khoản 2 Điều 76 như sau:

“a) Phối hợp với các phòng, ban, ngành liên quan tổ chức triển khai thực hiện mạng lưới cơ sở giết mổ động vật tập trung;”.

4. Sửa đổi, bổ sung Điều 58 của Luật Dự trữ quốc gia số 22/2012/QH13 như sau:

“Điều 58. Quy hoạch tổng thể hệ thống kho dự trữ quốc gia

1. Việc lập quy hoạch tổng thể hệ thống kho dự trữ quốc gia phải tuân thủ các nguyên tắc theo quy định của Luật Quy hoạch và bảo đảm phù hợp với chiến lược dự trữ quốc gia; đồng bộ, phù hợp với nơi sản xuất nguồn hàng, mật độ dân cư; bảo đảm an toàn.

2. Quy hoạch tổng thể hệ thống kho dự trữ quốc gia bao gồm các nội dung theo quy định của Luật Quy hoạch và đáp ứng các yêu cầu sau đây:

a) Phù hợp với mục tiêu và yêu cầu dự trữ quốc gia;

b) Bảo đảm tính liên hoàn của hệ thống kho dự trữ quốc gia theo tuyến, vùng lãnh thổ;

c) Bảo đảm phát triển theo hướng hiện đại hóa;

d) Phù hợp với khả năng vốn đầu tư;

đ) Xác định rõ giải pháp và lộ trình thực hiện.

3. Việc lập, thẩm định, phê duyệt, công bố, thực hiện, điều chỉnh quy hoạch tổng thể hệ thống kho dự trữ quốc gia thực hiện theo quy định của pháp luật về quy hoạch và quy định khác của pháp luật có liên quan.”.

5. Sửa đổi, bổ sung Điều 8 của Luật Giáo dục nghề nghiệp số 74/2014/QH13 như sau:

“Điều 8. Quy hoạch mạng lưới cơ sở giáo dục nghề nghiệp

1. Việc lập quy hoạch mạng lưới cơ sở giáo dục nghề nghiệp phải tuân thủ các nguyên tắc theo quy định của Luật Quy hoạch và bảo đảm cơ cấu ngành, nghề, trình độ đào tạo và cơ cấu vùng, miền; tính đa dạng, đồng bộ của hệ thống giáo dục nghề nghiệp, gắn đào tạo với sản xuất, kinh doanh và dịch vụ; từng bước nâng cao chất lượng đào tạo, phục vụ sự nghiệp công nghiệp hóa, hiện đại hóa và hội nhập quốc tế.

2. Quy hoạch mạng lưới cơ sở giáo dục nghề nghiệp bao gồm nội dung theo quy định của Luật Quy hoạch và các nội dung sau đây:

a) Cơ cấu mạng lưới cơ sở giáo dục nghề nghiệp và quy mô đào tạo theo ngành, nghề, trình độ đào tạo, loại hình cơ sở giáo dục nghề nghiệp;

b) Phân bố các cơ sở giáo dục nghề nghiệp theo từng vùng, từng địa phương;

c) Phát triển đội ngũ nhà giáo và cán bộ quản lý giáo dục nghề nghiệp;

d) Đầu tư cơ sở vật chất, thiết bị đào tạo.

3. Việc lập, thẩm định, phê duyệt, công bố, thực hiện, điều chỉnh quy hoạch mạng lưới cơ sở giáo dục, nghề nghiệp quốc gia thực hiện theo quy định của pháp luật về quy hoạch và quy định khác của pháp luật có liên quan.

4. Bộ, cơ quan ngang bộ, Ủy ban nhân dân cấp tỉnh căn cứ vào quy hoạch mạng lưới cơ sở giáo dục nghề nghiệp quốc gia xây dựng và phê duyệt quy hoạch mạng lưới cơ sở giáo dục nghề nghiệp của Bộ, cơ quan ngang bộ, địa phương mình và chịu trách nhiệm chỉ đạo việc tổ chức thực hiện.

Việc tích hợp quy hoạch mạng lưới cơ sở giáo dục nghề nghiệp của Bộ, cơ quan ngang bộ, địa phương vào các quy hoạch thuộc hệ thống quy hoạch quốc gia thực hiện theo quy định của pháp luật về quy hoạch.”.

6. Bổ sung khoản 5 vào Điều 82 của Luật Khám bệnh, chữa bệnh số 40/2009/QH12 như sau:

“5. Quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh trên toàn quốc và cơ sở khám bệnh, chữa bệnh chuyên ngành được tích hợp vào quy hoạch mạng lưới cơ sở y tế quốc gia; quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh của địa phương được tích hợp vào quy hoạch tỉnh theo quy định của pháp luật về quy hoạch.”.

7. Sửa đổi, bổ sung một số điều của Luật Viễn thông số 41/2009/QH12 như sau:

a) Sửa đổi, bổ sung điểm a khoản 2 Điều 8 như sau:

“a) Phù hợp với chiến lược phát triển kinh tế - xã hội, quy hoạch cấp quốc gia, kế hoạch phát triển kinh tế - xã hội của đất nước trong từng thời kỳ; tuân thủ pháp luật Việt Nam, điều ước quốc tế mà Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên;”;

b) Sửa đổi, bổ sung khoản 3 Điều 8 như sau:

“3. Bộ Thông tin và Truyền thông xây dựng quy hoạch phát triển viễn thông quốc gia và tích hợp vào quy hoạch hạ tầng thông tin và truyền thông quốc gia theo quy định của pháp luật về quy hoạch và quy định khác của pháp luật có liên quan.”;

c) Sửa đổi, bổ sung điểm đ khoản 1 Điều 14 như sau:

“đ) Được phân bổ tài nguyên viễn thông theo quy định về quản lý tài nguyên viễn thông;”;

d) Sửa đổi, bổ sung khoản 3 Điều 38 như sau:

“3. Việc sửa đổi, bổ sung giấy phép viễn thông trong thời gian giấy phép còn hiệu lực được thực hiện theo đề nghị của tổ chức được cấp giấy phép hoặc theo yêu cầu của Bộ Thông tin và Truyền thông phải phù hợp với các quy định về quản lý tài nguyên viễn thông, kết nối, giá cước, tiêu chuẩn, quy chuẩn kỹ thuật viễn thông.”;

đ) Sửa đổi, bổ sung khoản 1 Điều 60 như sau:

“1. Việc sử dụng chung cơ sở hạ tầng kỹ thuật giao thông, cung cấp năng lượng, chiếu sáng công cộng, cấp nước, thoát nước, viễn thông và các công trình hạ tầng kỹ thuật khác được thực hiện theo nguyên tắc hiệu quả, tiết kiệm, bảo đảm yêu cầu về cảnh quan, môi trường, phù hợp với các quy hoạch được cơ quan có thẩm quyền quyết định hoặc phê duyệt.”.

8. Sửa đổi, bổ sung một số Điều của Luật Thực hành tiết kiệm, chống lãng phí số 44/2013/QH13 như sau:

a) Sửa đổi, bổ sung điểm d khoản 2 Điều 5 như sau:

“d) Các quy hoạch đã được cơ quan có thẩm quyền quyết định hoặc phê duyệt; kế hoạch phát triển kinh tế - xã hội; kế hoạch phát triển ngành, vùng; kế hoạch sử dụng đất; danh mục dự án đầu tư, nguồn vốn đầu tư; kế hoạch và hoạt động khai thác tài nguyên;”;

b) Sửa đổi, bổ sung Điều 33 như sau:

“Điều 33. Lập, thẩm định, phê duyệt quy hoạch, kế hoạch và danh mục dự án đầu tư

1. Việc lập, thẩm định và phê duyệt quy hoạch trong hệ thống quy hoạch quốc gia; kế hoạch phát triển kinh tế - xã hội; kế hoạch phát triển ngành, vùng, lĩnh vực và sản phẩm; kế hoạch sử dụng đất phải phù hợp với định hướng, chiến lược phát triển kinh tế - xã hội và khả năng của nền kinh tế.

2. Việc lập, thẩm định và phê duyệt danh mục dự án đầu tư phải phù hợp với quy hoạch đã được cơ quan có thẩm quyền quyết định hoặc phê duyệt; kế hoạch phát triển kinh tế - xã hội; kế hoạch phát triển ngành, vùng, lĩnh vực và sản phẩm; kế hoạch sử dụng đất.”;

c) Sửa đổi, bổ sung khoản 1 Điều 34 như sau:

“1. Lập, thẩm định dự án đầu tư phải phù hợp với quy hoạch được cơ quan có thẩm quyền quyết định hoặc phê duyệt; kế hoạch phát triển kinh tế - xã hội; kế hoạch phát triển ngành, vùng; kế hoạch sử dụng đất; danh mục dự án đầu tư theo đúng tiêu chuẩn, quy chuẩn trong xây dựng.”.

9. Quy hoạch phát triển kinh tế - xã hội, quy hoạch tổng thể phát triển kinh tế - xã hội tại Luật Quốc phòng số 39/2005/QH11, Luật Tần số vô tuyến điện số 42/2009/QH12, Luật Giáo dục số 38/2005/QH11 đã được sửa đổi, bổ sung theo Luật sửa đổi, bổ sung một số Điều của Luật Giáo dục số 44/2009/QH12, Luật Biển Việt Nam số 18/2012/QH13, Luật Phòng, chống thiên tai số 33/2013/QH13, Luật Nhà ở số 65/2014/QH13, Luật Công an nhân dân số 73/2014/QH13, Luật Tài nguyên, môi trường biển và hải đảo số 82/2015/QH13, Luật Tiếp cận thông tin số 104/2016/QH13, Luật Du lịch số 09/2017/QH14, Pháp lệnh về Giống cây trồng số 15/2004/PL-UBTVQH11, Pháp lệnh về Giống vật nuôi số 16/2004/PL- UBTVQH11, Pháp lệnh Dân số số 06/2003/PL-UBTVQH11 đã được sửa đổi, bổ sung theo Pháp lệnh sửa đổi Điều 10 của Pháp lệnh Dân số số 08/2008/PL-UBTVQH12 và các văn bản quy phạm pháp luật khác được thay thế bằng quy hoạch được cơ quan có thẩm quyền quyết định hoặc phê duyệt.

Điều 58. Hiệu lực thi hành

1. Luật này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2019.

2. Các quy định của Luật này về lập, thẩm định quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh có hiệu lực thi hành từ ngày 01 tháng 3 năm 2018.

Chính phủ bảo đảm kinh phí lập, thẩm định quy hoạch quy định tại khoản này theo quy định của pháp luật về đầu tư công và pháp luật về ngân sách nhà nước.

Điều 59. Quy định chuyển tiếp

1. Các quy hoạch đã được quyết định hoặc phê duyệt theo quy định của pháp luật trước ngày Luật này có hiệu lực được thực hiện như sau:

a) Quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh được thực hiện đến hết thời kỳ quy hoạch; trường hợp nội dung của quy hoạch đó không phù hợp với quy định của Luật này thì phải Điều chỉnh theo quy định của Luật này;

b) Các quy hoạch có tính chất kỹ thuật, chuyên ngành quy định tại Phụ lục 2 của Luật này được tiếp tục thực hiện theo quy định của pháp luật có liên quan; trường hợp nội dung của quy hoạch đó không phù hợp với quy hoạch cao hơn đã được quyết định hoặc phê duyệt theo quy định của Luật này thì phải điều chỉnh cho phù hợp với quy hoạch cao hơn;

c) Các quy hoạch được tích hợp vào quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh được thực hiện cho đến khi quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh được quyết định hoặc phê duyệt theo quy định của Luật này, trừ trường hợp quy định tại điểm b khoản này;

d) Các quy hoạch về đầu tư phát triển hàng hóa, dịch vụ, sản phẩm cụ thể, ấn định khối lượng, số lượng hàng hóa, dịch vụ, sản phẩm được sản xuất, tiêu thụ đã được quyết định hoặc phê duyệt hết hiệu lực chậm nhất là ngày 31 tháng 12 năm 2018.

2. Quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh đã được lập, thẩm định trước ngày Luật này có hiệu lực mà chưa được quyết định hoặc phê duyệt thì được thực hiện quyết định hoặc phê duyệt theo quy định của Luật này.

3. Dự án đã được cơ quan có thẩm quyền phê duyệt theo quy hoạch đã được công bố trước ngày Luật này có hiệu lực thì được thực hiện đến hết thời hạn của dự án đó theo quy định của pháp luật có liên quan.

4. Chính phủ rà soát, ban hành danh mục các quy hoạch quy định tại điểm c và điểm d khoản 1 Điều này và tại điểm 39 của Phụ lục 2 trước ngày 31 tháng 12 năm 2018.

5. Chính phủ rà soát, trình Quốc hội sửa đổi, bổ sung các quy định liên quan đến quy hoạch trong các bộ luật, luật thuộc danh mục quy định tại Phụ lục 3 của Luật này và các văn bản quy phạm pháp luật khác bảo đảm phù hợp với Luật Quy hoạch và có hiệu lực thi hành chậm nhất là ngày 01 tháng 01 năm 2019.

Chapter VI

IMPLEMENTATION CLAUSE

Article 57. Amendments to certain articles of the laws relating to planning

1. Clause 2, Article 50 of the Law on Information Technology No. 67/2006/QH11 is amended as follows:

“2. The Ministry of Information and Communications shall announce the list and formulate a plan for development of focal information technology products during each period in conformity with the information technology development strategy.”.

2. Certain articles of the Law on Local Government Organization No. 77/2015/QH13 are amended as follows:

a) Point g, Clause 3 of Article 19 is annulled

b) Point a, Clause 2 of Article 128 is amended as follows:

“a) Conform to the relevant planning decided or approved by the competent authority;”.

3. Certain articles of the Law on Veterinary Medicine No. 79/2015/QH13 are amended as follows:

a) Point b, Clause 1 of Article 5 is amended as follows:

“b) Creation of system for tracing origin of animals and animal products; creation of a network of slaughterhouses and animal product preparing establishments towards industrialization in association with breeding areas;”;

b) Point b, Clause 1 of Article 9 is amended as follows:

“b) Formulate planning for animal epidemic-free zones and establishments, integrate it into the provincial planning and organize implementation thereof; formulate, unveil and organize implementation of the plan for prevention and fighting against animal diseases; programs for supervision, control and eradication of animal diseases;”;

c) Clause 3 and Clause 4, Article 40 are amended as follows:

“3. The Minister of Agriculture and Rural Development shall decide the establishment of animal quarantine stations at main roads nationwide.

4. The People's Committees of provinces shall, according to the regulation of the Minister of Agriculture and Rural Development that is specified in Clause 3 of this Article, decide to establish and organize quarantine of animals and animal products of animal quarantine stations at main roads in within their provinces.”;

d) Point b, Clause 1 of Article 76 is amended as follows:

“b) Direct creation of a network of centralized slaughterhouses and formulation of plans for centralized animal slaughter;

dd) Point a, Clause 2 of Article 76 is amended as follows:

“a) Cooperate with relevant divisions and sectors in setting up a network of centralized slaughterhouses;”.

4. Article 58 of the Law on National Reserve No. 22/2012/QH13 is amended as follows:

“Article 58. Comprehensive national reserve warehouse system planning

1. The comprehensive planning of the system of national reserve warehouses shall be formulated in accordance with the principles prescribed by the Law on Planning and in conformity with the national reserve strategy; in conformity with places of commodity sources, population density; in accordance with safety requirements.

2. The comprehensive national reserve warehouse system planning includes the contents prescribed by the Law on Planning and is compliant with the following requirements:

a) Conform to the objectives and requirements for national reserves;

b) Ensure continuity in the system of national reserve warehouses according to territorial lines and regions;

c) Ensure development towards modernization;

d) Conform to the amount of investments;

dd) Clearly determine implementation solutions and roadmaps.

3. The formulation, appraisal, approval, announcement, implementation and adjustment of the comprehensive national reserve warehouse system planning shall be carried out in accordance with regulations of the Law on Planning and other relevant regulations of law.”.

5. Article 8 of the Law on Vocational Education No. 74/2014/QH13 is amended as follows:

 “Article 8. Vocational education institution network planning

1. The vocational education institution network planning shall be formulated in accordance with the principles prescribed by the Law on Planning and ensure the structure of disciplines, training levels and structure of regions; diversity and uniformity of the vocational education system, combination of training and production, business and services; improvement in training quality, and shall serve industrialization, modernization and international integration.

2. The vocational education institution network planning includes the contents prescribed by the Law on Planning and the following contents:

a) Structure of networks of vocational education institutions and training scope according to disciplines, training levels, and types of vocational education institutions;

b) Dispose vocational education institutions in every area or local government;

c) Develop teaching staff and vocational education administrative officials;

d) Invest in training facilities and equipment.

3. The formulation, appraisal, approval, announcement, implementation and adjustment of the national vocational educational institution network planning shall be carried out in accordance with regulations of the Law on Planning and other relevant regulations of law.

4. Ministries, ministerial authorities and People’s Committees of provinces shall, according to the national vocational educational institutions network planning, formulate and approve the planning for a network of their vocational educational institutions and take responsibility for directing the implementation thereof.

The planning for a network of national vocational educational institutions of Ministries, ministerial authorities and local governments shall be integrated into the planning under the national planning system in accordance with regulations of the Law on Planning.”.

6. Clause 5 is added to Article 82 of the Law on Medical Examination and Treatment No. 40/2009/QH12 as follows:

“5. The planning for the system of health facilities nationwide and specialized health facilities shall be integrated into the national health facility network planning; the local health facility system planning shall be integrated into the provincial planning in accordance with regulations of the Law on Planning.".

7. Certain articles of the Law on Telecommunications No. 41/2009/QH12 are amended as follows:

a) Point a, Clause 2 of Article 8 is amended as follows:

“a) Conform to the national socio­economic development strategy, national planning and national socio-economic development plan during each period; comply with Vietnamese laws and international treaties to which the Socialist Republic of Vietnam is a signatory;”;

b) Clause 3 of Article 8 is amended as follows:

“3. The Ministry of Information and Communications shall formulate the national telecommunications development planning and integrate it into the national information and communication infrastructure planning in accordance with regulations of the Law on Planning and other relevant regulations of law.”;

c) Point dd, Clause 1 of Article 14 is amended as follows:

“dd) Be allowed to distribute telecommunications resources in accordance with regulations on management of telecommunications resources;”;

b) Clause 3 of Article 38 is amended as follows:

“3. The adjustment that is made to a telecommunications license within its validity period at the request of the licensed organization or of the Ministry of Information and Communications shall be conformable to regulations on management of telecommunications resources, telecommunications connection, charge rates, technical standards and regulations on telecommunications.”;

dd) Clause 1 of Article 60 is amended as follows:

“1. The common use of transport, energy supply, public lighting, water supply and drainage and telecommunications infrastructure and other infrastructure works must ensure effectiveness and thrift and fulfillment of requirements for landscape and environment, and be conformable to the planning decided or approved by a competent authority.”.

8. Certain articles of the Law on Thrift Practice and Waste Combat No. 44/2013/QH13 are amended as follows:

a) Point d, Clause 2 of Article 5 is amended as follows:

“d) The planning decided or approved by the competent authority; socio-economic development plans; sector and regional development plans; land use plans; list of investment projects and investments; natural resource extraction plans and natural resource extraction;";

b) Article 33 is amended as follows:

“Article 33. Formulation, appraisal and approval of planning, plans and list of investment projects

1. The formulation, appraisal and approval of the planning under the national planning; socio-economic development planning; sector and regional development planning; and land use planning shall be conformable to the socio-economic development strategy and orientation and capability of the economy.

2. The formulation, appraisal and approval of the list of investment projects shall be conformable to the planning decided or approved by the competent authority; socio-economic development plans; plans for development of sectors, regions, fields and products; land use plans.”;

c) Clause 1 of Article 34 is amended as follows:

“1. The formulation and appraisal of the investment projects shall be conformable to the planning decided or approved by the competent authority; socio-economic development plans; sector and regional development plans; land use plans; list of investment projects in accordance with regulations and standards on construction.”.

9. The socio-economic development planning and comprehensive socio-economic development planning which are specified in the Law on National Defense No. 39/2005/QH11, Law on Radio Frequencies No. 42/2009/QH12, Law on Education No. 38/2005/QH11 already amended in the Law on amendments to certain articles of the Law on Education No 44/2009/QH12, Law on Vietnamese Sea No. 18/2012/QH13, Law on Natural disaster management No. 33/2013/QH13, Law on Housing No. 65/2014/QH13, Law on the People’s Public Security Forces No.73/2014/QH13, Law On Natural Resources and Environment of Sea And Islands No. 82/2015/QH13, Law on Access to Information No. 104/2016/QH13, Law on Tourism No.09/2017/QH14, Ordinance on Plant Varieties No. 15/2004/PL-UBTVQH11, Ordinance on Livestock Breeds No. 16/2004/PL- UBTVQH11, Ordinance on Population No. 08/2008/PL-UBTVQH12 already amended in the Ordinance on amendments to Article 10 of the Ordinance on Population No. 08/2008/PL-UBTVQH12 and other legislative documents shall be replaced with the planning decided or approved by the competent authority.

Article 58. Effect

1. This Law comes into force from January 01, 2019.

2. The regulations of this Law on formulation and appraisal of the national planning, regional planning and regional planning come into force from March 01, 2018.

The Government shall provide funding for formulation and appraisal of the planning specified in this Clause in accordance with regulations of the Law on Public Investment and Law on State Budget.

Article 59. Transition clause

1. The planning already decided or approved in accordance with regulations of Law before the effective date of this Law shall be implemented as follows:

a) The national, regional and provincial planning shall be implemented until the end of the planning period. If the contents of such planning are inconsistent with regulations of this Law, such contents shall be adjusted as prescribed by this Law;

b) The detailed planning specified in Appendix 2 of this Law shall continue to be implemented in accordance with relevant regulations of law. If the contents of such planning are inconsistent with the planning at a higher level that is already decided or approved as prescribed by this Law, such contents shall be adjusted to be consistent with the planning at a higher level;

c) The planning integrated into the national, regional and provincial planning shall be implemented until the national, regional and provincial planning are decided or approved as prescribed by this Law, except for the case prescribed in Point b of this Clause;

d) The planning for investment in and development of specific goods, services and products, determination of the volume of goods, services and produced and sold products that is decided or approved is null and void no later than December 31, 2018.

2. The national, regional and provincial planning already that are formulated and appraised before the effective date of this Law but are yet to be decided or approved shall be decided or approved as prescribed by this Law.

3. The planning already decided or approved by the competent authority according to the planning announced before the effective date of this Law shall be implemented until the expiry of such planning in accordance with regulations of law.

4. The Government shall review and issue the list of planning set forth in Point c and Point d, Clause 1 of this Article and Point 39 of the Appendix 2 before December 31, 2018.

5. The Government shall review and request the National Assembly to amend the regulations on planning which are specified in codes and laws on the list provided in the Appendix 3 of this Law and other legislative documents to ensure conformity with the Law on Planning and which come into force no later than January 01, 2019.
