Điều 43. Trách nhiệm giám sát chương trình đầu tư công
1. Chủ chương trình, chủ dự án thành phần thực hiện theo dõi, kiểm tra quá trình đầu tư chương trình đầu tư công theo nội dung và các chỉ tiêu được phê duyệt nhằm bảo đảm mục tiêu và hiệu quả đầu tư.
2. Cơ quan chủ quản, người có thẩm quyền quyết định đầu tư chương trình thực hiện theo dõi, kiểm tra chương trình thuộc phạm vi quản lý. Việc kiểm tra được thực hiện như sau:
a) Kiểm tra ít nhất một lần đối với chương trình có thời gian thực hiện trên 12 tháng;
b) Kiểm tra khi điều chỉnh chương trình làm thay đổi địa điểm, mục tiêu, quy mô, tăng tổng mức đầu tư.
3. Cơ quan quản lý nhà nước về đầu tư công thực hiện theo dõi, kiểm tra chương trình thuộc phạm vi quản lý.
4. Cơ quan quản lý nhà nước về đầu tư công, cơ quan chủ quản và người có thẩm quyền quyết định đầu tư chương trình quyết định tổ chức kiểm tra chương trình theo kế hoạch hoặc đột xuất.
Điều 44. Nội dung giám sát của chủ chương trìnhChủ chương trình tự tổ chức thực hiện theo dõi, kiểm tra toàn bộ quá trình thực hiện chương trình và báo cáo nội dung sau:
1. Việc quản lý thực hiện chương trình: Lập kế hoạch tổng thể và kế hoạch chi tiết triển khai chương trình; thực hiện và điều chỉnh kế hoạch triển khai chương trình.
2. Tình hình thực hiện chương trình: Tiến độ thực hiện các mục tiêu của chương trình; tổng hợp tình hình thực hiện dự án thành phần thuộc chương trình; giá trị khối lượng thực hiện.
3. Tình hình thực hiện kế hoạch vốn đầu tư: Việc huy động vốn cho chương trình; giải ngân; nợ đọng vốn xây dựng cơ bản (nếu có).
4. Năng lực tổ chức thực hiện dự án thành phần thuộc chương trình và việc chấp hành quy định về quản lý đầu tư của chủ dự án thành phần.
5. Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
Điều 45. Nội dung giám sát của cơ quan chủ quản và người có thẩm quyền quyết định đầu tư chương trình1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của chủ chương trình, chủ dự án thành phần thuộc chương trình theo quy định;
b) Tổng hợp tình hình thực hiện lập, thẩm định, phê duyệt các dự án thuộc chương trình;
c) Tổng hợp tình hình thực hiện chương trình: Tiến độ thực hiện các mục tiêu của chương trình; thực hiện kế hoạch vốn đầu tư, giải ngân; khó khăn, vướng mắc, phát sinh chính ảnh hưởng đến việc thực hiện chương trình và kết quả xử lý;
d) Việc chấp hành các biện pháp xử lý của chủ chương trình, chủ dự án thành phần;
d) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Nội dung kiểm tra:
a) Việc quản lý thực hiện chương trình của chủ chương trình và việc quản lý thực hiện dự án thành phần thuộc chương trình của chủ dự án thành phần;
b) Việc chấp hành các biện pháp xử lý các vấn đề đã phát hiện của các cơ quan, đơn vị liên quan.
Điều 46. Nội dung giám sát của chủ dự án thành phần1. Nội dung theo dõi:
a) Tổng hợp tình hình thực hiện dự án thành phần thuộc chương trình: Lập, thẩm định, phê duyệt dự án đầu tư; thực hiện dự án đầu tư; thực hiện kế hoạch vốn đầu tư, giải ngân; khó khăn, vướng mắc, phát sinh và kết quả xử lý;
b) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Nội dung kiểm tra:
a) Kiểm tra nội dung liên quan đến tổ chức thực hiện và quản lý dự án thành phần thuộc chương trình;
b) Việc chấp hành quy định về quản lý đầu tư và năng lực quản lý dự án của chủ đầu tư;
c) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện của chủ đầu tư.
Điều 47. Nội dung giám sát của cơ quan quản lý nhà nước về đầu tư công1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của chủ chương trình, chủ dự án thành phần theo quy định;
b) Tổng hợp tình hình thực hiện chương trình: Tiến độ thực hiện mục tiêu của chương trình; thực hiện kế hoạch vốn đầu tư, giải ngân; khó khăn, vướng mắc, phát sinh chính ảnh hưởng đến việc thực hiện chương trình và kết quả xử lý;
c) Việc chấp hành biện pháp xử lý của chủ chương trình, chủ dự án thành phần;
d) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Nội dung kiểm tra:
a) Việc chấp hành quy định trong việc lập, thẩm định, quyết định đầu tư dự án thuộc chương trình và quyết định điều chỉnh dự án thuộc chương trình (nếu có);
b) Việc quản lý và thực hiện chương trình của cơ quan chủ quản, chủ chương trình và chủ dự án thành phần;
c) Việc xử lý và chấp hành biện pháp xử lý vấn đề đã phát hiện của các cơ quan, đơn vị liên quan.
Điều 48. Giám sát dự án đầu tư thuộc chương trình đầu tư côngViệc giám sát dự án đầu tư thuộc chương trình đầu tư công thực hiện theo quy định tại Mục 2, 3, 4 và 5 Chương này.
Điều 49. Đánh giá chương trình đầu tư công1. Đánh giá chương trình đầu tư công được thực hiện như sau:
a) Chương trình đầu tư công phải thực hiện đánh giá giữa kỳ hoặc giai đoạn, đánh giá kết thúc, đánh giá tác động;
b) Cơ quan chủ quản, người có thẩm quyền quyết định đầu tư quyết định việc đánh giá đột xuất chương trình khi cần thiết.
2. Trách nhiệm tổ chức thực hiện đánh giá chương trình đầu tư công:
a) Chủ chương trình chịu trách nhiệm tổ chức thực hiện đánh giá giữa kỳ hoặc giai đoạn và đánh giá kết thúc;
b) Người có thẩm quyền quyết định đầu tư chịu trách nhiệm tổ chức thực hiện đánh giá đột xuất, đánh giá tác động;
c) Cơ quan quản lý nhà nước về đầu tư công và cơ quan chủ quản tổ chức thực hiện các loại đánh giá theo kế hoạch và đánh giá đột xuất chương trình thuộc phạm vi quản lý.
3. Nội dung đánh giá chương trình thực hiện theo quy định tại Điều 73 của Luật Đầu tư công.
4. Đánh giá hiệu quả đầu tư chương trình đầu tư công:
a) Phương pháp đánh giá hiệu quả chương trình đầu tư công: phương pháp so sánh, đối chiếu (giữa kết quả/số liệu thực tế thu thập tại thời điểm đánh giá và mục tiêu/kế hoạch đặt ra; hoặc giữa các thông số của dự án tại thời điểm đánh giá với các chỉ số tiêu chuẩn; hoặc kết hợp).
b) Tiêu chí đánh giá hiệu quả đầu tư chương trình đầu tư công: sự phù hợp của chương trình với mục tiêu kinh tế - xã hội quốc gia, mục tiêu kinh tế - xã hội của địa phương, phù hợp với nhu cầu của đối tượng hưởng lợi và chính sách phát triển của nhà tài trợ (nếu có); mức độ đạt được mục tiêu đầu tư chương trình theo quyết định đầu tư đã được phê duyệt; chỉ số khai thác, vận hành thực tế của chương trình so với các chỉ số khai thác, vận hành của chương trình đã được phê duyệt; các tác động kinh tế - xã hội, môi trường và các mục tiêu phát triển đặc thù khác (xóa đói giảm nghèo, bình đẳng giới, hộ chính sách, đối tượng ưu tiên,...); các biện pháp để giảm thiểu các tác động tiêu cực về xã hội, môi trường được thực hiện.
Mục 2. GIÁM SÁT, ĐÁNH GIÁ DỰ ÁN ĐẦU TƯ CÔNGĐiều 50. Trách nhiệm giám sát dự án đầu tư công
1. Chủ đầu tư tự tổ chức thực hiện theo dõi, kiểm tra toàn bộ quá trình đầu tư dự án theo nội dung và các chỉ tiêu được phê duyệt nhằm bảo đảm mục tiêu và hiệu quả đầu tư.
2. Cơ quan chủ quản, người có thẩm quyền quyết định đầu tư thực hiện theo dõi, kiểm tra dự án thuộc phạm vi quản lý. Việc kiểm tra được thực hiện như sau:
a) Kiểm tra ít nhất một lần đối với dự án có thời gian thực hiện trên 12 tháng;
b) Kiểm tra khi điều chỉnh dự án làm thay đổi địa điểm, mục tiêu, quy mô, tăng tổng mức đầu tư.
3. Cơ quan quản lý nhà nước về đầu tư công và cơ quan quản lý nhà nước chuyên ngành thực hiện theo dõi, kiểm tra dự án thuộc phạm vi quản lý.
4. Cơ quan quản lý nhà nước về đầu tư công, cơ quan quản lý nhà nước chuyên ngành, cơ quan chủ quản và người có thẩm quyền quyết định đầu tư quyết định tổ chức kiểm tra dự án theo kế hoạch hoặc đột xuất.
Điều 51. Nội dung giám sát của chủ đầu tư, chủ sử dụng1. Chủ đầu tư tự tổ chức thực hiện theo dõi, kiểm tra toàn bộ quá trình thực hiện dự án và báo cáo nội dung sau:
a) Việc quản lý thực hiện dự án: Lập kế hoạch tổng thể và kế hoạch chi tiết thực hiện dự án; tình hình thực hiện và điều chỉnh kế hoạch;
b) Tình hình thực hiện dự án đầu tư; Tiến độ thực hiện; khối lượng và giá trị khối lượng thực hiện; chất lượng công việc; các biến động trong quá trình thực hiện dự án;
c) Tình hình thực hiện kế hoạch vốn đầu tư: Việc huy động vốn cho dự án; giải ngân (tạm ứng, thu hồi tạm ứng, thanh toán); quyết toán vốn dự án hoàn thành; nợ đọng xây dựng cơ bản (nếu có) và việc xử lý;
d) Năng lực tổ chức thực hiện dự án và việc chấp hành các quy định về quản lý đầu tư, của ban quản lý dự án và các nhà thầu;
đ) Khó khăn, vướng mắc, phát sinh trong quá trình thực hiện dự án và việc xử lý theo thẩm quyền;
e) Đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Chủ sử dụng tự tổ chức thực hiện theo dõi, kiểm tra toàn bộ quá trình khai thác, vận hành dự án và báo cáo nội dung sau:
a) Việc quản lý, khai thác, vận hành dự án;
b) Khó khăn, vướng mắc, phát sinh trong quá trình khai thác, vận hành dự án và việc xử lý theo thẩm quyền;
c) Đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
Điều 52. Nội dung giám sát của người có thẩm quyền quyết định đầu tư1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của chủ đầu tư, chủ sử dụng;
b) Tổng hợp tình hình thực hiện dự án: Tiến độ thực hiện; thực hiện kế hoạch vốn đầu tư; giải ngàn, quyết toán vốn dự án hoàn thành; nợ đọng xây dựng cơ bản (nếu có) và việc xử lý; khó khăn, vướng mắc, phát sinh ảnh hưởng đến việc thực hiện dự án và kết quả xử lý;
c) Tổng hợp tình hình tổ chức khai thác, vận hành dự án; khó khăn, vướng mắc, phát sinh chính ảnh hưởng đến quá trình khai thác, vận hành dự án và kết quả xử lý;
d) Việc chấp hành các biện pháp xử lý của chủ đầu tư, chủ sử dụng;
đ) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền theo quy định.
2. Nội dung kiểm tra:
a) Việc chấp hành quy định về: giám sát, đánh giá đầu tư; đấu thầu; đền bù giải phóng mặt bằng, tái định cư; sử dụng vốn đầu tư và các nguồn lực khác của dự án; bố trí vốn đầu tư, giải ngân, thanh toán, quyết toán vốn đầu tư; giải quyết các vướng mắc, phát sinh trong quá trình thực hiện dự án; nghiệm thu đưa dự án vào hoạt động; quản lý, vận hành dự án; bảo vệ môi trường;
b) Việc quản lý thực hiện dự án của chủ đầu tư, ban quản lý dự án;
c) Tiến độ thực hiện dự án;
d) Việc quản lý, khai thác, vận hành dự án của chủ sử dụng;
d) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện của cơ quan được giao chuẩn bị đầu tư, chủ đầu tư, ban quản lý dự án, chủ sử dụng.
Điều 53. Nội dung giám sát của cơ quan chủ quản và cơ quan quản lý nhà nước về đầu tư công1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của chủ đầu tư, người có thẩm quyền quyết định đầu tư và chủ sử dụng theo quy định;
c) Tổng hợp tình hình thực hiện dự án: tiến độ thực hiện, thực hiện kế hoạch vốn đầu tư, giải ngân; khó khăn, vướng mắc, phát sinh chính ảnh hưởng đến việc thực hiện dự án và kết quả xử lý;
d) Tổng hợp tình hình tổ chức khai thác, vận hành dự án; khó khăn, vướng mắc, phát sinh chính ảnh hưởng đến quá trình khai thác, vận hành dự án và kết quả xử lý;
đ) Việc chấp hành biện pháp xử lý của chủ đầu tư, người có thẩm quyền quyết định đầu tư và chủ sử dụng;
e) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Nội dung kiểm tra:
a) Việc chấp hành quy định về đầu tư và giám sát, đánh giá đầu tư;
b) Việc quản lý thực hiện dự án của người có thẩm quyền quyết định đầu tư, chủ đầu tư, ban quản lý dự án;
c) Tiến độ thực hiện dự án;
d) Việc quản lý, khai thác, vận hành dự án của chủ sử dụng;
đ) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện của cơ quan được giao chuẩn bị đầu tư, người có thẩm quyền quyết định đầu tư, chủ đầu tư, ban quản lý dự án, chủ sử dụng.
Điều 54. Nội dung giám sát của cơ quan quản lý nhà nước chuyên ngànhCăn cứ chức năng, nhiệm vụ và lĩnh vực quản lý nhà nước được phân công, cơ quan quản lý nhà nước chuyên ngành thực hiện giám sát dự án đầu tư công theo quy định của pháp luật chuyên ngành.
Điều 55. Đánh giá dự án đầu tư công1. Việc đánh giá dự án được thực hiện như sau:
a) Dự án quan trọng quốc gia, dự án nhóm A phải thực hiện đánh giá ban đầu, đánh giá giữa kỳ, đánh giá kết thúc và đánh giá tác động;
b) Dự án nhóm B, nhóm C phải thực hiện đánh giá kết thúc và đánh giá tác động;
c) Ngoài các quy định tại điểm a và điểm b khoản này, người có thẩm quyền quyết định đầu tư và cơ quan quản lý nhà nước về đầu tư công quyết định thực hiện đánh giá khác quy định tại khoản 4 Điều 3 Nghị định này khi cần thiết.
2. Trách nhiệm tổ chức thực hiện đánh giá dự án:
a) Chủ đầu tư chịu trách nhiệm tổ chức thực hiện đánh giá ban đầu, đánh giá giữa kỳ và đánh giá kết thúc;
b) Người có thẩm quyền quyết định đầu tư chịu trách nhiệm tổ chức thực hiện đánh giá đột xuất, đánh giá tác động.
Người có thẩm quyền quyết định đầu tư có thể giao cho chủ sử dụng hoặc cơ quan chuyên môn trực thuộc tổ chức thực hiện đánh giá tác động dự án do mình quyết định đầu tư;
c) Cơ quan quản lý nhà nước về đầu tư công tổ chức thực hiện các loại đánh giá theo kế hoạch và đánh giá đột xuất dự án thuộc phạm vi quản lý.
3. Nội dung đánh giá dự án đầu tư công thực hiện theo quy định tại Điều 73 của Luật Đầu tư công.
4. Đánh giá hiệu quả đầu tư dự án đầu tư công:
a) Phương pháp đánh giá hiệu quả đầu tư dự án đầu tư công: Tùy theo quy mô và tính chất của dự án, có thể sử dụng phương pháp so sánh, đối chiếu (giữa kết quả/số liệu thực tế thu thập tại thời điểm đánh giá và mục tiêu/kế hoạch đặt ra; hoặc giữa các thông số của dự án tại thời điểm đánh giá với các chỉ số tiêu chuẩn; hoặc kết hợp) hoặc phương pháp phân tích chi phí - lợi ích;
b) Tiêu chí đánh giá hiệu quả đầu tư dự án đầu tư công: Mức độ đạt được mục tiêu đầu tư dự án theo quyết định đầu tư đã được phê duyệt; chỉ số khai thác, vận hành thực tế của dự án so với các chỉ số khai thác, vận hành của dự án đã được phê duyệt; tỷ suất hoàn vốn nội bộ (EIRR); các tác động kinh tế - xã hội, môi trường và các mục tiêu phát triển đặc thù khác (xóa đói giảm nghèo, bình đẳng giới, hộ chính sách, đối tượng ưu tiên); các biện pháp để giảm thiểu tối đa các tác động tiêu cực về xã hội, môi trường được thực hiện.
Mục 3. GIÁM SÁT, ĐÁNH GIÁ DỰ ÁN PPPĐiều 56. Trách nhiệm giám sát dự án
1. Cơ quan ký kết hợp đồng dự án PPP và nhà đầu tư tự tổ chức thực hiện theo dõi, kiểm tra quá trình đầu tư dự án theo nội dung được phê duyệt và hợp đồng dự án.
2. Người có thẩm quyền phê duyệt dự án, cơ quan có thẩm quyền thực hiện theo dõi, kiểm tra dự án thuộc thẩm quyền. Việc kiểm tra được thực hiện như sau:
a) Kiểm tra ít nhất một lần đối với các dự án do mình phê duyệt;
b) Kiểm tra khi điều chỉnh dự án làm thay đổi địa điểm, mục tiêu, quy mô, tăng tổng vốn đầu tư.
3. Cơ quan quản lý nhà nước về đầu tư theo phương thức đối tác công tư, cơ quan quản lý nhà nước chuyên ngành thực hiện theo dõi, kiểm tra dự án thuộc phạm vi quản lý.
4. Cơ quan quản lý nhà nước về đầu tư theo phương thức đối tác công tư, cơ quan quản lý nhà nước chuyên ngành, cơ quan có thẩm quyền và người có thẩm quyền phê duyệt dự án quyết định tổ chức kiểm tra dự án theo kế hoạch hoặc đột xuất.
Điều 57. Nội dung giám sát của nhà đầu tư, doanh nghiệp dự án và cơ quan ký kết hợp đồng dự án PPP1. Nhà đầu tư, doanh nghiệp dự án tự tổ chức thực hiện theo dõi, kiểm tra việc thực hiện Hợp đồng dự án và báo cáo các nội dung sau:
a) Tiến độ thực hiện hợp đồng dự án theo các mốc thời gian;
b) Tình hình thực hiện dự án đầu tư: tiến độ thực hiện; khối lượng và giá trị khối lượng thực hiện; chất lượng công việc;
c) Tình hình thực hiện huy động vốn đầu tư để thực hiện dự án (vốn nhà nước, vốn chủ sở hữu, vốn vay);
d) Doanh thu thực tế của dự án; giá trị phần doanh thu tăng mà doanh nghiệp dự án chia sẻ với nhà nước (nếu có); giá trị phần doanh thu giảm mà Nhà nước đã hoặc dự kiến thanh toán cho doanh nghiệp dự án (nếu có);
đ) Khó khăn, vướng mắc, phát sinh trong quá trình thực hiện hợp đồng dự án và việc xử lý theo thẩm quyền;
e) Đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Cơ quan ký kết hợp đồng dự án PPP tự tổ chức thực hiện theo dõi, kiểm tra và báo cáo nội dung sau:
a) Việc lựa chọn nhà đầu tư; đàm phán, ký kết Hợp đồng dự án;
b) Tổng hợp tình hình thực hiện các nội dung theo quy định tại khoản 1 Điều này;
c) Dự báo về các chi phí phát sinh cho phía Nhà nước trong giai đoạn 03, 05 năm tới kể từ năm báo cáo;
d) Khó khăn, vướng mắc, phát sinh trong quá trình thực hiện hợp đồng dự án và việc xử lý theo thẩm quyền;
đ) Đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
Điều 58. Nội dung giám sát của cơ quan có thẩm quyền và người có thẩm quyền phê duyệt dự án1. Theo dõi, kiểm tra việc lựa chọn nhà đầu tư, ký kết Hợp đồng dự án.
2. Theo dõi, kiểm tra tình hình thực hiện Hợp đồng dự án.
Điều 59. Nội dung giám sát của cơ quan quản lý nhà nước về đầu tư theo phương thức đối tác công tư1. Theo dõi, kiểm tra việc công bố dự án.
2. Tổng hợp tình hình thực hiện lựa chọn nhà đầu tư, đàm phán, ký kết hợp đồng dự án.
3. Tổng hợp tình hình thực hiện Hợp đồng dự án.
4. Kiểm tra việc chấp hành quy định về quản lý đầu tư của các bên ký kết Hợp đồng dự án trong việc thực hiện Hợp đồng dự án.
5. Theo dõi, kiểm tra các nội dung khác theo quy định tại Điều 86 và Điều 87 Luật Đầu tư theo phương thức đối tác công tư.
Điều 60. Nội dung giám sát của cơ quan quản lý nhà nước chuyên ngànhCăn cứ chức năng, nhiệm vụ và lĩnh vực quản lý nhà nước được phân công, cơ quan quản lý nhà nước chuyên ngành thực hiện theo dõi, kiểm tra dự án PPP theo quy định của pháp luật chuyên ngành.
Điều 61. Đánh giá dự án PPP1. Việc đánh giá dự án được thực hiện như sau:
a) Dự án thuộc thẩm quyền quyết định chủ trương đầu tư của Quốc hội, Thủ tướng Chính phủ, phải thực hiện đánh giá giữa kỳ, đánh giá kết thúc và đánh giá tác động;
b) Dự án thuộc thẩm quyền quyết định chủ trương đầu tư của Bộ trưởng, người đứng đầu cơ quan trung ương, cơ quan khác theo quy định của pháp luật về PPP phải thực hiện đánh giá kết thúc và đánh giá tác động;
c) Ngoài các quy định tại điểm a và điểm b khoản này, cơ quan có thẩm quyền, người có thẩm quyền phê duyệt dự án và cơ quan quản lý nhà nước về đầu tư theo phương thức đối tác công tư quyết định thực hiện đánh giá khác quy định tại khoản 4 Điều 3 Nghị định này khi cần thiết.
2. Trách nhiệm tổ chức thực hiện đánh giá dự án:
a) Cơ quan ký kết hợp đồng dự án PPP chịu trách nhiệm tổ chức thực hiện đánh giá giữa kỳ và đánh giá kết thúc;
b) Người có thẩm quyền phê duyệt dự án chịu trách nhiệm tổ chức thực hiện đánh giá đột xuất, đánh giá tác động;
c) Cơ quan quản lý nhà nước về đầu tư theo phương thức đối tác công tư thực hiện các loại đánh giá theo kế hoạch và đánh giá đột xuất dự án thuộc phạm vi quản lý.
3. Nội dung đánh giá dự án PPP thực hiện theo quy định tại Điều 73 của Luật Đầu tư công.
Mục 4. GIÁM SÁT, ĐÁNH GIÁ DỰ ÁN ĐẦU TƯ SỬ DỤNG VỐN NHÀ NƯỚC NGOÀI ĐẦU TƯ CÔNGĐiều 62. Trách nhiệm giám sát dự án
1. Nhà đầu tư tự tổ chức thực hiện theo dõi, kiểm tra quá trình đầu tư dự án theo nội dung và các chỉ tiêu được phê duyệt tại quyết định đầu tư.
2. Người có thẩm quyền quyết định đầu tư thực hiện theo dõi, kiểm tra dự án thuộc thẩm quyền. Việc kiểm tra được thực hiện như sau:
a) Kiểm tra ít nhất một lần đối với các dự án đầu tư từ nhóm B trở lên;
b) Kiểm tra khi điều chỉnh dự án đầu tư làm thay đổi địa điểm, mục tiêu, quy mô, tăng tổng mức đầu tư.
3. Cơ quan đại diện chủ sở hữu nhà nước, cơ quan có thẩm quyền quyết định sử dụng vốn nhà nước để đầu tư, cơ quan quản lý nhà nước về đầu tư và cơ quan quản lý nhà nước chuyên ngành thực hiện theo dõi, kiểm tra dự án thuộc phạm vi quản lý.
4. Cơ quan quản lý nhà nước về đầu tư, cơ quan quản lý nhà nước chuyên ngành, cơ quan đại diện chủ sở hữu nhà nước, cơ quan có thẩm quyền quyết định sử dụng vốn nhà nước để đầu tư quyết định tổ chức kiểm tra dự án theo kế hoạch hoặc đột xuất.
Điều 63. Nội dung giám sát của nhà đầu tưNhà đầu tư tự tổ chức thực hiện theo dõi, kiểm tra toàn bộ quá trình thực hiện dự án và báo cáo nội dung sau;
1. Tình hình thực hiện dự án đầu tư: tiến độ thực hiện; khối lượng và giá trị khối lượng thực hiện; chất lượng công việc; các biến động trong quá trình thực hiện dự án.
2. Tình hình thực hiện kế hoạch vốn đầu tư: việc huy động vốn cho dự án (vốn nhà nước, vốn chủ sở hữu, vốn vay); giải ngân (tạm ứng, thu hồi tạm ứng, thanh toán); quyết toán vốn dự án hoàn thành; nợ đọng xây dựng cơ bản (nếu có) và việc xử lý.
3. Tình hình khai thác, vận hành dự án: kết quả hoạt động đầu tư kinh doanh, thông tin về lao động, nộp ngân sách nhà nước, đầu tư cho nghiên cứu và phát triển, tình hình tài chính của doanh nghiệp và các chỉ tiêu chuyên ngành theo lĩnh vực hoạt động.
4. Việc thực hiện các yêu cầu về bảo vệ môi trường, sử dụng đất đai, sử dụng tài nguyên khoáng sản theo quy định.
5. Việc thực hiện các nội dung quy định tại văn bản chấp thuận chủ trương đầu tư, Giấy chứng nhận đăng ký đầu tư (nếu có) và quyết định đầu tư Dự án.
6. Việc đáp ứng các điều kiện đầu tư kinh doanh đối với các dự án thuộc ngành, nghề đầu tư kinh doanh có điều kiện.
7. Tình hình thực hiện ưu đãi đầu tư (nếu có).
8. Khó khăn, vướng mắc, phát sinh trong quá trình thực hiện, khai thác, vận hành dự án và kết quả xử lý.
Điều 64. Nội dung giám sát của người có thẩm quyền quyết định đầu tư1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của nhà đầu tư;
b) Tổng hợp tình hình thực hiện dự án: tiến độ thực hiện; thực hiện kế hoạch vốn đầu tư; giải ngân, quyết toán vốn dự án hoàn thành; nợ đọng xây dựng cơ bản (nếu có) và việc xử lý; khó khăn, vướng mắc, phát sinh ảnh hưởng đến việc thực hiện dự án và kết quả xử lý;
c) Tổng hợp tình hình tổ chức khai thác, vận hành dự án; khó khăn, vướng mắc, phát sinh chính ảnh hưởng đến quá trình khai thác, vận hành dự án và kết quả xử lý;
d) Tổng hợp tình hình thực hiện các yêu cầu về bảo vệ môi trường, sử dụng đất đai, sử dụng tài nguyên khoáng sản theo quy định;
đ) Tổng hợp tình hình thực hiện các nội dung khác quy định tại quyết định đầu tư dự án;
e) Việc chấp hành các biện pháp xử lý của nhà đầu tư;
g) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền theo quy định.
2. Nội dung kiểm tra:
a) Việc chấp hành quy định về: giám sát, đánh giá đầu tư; đấu thầu; đền bù giải phóng mặt bằng, tái định cư; sử dụng vốn đầu tư và các nguồn lực khác của dự án; bố trí vốn đầu tư, giải ngân, thanh toán, quyết toán vốn đầu tư; giải quyết các vướng mắc, phát sinh trong quá trình thực hiện dự án; nghiệm thu đưa dự án vào hoạt động; quản lý, vận hành dự án; bảo vệ môi trường, sử dụng đất đai, sử dụng tài nguyên khoáng sản (nếu có);
b) Việc quản lý thực hiện dự án;
c) Tiến độ thực hiện dự án;
d) Việc quản lý, khai thác, vận hành dự án;
đ) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện.
Điều 65. Nội dung giám sát của cơ quan đại diện chủ sở hữu nhà nước và cơ quan có thẩm quyền quyết định việc sử dụng vốn nhà nước để đầu tư1. Cơ quan đại diện chủ sở hữu nhà nước tổng hợp tình hình thực hiện dự án và kiểm tra việc chấp hành các quy định của pháp luật trong việc thực hiện dự án đầu tư của nhà đầu tư.
2. Cơ quan có thẩm quyền quyết định việc sử dụng vốn nhà nước để đầu tư tổng hợp tình hình thực hiện dự án và kiểm tra việc chấp hành các quy định trong việc sử dụng vốn nhà nước để đầu tư dự án của nhà đầu tư.
Điều 66. Nội dung giám sát đầu tư của cơ quan đăng ký đầu tư và cơ quan quản lý nhà nước về đầu tư1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của nhà đầu tư;
b) Tổng hợp tình hình thực hiện dự án;
c) Tổng hợp tình hình tổ chức khai thác, vận hành dự án;
d) Tổng hợp tình hình thực hiện các yêu cầu về bảo vệ môi trường, sử dụng đất đai, sử dụng tài nguyên khoáng sản theo quy định;
đ) Tổng hợp tình hình thực hiện các nội dung khác quy định tại quyết định đầu tư dự án.
2. Nội dung kiểm tra:
a) Việc thực hiện quy định tại văn bản chấp thuận chủ trương đầu tư, Giấy chứng nhận đăng ký đầu tư (nếu có);
b) Tiến độ thực hiện dự án;
c) Việc đáp ứng điều kiện đầu tư, điều kiện ưu đãi, hỗ trợ đầu tư và việc thực hiện các cam kết của nhà đầu tư (nếu có);
d) Việc chấp hành quy định về giám sát, đánh giá đầu tư và chế độ báo cáo thống kê theo quy định;
đ) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện.
Điều 67. Nội dung giám sát của cơ quan quản lý nhà nước chuyên ngànhCăn cứ chức năng, nhiệm vụ và lĩnh vực quản lý nhà nước được phân công, cơ quan quản lý nhà nước chuyên ngành thực hiện giám sát dự án đầu tư sử dụng vốn nhà nước ngoài đầu tư công theo các nội dung sau:
1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của nhà đầu tư theo quy định của pháp luật chuyên ngành;
b) Tình hình thực hiện các yêu cầu về bảo vệ môi trường, công nghệ, sử dụng đất đai, sử dụng tài nguyên khoáng sản theo quy định;
c) Việc chấp hành các biện pháp xử lý của nhà đầu tư.
2. Nội dung kiểm tra:
a) Sự phù hợp của dự án đầu tư với quy hoạch ngành, quy hoạch đô thị và quy hoạch sử dụng đất;
b) Việc chấp hành quy định về bảo vệ môi trường, công nghệ, sử dụng đất đai, sử dụng tài nguyên khoáng sản (nếu có);
c) Việc bồi thường, giải phóng mặt bằng, thu hồi đất;
d) Việc áp dụng và chấp hành quy định của pháp luật chuyên ngành đối với dự án.
Điều 68. Đánh giá dự án sử dụng vốn nhà nước ngoài đầu tư công1. Việc đánh giá dự án được thực hiện như sau:
a) Dự án quan trọng quốc gia, dự án nhóm A phải thực hiện đánh giá giữa kỳ, đánh giá kết thúc và đánh giá tác động;
b) Dự án nhóm B phải thực hiện đánh giá kết thúc và đánh giá tác động;
c) Ngoài các quy định tại điểm a và điểm b khoản này, người có thẩm quyền quyết định đầu tư, cơ quan đại diện chủ sở hữu nhà nước và cơ quan quản lý nhà nước về đầu tư quyết định thực hiện đánh giá khác quy định tại khoản 4 Điều 3 Nghị định này khi cần thiết.
2. Trách nhiệm tổ chức thực hiện đánh giá dự án:
a) Nhà đầu tư chịu trách nhiệm tổ chức thực hiện đánh giá giữa kỳ và đánh giá kết thúc;
b) Người có thẩm quyền quyết định đầu tư chịu trách nhiệm tổ chức thực hiện đánh giá đột xuất, đánh giá tác động;
c) Cơ quan quản lý nhà nước về đầu tư, cơ quan đại diện chủ sở hữu nhà nước tổ chức thực hiện các loại đánh giá theo kế hoạch và đánh giá đột xuất dự án thuộc phạm vi quản lý.
3. Nội dung đánh giá dự án áp dụng theo quy định tại Điều 73 của Luật Đầu tư công.
Mục 5. GIÁM SÁT, ĐÁNH GIÁ DỰ ÁN ĐẦU TƯ SỬ DỤNG NGUỒN VỐN KHÁCĐiều 69. Trách nhiệm giám sát dự án
1. Nhà đầu tư, tổ chức kinh tế tự tổ chức thực hiện theo dõi, kiểm tra dự án.
2. Cơ quan đăng ký đầu tư thực hiện theo dõi, kiểm tra dự án trong phạm vi quản lý. Việc kiểm tra được thực hiện ít nhất một lần đối với mỗi dự án.
3. Cơ quan quản lý nhà nước về đầu tư và cơ quan quản lý nhà nước chuyên ngành thực hiện theo dõi, kiểm tra dự án trong phạm vi quản lý.
4. Cơ quan quản lý nhà nước về đầu tư, cơ quan quản lý nhà nước chuyên ngành và cơ quan đăng ký đầu tư quyết định tổ chức kiểm tra dự án theo kế hoạch hoặc đột xuất.
Điều 70. Nội dung giám sát của nhà đầu tưNhà đầu tư, tổ chức kinh tế tự tổ chức thực hiện theo dõi, kiểm tra dự án và báo cáo các nội dung sau:
1. Tiến độ thực hiện dự án và tiến độ thực hiện mục tiêu của dự án.
2. Tiến độ góp vốn đầu tư, vốn điều lệ, góp vốn pháp định (đối với các ngành, nghề đầu tư kinh doanh có yêu cầu phải có vốn pháp định).
3. Tình hình khai thác, vận hành dự án: Kết quả hoạt động đầu tư kinh doanh, thông tin về lao động, nộp ngân sách nhà nước, đầu tư cho nghiên cứu và phát triển, tình hình tài chính của doanh nghiệp và các chỉ tiêu chuyên ngành theo lĩnh vực hoạt động.
4. Việc thực hiện các yêu cầu về bảo vệ môi trường, sử dụng đất đai, sử dụng tài nguyên khoáng sản theo quy định.
5. Việc thực hiện quy định tại văn bản quyết định hoặc chấp thuận chủ trương đầu tư và Giấy chứng nhận đăng ký đầu tư (nếu có).
6. Việc đáp ứng các điều kiện đầu tư kinh doanh đối với các dự án thuộc ngành, nghề đầu tư kinh doanh có điều kiện.
7. Tình hình thực hiện ưu đãi đầu tư (nếu có).
Điều 71. Nội dung giám sát của cơ quan đăng ký đầu tư1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của nhà đầu tư;
b) Tổng hợp tình hình thực hiện dự án;
c) Tổng hợp tình hình khai thác, vận hành dự án;
d) Tổng hợp tình hình thực hiện yêu cầu về bảo vệ môi trường, sử dụng đất đai, sử dụng tài nguyên khoáng sản của dự án;
đ) Việc xử lý và chấp hành các biện pháp xử lý của nhà đầu tư, tổ chức kinh tế;
e) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, các vấn đề vượt quá thẩm quyền.
a) Việc thực hiện quy định tại văn bản quyết định hoặc chấp thuận chủ trương đầu tư, Giấy chứng nhận đăng ký đầu tư (nếu có);
b) Tiến độ thực hiện dự án, gồm tiến độ thực hiện vốn đầu tư, trong đó có vốn vay và tiến độ thực hiện mục tiêu dự án;
c) Việc đáp ứng điều kiện đầu tư, điều kiện ưu đãi, hỗ trợ đầu tư và việc thực hiện các cam kết của nhà đầu tư (nếu có);
d) Việc chấp hành quy định về giám sát, đánh giá đầu tư và chế độ báo cáo thống kê theo quy định;
đ) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện.
Điều 72. Nội dung giám sát của cơ quan quản lý nhà nước về đầu tư1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của cơ quan đăng ký đầu tư;
b) Việc chấp hành các biện pháp xử lý của cơ quan đăng ký đầu tư;
c) Các nội dung quy định tại khoản 1 Điều 71 Nghị định này.
2. Nội dung kiểm tra:
a) Sự phù hợp của dự án đầu tư với quy hoạch có liên quan theo pháp luật về quy hoạch;
b) Việc cấp, điều chỉnh, thu hồi Giấy chứng nhận đăng ký đầu tư của cơ quan đăng ký đầu tư theo các quy định của pháp luật;
c) Quy định ưu đãi đối với dự án đầu tư;
d) Việc giám sát, đánh giá và hỗ trợ đầu tư sau khi cấp Giấy chứng nhận đăng ký đầu tư;
đ) Thực hiện chức năng cơ quan đầu mối tổng hợp báo cáo về tình hình thực hiện dự án đầu tư theo quy định;
e) Các nội dung quy định tại khoản 2 Điều 71 Nghị định này.
Điều 73. Nội dung giám sát của cơ quan quản lý nhà nước chuyên ngànhCăn cứ chức năng, nhiệm vụ và lĩnh vực quản lý nhà nước được phân công, cơ quan quản lý nhà nước chuyên ngành thực hiện giám sát dự án đầu tư sử dụng nguồn vốn khác theo các nội dung quy định tại Điều 67 Nghị định này.
Điều 74. Đánh giá dự án đầu tư sử dụng nguồn vốn khác1. Trách nhiệm tổ chức thực hiện đánh giá dự án:
a) Nhà đầu tư, tổ chức kinh tế thực hiện dự án thuộc diện chấp thuận chủ trương đầu tư phải đánh giá kết thúc;
b) Cơ quan đăng ký đầu tư và cơ quan quản lý nhà nước về đầu tư tổ chức thực hiện đánh giá đột xuất và đánh giá tác động khi cần thiết.
2. Nội dung đánh giá kết thúc:
a) Đánh giá kết quả thực hiện các mục tiêu, các nguồn lực đã huy động, tiến độ thực hiện, lợi ích dự án;
b) Đề xuất và kiến nghị.
3. Nội dung đánh giá tác động:
a) Thực trạng việc khai thác, vận hành dự án;
b) Tác động, hiệu quả kinh tế - xã hội của dự án;
c) Đề xuất và kiến nghị.
4. Nội dung đánh giá đột xuất:
a) Sự phù hợp của kết quả thực hiện dự án so với mục tiêu đầu tư;
b) Mức độ hoàn thành khối lượng công, việc so với quy định tại văn bản quyết định hoặc chấp thuận chủ trương đầu tư, Giấy chứng nhận đăng ký đầu tư (nếu có);
c) Xác định những phát sinh ngoài dự kiến (nếu có) và nguyên nhân;
d) Ảnh hưởng của những phát sinh ngoài dự kiến đến việc thực hiện dự án, khả năng hoàn thành mục tiêu của dự án;
đ) Đề xuất và kiến nghị.
Mục 6. GIÁM SÁT, ĐÁNH GIÁ DỰ ÁN ĐẦU TƯ RA NƯỚC NGOÀIĐiều 75. Trách nhiệm giám sát dự án đầu tư ra nước ngoài
1. Nhà đầu tư, người có thẩm quyền quyết định đầu tư dự án, cơ quan đại diện chủ sở hữu nhà nước thực hiện theo dõi, kiểm tra quá trình đầu tư dự án theo nội dung và các chỉ tiêu được phê duyệt tại quyết định đầu tư.
2. Cơ quan quản lý nhà nước về đầu tư và cơ quan quản lý nhà nước chuyên ngành thực hiện theo dõi, kiểm tra dự án trong phạm vi quản lý.
Điều 76. Nội dung giám sát của nhà đầu tưNhà đầu tư tự tổ chức thực hiện theo dõi, kiểm tra dự án và báo cáo các nội dung sau:
1. Việc thực hiện thủ tục đầu tư kinh doanh tại nước ngoài.
2. Tình hình thực hiện dự án: Tiến độ thực hiện dự án, tiến độ thực hiện các mục tiêu của dự án, việc huy động và chuyển vốn đầu tư ra nước ngoài, việc huy động và sử dụng vốn nhà nước để đầu tư ra nước ngoài (nếu có).
3. Tình hình khai thác, vận hành dự án: Kết quả hoạt động đầu tư kinh doanh, tình hình tài chính của tổ chức kinh tế thành lập tại nước ngoài để thực hiện dự án; việc giữ lại lợi nhuận để tái đầu tư, giữ lại lợi nhuận để đầu tư dự án mới, chuyển lợi nhuận về nước; việc thực hiện nghĩa vụ tài chính đối với nhà nước Việt Nam; tình hình sử dụng lao động Việt Nam.
4. Việc thực hiện các nội dung quy định tại Giấy chứng nhận đăng ký đầu tư ra nước ngoài.
5. Việc đảm bảo các điều kiện đầu tư ra nước ngoài đối với các dự án đầu tư ra nước ngoài trong các lĩnh vực ngân hàng, bảo hiểm, chứng khoán, báo chí, phát thanh, truyền hình, kinh doanh bất động sản.
Điều 77. Nội dung giám sát của người có thẩm quyền quyết định đầu tư và cơ quan đại diện sở hữu nhà nước đối với các dự án sử dụng vốn nhà nước để đầu tư ra nước ngoài1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của nhà đầu tư;
b) Tổng hợp tình hình thực hiện dự án: Tiến độ thực hiện dự án, tiến độ thực hiện các mục tiêu của dự án, tiến độ chuyển vốn đầu tư ra nước ngoài; việc quản lý, sử dụng, bảo toàn và phát triển vốn đầu tư của Nhà nước đúng quy định;
c) Tổng hợp kết quả hoạt động đầu tư kinh doanh, tình hình tài chính của tổ chức kinh tế thành lập tại nước ngoài để thực hiện dự án, việc chuyển lợi nhuận về nước;
d) Việc chấp hành biện pháp xử lý của nhà đầu tư;
đ) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, các vấn đề vượt quá thẩm quyền.
2. Nội dung kiểm tra:
a) Tiến độ thực hiện dự án;
b) Việc chấp hành quy định của pháp luật trong việc sử dụng vốn nhà nước để đầu tư ra nước ngoài;
c) Việc thực hiện quy định tại Giấy chứng nhận đăng ký đầu tư ra nước ngoài;
d) Việc chấp hành quy định của pháp luật trong việc: Chuyển vốn đầu tư ra nước ngoài, đưa lao động Việt Nam ra nước ngoài, chuyển lợi nhuận về nước, giám sát và đánh giá dự án đầu tư ra nước ngoài;
đ) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện.
Điều 78. Nội dung giám sát của cơ quan quản lý nhà nước về đầu tư1. Nội dung theo dõi:
a) Tình hình thực hiện chế độ báo cáo của nhà đầu tư;
b) Tổng hợp tình hình thực hiện dự án: Tiến độ thực hiện dự án, việc thực hiện mục tiêu của dự án, tiến độ chuyển vốn đầu tư ra nước ngoài;
c) Tổng hợp kết quả hoạt động đầu tư ra nước ngoài;
d) Việc chấp hành biện pháp xử lý của nhà đầu tư;
đ) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Nội dung kiểm tra:
a) Tiến độ thực hiện dự án;
b) Việc thực hiện quy định tại văn bản quyết định hoặc chấp thuận chủ trương đầu tư, Giấy chứng nhận đăng ký đầu tư ra nước ngoài và quy định khác của pháp luật về đầu tư ra nước ngoài;
c) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện.
Điều 79. Nội dung giám sát của cơ quan quản lý nhà nước chuyên ngànhCăn cứ chức năng, nhiệm vụ và lĩnh vực quản lý nhà nước được phân công, cơ quan quản lý nhà nước chuyên ngành thực hiện giám sát dự án đầu tư ra nước ngoài theo các nội dung sau:
1. Nội dung theo dõi:
a) Theo dõi tình hình thực hiện dự án trong phạm vi, lĩnh vực quản lý: Tiến độ thực hiện dự án, việc thực hiện các mục tiêu của dự án, tiến độ chuyển vốn đầu tư ra nước ngoài, việc huy động và sử dụng vốn nhà nước để đầu tư ra nước ngoài (nếu có);
b) Tổng hợp tình hình hoạt động đầu tư ra nước ngoài trong phạm vi, lĩnh vực quản lý;
c) Việc đảm bảo điều kiện đầu tư ra nước ngoài đối với dự án đầu tư ra nước ngoài trong các lĩnh vực ngân hàng, bảo hiểm, chứng khoán, báo chí, phát thanh, truyền hình, kinh doanh bất động sản;
d) Việc chấp hành biện pháp xử lý của nhà đầu tư;
đ) Báo cáo và đề xuất phương án xử lý khó khăn, vướng mắc, vấn đề vượt quá thẩm quyền.
2. Nội dung kiểm tra:
a) Kiểm tra theo thẩm quyền việc chấp hành các quy định của pháp luật trong việc: Chuyển vốn đầu tư ra nước ngoài, sử dụng vốn nhà nước để đầu tư ra nước ngoài, đưa lao động Việt Nam ra nước ngoài, chuyển lợi nhuận về nước và quy định pháp luật khác liên quan đến đầu tư ra nước ngoài;
b) Việc chấp hành biện pháp xử lý vấn đề đã phát hiện.
Điều 80. Đánh giá dự án đầu tư ra nước ngoài1. Trách nhiệm tổ chức thực hiện đánh giá dự án:
a) Nhà đầu tư chịu trách nhiệm tổ chức đánh giá kết thúc;
b) Cơ quan đại diện chủ sở hữu nhà nước, người có thẩm quyền quyết định đầu tư, cơ quan quản lý nhà nước chuyên ngành và cơ quan quản lý nhà nước về đầu tư tổ chức thực hiện đánh giá đột xuất khi cần thiết.
2. Nội dung đánh giá kết thúc:
a) Đánh giá kết quả thực hiện dự án so với quy định tại Giấy chứng nhận đăng ký đầu tư ra nước ngoài: kết quả thực hiện mục tiêu của dự án; nguồn lực đã huy động; tiến độ thực hiện dự án; hiệu quả kinh tế của dự án;
b) Đề xuất và kiến nghị.
3. Nội dung đánh giá đột xuất:
a) Sự phù hợp của kết quả thực hiện dự án so với mục tiêu đầu tư;
b) Mức độ hoàn thành khối lượng công việc so với quy định tại Giấy chứng nhận đăng ký đầu tư ra nước ngoài;
c) Xác định phát sinh ngoài dự kiến (nếu có) và nguyên nhân;
d) Ảnh hưởng của phát sinh ngoài dự kiến đến việc thực hiện dự án, khả năng hoàn thành mục tiêu của dự án;
đ) Đề xuất và kiến nghị.
SUPERVISION AND ASSESSMENT OF INVESTMENT PROGRAMS/PROJECTS
Section 1. SUPERVISION AND ASSESSMENT OF PUBLIC INVESTMENT PROGRAMS
Article 43. Responsibility to supervise public investment program
1. Owners of the program and component projects shall monitor and inspect the investment process of the public investment program according to the approved contents and criteria to ensure achievement of objectives and investment efficiency.
2. The supervisory body and person competent to decide investment (hereinafter referred to as “the investment decider”) in the program shall monitor and inspect the program under their management. Inspection shall be carried out as follows:
a) The program whose investment duration is longer than 12 months shall undergo at least one inspection;
b) Inspection shall be carried out if the location, objective or scale of the project is changed or the total investment is increased.
3. The public investment authority shall monitor and inspect the program under its management.
4. The public investment authority, supervisory authority and person competent to decide the investment guidelines of the program shall decide to organize planned and ad hoc inspections of the program.
Article 44. Contents of supervision by program owner
The program owner shall monitor and inspect the entire process of execution of the program and make a report on the following issues:
1. Management of the program execution: formulation of an overall plan and detailed plan for launching the program; implementation and adjustment of such plans;
2. Progress of program execution: progress of achievement of the program’s objectives; progress of component projects of the program; value of finished works.
3. Implementation of capital investment plan: raising capital for the program; disbursement; outstanding debts accruing from capital construction activities (if any).
4. Capacity for execution of component projects and adherence of owners of component projects to regulations on investment management.
5. Proposed plans for resolving difficulties and issues beyond the program owner’s competence.
Article 45. Contents of supervision by the supervisory body and investment decider in the program
1. Monitoring contents:
a) Adherence to reporting regulations by the program owner and owners of component projects of the program;
b) Formulation, appraisal and approval of projects of the program;
c) Progress of program execution: progress of achievement of the program’s objectives; progress of implementation of the capital investment and disbursement plan; primary difficulties that affect the program execution, and results of resolution thereto;
d) Implementation of measures by the program owner and owners of component projects;
dd) Proposed plans for resolving difficulties and issues beyond the one’s competence.
2. Inspection contents:
a) Management of execution of the program by the its owner and management of execution of component projects by their owners;
b) Implementation of measures for resolving issues taken by relevant agencies and units.
Article 46. Contents of supervision by owners of component projects
1. Monitoring contents:
a) Execution of component projects of the program: setting up, appraisal and approval of investment projects; execution of investment projects; implementation of capital investment and disbursement plan; difficulties that arise, and results of resolution thereto;
b) Proposed plans for resolving difficulties and issues beyond owner’s competence.
2. Inspection contents:
a) Execution and management of component projects;
b) Adherence to regulations on investment management and owner’ capacity of project management;
c) Implementation of measures for resolving discovered issues.
Article 47. Contents of supervision by public investment authorities
1. Monitoring contents:
a) Adherence to reporting regulations by the program owner and owners of component projects of the program;
b) Progress of program execution: progress of achievement of the program’s objectives; progress of implementation of the capital investment and disbursement plan; primary difficulties that affect the program execution and results of resolution thereto;
c) Implementation of measures by the program owner and owners of component projects;
d) Proposed plans for resolving difficulties and issues beyond the one’s competence.
2. Inspection contents:
a) Adherence to regulations on formulation and appraisal of, and decision on investment in projects, and decision on adjustments to projects (if any) of the program;
b) Management and execution of the program by the supervisory authority, program owner and owners of component projects;
c) Implementation of measures for resolving issues taken by relevant agencies and units.
Article 48. Supervision of investment projects of a public investment program
Supervision of investment projects of a public investment program shall comply with Sections 2, 3, 4 and 5 of this Chapter.
Article 49. Assessment of public investment programs
1. A public investment program shall be assessed as follows:
a) Every public investment program must undergo an initial assessment, midterm assessment, terminal assessment and impact assessment;
b) The supervisory body and investment decider shall decide ad hoc assessment of the program where necessary.
2. Responsibility for assessment of public investment programs:
a) The program owner shall carry out the initial assessment, midterm assessment, and terminal assessment;
b) The investment decider shall carry out ad hoc assessment and impact assessment;
c) The public investment authority and supervisory body shall carry out various types of planned and ad hoc assessments of the programs under their management.
3. Assessment contents shall comply with Article 73 of the Law on Public Investment.
4. Assessment of investment efficiency of a public investment program:
a) Method for assessment of investment efficiency of the public investment program: comparative method (comparison between results/data actually collected at the assessment time and the expected objectives/planned data; or comparison between parameters of the project at the assessment time and standard indicators; or combination thereof).
b) Criteria for assessment of investment efficiency of the public investment program: the conformity of the program with national socio-economic objectives, local socio-economic objectives, the conformity between the demand of beneficiaries and the sponsor’s development policies (if any); the level of achievement of investment objectives of the program according to the approved investment decision; actual operation indexes of the program compared with those of an approved program; socio-economic impacts, environmental impacts, and other specific development objectives (such as poverty reduction, gender equality, households benefiting social policies, and priority entities, etc.); adopted measures for minimizing negative social and environmental impacts.
Section 2. SUPERVISION AND ASSESSMENT OF PUBLIC INVESTMENT PROJECTS
Article 50. Responsibility to supervise public investment projects
1. Every project owner shall monitor and inspect the entire investment process of the project according to the approved contents and criteria to ensure achievement of objectives and investment efficiency.
2. Supervisory authorities and investment deciders shall monitor and inspect projects under their management. Inspection shall be carried out as follows:
a) A project whose investment duration is longer than 12 months shall undergo at least one inspection;
b) Inspection shall be carried out if the location, objective or scale of the project is changed or the total investment is increased.
3. Public investment authorities and specialized regulatory authorities shall monitor and inspect projects under their management.
4. Public investment authorities, specialized regulatory authorities, supervisory authorities and investment deciders shall decide to organize planned and ad hoc inspections of projects.
Article 51. Contents of supervision by the project owner and operator
1. The project owner shall monitor and inspect the entire process of execution of the program and make a report on the following issues:
a) Management of the project execution: formulation of an overall plan and detailed plan for project execution; implementation and adjustment of such plans;
b) Execution of the project: progress, amount and value of finished works; work quality; fluctuation during the project execution;
c) Implementation of capital investment plan: raising capital for the project; disbursement (advance, advance withdrawal and payment); financial statement after the project is complete, outstanding debts accruing from capital construction activities (if any) and settlement thereof;
d) Capacity for project execution and adherence to regulations on investment management of the project management board and contractors;
dd) Difficulties that arise during the execution of the project and resolution thereto;
e) Proposed plans for resolving difficulties and issues beyond the project owner’s competence.
2. The operator shall monitor and inspect the entire process of execution of the project and make a report on the following issues:
a) Management and operation of the project;
b) Difficulties that arise during the operation of the project and resolution thereto;
c) Proposed plans for resolving difficulties and issues beyond the operator’s competence.
Article 52. Contents of supervision by the investment decider
1. Monitoring contents:
a) Adherence to reporting regulations by the project owner and operator;
b) Execution of the project: progress; implementation of capital investment plan; disbursement; financial statement after the project is complete; outstanding debts accruing from capital construction activities (if any) and settlement thereof; difficulties that affect the project execution and results of resolution thereto;
c) Operation of the project; primary difficulties that arise affect project operation and results of resolution thereto;
d) Implementation of measures by the project owner and operator;
dd) Proposed plans for resolving difficulties and issues beyond the competence.
2. Inspection contents:
a) Adherence to regulations on supervision and assessment of investment; bidding; compensation for land clearance and relocation; use of capital and other resources; distribution of capital, disbursement, payment, statement of investment capital; settlement of difficulties that arise during the project execution; acceptance and inauguration of the project; management and operation of the project; environmental protection;
b) Project execution management by the project owner and project management board;
c) The project’s progress;
d) Project operation by the operator;
dd) Implementation of measures for resolving discovered issues by the authority assigned to prepare investment, project owner, project management board and operator.
Article 53. Contents of supervision by the supervisory authority and public investment authority
1. Monitoring contents:
a) Adherence to reporting regulations by the authority assigned to prepare investment, project owner, investment decider and operator;
c) Progress of program execution: progress of implementation of the capital investment and disbursement plan; difficulties that affect the program execution, and results of resolution thereto;
d) Operation of the project; primary difficulties that arise affect project operation and results of resolution thereto;
dd) Implementation of measures by the project owner, investment decider and operator;
e) Proposed plans for resolving difficulties and issues beyond their competence.
2. Inspection contents:
a) Adherence to regulations on supervision and assessment of investment;
b) Project execution management by the investment decider, project owner and project management board;
c) The project’s progress;
d) Project operation by the operator;
dd) Implementation of measures for resolving discovered issues by the authority assigned to prepare investment, investment decider, project owner, project management board and operator.
Article 54. Contents of supervision by specialized regulatory authorities
Specialized regulatory authorities shall, within their jurisdiction, supervise public investment projects in accordance with special legislation.
Article 55. Assessment of public investment projects
1. Assessment shall be carried out as follows:
a) PNS and Group A projects must undergo an initial assessment, midterm assessment, terminal assessment and impact assessment;
b) Group B and Group C projects must undergo terminal assessment and impact assessment;
c) In addition to the regulations mentioned in Point a and Point b of this Clause, the investment deciders and public investment authorities shall decide other types of assessment prescribed in Clause 4 Article 3 of this Decree where necessary.
2. Responsibility to carry out project assessments:
a) The project owner shall carry out the initial assessment, midterm assessment and terminal assessment;
b) The investment decider shall carry out ad hoc assessment and impact assessment.
The investment decider may delegate the operator or a specialized agency to carry out the impact assessment of the project;
c) Public investment authorities shall carry out various types of planned and ad hoc assessments of projects under their management.
3. Contents of assessment of public investment projects shall comply with Article 73 of the Law on Public Investment.
4. Assessment of investment efficiency of the public investment project:
a) Method for assessment of investment efficiency of a public investment project: depending on the scale and nature of the project, either comparative method (comparison between results/data actually collected at the evaluation time and the expected objectives/planned data; or comparison between parameters of the project at the evaluation time and standard indicators; or combination thereof) or cost - benefit analysis method may be employed;
b) Criteria for assessment of investment efficiency of a public investment project: the level of achievement of investment objectives of the project according to the approved investment decision; actual operation indexes of the project compared with those of approved projects; the economic internal rate of return (EIRR); socio-economic impacts, environmental impacts, and other specific development objectives (such as poverty reduction, gender equality, households benefiting social policies and priority entities); adopted measures for minimizing negative social and environmental impacts.
Section 3. SUPERVISION AND ASSESSMENT OF PPP PROJECTS
Article 56. Responsibility for project supervision
1. Authorities signing PPP contracts and investor shall monitor and inspect the investment process of projects according to the approved contents and project contract.
2. Persons competent to approve the project and competent authorities shall monitor and inspect projects under their management. Inspection shall be carried out as follows:
a) Every approved project shall undergo at least one inspection;
b) Inspection shall be carried out if the location, objective or scale of the project is changed or the total investment is increased.
3. The PPP investment authority and specialized regulatory authority shall monitor and inspect the project under their management.
4. The PPP investment authority, specialized regulatory authority, competent authority and person competent to approve projects shall decide to organize planned and ad hoc inspections.
Article 57. Contents of supervision by the investor, project enterprise and authority signing PPP contract
1. The investor and project enterprise shall monitor and inspect the execution of the project contract and make a report on the following issues:
a) Execution of the project contract by timeline;
b) Execution of the investment project: progress; amount and value of finished works; work quality;
c) Raising of the investment capital for project execution (state capital, equity and loans);
d) Actual revenue of the project; value of the increased revenue (if any) shared by the project enterprise with the State; value of the reduced revenue (if any) which the State has paid or is expected to pay to the project enterprise;
dd) Difficulties that arise during the execution of the project and results of resolution thereto;
e) Proposed plans for resolving difficulties and issues beyond the project owner’s competence.
2. The authority signing the PPP contract shall monitor, inspect and make a report on the following issues:
a) Selection of the investor; negotiation and signature of the project contract;
b) Performance of the tasks in Clause 1 of this Article;
c) Forecasting of costs for the State during the next 03 or 05 year period from the reporting year;
d) Difficulties that arise during the execution of the project contract and results of resolution thereto;
dd) Proposed plans for resolving difficulties and issues beyond the competence.
Article 58. Contents of the competent authority and person competent to approve a project
1. Monitoring and inspection of the selection of the investor and signature of the project contract.
2. Monitoring and inspection of the execution of the project contract.
Article 59. Contents of supervision by the PPP investment authority
1. Monitoring and inspection of the project announcement.
2. Selection of investors, negotiation and signature of the project contract.
3. Execution of the project contract.
4. Inspection of the compliance with regulations on investment management by the parties while performing the project contract.
5. Monitoring and inspection of other contents specified in Articles 86 and 87 of the Law on Public – Private Partnership Investment.
Article 60. Contents of supervision by specialized regulatory authorities
Specialized regulatory authorities shall, within their jurisdiction, monitor and inspect PPP projects in accordance with special legislation.
Article 61. Assessment of PPP projects
1. Project assessment shall be carried out as follows:
a) Projects subject to decision on their investment guidelines by the National Assembly and the Prime Minister must undergo a midterm assessment, terminal assessment and impact assessment;
b) Projects subject to decision on their investment guidelines by Ministers, heads of central government authorities and other authorities in accordance with regulations of law on PPP must undergo a terminal assessment and impact assessment;
c) In addition to the regulations mentioned in Point a and Point b of this Clause, competent authorities, persons competent to approve projects and PPP investment authorities shall decide other types of assessment prescribed in Clause 4 Article 3 of this Decree where necessary.
2. Responsibility to carry out project assessments:
a) Authorities signing PPP project contracts shall carry out midterm assessment and terminal assessment;
b) Persons competent to approve projects shall carry out ad hoc assessment and impact assessment;
c) PPP investment authorities shall carry out various types of planned and ad hoc assessments of projects under their management.
3. Contents of assessment of PPP projects shall comply with Article 73 of the Law on Public Investment.
Section 4. SUPERVISION AND ASSESSMENT OF INVESTMENT PROJECTS FUNDED BY NON-PUBLIC INVESTMENT STATE CAPITAL
Article 62. Responsibility for project supervision
1. Investors shall monitor and inspect the investment process of their projects according to the approved contents and criteria approved in the investment decisions.
2. Investment deciders shall monitor and inspect projects under their management. Inspection shall be carried out as follows:
a) Group B or higher level projects shall undergo at least one inspection;
b) Inspection shall be carried out if the location, objective or scale of the project is changed or total investment is increased.
3. State ownership representative agencies, authorities competent to decide use state capital for investment, investment authorities and specialized regulatory authorities shall monitor and inspect projects under their management.
4. Investment authorities, specialized regulatory authorities, supervisory authorities, state ownership representative agencies and authorities that have the power to decide to use state capital for investment shall decide to organize planned or ad hoc inspections of projects.
Article 63. Contents of supervision by investors
Every investor shall monitor and inspect the entire process of execution of their own project and make a report on the following issues:
1. Execution of the project: progress; amount and value of finished works; work quality; fluctuation during the project execution.
2. Implementation of the capital investment plan: raising capital for the project (state capital, equity, loans); disbursement (advance, advance withdrawal and payment); financial statement after the project is complete; outstanding debts accruing from capital construction activities (if any) and settlement thereof;
3. Project operation: investment results, information about employment, payment to state budget, investment in research and development, financial status of the enterprise, and other professional indicators depending on the business lines.
4. Satisfaction of regulations on environmental protection, use of land and natural resources as prescribed.
5. Implementation of the regulations laid down in the written approval for investment guidelines, investment registration certificate (if any) and decision on investment in the project.
6. Fulfillment of business investment conditions (if the business lines of the project is subject to certain conditions).
7. Investment incentives (if any).
8. Difficulties that arise during the operation of the project and results of resolution thereto.
Article 64. Contents of supervision by investment deciders
1. Monitoring contents:
a) Adherence to reporting regulations by investors;
b) Execution of the project: progress; implementation of the capital investment plan; disbursement, financial statement after the project is complete; outstanding debts accruing from capital construction activities (if any) and settlement thereof; difficulties that affect the project execution and results of resolution thereto;
c) Operation of the project; primary difficulties that arise affect project operation and results of resolution thereto;
d) Adherence to regulations on environmental protection, use of land and natural resources as prescribed;
dd) Performance of other tasks specified in decisions on investment in projects;
e) Implementation of measures by investors;
g) Proposed plans for resolving difficulties and issues beyond the competence as prescribed.
2. Inspection contents:
a) Adherence to regulations on supervision and assessment of investment; bidding; compensation for land clearance and relocation; use of capital and other resources; distribution of capital, disbursement, payment, statement of investment capital; settlement of difficulties that arise during the project execution; acceptance and inauguration of the project; management and operation of the project; environmental protection, use of land and natural resources (if any);
b) Project management;
c) Projects’ progress;
d) Management and operation of projects;
dd) Implementation of measures for resolving discovered issues.
Article 65. Contents of supervision by state ownership representative agencies and authorities competent to decide to use state capital for investment
1. State ownership representative agencies shall monitor the execution of projects and inspect the compliance with regulations of law on execution of investment projects by investors.
2. Competent authorities that have the power to decide to use state capital for investment shall monitor the execution of projects and inspect the compliance with regulations of law on use of state capital for of investment projects by investors.
Article 66. Contents of supervision by investment registration authorities and investment authorities
1. Monitoring contents:
a) Adherence to reporting regulations by investors;
b) Project execution.
c) Project operation;
d) Adherence to regulations on environmental protection, use of land and natural resources as prescribed;
dd) Performance of other tasks specified in decisions on investment in projects.
2. Inspection contents:
a) Implementation of the regulations laid down in the written approval for investment guidelines and investment registration certificate (if any);
b) Projects’ progress;
c) Satisfaction of conditions for investment, incentives, investment assistance and investors’ adherence to their commitments (if any);
d) Adherence to regulations on supervision and assessment of investment and statistical reporting as prescribed;
dd) Implementation of measures for resolving discovered issues.
Article 67. Contents of supervision by specialized regulatory authorities
Specialized regulatory authorities shall, within their jurisdiction, supervise investment projects funded by non-public investment state capital as follows:
1. Monitoring contents:
a) Adherence to reporting regulations by investors in accordance with special legislation;
b) Adherence to regulations on environmental protection, use of land and natural resources as prescribed;
c) Implementation of measures by investors.
2. Inspection contents:
a) Conformity of investment projects with sectoral planning, urban planning and land use planning;
b) Adherence to regulations on environmental protection, technology, use of land and natural resources (if any);
c) Compensation, land clearance and land appropriation;
d) Application of and adherence to special legislation by projects.
Article 68. Assessment of projects funded by non-public investment state capital
1. Project assessment shall be carried out as follows:
a) PNS and Group A projects must undergo a midterm assessment, terminal assessment and impact assessment;
b) Group B projects must undergo terminal assessment and impact assessment;
c) In addition to the regulations mentioned in Point a and Point b of this Clause, the investment deciders, state ownership representative agencies and investment authorities shall decide other types of assessment prescribed in Clause 4 Article 3 of this Decree where necessary.
2. Responsibility to carry out project assessments:
a) Investors shall carry out the midterm assessment and terminal assessment;
b) Investment deciders shall carry out ad hoc assessment and impact assessment;
c) Investment authorities and state ownership representative agencies shall carry out various types of planned and ad hoc assessments of projects under their management.
3. Contents of assessment of projects shall comply with Article 73 of the Law on Public Investment.
Section 5. SUPERVISION AND ASSESSMENT OF PROJECTS FUNDED BY OTHER CAPITAL SOURCES
Article 69. Responsibility for project supervision
1. Investors and business entities shall monitor and inspect their own projects.
2. Investment registration authorities shall monitor and inspect projects under their management. Each project shall undergo at least one inspection.
3. Investment authorities and specialized regulatory authorities shall monitor and inspect projects under their management.
4. Investment authorities, specialized regulatory authorities, investment registration authorities shall decide to organize planned or ad hoc inspections of projects.
Article 70. Contents of supervision by investors
Each investor and business entity shall monitor and inspect their own projects and make a report on the following issues:
1. Progress of the project and achievement of its objectives.
2. Progress of contribution of capital, charter capital, and legal capital (if required).
3. Project operation: investment results, information about employment, payment to state budget, investment in research and development, financial status of the enterprise, and other professional indicators depending on the business lines.
4. Adherence to regulations on environmental protection, use of land and natural resources as prescribed.
5. Implementation of the regulations laid down in the decision on or written approval for investment guidelines and investment registration certificate (if any).
6. Fulfillment of business investment conditions (if the business lines of the project is subject to certain conditions).
7. Investment incentives (if any).
Article 71. Contents of supervision by investment registration authorities
1. Monitoring contents:
a) Adherence to reporting regulations by investors;
b) Project execution;
c) Project operation;
d) Adherence to regulations on environmental protection, use of land and natural resources;
dd) Implementation of measures by investors and business entities;
e) Proposed plans for resolving difficulties and issues beyond their competence.
2. Inspection contents:
a) Implementation of the regulations laid down in the decision on or written approval for investment guidelines and investment registration certificate (if any).
b) Progress of projects, including investment progress which consists of loan capital and achievement of objectives of projects;
c) Satisfaction of conditions for investment, incentives, investment assistance and investors’ adherence to their commitments (if any);
d) Adherence to regulations on supervision and assessment of investment and statistical reporting as prescribed;
dd) Implementation of measures for resolving discovered issues.
Article 72. Contents of supervision by investment authorities
1. Monitoring contents:
a) Adherence to reporting regulations by investment registration authorities;
b) Implementation of measures by investment registration authorities;
c) The contents mentioned in Clause 1 Article 71 of this Decree.
2. Inspection contents:
a) Conformity of investment projects with relevant planning in accordance with the law on planning;
b) Issuance, adjustment and revocation of investment registration certificates by investment registration authorities as prescribed by law;
c) Regulations on incentives for investment projects;
d) Supervision, assessment of investment and investment assistance after issuance of investment registration certificates;
dd) Consolidation of reports on execution of investment projects;
e) The contents mentioned in Clause 2 Article 71 of this Decree.
Article 73. Contents of supervision by specialized regulatory authorities
Specialized regulatory authorities shall, within their jurisdiction, supervise investment projects funded by other capital sources as prescribed in Article 67 of this Decree.
Article 74. Assessment of projects funded by other capital sources
1. Responsibility to carry out project assessments:
a) Investors and business entities shall carry out terminal assessments of projects subject to approval for their investment guidelines;
b) Investment registration authorities and investment authorities shall carry out ad hoc assessments and impact assessments where necessary.
2. Contents of a terminal assessment:
a) Achievement of objectives, mobilized resources, punctuality, and benefits of the project;
b) Proposals and recommendations.
3. Contents of an impact assessment:
a) Operation of the project;
b) Socio-economic effects of the project;
c) Proposals and recommendations.
4. Contents of an ad hoc assessment:
a) Conformity of the project execution result with investment objectives;
b) Completeness of works in comparison with those in the decision on or written approval for investment guidelines and investment registration certificate (if any);
c) Unexpected difficulties (if any) and causes;
d) Impact of unexpected difficulties to the project execution and ability to achieve objectives of the project;
dd) Proposals and recommendations.
Section 6. SUPERVISION AND ASSESSMENT OF OUTWARD INVESTMENT PROJECTS
Article 75. Responsibility to supervise outward investment projects
1. Investors, investment deciders and state ownership representative agencies shall monitor and inspect the project execution according to the contents and criteria approved in the investment decisions.
2. Investment authorities and specialized regulatory authorities shall monitor and inspect projects under their management.
Article 76. Contents of supervision by investors
Each investor shall monitor and inspect their own projects and make a report on the following issues:
1. Performance of procedures for making outward investment.
2. Project execution: progress of the project and achievement of its objectives, capital raising and transfer of capital abroad, raising and use of state capital (if any) for outward investment.
3. Project operation: investment results, financial status of the business organization established overseas to execute the project; retention of profit for reinvestment, retention of profit for investment in new projects, transfer of profits to Vietnam; fulfillment of financial obligations to Vietnam; employment of Vietnamese workers.
4. Implementation of the Certificate of registration of outward investment.
5. Fulfillment of conditions for outward investment with regard to outward investment projects in the fields of banking, insurance, securities, press, radio, television and real estate trading.
Article 77. Contents of supervision of outward investment projects funded by state capital by investment deciders and state ownership representative agencies
1. Monitoring contents:
a) Adherence to reporting regulations by investors;
b) Project execution: progress of the project and achievement of its objectives, progress of transferring investment capital abroad; management, use, preservation and development of state capital as prescribed;
c) Investment results, financial status of the business entity established overseas to execute the project; transfer of profit to Vietnam;
d) Implementation of measures by investors;
dd) Proposed plans for resolving difficulties and issues beyond their competence.
2. Inspection contents:
a) Projects’ progress;
b) Adherence to regulations of law on use of state capital for outward investment;
c) Implementation of the Certificate of registration of outward investment;
d) Adherence to regulations of law on: transfer of capital abroad, sending Vietnamese workers abroad, transfer of profit to Vietnam, supervision and assessment of outward investment projects.
dd) Implementation of measures for resolving discovered issues.
Article 78. Contents of supervision by investment authorities
1. Monitoring contents:
a) Adherence to reporting regulations by investors;
b) Project execution: progress of the project and achievement of its objectives, progress of transferring investment capital abroad;
c) Consolidation of results of outward investment;
d) Implementation of measures by investors;
dd) Proposed plans for resolving difficulties and issues beyond their competence.
2. Inspection contents:
b) Projects’ progress;
b) Implementation of the decision or written approval for investment guidelines, certificate of registration of outward investment and other regulations of law on outward investment;
c) Implementation of measures for resolving discovered issues.
Article 79. Contents of supervision by specialized regulatory authorities
Specialized regulatory authorities shall, within their jurisdiction, supervise outward investment projects as follows:
1. Monitoring contents:
a) Execution of projects under their management: progress of projects and achievement of their objectives, progress of transferring capital abroad, raising and use of state capital for outward investment (if any);
b) Developments of outward investment activities under their management;
c) Fulfillment of conditions for outward investment with regard to outward investment projects in the fields of banking, insurance, securities, press, radio, television and real estate trading;
d) Implementation of measures by investors;
dd) Proposed plans for resolving difficulties and issues beyond their competence.
2. Inspection contents:
a) Adherence to regulations of law on: transfer of capital abroad, use of state capital for outward investment, sending Vietnamese workers abroad, transfer of profit to Vietnam and other regulations of law on outward investment;
b) Implementation of measures for resolving discovered issues.
Article 80. Assessment of outward investment projects
1. Responsibility to carry out project assessments:
a) Investors shall carry out terminal assessments;
b) State ownership representative agencies, investment deciders, specialized regulatory authorities and investment authorities shall carry out ad hoc assessments and impact assessments where necessary.
2. Contents of a terminal assessment:
a) Assessment of result of project execution compared to the Certificate of registration of outward investment: achievement of the project objectives; mobilized resources; project execution progress; economic effects of the project;
b) Proposals and recommendations.
3. Contents of an ad hoc assessment:
a) Conformity of the project execution result with investment objectives;
b) Completeness of works in comparison with those in the Certificate of registration of outward investment;
c) Unexpected difficulties (if any) and causes;
d) Impact of unexpected difficulties to the project execution and ability to achieve objectives of the project;
dd) Proposals and recommendations.
