Căn cứ Hiến pháp nước Cộng hòa xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Quốc hội ban hành Luật khám bệnh, chữa bệnh,
Luật này quy định quyền và nghĩa vụ của người bệnh, người hành nghề khám bệnh, chữa bệnh và cơ sở khám bệnh, chữa bệnh; điều kiện đối với người hành nghề khám bệnh, chữa bệnh và cơ sở khám bệnh, chữa bệnh; quy định chuyên môn kỹ thuật trong khám bệnh, chữa bệnh; áp dụng kỹ thuật, phương pháp mới trong khám bệnh, chữa bệnh; sai sót chuyên môn kỹ thuật, giải quyết khiếu nại, tố cáo và tranh chấp trong khám bệnh, chữa bệnh; điều kiện bảo đảm công tác khám bệnh, chữa bệnh.
Điều 2. Giải thích từ ngữTrong Luật này, các từ ngữ dưới đây được hiểu như sau:
1. Khám bệnh là việc hỏi bệnh, khai thác tiền sử bệnh, thăm khám thực thể, khi cần thiết thì chỉ định làm xét nghiệm cận lâm sàng, thăm dò chức năng để chẩn đoán và chỉ định phương pháp điều trị phù hợp đã được công nhận.
2. Chữa bệnh là việc sử dụng phương pháp chuyên môn kỹ thuật đã được công nhận và thuốc đã được phép lưu hành để cấp cứu, điều trị, chăm sóc, phục hồi chức năng cho người bệnh.
3. Người bệnh là người sử dụng dịch vụ khám bệnh, chữa bệnh.
4. Chứng chỉ hành nghề khám bệnh, chữa bệnh là văn bản do cơ quan nhà nước có thẩm quyền cấp cho người có đủ điều kiện hành nghề theo quy định của Luật này (sau đây gọi chung là chứng chỉ hành nghề).
5. Giấy phép hoạt động khám bệnh, chữa bệnh là văn bản do cơ quan nhà nước có thẩm quyền cấp cho cơ sở khám bệnh, chữa bệnh có đủ điều kiện hoạt động theo quy định của Luật này (sau đây gọi chung là giấy phép hoạt động).
6. Người hành nghề khám bệnh, chữa bệnh là người đã được cấp chứng chỉ hành nghề và thực hiện khám bệnh, chữa bệnh (sau đây gọi chung là người hành nghề).
7. Cơ sở khám bệnh, chữa bệnh là cơ sở cố định hoặc lưu động đã được cấp giấy phép hoạt động và cung cấp dịch vụ khám bệnh, chữa bệnh.
8. Lương y là người có hiểu biết về lý luận y dược học cổ truyền, có kinh nghiệm khám bệnh, chữa bệnh bằng phương pháp y dược học cổ truyền có dùng thuốc hoặc không dùng thuốc được Bộ Y tế hoặc Sở Y tế công nhận sau khi có ý kiến của Hội đông y trung ương hoặc Hội đông y cấp tỉnh.
9. Người có bài thuốc gia truyền hoặc có phương pháp chữa bệnh gia truyền là người sở hữu bài thuốc hoặc phương pháp chữa bệnh theo kinh nghiệm lâu đời do dòng tộc, gia đình truyền lại, điều trị có hiệu quả đối với một hoặc vài bệnh, chứng nhất định được Sở Y tế công nhận sau khi có ý kiến của Hội đông y cấp tỉnh.
10. Cập nhật kiến thức y khoa liên tục là việc người hành nghề tham gia các khóa đào tạo, bồi dưỡng ngắn hạn, hội nghị, hội thảo về y khoa thuộc lĩnh vực hành nghề theo chương trình do Bộ Y tế phê duyệt hoặc công nhận và được cấp giấy chứng nhận theo quy định của Bộ trưởng Bộ Y tế.
11. Người bệnh không có người nhận là người bệnh đang ở trong tình trạng cấp cứu, bị bệnh tâm thần hoặc bị bỏ rơi, bao gồm cả trẻ sơ sinh bị bỏ rơi tại cơ sở khám bệnh, chữa bệnh mà không có giấy tờ tùy thân, không xác định được địa chỉ cư trú.
12. Hội chẩn là hình thức thảo luận giữa những người hành nghề về tình trạng bệnh của người bệnh để chẩn đoán và đưa ra phương pháp điều trị phù hợp, kịp thời.
13. Tai biến trong khám bệnh, chữa bệnh là hậu quả gây tổn hại đến sức khỏe, tính mạng của người bệnh do sai sót chuyên môn kỹ thuật trong khám bệnh, chữa bệnh hoặc rủi ro xảy ra ngoài ý muốn trong khám bệnh, chữa bệnh mặc dù người hành nghề đã tuân thủ các quy định chuyên môn kỹ thuật.
Điều 3. Nguyên tắc trong hành nghề khám bệnh, chữa bệnh1. Bình đẳng, công bằng và không kỳ thị, phân biệt đối xử đối với người bệnh.
2. Tôn trọng quyền của người bệnh; giữ bí mật thông tin về tình trạng sức khỏe và đời tư được ghi trong hồ sơ bệnh án, trừ trường hợp quy định tại khoản 2 Điều 8, khoản 1 Điều 11 và khoản 4 Điều 59 của Luật này.
3. Kịp thời và tuân thủ đúng quy định chuyên môn kỹ thuật
4. Ưu tiên khám bệnh, chữa bệnh đối với trường hợp cấp cứu, trẻ em dưới 6 tuổi, người khuyết tật nặng, người từ đủ 80 tuổi trở lên, người có công với cách mạng, phụ nữ có thai.
5. Bảo đảm đạo đức nghề nghiệp của người hành nghề.
6. Tôn trọng, hợp tác và bảo vệ người hành nghề khi làm nhiệm vụ.
Điều 4. Chính sách của Nhà nước về khám bệnh, chữa bệnh1. Ưu tiên bố trí ngân sách nhằm đáp ứng nhu cầu khám bệnh, chữa bệnh cơ bản của nhân dân. Quan tâm dành ngân sách cho việc chăm sóc sức khỏe đối với người có công với cách mạng, trẻ em, người nghèo, nông dân, đồng bào dân tộc thiểu số, nhân dân ở vùng có điều kiện kinh tế - xã hội khó khăn và vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn.
2. Tăng cường phát triển nguồn nhân lực y tế, đặc biệt là nguồn nhân lực y tế ở vùng có điều kiện kinh tế - xã hội khó khăn và vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn. Thực hiện chế độ luân phiên có thời hạn đối với người hành nghề tại cơ sở khám bệnh, chữa bệnh từ tuyến trên xuống tuyến dưới, từ vùng có điều kiện kinh tế - xã hội không khó khăn đến vùng có điều kiện kinh tế - xã hội khó khăn và vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn.
3. Đẩy mạnh xã hội hóa các hoạt động khám bệnh, chữa bệnh; khuyến khích tổ chức, cá nhân đầu tư phát triển dịch vụ khám bệnh, chữa bệnh.
4. Khuyến khích việc nghiên cứu, ứng dụng khoa học, công nghệ trong khám bệnh, chữa bệnh.
5. Kết hợp y học hiện đại với y học cổ truyền trong khám bệnh, chữa bệnh.
Điều 5. Trách nhiệm quản lý nhà nước về khám bệnh, chữa bệnh1. Chính phủ thống nhất quản lý nhà nước về khám bệnh, chữa bệnh
2. Bộ Y tế chịu trách nhiệm trước Chính phủ thực hiện quản lý nhà nước về khám bệnh, chữa bệnh và có các nhiệm vụ, quyền hạn sau đây:
a) Xây dựng và ban hành theo thẩm quyền hoặc trình cơ quan có thẩm quyền ban hành văn bản quy phạm pháp luật, quy chuẩn kỹ thuật về khám bệnh, chữa bệnh; chiến lược phát triển, quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh;
b) Chỉ đạo hướng dẫn, tuyên truyền và tổ chức triển khai thực hiện văn bản quy phạm pháp luật về khám bệnh, chữa bệnh; chiến lược phát triển, quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh;
c) Quản lý thống nhất việc cấp, cấp lại, thu hồi chứng chỉ hành nghề và giấy phép hoạt động;
d) Xây dựng và quản lý cơ sở dữ liệu quốc gia về người hành nghề và cơ sở khám bệnh, chữa bệnh;
đ) Thanh tra, kiểm tra, giải quyết khiếu nại, tố cáo và xử lý vi phạm pháp luật về khám bệnh, chữa bệnh;
e) Tổ chức đào tạo, đào tạo liên tục, bồi dưỡng phát triển nguồn nhân lực; hướng dẫn việc luân phiên người hành nghề; nghiên cứu, ứng dụng khoa học và công nghệ trong khám bệnh, chữa bệnh;
g) Thực hiện hợp tác quốc tế về khám bệnh, chữa bệnh; thừa nhận chứng chỉ hành nghề giữa các nước; hướng dẫn khám bệnh, chữa bệnh nhân đạo; hợp tác chuyên gia, chuyển giao kỹ thuật và phương pháp chữa bệnh mới.
3. Bộ Quốc phòng trong phạm vi nhiệm vụ, quyền hạn của mình tổ chức thực hiện và hướng dẫn việc khám bệnh, chữa bệnh tại cơ sở khám bệnh, chữa bệnh thuộc thẩm quyền quản lý theo quy định của Luật này và phù hợp với điều kiện thực tế của quân đội.
4. Các bộ, cơ quan ngang bộ trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm phối hợp với Bộ Y tế thực hiện quản lý nhà nước về khám bệnh, chữa bệnh.
5. Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương (sau đây gọi chung là cấp tỉnh) trong phạm vi nhiệm vụ, quyền hạn của mình thực hiện quản lý nhà nước về khám bệnh, chữa bệnh trong phạm vi địa phương.
Điều 6. Các hành vi bị cấm1. Từ chối hoặc cố ý chậm cấp cứu người bệnh
2. Khám bệnh, chữa bệnh không có chứng chỉ hành nghề hoặc đang trong thời gian bị đình chỉ hành nghề, cung cấp dịch vụ khám bệnh, chữa bệnh mà không có giấy phép hoạt động hoặc đang trong thời gian bị đình chỉ hoạt động.
3. Hành nghề khám bệnh, chữa bệnh, cung cấp dịch vụ khám bệnh, chữa bệnh vượt quá phạm vi hoạt động chuyên môn được ghi trong chứng chỉ hành nghề, giấy phép hoạt động, trừ trường hợp cấp cứu.
4. Thuê, mượn, cho thuê, cho mượn chứng chỉ hành nghề hoặc giấy phép hoạt động.
5. Người hành nghề bán thuốc cho người bệnh dưới mọi hình thức, trừ bác sỹ đông y, y sỹ đông y, lương y và người có bài thuốc gia truyền.
6. Áp dụng phương pháp chuyên môn kỹ thuật y tế chưa được công nhận, sử dụng thuốc chưa được phép lưu hành trong khám bệnh, chữa bệnh.
7. Quảng cáo không đúng với khả năng, trình độ chuyên môn hoặc quá phạm vi hoạt động chuyên môn được ghi trong chứng chỉ hành nghề, giấy phép hoạt động; lợi dụng kiến thức y học cổ truyền hoặc kiến thức y khoa khác để quảng cáo gian dối về phương pháp chữa bệnh, thuốc chữa bệnh.
8. Sử dụng hình thức mê tín trong khám bệnh, chữa bệnh.
9. Người hành nghề sử dụng rượu, bia, thuốc lá hoặc có nồng độ cồn trong máu, hơi thở khi khám bệnh, chữa bệnh.
10. Vi phạm quyền của người bệnh; không tuân thủ các quy định chuyên môn kỹ thuật trong khám bệnh, chữa bệnh; lợi dụng chức vụ, quyền hạn trong quá trình khám bệnh, chữa bệnh; lạm dụng nghề nghiệp để xâm phạm danh dự, nhân phẩm, thân thể người bệnh; tẩy xóa, sửa chữa hồ sơ bệnh án nhằm làm sai lệch thông tin về khám bệnh, chữa bệnh.
11. Gây tổn hại đến sức khỏe, tính mạng, danh dự, nhân phẩm của người hành nghề.
12. Ngăn cản người bệnh thuộc diện chữa bệnh bắt buộc vào cơ sở khám bệnh, chữa bệnh hoặc cố ý thực hiện chữa bệnh bắt buộc đối với người không thuộc diện chữa bệnh bắt buộc.
13. Cán bộ, công chức, viên chức y tế thành lập, tham gia thành lập hoặc tham gia quản lý, điều hành bệnh viện tư nhân hoặc cơ sở khám bệnh, chữa bệnh được thành lập và hoạt động theo Luật doanh nghiệp và Luật hợp tác xã, trừ trường hợp được cơ quan nhà nước có thẩm quyền cử tham gia quản lý, điều hành tại cơ sở khám bệnh, chữa bệnh có phần vốn của Nhà nước.
14. Đưa, nhận, môi giới hối lộ trong khám bệnh, chữa bệnh.
Điều 7. Quyền được khám bệnh, chữa bệnh có chất lượng phù hợp với điều kiện thực tế
1. Được tư vấn, giải thích về tình trạng sức khỏe, phương pháp điều trị và dịch vụ khám bệnh, chữa bệnh phù hợp với bệnh.
2. Được điều trị bằng phương pháp an toàn, hợp lý và có hiệu quả theo các quy định chuyên môn kỹ thuật.
Điều 8. Quyền được tôn trọng bí mật riêng tư1. Được giữ bí mật thông tin về tình trạng sức khỏe và đời tư được ghi trong hồ sơ bệnh án.
2. Thông tin quy định tại khoản 1 Điều này chỉ được phép công bố khi người bệnh đồng ý hoặc để chia sẻ thông tin, kinh nghiệm nhằm nâng cao chất lượng chẩn đoán, chăm sóc, điều trị người bệnh giữa những người hành nghề trong nhóm trực tiếp điều trị cho người bệnh hoặc trong trường hợp khác được pháp luật quy định.
Điều 9. Quyền được tôn trọng danh dự, bảo vệ sức khỏe trong khám bệnh, chữa bệnh1. Không bị kỳ thị, phân biệt đối xử hoặc bị ép buộc khám bệnh, chữa bệnh, trừ trường hợp quy định tại khoản 1 Điều 66 của Luật này.
2. Được tôn trọng về tuổi tác, giới tính, dân tộc, tín ngưỡng.
2. Không bị phân biệt giàu nghèo, địa vị xã hội.
Điều 10. Quyền được lựa chọn trong khám bệnh, chữa bệnh1. Được cung cấp thông tin, giải thích, tư vấn đầy đủ về tình trạng bệnh, kết quả, rủi ro có thể xảy ra để lựa chọn phương pháp chẩn đoán và điều trị.
2. Chấp nhận hoặc từ chối tham gia nghiên cứu y sinh học về khám bệnh, chữa bệnh.
3. Được lựa chọn người đại diện để thực hiện và bảo vệ quyền, nghĩa vụ của mình trong khám bệnh, chữa bệnh.
Điều 11. Quyền được cung cấp thông tin về hồ sơ bệnh án và chi phí khám bệnh, chữa bệnh1. Được cung cấp thông tin tóm tắt về hồ sơ bệnh án nếu có yêu cầu bằng văn bản, trừ trường hợp pháp luật có quy định khác.
2. Được cung cấp thông tin về giá dịch vụ khám bệnh, chữa bệnh, giải thích chi tiết về các khoản chi trong hóa đơn thanh toán dịch vụ khám bệnh, chữa bệnh.
Điều 12. Quyền được từ chối chữa bệnh và ra khỏi cơ sở khám bệnh, chữa bệnh1. Được từ chối xét nghiệm, sử dụng thuốc, áp dụng thủ thuật hoặc phương pháp điều trị nhưng phải cam kết tự chịu trách nhiệm bằng văn bản về việc từ chối của mình, trừ trường hợp quy định tại khoản 1 Điều 66 của Luật này.
2. Được ra khỏi cơ sở khám bệnh, chữa bệnh khi chưa kết thúc điều trị nhưng phải cam kết tự chịu trách nhiệm bằng văn bản về việc ra khỏi cơ sở khám bệnh, chữa bệnh trái với chỉ định của người hành nghề, trừ trường hợp quy định tại khoản 1 Điều 66 của Luật này.
Điều 13. Quyền của người bệnh bị mất năng lực hành vi dân sự, không có năng lực hành vi dân sự, hạn chế năng lực hành vi dân sự hoặc người chưa thành niên từ đủ 6 tuổi đến chưa đủ 18 tuổi1. Trường hợp người bệnh bị mất năng lực hành vi dân sự, không có năng lực hành vi dân sự, hạn chế năng lực hành vi dân sự hoặc người chưa thành niên từ đủ 6 tuổi đến chưa đủ 18 tuổi thì người đại diện hợp pháp của người bệnh quyết định việc khám bệnh, chữa bệnh.
2. Trường hợp cấp cứu, để bảo vệ tính mạng, sức khỏe của người bệnh, nếu không có mặt người đại diện hợp pháp của người bệnh thì người đứng đầu cơ sở khám bệnh, chữa bệnh quyết định việc khám bệnh, chữa bệnh.
Mục 2. NGHĨA VỤ CỦA NGƯỜI BỆNHĐiều 14. Nghĩa vụ tôn trọng người hành nghề
Tôn trọng và không được có hành vi xâm phạm danh dự, nhân phẩm, sức khỏe, tính mạng của người hành nghề và nhân viên y tế khác.
Điều 15. Nghĩa vụ chấp hành các quy định trong khám bệnh, chữa bệnh1. Cung cấp trung thực thông tin liên quan đến tình trạng sức khỏe của mình, hợp tác đầy đủ với người hành nghề và cơ sở khám bệnh, chữa bệnh.
2. Chấp hành chỉ định chẩn đoán, điều trị của người hành nghề, trừ trường hợp quy định tại Điều 12 của Luật này.
3. Chấp hành và yêu cầu người nhà của mình chấp hành nội quy của cơ sở khám bệnh, chữa bệnh, quy định của pháp luật về khám bệnh, chữa bệnh.
Điều 16. Nghĩa vụ chi trả chi phí khám bệnh, chữa bệnhNgười bệnh có trách nhiệm chi trả chi phí khám bệnh, chữa bệnh, trừ trường hợp được miễn, giảm theo quy định của pháp luật. Trường hợp người bệnh tham gia bảo hiểm y tế thì việc thanh toán chi phí khám bệnh, chữa bệnh được thực hiện theo quy định của pháp luật về bảo hiểm y tế.
Điều 17. Người xin cấp chứng chỉ hành nghề
1. Bác sỹ, y sỹ
2. Điều dưỡng viên
3. Hộ sinh viên.
4. Kỹ thuật viên
5. Lương y
6. Người có bài thuốc gia truyền hoặc có phương pháp chữa bệnh gia truyền.
Điều 18. Điều kiện để cấp chứng chỉ hành nghề đối với người Việt Nam1. Có một trong các văn bằng, giấy chứng nhận sau đây phù hợp với hình thức hành nghề khám bệnh, chữa bệnh:
a) Văn bằng chuyên môn liên quan đến y tế được cấp hoặc công nhận tại Việt Nam;
b) Giấy chứng nhận là lương y;
c) Giấy chứng nhận là người có bài thuốc gia truyền hoặc có phương pháp chữa bệnh gia truyền.
2. Có văn bản xác nhận quá trình thực hành, trừ trường hợp là lương y, người có bài thuốc gia truyền hoặc có phương pháp chữa bệnh gia truyền.
3. Có giấy chứng nhận đủ sức khỏe để hành nghề khám bệnh, chữa bệnh.
4. Không thuộc trường hợp đang trong thời gian bị cấm hành nghề, cấm làm công việc liên quan đến chuyên môn y, dược theo bản án, quyết định của Tòa án; đang bị truy cứu trách nhiệm hình sự; đang trong thời gian chấp hành bản án hình sự, quyết định hình sự của tòa án hoặc quyết định áp dụng biện pháp xử lý hành chính đưa vào cơ sở giáo dục, cơ sở chữa bệnh; đang trong thời gian bị kỷ luật từ hình thức cảnh cáo trở lên có liên quan đến chuyên môn khám bệnh, chữa bệnh; mất hoặc hạn chế năng lực hành vi dân sự.
Điều 19. Điều kiện để cấp chứng chỉ hành nghề tại Việt Nam đối với người nước ngoài, người Việt Nam định cư ở nước ngoài1. Có đủ điều kiện quy định tại Điều 18 của Luật này.
2. Đáp ứng yêu cầu về sử dụng ngôn ngữ trong khám bệnh, chữa bệnh quy định tại Điều 23 của Luật này.
3. Có lý lịch tư pháp được cơ quan có thẩm quyền của nước sở tại xác nhận.
4. Có giấy phép lao động do cơ quan nhà nước có thẩm quyền về lao động của Việt Nam cấp theo quy định của pháp luật về lao động.
Điều 20. Điều kiện cấp lại chứng chỉ hành nghề đối với trường hợp bị thu hồi chứng chỉ hành nghề1. Có đủ điều kiện quy định tại Điều 18 của Luật này đối với người Việt Nam hoặc Điều 19 của Luật này đối với người nước ngoài, người Việt Nam định cư ở nước ngoài, trừ điều kiện về văn bản xác nhận quá trình thực hành.
2. Có giấy chứng nhận đã cập nhật kiến thức y khoa liên tục
Điều 21. Khám bệnh, chữa bệnh nhân đạo, chuyển giao kỹ thuật chuyên môn về khám bệnh, chữa bệnh, hợp tác đào tạo về y có thực hành khám bệnh, chữa bệnh1. Cá nhân, tổ chức trong và ngoài nước có quyền đề nghị được tổ chức khám bệnh, chữa bệnh nhân đạo hoặc chuyển giao kỹ thuật chuyên môn về khám bệnh, chữa bệnh hoặc hợp tác đào tạo về y có thực hành khám bệnh, chữa bệnh tại Việt Nam.
2. Bộ trưởng Bộ Y tế quy định chi tiết về điều kiện, hồ sơ, thủ tục đề nghị và thẩm quyền cho phép khám bệnh, chữa bệnh trong các trường hợp quy định tại khoản 1 Điều này.
Điều 22. Thừa nhận chứng chỉ hành nghềViệc thừa nhận chứng chỉ hành nghề khám bệnh, chữa bệnh giữa các nước được thực hiện theo quy định của thỏa thuận quốc tế hoặc điều ước quốc tế mà Cộng hòa xã hội chủ nghĩa Việt Nam là thành viên.
Điều 23. Sử dụng ngôn ngữ trong khám bệnh, chữa bệnh tại Việt Nam của người nước ngoài, người Việt Nam định cư ở nước ngoài1. Người nước ngoài, người Việt Nam định cư ở nước ngoài trực tiếp khám bệnh, chữa bệnh cho người Việt Nam phải biết tiếng Việt thành thạo; trường hợp không biết tiếng Việt thành thạo thì phải đăng ký ngôn ngữ sử dụng và có người phiên dịch.
2. Việc chỉ định điều trị, kê đơn thuốc phải ghi bằng tiếng Việt; trường hợp người hành nghề không biết tiếng Việt thành thạo thì việc chỉ định điều trị, kê đơn thuốc phải ghi bằng ngôn ngữ mà người hành nghề đã đăng ký sử dụng và người phiên dịch phải dịch sang tiếng Việt.
3. Người nước ngoài, người Việt Nam định cư ở nước ngoài trực tiếp khám bệnh, chữa bệnh cho người Việt Nam được xác định là biết tiếng Việt thành thạo và người được xác định là đủ trình độ phiên dịch trong khám bệnh, chữa bệnh khi được cơ sở đào tạo chuyên ngành y do Bộ trưởng Bộ Y tế chỉ định kiểm tra và công nhận.
Bộ trưởng Bộ Y tế quy định chi tiết về tiêu chí để công nhận biết tiếng Việt thành thạo hoặc đủ trình độ phiên dịch trong khám bệnh, chữa bệnh.
4. Người phiên dịch phải chịu trách nhiệm trước pháp luật về tính chính xác của nội dung phiên dịch trong khám bệnh, chữa bệnh.
Điều 24. Xác nhận quá trình thực hành1. Người có văn bằng chuyên môn liên quan đến y tế được cấp hoặc công nhận tại Việt Nam, trước khi được cấp chứng chỉ hành nghề, phải qua thời gian thực hành tại cơ sở khám bệnh, chữa bệnh sau đây:
a) 18 tháng thực hành tại bệnh viện, viện nghiên cứu có giường bệnh (sau đây gọi chung là bệnh viện) đối với bác sỹ;
b) 12 tháng thực hành tại bệnh viện đối với y sỹ;
c) 09 tháng thực hành tại bệnh viện có khoa phụ sản hoặc tại nhà hộ sinh đối với hộ sinh viên;
d) 09 tháng thực hành tại cơ sở khám bệnh, chữa bệnh đối với điều dưỡng viên, kỹ thuật viên.
2. Người đứng đầu cơ sở khám bệnh, chữa bệnh có trách nhiệm xác nhận bằng văn bản về quá trình thực hành cho người đã thực hành tại cơ sở của mình, bao gồm nội dung về thời gian, năng lực chuyên môn, đạo đức nghề nghiệp.
Điều 25. Chứng chỉ hành nghề1. Chứng chỉ hành nghề được cấp cho người có đủ điều kiện quy định tại Điều 18 hoặc Điều 19 của Luật này.
2. Chứng chỉ hành nghề được cấp một lần và có giá trị trong phạm vi cả nước.
3. Nội dung của chứng chỉ hành nghề bao gồm:
a) Họ và tên, ngày tháng năm sinh, địa chỉ cư trú, bằng cấp chuyên môn;
b) Hình thức hành nghề;
c) Phạm vi hoạt động chuyên môn.
4. Trường hợp chứng chỉ hành nghề bị mất hoặc bị hư hỏng, người hành nghề được cấp lại chứng chỉ hành nghề.
5. Bộ trưởng Bộ Y tế ban hành mẫu chứng chỉ hành nghề.
6. Chính phủ quy định lộ trình cấp chứng chỉ hành nghề để bảo đảm đến ngày 01 tháng 01 năm 2016, tất cả đối tượng đang tham gia khám bệnh, chữa bệnh ở các cơ sở khám bệnh, chữa bệnh của Nhà nước vào thời điểm Luật này có hiệu lực phải có chứng chỉ hành nghề.
Mục 2. THẨM QUYỀN, HỒ SƠ, THỦ TỤC CẤP, CẤP LẠI VÀ THU HỒI CHỨNG CHỈ HÀNH NGHỀĐiều 26. Thẩm quyền cấp, cấp lại và thu hồi chứng chỉ hành nghề
1. Bộ trưởng Bộ Y tế cấp, cấp lại và thu hồi chứng chỉ hành nghề đối với các trường hợp sau đây:
a) Người làm việc tại cơ sở khám bệnh, chữa bệnh thuộc Bộ Y tế;
b) Người làm việc tại cơ sở khám bệnh, chữa bệnh thuộc các bộ khác, trừ trường hợp quy định tại khoản 2 và khoản 3 Điều này;
c) Người nước ngoài đến hành nghề khám bệnh, chữa bệnh tại Việt Nam.
2. Giám đốc Sở Y tế cấp, cấp lại và thu hồi chứng chỉ hành nghề đối với người làm việc tại cơ sở khám bệnh, chữa bệnh trên địa bàn quản lý, trừ trường hợp quy định tại khoản 1 và khoản 3 Điều này.
3. Bộ trưởng Bộ Quốc phòng quy định việc cấp, cấp lại và thu hồi chứng chỉ hành nghề đối với người làm việc tại cơ sở khám bệnh, chữa bệnh thuộc thẩm quyền quản lý.
Điều 27. Hồ sơ cấp, cấp lại chứng chỉ hành nghề1. Hồ sơ đề nghị cấp chứng chỉ hành nghề đối với người Việt Nam bao gồm:
a) Đơn đề nghị cấp chứng chỉ hành nghề;
b) Bản sao văn bằng hoặc giấy chứng nhận trình độ chuyên môn;
c) Văn bản xác nhận quá trình thực hành;
d) Giấy chứng nhận đủ sức khỏe để hành nghề do cơ sở khám bệnh, chữa bệnh có đủ điều kiện theo quy định của Bộ trưởng Bộ Y tế cấp;
đ) Phiếu lý lịch tư pháp;
e) Sơ yếu lý lịch có xác nhận của Ủy ban nhân dân xã, phường, thị trấn (sau đây gọi chung là cấp xã) nơi cư trú hoặc xác nhận của Thủ trưởng đơn vị nơi công tác.
2. Hồ sơ đề nghị cấp chứng chỉ hành nghề đối với người nước ngoài, người Việt Nam định cư ở nước ngoài bao gồm:
a) Đơn đề nghị cấp chứng chỉ hành nghề;
b) Bảo sao văn bằng chuyên môn;
c) Văn bản xác nhận quá trình thực hành;
d) Văn bản xác nhận biết tiếng Việt thành thạo hoặc hồ sơ của người phiên dịch theo quy định tại khoản 3 Điều 23 của Luật này;
đ) Giấy chứng nhận đủ sức khỏe để hành nghề do cơ sở khám bệnh, chữa bệnh có đủ điều kiện theo quy định của Bộ trưởng Bộ Y tế cấp;
e) Phiếu lý lịch tư pháp;
g) Giấy phép lao động do cơ quan nhà nước có thẩm quyền về lao động của Việt Nam cấp.
3. Người bị mất hoặc bị hư hỏng chứng chỉ hành nghề hoặc bị thu hồi chứng chỉ hành nghề theo quy định tại điểm a và điểm b khoản 1 Điều 29 của Luật này thì chỉ phải làm đơn đề nghị cấp lại chứng chỉ hành nghề.
4. Hồ sơ đề nghị cấp lại chứng chỉ hành nghề trong trường hợp bị thu hồi quy định tại các điểm c, d, đ, e và g khoản 1 Điều 29 của Luật này bao gồm:
a) Các giấy tờ theo quy định tại khoản 1 Điều này đối với người Việt Nam hoặc khoản 2 Điều này đối với người nước ngoài, người Việt Nam định cư ở nước ngoài, trừ văn bản xác nhận quá trình thực hành;
b) Giấy chứng nhận đã cập nhật kiến thức y khoa liên tục.
Điều 28. Thủ tục cấp, cấp lại chứng chỉ hành nghề1. Hồ sơ đề nghị cấp, cấp lại chứng chỉ hành nghề quy định tại Điều 27 của Luật này được nộp cho Bộ Y tế hoặc Bộ Quốc phòng hoặc Sở Y tế.
2. Trong thời hạn 60 ngày, kể từ ngày nhận đủ hồ sơ, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế phải cấp chứng chỉ hành nghề; trường hợp cần xác minh đối với người được đào tạo ở nước ngoài hoặc có chứng chỉ hành nghề do nước ngoài cấp thì thời hạn có thể kéo dài hơn nhưng không quá 180 ngày; nếu không cấp chứng chỉ hành nghề thì phải trả lời bằng văn bản và nêu lý do.
3. Trong thời hạn 30 ngày, kể từ ngày nhận đủ hồ sơ, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế phải cấp lại chứng chỉ hành nghề; nếu không cấp lại chứng chỉ hành nghề thì phải trả lời bằng văn bản và nêu lý do.
4. Bộ trưởng Bộ Y tế thành lập Hội đồng tư vấn với sự tham gia của đại diện tổ chức xã hội - nghề nghiệp về y, hội luật gia, cơ sở đào tạo y khoa, cơ sở khám bệnh, chữa bệnh, tổ chức xã hội về bảo vệ quyền lợi người tiêu dùng và một số tổ chức xã hội khác để tư vấn cho Bộ trưởng Bộ Y tế trong việc cấp, cấp lại, thu hồi chứng chỉ hành nghề; đình chỉ hoạt động chuyên môn của người hành nghề; xây dựng các tiêu chuẩn công nhận nội dung, hình thức cập nhật kiến thức y khoa liên tục và điều kiện đối với các cơ sở thực hiện cập nhật kiến thức y khoa liên tục; quy định nội dung, hình thức và tổ chức kiểm tra để xác nhận bằng văn bản người biết tiếng Việt thành thạo và người đủ trình độ phiên dịch trong khám bệnh, chữa bệnh.
Giám đốc Sở Y tế thành lập Hội đồng tư vấn với sự tham gia của đại diện tổ chức xã hội - nghề nghiệp về y, hội luật gia, cơ sở đào tạo y khoa, cơ sở khám bệnh, chữa bệnh, tổ chức xã hội về bảo vệ quyền lợi người tiêu dùng và một số tổ chức xã hội khác để tư vấn cho Giám đốc Sở Y tế trong việc cấp, cấp lại, thu hồi chứng chỉ hành nghề, đình chỉ hoạt động chuyên môn của người hành nghề.
5. Bộ trưởng Bộ Quốc phòng quy định thủ tục cấp, cấp lại chứng chỉ hành nghề đối với người làm việc tại cơ sở khám bệnh, chữa bệnh thuộc thẩm quyền quản lý.
Điều 29. Thu hồi chứng chỉ hành nghề, đình chỉ hành nghề1. Chứng chỉ hành nghề bị thu hồi trong trường hợp sau đây:
a) Chứng chỉ hành nghề được cấp không đúng thẩm quyền;
b) Chứng chỉ hành nghề có nội dung trái pháp luật;
c) Người hành nghề không hành nghề trong thời hạn 02 năm liên tục;
d) Người hành nghề được xác định có sai sót chuyên môn kỹ thuật gây hậu quả nghiêm trọng đến sức khỏe, tính mạng người bệnh;
đ) Người hành nghề không cập nhật kiến thức y khoa liên tục trong thời gian 02 năm liên tiếp;
e) Người hành nghề không đủ sức khỏe để hành nghề;
g) Người hành nghề thuộc một trong các đối tượng quy định tại khoản 4 Điều 18 của Luật này.
2. Khi phát hiện một trong các trường hợp quy định tại khoản 1 Điều này, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế ra quyết định thu hồi chứng chỉ hành nghề theo quy định tại Điều 26 của Luật này.
3. Trong trường hợp phát hiện người hành nghề có sai sót chuyên môn kỹ thuật mà không thuộc quy định tại điểm d khoản 1 Điều này thì tùy theo tính chất, mức độ sai sót, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế đình chỉ một phần hoặc toàn bộ hoạt động chuyên môn của người hành nghề theo quy định của pháp luật.
4. Bộ trưởng Bộ Y tế quy định thủ tục thu hồi chứng chỉ hành nghề; thủ tục, thời gian đình chỉ một phần hoặc toàn bộ hoạt động chuyên môn của người hành nghề.
5. Bộ trưởng Bộ Quốc phòng quy định thủ tục thu hồi chứng chỉ hành nghề; thủ tục, thời gian đình chỉ một phần hoặc toàn bộ hoạt động chuyên môn của người hành nghề tại cơ sở khám bệnh, chữa bệnh thuộc thẩm quyền quản lý.
Điều 30. Lệ phí cấp, cấp lại chứng chỉ hành nghề1. Người đề nghị cấp, cấp lại chứng chỉ hành nghề phải nộp lệ phí.
2. Bộ trưởng Bộ Tài chính quy định mức thu lệ phí cấp, cấp lại chứng chỉ hành nghề.
Mục 3. QUYỀN CỦA NGƯỜI HÀNH NGHỀĐiều 31. Quyền được hành nghề
1. Được hành nghề theo đúng phạm vi hoạt động chuyên môn ghi trong chứng chỉ hành nghề.
2. Được quyết định và chịu trách nhiệm về chẩn đoán, phương pháp điều trị bệnh trong phạm vi hoạt động chuyên môn ghi trong chứng chỉ hành nghề.
3. Được ký hợp đồng hành nghề khám bệnh, chữa bệnh với các cơ sở khám bệnh, chữa bệnh nhưng chỉ được chịu trách nhiệm chuyên môn kỹ thuật cho một cơ sở khám bệnh, chữa bệnh.
4. Được tham gia các tổ chức xã hội - nghề nghiệp.
Điều 32. Quyền từ chối khám bệnh, chữa bệnh1. Được từ chối khám bệnh, chữa bệnh nếu trong quá trình khám bệnh, chữa bệnh mà tiên lượng bệnh vượt quá khả năng hoặc trái với phạm vi hoạt động chuyên môn của mình, nhưng phải báo cáo với người có thẩm quyền hoặc giới thiệu người bệnh đến cơ sở khám bệnh, chữa bệnh khác để giải quyết. Trong trường hợp này, người hành nghề vẫn phải thực hiện việc sơ cứu, cấp cứu, theo dõi, chăm sóc, điều trị người bệnh cho đến khi người bệnh được chuyển đi cơ sở khám bệnh, chữa bệnh khác.
2. Được từ chối khám bệnh, chữa bệnh nếu việc khám bệnh, chữa bệnh đó trái với quy định của pháp luật hoặc đạo đức nghề nghiệp.
Điều 33. Quyền được nâng cao năng lực chuyên môn1. Được đào tạo, đào tạo lại và cập nhật kiến thức y khoa liên tục phù hợp với trình độ chuyên môn hành nghề.
2. Được tham gia bồi dưỡng, trao đổi thông tin về chuyên môn, kiến thức pháp luật về y tế.
Điều 34. Quyền được bảo vệ khi xảy ra tai biến đối với người bệnh1. Được pháp luật bảo vệ và không phải chịu trách nhiệm khi thực hiện đúng quy định về chuyên môn kỹ thuật mà vẫn xảy ra tai biến.
2. Được đề nghị cơ quan, tổ chức, hội nghề nghiệp bảo vệ quyền, lợi ích hợp pháp của mình khi xảy ra tai biến đối với người bệnh.
Điều 35. Quyền được bảo đảm an toàn khi hành nghề1. Được trang bị phương tiện bảo hộ lao động, vệ sinh lao động để phòng ngừa, giảm thiểu nguy cơ lây nhiễm, tai nạn liên quan đến nghề nghiệp.
2. Được bảo vệ sức khỏe, tính mạng, danh dự, thân thể.
3. Trường hợp bị người khác đe dọa đến tính mạng, người hành nghề được phép tạm lánh khỏi nơi làm việc, sau đó phải báo cáo với người đứng đầu cơ sở khám bệnh, chữa bệnh hoặc chính quyền nơi gần nhất.
Mục 4. NGHĨA VỤ CỦA NGƯỜI HÀNH NGHỀĐiều 36. Nghĩa vụ đối với người bệnh
1. Kịp thời sơ cứu, cấp cứu, khám bệnh, chữa bệnh cho người bệnh, trừ trường hợp quy định tại Điều 32 của Luật này.
2. Tôn trọng các quyền của người bệnh, có thái độ ân cần, hòa nhã với người bệnh.
3. Tư vấn, cung cấp thông tin theo quy định tại khoản 1 Điều 7 và khoản 1 Điều 11 của Luật này.
4. Đối xử bình đẳng với người bệnh, không để lợi ích cá nhân hay sự phân biệt đối xử ảnh hưởng đến quyết định chuyên môn của mình.
5. Chỉ được yêu cầu người bệnh thanh toán các chi phí khám bệnh, chữa bệnh đã niêm yết công khai theo quy định của pháp luật.
Điều 37. Nghĩa vụ đối với nghề nghiệp1. Thực hiện đúng quy định chuyên môn kỹ thuật.
2. Chịu trách nhiệm về việc khám bệnh, chữa bệnh của mình.
3. Thường xuyên học tập, cập nhật kiến thức y khoa liên tục để nâng cao trình độ chuyên môn theo quy định của Bộ trưởng Bộ Y tế.
4. Tận tâm trong quá trình khám bệnh, chữa bệnh.
5. Giữ bí mật tình trạng bệnh của người bệnh, những thông tin mà người bệnh đã cung cấp và hồ sơ bệnh án, trừ trường hợp quy định tại khoản 2 Điều 8 của Luật này.
6. Thông báo với người có thẩm quyền về người hành nghề có hành vi lừa dối người bệnh, đồng nghiệp hoặc vi phạm quy định của Luật này.
7. Không được kê đơn, chỉ định sử dụng các dịch vụ khám bệnh, chữa bệnh, gợi ý chuyển người bệnh tới cơ sở khám bệnh, chữa bệnh khác vì vụ lợi.
Điều 38. Nghĩa vụ đối với đồng nghiệp1. Hợp tác và tôn trọng đồng nghiệp trong khám bệnh, chữa bệnh.
2. Bảo vệ danh dự, uy tín của đồng nghiệp.
Điều 39. Nghĩa vụ đối với xã hội1. Tham gia bảo vệ và giáo dục sức khỏe tại cộng đồng.
2. Tham gia giám sát về năng lực chuyên môn và đạo đức nghề nghiệp của người hành nghề khác.
3. Chấp hành quyết định điều động của cơ quan quản lý trực tiếp theo quy định tại khoản 2 Điều 4 của Luật này.
4. Chấp hành quyết định huy động của cơ quan nhà nước có thẩm quyền khi có thiên tai, thảm họa, dịch bệnh nguy hiểm.
Điều 40. Nghĩa vụ thực hiện đạo đức nghề nghiệpNgười hành nghề có nghĩa vụ thực hiện đạo đức nghề nghiệp theo quy định của Bộ trưởng Bộ Y tế.
Điều 41. Các hình thức tổ chức của cơ sở khám bệnh, chữa bệnh
1. Các hình thức tổ chức của cơ sở khám bệnh, chữa bệnh bao gồm:
a) Bệnh viện;
b) Cơ sở giám định y khoa;
c) Phòng khám đa khoa;
d) Phòng khám chuyên khoa, bác sỹ gia đình;
đ) Phòng chẩn trị y học cổ truyền;
e) Nhà hộ sinh;
g) Cơ sở chẩn đoán;
h) Cơ sở dịch vụ y tế;
i) Trạm y tế cấp xã và tương đương;
k) Các hình thức tổ chức khám bệnh, chữa bệnh khác.
2. Chính phủ quy định chi tiết khoản 1 Điều này và các hình thức tổ chức cơ sở khám bệnh, chữa bệnh trong quân đội.
Điều 42. Điều kiện hoạt động của cơ sở khám bệnh, chữa bệnh1. Có quyết định thành lập của cơ quan nhà nước có thẩm quyền đối với cơ sở khám bệnh, chữa bệnh do Nhà nước thành lập hoặc giấy chứng nhận đăng ký kinh doanh hoặc giấy phép đầu tư theo quy định của pháp luật đối với cơ sở khám bệnh, chữa bệnh khác.
2. Có giấy phép hoạt động do Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế cấp.
Điều 43. Điều kiện cấp giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh1. Cơ sở khám bệnh, chữa bệnh được cấp giấy phép hoạt động phải có đủ các điều kiện sau đây:
a) Đáp ứng các quy định của quy chuẩn kỹ thuật quốc gia về cơ sở khám bệnh, chữa bệnh do Bộ trưởng Bộ Y tế ban hành.
b) Có đủ người hành nghề phù hợp với phạm vi hoạt động chuyên môn;
c) Người chịu trách nhiệm chuyên môn kỹ thuật của cơ sở khám bệnh, chữa bệnh phải có thời gian hành nghề khám bệnh, chữa bệnh ít nhất là 36 tháng.
2. Trường hợp đăng ký thành lập phòng khám chuyên khoa hoặc bác sỹ gia đình thì ngoài các điều kiện quy định tại khoản 1 Điều này, người đứng đầu cơ sở phải là người hành nghề có bằng cấp chuyên môn phù hợp với loại hình hành nghề.
3. Bộ trưởng Bộ Y tế, Bộ trưởng Bộ Quốc phòng quy định chi tiết điều kiện cấp giấy phép hoạt động quy định tại Điều này đối với từng hình thức tổ chức của cơ sở khám bệnh, chữa bệnh theo thẩm quyền quản lý.
Điều 44. Giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh1. Giấy phép hoạt động được cấp một lần cho cơ sở khám bệnh, chữa bệnh có đủ điều kiện theo quy định tại Điều 43 của Luật này.
2. Nội dung của giấy phép hoạt động bao gồm:
a) Tên, hình thức tổ chức, địa điểm hoạt động;
b) Phạm vi hoạt động chuyên môn;
c) Thời gian làm việc hằng ngày.
3. Cơ sở khám bệnh, chữa bệnh khi thay đổi quy mô, phạm vi hoạt động chuyên môn phải làm thủ tục đề nghị điều chỉnh giấy phép hoạt động; trường hợp thay đổi hình thức tổ chức, chia tách, hợp nhất, sáp nhập hoặc thay đổi địa điểm phải làm thủ tục đề nghị cấp giấy phép hoạt động.
4. Trường hợp giấy phép hoạt động bị mất hoặc bị hư hỏng hoặc bị thu hồi theo quy định tại điểm a khoản 1 Điều 48 của Luật này, cơ sở khám bệnh, chữa bệnh được cấp lại giấy phép hoạt động.
5. Bộ trưởng Bộ Y tế ban hành mẫu giấy phép hoạt động.
6. Chính phủ quy định lộ trình cấp giấy phép hoạt động để bảo đảm đến ngày 01 tháng 01 năm 2016, tất cả cơ sở khám bệnh, chữa bệnh của Nhà nước đang hoạt động vào thời điểm Luật này có hiệu lực phải có giấy phép hoạt động.
Mục 2. THẨM QUYỀN, HỒ SƠ, THỦ TỤC CẤP, CẤP LẠI, ĐIỀU CHỈNH VÀ THU HỒI GIẤY PHÉP HOẠT ĐỘNG ĐỐI VỚI CƠ SỞ KHÁM BỆNH, CHỮA BỆNHĐiều 45. Thẩm quyền cấp, cấp lại, điều chỉnh và thu hồi giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh
1. Bộ trưởng Bộ Y tế cấp, cấp lại, điều chỉnh và thu hồi giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh thuộc Bộ Y tế, bệnh viện tư nhân hoặc thuộc các bộ khác, trừ trường hợp quy định tại khoản 2 và khoản 3 Điều này và thông báo cho Ủy ban nhân dân cấp tỉnh nơi cơ sở đó đặt trụ sở trong thời gian không quá 30 ngày kể từ ngày cấp, điều chỉnh hoặc thu hồi giấy phép hoạt động.
2. Giám đốc Sở Y tế cấp, cấp lại, điều chỉnh và thu hồi giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh trên địa bàn, trừ trường hợp quy định tại khoản 1 và khoản 3 Điều này và thông báo cho Ủy ban nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh nơi cơ sở đó đặt trụ sở trong thời gian 30 ngày kể từ ngày cấp, điều chỉnh hoặc thu hồi giấy phép hoạt động.
3. Bộ trưởng Bộ Quốc phòng quy định việc cấp, cấp lại, điều chỉnh, thu hồi giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh thuộc thẩm quyền quản lý.
Điều 46. Hồ sơ đề nghị cấp, cấp lại hoặc điều chỉnh giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh1. Hồ sơ đề nghị cấp giấy phép hoạt động bao gồm:
a) Đơn đề nghị cấp giấy phép hoạt động;
b) Bản sao quyết định thành lập của cơ quan nhà nước có thẩm quyền đối với cơ sở khám bệnh, chữa bệnh của Nhà nước hoặc giấy chứng nhận đăng ký kinh doanh đối với cơ sở khám bệnh, chữa bệnh tư nhân hoặc giấy chứng nhận đầu tư đối với cơ sở khám bệnh, chữa bệnh có vốn đầu tư nước ngoài;
c) Bản sao chứng chỉ hành nghề của người chịu trách nhiệm chuyên môn kỹ thuật, người phụ trách bộ phận chuyên môn và danh sách ghi rõ họ tên, số chứng chỉ, phạm vi hoạt động chuyên môn của từng người hành nghề đối với bệnh viện; bản sao chứng chỉ hành nghề của từng người hành nghề đối với cơ sở khám bệnh, chữa bệnh khác;
d) Bản kê khai cơ sở vật chất, thiết bị y tế, bản mô tả mô hình tổ chức và hồ sơ nhân sự;
đ) Tài liệu chứng minh cơ sở khám bệnh, chữa bệnh đáp ứng điều kiện quy định tại Điều 43 của Luật này;
e) Đối với bệnh viện, ngoài các điều kiện quy định tại các điểm a, b, c, d và đ khoản này còn phải có Điều lệ tổ chức và hoạt động, phương án hoạt động ban đầu.
2. Hồ sơ đề nghị cấp lại giấy phép hoạt động bao gồm:
a) Đơn đề nghị cấp lại giấy phép hoạt động;
b) Bản gốc giấy phép bị hư hỏng (nếu có).
3. Hồ sơ đề nghị điều chỉnh giấy phép hoạt động bao gồm:
a) Đơn đề nghị điều chỉnh giấy phép hoạt động;
b) Bản kê khai cơ sở vật chất, thiết bị y tế và hồ sơ nhân sự tương ứng với quy mô hoặc phạm vi hoạt động chuyên môn dự kiến điều chỉnh.
Điều 47. Thủ tục cấp, cấp lại, điều chỉnh giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh1. Thủ tục cấp, cấp lại, điều chỉnh giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh được quy định như sau:
a) Hồ sơ đề nghị cấp, cấp lại, điều chỉnh giấy phép hoạt động quy định tại Điều 46 của Luật này được nộp cho Bộ Y tế hoặc Bộ Quốc phòng hoặc Sở Y tế;
b) Trong thời hạn 90 ngày, kể từ ngày nhận đủ hồ sơ, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế cấp hoặc điều chỉnh giấy phép hoạt động; nếu không cấp hoặc điều chỉnh giấy phép hoạt động thì phải trả lời bằng văn bản và nêu lý do;
c) Trong thời hạn 30 ngày, kể từ ngày nhận đủ hồ sơ, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế cấp lại giấy phép hoạt động; nếu không cấp lại giấy phép hoạt động thì phải trả lời bằng văn bản và nêu rõ lý do.
2. Bộ trưởng Bộ Y tế quy định việc tổ chức thẩm định, thành phần thẩm định, thủ tục thẩm định để cấp, điều chỉnh giấy phép hoạt động.
3. Bộ trưởng Bộ Quốc phòng quy định việc tổ chức thẩm định, thành phần thẩm định, thủ tục thẩm định để cấp, điều chỉnh giấy phép hoạt động cho các cơ sở khám bệnh, chữa bệnh thuộc thẩm quyền quản lý.
Điều 48. Thu hồi và đình chỉ giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh1. Giấy phép hoạt động bị thu hồi trong những trường hợp sau đây:
a) Giấy phép hoạt động được cấp không đúng thẩm quyền;
b) Cơ sở khám bệnh, chữa bệnh không bảo đảm các điều kiện quy định tại Điều 43 của Luật này;
c) Sau 12 tháng, kể từ ngày được cấp giấy phép hoạt động mà cơ sở khám bệnh, chữa bệnh không hoạt động.
d) Cơ sở khám bệnh, chữa bệnh tạm dừng hoạt động trong thời gian 12 tháng liên tục hoặc chấm dứt hoạt động.
2. Khi phát hiện một trong các trường hợp quy định tại khoản 1 Điều này, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế ra quyết định thu hồi giấy phép hoạt động theo quy định tại Điều 45 của Luật này.
3. Trong trường hợp phát hiện cơ sở khám bệnh, chữa bệnh có sai sót chuyên môn hoặc không bảo đảm một trong các điều kiện quy định tại Điều 43 của Luật này thì tùy theo tính chất, mức độ sai sót, Bộ trưởng Bộ Y tế hoặc Bộ trưởng Bộ Quốc phòng hoặc Giám đốc Sở Y tế đình chỉ một phần hoặc toàn bộ hoạt động chuyên môn của cơ sở khám bệnh, chữa bệnh.
4. Bộ trưởng Bộ Y tế quy định thủ tục thu hồi giấy phép hoạt động; thủ tục, thời gian đình chỉ một phần hoặc toàn bộ hoạt động chuyên môn của cơ sở khám bệnh, chữa bệnh.
5. Bộ trưởng Bộ Quốc phòng quy định thủ tục thu hồi giấy phép hoạt động; thủ tục, thời gian đình chỉ một phần hoặc toàn bộ hoạt động chuyên môn của cơ sở khám bệnh, chữa bệnh thuộc thẩm quyền quản lý.
Điều 49. Lệ phí cấp, cấp lại, điều chỉnh giấy phép hoạt động đối với cơ sở khám bệnh, chữa bệnh1. Cơ sở khám bệnh, chữa bệnh đề nghị cấp, cấp lại, điều chỉnh giấy phép hoạt động phải nộp lệ phí.
2. Bộ trưởng Bộ Tài chính quy định mức thu lệ phí cấp, cấp lại, điều chỉnh giấy phép hoạt động.
Mục 3. CHỨNG NHẬN NÂNG CAO CHẤT LƯỢNG ĐỐI VỚI CƠ SỞ KHÁM BỆNH, CHỮA BỆNHĐiều 50. Chứng nhận chất lượng đối với cơ sở khám bệnh, chữa bệnh
1. Tiêu chuẩn quản lý chất lượng đối với cơ sở khám bệnh, chữa bệnh là yêu cầu về đặc tính kỹ thuật và quản lý dùng làm chuẩn để phân loại, đánh giá chất lượng của cơ sở khám bệnh, chữa bệnh do tổ chức trong nước hoặc nước ngoài ban hành được cơ quan nhà nước có thẩm quyền của Việt Nam thừa nhận.
2. Khuyến khích cơ sở khám bệnh, chữa bệnh đã được cấp giấy phép hoạt động áp dụng tiêu chuẩn quản lý chất lượng quy định tại khoản 1 Điều này để nâng cao chất lượng khám bệnh, chữa bệnh.
3. Việc chứng nhận chất lượng đối với cơ sở khám bệnh, chữa bệnh phải do tổ chức có đủ điều kiện quy định tại Điều 51 của Luật này thực hiện trên cơ sở đánh giá chất lượng thực tế của cơ sở khám bệnh, chữa bệnh so với tiêu chuẩn quản lý chất lượng.
Điều 51. Các tổ chức chứng nhận chất lượng đối với cơ sở khám bệnh, chữa bệnh1. Tổ chức chứng nhận chất lượng đối với cơ sở khám bệnh, chữa bệnh là tổ chức độc lập với cơ sở khám bệnh, chữa bệnh do cơ quan, tổ chức, cá nhân thành lập.
2. Khi thực hiện việc chứng nhận chất lượng đối với cơ sở khám bệnh, chữa bệnh, tổ chức chứng nhận chất lượng phải bảo đảm nguyên tắc độc lập, khách quan, trung thực, công khai, minh bạch và chịu trách nhiệm trước pháp luật về kết quả chứng nhận của mình.
3. Chính phủ quy định chi tiết việc thành lập, tổ chức và hoạt động của tổ chức chứng nhận chất lượng đối với cơ sở khám bệnh, chữa bệnh.
Mục 4. QUYỀN VÀ TRÁCH NHIỆM CỦA CƠ SỞ KHÁM BỆNH, CHỮA BỆNHĐiều 52. Quyền của cơ sở khám bệnh, chữa bệnh
1. Được thực hiện các hoạt động khám bệnh, chữa bệnh theo quy định của Luật này; cơ sở khám bệnh, chữa bệnh có đủ điều kiện theo quy định của Bộ trưởng Bộ Y tế được khám sức khỏe định kỳ, khám sức khỏe để lao động, học tập, làm việc và chịu trách nhiệm trước pháp luật về kết quả khám sức khỏe của mình.
2. Được từ chối khám bệnh, chữa bệnh nếu trong quá trình khám bệnh, chữa bệnh mà tiên lượng bệnh vượt quá khả năng hoặc trái phạm vi hoạt động chuyên môn được ghi trong giấy phép hoạt động nhưng phải giới thiệu người bệnh đến cơ sở khám bệnh, chữa bệnh khác để giải quyết. Trong trường hợp này, cơ sở khám bệnh, chữa bệnh vẫn phải thực hiện việc sơ cứu, cấp cứu, theo dõi, chăm sóc, điều trị cho người bệnh cho đến khi người bệnh được chuyển đi cơ sở khám bệnh, chữa bệnh khác.
3. Được thu các khoản chi phí khám bệnh, chữa bệnh theo quy định của pháp luật.
4. Được hưởng chế độ ưu đãi khi thực hiện các hoạt động khám bệnh, chữa bệnh theo quy định của pháp luật.
Điều 53. Trách nhiệm của cơ sở khám bệnh, chữa bệnh1. Tổ chức việc cấp cứu, khám bệnh, chữa bệnh kịp thời cho người bệnh.
2. Thực hiện quy định về chuyên môn kỹ thuật và các quy định khác của pháp luật có liên quan.
3. Công khai thời gian làm việc, niêm yết giá dịch vụ và thu theo đúng giá đã niêm yết.
4. Báo cáo cơ quan cấp giấy phép hoạt động trong trường hợp thay đổi người chịu trách nhiệm chuyên môn kỹ thuật của cơ sở khám bệnh, chữa bệnh hoặc người hành nghề là người nước ngoài theo quy định của Bộ trưởng Bộ Y tế.
5. Bảo đảm việc thực hiện các quyền và nghĩa vụ của người bệnh, người hành nghề được quy định tại Luật này.
6. Bảo đảm các điều kiện cần thiết để người hành nghề thực hiện khám bệnh, chữa bệnh trong phạm vi hoạt động chuyên môn được phép.
7. Chấp hành quyết định huy động của cơ quan nhà nước có thẩm quyền trong trường hợp xảy ra thiên tai, thảm họa, dịch bệnh nguy hiểm.
8. Trường hợp dừng hoạt động, cơ sở khám bệnh, chữa bệnh có trách nhiệm chuyển người bệnh, hồ sơ bệnh án đến cơ sở khám bệnh, chữa bệnh phù hợp và quyết toán chi phí khám bệnh, chữa bệnh với người bệnh.
1. Các hình thức cấp cứu bao gồm:
a) Cấp cứu tại cơ sở khám bệnh, chữa bệnh;
b) Cấp cứu ngoài cơ sở khám bệnh, chữa bệnh.
2. Khi việc cấp cứu vượt quá khả năng chuyên môn thì tùy từng trường hợp cụ thể, cơ sở khám bệnh, chữa bệnh phải thực hiện một hoặc một số hoạt động sau đây:
a) Tổ chức hội chẩn theo quy định tại Điều 56 của Luật này;
b) Mời cơ sở khám bệnh, chữa bệnh khác đến hỗ trợ cấp cứu;
c) Chuyển người bệnh cấp cứu đến cơ sở khám bệnh, chữa bệnh phù hợp.
3. Người đứng đầu cơ sở khám bệnh, chữa bệnh có trách nhiệm ưu tiên mọi điều kiện về nhân lực và phương tiện tốt nhất cho việc cấp cứu người bệnh.
Điều 55. Chẩn đoán bệnh, chỉ định phương pháp điều trị và kê đơn thuốc1. Việc chẩn đoán bệnh, chỉ định phương pháp điều trị và kê đơn thuốc phải bảo đảm các nguyên tắc sau đây:
a) Dựa trên kết quả khám lâm sàng, kiểm tra cận lâm sàng, kết hợp với yếu tố tiền sử bệnh, gia đình, nghề nghiệp và dịch tễ;
b) Kịp thời, khách quan, thận trọng và khoa học.
2. Người hành nghề được giao nhiệm vụ khám bệnh, chữa bệnh có trách nhiệm sau đây:
a) Khám bệnh, chẩn đoán bệnh, chỉ định phương pháp điều trị, kê đơn thuốc kịp thời, chính xác và chịu trách nhiệm về việc khám bệnh, chẩn đoán bệnh, chỉ định phương pháp điều trị, kê đơn thuốc của mình;
b) Quyết định điều trị nội trú hoặc ngoại trú; trường hợp người bệnh phải điều trị nội trú mà cơ sở khám bệnh, chữa bệnh không có giường điều trị nội trú thì phải giới thiệu người bệnh đến cơ sở khám bệnh, chữa bệnh phù hợp.
Điều 56. Hội chẩn1. Việc hội chẩn được thực hiện khi bệnh vượt quá khả năng chẩn đoán và điều trị của người hành nghề hoặc cơ sở khám bệnh, chữa bệnh hoặc đã điều trị nhưng bệnh không có tiến triển tốt hoặc có diễn biến xấu đi.
2. Các hình thức hội chẩn bao gồm:
a) Hội chẩn khoa;
b) Hội chẩn liên khoa;
c) Hội chẩn liên cơ sở khám bệnh, chữa bệnh;
d) Hội chẩn qua tham khảo ý kiến chuyên gia;
đ) Hội chẩn từ xa bằng công nghệ thông tin;
e) Hội chẩn khác theo quy định của Bộ trưởng Bộ Y tế.
Điều 57. Điều trị ngoại trú1. Điều trị ngoại trú được thực hiện trong trường hợp sau đây:
a) Người bệnh không cần điều trị nội trú;
b) Người bệnh sau khi đã điều trị nội trú ổn định nhưng phải theo dõi và điều trị tiếp sau khi ra khỏi cơ sở khám bệnh, chữa bệnh.
2. Sau khi quyết định người bệnh phải điều trị ngoại trú, người hành nghề có trách nhiệm sau đây:
a) Lập hồ sơ bệnh án ngoại trú theo quy định tại Điều 59 của Luật này;
b) Ghi sổ y bạ theo dõi điều trị ngoại trú trong đó ghi rõ thông tin cá nhân của người bệnh, chẩn đoán, chỉ định điều trị, kê đơn thuốc và thời gian khám lại.
Điều 58. Điều trị nội trú1. Việc thực hiện các thủ tục hành chính liên quan đến việc vào, chuyển hoặc ra khỏi cơ sở khám bệnh, chữa bệnh, chuyển khoa phải bảo đảm kịp thời và không gây phiền hà cho người bệnh.
2. Điều trị nội trú được thực hiện trong trường hợp sau đây:
a) Có chỉ định điều trị nội trú của người hành nghề thuộc cơ sở khám bệnh, chữa bệnh;
b) Có giấy chuyển đến cơ sở khám bệnh, chữa bệnh từ cơ sở khám bệnh, chữa bệnh khác.
3. Thủ tục điều trị nội trú được quy định như sau:
a) Nhận người bệnh vào cơ sở khám bệnh, chữa bệnh.
Trường hợp người bệnh mắc nhiều bệnh, người đứng đầu cơ sở khám bệnh, chữa bệnh có trách nhiệm xem xét, quyết định khoa sẽ tiến hành điều trị;
b) Hướng dẫn người bệnh đến khoa nơi người bệnh sẽ điều trị nội trú.
4. Việc chuyển khoa được thực hiện trong trường hợp phát hiện người mắc bệnh mà bệnh đó không thuộc phạm vi chuyên môn của khoa đang tiến hành điều trị hoặc bệnh liên quan chủ yếu đến chuyên khoa khác.
5. Các trường hợp sau đây phải chuyển cơ sở khám bệnh, chữa bệnh:
a) Bệnh vượt quá khả năng điều trị và điều kiện vật chất của cơ sở khám bệnh, chữa bệnh;
b) Bệnh không phù hợp với phân tuyến chuyên môn kỹ thuật theo quy định của Bộ trưởng Bộ Y tế;
c) Theo yêu cầu của người bệnh.
6. Thủ tục chuyển khoa, chuyển cơ sở khám bệnh, chữa bệnh được quy định như sau:
a) Hoàn chỉnh hồ sơ bệnh án, tổng kết toàn bộ quá trình điều trị của người bệnh;
b) Nếu chuyển khoa thì chuyển toàn bộ hồ sơ bệnh án của người bệnh đến khoa mới; nếu chuyển cơ sở khám bệnh, chữa bệnh thì gửi giấy chuyển cơ sở khám bệnh, chữa bệnh, kèm tóm tắt hồ sơ bệnh án đến cơ sở khám bệnh, chữa bệnh mới.
7. Khi tình trạng bệnh của người bệnh đã ổn định hoặc người bệnh có yêu cầu được ra khỏi cơ sở khám bệnh, chữa bệnh và có cam kết của người bệnh hoặc người đại diện của người bệnh, sau khi đã có sự tư vấn của người hành nghề thì cơ sở khám bệnh, chữa bệnh có trách nhiệm sau đây:
a) Hoàn chỉnh hồ sơ bệnh án, tổng kết toàn bộ quá trình điều trị của người bệnh;
b) Hướng dẫn người bệnh về việc tự chăm sóc sức khỏe;
c) Chỉ định chế độ điều trị ngoại trú trong trường hợp cần thiết;
d) Quyết toán chi phí khám bệnh, chữa bệnh theo quy định tại Điều 16 của Luật này;
đ) Làm giấy cho người bệnh ra khỏi cơ sở khám bệnh, chữa bệnh.
Điều 59. Hồ sơ bệnh án1. Hồ sơ bệnh án là tài liệu y học, y tế và pháp lý; mỗi người bệnh chỉ có một hồ sơ bệnh án trong mỗi lần khám bệnh, chữa bệnh tại cơ sở khám bệnh, chữa bệnh.
2. Việc lập hồ sơ bệnh án được quy định như sau:
a) Người bệnh điều trị nội trú và ngoại trú trong các cơ sở khám bệnh, chữa bệnh đều phải được lập hồ sơ bệnh án;
b) Hồ sơ bệnh án được lập bằng giấy hoặc bản điện tử và phải được ghi rõ, đầy đủ các mục có trong hồ sơ bệnh án;
c) Hồ sơ bệnh án bao gồm các tài liệu, thông tin liên quan đến người bệnh và quá trình khám bệnh, chữa bệnh;
3. Việc lưu trữ hồ sơ bệnh án được quy định như sau:
a) Hồ sơ bệnh án được lưu trữ theo các cấp độ mật của pháp luật về bảo vệ bí mật nhà nước;
b) Hồ sơ bệnh án nội trú, ngoại trú được lưu trữ ít nhất 10 năm; hồ sơ bệnh án tai nạn lao động, tai nạn sinh hoạt được lưu trữ ít nhất 15 năm; hồ sơ bệnh án đối với người bệnh tâm thần, người bệnh tử vong được lưu trữ ít nhất 20 năm;
c) Trường hợp lưu trữ hồ sơ bệnh án bằng bản điện tử, cơ sở khám bệnh, chữa bệnh phải có bản sao dự phòng và thực hiện theo các chế độ lưu trữ quy định tại điểm a và điểm b khoản này.
4. Người đứng đầu cơ sở khám bệnh, chữa bệnh quyết định việc cho phép khai thác hồ sơ bệnh án trong các trường hợp sau đây:
a) Sinh viên thực tập, nghiên cứu viên, người hành nghề trong cơ sở khám bệnh, chữa bệnh được mượn hồ sơ bệnh án tại chỗ để đọc hoặc sao chép phục vụ cho việc nghiên cứu hoặc công tác chuyên môn kỹ thuật;
b) Đại diện cơ quan quản lý nhà nước về y tế trực tiếp quản lý cơ sở khám bệnh, chữa bệnh, cơ quan điều tra, viện kiểm sát, tòa án, thanh tra chuyên ngành y tế, cơ quan bảo hiểm, tổ chức giám định pháp y, pháp y tâm thần, luật sư được mượn hồ sơ bệnh án tại chỗ để đọc hoặc sao chép phục vụ nhiệm vụ được giao theo thẩm quyền cho phép;
c) Người bệnh hoặc người đại diện của người bệnh được nhận bản tóm tắt hồ sơ bệnh án theo quy định tại khoản 1 Điều 11 của Luật này.
5. Các đối tượng quy định tại khoản 4 Điều này khi sử dụng thông tin trong hồ sơ bệnh án phải giữ bí mật và chỉ được sử dụng đúng mục đích như đã đề nghị với người đứng đầu cơ sở khám bệnh, chữa bệnh.
Điều 60. Sử dụng thuốc trong cơ sở khám bệnh, chữa bệnh có điều trị nội trú1. Việc sử dụng thuốc trong cơ sở khám bệnh, chữa bệnh có điều trị nội trú phải bảo đảm các nguyên tắc sau đây:
a) Chỉ sử dụng thuốc khi thật sự cần thiết, đúng mục đích, an toàn, hợp lý và hiệu quả;
b) Việc kê đơn thuốc phải phù hợp với chẩn đoán bệnh, tình trạng bệnh của người bệnh;
c) Đúng quy định về bảo quản, cấp phát và sử dụng thuốc.
2. Khi kê đơn thuốc, người hành nghề phải ghi đầy đủ, rõ ràng vào đơn thuốc hoặc bệnh án thông tin về tên thuốc, hàm lượng, liều dùng, cách dùng và thời gian dùng thuốc.
3. Khi cấp phát thuốc cho người bệnh, người được giao nhiệm vụ cấp phát thuốc có trách nhiệm sau đây:
a) Kiểm tra đơn thuốc, phiếu lĩnh thuốc, hàm lượng, liều dùng, cách dùng, tên thuốc và chất lượng thuốc;
b) Đối chiếu đơn thuốc với các thông tin về nồng độ, hàm lượng, số lượng khi nhận thuốc và hạn dùng ghi trên phiếu lĩnh thuốc, nhãn thuốc;
c) Đối chiếu họ tên người bệnh, tên thuốc, dạng thuốc, hàm lượng, liều dùng, cách dùng, thời gian dùng trước khi cho người bệnh sử dụng thuốc;
d) Ghi chép đầy đủ thời gian cấp phát thuốc cho người bệnh, theo dõi và ghi diễn biến lâm sàng của người bệnh vào hồ sơ bệnh án, phát hiện kịp thời các tai biến và báo cho người hành nghề trực tiếp điều trị.
4. Sau khi người bệnh dùng thuốc, người hành nghề trực tiếp điều trị có trách nhiệm theo dõi tác dụng và xử lý kịp thời tai biến do dùng thuốc.
Người bệnh có trách nhiệm dùng thuốc theo đúng hướng dẫn của người hành nghề và thông báo cho người hành nghề về các dấu hiệu bất thường sau khi dùng thuốc.
Điều 61. Thực hiện phẫu thuật, can thiệp ngoại khoa1. Mọi trường hợp phẫu thuật, can thiệp ngoại khoa đều phải được sự đồng ý của người bệnh hoặc đại diện của người bệnh, trừ trường hợp quy định tại khoản 3 Điều này.
2. Người bệnh thuộc đối tượng quy định tại khoản 1 Điều 13 của Luật này, trước khi phẫu thuật, can thiệp ngoại khoa phải được người đại diện của người bệnh đồng ý bằng văn bản.
3. Trường hợp không thể hỏi ý kiến của người bệnh hoặc người đại diện của người bệnh và nếu không thực hiện phẫu thuật hoặc can thiệp ngoại khoa sẽ đe dọa trực tiếp đến tính mạng của người bệnh thì người đứng đầu cơ sở khám bệnh, chữa bệnh quyết định tiến hành phẫu thuật hoặc can thiệp ngoại khoa.
Điều 62. Kiểm soát nhiễm khuẩn trong cơ sở khám bệnh, chữa bệnh1. Các biện pháp kiểm soát nhiễm khuẩn trong cơ sở khám bệnh, chữa bệnh bao gồm:
a) Khử trùng thiết bị y tế, môi trường và xử lý chất thải tại cơ sở khám bệnh, chữa bệnh;
b) Phòng hộ cá nhân, vệ sinh cá nhân;
c) Vệ sinh an toàn thực phẩm;
d) Giám sát nhiễm khuẩn;
đ) Các biện pháp kiểm soát nhiễm khuẩn khác theo quy định của pháp luật.
2. Cơ sở khám bệnh, chữa bệnh có trách nhiệm sau đây:
a) Thực hiện các biện pháp kiểm soát nhiễm khuẩn tại cơ sở khám bệnh, chữa bệnh;
b) Bảo đảm cơ sở vật chất, thiết bị, trang phục phòng hộ, điều kiện vệ sinh cá nhân cho người làm việc trong cơ sở khám bệnh, chữa bệnh, người bệnh và người khác đến cơ sở khám bệnh, chữa bệnh phù hợp với yêu cầu về kiểm soát nhiễm khuẩn trong cơ sở khám bệnh, chữa bệnh;
c) Tư vấn về các biện pháp kiểm soát nhiễm khuẩn cho người bệnh và người nhà của người bệnh;
d) Thực hiện các biện pháp kiểm soát nhiễm khuẩn khác theo quy định của pháp luật.
3. Người làm việc trong cơ sở khám bệnh, chữa bệnh, người bệnh và người khác đến cơ sở khám bệnh, chữa bệnh phải tuân thủ quy định của cơ sở khám bệnh, chữa bệnh về kiểm soát nhiễm khuẩn.
Điều 63. Xử lý chất thải y tế1. Chất thải y tế bao gồm chất thải rắn, lỏng, khí, hóa chất, phóng xạ được thải ra trong quá trình khám bệnh, chẩn đoán, điều trị, chăm sóc người bệnh và sinh hoạt của người bệnh trong cơ sở khám bệnh, chữa bệnh.
2. Cơ sở khám bệnh, chữa bệnh có trách nhiệm phân loại, thu gom và xử lý chất thải y tế theo đúng quy định của pháp luật về bảo vệ môi trường.
Điều 64. Giải quyết đối với người bệnh không có người nhận1. Tiếp nhận và thực hiện khám bệnh, chữa bệnh theo quy định của Luật này.
2. Kiểm kê, lập biên bản và lưu giữ tài sản của người bệnh.
3. Thông báo ngay cho cơ quan công an hoặc Ủy ban nhân dân cấp xã nơi cơ sở khám bệnh, chữa bệnh đặt trụ sở để cơ quan này thông báo tìm người nhà của người bệnh trên phương tiện thông tin đại chúng.
4. Đối với trẻ sơ sinh bị bỏ rơi, người bệnh đã được điều trị ổn định mà vẫn chưa có người nhận, cơ sở khám bệnh, chữa bệnh thông báo cho cơ sở bảo trợ xã hội để tiếp nhận đối tượng này.
5. Đối với người bệnh tâm thần mà cơ sở khám bệnh, chữa bệnh không có chuyên khoa tâm thần thì chuyển người bệnh đến cơ sở khám bệnh, chữa bệnh chuyên ngành tâm thần. Cơ sở khám bệnh, chữa bệnh chuyên ngành tâm thần có trách nhiệm tiếp nhận, chăm sóc và điều trị cho người bệnh. Sau khi điều trị ổn định mà vẫn không có người nhận, cơ sở khám bệnh, chữa bệnh thông báo cho cơ sở bảo trợ xã hội để tiếp nhận người bệnh.
Cơ sở bảo trợ xã hội có trách nhiệm tiếp nhận các đối tượng theo quy định tại khoản 4 và khoản 5 Điều này chậm nhất là 10 ngày làm việc, kể từ ngày nhận được thông báo.
6. Đối với người bệnh tử vong không có người nhận, sau khi thực hiện quy định tại Điều 65 của Luật này, cơ sở khám bệnh, chữa bệnh phải chụp ảnh, lưu giữ mô để xác định danh tính, làm thủ tục khai tử theo quy định của pháp luật về hộ tịch và tổ chức mai táng.
Điều 65. Giải quyết đối với người bệnh tử vong1. Cơ sở khám bệnh, chữa bệnh có trách nhiệm sau đây:
a) Cấp giấy chứng tử;
b) Tiến hành kiểm thảo tử vong trong thời hạn 15 ngày, kể từ khi người bệnh tử vong;
c) Giao người hành nghề trực tiếp điều trị hoặc phụ trách ca trực lập hồ sơ tử vong, trong đó ghi rõ diễn biến bệnh, cách xử lý, thời gian và nguyên nhân tử vong;
d) Lưu trữ hồ sơ tử vong theo quy định tại khoản 3 Điều 59 của Luật này.
2. Đối với trường hợp tử vong trước khi đến cơ sở khám bệnh, chữa bệnh được giải quyết như sau:
a) Đối với người có giấy tờ tùy thân, cơ sở khám bệnh, chữa bệnh thông báo cho thân nhân của hộ để tổ chức mai táng;
b) Đối với người không có giấy tờ tùy thân, cơ sở khám bệnh, chữa bệnh thông báo trên phương tiện thông tin đại chúng để tìm người nhà của người bệnh.
Trường hợp không có giấy tờ tùy thân hoặc có giấy tờ tùy thân nhưng không có người nhận, cơ sở khám bệnh, chữa bệnh có trách nhiệm bảo quản thi thể, chụp ảnh và thông báo cho cơ quan công an hoặc Ủy ban nhân dân cấp xã nơi cơ sở khám bệnh, chữa bệnh đặt trụ sở.
Trường hợp không có người nhận, cơ sở khám bệnh, chữa bệnh liên hệ với Ủy ban nhân dân cấp xã hoặc cơ quan lao động, thương binh và xã hội trên địa bàn để các cơ quan này tổ chức mai táng.
3. Việc xác định người bệnh đã tử vong và thời hạn bảo quản thi thể được thực hiện theo quy định của pháp luật.
Điều 66. Bắt buộc chữa bệnh1. Các trường hợp bắt buộc chữa bệnh theo quy định của Luật này bao gồm:
a) Mắc bệnh truyền nhiễm nhóm A theo quy định của pháp luật về phòng, chống bệnh truyền nhiễm;
b) Bệnh tâm thần ở trạng thái kích động, trầm cảm có ý tưởng, hành vi tự sát hoặc gây nguy hiểm cho người khác theo quy định của pháp luật.
2. Việc bắt buộc chữa bệnh thực hiện theo quy định của pháp luật về hình sự và pháp luật về xử lý vi phạm hành chính không thuộc phạm vi điều chỉnh của Luật này.
Điều 67. Trực khám bệnh, chữa bệnh1. Cơ sở khám bệnh, chữa bệnh có giường bệnh nội trú, cơ sở cấp cứu phải bảo đảm trực liên tục ngoài giờ hành chính, ngày lễ, ngày nghỉ.
Khuyến khích cơ sở khám bệnh, chữa bệnh có giường bệnh nội trú tổ chức khám bệnh, chữa bệnh 24 giờ/ngày.
2. Trực ở cơ sở khám bệnh, chữa bệnh bao gồm trực lãnh đạo, trực lâm sàng, trực cận lâm sàng và trực hậu cần, bảo vệ.
3. Người đứng đầu cơ sở khám bệnh, chữa bệnh có trách nhiệm sau đây:
a) Phân công người trực, quy định rõ trách nhiệm đối với từng cấp trực, người trực và chế độ trực cụ thể;
b) Bảo đảm đầy đủ các phương tiện vận chuyển cấp cứu phù hợp với hình thức tổ chức khám bệnh, chữa bệnh; thiết bị, dụng cụ y tế và thuốc thiết yếu để kịp thời cấp cứu người bệnh;
c) Bảo đảm chế độ báo cáo trực đối với mỗi phiên trực.
Điều 68. Kết hợp y học cổ truyền với y học hiện đại trong quá trình khám bệnh, chữa bệnh1. Khuyến khích việc kết hợp y học cổ truyền với y học hiện đại tại cơ sở khám bệnh, chữa bệnh.
2. Việc kết hợp y học cổ truyền với y học hiện đại tại bệnh viện y học cổ truyền được thực hiện như sau:
a) Sử dụng một số phương tiện kỹ thuật của y học hiện đại để phục vụ chẩn đoán, đánh giá kết quả điều trị, kết quả nghiên cứu thừa kế;
b) Sử dụng một số thiết bị và thuốc y học hiện đại để phục vụ cấp cứu người bệnh, sử dụng một số thuốc thiết yếu để điều trị người bệnh.
3. Việc kết hợp y học cổ truyền với y học hiện đại tại bệnh viện khác được thực hiện như sau:
a) Kết hợp phương pháp y học cổ truyền trong khám bệnh, chữa bệnh;
b) Sử dụng phương tiện kỹ thuật của y học hiện đại để chẩn đoán bệnh, tổ chức áp dụng, đánh giá kết quả các bài thuốc, môn thuốc, phương pháp chữa bệnh của y học cổ truyền.
4. Bộ trưởng Bộ Y tế quy định chi tiết khoản 2 và khoản 3 Điều này và việc kết hợp y học cổ truyền với y học hiện đại trong khám bệnh, chữa bệnh tại cơ sở khám bệnh, chữa bệnh khác.
Kỹ thuật, phương pháp mới trong khám bệnh, chữa bệnh bao gồm:
1. Kỹ thuật, phương pháp được nghiên cứu tại Việt Nam hoặc nước ngoài, được cơ quan nhà nước có thẩm quyền của Việt Nam công nhận và lần đầu tiên áp dụng tại Việt Nam;
2. Kỹ thuật, phương pháp được cơ quan nhà nước có thẩm quyền ở nước ngoài cho phép áp dụng nhưng lần đầu tiên áp dụng tại Việt Nam;
3. Kỹ thuật, phương pháp được cơ quan nhà nước có thẩm quyền cho phép và đã áp dụng tại Việt Nam, nhưng lần đầu tiên áp dụng tại một cơ sở khám bệnh, chữa bệnh.
Điều 70. Điều kiện áp dụng kỹ thuật, phương pháp mới trong khám bệnh, chữa bệnh tại Việt Nam1. Có đủ điều kiện về nhân lực, cơ sở vật chất, thiết bị để có thể áp dụng kỹ thuật, phương pháp mới.
2. Được Bộ trưởng Bộ Y tế hoặc Giám đốc Sở Y tế cho phép áp dụng.
Điều 71. Thẩm quyền cho phép áp dụng kỹ thuật, phương pháp mới1. Bộ trưởng Bộ Y tế tổ chức thẩm định và cho phép cơ sở khám bệnh, chữa bệnh áp dụng lần đầu kỹ thuật, phương pháp mới quy định tại khoản 1 và khoản 2 Điều 69 của Luật này.
2. Giám định Sở Y tế tổ chức thẩm định và cho phép cơ sở khám bệnh, chữa bệnh thuộc địa bàn quản lý áp dụng kỹ thuật, phương pháp mới quy định tại khoản 3 Điều 69 của Luật này theo phân tuyến chuyên môn kỹ thuật của Bộ Y tế.
Điều 72. Hồ sơ, thủ tục cho phép cơ sở khám bệnh, chữa bệnh áp dụng kỹ thuật, phương pháp mới1. Hồ sơ đề nghị áp dụng kỹ thuật, phương pháp mới bao gồm:
a) Đơn đề nghị áp dụng kỹ thuật, phương pháp mới;
b) Tài liệu chứng minh tính hợp pháp, bằng chứng lâm sàng, tính hiệu quả trong khám bệnh, chữa bệnh của kỹ thuật, phương pháp mới đối với trường hợp quy định tại khoản 2 Điều 69 của Luật này;
c) Đề án triển khai áp dụng kỹ thuật, phương pháp mới, bao gồm các nội dung chủ yếu sau: mô tả năng lực của cơ sở khám bệnh, chữa bệnh về cơ sở vật chất, nhân lực, thiết bị, hiệu quả kinh tế, quy trình kỹ thuật dự kiến áp dụng và phương án triển khai thực hiện;
d) Bản sao văn bằng, chứng chỉ chuyên môn, giấy chứng nhận của người hành nghề có liên quan đến kỹ thuật, phương pháp mới;
đ) Hợp đồng do cơ quan, tổ chức, cá nhân trong nước hoặc nước ngoài chuyển giao kỹ thuật, phương pháp mới.
2. Thủ tục cho phép áp dụng kỹ thuật, phương pháp mới được quy định như sau:
a) Cơ sở khám bệnh, chữa bệnh nộp hồ sơ đề nghị áp dụng kỹ thuật, phương pháp mới theo quy định tại khoản 1 Điều này cho Bộ Y tế hoặc Sở Y tế;
b) Chậm nhất 10 ngày làm việc, kể từ ngày nhận đủ hồ sơ, Bộ trưởng Bộ Y tế hoặc Giám đốc Sở Y tế phải tổ chức thẩm định hồ sơ và có văn bản cho phép hoặc không cho phép cơ sở khám bệnh, chữa bệnh triển khai thí điểm kỹ thuật, phương pháp mới; trường hợp không cho phép phải trả lời bằng văn bản và nêu lý do;
c) Cơ sở khám bệnh, chữa bệnh triển khai thí điểm kỹ thuật, phương pháp mới đã được Bộ trưởng Bộ Y tế hoặc Giám đốc Sở Y tế cho phép. Quy mô triển khai thí điểm đối với từng loại kỹ thuật, phương pháp mới thực hiện theo văn bản cho phép của Bộ trưởng Bộ Y tế hoặc Giám đốc Sở Y tế;
d) Sau khi kết thúc giai đoạn triển khai thí điểm, cơ sở khám bệnh, chữa bệnh nộp báo cáo kết quả và quy trình kỹ thuật đã được xây dựng hoàn thiện cho Bộ Y tế hoặc Sở Y tế để thẩm định;
đ) Chậm nhất 20 ngày, kể từ ngày nhận được báo cáo kết quả và quy trình kỹ thuật, Bộ trưởng Bộ Y tế hoặc Giám đốc Sở Y tế thành lập Hội đồng chuyên môn thẩm định kết quả triển khai thí điểm và quy trình kỹ thuật do cơ sở khám bệnh, chữa bệnh đề xuất để tư vấn cho Bộ trưởng Bộ Y tế hoặc Giám đốc Sở Y tế xem xét quyết định cho phép;
e) Chậm nhất 05 ngày làm việc, kể từ ngày nhận được biên bản tư vấn của Hội đồng chuyên môn, Bộ trưởng Bộ Y tế hoặc Giám đốc Sở Y tế ra quyết định cho phép hoặc từ chối cho phép cơ sở khám bệnh, chữa bệnh thực hiện kỹ thuật, phương pháp mới và phê duyệt quy trình kỹ thuật. Đối với các quy trình kỹ thuật giống nhau về cả thiết bị và quy trình thực hiện thì áp dụng chung trong toàn quốc; nếu khác nhau thì sẽ phải phê duyệt quy trình kỹ thuật riêng đối với từng kỹ thuật, phương pháp mới; trường hợp không cho phép phải trả lời bằng văn bản và nêu lý do.
3. Bộ trưởng Bộ Y tế quy định chi tiết điều kiện, thủ tục cho phép áp dụng kỹ thuật, phương pháp mới trong khám bệnh, chữa bệnh.
Điều 73. Xác định người hành nghề có sai sót hoặc không có sai sót chuyên môn kỹ thuật
1. Người hành nghề có sai sót chuyên môn kỹ thuật khi được hội đồng chuyên môn quy định tại Điều 74 và Điều 75 của Luật này xác định đã có một trong các hành vi sau đây:
a) Vi phạm trách nhiệm trong chăm sóc và điều trị người bệnh;
b) Vi phạm các quy định chuyên môn kỹ thuật và đạo đức nghề nghiệp;
c) Xâm phạm quyền của người bệnh.
2. Người hành nghề không có sai sót chuyên môn kỹ thuật khi được hội đồng chuyên môn quy định tại Điều 74 và Điều 75 của Luật này xác định thuộc một trong các trường hợp sau đây:
a) Đã thực hiện đúng các quy định chuyên môn kỹ thuật trong quá trình khám bệnh, chữa bệnh nhưng vẫn xảy ra tai biến đối với người bệnh;
b) Trong trường hợp cấp cứu nhưng do thiếu phương tiện, thiết bị kỹ thuật, thiếu người hành nghề theo quy định của pháp luật mà không thể khắc phục được hoặc bệnh đó chưa có quy định chuyên môn để thực hiện dẫn đến xảy ra tai biến đối với người bệnh; các trường hợp bất khả kháng khác dẫn đến xảy ra tai biến đối với người bệnh.
Điều 74. Thành lập hội đồng chuyên môn1. Trường hợp có yêu cầu giải quyết tranh chấp về khám bệnh, chữa bệnh khi xảy ra tai biến đối với người bệnh thì thành lập hội đồng chuyên môn để xác định có hay không có sai sót chuyên môn kỹ thuật.
2. Việc thành lập hội đồng chuyên môn được quy định như sau:
a) Trong thời hạn 05 ngày làm việc, kể từ ngày nhận được yêu cầu giải quyết tranh chấp, người đứng đầu cơ sở khám bệnh, chữa bệnh phải tự thành lập hội đồng chuyên môn hoặc nếu không tự thành lập được thì đề nghị cơ quan nhà nước có thẩm quyền về y tế quản lý trực tiếp thành lập hội đồng chuyên môn;
Trong thời hạn 10 ngày làm việc, kể từ ngày nhận được đề nghị của cơ sở khám bệnh, chữa bệnh, cơ quan nhà nước có thẩm quyền về y tế quản lý trực tiếp phải thành lập hội đồng chuyên môn;
b) Trường hợp các bên tranh chấp không nhất trí với kết luận của hội đồng chuyên môn quy định tại điểm a khoản này, các bên có quyền đề nghị Bộ Y tế thành lập hội đồng chuyên môn.
Trong thời hạn 20 ngày, kể từ ngày nhận được đề nghị, Bộ Y tế phải thành lập hội đồng chuyên môn.
3. Trong thời hạn 30 ngày, kể từ ngày thành lập, hội đồng chuyên môn phải họp và mời các bên liên quan đến tranh chấp tham gia một số phiên họp và phiên kết luận.
4. Trường hợp vụ việc liên quan đến tai biến trong khám bệnh, chữa bệnh được giải quyết theo thủ tục tố tụng, cơ quan tiến hành tố tụng có thể đề nghị cơ quan quản lý nhà nước có thẩm quyền về y tế thành lập hội đồng chuyên môn để xác định có hay không có sai sót chuyên môn kỹ thuật.
Điều 75. Thành phần, nguyên tắc hoạt động và nhiệm vụ của hội đồng chuyên môn1. Thành phần của hội đồng chuyên môn bao gồm:
a) Các chuyên gia thuộc lĩnh vực chuyên môn phù hợp;
b) Các chuyên gia thuộc các chuyên khoa khác có liên quan đến tai biến trong khám bệnh, chữa bệnh;
c) Luật gia hoặc luật sư.
2. Hội đồng chuyên môn hoạt động theo nguyên tắc thảo luận tập thể, quyết định theo đa số và chịu trách nhiệm trước pháp luật về kết luận của mình.
3. Hội đồng chuyên môn căn cứ vào các quy định tại Điều 73 của Luật này có trách nhiệm xác định có hay không có sai sót chuyên môn kỹ thuật.
4. Kết luận của hội đồng chuyên môn là cơ sở để giải quyết tranh chấp hoặc để cơ quan tiến hành tố tụng xem xét, quyết định giải quyết vụ việc; là căn cứ để cơ quan quản lý nhà nước có thẩm quyền về y tế, người đứng đầu cơ sở khám bệnh, chữa bệnh quyết định áp dụng các biện pháp xử lý theo thẩm quyền đối với người hành nghề.
5. Kết luận của hội đồng chuyên môn do Bộ Y tế thành lập quy định tại điểm b khoản 2 Điều 74 của Luật này là kết luận cuối cùng về việc có hay không có sai sót chuyên môn kỹ thuật.
Điều 76. Trách nhiệm của người hành nghề, cơ sở khám bệnh, chữa bệnh khi xảy ra tai biến trong khám bệnh, chữa bệnh1. Trường hợp xảy ra sai sót chuyên môn kỹ thuật gây ra tai biến cho người bệnh hoặc trong trường hợp quy định tại điểm b khoản 2 Điều 73 của Luật này, doanh nghiệp bảo hiểm mà cơ sở khám bệnh, chữa bệnh đã mua bảo hiểm có trách nhiệm bồi thường thiệt hại cho người bệnh theo hợp đồng bảo hiểm đã ký với cơ sở khám bệnh, chữa bệnh đó.
Trường hợp cơ sở khám bệnh, chữa bệnh chưa mua bảo hiểm theo quy định tại khoản 1 Điều 78 của Luật này thì phải tự bồi thường thiệt hại cho người bệnh theo quy định của pháp luật.
2. Ngoài việc bồi thường theo quy định tại khoản 1 Điều này, cơ sở khám bệnh, chữa bệnh và người hành nghề có sai sót chuyên môn kỹ thuật gây ra tai biến cho người bệnh phải chịu các trách nhiệm pháp lý khác theo quy định của pháp luật.
3. Trường hợp xảy ra tai biến trong khám bệnh, chữa bệnh theo quy định tại điểm a khoản 2 Điều 73 của Luật này thì cơ sở khám bệnh, chữa bệnh và người hành nghề không phải bồi thường thiệt hại.
Điều 77. Xác định mức bồi thường thiệt hại do sai sót chuyên môn kỹ thuật gây ra tai biến trong khám bệnh, chữa bệnhViệc xác định mức bồi thường thiệt hại trong trường hợp quy định tại khoản 1 Điều 76 của Luật này được thực hiện theo quy định của pháp luật.
Điều 78. Bảo hiểm trách nhiệm trong khám bệnh, chữa bệnh1. Cơ sở khám bệnh, chữa bệnh và người hành nghề mua bảo hiểm trách nhiệm trong khám bệnh, chữa bệnh theo quy định của Chính phủ tại doanh nghiệp bảo hiểm được thành lập và hoạt động tại Việt Nam.
2. Chính phủ quy định chi tiết về bảo hiểm trách nhiệm trong khám bệnh, chữa bệnh và lộ trình để tiến tới tất cả người hành nghề và cơ sở khám bệnh, chữa bệnh tham gia bảo hiểm trách nhiệm trong khám bệnh, chữa bệnh.
Mục 2. KHIẾU NẠI, TỐ CÁO VÀ GIẢI QUYẾT TRANH CHẤP VỀ KHÁM BỆNH, CHỮA BỆNHĐiều 79. Khiếu nại, tố cáo về khám bệnh, chữa bệnh
Việc khiếu nại và giải quyết khiếu nại đối với quyết định hành chính, hành vi hành chính về khám bệnh, chữa bệnh; việc tố cáo và giải quyết tố cáo vi phạm pháp luật về khám bệnh, chữa bệnh được thực hiện theo quy định của pháp luật về khiếu nại, tố cáo.
Điều 80. Tranh chấp về khám bệnh, chữa bệnh1. Tranh chấp về khám bệnh, chữa bệnh là tranh chấp liên quan đến quyền, nghĩa vụ và trách nhiệm trong khám bệnh, chữa bệnh giữa các đối tượng sau đây:
a) Người bệnh, người đại diện của người bệnh;
b) Người hành nghề;
c) Cơ sở khám bệnh, chữa bệnh.
2. Tranh chấp về khám bệnh, chữa bệnh được giải quyết như sau:
a) Các bên tranh chấp có trách nhiệm tự hòa giải về nội dung tranh chấp;
b) Trường hợp hòa giải không thành thì các bên tranh chấp có quyền khởi kiện tại Tòa án theo quy định của pháp luật.
3. Thời hiệu yêu cầu giải quyết tranh chấp về khám bệnh, chữa bệnh là 05 năm, kể từ khi sự việc xảy ra.
1. Hệ thống cơ sở khám bệnh, chữa bệnh bao gồm cơ sở khám bệnh, chữa bệnh của Nhà nước, tư nhân và cơ sở khám bệnh, chữa bệnh khác.
2. Hệ thống cơ sở khám bệnh, chữa bệnh của Nhà nước bao gồm 4 tuyến như sau:
a) Tuyến trung ương;
b) Tuyến tỉnh, thành phố trực thuộc trung ương;
c) Tuyến huyện, quận, thị xã, thành phố thuộc tỉnh;
d) Tuyến xã, phường, thị trấn.
3. Cơ sở khám bệnh, chữa bệnh của tuyến trên có trách nhiệm chỉ đạo, hỗ trợ về chuyên môn kỹ thuật đối với cơ sở khám bệnh, chữa bệnh của tuyến dưới.
4. Bộ trưởng Bộ Y tế quy định chi tiết phân tuyến chuyên môn kỹ thuật đối với cơ sở khám bệnh, chữa bệnh của từng tuyến quy định tại khoản 2 và khoản 3 Điều này.
Điều 82. Quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh1. Quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh phải đáp ứng các yêu cầu sau đây:
a) Khai thác, sử dụng có hiệu quả mọi tiềm năng và nguồn lực của đất nước để xây dựng và phát triển hệ thống cơ sở khám bệnh, chữa bệnh; bảo đảm cơ sở vật chất, thiết bị ngày càng tiên tiến, hiện đại nhằm nâng cao chất lượng dịch vụ khám bệnh, chữa bệnh;
b) Bảo đảm cân đối, đồng bộ, có quy mô hợp lý, được bố trí phù hợp, tạo điều kiện thuận lợi cho người dân trong việc tiếp cận với các dịch vụ khám bệnh, chữa bệnh;
c) Phù hợp với kế hoạch phát triển kinh tế - xã hội của đất nước.
2. Căn cứ để xây dựng quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh bao gồm:
a) Nhu cầu khám bệnh, chữa bệnh, cơ cấu bệnh tật;
b) Địa giới hành chính, địa bàn dân cư, quy mô dân số;
c) Kế hoạch phát triển kinh tế - xã hội.
3. Nội dung quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh bao gồm:
a) Mục tiêu, nhiệm vụ, chương trình, dự án trọng điểm;
b) Hệ thống tổ chức cơ sở khám bệnh, chữa bệnh;
c) Nguồn lực, giải pháp thực hiện, điều kiện bảo đảm.
4. Thẩm quyền phê duyệt quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh được quy định như sau:
a) Thủ tướng Chính phủ phê duyệt quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh trên toàn quốc theo đề nghị của Bộ trưởng Bộ Y tế và Bộ trưởng Bộ Quốc phòng;
b) Bộ trưởng Bộ Y tế phê duyệt quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh chuyên ngành;
c) Chủ tịch Ủy ban nhân dân cấp tỉnh phê duyệt quy hoạch hệ thống cơ sở khám bệnh, chữa bệnh của địa phương theo đề nghị của Giám đốc Sở Y tế.
Điều 83. Đào tạo, bồi dưỡng người hành nghề1. Nhà nước có quy hoạch, kế hoạch đào tạo, đào tạo lại, bồi dưỡng về chuyên môn kỹ thuật, đạo đức nghề nghiệp cho người hành nghề, kết hợp y học cổ truyền dân tộc với y học hiện đại.
2. Nhà nước miễn học phí đối với người học chuyên ngành giải phẫu bệnh, giám định pháp y, pháp y tâm thần.
Điều 84. Chế độ đối với người hành nghề1. Người hành nghề bị mắc bệnh nghề nghiệp, bệnh do tai nạn rủi ro nghề nghiệp được hưởng các chế độ theo quy định của Thủ tướng Chính phủ.
2. Trong quá trình hành nghề, người hành nghề dũng cảm cứu người mà bị chết hoặc bị thương thì được xem xét để công nhận là liệt sỹ hoặc thương binh, hưởng chính sách như thương binh theo quy định của pháp luật về ưu đãi người có công với cách mạng.
Điều 85. Các nguồn tài chính phục vụ cho công tác khám bệnh, chữa bệnh1. Ngân sách nhà nước đối với cơ sở khám bệnh, chữa bệnh của Nhà nước.
2. Kinh phí từ nguồn chi trả chi phí sử dụng dịch vụ khám bệnh, chữa bệnh.
3. Các nguồn kinh phí khác theo quy định của pháp luật.
Điều 86. Ngân sách nhà nước chi cho công tác y tế1. Ưu tiên bố trí ngân sách nhằm đáp ứng nhu cầu sử dụng dịch vụ khám bệnh, chữa bệnh cơ bản của nhân dân; từng bước chuyển hình thức đầu tư từ ngân sách nhà nước trực tiếp cho các cơ sở khám bệnh, chữa bệnh của Nhà nước sang hình thức hỗ trợ cho người dân thông qua bảo hiểm y tế.
2. Ngân sách nhà nước chi cho công tác khám bệnh, chữa bệnh phải được phân bổ công khai, minh bạch; căn cứ vào quy mô dân số, cơ cấu bệnh tật, điều kiện phát triển kinh tế - xã hội của từng vùng; thể hiện được chính sách ưu tiên của Nhà nước đối với công tác khám bệnh, chữa bệnh ở vùng dân tộc thiểu số và vùng có điều kiện kinh tế - xã hội khó khăn, vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn và công tác khám bệnh, chữa bệnh đối với các bệnh xã hội, bệnh dịch nguy hiểm.
Điều 87. Xã hội hóa công tác khám bệnh, chữa bệnh1. Nhà nước giữ vai trò chủ đạo trong phát triển hệ thống cơ sở khám bệnh, chữa bệnh; cơ sở khám bệnh, chữa bệnh của Nhà nước hoạt động không vì mục đích lợi nhuận.
2. Nhà nước thực hiện đa dạng hóa các loại hình dịch vụ khám bệnh, chữa bệnh; khuyến khích, huy động và tạo điều kiện để tổ chức, cá nhân tham gia xây dựng các cơ sở khám bệnh, chữa bệnh; khuyến khích cơ sở khám bệnh, chữa bệnh tư nhân hoạt động không vì mục đích lợi nhuận.
3. Mọi tổ chức, gia đình và công dân có trách nhiệm tự chăm lo sức khỏe, phát hiện bệnh sớm cho các thành viên trong tổ chức, gia đình và bản thân; tham gia cấp cứu, hỗ trợ giải quyết các trường hợp xảy ra tai nạn, thương tích tại cộng đồng và tham gia các hoạt động khám bệnh, chữa bệnh khi có sự huy động của cơ quan có thẩm quyền.
4. Nhà nước có hình thức khen thưởng thích hợp đối với tổ chức, cá nhân đầu tư xây dựng cơ sở khám bệnh, chữa bệnh không vì mục đích lợi nhuận; đóng góp, tài trợ, ủng hộ cho việc phát triển công tác khám bệnh, chữa bệnh.
Điều 88. Giá dịch vụ khám bệnh, chữa bệnh1. Giá dịch vụ khám bệnh, chữa bệnh là số tiền phải trả cho mỗi dịch vụ khám bệnh, chữa bệnh.
2. Chính phủ quy định cơ chế thu, quản lý và sử dụng khoản thu từ dịch vụ khám bệnh, chữa bệnh trong cơ sở khám bệnh, chữa bệnh của Nhà nước.
3. Bộ trưởng Bộ Tài chính phối hợp với Bộ trưởng Bộ Y tế quy định khung giá dịch vụ khám bệnh, chữa bệnh; giá dịch vụ khám bệnh, chữa bệnh đối với người bệnh là người nước ngoài, người Việt Nam định cư ở nước ngoài trong cơ sở khám bệnh, chữa bệnh của Nhà nước.
4. Căn cứ vào khung giá dịch vụ khám bệnh, chữa bệnh quy định tại khoản 3 Điều này, Bộ trưởng Bộ Y tế quy định giá dịch vụ khám bệnh, chữa bệnh đối với cơ sở khám bệnh, chữa bệnh thuộc Bộ Y tế và các bộ khác; Hội đồng nhân dân cấp tỉnh quy định giá dịch vụ khám bệnh, chữa bệnh đối với cơ sở khám bệnh, chữa bệnh của Nhà nước thuộc phạm vi quản lý của địa phương theo đề nghị của Ủy ban nhân dân cùng cấp.
5. Cơ sở khám bệnh, chữa bệnh tư nhân được quyền quyết định và phải niêm yết công khai giá dịch vụ khám bệnh, chữa bệnh.
Điều 89. Quỹ hỗ trợ khám bệnh, chữa bệnh1. Quỹ hỗ trợ khám bệnh, chữa bệnh là quỹ xã hội, từ thiện được thành lập và hoạt động để hỗ trợ chi phí khám bệnh, chữa bệnh cho các đối tượng có hoàn cảnh khó khăn hoặc không có khả năng chi trả chi phí khám bệnh, chữa bệnh và các hoạt động khác phục vụ cho công tác khám bệnh, chữa bệnh.
2. Nguồn tài chính của Quỹ được hình thành trên cơ sở đóng góp tự nguyện, tài trợ của tổ chức, cá nhân trong nước và nước ngoài; việc thành lập, tổ chức, hoạt động và quản lý quỹ hỗ trợ khám bệnh, chữa bệnh được thực hiện theo quy định của pháp luật.
Luật này có hiệu lực từ ngày 01 tháng 01 năm 2011.
Pháp lệnh hành nghề y, dược tư nhân số 07/2003/PL-UBTVQH11 hết hiệu lực kể từ ngày Luật này có hiệu lực.
Điều 91. Quy định chi tiết và hướng dẫn thi hànhChính phủ quy định chi tiết, hướng dẫn thi hành các điều, khoản được giao trong Luật; hướng dẫn những nội dung cần thiết khác của Luật này để đáp ứng yêu cầu quản lý nhà nước.
Luật này đã được Quốc hội nước Cộng hòa xã hội chủ nghĩa Việt Nam khóa XII, kỳ họp thứ 6 thông qua ngày 23 tháng 11 năm 2009.

ON MEDICAL EXAMINATION AND TREATMENT
Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10
The National Assembly promulgates the Law on Medical Examination and Treatment.
Article 1. Scope of regulation
This Law provides the rights and obligations of patients, medical practitioners and medical examination and treatment establishments; conditions on medical practitioners and medical examination and treatment establishments; professional and technical requirements for medical examination and treatment; application of new techniques and methods to medical examination and treatment; professional and technical mistakes, settlement of complaints, denunciations and disputes related to medical examination and treatment; and conditions to assure medical examination and treatment.
Article 2. Interpretation of terms
In this Law, the terms below are construed as follows:
1. Medical examination means the inquiry into diseases and medical history, physical examination, and instruction for paraclinical testing or functional probe, when necessary, for diagnosis and instruction of recognized appropriate treatment methods.
2. Medical treatment means the use of recognized professional and technical methods and drugs licensed for circulation for first aid, cure, care and functional rehabilitation of patients.
3. Patient means a user of medical examination and treatment services.
4. Medical practice certificate means a document granted by a competent state agency to a person eligible for professional practice under this Law.
5. License for medical examination and treatment means a document granted by a competent state agency to a medical examination and treatment establishment eligible for operation under this Law (below referred to as operation license).
6. Medical practitioner means a person possessing a medical practice certificate and practicing medical examination and treatment (below referred to as practitioner).
7. Medical examination and treatment establishment means a fixed or mobile establishment possessing an operation license and providing medical examination and treatment services.8.
8. Herbalist means a person knowledgeable about traditional theories and experienced in providing examination and treatment with traditional medicine methods with or without drugs, which are recognized by the Ministry of Health or provincial-level Health Departments after consulting the Central Oriental Medicine Council or provincial-level Oriental Medicine Councils.
9 Owner of a family herbal remedy or treatment method means a person owning an old remedy or treatment method passed from one generation to another of a family or family line, which effectively cures one or some diseases or symptoms and is recognized by a provincial-level Health Department after consulting a provincial-level Oriental Medicine Council.
10. Continued updating of medical knowledge means a practitioner's attendance to short-term health training courses, conferences and seminars related to his/her professional practice under programs approved or recognized by the Ministry of Health and receipt of training certificates under the Health Minister's regulations.
11. Abandoned patient means a patient in an emergency state, suffering from a mental disease or being abandoned, including infants abandoned at medical examination and treatment establishments, without personal identification papers and whose address of residence is unknown.
12. Consultation means a discussion between practitioners on the disease status of a patient for diagnosis and introduction of appropriate and timely treatment methods.
13. Incident in medical examination and treatment means consequences harming the health or life of a patient caused by professional and technical mistakes in medical examination
and treatment or unexpected misfortunes in medical examination and treatment even though
a practitioner has observed professional and technical regulations.
Article 3. Principles for medical practice
1. To ensure equality, fairness and non-discrimination for patients.
2. To respect patients' rights; to keep confidential information on the health status and privacy of patients indicated in their case history dossiers, except the cases specified in Clause 2. Article 8: Clause 1. Article II; and Clause 4. Article 59. of this Law.
3. To promptly and properly observe professional and technical regulations.
4. To prioritize medical examination and treatment for cases of emergency, under-6 children, sufferers of serious disabilities, people aged full 80 or older; people with contributions to the revolution; and pregnant women.
5. To guarantee professional ethics of practitioners.
6. To respect, cooperate with, and protect practitioners on duty.
Article 4. State policies on medical examination and treatment
1. To prioritize budget to meet people's basic needs for medical examination and treatment. To allocate budget to healthcare for people with contributions to the revolution, children, poor people, farmers, ethnic minority people and inhabitants in areas meeting with socio-economic difficulties or extreme socio-economic difficulties.
2. To increasingly develop human resources for the health sector, especially in areas meeting with socio-economic difficulties or extreme socioeconomic difficulties. To rotate on a definite term practitioners at medical examination and treatment establishments from higher to lower levels and from areas without socio-economic difficulties to those with socio-economic difficulties or extreme socio-economic difficulties.
3. To enhance the socialization of medical examination and treatment activities; to encourage organizations and individuals to invest in developing medical examination and treatment services.
4. To encourage scientific and technological research and application to medical examination and treatment.
5. To combine western medicine with traditional medicine in medical examination and treatment.
Article 5. State management responsibilities for medical examination and treatment
1. The Government shall perform the unified state management of medical examination and treatment.
2. The Ministry of Health shall take responsibility before the Government for performing the state management of medical examination and treatment and has the following tasks and powers:
a/ To elaborate and promulgate according to its competence or submit to competent authorities for promulgation legal documents and technical regulations on medical examination and treatment; development strategies and master plans on the system of medical examination and treatment establishments;
b/ To direct, guide, disseminate, and organize the implementation of, legal documents on medical examination and treatment; and development strategies and master plans on the system of medical examination and treatment establishments;
c/ To uniformly manage the grant, re-grant and revocation of medical practice certificates and operation licenses;
d/ To establish and manage a national database on practitioners and medical examination and treatment establishments.
e/ To inspect, examine, settle complaints and denunciations and handle violations of the law on medical examination and treatment;
f/ To provide training, continued training and refresher training for human resources; to guide the rotation of practitioners; to study and apply science and technology to medical examination and treatment;
g/ To carry out international cooperation on medical examination and treatment; to recognize medical practice certificates of other countries; to guide humanitarian medical examination and treatment; to cooperate with foreign experts, to transfer new technologies and treatment methods.
3. The Ministry of National Defense shall, within the ambit of its tasks and powers, organize and guide medical examination and treatment at establishments under its management in accordance with this Law and suitable to the army's actual conditions.
4. Ministries and ministerial-level agencies shall, within the ambit of their tasks and powers, collaborate with the Ministry of Health in performing the state management of medical examination and treatment.
5. People's Committees of provinces and centrally run cities (below referred to as provincial level) shall, within the ambit of their tasks and powers, perform the state management of medical examination and treatment in their localities.
1. Refusing to provide or intentionally delaying first aid for patients.
2. Providing medical examination and treatment without a medical practice certificate or during the time subject to suspension from professional practice; providing medical examination and treatment services without an operation license or during the time subject to suspension from operation.
3. Practicing medical examination and treatment or providing medical examination and treatment services outside the scope of professional operation under a medical practice certificate or operation license, except cases of emergency.
4. Hiring, borrowing, leasing or lending medical practice certificates or operation licenses.
5. Practitioners selling drugs to patients in any forms, except herb doctors, herb assistant doctors, herbalists and owners of family remedies.
6. Applying medical professional methods and techniques which have not been recognized and using drugs which have not been licensed for circulation, in medical examination and treatment.
7. Advertising professional capacity and qualifications untruthfully or beyond the scope of professional operation under medical practice certificates or operation licenses; abusing traditional herbal medicament knowledge or other medical knowledge to advertise treatment methods or drugs untruthfully.
8. Using superstitions in medical examination and treatment.
9. Practitioners drinking alcohol or beer or smoking or having an alcoholic concentration in blood or breath when providing medical examination and treatment.
10. Infringing upon patients' rights; failing to observe professional and technical regulations in medical examination and treatment; taking advantage of positions and powers in medical examination and treatment: abusing the profession to harm the honor, dignity and body of patients: erasing and modifying case history dossiers to falsify information on medical examination and treatment.
11. Harming the health, life, honor and dignity of practitioners.
12. Obstructing patients in need of compulsory treatment in admitting to medical examination and treatment establishments or intentionally providing treatment for those not in need of compulsory treatment.
13. Medical cadres, civil servants and public employees establishing, engaged in the establishment or management and administration of, private hospitals or medical examination and treatment establishments set up and operating under the Enterprise Law or the Law on Cooperatives, unless they are assigned by competent state agencies to manage and administer state-funded medical examination and treatment establishments.
14. Bribe giving, taking and broking in medical examination and treatment.
RIGHTS AND OBLIGATIONS OF PATIENTS
Article 7. Rights to medical examination and treatment with quality suitable to actual conditions
To be given counseling and explanations about their health status, treatment methods and medical examination and treatment services suitable to their diseases.
To receive treatment with safe, appropriate and effective methods according to professional and technical regulations.
Article 8. Rights to respect for privacy
1. To have their health status and private information given in their case history dossiers kept confidential.
2. The information referred to in Clause 1 of this Article may be disclosed only when so agreed by patients or for exchange of information and experience between practitioners directly treating the patients to improve the quality of diagnosis, care and treatment of patients or in other cases provided by law.
Article 9. Rights to respect for honor and protection of health in medical examination and treatment
1. To be subject to no discrimination in medical examination and treatment or forced medical examination and treatment, except the cases specified in Clause 1, Article 66 of this Law.
2. To be respected in terms of age, gender, ethnics and belief.
3. To be subject to no discrimination based on their financial and social status.
Article 10. Rights to choice in medical examination and treatment
1. To fully receive information, explanations and counseling about their disease status, results and possible risks to choose diagnosis and treatment methods.
2. To accept or refuse to participate in biomedical research in medical examination and treatment.
3. To nominate representatives to perform and protect their rights and obligations in medical examination and treatment.
Article 11. Rights to obtainment of information on case history dossiers and medical examination and treatment expenses
1. To receive brief information on their case history dossiers when so requested in writing, unless otherwise provided by law.
2. To be provided with information on charges for medical examination and treatment services and detailed explanations about expenses indicated in invoices for medical examination and treatment services.
Article 12. Rights to refusal of medical treatment and discharge from medical examination and treatment establishments
1. To refuse testing, use of drugs and application of treatment techniques or methods, but to make written commitment on personal responsibility for such refusal, except the cases specified in Clause 1. Article 66 of this Law.
2. To leave medical examination and treatment establishments when treatment is not completed, but to make written commitment to take personal responsibility for such leaving, which is contrary to practitioners’ instruction, except the cases specified in Clause 1. Article 66 of this Law.
Article 13. Rights of patients losing civil act capacity, or without civil act capacity or with restricted civil act capacity, or being juveniles aged between full 6 years and under full 18 years
1. Lawful representatives of patients losing civil act capacity, or without civil act capacity or with restricted civil act capacity, or being juveniles aged between full 6 years and under full 18 years may decide on medical examination and treatment for the patients.
2. In cases of emergency, to protect the life and health of a patient, the head of a medical examination and treatment establishment may decide on medical examination and treatment for the patient when his/her lawful representative is absent.
SECTION 2. OBLIGATIONS OF PATIENTS
Article 14. To respect practitioners
To respect and commit no act of harming the honor, dignity, health and life of practitioners and other health workers.
Article 15. To observe regulations on medical examination and treatment
1 To truthfully provide information related to their health status and fully cooperate with practitioners and medical examination and treatment establishments.
2. To follow practitioners' instructions on diagnosis and treatment, except the cases speicified in Article 12 of this Law.
3. To observe and request their relatives to observe rules of medical examination and treatment establishments and the law on medical examination and treatment.
Article 16. To pay medical examination and treatment expenses
To pay medical examination and treatment expenses, except cases of exemption or reduction under law. For insured patients, payment of medical examination and treatment expenses complies with the law on health insurance.
SECTION 1. CONDITIONS ON PRACTITIONERS
Article 17. Applicants for medical practice certificates
1. Doctors, assistant doctors.
2. Nurses.
3. Midwives.
4. Technicians.
5. Herbalists.
6. Owners of family herbal remedies or treatment methods.
Article 18. Conditions for Vietnamese to obtain a medical practice certificate
1. To possess any of the following diplomas and certificates relevant to the form of medical practice:
a/ Professional diplomas in health granted or recognized in Vietnam:
b/ Certificates of herbalists;
c/ Certificates of owners of herbal remedies or treatment methods.
2. To possess a written certification of the practice duration, except for herbalists and owners of herbal remedies or treatment methods.
3. To possess a health certificate for practicing medical examination and treatment.
4. Not to fall into cases of being banned from professional practice or work related to the medical or pharmaceutical profession under court rulings or decisions; being examined for penal liability: serving penal sentences or rulings of courts or administrative sanction decisions on confinement to educational or medical treatment establishments: being disciplined by caution or a higher level related to professional medical examination and treatment; or losing civil act capacity or having civil act capacity restricted.
Article 19. Conditions for foreigners and overseas Vietnamese to obtain a medical practice certificate in Vietnam
1. To meet all the conditions specified in Article 18 of this Law.
2. To meet requirements on language skills in medical examination and treatment specified in Article 23 of this Law.
3. To have judicial history records certified by competent authorities of their own countries
4. To possess a work permit granted by a competent Vietnamese state agency in charge of labor under the labor law.
Article 20. Conditions to re-obtain a medical practice certificate after having such certificate revoked
1. To meet all the conditions specified in Article 18 of this Law. for Vietnamese, or Article 19 of this Law, for foreigners and overseas Vietnamese, except the condition on written certification of the practice duration.
2. To possess a certificate of continued updating of medical knowledge.
Article 21. Humanitarian medical examination and treatment, technical transfer in medical examination and treatment, cooperation in medical training associated with medical examination and treatment practice
1. Domestic and overseas individuals and organizations may request to provide humanitarian medical examination and treatment or technical transfer in medical examination and treatment, or cooperate in medical training associated with medical examination and treatment practice in Vietnam.
2. The Minister of Health shall detail conditions, dossiers and procedures for. and competence to license, medical examination and treatment in the cases specified in Clause 1 of this Article.
Article 22. Recognition of medical practice certificates
The recognition of medical practice certificates between countries complies with international agreements or treaties to which the Socialist Republic of Vietnam is a contracting party.
Article 23. Languages used in medical examination and treatment in Vietnam by foreigners and overseas Vietnamese
1. Foreigners or overseas Vietnamese directly providing medical examination and treatment for Vietnamese must be proficient in Vietnamese. When not proficient in Vietnamese, they shall register the language they will use in medical examination and treatment and have a translator.
2. Instructions on treatment and prescriptions shall be written in Vietnamese. Practitioners who are not proficient in Vietnamese shall make treatment instructions and prescriptions in the language they have registered and have them translated into Vietnamese by translators.
3. Foreigners and overseas Vietnamese directly providing medical examination and treatment for Vietnamese proficient in Vietnamese and translators qualified for translation in medical examination and treatment arc those beinc tested and recognized by professional medical training institutions designated by the Minister of Health.
The Minister of Health shall detail criteria to recognize proficiency in Vietnamese or qualification for translation in medical examination and treatment.
4. Translators shall take responsibility before law for the accuracy of their translation in medical examination and treatment.
Article 24. Certification of the practice duration
1. Before obtaining a medical practice certificate, holders of professional diplomas in health granted or recognized in Vietnam must practice at the following medical examination and treatment establishments for:
a/ 18 months at hospitals or research institutes with patient beds (below referred to as hospitals), for medical doctors:
b/ 12 months at hospitals, for assistant doctors:
c/ 9 months at hospitals with obstetrics wards or obstetrics clinics, for midwives:
d/ 9 months at medical examination and treatment establishments, for nurses and technicians.
2. Heads of medical examination and treatment establishments shall certify in writing the practice duration and professional capacity and ethics for practitioners at their establishments.
Article 25. Medical practice certificates
1. Medical practice certificates shall be granted to those fully meeting the conditions specified in Article 18 or Article 19 of this Law.
2. A medical practice certificate shall be granted once and is valid nationwide.
3. A medical practice certificate contains the following details:
a/ Full name, birth date, address of residence and professional diplomas:
b/ Form of professional practice:
c/ Scope of professional operation.
4. A practitioner who loses his/her medical practice certificate or whose medical practice certificate is damaged may be granted another certificate.
5. The Minister of Health shall promulgate the form of medical practice certificate.
6. The Government shall devise a roadmap to grant medical practice certificates to ensure that by January 1. 2016, those engaged in medical examination and treatment at state medical examination and treatment establishments by the effective date of this Law will possess a medical practice certificate.
SECTION 2. COMPETENCE, DOSSIERS AND PROCEDURES TO GRANT RE-GRANT AND REVOKE MEDICAL PRACTICE CERTIFICATES
Article 26. Competence to grant, re-grant and revoke medical practice certificates
1. The Minister of Health shall grant, re-grant and revoke medical practice certificates for:
a/Those working at medical examination and treatment establishments under the Ministry of Health:
b/Those working at medical examination and treatment establishments under other ministries, except the cases specified in Clauses 2 and 3 of this Article:
c/ Foreigners practicing medical examination and treatment in Vietnam.
2. Directors of provincial-level Health
Departments shall grant, re grant and evok medical practice certificates for those working at medical examination and treatment establishments in localities under their management, except the cases specified in Clauses 1 and 3 of this Article.
3. The Minister of National Defense shall provide the grant, re-grant and revocation of medical practice certificates for those working at medical examination and treatment establishment • under his/her management.
Article 27. Dossiers of application for nev and re-granted medical practice certificates
1. For a Vietnamese applicant, a dossier of application for a new medical practice certificate comprises:
a/ An application for a medical practice certificate:
b/ Copies of diplomas or certificates o professional qualifications:
c/ Written certification of the practice duration:
d/ Health certificate for professional practice issued by an eligible medical examination and treatment establishment under the Health Minister's regulations:
e/ Judicial history card;
f/ A resume certified by the People'1 Committee of a commune, ward or township (below referred to as commune level) where, the applicant resides or by the head of the agency where the applicant works.
2. For a foreign or overseas Vietnamese applicant, a dossier of application for a medical
practice certificate comprises:
a/ An application for a medical practice certificate;
b/ Copies of professional diplomas:
c/ Written certification of the practice duration:
d/ Written certification of Vietnamese proficiency or dossier of the translator under Clause 3. Article 23 of this Law:
e/ Health certificate for professional practice issued by an eligible medical examination and treatment establishment under the Health Minister's regulations:
f/ Judicial history card:
g/ Work permit granted by a competent Vietnamese state agency in charge of labor.
3. Those losing their medical practice certificates, or with damaged ones, or having such certificates revoked under Points a and b. Clause 1, Article 29 of this Law shall only make a written application for a re-granted medical practice certificate.
4. A dossier of application for a medical practice certificate revoked under Points c. d. e. f and g. Clause 1. Article 29 of this Law comprises:
a/ The papers specified in Clause 1 of this Article, for a Vietnamese applicant, or specified in Clause 2 of this Article, for a foreign or overseas Vietnamese applicant, except the written certification of the practice duration;
b/ Certificate of continued updating of medical knowledge.
Article 28. Procedures to grant and re-grant medical practice certificates
1. Dossiers of application for new or re-granted medical practice certificates under Article 27 of this Law shall be submitted to the Ministry of Health or the Ministry of National Defense or provincial-level Health Departments.
2. Within 60 days after receiving a complete dossier, the Minister of Health, the Minister of National Defense, or the director of a provinciallevel Health Department shall grant a medical practice certificate. For cases which require verification for applicants being trained overseas or possessing foreign medical practice certificates, the time limit to grant certificates may be extended up to no more than 180 days. In case of refusal, a written reply shall be issued, clearly stating the reason.
3. Within 30 days after receiving a complete dossier, the Minister of Health, the Minister of National Defense, or the director of a provincial-level Health Department shall re-grant a medical practice certificate. In case of refusal, they shall issue a written reply clearly stating the reason.
4. The Minister of Health shall set up an advisory council which is composed of representatives of the health socio-professional organization, the lawyers association, medical training institutions, medical examination and treatment establishments, the social organization for protection of consumers' rights and some other social organizations to advise the Minister of Health in granting, re-granting and revoking medical practice certificates; suspending professional operation of practitioners; setting criteria to recognize contents and forms of continued updating of medical knowledge and conditions on establishments providing continued updating of medical knowledge; prescribing contents and forms of. and organizing, examinations to make written certification of Vietnamese proficiency and qualification for translation in medical examination and treatment.
Directors of provincial-level Health Departments shall set up advisory councils composed of representatives of the health socio-professional organization, the lawyers association, medical training institutions, medical examination and treatment establishments, the social organization for protection of consumers' rights and some other social organizations to advise directors of provincial-level Health Departments in granting, re-granting and revoking medical practice certificates and suspending professional operation of practitioners.
5. The Minister of National Defense shall provide procedures to grant and re-grant medical practice certificates to those working at medical examination and treatment establishments under his/her management.
Article 29. Revocation of medical practice certificates and suspension of professional practice
1. A medical practice certificate shall be revoked when:
a/ It is granted ultra vires;
b/ It contains contents contrary to law:
c/ The practitioner fails to practice for 2 consecutive years;
d/ The practitioner is confirmed to have committed professional and technical mistakes causing serious consequences to the health or life of patients;
e/ The practitioner fails to update medical knowledge for 2 consecutive years;
f/ The practitioner fails to meet health requirements for professional practice:
g/ The practitioner falls into any of the cases specified in Clause 4. Article 18 of this Law.
2. When detecting any of the cases specified in Clause 1 of this Article, the Minister of Health, the Minister of National Defense, or the director of a provincial-level Health Department shall issue a decision to revoke the medical practice certificate under Article 26 of this Law.
3. When detecting a practitioner committing professional and technical mistakes other than those defined at Point d. Clause I of this Article, depending on the nature and severity of his/her mistakes, the Minister of Health, the Minister of National Defense, or the director of a provincial-level Health Department shall partially or wholly suspend his/her professional practice under law.
4. The Ministry of Health shall provide procedures to revoke medical practice certificates, and procedures for partially or wholly suspending practitioners from professional practice.
5. The Minister of National Defense shall provide procedures to revoke medical practice certificates; procedures for partially or wholly suspending practitioners at medical examination and treatment establishments under his/her management from professional practice and the suspension duration.
Article 30. Fees for new or re-granted medical practice certificates
1. Applicants for new or re-granted medical practice certificates shall pay fees.
2. The Minister of Finance shall set levels of fees for new and re-granted medical practice certificates.
SECTION 3. RIGHTS OF PRACTITIONERS
Article 31. Rights to professional practice
1. To professionally practice within the scope of professional operation indicated in their medical practice certificates.
2. To decide on and take responsibility for diagnosis and treatment methods within the scope of professional operation indicated in their medical practice certificates.
3. To sign contracts with medical examination and treatment establishments to provide medical examination and treatment, but to be in charge of professional and technical operations at only one medical examination and treatment establishment.
4. To join socio-professional organizations.
Article 32. Rights to refusal of medical examination and treatment
1. To refuse to provide medical examination and treatment when, in the course of medical examination and treatment, anticipating that treatment of a disease goes beyond their capacity or is outside the scope of their professional operation, but to report such to a competent person or introduce patients to other medical examination and treatment establishments for treatment. In this case, practitioners shall still provide first aid, supervision, care and treatment for the patients until they arc transferred to other medical examination and treatment establishments.
2. To refuse to provide medical examination and treatment when such examination and treatment is contrary to law or professional ethics.
Article 33. Rights to improvement of professional capacity
1. To receive training, re-training and continued updating of medical knowledge relevant to their professional practice level.
2. To participate in refresher training and sharing information on professional operation and the health law.
Article 34. Rights to protection upon occurrence of incidents to patients
1. To be protected by law and take no responsibility when properly observing professional and technical regulations but incidents still occur.
2. To request agencies, organizations and professional associations to protect their lawful rights and interests upon occurrence of incidents to patients.
Article 35. Rights to assurance of safety during professional practice
1. To be equipped with means of labor protection and sanitation to prevent and mitigate risks for infection and occupational accidents.
2. To have their health, life, honor and body protected.
3. To temporarily leave work places when having their life threatened by others, but then to report such to heads of medical examination and treatment establishments or administrations of nearest localities.
SECTION 4. OBLIGATIONS OF PRACTITIONERS
Article 36. Obligations toward patients
1. To provide timely first aid, emergency aid and medical examination and treatment for patients, except the cases specified in Article 32 of this Law.
2. To respect rights of patients, to be considerate and polite to patients.
3. To give counseling and provide information under Clause 1. Article 7. and Clause 1. Article 11, of this Law.
4. To equally treat patients, not to let personal interests or discrimination affect their professional decisions.
5. To request patients to pay only expenses for medical examination and treatment posted up under law.
Article 37. Professional obligations
1. To observe professional and technical regulations.
2. To take responsibility for their medical examination and treatment.
3. To regularly study and update medical knowledge to improve their professional capacity under the Health Minister's regulations.
4. To be devoted in medical examination and treatment.
5. To keep confidential the health status of patients, information provided by patients and case history dossiers, except the cases specified in Clause 2, Article 8 of this Law.
6. To report on practitioners deceiving patients or colleagues or violating this Law to competent persons.
7. Not to prescribe or instruct the use of medical examination and treatment services for patients or recommend them to move to other medical examination and treatment establishment for self-seeking interests.
Article 38. Obligations toward colleagues
1. To cooperate and respect colleagues in medical examination and treatment.
2. To protect the honor and prestige of colleagues.
Article 39. Obligations toward the society
1. To participate in community health protection and education.
2. To participate in supervising the professional capacity and ethics of other practitioners.
3. To observe assignment decisions of their managing agencies under Clause 2, Article 4 of this Law.
4. To observe mobilization decisions of competent state agencies upon occurrence of natural disasters, catastrophes or dangerous epidemics.
Article 40. Professional ethics obligations
Practitioners are obliged to perform professional ethics obligations under the Health Minister's regulations.
MEDICAL EXAMINATION AND TREATMENT ESTABLISHMENTS
SECTION I. FORMS OF ORGANIZATION AND CONDITIONS ON OPERATION OF MEDICAL EXAMINATION AND TREATMENT ESTABLISHMENTS
Article 41. Organizational forms of medical examination and treatment establishments
1. Organizational forms of medical examina-tion and treatment establishments include:
a/ Hospital:
b/ Medical assessment establishment:
c/ General clinic;
d/ Specialized clinic, family doctor clinic;
e/ Traditional medicine diagnosis and treatment clinic;
f/ Obstetrics clinic:
g/ Diagnosis establishment:
h/ Health service establishment;
i/ Commune-level health center and equivalent;
j/ Other forms of medical examination and treatment.
2. The Government shall detail Clause 1 of this Article and organizational forms of medical examination and treatment establishments of the army.
Article 42. Conditions on operation of medical examination and treatment establishments
1. To have an establishment decision issued by a competent state agency, for medical examination and treatment establishments set up by the State, or a business registration certificate or investment license under law. for other medical examination and treatment establishments.
2. To possess an operation license granted by the Minister of Health, the Minister of National Defense or the director of a provincial-level Health Department.
Article 43. Conditions for a medical examination and treatment establishment to obtain an operation license
1. A medical examination and treatment establishment may obtain an operation license when fully meeting the following conditions:
a/ To meet requirements under national technical regulations on medical examination and treatment establishments promulgated by the Minister of Health:
b/ To have sufficient practitioners relevant to its scope of professional operation;
c/ The person responsible for its professional and technical operations must have provided medical examination and treatment for at least 36 months.
2. When registering to establish a specialized or family doctor clinic, apart from the conditions specified in Clause 1 of this Article, the head of the establishment must be a practitioner with professional diplomas relevant to the form of the establishment's professional operation.
3. The Minister of Health and the Minister of National Defense shall detail conditions to grant operation licenses under this Article for each organizational form of medical examination and treatment establishments under their management.
Article 44. Operation licenses for medical examination and treatment establishments
1. An operation license shall be granted once to a medical examination and treatment establishment fully meeting the conditions specified in Article 43 of this Law.
2. An operation license contains the following details:
a/ Name, organizational form and place of operation of the medical examination and treatment establishment;
b/ Scope of professional operations;
c/ Daily working hours.
3. A medical examination and treatment establishment which changes its scale or scope of professional operations shall carry out procedures to modify its operation license. When changing its organizational form, or being divided, consolidated or merged, or changing its place of operation, it shall carry out procedures to apply for a new operation license.
4. A medical examination and treatment establishment whose operation license is lost, damaged or revoked under Point a. Clause 1, Article 48 of this Law may have the license re-granted.
5. The Minister of Health shall promulgate the form of operation license.
6. The Government shall devise a roadmap to grant operation licenses to ensure that by January I. 2016. all state medical examination and treatment establishments operating at the effective time of this Law possess an operation license.
SECTION 2. COMPETENCE, DOSSIERS AND PROCEDURES TO GRANT, RE-GRANT, MODIFY AND REVOKE OPERATION LICENSES FOR MEDICAL EXAMINATION AND TREATMENT ESTABLISHMENTS
Article 45. Competence to grant, re-grant, modify and revoke operation licenses for medical examination and treatment establishments
1. The Minister of Health shall grant, re-grant, modify and revoke operation licenses for medical examination and treatment establishments under the Ministry of Health, private hospitals or other ministries, except the cases specified in Clauses 2 and 3 of this Article, and notify such to provincial-level People's Committees of localities where such establishments are headquartered within 30 days after granting, modifying or revoking an operation license.
2. Directors of provincial-level Health Departments shall grant, re-grant, modify and revoke operation licenses for medical examination and treatment establishments in their localities, except the cases specified in Clauses 1 and 3 of this Article, and notify such to People's Committees of districts, towns or provincial cities where such establishments are headquartered within 30 days after granting, modifying or revoking an operation license.
3. The Minister of National Defense shall provide the grant, re-grant, modification and revocation of operation licenses for medical examination and treatment establishments under his/her management.
Article 46. Dossiers of application for new, re-granted or modified operation licenses for medical examination and treatment establishments
1. A dossier of application for an operation license comprises:
a/ An application for an operation license;
b/ A copy of the establishment decision issued by a competent state agency, for state medical examination and treatment establishments, or the business registration certificate, for private medical examination and treatment establishments, or the investment certificate, for foreign-invested medical examination and treatment establishments;
c/ Copies of the medical practice certificates of the person responsible for professional and technical operations and the person in charge of the professional section, a list of practitioners with their names, serial numbers of medical practice certificates and scope of professional practice, for hospitals; copies of medical practice certificates of all practitioners, for other medical examination and treatment establishments;
d/ A declaration of physical foundations and medical equipment, a description of the organizational model and personnel records;
e/ Documents proving the medical examination and treatment establishment's satisfaction of the conditions specified in Article 43 of this Law;
f/ For hospitals, apart from the conditions specified at Points a. b. c. d and e of this Clause, the organization and operation charter and the initial operation plan.
2. A dossier of application for a re-granted operation license comprises:
a/ An application for a re-granted operation license;
b/ The original damaged permit (if any).
3. A dossier of application for a modified operation license comprises:
a/ An application for a modified operation license;
b/ A declaration of physical foundations and medical equipment and personnel records corresponding to the scale or scope of professional operations to be adjusted.
Article 47. Procedures to grant, re-grant and modify operation licenses for medical examination and treatment establishments
1. The procedures to grant, re-grant and modify operation licenses for medical examination and treatment establishments are as follows:
a/ Dossiers of application for new. re-granted or modified operation licenses under Article 46 of this Law shall be submitted to the Ministry of Health, the Ministry of National Defense or provincial-level Health Departments;
b/ Within 90 days after receiving a complete dossier, the Minister of Health, or the Minister of National Defense, or the director of a provincial-level Health Department shall grant or modify an operation license. In case of refusal, they shall issue a written reply clearly stating the reason;
c/ With 30 days after receiving a complete dossier, the Minister of Health, the Minister of National Defense, or the director of a provincial-level Health Department shall re-grant an operation license. In case of refusal, they shall issue a written reply clearly stating the reason.
2. The Minister of Health shall prescribe the organization, persons and procedures for appraisal to grant and modify operation licenses.
3. The Minister of National Defense shall prescribe the organization, persons and procedures for appraisal to grant and modify operation licenses for medical examination and treatment establishments under his/her management.
Article 48. Revocation of operation licenses and suspension from operation of medical examination and treatment establishments
1. An operation license shall be revoked when:
a/ It is granted ultra vires:
b/ The medical examination and treatment establishment fails to meet the conditions specified in Article 43 of this Law;
c/ The medical examination and treatment establishment fails to operate 12 months after obtaining an operation license;
d/ The medical examination and treatment establishment suspends its operation for 12 consecutive months or terminates its operation.
2. When detecting any of the cases specified in Clause 1 of this Article, the Minister of Health, the Minister of National Defense, or the director of a provincial-level Health Department shall issue a decision to revoke the operation license under Article 45 of this Law.
3. When detecting a medical examination and treatment establishment committing professional mistakes or failing to meet any of the conditions specified in Article 43 of this Law. depending on the nature and severity of its mistakes, the Minister of Health, the Minister of National Defense, or the director of a provincial-level Health Department shall partially or wholly suspend professional operations of the medical examination and treatment establishment.
4. The Minister of Health shall prescribe the procedures to revoke operation licenses; and procedures and lime to partially or wholly suspend professional operations of medical examination and treatment establishments.
5. The Minister of National Defense shall prescribe the procedures to revoke operation licenses; and procedures to partially or wholly suspend professional operations of medical examination and treatment establishments under his/her management.
Article 49. Fees for grant, re-grant and modification of operation licenses for medical examination and treatment establishments
1. A medical examination and treatment establishment applying for a new. re-granted or modified operation license shall pay a fee.
2. The Minister of Finance shall set the levels of fees for new. re-granted and modified operation licenses.
SECTION 3. CERTIFICATION OF QUALITY IMPROVEMENT FOR MEDICAL EXAMINATION AND TREATMENT ESTABLISHMENTS
Article 50. Certification of quality for medical examination and treatment establishments
1. Quality control standards for medical examination and treatment establishments are requirements on technical and managerial specifications used as the standards to classify and evaluate the quality of medical examination and treatment establishments promulgated by domestic or foreign organizations and recognized by competent Vietnamese state agencies.
2. Licensed medical examination and treatment establishments are encouraged to apply the quality control standards defined in Clause 1 of this Article to improve their medical examination and treatment quality.
3. The quality of medical examination and treatment establishments shall be certified by organizations fully meeting the conditions specified in Article 51 of this Law on the basis of evaluating the actual quality of medical examination and treatment establishments against quality control standards.
Article 51. Organizations certifying the quality of medical examination and treatment establishments
1. Organizations certifying the quality of medical examination and treatment establishments are those established by agencies, organizations or individuals and independent from medical examination and treatment establishments.
2. When certifying the quality of a medical examination and treatment establishment, a quality certification organization shall adhere to the principles of independence, objectivity, honesty, publicity and transparency and take responsibility before law for its certification results.
3. The Government shall detail the establishment, organization and operation of organizations certifying the quality of medical examination and treatment establishments.
SECTION 4. RIGHTS AND RESPONSIBILITIES OF MEDICAL EXAMINATION AND TREATMENT ESTABLISHMENTS
Article 52. Rights of a medical examination and treatment establishment
1. To provide medical examination and treatment under this Law; eligible medical examination and treatment establishments under the Minister of Health's regulations may provide regular medical check-up and medical examination for study and working purposes and take responsibility before law for its medical examination results.
2. To refuse to provide medical examination and treatment when, in the course of medical examination and treatment, anticipating that treatment of a disease goes beyond its capacity or is contrary to the scope of professional operations under its operation license, but to introduce the patient to another medical examination and treatment establishment for treatment. In this case, it shall still give first or emergency aid to, supervise, care for and treat the patient until he/ she is transferred to another medical examination and treatment establishment.
3. To collect charges for medical examination and treatment under law.
4. To enjoy incentives when providing medical examination and treatment under law.
Article 53. Responsibilities of a medical examination and treatment establishment
1. To promptly give first aid to and provide medical examination and treatment for patients.
2. To observe professional and technical regulations and other relevant laws.
3. To publicize working hours, post up service charges and collect charges as posted up.
4. To report to the operation license-granting agency when changing the person responsible for its professional and technical operations or foreign practitioners under the Minister of Health's regulations.
5. To guarantee the rights and obligations of patients and practitioners under this Law.
6. To ensure necessary conditions for practitioners to provide medical examination and treatment within their licensed scope of professional practice.
7. To observe mobilization decisions of competent state agencies upon occurrence of natural disasters, catastrophes or dangerous epidemics.
8. When terminating its operation, to transfer patients and their case history dossiers to appropriate medical examination and treatment establishments and settle medical examination and treatment expenses for patients.
PROFESSIONAL AND TECHNICAL REGULATIONS IN MEDICAL EXAMINATION AND TREATMENT
Article 54. First aid 1. First aid includes:
a/ First aid at medical examination and treatment establishments;
b/ First aid outside medical examination and treatment establishments.
2. When giving first aid goes beyond the professional capacity of a medical examination and treatment establishment, depending on specific cases, the establishment shall carry out one or some of the following activities:
a/ Holding a consultation under Article 56 of this Law;
b/ Inviting another medical examination and treatment establishment to support first aid;
c/ Transferring the patient to an appropriate medical examination and treatment establishment.
3. Heads of medical examination and treatment establishments shall prioritize best conditions in terms of human resources and equipment to give first aid to patients.
Article 55. Diagnosis, instruction on treatment methods and prescription
1. Diagnosis, instruction on treatment methods and prescription must adhere to the following principles:
a/ To be based on results of clinical examination and paraclinical examination in combination with disease history and family, occupational and epidemiologic elements:
b/ To be timely, objective, prudent and scientific.
2. A practitioner assigned to provide medical examination and treatment shall:
a/ Give medical examination and diagnosis, instruct treatment methods and make prescription promptly and accurately and take responsibility for his/her medical examination, diagnosis, treatment methods and prescription;
b/ Decide on inpatient or outpatient treatment; introduce patients in need of inpatient treatment to appropriate medical examination and treatment establishments when his/her medical examination and treatment establishment has no patient beds.
1. A consultation shall be held when treatment of a disease goes beyond the diagnosis and treatment capacity of practitioners or a medical examination and treatment establishment or treatment of a disease experiences worse developments or no progress.
2. Consultation includes:
a/ Consultation within a ward;
b/ Consultation involving different wards:
c/ Consultation involving different medical examination and treatment establishments;
d/ Consultation of experts* opinions;
e/ Distance consultation with information technology;
f/ Other consultations under the Minister of Health's regulations.
Article 57. Outpatient treatment
1. Outpatient treatment is given when:
a/ Inpatient treatment is not required for patients;
b/ Patients need further treatment and supervision after having received inpatient treatment and left medical examination and treatment establishments.
2. After deciding on outpatient treatment for a patient, a practitioner shall:
a/ Make an outpatient case history dossier under Article 59 of this Law;
b/ Record on the medical report book, specifying personal information of the patient, diagnosis, treatment instructions, prescription and lime for re-examination.
Article 58. Inpatient treatment
1. Administrative procedures related to hospitalization, transfer to another medical examination and treatment establishment or ward and discharge from a medical examination and treatment establishment shall be carried out promptly without troubling patients.
2. Inpatient treatment shall be given when:
a/ It is instructed by a practitioner of the medical examination and treatment establishment:
b/ The patient is transferred to the medical examination and treatment establishment from another under a patient transfer notice.
3. Inpatient treatment procedures are as follows:
a/ Admitting the patient to the medical examination and treatment establishment.
For a patient suffering different diseases, the head of the medical examination and treatment establishment shall consider and decide on the ward where the patient will be treated.
b/ Guiding the patient to the ward where he/ she will be treated.
4. A patient shall be transferred from a ward to another when he/she suffers a disease which does not fall into the scope of professional operations of the ward currently treating him/ her or a disease mostly related to another specialty.
5. Cases to be transferred to other medical examination and treatment establishments:
a/ The capacity and physical foundations of a medical examination and treatment establishment are not eligible for treatment of a disease.
b/ Treatment of a disease is not relevant to the professional and technical operations of a medical examination and treatment establishment as classified by the Minister of Health:
c/ The patient requests the transfer.
6. Procedures for transfer to another ward or medical examination and treatment establish-ment are as follows:
a/ Completing the patient's case history dossier and summarizing the entire treatment process:
b/ Transferring the patient's case history dossier to the new ward, for transfer to another ward; sending a transfer notice enclosed with a brief summary of the case history to the new medical examination and treatment establishment, for transfer to another medical examination and treatment establishment.
7. When the patient's health conditions are stable or the patient requests discharge from the medical examination and treatment establishment with a written commitment made by the patient or his/her representative after being counseled by a practitioner, the medical examination and treatment establishment shall:
a/ Complete the patient's case history dossier and summarize the entire treatment process;
b/ Provide healthcare guidance for the patient:
c/ Decide on outpatient treatment, when necessary;
d/ Settle medical examination and treatment expenses under Article 16 of this Law;
e/ Issue a notice of discharge from the medical examination and treatment establishment for the patient.
Article 59. Case history dossiers
1. Case history dossier is a medical, health and legal record. Each patient has only one case history dossier at each time of medical examination and treatment at a medical examination and treatment establishment.
2. Case history dossiers shall be made as follows:
a/ Case history dossiers shall be made for all patients receiving inpatient or outpatient treatment at medical examination and treatment establishments;
b/ Case history dossiers shall be made in hard or soft copies with all items filled in clearly and fully;
c/ A case history dossier comprises documents and information on the patient and the medical examination and treatment process.
3. Case history dossiers shall be preserved as follows:
a/ Case history dossiers shall be preserved according to the levels of confidentiality under the law on protection of state secrets;
b/ Case history dossiers of inpatients and outpatients shall be preserved for at least 10 years; case history dossiers of victims of labor and daily-life accidents shall be preserved for at least 15 years: case history dossiers of mental and dead patients shall be preserved for at least 20 years;
c/ Medical examination and treatment establishments that preserve case history dossiers electronically shall have backup copies and comply with Points a and b of this Clause.
4. The head of a medical examination and treatment establishment shall permit the use of case history dossiers in the following cases:
a/ Trainee students, researchers and practitioners of medical examination and treatment establishments borrowing case history dossiers for on-the-spot reading or for copying for research or professional purposes;
b/ Representatives of health state management agencies that directly manage medical examination and treatment establishments, investigative agencies, procuracies, courts, health inspectors, insurance agencies, forensic and mental forensic examination organizations and lawyers borrowing case history dossiers for on-the-spot-reading or for copying for performance of their assigned tasks according to their vested powers:
c/ Patients or their representatives receiving brief summaries of case history dossiers under Clause 1. Article 11 of this Law.
5. When using information of case history dossiers, the users specified in Clause 4 of this Article shall keep it confidential and may use it only for the purposes reported to heads of medical examination and treatment establishments.
Article 60. Use of drugs at medical examination and treatment establishments with inpatient treatment
1. The use of drugs at medical examination and treatment establishments providing inpatient treatment must adhere to the following principles:
a/ To use drugs only when actually necessary and properly, safely, reasonably and effectively:
b/ To prescribe drugs properly according to diagnosis and illness of patients;
c/ To use drugs in compliance with regulations on drug storage, distribution and use.
2. When making a prescription, a practitioner shall fully and clearly write in the prescription or case history names of drugs, their contents, dosage, methods of administration and use times.
3. When distributing drugs to patients, the assigned distributor shall:
a/ Check the prescription, drug receipt slip, contents, dosage, methods of administration, names and quality of drugs;
b/ Compare the prescription with information on concentrations, contents and quantities when receiving drugs and expiry dates of drugs indicated in drug receipt slips and on drug labels:
c/ Check the patient's full name and the names, forms, contents, dosage, methods of administration and use times of drugs before letting the patient use drugs:
d/ Fully record times of distributing drugs to the patient, monitor and record clinical developments of the patient in the case history dossier and promptly detect and report incidents to the practitioner directly providing treatment.
4. Aftet the patient uses drugs. the practitioner directly providing treatment shall monitor effects and promptly handle incidents caused by drug use.
A patient shall use drugs in strict accordance with the practitioner's instructions and report to the latter on abnormal signs after using drugs.
Article 61. Surgery, surgical interference
1. All surgeries and surgical interference aie subject to consent of patients or their representatives, except the cases under Clause 3 of this Article.
2. Surgery or surgical interference for patients being those specified in Clause 1. Article 13 of this Law is subject to prior written consent of their representatives.
3. When it is impossible to consult a patient or his/her representative and the patient's life is directly threatened without surgery or surgical interference, the head of a medical examination and treatment establishment shall decide on such surgery or surgical interference.
Article 62. Control of bacterial contamination at medical examination and treatment establishments
1. Measures to control bacterial contamination at medical examination and treatment establishments include:
a/ Sterilization of medical equipment and the environment and treatment of waste at medical examination and treatment establishments:
b/ Personal protection and hygiene:
c/ Food hygiene and safety:
d/ Supervision of bacterial contamination:
e/ Other measures to control bacterial contamination under law.
2. A medical examination and treatment establishment shall:
a/ Take measures to control bacterial contamination at its establishment:
b/ Guarantee physical foundations, equipment, protective clothing, personal hygiene conditions for those working at its establishment, patients and visitors of the establishment in conformity with requirements on bacterial contamination control at medical examination and treatment establishments:
c/ Counsel patients and their relatives on measures to control bacterial contamination:
d/ Take other measures to control bacterial contamination under law.
3. Those working at medical examination and treatment establishments, patients and visitors of medical examination and treatment establishments shall observe medical examination and treatment establishments" regulations on bacterial contamination control.
Article 63. Treatment of medical waste
1. Medical waste includes solid, liquid, gas. chemical and radioactive waste discharged in the course of medical examination, diagnosis, treatment and care for patients and their daily-life activities at medical examination and treatment establishments.
2. Medical examination and treatment establishments shall sort, collect and treat medical waste under the law on environmental protection.
Article 64. Handling of an abandoned patient
1. To receive and provide medical examination and treatment for him/her under this Law.
2. To check, make a record of, and keep his/ her personal articles.
3. To immediately notify such to the police office or the commune-level People's Committee of the locality where the medical examination and treatment establishment is based, which shall issue a notice of search for relatives of the patient in the mass media.
4. For an abandoned infant, to notify a social security establishment for admission if nobody receives the child after he/she is treated.
5. For a mental patient, to transfer him/her to a psychiatry establishment if the medical examination and treatment establishment has no psychiatry ward. The psychiatry establishment shall receive, care and treat the patient and notify a social security establishment for admission if nobody receives the patient after he/she is treated.
Social security establishments shall receive those specified in Clauses 4 and 5 of this Article within 10 days after receiving a notice.
6. For an abandoned dead patient, after performing the obligations under Article 65 of this Law. a medical examination and treatment establishment shall take photos and keep tissues of the patient to identify him/her. carry out death declaration procedures under the law on civil status and hold his/her funeral.
Article 65. Handling of a dead patient
1. A medical examination and treatment establishment shall:
a/ Issue a death certificate;
b/ Hold a critical discussion within 15 days after the patient's death;
c/ Assign the practitioner directly treating the patient or on duty to compile a death dossier which specifies disease developments, treatment methods, time of and cause of the death;
d/ Preserve the death dossier under Clause 3. Article 59 of this Law.
2. For a patient who dies before being admitted to a medical examination and treatment establishment, the medical examination and treatment establishment shall:
a/ Notify the patient's relatives for holding his/her funeral, for a patient with personal identification papers;
b/ Publish a notice in the mass media to look for the patient's relatives, for a patient without personal identification papers.
For a patient without personal identification papers or a patient with personal identification papers whom nobody receives, the medical examination and treatment establishment shall preserve his/her body, take photos and notify the police office or the commune-level People's Committee of the locality where the medical examination and treatment establishment is based.
When nobody receives the dead, the medical examination and treatment establishment shall contact the commune-level People's Committee or the local agency in charge of labor, war invalids and social affairs, which shall hold his/her funeral.
3. Determination of a patient's death and the duration to preserve his/her body comply with law.
Article 66. Compulsory medical treatment
1. Cases subject to compulsory medical treatment under this Law include:
a/ Suffering a group-A infectious disease under the law on prevention and control of infectious diseases:
b/ Suffering a mental disease in a state of loss of self-control or depression which gives rise to the idea or act of committing suicide or causing danger to others under law.
2. Compulsory medical treatment under the penal law and the law on administrative sanctioning falls outside the scope of regulation of this Law.
Article 67. On-standby medical examination and treatment
1. Medical examination and treatment establishments with inpatient treatment and first-aid establishments shall provide on-standby medical examination and treatment outside working hours and on holidays.
Medical examination and treatment establishments with inpatient treatment are encouraged to provide 24-hour medical examination and treatment.
2. On-standby medical examination and treatment at a medical examination and treatment establishment includes leaders on standby, clinical standby, paraclinical standby, logistic-standby and guards on standby.
3. The head of a medical examination and treatment establishment shall:
a/ Assign persons on standby, specifically define responsibilities of each level and persons on standby and on-standby regimes:
b/ Ensure sufficient means of transport for first-aid suited to the form of medical examination and treatment; medical equipment and devices and essential drugs to promptly give first aid to patients;
c/ Ensure reporting by each on-standby shift.
Article 68. Combination of traditional medicine with western medicine in medical examination and treatment
1. The combination of traditional medicine with western medicine is encouraged at medical examination and treatment establishments.
2. Traditional medicine shall be combined with western medicine at traditional medicine hospitals as follows:
a/ Using some technical equipment of western medicine for diagnosis and evaluation of treatment results and successive research results:
b/ Using some equipment and drugs of western medicine to give lirst aid to patients, using some essential drugs to treat patients.
3. Traditional medicine shall be combined with western medicine at other hospitals as follows:
a/Combining methods of traditional medicine in medical examination and treatment:
b/ Using technical equipment of western medicine for diagnosis, application and evaluation of results of herbal remedies and medicaments and treatment methods of traditional medicine.
4. The Minister of Health shall detail Clauses 2 and 3 of this Article and prescribe the combination of traditional medicine with western medicine in medical examination and treatment at other medical examination and treatment establishments.
APPLICATION OF NEW TECHNIQUES AND METHODS TO MEDICAL EXAMINATION AND TREATMENT
Article 69. New techniques and methods in medical examination and treatment
New techniques and methods in medical examination and treatment include:
1. Techniques and methods which arc studied in Vietnam or overseas, recognized In competent Vietnamese state agencies and applied in Vietnam for the first time:
2. Techniques and methods which have been licensed for application by overseas competent state agencies but are applied in Vietnam for the first time:
3. Techniques and methods which have been licensed by competent state agencies and applied in Vietnam, but are applied for the lirst time at a medical examination and treatment establishment.
Article 70. Conditions on application of new techniques and methods to medical examination and treatment in Vietnam
1. To fully meet the conditions on human resources, physical foundations and equipment to apply new techniques and methods.
2. To be licensed for application by the Minister of Health or the Director of a provincial-level Health Department.
Article 71. Competence to license application of new techniques and methods
1. The Minister of Health shall evaluate and license a medical examination and treatment establishment to apply for the first time new techniques and methods specified in Clauses 1 and 2. Article 69 of this Law.
2. The Director of a provincial-level Health Department shall evaluate and license a medical examination and treatment establishment under his/her management to apply for the first time new techniques and methods specified in Clause 3. Article 69 of this Law according to the Ministry of Health's classification of professional and technical operations.
Article 72. Dossiers and procedures for licensing medical examination and treatment establishments to apply new techniques and methods
1. A dossier of request to apply a new technique or method comprises:
a/ An application for application of a new technique or method;
b/ Documents evidencing the legality, clinical proofs and effects of the new technique or method in medical examination and treatment, for the case specified in Clause 2, Article 69 of this Law;
c/ A plan to apply the new technique or method, which describes the medical examination and treatment establishment's capacity in terms of physical foundations, human resources and equipment, economic efficiency of the technique or method, the technical process to be applied and the implementation scheme;
d/ Copies of professional diplomas and certificates of practitioners related to the new technique or method;
e/ The contract signed with the domestic or foreign agency, organization or individual transferring the new technique or method.
2. Procedures to license the application of a new technique or method are as follows:
a/ A medical examination and treatment establishment shall submit a dossier of request to apply a new technique or method under Clause 1 of this Article to the Ministry of Health or a provincial-level Health Department:
b/ Within 10 working days after receiving a complete dossier, the Minister of Health or the provincial-level Health Department director shall appraise the dossier and issue a document allowing the medical examination and treatment establishment to test the new technique or method on a pilot basis. In case of refusal, he/she shall issue a written reply clearly stating the reason:
c/ The medical examination and treatment establishment shall apply the new technique or method on a pilot scale as licensed by the Minister of Health or the provincial-level Health Department director:
d/ After completing the pilot application, the medical examination and treatment establishment shall submit a report on application results and a complete technical process to the Ministry of Health or the provincial-level Health Department for appraisal:
e/ Within 20 days after receiving such report and technical process, the Minister of Health or the provincial-level Health Department director shall set up a professional council to appraise pilot application results and the technical process proposed by the medical examination and treatment establishment for advice to the Minister of Health or the provincial-level Health Department director for consideration and licensing;
f/ Within 5 working days after receiving an advisory report of the professional council, the Minister of Health or the provincial-level Health Department director shall issue a decision allowing the medical examination and treatment establishment to apply the new technique or method and approving the technical process. Technical processes with the same equipment and implementation steps shall be applied nationwide while those with different equipment and implementation steps shall be approved on a case-by-case basis. When disallowing such application, he/she shall issue a written reply clearly stating the reason.
3. The Minister of Health shall detail conditions and procedures to license the application of new techniques and methods in medical examination and treatment.
PROFESSIONAL AND TECHNICAL MISTAKES, SETTLEMENT OF COMPLAINTS. DENUNCIATIONS AND DISPUTES IN MEDICAL EXAMINATION AND TREATMENT
SECTION I. PROFESSIONAL AND TECHNICAL MISTAKES IN MEDICAL EXAMINATION AND TREATMENT
Article 73. Determination of practitioners with or without professional and technical mistakes
1. A practitioner makes professional and technical mistakes when he/she is determined by a professional council under Articles 74 and 75 of this Law to commit any of the following acts:
a/ Violating regulations on responsibilities for care for and treatment of patients:
b/ Violating professional and technical regulations and professional ethics:
c/ Infringing upon the rights of patients.
2. A practitioner makes no professional and technical mistakes when he/she is determined by a professional council under Articles 74 and 75 of this Law to fall into either of the following cases:
a/Having observed professional and technical regulations in medical examination and treatment but incidents still occur to patients:
b/ Cases of emergency in which incidents occur to patients due to an unsolvable lack of technical means and equipment and practitioners under law or the unavailability of professional regulations on a disease: and other force majeure cases resulting in such incidents.
Article 74. Establishment of professional councils
1. When there is a request for settlement of a dispute over medical examination and treatment upon occurrence of an incident to a patient, a professional council shall be set up to determine whether or not professional and technical mistakes are made.
2. A professional council shall be set up as follows:
a/ Within 5 working days after receiving a request to settle a dispute, the head of a medical examination and treatment establishment shall set up or propose the competent health state agency directly managing that medical examination and treatment establishment to set up a professional council.
Within 10 working days after receiving a request from a medical examination and treatment establishment, the competent health state agency directly managing the medical examination and treatment establishment shall set up a professional council:
b/ When involved parties disagree with conclusions made by the professional council under Point a of this Clause, they may request the Ministry of Health to set up a professional council.
Within 20 days after receiving such request, the Ministry of Health shall set up a professional council.
3. Within 30 days after being set up. a professional council shall meet and invite parties involved in the dispute to some of its meetings and the final meeting.
4. For a case related to an incident in medical examination and treatment which is settled according to procedural formalities, procedure-conducting agencies may request a competent health state agency to set up a professional council to determine whether or not professional and technical mistakes are made.
Article 75.Composition, operation principles and tasks of a professional council
1. A professional council comprises:
a/ Experts in relevant specialties;
b/ Experts in other specialties related to incidents in medical examination and treatment:
c/ Legal experts or lawyers.
2. A professional council operates on the principle of collective discussion, decision making by votes of majority and taking responsibility before law for its conclusions.
3. A professional council shall, pursuant to Article 73 of this Law. determine whether or not professional and technical mistakes are made.
4. Conclusions of a professional council serve as a basis for dispute settlement or for procedure-conducting agencies to consider and decide on settlement of the case: and for competent health state agencies and heads of medical examination and treatment establishments to handle practitioners according to their competence.
5. Conclusions of a professional council set up by the Ministry of Health under Point b. Clause 2. Article 74 of this Law are final conclusions on whether or not professional and technical mistakes arc made.
Article 76. Responsibilities of practitioners and medical examination and treatment establishments upon occurrence of incidents in medical examination and treatment
1. When occurs an incident to a patient as a result of professional and technical mistakes or in the case specified at Point b. Clause 2. Article 73 of this Law. the insurer from which the medical examination and treatment establishment buys insurance shall pay damages to the patient under the insurance contract signed with that medical examination and treatment establishment.
A medical examination and treatment establishment which fails to buy insurance under Clause 1. Article 78 of this Law shall itself pa; damages to the patient under law.
2. Apart from paying damages under Clause I of this Article, a medical examination and treatment establishment and a practitioner making professional and technical mistake-resulting in an incident to a patient shall take other legal responsibilities under law.
3. When occurs an incident in medical examination and treatment under Point a. Clause 2. Article 73 of this Law. medical examination and treatment establishments and practitioners are not required to pay damages.
Article 77. Determination of amounts of damages for professional and technical mistakes causing incidents in medical examination and treatment
Amounts of damages in the cases specified in Clause I, Article 76 of this Law shall be determined under law.
Article 78. Insurance for liability in medical examination and treatment
1. Medical examination and treatment establishments and practitioners shall buy insurance for liability in medical examination and treatment under the Government's regulations from insurers established and operating in Vietnam.
2. The Government shall detail insurance for liability in medical examination and treatment and a roadmap to ensure that all practitioners and medical examination and treatment establishments buy insurance for liability in medical examination and treatment.
SECLION 2. COMPLAINTS AND DENUNCIATIONS ABOUT AND SETTLEMENT OF DISPUTES OVER MEDICAL EXAMINATION AND TREATMENT
Article 79. Complaints and denunciations about medical examination and treatment
Complaints about administrative decisions on and administrative acts in medical examination and treatment and their settlement: and denunciations about violations of the law on medical examination and treatment and their settlement comply with the law on complaints and denunciations.
Article 80. Disputes over medical examination and treatment
1. Disputes over medical examination and treatment are disputes related to the rights, obligations and responsibilities in medical examination and treatment between the following parties:
a/ Patients or their representatives:
b/ Practitioners:
c/ Medical examination and treatment establishments.
2. A dispute over medical examination and treatment shall be settled as follows:
a/ Involved parties shall conciliate the dispute themselves;
b/ When conciliation fails, involved parties may initiate a lawsuit at a court under law.
3. The statute of limitations for requesting settlement of a dispute over medical examination and treatment is 5 years after the occurrence of a case.
CONDITIONS TO ASSURE MEDICAL EXAMINATION AND TREATMENT
Article 81. Organizational system of medical examination and treatment establishments
1. The system of medical examination and treatment establishments consists of slate, private and other medical examination and treatment establishments.
2. The system of state medical examination and treatment establishments has 4 levels as follows:
a/ Central level;
b/ Level of provinces and centrally run cities; cl Level of districts, towns and provincial cities; d/ Level of communes, wards and townships.
3. Medical examination and treatment establishments of higher level shall provide professional and technical guidance and assistance for medical examination and treatment establishments of lower level.
4. The Minister of Health shall detail the professional and technical classification for medical examination and treatment establishments of each level specified in Clauses 2 and 3 of this Article.
Article 82. Planning on the system of medical examination and treatment establishments
1. Planning on the system of medical examination and treatment establishments must meet the following requirements:
a/To effectively exploit and use all domestic potential and resources to build and develop the system of medical examination and treatment establishments; to assure increasingly advanced and modern physical foundations and equipment to improve the quality of medical examination and treatment services:
b/To ensure balance, uniformity, reasonable sizes and appropriate locations of medical examination and treatment establishments to facilitate public access to medical examination and treatment services;
c/ To be in line with the national socio-economic development plan.
2. Planning on the system of medical examination and treatment establishments is based on:
a/ Needs for medical examination and treatment, structure of diseases:
b/ Administrative boundaries, residential areas and population size;
c/ Socio-economic development plans.
3. Planning on the system of medical exami-nation and treatment establishments covers:
a/ Objectives, tasks, key programs and projects;
b/ Organizational system of medical examination and treatment establishments:
c/ Resources and solutions for and conditions to guarantee implementation.
4. Competence to approve planning on the system of medical examination and treatment establishments is as follows:
a/ The Prime Minister may approve the national master plan on the system of medical examination and treatment establishments at the proposal of the Minister of Health and the Minister of National Defense:
b/ The Minister of Health may approve the master plan on the system of specialized medical examination and treatment establishments:
c/ Chairpersons of provincial-level People’s Committees may approve local master plans on medical examination and treatment establishments at the proposal of directors of provincial-level Health Departments.
Article 83. Practitioner training and retraining
1. The Slate shall adopt master plans and plans to provide professional and technical and ethic training, retraining and refresher training for practitioners, combining traditional medicine with western medicine.
2. The State exempts training fees for trainees in disease surgery, forensic examination and mental forensic examination.
Article 84. Treatment regimes for practitioners
1. Practitioners suffering occupational diseases and diseases caused by occupational accidents are entitled to treatment regimes under the Prime Mister's regulations.
2. In the course of professional practice-practitioners who bravely save patients and thereby die or arc injured may be recognized as fallen heroes or war invalids and enjoy policies for war invalids under the law on preferential treatment for people making contributions to the revolution.
Article 85. Financial sources for medical examination and treatment
1. State budget, for state medical examination and treatment establishments.
2. Collected charges for medical examination and treatment services.
3. Other funds under law.
Article 86. State budget for healthcare work
1. To prioritize budget to meet people’s basic needs for medical examination and treatment services; to step by step transform from state direct investment in medical examination and treatment establishments to support for people through health insurance.
2. Suite budget funds for medical examination and treatment shall be allocated openly and transparently: based on population size, structure of diseases and socio-economic development conditions of each region: and reflecting the State’s policies to prioritize medical examination and treatment in ethnic minority areas, and areas meeting with socio-economic difficulties and extreme socio-economic difficulties, and medical examination and treatment for social diseases and dangerous epidemics.
Article 87. Socialization of medical examination and treatment
1. The Stale shall play the key role in developing the system of medical examination and treatment establishments. State medical examination and treatment establishments shall operate for non-profit purposes.
2. The Slate shall diversify forms of medical examination and treatment services; encourage, mobilize and create conditions for organizations and individuals to build medical examination and treatment establishments: and encourage private medical examination and treatment establishments to operate for non-profit purposes.
3. All organizations, families and citizens shall take care of themselves, early detect diseases for members of their organizations and families and themselves: participate in first aid. support the remedy of accidents and injuries occurred in the community and participate in medical examination and treatment activities when being mobilized by competent authorities.
4. The State shall appropriately commend and reward organizations and individuals building medical examination and treatment establishments for non-profit purposes and making contributions and giving donations to and supporting the development of medical examination and treatment.
Article 88. Charges for medical examination and treatment services
1. The charge for a medical examination and treatment service is the amount payable to that service.
2. The Government shall provide mechanisms to collect, manage and use revenues from medical examination and treatment services at state medical examination and treatment establishments.
3.The Minister of finance shall coordinate with the Minister of Health in providing the bracket of charges for m edical examination and treatment services: charges for medical examination and treatment services for foreigners and overseas Vietnamese at state medical examination and treatment establishments.
4. On the basis of the charge bracket under Clause 3 of this Article, (he Minister of Health shall set charge rates for medical examination and treatment services at medical examination and treatment establishments under the Ministry of Health and other ministries. Provincial-level People's Councils shall set charge rates for medical examination and treatment services for state medical examination and treatment establishments under the management of their localities at the proposal of provincial-level People's Committees.
5. Private medical examination and treatment establishments may set and shall publicly post up charge rates for their medical examination and treatment services.
Article 89. Funds for medical examination and treatment support
I. A fund for medical examination and treatment support is a social and charitable fund established and operating to support those meeting with difficulties or unable to pay medical examination and treatment expenses in paying such expenses and for other activities serving medical examination and treatment.
2. A fund is formed from voluntary contributions and donations of domestic and foreign organizations and individuals. The formation, organization, operation and management of funds for medical examination and treatment support comply with law.
This Law takes effect on January 1, 2011.
Ordinance No. 07/2003/PL-UBTVQH11 on Private Medical and Pharmaceutical Practice ceases to be effective on the effective date of this Law.
Article 91. Implementation detailing and guidance
The Government shall detail and guide the Law's articles and clauses assigned to it; and guide other necessary contents of this Law to meet state management requirements.
This Law was passed on November 23, 2009, by the XIIth National Assembly of the Socialist Republic of Vietnam at its 6,th session.
