1. Chi phí giám sát, đánh giá đầu tư là toàn bộ chi phí cần thiết để cơ quan, tổ chức, cá nhân thực hiện việc giám sát, đánh giá đầu tư theo quy định tại Nghị định này.
2. Nguồn vốn thực hiện giám sát, đánh giá đầu tư:
a) Chi phí cho công tác giám sát, đánh giá đầu tư do cơ quan quản lý nhà nước thực hiện được sử dụng từ nguồn kinh phí sự nghiệp, nguồn kinh phí thường xuyên cho công tác giám sát, đánh giá đầu tư theo kế hoạch hàng năm của cơ quan, đơn vị thực hiện nhiệm vụ này;
b) Chi phí cho công tác giám sát, đánh giá đầu tư do chủ chương trình, chủ đầu tư, nhà đầu tư, cơ quan ký kết hợp đồng dự án PPP tự thực hiện hoặc thuê tư vấn thực hiện được tính trong tổng mức đầu tư chương trình, dự án;
c) Chi phí cho công tác giám sát, đánh giá đầu tư của chủ sử dụng được tính trong chi phí khai thác, vận hành dự án;
d) Chi phí hỗ trợ giám sát đầu tư của cộng đồng được sử dụng từ nguồn ngân sách nhà nước theo kế hoạch hàng năm của Ủy ban Mặt trận Tổ quốc cấp xã, do ngân sách cấp xã đảm bảo.
3. Định mức chi phí giám sát, đánh giá đầu tư:
a) Chi phí cho công tác giám sát đầu tư do chủ chương trình, chủ đầu tư, nhà đầu tư, cơ quan ký kết hợp đồng dự án PPP tự thực hiện được tính bằng 10% chi phí quản lý chương trình, dự án;
b) Chi phí cho công tác đánh giá đầu tư được tính bằng % chi phí quản lý chương trình, dự án theo quy định hiện hành như sau: chi phí đánh giá ban đầu: 2%; chi phí đánh giá giữa kỳ hoặc giai đoạn: 2%; chi phí đánh giá kết thúc: 3%; chi phí đánh giá đột xuất: 3%.
Trường hợp vận dụng định mức chi phí không phù hợp hoặc chương trình, dự án có quy mô lớn hoặc trường hợp cần phải thuê tư vấn nước ngoài, liên danh tư vấn trong nước và tư vấn nước ngoài thực hiện thì tổ chức lập dự toán để xác định chi phí.
4. Các cơ quan, tổ chức, cá nhân được giao nhiệm vụ giám sát, đánh giá đầu tư quy định tại Nghị định này sử dụng vốn ngân sách nhà nước hoặc các nguồn vốn đầu tư khác để thực hiện công tác giám sát, đánh giá đầu tư phải đảm bảo đúng mục đích, tiết kiệm, hiệu quả theo chế độ quản lý tài chính hiện hành của nhà nước và quy định tại Nghị định này.
Điều 89. Nội dung chi phí giám sát, đánh giá đầu tư1. Chi cho công tác theo dõi chương trình, dự án đầu tư:
a) Chi mua văn phòng phẩm, vật tư, trang thiết bị phục vụ trực tiếp cho công tác theo dõi chương trình, dự án đầu tư;
b) Chi phí cho thông tin, liên lạc phục vụ trực tiếp cho công tác theo dõi chương trình, dự án đầu tư;
c) Chi phí sao chụp, đánh máy, gửi tài liệu, gửi báo cáo;
d) Chi phí hành chính cho các cuộc họp, hội nghị;
đ) Chi phí xây dựng báo cáo định kỳ theo quy định;
e) Chi phí tổ chức các lớp tập huấn, hướng dẫn nghiệp vụ;
g) Chi phí cho việc lập, cập nhật báo cáo và vận hành Hệ thống thông tin về giám sát, đánh giá đầu tư.
2. Chi cho công tác kiểm tra chương trình, dự án đầu tư:
a) Chi mua văn phòng phẩm, vật tư, trang thiết bị phục vụ trực tiếp cho công tác kiểm tra chương trình, dự án đầu tư;
b) Chi phí cho thông tin, liên lạc phục vụ trực tiếp cho công tác kiểm tra chương trình, dự án đầu tư;
c) Chi phí sao chụp, đánh máy, gửi tài liệu, gửi báo cáo;
d) Chi phí hành chính cho các cuộc họp, hội nghị;
đ) Chi phí tàu xe đi lại và cước hành lý, tài liệu mang theo để làm việc (nếu có); tiền phụ cấp lưu trú, tiền thuê chỗ ở cho người đi công tác;
e) Chi phí xây dựng báo cáo kết quả kiểm tra.
3. Chi cho công tác đánh giá chương trình, dự án đầu tư:
a) Chi mua văn phòng phẩm, vật tư, trang thiết bị phục vụ trực tiếp cho công tác đánh giá chương trình, dự án đầu tư;
b) Chi phí cho thông tin, liên lạc phục vụ trực tiếp cho công tác đánh giá chương trình, dự án đầu tư;
c) Chi phí sao chụp, đánh máy, gửi tài liệu, gửi báo cáo;
d) Chi phí hành chính cho các cuộc họp, hội nghị;
đ) Chi phí tàu xe đi lại và cước hành lý, tài liệu mang theo để làm việc (nếu có); tiền phụ cấp lưu trú, tiền thuê chỗ ở cho người đi công tác;
e) Chi phí xây dựng báo cáo kết quả đánh giá chương trình, dự án;
g) Chi phí thuê chuyên gia, tư vấn.
4. Chi cho công tác giám sát, đánh giá tổng thể đầu tư:
a) Chi mua văn phòng phẩm, vật tư, trang thiết bị phục vụ trực tiếp cho công tác giám sát, đánh giá tổng thể đầu tư;
b) Chi phí cho thông tin, liên lạc phục vụ trực tiếp cho công tác giám sát, đánh giá tổng thể đầu tư;
c) Chi phí sao chụp, đánh máy, gửi tài liệu, gửi báo cáo;
d) Chi phí hành chính cho các cuộc họp, hội nghị;
đ) Chi phí tàu xe đi lại và cước hành lý, tài liệu mang theo để làm việc (nếu có); tiền phụ cấp lưu trú, tiền thuê chỗ ở cho người đi công tác;
e) Chi phí xây dựng báo cáo kết quả kiểm tra tổng thể đầu tư;
g) Chi phí xây dựng báo cáo kết quả giám sát, đánh giá tổng thể đầu tư;
h) Chi phí thuê chuyên gia, tư vấn.
5. Chi phí cho việc vận hành Hệ thống thông tin về giám sát, đánh giá đầu tư theo quy định tại Điều 101 Nghị định này,
6. Chi phí hỗ trợ giám sát đầu tư của cộng đồng:
a) Chi phí mua văn phòng phẩm; thông tin, liên lạc phục vụ giám sát đầu tư của cộng đồng;
b) Chi phí sao chụp, đánh máy, gửi tài liệu, gửi báo cáo giám sát đầu tư của cộng đồng;
c) Chi phí hành chính cho các cuộc họp, hội nghị về giám sát đầu tư của cộng đồng;
d) Chi phí tổ chức các lớp tập huấn, hướng dẫn về giám sát đầu tư của cộng đồng;
đ) Chi thù lao trách nhiệm cho các thành viên của Ban giám sát đầu tư của cộng đồng.
Điều 90. Quản lý, sử dụng chi phí giám sát, đánh giá đầu tư1. Việc quản lý, sử dụng chi phí giám sát, đánh giá đầu tư của chủ chương trình đầu tư công, chủ đầu tư dự án đầu tư công thực hiện theo quy định về quản lý chi phí chương trình, dự án đầu tư.
2. Quản lý, sử dụng chi phí giám sát, đánh giá đầu tư của người có thẩm quyền quyết định đầu tư, nhà đầu tư dự án sử dụng vốn nhà nước ngoài đầu tư công và cơ quan quản lý nhà nước có thẩm quyền ký kết và thực hiện Hợp đồng dự án PPP thực hiện theo quy định tại khoản 1 Điều này.
3. Quản lý, sử dụng chi phí giám sát, đánh giá đầu tư của nhà đầu tư các dự án sử dụng nguồn vốn khác: Nhà đầu tư tự quản lý và sử dụng nguồn kinh phí giám sát, đánh giá đầu tư theo tính chất quản lý nguồn vốn đầu tư của dự án.
4. Quản lý, sử dụng chi phí giám sát, đánh giá đầu tư của cơ quan quản lý nhà nước có thẩm quyền.
a) Hằng năm cơ quan quản lý nhà nước có thẩm quyền giám sát, đánh giá đầu tư lập kế hoạch và dự toán chi sự nghiệp, chi thường xuyên cho nhiệm vụ giám sát, đánh giá đầu tư. Dự toán chi cho nhiệm vụ giám sát, đánh giá đầu tư được lập trên cơ sở kế hoạch giám sát, đánh giá đầu tư, nội dung chi theo quy định tại Điều 89 Nghị định này và định mức theo quy định hiện hành;
b) Việc quản lý chi phí giám sát, đánh giá đầu tư thực hiện theo quy định về quản lý và sử dụng nguồn chi sự nghiệp, chi thường xuyên của cơ quan có thẩm quyền hoặc theo Luật Ngân sách nhà nước;
c) Trường hợp cơ quan quản lý nhà nước có thẩm quyền thuê tư vấn để thực hiện đánh giá chương trình, dự án đầu tư thì việc quản lý chi phí này như quản lý chi phí dịch vụ tư vấn. Việc tạm ứng, thanh toán vốn cho tư vấn đánh giá chương trình, dự án được thực hiện theo quy định hiện hành về quản lý cấp phát, thanh toán vốn đầu tư đối với các tổ chức tư vấn đầu tư và xây dựng.
5. Quản lý, sử dụng chi phí hỗ trợ giám sát đầu tư của cộng đồng:
a) Chi phí hỗ trợ giám sát đầu tư của cộng đồng trên địa bàn cấp xã được cân đối trong dự toán chi của Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã và do ngân sách cấp xã đảm bảo. Mức kinh phí hỗ trợ giám sát đầu tư của cộng đồng trên địa bàn xã bố trí phù hợp với kế hoạch hoạt động giám sát đầu tư của cộng đồng do Hội đồng nhân dân xã quyết định và đảm bảo mức kinh phí tối thiểu 10 triệu đồng/năm cho một xã.
Việc lập dự toán, cấp phát, thanh toán và quyết toán kinh phí cho Ban giám sát đầu tư của cộng đồng thực hiện theo quy định về quản lý ngân sách cấp xã và các hoạt động tài chính khác của cấp xã;
b) Chi phí hỗ trợ công tác tuyên truyền, tổ chức các lớp tập huấn, hướng dẫn, sơ kết, tổng kết về giám sát đầu tư của cộng đồng ở cấp huyện, tỉnh được cân đối trong dự toán chi của Ủy ban Mặt trận Tổ quốc cấp huyện, cấp tỉnh và do ngân sách cấp huyện, cấp tỉnh đảm bảo.
6. Việc lập dự toán chi phí giám sát và đánh giá đầu tư và quản lý chi phí giám sát và đánh giá đầu tư thực hiện theo quy định hiện hành.
COSTS OF INVESTMENT SUPERVISION AND ASSESSMENT
Article 88. Costs of and sources of capital for investment supervision and assessment
1. Costs of supervision and assessment of investment are the costs necessary for agencies, organizations and individuals to supervise and assess investment as prescribed by this Decree.
2. Sources of capital for investment supervision and assessment:
a) The costs of supervision and assessment of investment carried out by competent authorities shall be covered by their budgets and regular funding sources for supervision and assessment of investment according to their annual plans;
b) The costs of supervision and assessment of investment carried out by program owners, project owners and authorities signing PPP project contracts or organizations hired by such authorities shall be included in the total investment of the programs/projects;
c) The costs of supervision and assessment of investment carried out by operators shall be included in the costs of project operation;
d) The costs of public supervision of investment covered by the state budget according to annual plans of Vietnamese Fatherland Front Committees of communes shall be covered by the communes.
3. Maximum costs of investment supervision and assessment:
a) The cost of investment supervision carried out by a program owner, project owner or authority signing the PPP project contract is 10% of the program/project management cost;
b) The cost of investment assessment is expressed in percentage of the cost of management of a program/project in accordance with applicable regulations as follows: cost of initial assessment: 2%; cost of midterm assessment: 2%; cost of terminal assessment: 3%; cost of ad hoc assessment: 3%.
If the maximum cost is inappropriate or the program/project is on a large scale or it is necessary to hire a foreign consultant or domestic-foreign joint venture, a cost estimate shall be made to determine the cost.
4. The agencies, organizations, and individuals assigned to carry out supervision and assessment of investment in this Decree have the responsibility to use the state budget or other sources of capital for intended purposes and in an economical and efficient manner according to applicable regulations on financial management of the State and this Decree.
Article 89. Specific costs of supervision and assessment of investment
1. Costs of monitoring investment programs/projects:
a) Expenditures on stationery, supplies and equipment directly serving the monitoring of investment programs/projects;
b) Costs of communication directly serving the monitoring of investment programs/projects;
c) Cost of photocopying, typing, sending documents and reports;
d) Administrative costs of meetings and conventions;
dd) Costs of making periodic reports;
e) Costs of provision of training;
g) Cost of making and updating reports on investment supervision and assessment, and operating the investment supervision and assessment information system.
2. Costs of inspection of investment programs/projects:
a) Expenditures on stationery, supplies and equipment directly serving the inspection of investment programs/projects;
b) Costs of communication directly serving the inspection of investment programs/projects;
c) Cost of photocopying, typing, sending documents and reports;
d) Administrative costs of meetings and conventions;
dd) Travel costs (including luggage charges); allowance for accommodations during business trips;
e) Costs of making inspection result reports.
3. Costs of assessment of investment programs/projects:
a) Expenditures on stationery, supplies and equipment directly serving the assessment of investment programs/projects;
b) Costs of communication directly serving the assessment of investment programs/projects;
c) Cost of photocopying, typing, sending documents and reports;
d) Administrative costs of meetings and conventions;
dd) Travel costs (including luggage charges); allowance for accommodations during business trips;
e) Costs of making assessment result reports.
g) Costs of hiring experts and consultants.
4. Costs of overall investment supervision and assessment:
a) Expenditures on stationery, supplies and equipment directly serving the overall investment supervision and assessment;
b) Costs of communication directly serving the overall investment supervision and assessment;;
c) Cost of photocopying, typing, sending documents and reports;
d) Administrative costs of meetings and conventions;
dd) Travel costs (including luggage charges); allowance for accommodations during business trips;
e) Costs of making reports on overall investment inspection results;
g) Costs of making reports on overall investment supervision and assessment results;
h) Costs of hiring experts and consultants.
5. The costs of operating the investment supervision and assessment information system shall comply with Article 101 of this Decree.
6. Costs of public supervision of investment:
a) Costs of stationery and communication serving public supervision of investment;
b) Cost of photocopying, typing, sending documents and reports on public supervision of investment;
c) Administrative costs of meetings and conventions about public supervision of investment;
d) Costs of provision of training courses on public supervision of investment;
dd) Liability payment for members of Public Investment Supervision Boards.
Article 90. Management and use of funding for supervision and assessment of investment
1. Funding for supervision and assessment of investment by owners of public investment programs and owners of public investment projects shall comply with regulations on cost management of investment programs/projects.
2. Management and use of funding for supervision and assessment of investment by investment deciders, investors in projects funded by non-public investment state capital and regulatory authorities competent to conclude and execute PPP contracts shall comply with Clause 1 of this Article.
3. Funding for supervision and assessment of investment by investors in projects funded by other sources of capital: investors shall manage and use the funding for supervision and assessment of investment on a case-by-case basis.
4. Management and use of funding for supervision and assessment of investment by competent authorities.
a) Authorities in charge of supervision and assessment of investment shall make annual plans and estimates of costs of supervision and assessment of investment. The cost estimate shall be made according to the plan for supervision and assessment of investment, the specific costs mentioned in Article 89 of this Decree, and the limits prescribed by applicable regulations;
b) Funding for supervision and assessment of investment shall comply with regulations on management and use of sources of administrative and regular funding of competent authorities or the Law on State Budget;
c) In case an authority hires a consultancy to assess the program/project, the cost management in which case is the same as management of cost of consultancy services. Advance and payment for hiring a consultancy to assess the program/project shall comply with current regulations on management of payments for investment and construction consultancy.
5. Management and use of funding for public supervision of investment
a) Funding for public supervision of investment in a commune is included in the cost estimate of Vietnamese Fatherland Front Committee of the commune, which is covered by the commune budget. The minimum funding for public supervision of investment is VND 10 million per year and varies according to the plan for public supervision of investment made by the People’s Council of the commune.
The estimation, provision and statement of funding shall be done by Public Investment Supervision Board in accordance with regulations on management of commune budget and other financial activities of the commune;
b) Funding for propagation, provision of training courses, guidance and review of public supervision of investment of each district and province shall be included in the cost estimate of Vietnamese Fatherland Front Committee of the district/province and covered by the budget of the district/province.
6. The estimation and management of funding for supervision and assessment of investment shall comply with applicable regulations.
