Điều 13. Hồ sơ, thủ tục trình thẩm định nội bộ của chủ đầu tư hoặc đơn vị trực thuộc cơ quan được giao chuẩn bị đầu tư
1. Hồ sơ trình thẩm định nội bộ gồm;
a) Tờ trình thẩm định nội bộ của chủ đầu tư hoặc đơn vị trực thuộc cơ quan được giao chuẩn bị đầu tư;
b) Báo cáo nghiên cứu tiền khả thi;
c) Tài liệu khác có liên quan (nếu có).
2. Chủ đầu tư hoặc đơn vị trực thuộc cơ quan được giao chuẩn bị đầu tư gửi 15 bộ hồ sơ dự án theo quy định tại khoản 1 Điều này đến cơ quan chủ quản của mình hoặc cơ quan được giao chuẩn bị đầu tư để tổ chức thẩm định nội bộ theo quy định tại điểm b khoản 1 Điều 19 Luật Đầu tư công. Thời gian thẩm định nội bộ không quá 30 ngày kể từ ngày nhận đủ hồ sơ hợp lệ.
Điều 14. Hồ sơ, thủ tục trình thẩm định của cơ quan chủ quản chủ đầu tư hoặc cơ quan được giao nhiệm vụ chuẩn bị đầu tư1. Hồ sơ trình thẩm định gồm:
a) Tờ trình Thủ tướng Chính phủ của cơ quan chủ quản hoặc cơ quan được giao nhiệm vụ chuẩn bị đầu tư;
b) Báo cáo nghiên cứu tiền khả thi đã được hoàn thiện theo ý kiến thẩm định nội bộ;
c) Báo cáo thẩm định nội bộ;
d) Tài liệu khác có liên quan (nếu có).
2. Cơ quan chủ quản chủ đầu tư hoặc cơ quan được giao nhiệm vụ chuẩn bị đầu tư gửi 01 bộ hồ sơ theo quy định tại khoản 1 Điều này để báo cáo Thủ tướng Chính phủ, đồng thời gửi 20 bộ hồ sơ đến Bộ Kế hoạch và Đầu tư.
3. Trong thời hạn 15 ngày kể từ ngày nhận hồ sơ dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
4. Hội đồng thẩm định nhà nước thẩm định chủ trương đầu tư dự án quan trọng quốc gia trong thời hạn 90 ngày kể từ ngày thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng thuê tư vấn thẩm tra.
Điều 15. Hồ sơ, thủ tục trình thẩm định của Hội đồng thẩm định nhà nước và của Chính phủ1. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước, gồm:
a) Tờ trình Chính phủ của cơ quan chủ quản hoặc cơ quan được giao nhiệm vụ chuẩn bị đầu tư;
b) Báo cáo nghiên cứu tiền khả thi;
c) Báo cáo thẩm định của Hội đồng thẩm định nhà nước;
d) Tài liệu khác có liên quan (nếu có).
2. Chính phủ xem xét, cho ý kiến về chủ trương đầu tư dự án quan trọng quốc gia theo quy chế làm việc của Chính phủ.
3. Hồ sơ Chính phủ trình Quốc hội theo quy định tại Điều 20 Luật Đầu tư công gồm:
a) Tờ trình của Chính phủ;
b) Các tài liệu theo quy định tại khoản 1 Điều này;
c) Tài liệu khác có liên quan (nếu có).
Điều 16. Nội dung thẩm định quyết định chủ trương đầu tư dự án quan trọng quốc gia sử dụng vốn đầu tư công1. Đánh giá về hồ sơ dự án: căn cứ pháp lý, thành phần, nội dung hồ sơ theo quy định.
2. Việc đáp ứng các tiêu chí xác định dự án là dự án quan trọng quốc gia.
3. Sự cần thiết đầu tư, các điều kiện để thực hiện đầu tư, đánh giá về sự phù hợp với chiến lược, kế hoạch phát triển kinh tế - xã hội và quy hoạch có liên quan theo quy định của pháp luật về quy hoạch.
4. Đánh giá về dự báo nhu cầu, phạm vi phục vụ và dự kiến mục tiêu đầu tư, quy mô và hình thức đầu tư.
5. Đánh giá về khu vực, địa điểm đầu tư, dự kiến nhu cầu diện tích sử dụng đất và nhu cầu sử dụng tài nguyên khác (nếu có); đánh giá về phương án bồi thường, hỗ trợ, giải phóng mặt bằng, tái định cư.
6. Đánh giá về việc phân tích, lựa chọn sơ bộ về công nghệ, kỹ thuật chính và các điều kiện cung cấp vật tư, thiết bị, nguyên liệu, năng lượng, dịch vụ, hạ tầng.
7. Đánh giá về việc phân tích, lựa chọn sơ bộ các phương án đầu tư và quy mô các hạng mục đầu tư.
8. Đánh giá sơ bộ tác động môi trường (nếu có) theo quy định của pháp luật về bảo vệ môi trường.
9. Đánh giá về việc xác định sơ bộ tổng mức đầu tư, phương án huy động vốn: căn cứ xác định sơ bộ tổng mức đầu tư; cơ cấu nguồn vốn; phân tích sơ bộ tính khả thi của các phương án huy động vốn và khả năng cân đối nguồn vốn đầu tư công.
10. Đánh giá về việc xác định sơ bộ chi phí vận hành, bảo dưỡng, duy tu, sửa chữa lớn trong giai đoạn khai thác vận hành dự án.
11. Đánh giá về tiến độ dự kiến thực hiện dự án, phân chia giai đoạn đầu tư hoặc phân chia các dự án thành phần hoặc tiểu dự án (nếu có).
12. Đánh giá sơ bộ về hiệu quả đầu tư: hiệu quả tài chính, hiệu quả kinh tế - xã hội, quốc phòng, an ninh và phát triển bền vững.
13. Đánh giá về các giải pháp tổ chức thực hiện dự án: xác định chủ đầu tư (nếu có); hình thức quản lý dự án.
14. Đánh giá về cơ chế, chính sách đặc thù; ưu đãi, hỗ trợ đầu tư và điều kiện áp dụng (nếu có).
Mục 2. HỒ SƠ, THỦ TỤC VÀ NỘI DUNG THẨM ĐỊNH QUYẾT ĐỊNH CHỦ TRƯƠNG ĐẦU TƯ DỰ ÁN PPP THUỘC THẨM QUYỀN QUYẾT ĐỊNH CHỦ TRƯƠNG ĐẦU TƯ CỦA QUỐC HỘIĐiều 17. Hồ sơ, thủ tục trình thẩm định
1. Hồ sơ trình thẩm định:
a) Hồ sơ trình thẩm định của cơ quan có thẩm quyền gồm các tài liệu theo quy định tại khoản 1 Điều 15 Luật Đầu tư theo phương thức đối tác công tư.
b) Hồ sơ trình thẩm định của nhà đầu tư gồm các tài liệu theo quy định tại điểm c khoản 1 Điều 27 Luật Đầu tư theo phương thức đối tác công tư.
2. Cơ quan có thẩm quyền gửi 01 bộ hồ sơ theo quy định tại khoản 1 Điều này để báo cáo Thủ tướng Chính phủ, đồng thời gửi 20 bộ hồ sơ đến Bộ Kế hoạch và Đầu tư.
3. Trong thời hạn 15 ngày kể từ ngày nhận hồ sơ dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
4. Hội đồng thẩm định nhà nước thẩm định chủ trương đầu tư dự án trong thời hạn 90 ngày kể từ ngày thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng tư vấn thẩm tra.
5. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước, gồm:
a) Các tài liệu theo quy định tại khoản 1 Điều này;
b) Báo cáo thẩm định của Hội đồng thẩm định nhà nước;
c) Tài liệu khác có liên quan (nếu có).
6. Chính phủ xem xét, cho ý kiến về chủ trương đầu tư dự án theo quy chế làm việc của Chính phủ.
7. Hồ sơ Chính phủ trình Quốc hội thực hiện theo quy định tại Điều 16 Luật Đầu tư theo phương thức đối tác công tư.
Điều 18. Nội dung thẩm định quyết định chủ trương đầu tư dự án1. Đánh giá về hồ sơ dự án: căn cứ pháp lý, thành phần, nội dung hồ sơ theo quy định.
2. Việc đáp ứng các tiêu chí xác định dự án là dự án thuộc thẩm quyền quyết định chủ trương đầu tư của Quốc hội.
3. Sự phù hợp với điều kiện lựa chọn dự án để đầu tư theo phương thức PPP quy định tại khoản 1 Điều 14 của Luật Đầu tư theo phương thức đối tác công tư.
4. Sự phù hợp với căn cứ lập báo cáo nghiên cứu tiền khả thi quy định tại khoản 2 Điều 14 của Luật Đầu tư theo phương thức đối tác công tư.
5. Sự phù hợp với chiến lược, kế hoạch phát triển kinh tế - xã hội và quy hoạch có liên quan theo quy định của pháp luật về quy hoạch.
6. Đánh giá về mục tiêu; dự kiến quy mô, địa điểm, thời gian thực hiện dự án, nhu cầu sử dụng đất và tài nguyên khác.
7. Đánh giá về việc phân tích, lựa chọn sơ bộ về công nghệ, kỹ thuật chính và các điều kiện cung cấp vật tư, thiết bị, nguyên liệu, năng lượng, dịch vụ, hạ tầng.
8. Đánh giá về việc phân tích, lựa chọn sơ bộ các phương án đầu tư và quy mô các hạng mục đầu tư.
9. Đánh giá về phương án bồi thường, hỗ trợ, giải phóng mặt bằng, tái định cư.
10. Đánh giá sơ bộ tác động môi trường (nếu có) theo quy định của pháp luật về bảo vệ môi trường.
11. Đánh giá về việc xác định sơ bộ tổng mức đầu tư.
12. Đánh giá về việc xác định sơ bộ chi phí vận hành, bảo dưỡng, duy tu, sửa chữa lớn trong giai đoạn khai thác vận hành dự án.
13. Đánh giá về phân chia giai đoạn đầu tư hoặc phân chia các dự án thành phần hoặc tiểu dự án (nếu có).
14. Đánh giá sơ bộ hiệu quả đầu tư: hiệu quả tài chính, hiệu quả kinh tế - xã hội; tác động của việc thực hiện dự án theo phương thức PPP đối với cộng đồng, dân cư trong phạm vi dự án; tác động của dự án đối với việc bảo đảm quốc phòng, an ninh và phát triển bền vững; khả năng thu hồi vốn cho nhà đầu tư.
15. Sự phù hợp của loại hợp đồng dự án PPP.
16. Cơ chế chia sẻ phần giảm doanh thu.
17. Nguồn vốn và khả năng cân đối vốn đối với dự án PPP có sử dụng vốn nhà nước.
18. Đánh giá về hình thức quản lý dự án.
19. Đánh giá về cơ chế, chính sách đặc thù; ưu đãi, hỗ trợ đầu tư và điều kiện áp dụng (nếu có).
Mục 3. HỒ SƠ, THỦ TỤC VÀ NỘI DUNG THẨM ĐỊNH CHẤP THUẬN CHỦ TRƯƠNG ĐẦU TƯ DỰ ÁN THUỘC THẨM QUYỀN CHẤP THUẬN CHỦ TRƯƠNG ĐẦU TƯ CỦA QUỐC HỘIĐiều 19. Hồ sơ, thủ tục trình thẩm định của nhà đầu tư hoặc cơ quan nhà nước có thẩm quyền
1. Hồ sơ trình thẩm định:
a) Hồ sơ trình thẩm định chấp thuận chủ trương đầu tư dự án do nhà đầu tư đề xuất thực hiện theo quy định tại khoản 1 Điều 33 Luật Đầu tư;
b) Hồ sơ trình thẩm định chấp thuận chủ trương đầu tư dự án do cơ quan nhà nước có thẩm quyền lập thực hiện theo quy định tại khoản 2 Điều 33 Luật Đầu tư.
2. Nhà đầu tư hoặc cơ quan nhà nước có thẩm quyền nộp 20 bộ hồ sơ theo quy định tại khoản 1 Điều này đến Bộ Kế hoạch và Đầu tư.
3. Trong thời hạn 15 ngày kể từ ngày nhận đủ hồ sơ dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
4. Hội đồng thẩm định nhà nước thẩm định chủ trương đầu tư dự án trong thời hạn 90 ngày kể từ ngày thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng tư vấn thẩm tra.
Điều 20. Hồ sơ, thủ tục trình thẩm định của Hội đồng thẩm định nhà nước và của Chính phủ1. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước, gồm:
a) Hồ sơ theo quy định tại khoản 1 Điều 19 Nghị định này;
b) Báo cáo thẩm định của Hội đồng thẩm định nhà nước;
c) Tài liệu khác có liên quan (nếu có).
2. Chính phủ xem xét, cho ý kiến về chủ trương đầu tư dự án quan trọng quốc gia theo quy chế làm việc của Chính phủ.
3. Hồ sơ Chính phủ trình Quốc hội theo quy định tại khoản 5 Điều 34 Luật Đầu tư gồm:
a) Tờ trình của Chính phủ;
b) Các tài liệu theo quy định tại khoản 1 Điều này;
c) Tài liệu khác có liên quan (nếu có).
Điều 21. Nội dung thẩm định chấp thuận chủ trương đầu tư1. Nội dung thẩm định chấp thuận chủ trương đầu tư bao gồm:
a) Đánh giá về hồ sơ dự án: căn cứ pháp lý, thành phần, nội dung hồ sơ theo quy định;
b) Việc đáp ứng tiêu chí xác định dự án đầu tư thuộc thẩm quyền chấp thuận chủ trương đầu tư của Quốc hội;
c) Sự cần thiết thực hiện dự án đầu tư:
d) Sự phù hợp của dự án đầu tư với chiến lược, quy hoạch cấp quốc gia, quy hoạch vùng, quy hoạch tỉnh, quy hoạch đô thị và quy hoạch đơn vị hành chính - kinh tế đặc biệt (nếu có);
đ) Mục tiêu, quy mô, địa điểm, thời gian, tiến độ thực hiện dự án đầu tư, nhu cầu sử dụng đất, phương án giải phóng mặt bằng, di dân tái định cư, phương án lựa chọn công nghệ chính;
e) Đánh giá về công nghệ sử dụng trong dự án đầu tư đối với dự án thuộc diện thẩm định hoặc lấy ý kiến về công nghệ theo quy định của pháp luật về chuyển giao công nghệ;
g) Đánh giá về việc xác định sơ bộ tổng vốn đầu tư; nguồn vốn và tính khả thi của nguồn vốn;
h) Đánh giá sơ bộ hiệu quả kinh tế - xã hội, bảo đảm quốc phòng, an ninh và phát triển bền vững của dự án đầu tư;
i) Đánh giá sơ bộ tác động môi trường (nếu có) theo quy định của pháp luật về bảo vệ môi trường;
k) Đánh giá về ưu đãi đầu tư và điều kiện hưởng ưu đãi đầu tư (nếu có);
l) Đánh giá về sự phù hợp của dự án đầu tư với mục tiêu, định hướng phát triển đô thị, chương trình, kế hoạch phát triển nhà ở; sơ bộ phương án phân kỳ đầu tư bảo đảm yêu cầu đồng bộ; sơ bộ cơ cấu sản phẩm nhà ở và việc dành quỹ đất phát triển nhà ở xã hội; sơ bộ phương án đầu tư xây dựng, quản lý hạ tầng đô thị trong và ngoài phạm vi dự án đối với dự án đầu tư xây dựng nhà ở, khu đô thị;
m) Cơ chế, chính sách đặc biệt, ưu đãi, hỗ trợ đầu tư và Điều kiện áp dụng (nếu có).
2. Nội dung thẩm định chấp thuận chủ trương đầu tư đồng thời với chấp thuận nhà đầu tư bao gồm:
a) Các nội dung thẩm định quy định tại khoản 1 Điều này;
b) Khả năng đáp ứng Điều kiện giao đất, cho thuê đất đối với trường hợp giao đất, cho thuê đất không thông qua đấu giá quyền sử dụng đất, đấu thầu lựa chọn nhà đầu tư; khả năng đáp ứng điều kiện chuyển mục đích sử dụng đất đối với dự án có yêu cầu chuyển mục đích sử dụng đất;
c) Đánh giá việc đáp ứng điều kiện tiếp cận thị trường đối với nhà đầu tư nước ngoài (nếu có);
d) Các Điều kiện khác đối với nhà đầu tư theo quy định của pháp luật có liên quan.
Mục 4. HỒ SƠ, THỦ TỤC VÀ NỘI DUNG THẨM ĐỊNH CHẤP THUẬN CHỦ TRƯƠNG ĐẦU TƯ RA NƯỚC NGOÀIĐiều 22. Hồ sơ, thủ tục trình thẩm định của nhà đầu tư
1. Nhà đầu tư nộp 20 bộ hồ sơ theo quy định tại khoản 1 Điều 57 Luật Đầu tư cho Bộ Kế hoạch và Đầu tư.
2. Trong thời hạn 05 ngày làm việc kể từ ngày nhận đủ hồ sơ dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
3. Hội đồng thẩm định nhà nước thẩm định chấp thuận chủ trương đầu tư ra nước ngoài trong thời hạn 90 ngày kể từ ngày thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng tư vấn thẩm tra.
Điều 23. Hồ sơ, thủ tục trình thẩm định của Hội đồng thẩm định nhà nước và của Chính phủ1. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước gồm:
a) Các tài liệu theo quy định tại khoản 1 Điều 57 Luật Đầu tư;
b) Báo cáo thẩm định của Hội đồng thẩm định nhà nước;
c) Tài liệu khác có liên quan (nếu có).
2. Chính phủ xem xét, cho ý kiến về chấp thuận chủ trương đầu tư ra nước ngoài theo quy chế làm việc của Chính phủ.
3. Hồ sơ Chính phủ trình Quốc hội theo quy định tại khoản 5 Điều 57 Luật Đầu tư gồm:
a) Tờ trình của Chính phủ;
b) Các tài liệu theo quy định tại khoản 1 Điều này;
c) Tài liệu khác có liên quan (nếu có).
Điều 24. Nội dung thẩm định chấp thuận chủ trương đầu tư ra nước ngoài1. Đánh giá về hồ sơ dự án: căn cứ pháp lý, thành phần, nội dung hồ sơ theo quy định.
2. Việc đáp ứng tiêu chí xác định dự án đầu tư thuộc thẩm quyền chấp thuận chủ trương đầu tư của Quốc hội.
3. Điều kiện cấp Giấy chứng nhận đăng ký đầu tư ra nước ngoài quy định tại Điều 60 của Luật Đầu tư.
4. Tư cách pháp lý của nhà đầu tư.
5. Sự cần thiết thực hiện hoạt động đầu tư ở nước ngoài.
6. Sự phù hợp của dự án đầu tư với quy định tại khoản 1 Điều 51 của Luật Đầu tư.
7. Hình thức, quy mô, địa điểm và tiến độ thực hiện dự án đầu tư, vốn đầu tư ra nước ngoài, nguồn vốn.
8. Đánh giá mức độ rủi ro tại nước tiếp nhận đầu tư.
9. Cơ chế, chính sách đặc biệt, ưu đãi, hỗ trợ đầu tư và điều kiện áp dụng (nếu có).
Mục 5. HỒ SƠ, THỦ TỤC VÀ NỘI DUNG THẨM ĐỊNH ĐIỀU CHỈNH CHỦ TRƯƠNG ĐẦU TƯ DỰ ÁN QUAN TRỌNG QUỐC GIA SỬ DỤNG VỐN ĐẦU TƯ CÔNGĐiều 25. Hồ sơ, thủ tục trình thẩm định nội bộ điều chỉnh chủ trương đầu tư của chủ đầu tư hoặc đơn vị trực thuộc cơ quan được giao nhiệm vụ chuẩn bị đầu tư
1. Hồ sơ trình thẩm định nội bộ gồm:
a) Tờ trình thẩm định nội bộ của chủ đầu tư hoặc đơn vị trực thuộc cơ quan được giao nhiệm vụ chuẩn bị đầu tư;
b) Báo cáo nghiên cứu tiền khả thi điều chỉnh hoặc Báo cáo nghiên cứu khả thi Điều chỉnh;
c) Báo cáo giám sát, đánh giá điều chỉnh dự án đầu tư;
d) Tài liệu khác có liên quan (nếu có).
2. Chủ đầu tư hoặc đơn vị trực thuộc cơ quan được giao nhiệm vụ chuẩn bị đầu tư gửi 15 bộ hồ sơ dự án theo quy định tại khoản 1 Điều này đến cơ quan chủ quản của mình hoặc cơ quan được giao nhiệm vụ chuẩn bị đầu tư để tổ chức thẩm định nội bộ theo quy định tại điểm b khoản 2 Điều 34 và điểm b khoản 1 Điều 19 Luật Đầu tư công. Thời gian thẩm định nội bộ không quá 30 ngày kể từ ngày nhận đủ hồ sơ hợp lệ.
3. Chủ đầu tư hoặc đơn vị trực thuộc cơ quan được giao nhiệm vụ chuẩn bị đầu tư hoàn thiện hồ sơ dự án theo nội dung thẩm định nội bộ.
Điều 26. Hồ sơ, thủ tục trình thẩm định điều chỉnh chủ trương đầu tư của cơ quan chủ quản chủ đầu tư hoặc cơ quan được giao nhiệm vụ chuẩn bị đầu tư1. Hồ sơ trình thẩm định gồm:
a) Tờ trình Thủ tướng Chính phủ của cơ quan chủ quản chủ đầu tư hoặc của cơ quan được giao nhiệm vụ chuẩn bị đầu tư;
b) Báo cáo nghiên cứu tiền khả thi điều chỉnh hoặc Báo cáo nghiên cứu khả thi điều chỉnh đã được hoàn thiện theo ý kiến thẩm định nội bộ;
c) Báo cáo thẩm định nội bộ theo quy định tại khoản 2 Điều 29 Nghị định này;
d) Báo cáo giám sát, đánh giá điều chỉnh dự án đầu tư;
đ) Tài liệu khác có liên quan (nếu có).
2. Cơ quan chủ quản chủ đầu tư hoặc cơ quan được giao nhiệm vụ chuẩn bị đầu tư gửi 01 bộ hồ sơ theo quy định tại khoản 1 Điều này để báo cáo Thủ tướng Chính phủ, đồng thời gửi 20 bộ hồ sơ đến Bộ Kế hoạch và Đầu tư.
3. Trong thời hạn 15 ngày kể từ ngày nhận hồ sơ dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
4. Hội đồng thẩm định nhà nước thẩm định điều chỉnh chủ trương đầu tư dự án trong thời hạn 90 ngày kể từ ngày thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng tư vấn thẩm tra.
Điều 27. Hồ sơ, thủ tục trình thẩm định của Hội đồng thẩm định nhà nước và của Chính phủ1. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước gồm:
a) Các tài liệu theo quy định tại khoản 1 Điều 26 Nghị định này;
b) Báo cáo thẩm định của Hội đồng thẩm định nhà nước;
c) Tài liệu khác có liên quan (nếu có).
2. Chính phủ xem xét, cho ý kiến về Điều chỉnh chủ trương đầu tư dự án theo quy chế làm việc của Chính phủ.
3. Hồ sơ Chính phủ trình Quốc hội gồm:
a) Tờ trình của Chính phủ;
b) Các tài liệu theo quy định tại khoản 1 Điều này;
c) Tài liệu khác có liên quan (nếu có).
Điều 28. Nội dung thẩm định điều chỉnh chủ trương đầu tư dự án quan trọng quốc gia sử dụng vốn đầu tư côngCác nội dung điều chỉnh phải được thẩm định; nội dung thẩm định điều chỉnh chủ trương đầu tư tương ứng với các nội dung thẩm định theo quy định tại Điều 16 Nghị định này.
Mục 6. HỒ SƠ, THỦ TỤC VÀ NỘI DUNG THẨM ĐỊNH ĐIỀU CHỈNH CHỦ TRƯƠNG ĐẦU TƯ DỰ ÁN PPP THUỘC THẨM QUYỀN QUYẾT ĐỊNH CHỦ TRƯƠNG ĐẦU TƯ CỦA QUỐC HỘIĐiều 29. Hồ sơ, thủ tục trình thẩm định điều chỉnh chủ trương đầu tư
1. Hồ sơ trình thẩm định của cơ quan có thẩm quyền thực hiện theo quy định tại khoản 4 Điều 18 Luật Đầu tư theo phương thức đối tác công tư.
2. Cơ quan có thẩm quyền gửi 01 bộ hồ sơ theo quy định tại khoản 1 Điều này để báo cáo Thủ tướng Chính phủ, đồng thời gửi 20 bộ hồ sơ đến Bộ Kế hoạch và Đầu tư.
3. Trong thời hạn 15 ngày kể từ ngày nhận hồ sơ dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
4. Hội đồng thẩm định nhà nước thẩm định điều chỉnh chủ trương đầu tư dự án quan trọng quốc gia trong thời hạn 90 ngày kể từ ngày thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng tư vấn thẩm tra.
5. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước gồm:
a) Các tài liệu theo quy định tại khoản 1 Điều này;
b) Báo cáo thẩm định của Hội đồng thẩm định nhà nước;
c) Tài liệu khác có liên quan (nếu có).
6. Chính phủ xem xét, cho ý kiến về điều chỉnh chủ trương đầu tư dự án quan trọng quốc gia theo quy chế làm việc của Chính phủ.
7. Hồ sơ Chính phủ trình Quốc hội gồm:
a) Tờ trình của Chính phủ;
b) Các tài liệu theo quy định tại khoản 5 Điều này;
c) Tài liệu khác có liên quan (nếu có).
Điều 30. Nội dung thẩm định điều chỉnh chủ trương đầu tư dự ánCác nội dung Điều chỉnh phải được thẩm định; nội dung thẩm định điều chỉnh chủ trương đầu tư tương ứng với các nội dung thẩm định theo quy định tại Điều 18 Nghị định này.
Mục 7. HỒ SƠ, THỦ TỤC VÀ NỘI DUNG THẨM ĐỊNH CHẤP THUẬN ĐIỀU CHỈNH CHỦ TRƯƠNG ĐẦU TƯ CÁC DỰ ÁN ĐẦU TƯ THEO QUY ĐỊNH TẠI ĐIỀU 41 LUẬT ĐẦU TƯĐiều 31. Hồ sơ, thủ tục trình thẩm định chấp thuận điều chỉnh chủ trương đầu tư dự án
1. Hồ sơ trình thẩm định của nhà đầu tư gồm:
a) Văn bản đề nghị chấp thuận điều chỉnh chủ trương đầu tư, trong đó nêu rõ các nội dung đề nghị điều chỉnh, lý do điều chỉnh;
b) Đề xuất dự án đầu tư Điều chỉnh hoặc Báo cáo nghiên cứu tiền khả thi điều chỉnh hoặc Báo cáo nghiên cứu khả thi điều chỉnh;
c) Các tài liệu quy định tại các điểm b, c, đ, e, g, h khoản 1 Điều 33 Luật Đầu tư liên quan đến các nội dung Điều chỉnh.
d) Tài liệu khác có liên quan (nếu có).
2. Nhà đầu tư nộp 20 bộ hồ sơ theo quy định tại khoản 1 Điều này đến Bộ Kế hoạch và Đầu tư.
3. Trong thời hạn 15 ngày kể từ ngày nhận đủ hồ sơ hợp lệ của dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
4. Hội đồng thẩm định nhà nước thẩm định chấp thuận điều chỉnh chủ trương đầu tư dự án trong thời hạn 90 ngày kể từ ngày có quyết định thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng tư vấn thẩm tra.
5. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước gồm:
a) Các tài liệu theo quy định tại khoản 1 Điều này;
b) Báo cáo thẩm định của Hội đồng thẩm định nhà nước;
c) Tài liệu khác có liên quan (nếu có).
6. Chính phủ xem xét, cho ý kiến về việc chấp thuận điều chỉnh chủ trương đầu tư dự án quan trọng quốc gia theo quy chế làm việc của Chính phủ.
7. Hồ sơ Chính phủ trình Quốc hội gồm:
a) Tờ trình của Chính phủ;
b) Các tài liệu theo quy định tại khoản 5 Điều này;
c) Tài liệu khác có liên quan (nếu có).
Điều 32. Nội dung thẩm định chấp thuận điều chỉnh chủ trương đầu tư dự ánCác nội dung điều chỉnh phải được thẩm định; nội dung thẩm định điều chỉnh chủ trương đầu tư tương ứng với các nội dung thẩm định theo quy định tại Điều 21 Nghị định này.
Mục 8. HỒ SƠ, THỦ TỤC VÀ NỘI DUNG THẨM ĐỊNH CHẤP THUẬN ĐIỀU CHỈNH CHỦ TRƯƠNG ĐẦU TƯ RA NƯỚC NGOÀIĐiều 33. Hồ sơ, thủ tục trình thẩm định điều chỉnh chủ trương đầu tư ra nước ngoài
1. Hồ sơ trình thẩm định của nhà đầu tư gồm:
a) Văn bản đề nghị chấp thuận Điều chỉnh chủ trương đầu tư ra nước ngoài, trong đó nêu rõ các nội dung đề nghị điều chỉnh, lý do Điều chỉnh;
b) Các tài liệu quy định tại khoản 3 Điều 63 Luật Đầu tư;
c) Tài liệu khác có liên quan (nếu có).
2. Nhà đầu tư nộp 20 bộ hồ sơ theo quy định tại khoản 1 Điều này đến Bộ Kế hoạch và Đầu tư.
3. Trong thời hạn 05 ngày làm việc kể từ ngày nhận đủ hồ sơ dự án, Bộ Kế hoạch và Đầu tư báo cáo Thủ tướng Chính phủ thành lập Hội đồng thẩm định nhà nước theo quy định tại Điều 4 Nghị định này.
4. Hội đồng thẩm định nhà nước thẩm định chấp thuận Điều chỉnh chủ trương đầu tư ra nước ngoài trong thời hạn 90 ngày kể từ ngày có quyết định thành lập. Trường hợp thuê tư vấn thẩm tra thì thời gian thẩm định của Hội đồng thẩm định nhà nước tính từ ngày ký hợp đồng tư vấn thẩm tra.
5. Hồ sơ trình Chính phủ của Hội đồng thẩm định nhà nước gồm:

Điều 34. Nội dung thẩm định chấp thuận Điều chỉnh chủ trương đầu tư dự ánCác nội dung điều chỉnh phải được thẩm định; nội dung thẩm định điều chỉnh chủ trương đầu tư tương ứng với các nội dung thẩm định theo quy định tại Điều 24 Nghị định này.
DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF DECISION ON INVESTMENT GUIDELINES AND ADJUSTMENTS TO INVESTMENT GUIDELINES OF PNS
Section 1. DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF DECISION ON INVESTMENT GUIDELINES OF PNS FUNDED BY PUBLIC INVESTMENT CAPITAL
Article 13. Documentation and procedures for application for internal appraisal by project owners or units affiliated to authorities assigned to prepare investment
1. Documentation submitted to apply for internal appraisal includes:
a) An application form for internal appraisal submitted by the project owner or unit affiliated to the authority assigned to prepare investment;
b) A pre-feasibility study report;
c) Other relevant documents (if any).
2. The project owner or unit affiliated to the authority assigned to prepare investment shall submit 15 sets of project dossiers as prescribed in Clause 1 of this Article to its supervisory authority or the authority assigned to prepare investment to carry out internal appraisal as prescribed in Point b Clause 1 Article 19 of the Law on Public Investment. The time limit for internal appraisal shall not exceed 30 days from the date of receipt of all valid documents.
Article 14. Documentation and procedures for application for appraisal by supervisory authorities or authorities assigned to prepare investment
1. Documentation submitted to apply for appraisal includes:
a) An application form filed to the Prime Minister by the supervisory authority or authority assigned to prepare investment;
b) A pre-feasibility study report that has been completed according to opinions received from the internal appraisal;
c) An internal appraisal report;
d) Other relevant documents (if any).
2. The supervisory authority or authority assigned to prepare investment shall submit 01 set of documents as prescribed in Clause 1 of this Article as a report to the Prime Minister, and concurrently submit 20 sets of documents to the Ministry of Planning and Investment.
3. Within 15 days from the receipt of the project dossiers, the Ministry of Planning and Investment shall request the Prime Minister to establish a Council as prescribed in Article 4 hereof.
4. The Council shall appraise investment guidelines of the PNS within 90 days from the date of establishment. If an inspection consultant is hired, the time limit for appraisal by the Council begins from the date on which the consultant hiring contract is signed.
Article 15. Documentation and procedures for application for appraisal by the Council and the Government
1. Documentation submitted by the Council to apply for appraisal to the Government includes:
a) An application form filed to the Government by the supervisory authority or authority assigned to prepare investment;
b) A pre-feasibility study report;
c) An appraisal report prepared by the Council;
d) Other relevant documents (if any).
2. The Government shall consider and give its opinions on investment guidelines of PNS in accordance with the Government’s working regulations.
3. Documentation submitted by the Government to the National Assembly as prescribed in Article 20 of the Law on Public Investment includes:
a) An application form prepared by the Government;
b) The documents specified in Clause 1 of this Article;
c) Other relevant documents (if any).
Article 16. Contents of appraisal of decision on investment guidelines of PNS funded by public investment capital
1. Assessment of project dossiers: legal bases, components and contents of dossiers in accordance with applied regulations.
2. Satisfaction of criteria for determination of PNS;
3. Necessity of investment, conditions for investment, assessment of conformity with socio – economic development strategies and plans, and relevant planning in accordance with the law on planning.
4. Assessment of demand forecast, influence coverage and proposed objectives of investment, scale and form of investment.
5. Assessment of location and site of investment, proposed demand for land area used and demand for utilization of other natural resources (if any); assessment of the compensation, assistance, land clearance and relocation plan.
6. Assessment of analysis, preliminary choice in terms of key technology and techniques, and conditions for supply of raw materials, equipment, energy, services and infrastructural facilities;
7. Assessment of analysis, preliminary selection of investment plans and scale of investment constituents;
8. Preliminary assessment of environmental impacts (if any) prescribed by the law on environmental protection.
9. Assessment of determination of preliminary total investment and capital raising plan: bases for determination of preliminary total investment; capital source structure; preliminary analysis of feasibility of capital raising plans and capability of balancing public investment capital.
10. Assessment of determination of preliminary costs of operation, maintenance, overhaul and major repair during the period of operation of projects.
11. Assessment of the proposed progress of execution of projects, division of investment phases or component or subordinate projects (if any).
12. Preliminary assessment of investment efficiency in terms of finance, society, economy, national defense and security and sustainable development.
13. Assessment of solutions for organizing execution of projects: definition of the project owner (if any); form of project management.
14. Assessment of particular mechanisms and policies; investment incentives and assistance and conditions for application thereof (if any).
Section 2. DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF DECISION ON INVESTMENT GUIDELINES OF PPP PROJECTS SUBJECT TO DECISION ON THEIR INVESTMENT GUIDELINES BY THE NATIONAL ASSEMBLY
Article 17. Documentation and procedures for application for appraisal
1. Documentation submitted to apply for appraisal:
a) Documentation submitted by the competent authority includes the documents specified in Clause 1 Article 15 of the Law on Public – Private Partnership Investment.
b) Documentation submitted by the investor includes the documents specified in Point c Clause 1 Article 27 of the Law on Public – Private Partnership Investment.
2. The competent authority shall submit 01 set of documents as prescribed in Clause 1 of this Article as a report to the Prime Minister, and concurrently submit 20 sets of documents to the Ministry of Planning and Investment.
3. Within 15 days from the receipt of the project dossiers, the Ministry of Planning and Investment shall request the Prime Minister to establish a Council as prescribed in Article 4 hereof.
4. The Council shall appraise investment guidelines of projects within 90 days from the date of establishment. If an inspection consultant is hired, the time limit for appraisal by the Council begins from the date on which the consultant hiring contract is signed.

Article 18. Contents of appraisal of decision on investment guidelines of projects
1. Assessment of project dossiers: legal bases, components and contents of dossiers in accordance with applied regulations.
2. Satisfaction of criteria for determination of projects subject to decision on their investment guidelines by the National Assembly.
3. Conformity with requirements for project’s eligibility for PPP investment specified in Clause 1 Article 14 of the Law on Public – Private Partnership Investment.
4. Conformity with bases for preparation of pre-feasibility study reports specified in Clause 2 Article 14 of the Law on Public – Private Partnership Investment.
5. Conformity with the socio – economic development strategies and plans, and relevant planning in accordance with the law on planning.
6. Assessment of objectives; proposed project scale, site and duration of the project, demands for use of land and other natural resources;
7. Assessment of analysis, preliminary choice in terms of key technology and techniques, and conditions for supply of raw materials, equipment, energy, services and infrastructural facilities;
8. Assessment of analysis, preliminary selection of investment plans and scale of investment constituents;
9. Assessment of the compensation, assistance, land clearance and relocation plan.
10. Preliminary assessment of environmental impacts (if any) prescribed by the law on environmental protection.
11. Assessment of determination of preliminary total investment.
12. Assessment of determination of preliminary costs of operation, maintenance, overhaul and major repair during the period of operation of projects;
13. Assessment of division of investment phases or component or subordinate projects (if any).
14. Preliminary assessment of investment efficiency in terms of finance, society, economy; effects of PPP projects on the community and population living within these projects; effects of projects on national defense, security and sustainable development; capital recovery.
15. Relevance of the PPP contract type.
16. Mechanism for distribution of revenue reductions.
17. Funding sources and capital balancing capability of PPP projects funded by state capital.
18. Assessment of form of project management.
19. Assessment of particular mechanisms and policies; investment incentives and assistance and conditions for application thereof (if any).
Section 3. DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF APPROVAL FOR INVESTMENT GUIDELINES OF PPP PROJECTS SUBJECT TO APPROVAL FOR THEIR INVESTMENT GUIDELINES BY THE NATIONAL ASSEMBLY
Article 19. Document and procedures for application for appraisal by investors or competent authorities
1. Documentation submitted to apply for appraisal:
a) Documentation submitted to apply for appraisal of approval for investment guidelines of projects proposed by investors shall comply with Clause 1 Article 33 of the Law on Investment;
b) Documentation submitted to apply for appraisal of approval for investment guidelines of projects set up by competent authorities shall comply with Clause 2 Article 33 of the Law on Investment.
2. The investor or competent authority shall submit 20 sets of documents as prescribed in Clause 1 of this Article to the Ministry of Planning and Investment.
3. Within 15 days from the receipt of the project dossiers, the Ministry of Planning and Investment shall request the Prime Minister to establish a Council as prescribed in Article 4 hereof.
4. The Council shall appraise investment guidelines of projects within 90 days from the date of establishment. If an inspection consultant is hired, the time limit for appraisal by the Council begins from the date on which the consultant hiring contract is signed.
Article 20. Documentation and procedures for application for appraisal by the Council and the Government
1. Documentation submitted by the Council to apply for appraisal to the Government includes:
a) The documents mentioned in Clause 1 Article 19 hereof;
b) An appraisal report prepared by the Council;
c) Other relevant documents (if any).
2. The Government shall consider and give its opinions on investment guidelines of PNS in accordance with the Government’s working regulations.
3. Documentation submitted by the Government to the National Assembly as prescribed in Clause 5 Article 34 of the Law on Investment includes:
a) An application form prepared by the Government;
b) The documents specified in Clause 1 of this Article;
c) Other relevant documents (if any).
Article 21. Contents of appraisal of approval for investment guidelines
1. Contents of appraisal of approval for investment guidelines include:
a) Assessment of project dossiers: legal bases, components and contents of dossiers in accordance with applied regulations.
b) Satisfaction of criteria for determination of projects subject to approval for their investment guidelines by the National Assembly;
c) Necessity of executing the investment project;
d) Conformity of the investment project with national planning, regional planning, provincial planning, urban planning and special economic - administrative unit planning (if any);
dd) Objectives, scale, location, duration, execution schedule of the investment project, demand for land use, land clearance and relocation plan, options to select primary technologies;
e) Assessment of the technology to be used in the investment project if the project requires appraisal and collection of opinions on the technology in accordance with the Law on Technology Transfer;
g) Assessment of determination of preliminary total investment; capital sources and feasibility of capital sources;
h) Preliminary assessment of investment efficiency in terms of finance, society, economy, national defense and security and sustainable development;
i) Preliminary assessment of environmental impacts (if any) prescribed by the law on environmental protection;
k) Assessment of investment incentives and conditions for enjoying investment incentives (if any);
l) Assessment of conformity of the investment project with the objectives and orientation for urban development, and residential housing development programs and plans; preliminary plan for phasing of investment with a view to synchronism assurance; preliminary structure of residential housing products and provision of land for social residential housing development; preliminary plan for investment in construction and management of urban infrastructure inside and outside the project in the case of a project on construction of residential houses and urban areas.
m) Special policies and mechanisms; investment incentives, investment assistance and conditions for application thereof (if any).
2. Contents of appraisal of approval for both investment guidelines and investors:
a) The contents specified in Clause 1 of this Article;
b) The ability to satisfy the conditions for land allocation or land lease in the case of land allocation or land lease without auction of the land use right or bidding for investor selection; the ability to satisfy the conditions for land repurposing if the project requires land repurposing;
c) Assessment of satisfaction of market access conditions applied to foreign investors (if any);
d) Other conditions applicable to the investor in accordance with relevant regulations of law.
Section 4. DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF APPROVAL FOR OUTWARD INVESTMENT GUIDELINES
Article 22. Documentation and procedures for application for appraisal by investors
1. The investor shall submit 20 sets of documents as referred to in Clause 1 Article 57 of the Law on Investment to the Ministry of Planning and Investment.
2. Within 05 working days from the receipt of all required project dossiers, the Ministry of Planning and Investment shall request the Prime Minister to establish a Council as prescribed in Article 4 hereof.
3. The Council shall appraise outward investment guidelines within 90 days from the date of establishment. If an inspection consultant is hired, the time limit for appraisal by the Council begins from the date on which the consultant hiring contract is signed.
Article 23. Documentation and procedures for application for appraisal by the Council and the Government
1. Documentation submitted by the Council to the Government includes:
a) The documents specified in Clause 1 Article 57 of the Law on Investment;
b) An appraisal report prepared by the Council;
c) Other relevant documents (if any).
2. The Government shall consider and give its opinions on outward investment guidelines in accordance with the Government’s working regulations.
3. Documentation submitted by the Government to the National Assembly as prescribed in Clause 5 Article 57 of the Law on Investment includes:
a) An application form prepared by the Government;
b) The documents specified in Clause 1 of this Article;
c) Other relevant documents (if any).
Article 24. Contents of appraisal of approval for outward investment guidelines
1. Assessment of project dossiers: legal bases, components and contents of dossiers in accordance with applied regulations.
2. Satisfaction of criteria for determination of projects subject to approval for their investment guidelines by the National Assembly;
3. Conditions for issuance of the outward investment registration certificate specified in Article 60 of the Law on Investment.
4. Legal status of the investor.
5. Necessity of conducting outward investment activities.
6. Conformity of the investment project with Clause 1 Article 51 of the Law on Investment.
7. Form, scale, location and execution schedule of the investment project, outward investment capital and sources of capital.
8. Assessment of level of risks in the host country.
9. Special policies and mechanisms; investment incentives, investment assistance and conditions for application thereof (if any).
Section 5. DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF ADJUSTMENTS TO INVESTMENT GUIDELINES OF PNS FUNDED BY PUBLIC INVESTMENT CAPITAL
Article 25. Documentation and procedures for application for internal appraisal of adjustments to investment guidelines by project owners or units affiliated to authorities assigned to prepare investment
1. Documentation submitted to apply for internal appraisal includes:
a) An application form for internal appraisal submitted by the project owner or unit affiliated to the authority assigned to prepare investment;
b) Adjusted pre-feasibility study report or adjusted feasibility study report;
c) A report on supervision and assessment of adjustments to the investment project;
d) Other relevant documents (if any).
2. The project owner or unit affiliated to the authority assigned to prepare investment shall submit 15 sets of documents as prescribed in Clause 1 of this Article to its supervisory authority or the authority assigned to prepare investment to carry out internal appraisal as prescribed in Point b Clause 2 Article 34 and Point Clause 1 Article 19 of the Law on Public Investment. The time limit for internal appraisal shall not exceed 30 days from the date of receipt of all valid documents.
3. The project owner or unit affiliated to the authority assigned to prepare investment shall complete the project dossiers based on the contents of internal appraisal.
Article 26. Documentation and procedures for application for appraisal of adjustments to investment guidelines by supervisory authorities or authorities assigned to prepare investment
1. Documentation submitted to apply for appraisal includes:
a) An application form filed to the Prime Minister by the supervisory authority or authority assigned to prepare investment;
b) Adjusted pre-feasibility study report or adjusted feasibility study report that has been completed according to opinions received from the internal appraisal;
c) The internal appraisal report specified in Clause 2 Article 29 hereof;
d) A report on supervision and assessment of adjustments to the investment project;
dd) Other relevant documents (if any).
2. The supervisory authority or authority assigned to prepare investment shall submit 01 set of documents as prescribed in Clause 1 of this Article as a report to the Prime Minister, and concurrently submit 20 sets of documents to the Ministry of Planning and Investment.
3. Within 15 days from the receipt of the project dossiers, the Ministry of Planning and Investment shall request the Prime Minister to establish a Council as prescribed in Article 4 hereof.
4. The Council shall appraise adjustments to investment guidelines of the project within 90 days from the date of establishment. If an inspection consultant is hired, the time limit for appraisal by the Council begins from the date on which the consultant hiring contract is signed.
Article 27. Documentation and procedures for application for appraisal by the Council and the Government
1. Documentation submitted by the Council to the Government includes:
a) The documents specified in Clause 1 Article 26 hereof;
b) An appraisal report prepared by the Council;
c) Other relevant documents (if any).
2. The Government shall consider and give its opinions on investment guidelines of the project in accordance with the Government’s working regulations.
3. Documentation submitted by the Government to the National Assembly includes:
a) An application form prepared by the Government;
b) The documents specified in Clause 1 of this Article;
c) Other relevant documents (if any).
Article 28. Contents of appraisal of adjustments to investment guidelines of PNS funded by public investment capital
All adjustments must be appraised in the similar manner to those referred to in Article 16 hereof.
Section 6. DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF ADJUSTMENTS TO INVESTMENT GUIDELINES OF PPP PROJECTS SUBJECT TO DECISION ON THEIR INVESTMENT GUIDELINES BY THE NATIONAL ASSEMBLY
Article 29. Documentation and procedures for application for appraisal of adjustments to investment guidelines
1. Documentation submitted by the competent authority includes the documents specified in Clause 4 Article 18 of the Law on Public – Private Partnership Investment.
2. The competent authority shall submit 01 set of documents as prescribed in Clause 1 of this Article as a report to the Prime Minister, and concurrently submit 20 sets of documents to the Ministry of Planning and Investment.
3. Within 15 days from the receipt of the project dossiers, the Ministry of Planning and Investment shall request the Prime Minister to establish a Council as prescribed in Article 4 hereof.
4. The Council shall appraise adjustments to investment guidelines of PNS within 90 days from the date of establishment. If an inspection consultant is hired, the time limit for appraisal by the Council begins from the date on which the consultant hiring contract is signed.

Section 7. . DOCUMENTATION, PROCEDURES AND CONTENTS OF APPRAISAL OF APPROVAL FOR ADJUSTMENTS TO INVESTMENT GUIDELINES OF INVESTMENT PROJECTS AS SPECIFIED IN ARTICLE 41 OF THE LAW ON INVESTMENT
Article 31. Documentation and procedures for application for appraisal of approval for adjustments to investment guidelines of projects
1. Documentation submitted by the investor to apply for appraisal includes:
a) An application form for approval for adjustments to investment guidelines, which specifies the adjustments and reason for adjustment;
b) Adjusted proposal for the investment project or adjusted pre-feasibility study report or adjusted feasibility study report;
c) The documents in Points b, c, dd, e, g and h Clause 1 Article 33 of the Law on Investment related to the adjustments.
d) Other relevant documents (if any).

Article 33. Documentation and procedures for application for appraisal of adjustments to outward investment guidelines
1. Documentation submitted by the investor to apply for appraisal includes:
a) An application form for approval for adjustments to outward investment guidelines, which specifies the adjustments and reason for adjustment;
b) The documents specified in Clause 3 Article 63 of the Law on Investment;
c) Other relevant documents (if any).
2. The investor shall submit 20 sets of documents as referred to in Clause 1 of this Article to the Ministry of Planning and Investment.
3. Within 05 working days from the receipt of all required project dossiers, the Ministry of Planning and Investment shall request the Prime Minister to establish a Council as prescribed in Article 4 hereof.
4. The Council shall appraise approval for adjustments to outward investment guidelines within 90 days from the date of establishment. If an inspection consultant is hired, the time limit for appraisal by the Council begins from the date on which the consultant hiring contract is signed.
5. Documentation submitted by the Council to the Government includes:
a) The documents specified in Clause 1 of this Article;
b) An appraisal report prepared by the Council;
c) Other relevant documents (if any).
