PHÁP LỆNH
CỦA UỶ BAN THƯỜNG VỤ QUỐC HỘI SỐ 06/2003/PL-UBTVQH11 NGÀY 09 THÁNG 01 NĂM 2003 VỀ DÂN SỐ
Dân số là một trong những yếu tố quyết định sự phát triển bền vững của đất nước.
Để nâng cao trách nhiệm của công dân, Nhà nước và xã hội trong công tác dân số; bảo vệ quyền và lợi ích hợp pháp của công dân; tăng cường, thống nhất quản lý nhà nước về dân số;
Căn cứ vào Hiến pháp nước Cộng hoà xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung theo Nghị quyết số 51/2001/QH10 ngày 25 tháng 12 năm 2001 của Quốc hội khoá X, kỳ họp thứ 10;
Căn cứ vào Nghị quyết số 12/2002/QH11 ngày 16 tháng 12 năm 2002 của Quốc hội khoá XI, kỳ họp thứ 2 về Chương trình xây dựng luật, pháp lệnh của Quốc hội nhiệm kỳ khoá XI (2002-2007) và năm 2003;
Pháp lệnh này quy định về dân số.
1. Pháp lệnh này quy định về quy mô dân số, cơ cấu dân số, phân bố dân cư, chất lượng dân số, các biện pháp thực hiện công tác dân số và quản lý nhà nước về dân số.
2. Pháp lệnh này áp dụng đối với cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội, tổ chức xã hội - nghề nghiệp, tổ chức kinh tế, đơn vị vũ trang nhân dân và mọi công dân Việt Nam (sau đây gọi chung là cơ quan, tổ chức, cá nhân); tổ chức nước ngoài hoạt động trên lãnh thổ Việt Nam, người nước ngoài thường trú trên lãnh thổ Việt Nam, trừ trường hợp điều ước quốc tế mà Cộng hoà xã hội chủ nghĩa Việt Nam ký kết hoặc gia nhập có quy định khác.
1. Bảo vệ quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân trong lĩnh vực dân số phù hợp với sự phát triển kinh tế - xã hội, chất lượng cuộc sống của cá nhân, gia đình và toàn xã hội.
2. Bảo đảm việc chủ động, tự nguyện, bình đẳng của mỗi cá nhân, gia đình trong kiểm soát sinh sản, chăm sóc sức khoẻ sinh sản, lựa chọn nơi cư trú và thực hiện các biện pháp nâng cao chất lượng dân số.
3. Kết hợp giữa quyền và lợi ích của cá nhân, gia đình với lợi ích của cộng đồng và toàn xã hội; thực hiện quy mô gia đình ít con, no ấm, bình đẳng, tiến bộ, hạnh phúc và bền vững.
Trong Pháp lệnh này, các từ ngữ dưới đây được hiểu như sau:
1. Dân số là tập hợp người sinh sống trong một quốc gia, khu vực, vùng địa lý kinh tế hoặc một đơn vị hành chính.
2. Quy mô dân số là số người sống trong một quốc gia, khu vực, vùng địa lý kinh tế hoặc một đơn vị hành chính tại thời điểm nhất định.
3. Cơ cấu dân số là tổng số dân được phân loại theo giới tính, độ tuổi, dân tộc, trình độ học vấn, nghề nghiệp, tình trạng hôn nhân và các đặc trưng khác.
4. Cơ cấu dân số già là dân số có người già chiếm tỷ lệ cao.
5. Phân bố dân cư là sự phân chia tổng số dân theo khu vực, vùng địa lý kinh tế hoặc một đơn vị hành chính.
6. Chất lượng dân số là sự phản ánh các đặc trưng về thể chất, trí tuệ và tinh thần của toàn bộ dân số.
7. Di cư là sự di chuyển dân số từ quốc gia này đến cư trú ở quốc gia khác, từ đơn vị hành chính này tới cư trú ở đơn vị hành chính khác.
8. Sức khoẻ sinh sản là sự thể hiện các trạng thái về thể chất, tinh thần và xã hội liên quan đến hoạt động và chức năng sinh sản của mỗi người.
9. Kế hoạch hoá gia đình là nỗ lực của Nhà nước, xã hội để mỗi cá nhân, cặp vợ chồng chủ động, tự nguyện quyết định số con, thời gian sinh con và khoảng cách giữa các lần sinh nhằm bảo vệ sức khoẻ, nuôi dạy con có trách nhiệm, phù hợp với chuẩn mực xã hội và điều kiện sống của gia đình.
10. Công tác dân số là việc quản lý và tổ chức thực hiện các hoạt động tác động đến quy mô dân số, cơ cấu dân số, phân bố dân cư và nâng cao chất lượng dân số.
11. Chỉ số phát triển con người (HDI) là số liệu tổng hợp để đánh giá mức độ phát triển con người, được xác định qua tuổi thọ trung bình, trình độ giáo dục và thu nhập bình quân đầu người.
12. Mức sinh thay thế là mức sinh tính bình quân trong toàn xã hội thì mỗi cặp vợ chồng có hai con.
13. Dịch vụ dân số là các hoạt động phục vụ công tác dân số, bao gồm cung cấp thông tin, tuyên truyền, giáo dục, vận động, hướng dẫn, tư vấn về dân số (sau đây gọi chung là tuyên truyền, tư vấn); cung cấp biện pháp chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình, nâng cao chất lượng dân số và các hoạt động khác theo quy định của pháp luật.
14. Đăng ký dân số là việc thu thập và cập nhật những thông tin cơ bản về dân số của mỗi người dân theo từng thời gian.
15. Hệ cơ sở dữ liệu quốc gia về dân cư là hệ thống thông tin được thu thập qua đăng ký dân số của toàn bộ dân cư và được thiết lập trên mạng điện tử.
1. Công dân có các quyền sau đây:
a) Được cung cấp thông tin về dân số;
b) Được cung cấp các dịch vụ dân số có chất lượng, thuận tiện, an toàn và được giữ bí mật theo quy định của pháp luật;
c) Lựa chọn các biện pháp chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình và nâng cao chất lượng dân số;
d) Lựa chọn nơi cư trú phù hợp với quy định của pháp luật.
2. Công dân có các nghĩa vụ sau đây:
a) Thực hiện kế hoạch hoá gia đình; xây dựng quy mô gia đình ít con, no ấm, bình đẳng, tiến bộ, hạnh phúc và bền vững;
b) Thực hiện các biện pháp phù hợp để nâng cao thể chất, trí tuệ, tinh thần của bản thân và các thành viên trong gia đình;
c) Tôn trọng lợi ích của Nhà nước, xã hội, cộng đồng trong việc điều chỉnh quy mô dân số, cơ cấu dân số, phân bố dân cư, nâng cao chất lượng dân số;
d) Thực hiện các quy định của Pháp lệnh này và các quy định khác của pháp luật có liên quan đến công tác dân số.
1. Nhà nước có chính sách, biện pháp để triển khai công tác dân số, thực hiện xã hội hoá công tác dân số, bảo đảm điều kiện thuận lợi cho công tác dân số phù hợp với sự phát triển kinh tế - xã hội của đất nước.
2. Nhà nước có chính sách khuyến khích tổ chức, cá nhân đầu tư, hợp tác, giúp đỡ, hỗ trợ chương trình chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình, nâng cao chất lượng dân số, ưu tiên đối với người nghèo, đồng bào các dân tộc thiểu số, vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn, vùng có điều kiện kinh tế - xã hội khó khăn.
3. Cơ quan quản lý nhà nước về dân số có trách nhiệm chỉ đạo thực hiện công tác dân số; phối hợp với Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên của Mặt trận để triển khai công tác dân số; thanh tra, kiểm tra việc thi hành pháp luật về dân số.
4. Cơ quan, tổ chức trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm:
a) Lồng ghép các yếu tố dân số trong quy hoạch, kế hoạch, chính sách phát triển kinh tế - xã hội;
b) Tuyên truyền, vận động thực hiện công tác dân số;
c) Cung cấp các loại dịch vụ dân số;
d) Tổ chức thực hiện pháp luật về dân số trong cơ quan, tổ chức mình.
Mặt trận Tổ quốc Việt Nam và các đoàn thể nhân dân có trách nhiệm:
1. Tham gia ý kiến vào việc hoạch định chính sách, xây dựng quy hoạch, kế hoạch dân số và các văn bản quy phạm pháp luật về dân số;
2. Tổ chức thực hiện công tác dân số trong hệ thống của mình;
3. Tuyên truyền, vận động đoàn viên, hội viên và toàn dân thực hiện pháp luật về dân số;
4. Giám sát việc thực hiện pháp luật về dân số.
Nghiêm cấm các hành vi sau đây:
1. Cản trở, cưỡng bức việc thực hiện kế hoạch hoá gia đình;
2. Lựa chọn giới tính thai nhi dưới mọi hình thức;
3. Sản xuất, kinh doanh, nhập khẩu, cung cấp phương tiện tránh thai giả, không bảo đảm tiêu chuẩn chất lượng, quá hạn sử dụng, chưa được phép lưu hành;
4. Di cư và cư trú trái pháp luật;
5. Tuyên truyền, phổ biến hoặc đưa ra những thông tin có nội dung trái với chính sách dân số, truyền thống đạo đức tốt đẹp của dân tộc, có ảnh hưởng xấu đến công tác dân số và đời sống xã hội;
6. Nhân bản vô tính người.
1. Nhà nước điều chỉnh quy mô dân số phù hợp với sự phát triển kinh tế - xã hội, tài nguyên, môi trường thông qua các chương trình, dự án phát triển kinh tế - xã hội, chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình để điều chỉnh mức sinh và ổn định quy mô dân số ở mức hợp lý.
2. Trong phạm vi nhiệm vụ, quyền hạn của mình, cơ quan, tổ chức chịu trách nhiệm đối với các chương trình, dự án về chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình. Hội đồng nhân dân, Uỷ ban nhân dân các cấp chịu trách nhiệm đối với các chương trình, dự án về chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình trên địa bàn địa phương.
1. Kế hoạch hoá gia đình là biện pháp chủ yếu để điều chỉnh mức sinh góp phần bảo đảm cuộc sống no ấm, bình đẳng, tiến bộ, hạnh phúc.
2. Biện pháp thực hiện kế hoạch hoá gia đình bao gồm:
a) Tuyên truyền, tư vấn, giúp đỡ, bảo đảm để mỗi cá nhân, cặp vợ chồng chủ động, tự nguyện thực hiện kế hoạch hoá gia đình;
b) Cung cấp các dịch vụ kế hoạch hoá gia đình bảo đảm chất lượng, thuận tiện, an toàn và đến tận người dân;
c) Khuyến khích lợi ích vật chất và tinh thần, thực hiện các chính sách bảo hiểm để tạo động lực thúc đẩy việc thực hiện kế hoạch hoá gia đình sâu rộng trong nhân dân.
3. Nhà nước hỗ trợ và tạo điều kiện thuận lợi cho việc thực hiện các chương trình, dự án về kế hoạch hoá gia đình; ưu tiên đối với vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn, vùng có điều kiện kinh tế - xã hội khó khăn, người nghèo, người có hoàn cảnh khó khăn và người chưa đến tuổi thành niên.
1. Mỗi cặp vợ chồng và cá nhân có quyền:
a) Quyết định về thời gian sinh con, số con và khoảng cách giữa các lần sinh phù hợp với lứa tuổi, tình trạng sức khoẻ, điều kiện học tập, lao động, công tác, thu nhập và nuôi dạy con của cá nhân, cặp vợ chồng trên cơ sở bình đẳng;
b) Lựa chọn, sử dụng các biện pháp kế hoạch hoá gia đình.
2. Mỗi cặp vợ chồng và cá nhân có nghĩa vụ:
a) Sử dụng các biện pháp tránh thai;
b) Bảo vệ sức khoẻ và thực hiện các biện pháp phòng, tránh các bệnh nhiễm khuẩn đường sinh sản và các bệnh lây truyền qua đường tình dục, HIV/AIDS;
c) Thực hiện các nghĩa vụ khác liên quan đến chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình.
1. Cơ quan quản lý nhà nước về dân số có trách nhiệm xây dựng chương trình, nội dung tuyên truyền, tư vấn về kế hoạch hoá gia đình; phối hợp với cơ quan, tổ chức, cá nhân trong việc tổ chức thực hiện tuyên truyền, tư vấn về kế hoạnh hoá gia đình.
2. Cơ quan, tổ chức, cá nhân có quyền được tiếp nhận thông tin, tham gia tuyên truyền, tư vấn việc thực hiện kế hoạch hoá gia đình.
3. Các cơ quan thông tin tuyên truyền có trách nhiệm tuyên truyền, phổ biến pháp luật về dân số và kế hoạch hoá gia đình. Nội dung và hình thức tuyên truyền phải phù hợp và dễ hiểu đối với từng nhóm đối tượng.
1. Nhà nước khuyến khích các tổ chức, cá nhân tham gia sản xuất, nhập khẩu, cung ứng phương tiện tránh thai và cung cấp dịch vụ kế hoạch hoá gia đình theo quy định của pháp luật.
2. Tổ chức, cá nhân cung cấp phương tiện tránh thai và dịch vụ kế hoạch hoá gia đình có trách nhiệm bảo đảm chất lượng phương tiện, dịch vụ, kỹ thuật an toàn, thuận tiện; theo dõi, giải quyết các tác dụng phụ và tai biến cho người sử dụng (nếu có).
1. Nhà nước điều chỉnh cơ cấu dân số nhằm bảo đảm cơ cấu dân số hợp lý về giới tính, độ tuổi, trình độ học vấn, ngành nghề và các đặc trưng khác; bảo vệ và tạo điều kiện để các dân tộc thiểu số phát triển.
2. Việc điều chỉnh cơ cấu dân số được thực hiện thông qua các chương trình, dự án phát triển kinh tế - xã hội của cả nước và từng địa phương. Nhà nước có chính sách; cơ quan, tổ chức có biện pháp phát triển các dịch vụ xã hội phù hợp với cơ cấu dân số già trong tương lai.
1. Nhà nước có chính sách và biện pháp cần thiết ngăn chặn việc lựa chọn giới tính thai nhi để bảo đảm cân bằng giới tính theo quy luật sinh sản tự nhiên; điều chỉnh mức sinh nhằm tạo cơ cấu dân số hợp lý về giới tính, độ tuổi.
2. Nhà nước thực hiện chính sách phát triển kinh tế - xã hội, khoa học - kỹ thuật, đào tạo ngành nghề, sử dụng lao động phù hợp với giới tính, độ tuổi, dân tộc và sự phát triển kinh tế - xã hội ở từng địa phương.
3. Cơ quan, tổ chức có trách nhiệm xây dựng chính sách và lập kế hoạch phát triển kinh tế - xã hội phải bảo đảm sự cân đối về giới tính, độ tuổi, cơ cấu ngành nghề ở mỗi khu vực, vùng địa lý kinh tế và từng đơn vị hành chính.
1. Nhà nước có chính sách, biện pháp giúp đỡ, hỗ trợ về vật chất, tinh thần cho đồng bào các dân tộc thiểu số ở vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn, vùng có điều kiện kinh tế - xã hội khó khăn bằng các chương trình, dự án phát triển kinh tế - xã hội, xoá đói giảm nghèo và đáp ứng nhu cầu dịch vụ chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình, nâng cao chất lượng dân số.
2. Cơ quan, tổ chức, cá nhân trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm tuyên truyền, tư vấn, hướng dẫn, giúp đỡ các dân tộc thiểu số trong việc bảo vệ, chăm sóc sức khoẻ sinh sản, kế hoạch hoá gia đình.
1. Nhà nước thực hiện việc phân bố dân cư hợp lý giữa các khu vực, vùng địa lý kinh tế và các đơn vị hành chính bằng các chương trình, dự án khai thác tiềm năng đất đai, tài nguyên để phát huy thế mạnh của từng nơi về phát triển kinh tế - xã hội và bảo vệ an ninh, quốc phòng.
2. Cơ quan nhà nước có thẩm quyền có trách nhiệm lập quy hoạch, kế hoạch phân bố dân cư phù hợp với các khu vực, vùng địa lý kinh tế và các đơn vị hành chính, ưu tiên đầu tư cho những vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn, vùng có điều kiện kinh tế - xã hội khó khăn, mật độ dân số thấp nhằm tạo việc làm và điều kiện sống tốt để thu hút lao động.
1. Nhà nước thực hiện chính sách khuyến khích phát triển toàn diện nông thôn, chuyển dịch cơ cấu kinh tế, công nghiệp hoá, hiện đại hoá nông nghiệp nông thôn, thu hẹp khoảng cách phát triển giữa các vùng để hạn chế động lực di dân ra đô thị.
2. Uỷ ban nhân dân các cấp trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm thực hiện các chương trình, dự án cho vay vốn, tạo việc làm, tăng thu nhập, xây dựng vùng kinh tế mới, thực hiện chính sách định canh, định cư để ổn định đời sống của đồng bào các dân tộc thiểu số, hạn chế du canh, du cư và di cư tự phát.
1. Nhà nước có chính sách và biện pháp cần thiết để hạn chế tập trung đông dân cư vào một số đô thị lớn; thực hiện việc quy hoạch phát triển đô thị, kết hợp xây dựng đô thị lớn, vừa và nhỏ, tạo điều kiện cho việc phân bố dân cư hợp lý.
2. Nhà nước có chính sách khuyến khích cá nhân, tổ chức, doanh nghiệp, người sử dụng lao động tại các đô thị tạo điều kiện về chỗ ở cho người lao động từ nơi khác đến.
3. Uỷ ban nhân dân các cấp trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm quản lý dân cư, quản lý đô thị, quản lý lao động từ nơi khác đến.
1. Nhà nước tạo điều kiện thuận lợi cho di cư trong nước và di cư quốc tế phù hợp với quy định của pháp luật Việt Nam và pháp luật của nước có người di cư hoặc người nhập cư.
2. Uỷ ban nhân dân các cấp thực hiện chính sách phát triển kinh tế - xã hội, cải thiện đời sống của nhân dân nhằm giảm động lực di cư tự phát, giải quyết kịp thời các vấn đề của di cư tự phát theo quy định của pháp luật.
1. Nâng cao chất lượng dân số là chính sách cơ bản của Nhà nước trong sự nghiệp phát triển đất nước.
2. Nhà nước thực hiện chính sách nâng cao chất lượng dân số về thể chất, trí tuệ và tinh thần nhằm nâng cao chỉ số phát triển con người của Việt Nam lên mức tiên tiến của thế giới, đáp ứng yêu cầu công nghiệp hoá, hiện đại hoá đất nước.
Các biện pháp nâng cao chất lượng dân số bao gồm:
1. Bảo đảm quyền cơ bản của con người; quyền phát triển đầy đủ, bình đẳng về thể chất, trí tuệ, tinh thần; hỗ trợ nâng cao những chỉ số cơ bản về chiều cao, cân nặng, sức bền; tăng tuổi thọ bình quân; nâng cao trình độ học vấn và tăng thu nhập bình quân đầu người;
2. Tuyên truyền, tư vấn và giúp đỡ nhân dân hiểu và chủ động, tự nguyện thực hiện các biện pháp nâng cao chất lượng dân số;
3. Đa dạng hoá các loại hình cung cấp hàng hoá và dịch vụ công cộng, đặc biệt về giáo dục, y tế để cải thiện chất lượng sống và nâng cao chất lượng dân số;
4. Thực hiện chính sách và biện pháp hỗ trợ đối với vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn, vùng có điều kiện kinh tế - xã hội khó khăn, người nghèo, người có hoàn cảnh khó khăn để nâng cao chất lượng dân số.
1. Nhà nước khuyến khích và tạo điều kiện thuận lợi để tổ chức, cá nhân thực hiện các biện pháp nâng cao chất lượng dân số, thông qua các chương trình, dự án phát triển kinh tế - xã hội, đầu tư cơ sở hạ tầng kỹ thuật, xây dựng hệ thống an sinh xã hội và bảo vệ môi trường sinh thái.
2. Cơ quan, tổ chức, cá nhân có trách nhiệm thực hiện công tác bảo vệ sức khoẻ và rèn luyện thân thể, nâng cao trình độ giáo dục và phát triển trí tuệ, phát triển kinh tế và nâng cao phúc lợi xã hội, giữ gìn giá trị văn hoá, tinh thần và bảo vệ môi trường sinh thái.
3. Cơ quan quản lý nhà nước về dân số có trách nhiệm phối hợp với các cơ quan, tổ chức hữu quan xây dựng và triển khai thực hiện mô hình nâng cao chất lượng dân số với phát triển gia đình bền vững, mô hình tác động nâng cao chất lượng dân số cộng đồng; cung cấp thông tin, tuyên truyền, tư vấn và giúp đỡ gia đình, cá nhân thực hiện các biện pháp nâng cao chất lượng dân số.
4. Cơ quan, tổ chức, cá nhân được cung cấp thông tin, hướng dẫn, giúp đỡ và tự nguyện thực hiện các biện pháp nâng cao chất lượng dân số.
1. Nhà nước khuyến khích và tạo điều kiện cho nam, nữ kiểm tra sức khoẻ trước khi đăng ký kết hôn, xét nghiệm gen đối với người có nguy cơ bị khuyết tật về gen, nhiễm chất độc hoá học; tư vấn về gen di truyền; giúp đỡ về vật chất và tinh thần đối với người bị khuyết tật về gen, nhiễm chất độc hoá học, nhiễm HIV/AIDS.
2. Nhà nước đầu tư và khuyến khích tổ chức, cá nhân đầu tư xây dựng cơ sở vật chất kỹ thuật phục vụ công nghệ hỗ trợ sinh sản nhằm giúp đỡ người vô sinh, người triệt sản và những người có nhu cầu theo quy định của pháp luật.
1. Nhà nước có chính sách và biện pháp nhằm loại trừ mọi hình thức phân biệt giới, phân biệt đối xử giữa con trai và con gái, bảo đảm phụ nữ và nam giới có quyền lợi, nghĩa vụ như nhau trong việc xây dựng gia đình no ấm, bình đẳng, tiến bộ, hạnh phúc và bền vững.
2. Nhà nước có chính sách khuyến khích duy trì gia đình nhiều thế hệ; mở rộng các dịch vụ xã hội phù hợp với các hình thái gia đình, bảo đảm cho mọi thành viên trong gia đình được hưởng các quyền lợi và thực hiện đầy đủ các nghĩa vụ.
3. Cơ quan, tổ chức, cá nhân có trách nhiệm tuyên truyền, tư vấn, giúp đỡ gia đình nâng cao đời sống vật chất, tinh thần và xây dựng cuộc sống no ấm, bình đẳng, tiến bộ, hạnh phúc và bền vững.
4. Các thành viên trong gia đình có trách nhiệm hỗ trợ nhau trong việc thực hiện các biện pháp chăm sóc sức khoẻ, sức khoẻ sinh sản, kế hoạch hoá gia đình, nâng cao đời sống vật chất và tinh thần cho từng thành viên.
Uỷ ban nhân dân các cấp có trách nhiệm chỉ đạo, tổ chức thực hiện các biện pháp phát triển kinh tế, các dịch vụ xã hội, bảo đảm an sinh xã hội nhằm nâng cao chất lượng dân số của cộng đồng trong phạm vi địa phương.
1. Nhà nước đưa quy hoạch, kế hoạch phát triển dân số vào quy hoạch, kế hoạch phát triển kinh tế - xã hội của quốc gia nhằm bảo đảm quy mô, cơ cấu, chất lượng dân số và phân bố dân cư phù hợp với điều kiện phát triển kinh tế - xã hội, tài nguyên và môi trường.
2. Hội đồng nhân dân, Uỷ ban nhân dân các cấp đưa quy hoạch, kế hoạch phát triển dân số vào quy hoạch, kế hoạch phát triển kinh tế - xã hội của địa phương mình.
3. Cơ quan, tổ chức trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm đưa chỉ tiêu kế hoạch thực hiện công tác dân số vào kế hoạch hoạt động, phát triển sản xuất, kinh doanh, dịch vụ của cơ quan, tổ chức mình; định kỳ kiểm điểm, đánh giá việc thực hiện.
Nhà nước thực hiện xã hội hoá công tác dân số bằng việc huy động mọi cơ quan, tổ chức, cá nhân tích cực tham gia công tác dân số. Cơ quan, tổ chức, cá nhân tham gia công tác dân số được hưởng quyền, lợi ích từ công tác dân số.
1. Nhà nước có chính sách và cơ chế huy động nguồn lực đầu tư cho công tác dân số.
2. Quỹ dân số được thành lập ở trung ương và do cơ quan quản lý nhà nước về dân số quản lý.
3. Quỹ dân số được hình thành từ các nguồn: hỗ trợ của ngân sách nhà nước; đóng góp tự nguyện của các tổ chức, cá nhân trong nước và nước ngoài.
4. Việc huy động và sử dụng quỹ dân số phải thực hiện theo quy định của pháp luật.
1. Giáo dục dân số được thực hiện trong các cơ sở giáo dục thuộc hệ thống giáo dục quốc dân.
2. Bộ Giáo dục và Đào tạo phối hợp với Uỷ ban Dân số, Gia đình và Trẻ em chỉ đạo, xây dựng chương trình, nội dung giáo trình về dân số phù hợp với từng cấp học, bậc học.
3. Nhà trường và các cơ sở giáo dục khác có trách nhiệm tổ chức giảng dạy và học tập theo chương trình, giáo trình quy định.
1. Nhà nước có chính sách và biện pháp mở rộng hợp tác quốc tế trong lĩnh vực dân số với các nước, tổ chức quốc tế trên cơ sở bình đẳng, tôn trọng độc lập, chủ quyền, cùng có lợi, phù hợp với pháp luật mỗi nước và thông lệ quốc tế.
2. Phạm vi hợp tác quốc tế bao gồm:
a) Xây dựng và thực hiện các chương trình, dự án trong lĩnh vực dân số;
b) Tham gia các tổ chức quốc tế, ký kết, gia nhập các điều ước quốc tế trong lĩnh vực dân số;
c) Nghiên cứu, ứng dụng khoa học và chuyển giao công nghệ hiện đại trong lĩnh vực dân số;
d) Đào tạo, bồi dưỡng, trao đổi thông tin và kinh nghiệm trong lĩnh vực dân số.
3. Nhà nước khuyến khích người Việt Nam định cư ở nước ngoài, tổ chức, cá nhân nước ngoài tham gia các hoạt động dân số.
4. Các tổ chức quốc tế, các hiệp hội về lĩnh vực dân số của nước ngoài được hoạt động trên lãnh thổ Việt Nam theo quy định của pháp luật Việt Nam.
1. Nhà nước có chính sách xây dựng, phát triển và tạo điều kiện nâng cao năng lực đội ngũ cán bộ làm công tác dân số ở các cấp, chú trọng đối với cán bộ chuyên trách và cộng tác viên dân số ở cơ sở.
2. Uỷ ban nhân dân các cấp có trách nhiệm tạo điều kiện thuận lợi cho cán bộ làm công tác dân số, ổn định đội ngũ cán bộ chuyên trách, cộng tác viên dân số ở cơ sở phù hợp với đặc điểm kinh tế - xã hội của mỗi địa phương.
1. Nhà nước khuyến khích và tạo điều kiện thuận lợi cho cơ quan, tổ chức, cá nhân nghiên cứu khoa học, chú trọng các đề tài nâng cao chất lượng dân số, nhất là ở vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn, vùng có điều kiện kinh tế - xã hội khó khăn.
2. Nhà nước có chính sách để bảo hộ, phổ biến, ứng dụng kết quả đã nghiên cứu về dân số vào chương trình phát triển kinh tế - xã hội và làm căn cứ cho việc hoạch định chính sách, lập kế hoạch và tổ chức thực hiện công tác dân số.
3. Các cơ quan nghiên cứu khoa học, cơ quan quản lý nhà nước về dân số có trách nhiệm áp dụng tiến bộ khoa học công nghệ, nâng cao chất lượng, hiệu quả các đề tài nghiên cứu về dân số để ứng dụng trong thực tế đời sống kinh tế - xã hội của đất nước.
Nội dung quản lý nhà nước về dân số bao gồm:
1. Xây dựng, tổ chức và chỉ đạo thực hiện chiến lược, quy hoạch, chương trình, kế hoạch và các biện pháp thực hiện công tác dân số;
2. Ban hành và tổ chức thực hiện các văn bản quy phạm pháp luật về dân số;
3. Tổ chức, phối hợp thực hiện công tác dân số giữa các cơ quan nhà nước, đoàn thể nhân dân và các tổ chức, cá nhân tham gia công tác dân số;
4. Quản lý, hướng dẫn nghiệp vụ về tổ chức bộ máy và cán bộ quản lý nhà nước về dân số;
5. Tổ chức, quản lý công tác thu thập, xử lý, khai thác, lưu trữ thông tin, số liệu về dân số; công tác đăng ký dân số và hệ cơ sở dữ liệu quốc gia về dân cư; tổng điều tra dân số định kỳ;
6. Tổ chức, quản lý công tác đào tạo, bồi dưỡng cán bộ, công chức làm công tác dân số;
7. Tổ chức, quản lý công tác nghiên cứu, ứng dụng khoa học và chuyển giao công nghệ trong lĩnh vực dân số;
8. Tổ chức, quản lý và thực hiện tuyên truyền, phổ biến, vận động nhân dân thực hiện pháp luật về dân số;
9. Thực hiện hợp tác quốc tế trong lĩnh vực dân số;
10. Kiểm tra, thanh tra, giải quyết khiếu nại, tố cáo và xử lý vi phạm pháp luật về dân số.
1. Chính phủ thống nhất quản lý nhà nước về dân số.
2. Uỷ ban Dân số, Gia đình và Trẻ em chịu trách nhiệm trước Chính phủ thực hiện quản lý nhà nước về dân số.
3. Các bộ, cơ quan ngang bộ trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm thực hiện quản lý nhà nước về dân số theo sự phân công của Chính phủ.
4. Chính phủ quy định cụ thể tổ chức, chức năng, nhiệm vụ và quyền hạn của cơ quan quản lý nhà nước về dân số và trách nhiệm của các bộ, cơ quan ngang bộ trong việc phối hợp với Uỷ ban Dân số, Gia đình và Trẻ em thực hiện quản lý nhà nước về dân số.
5. Uỷ ban nhân dân các cấp thực hiện quản lý nhà nước về dân số ở địa phương theo sự phân cấp của Chính phủ.
1. Nhà nước tổ chức, xây dựng và quản lý hệ cơ sở dữ liệu quốc gia về dân cư thống nhất trong phạm vi cả nước. Hệ cơ sở dữ liệu quốc gia về dân cư là tài sản của quốc gia.
2. Cơ quan, tổ chức, cá nhân có nghĩa vụ cung cấp đầy đủ, chính xác các thông tin cơ bản của dân số và có quyền được sử dụng thông tin, số liệu từ hệ cơ sở dữ liệu quốc gia về dân cư theo quy định của pháp luật.
3. Việc xây dựng, quản lý, khai thác và cung cấp thông tin dữ liệu từ hệ cơ sở dữ liệu quốc gia về dân cư được thực hiện theo quy định của pháp luật.
4. Chính phủ quy định quy trình, thủ tục, nội dung về đăng ký dân số và hệ cơ sở dữ liệu quốc gia về dân cư.
Việc khiếu nại, tố cáo và giải quyết khiếu nại, tố cáo hành vi vi phạm pháp luật về dân số được thực hiện theo quy định của pháp luật về khiếu nại, tố cáo.
1. Cơ quan, tổ chức, cá nhân có thành tích trong công tác dân số thì được khen thưởng theo quy định của pháp luật.
2. Cơ quan, tổ chức, cộng đồng dân cư có biện pháp khuyến khích khen thưởng những cá nhân, gia đình thực hiện tốt công tác dân số.
1. Người nào có hành vi vi phạm các quy định của Pháp lệnh này và các quy định khác của pháp luật có liên quan đến công tác dân số thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc bị truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.
2. Người nào lợi dụng chức vụ, quyền hạn vi phạm quy định của Pháp lệnh này và các quy định khác của pháp luật có liên quan đến công tác dân số thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật hoặc bị truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.
Pháp lệnh này có hiệu lực kể từ ngày 01 tháng 5 năm 2003.
Những quy định trước đây trái với Pháp lệnh này đều bãi bỏ.

POPULATION ORDINANCE
Population constitutes one of the factors decisive to the sustainable development of the country;
In order to raise the responsibilities of citizens, the State and society in the population work; to protect the rights and legitimate interests of citizens; to enhance and unify the State management over population;
Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001 of the Xth National Assembly at its 10th session;
Pursuant to Resolution No. 12/2002/QH11 of December 16, 2002 of the XIth National Assembly, its second session, on the Law- and Ordinance-Making Programs of the XIth National Assembly throughout its tenure (2002-2007) and for 2003;
This Ordinance provides for population.
Chapter I
GENERAL PROVISIONS
Article 1.- Scope of regulation and subjects of application
1. This Ordinance provides for the population size, population structure, population distribution, population quality, and measures to perform the population work and the State management over population.
2. This Ordinance shall apply to State agencies, political organizations, socio-political organizations, social organizations, socio-professional organizations, economic organizations, people’s armed force units and all Vietnamese citizens (hereinafter referred collectively to as agencies, organizations and individuals); foreign organizations operating in the territory of Vietnam and foreigners permanently residing in the territory of Vietnam, unless otherwise prescribed by the international agreements which Vietnam has signed or acceded to.
Article 2.- Principles of the population work
1. To protect the legitimate rights and interests of agencies, organizations and individuals in the population field in conformity with socio-economic development, the quality of life of individuals, families and the entire society.
2. To guarantee the initiative, voluntariness and equality of each individual and family in birth control, reproductive health care, selection of residential places, and application of measures to raise the population quality.
3. To harmonize the rights and interests of individuals and families with the interests of communities and the whole society; to build families with few children, which are prosperous, equal, progressive, happy and sustainable.
Article 3.- Interpretation of terms
In this Ordinance, the following words and phrases are construed as follows:
1. Population means an aggregation of people living in a country, a region, a geo-economic area or an administrative unit.
2. Population size means the number of people living in a country, a region, a geo-economic area or an administrative unit at a certain time.
3. Population structure means the total population classified by gender, age, ethnicity, educational level, profession, marital status and other characteristics.
4. Aged population structure means a population where the aged represent a high proportion.
5. Population distribution means the distribution of the total population by region, geo-economic area or administrative unit.
6. Population quality means the reflection of physical, intellectual and spiritual characteristics of the entire population.
7. Migration means the movement of population from one country to another for residence, from one administrative unit to another for residence.
8. Reproductive health means the demonstration of physical, spiritual and social states related to the reproductive activity and function of each person.
9. Family planning means the State’s and society’s efforts to enable every individual and couple to actively and voluntarily decide on the number of children, the time to have babies and the duration between child births in order to protect their health and raise their children with a sense of responsibility and in conformity with social standards and families’ living conditions.
10. Population work means the management and organization of implementation of activities affecting the population size, population structure, population distribution and raising the population quality.
11. Human development indexes are general data used for evaluating the level of human development, determined through average life expectancy, educational level and average per capita income.
12. The replacement birth rate means the average birth rate in the whole society, thereby each couple should have two children.
13. Population services means activities in service of the population work, including information supply, propagation, education, mobilization, guidance and counseling on population (hereinafter referred collectively to as propagation and counseling); provision of measures for reproductive healthcare, family planning, raising the population quality, and other activities as prescribed by law.
14. Population registration means the collection and updating of basic population-related information on each inhabitant according to each period of time.
15. The national database on population means a system of information collected through population registration of all inhabitants, and set up on the computerized network.
Article 4.- Rights and obligations of citizens regarding the population work
1. Citizens shall have the following rights:
a/ To be supplied with information on population;
b/ To be provided with quality, convenient, safe and secret population services as prescribed by law;
c/ To select measures to take care of reproductive health, practice family planning, and raise the population quality;
d/ To select appropriate residential places according to law provisions;
2. Citizens shall have the following obligations:
a/ To practice family planning; build families with few children, which are prosperous, equal, progressive, happy and sustainable;
b/ To take appropriate measures to raise the physical, intellectual and spiritual abilities of their own and of their family members;
c/ To respect the interests of the State, society and community in readjusting the population size, population structure, population distribution, and raising the population quality;
d/ To abide by the provisions of this Ordinance and other law provisions pertaining to the population work.
Article 5.- Responsibilities of the State, agencies and organizations in the population work
1. The State shall adopt policies and measures to carry out the population work, socialize the population work, ensure favorable conditions for the population work in compatibility with the national socio-economic development.
2. The State shall adopt policies to encourage organizations and individuals to invest in, cooperate on, assist and support the reproductive health care and family planning and population quality improvement programs, give priority to the poor, ethnic minority people as well as areas with exceptionally difficult socio-economic conditions and areas with difficult socio-economic conditions.
3. The State management agencies in charge of population shall have to direct the implementation of the population work, coordinate with Vietnam Fatherland Front and its member organizations in implementing the population work, inspecting and supervising the implementation of the population legislation.
4. Agencies and organizations shall, within the scope of their respective tasks and powers, have to:
a/ Integrate population elements into the socio-economic development planning, plans and policies;
b/ Propagate and campaign for the implementation of the population work;
c/ Provide various population services;
d/ Organize the implementation of the population legislation within their own agencies and organizations.
Article 6.- Responsibilities of Vietnam Fatherland Front and mass organizations in the population work
Vietnam Fatherland Front and mass organizations shall have to:
1. Contribute comments on the formulation of population policies, plannings and plans, and legal documents on population;
2. Organize the population work in their respective systems;
3. Propagate among their members and mobilize them to implement the population legislation.
4. Supervise the implementation of the population legislation.
Article 7.- Prohibited acts
The following acts are strictly prohibited:
1. Obstructing or forcing the practice of family planning;
2. Selecting the gender of unborn babies in any form;
3. Producing, dealing in, importing and supplying contraceptive devices which are faked, fail to satisfy quality standards, have their use duration expired, or have not yet been permitted for circulation;
4. Illegally migrating and residing;
5. Propagating, disseminating or issuing information contrary to the population policy, fine national ethics, adversely affecting the population work and social life;
6. Human cloning.
Chapter II
POPULATION SIZE, STRUCTURE AND DISTRIBUTION
Section 1. POPULATION SIZE
Article 8.- Readjustment of the population size
1. The State shall readjust the population size compatible with the socio-economic development, natural resources and environment through socio-economic development, reproductive health care and family planning programs and projects so as to readjust the birth rate and stabilize the population size at a reasonable level.
2. Agencies and organizations shall, within the scope of their respective tasks and powers, be responsible for reproductive health care and family planning programs and projects. The People’s Councils and People’s Committees at all levels shall be responsible for reproductive health care and family planning programs and projects in their respective localities.
Article 9.- Family planning
1. Family planning constitutes a prime measure to readjust the birthrate, contributing to ensuring a prosperous, equitable, progressive and happy life.
2. Family planning-practicing measures include:
a/ Propagating, mobilizing and assisting, ensuring that each individual and couple to apply family planning actively and voluntarily;
b/ Providing quality, convenient and safe family planning services directly for people;
c/ Offering material and moral incentives, implementing insurance policies so as to create a motive force for pushing up extensive and intensive application of family planning among people.
3. The State shall support and create favorable conditions for the implementation of family planning programs and projects, giving priority to areas with exceptionally difficult socio-economic conditions or with difficult socio-economic conditions, to the poor, persons meeting with difficulties, and minors.
Article 10.- Rights and obligations of each couple or individual in the practice of family planning
1. Each couple or individual shall have the rights to:
a/ Decide on the time to have babies, the number of children and the duration between child births suitable to their age, health, study, laboring or working conditions, incomes, and raise their children on the basis of equality;
b/ Select and apply family planning measures.
2. Each couple and individual shall have the obligations to:
a/ Use methods of contraception;
b/ Protect their health, apply measures to prevent and avoid reproductively infectious diseases as well as sexually transmitted diseases, HIV/AIDS;
c/ Fulfill other obligations related to reproductive health care and family planning.
Article 11.- Propagating and counseling on family planning
1. The State management agencies in charge of population shall have to work out programs for, and contents of, propagation and counseling on family planning; coordinate with other agencies, organizations and individuals in organizing the propagation and counseling on family planning.
2. Agencies, organizations and individuals shall be entitled to receive information on, participate in propagating and counseling on, the practice of family planning.
3. The information and propagation agencies shall have to propagate and disseminate the legislation on population and family planning. The contents and forms of propagation must be suitable and easily understandable to each target group.
Article 12.- Provision of family planning services
1. The State shall encourage organizations and individuals to participate in producing, importing and supplying contraceptive devices and providing family planning services according to law provisions.
2. Organizations and individuals supplying contraceptive devices and providing family planning services shall have to ensure the quality of devices and services using safe and convenient techniques; monitor and remedy side-effects and undesirable incidents (if any) for users.
Section 2. POPULATION STRUCTURE
Article 13.- Readjustment of the population structure
1. The State shall readjust the population structure in order to ensure a reasonable population structure in terms of gender, age, educational level, profession and other characteristics; protect and create conditions for ethnic minority groups to develop.
2. The population structure shall be readjusted through socio-economic development programs and projects in the whole country and in each locality. The State shall adopt policies while agencies and organizations shall take measures to develop social services suitable to the aged population structure in future.
Article 14.- Ensuring a reasonable population structure
1. The State shall adopt necessary policies and measures to prevent the selection of unborn babies’ gender so as to ensure gender equilibrium according to natural reproduction law; readjust the birth rate in order to have a reasonable age-gender population structure.
2. The State shall implement socio-economic development, scientific and technical, vocational training and labor employment policies suitable to the gender, age, ethnicity and socio-economic development in each locality.
3. Agencies and organizations responsible for formulating socio-economic development policies and plans shall have to ensure balances in gender, age and production and business lines in each region, each eco-geographical area and each administrative unit.
Article 15.- Protection of ethnic minority groups
1. The State shall adopt policies and measures to provide material and spiritual assistance and support for ethnic minority people in areas with exceptionally difficult socio-economic conditions and with difficult socio-economic conditions through socio-economic development, hunger elimination and poverty alleviation programs and projects, satisfy their demands for reproductive health care, family planning, and population quality-raising services.
2. Agencies, organizations and individuals, shall, within the scope of their respective tasks and powers, have to propagate, counsel, guide and help ethnic minority groups in the protection and care of reproductive health, and family planing.
Section 3. POPULATION DISTRIBUTION
Article 16.- Rational population distribution
1. The State shall effect rational population distribution among different regions, geo-economic areas and administrative units through programs and projects on tapping land and natural resource potentials so as to bring into play the strengths of each locality for socio-economic development and security and defense maintenance.
2. Competent State agencies shall have to work out population distribution plannings and plans suitable to different regions, geo-economic areas as well as administrative units, giving priority to investment in areas with exceptionally difficult socio-economic conditions and with difficult socio-economic conditions, where population density remains low, in order to create jobs and good living conditions for attracting labor.
Article 17.- Distribution of rural population
1. The State shall adopt policies to encourage comprehensive development, economic restructuring, industrialization and modernization in rural areas and in agriculture, narrowing the development gap between different regions so as to reduce the motive force for migration to urban centers.
2. The People’s Committees at all levels shall, within the scope of their respective tasks and powers, have to implement programs and projects on lending capital, creating jobs, generating incomes and building new economic zones, as well as sedentarization policies to stabilize the life of ethnic minority groups, restricting nomadic farming and living as well as spontaneous migration.
Article 18.- Distribution of urban population
1. The State shall adopt necessary policies and measures to restrict the concentration of population in a few big cities; materialize the urban development planning in combination with building big, medium and small urban centers, creating conditions for rational population distribution.
2. The State shall adopt policies to encourage individuals, organizations, enterprises and employers in urban centers to create dwelling conditions for laborers coming from other localities.
3. The People’s Committees at all levels shall, within the scope of their respective tasks and powers, have to manage population, urban centers, and laborers coming from other localities.
Article 19.- Domestic and international migration
1. The State shall create favorable conditions for domestic and international migration in accordance with the Vietnamese law and the laws of the countries where people emigrate to or immigrate from.
2. The People’s Committees at all levels shall implement socio-economic development policies to improve people’s life with a view to reducing the motive force for spontaneous migration; promptly settle spontaneous migration-related problems according to law provisions.
Chapter III
POPULATION QUALITY
Article 20.- Raising of the population quality
1. To raise the population quality is the fundamental policy of the State for the cause of national development.
2. The State shall implement policies to raise the population quality physically, intellectually and spiritually in order to increase Vietnam’s human development indexes to the world’s advanced level, thus meeting the requirements of national industrialization and modernization.
Article 21.- Measures to raise the population quality
The measures to raise the population quality include:
1. Ensuring fundamental human rights; the right to all-sided and equal physical, intellectual and spiritual development; supporting to raise basic indicators regarding height, weight and stamina; increasing average life expectancy; educational level as well as average per capita income.
2. Propagating, counseling and helping people to understand, actively and voluntarily take measures to raise the population quality;
3. Diversifying forms of provision of goods and public services, especially in the fields of education and health, with a view to improving the living quality and raising the population quality;
4. Implementing policies and measures to give support to areas with exceptionally difficult socio-economic conditions and with difficult socio-economic conditions, the poor, and persons meeting with difficulties, in order to raise the population quality.
Article 22.- Responsibility to raise the population quality
1. The State shall encourage and create favorable conditions for organizations and individuals to apply measures to raise the population quality through programs and projects on socio-economic development, investment in technical infrastructure, building of the social welfare system, and protection of the ecological environment.
2. Agencies, organizations and individuals shall have to perform the work of health protection and physical training, raise the educational, intellectual and economic levels of development, and increase social welfare, preserve cultural and spiritual values, and protect the ecological environment.
3. The State management agencies in charge of population shall have to coordinate with concerned agencies and organizations in designing and implementing the model of raising the population quality in combination with developing sustainable families, and the model of intervening and raising the population quality in communities; supply information, propagate, counsel and help families and individuals to apply measures to raise the population quality.
4. Agencies, organizations and individuals shall be provided with information, guided and assisted in, and voluntarily apply, measures to raise the population quality.
Article 23.- Reproduction-supporting measures
1. The State shall encourage and create conditions for men and women to have health checks before making marriage registration, have gene tests for people in danger of genetic defects or being affected with toxic chemicals; give counseling on hereditary genes; provide material and spiritual assistance for people with genetic defects, affected with toxic chemicals or infected with HIV/AIDS.
2. The State shall invest and encourage organizations and individuals to invest in building technical and material foundations in service of reproduction-supporting technology in order to assist sterile and sterilized people as well as people with demands therefor according to law provisions.
Article 24.- Building of prosperous, equal, progressive, happy and sustainable families
1. The State shall adopt policies and measures to eliminate all forms of gender discrimination, discriminatory treatment between boys and girls, ensuring that women and men have the same interests and obligations in building prosperous, equal, progressive, happy and sustainable families.
2. The State shall adopt policies to encourage the preservation of multi-generation families; expand social services suitable to different family patterns, ensuring that every family member can enjoy benefits and fulfill all obligations.
3. Agencies, organizations and individuals shall have the duty to propagate, counsel and assist families to raise their material and spiritual life, and build a prosperous, equal, progressive, happy and stable life.
4. Family members shall have the duty to support one another in applying measures to take care of health, reproductive health, practice family planning, and raise the material and spiritual life for each member.
Article 25.- Raising of the population quality for communities
The People’s Committees at all levels shall have to direct and organize the application of economic development measures, the provision of social services and assurance of social welfare in order to raise the population quality for communities in their respective localities.
Chapter IV
MEASURES TO IMPLEMENT THE POPULATION WORK
Article 26.- Population development plannings and plans
1. The State shall incorporate population development plannings and plans into the national socio-economic development plannings and plans in order to ensure the population size, structure, quality and distribution suitable to the socio-economic development conditions, natural resources and environment.
2. The People’s Councils and People’s Committees at all levels shall incorporate population development plannings and plans into their local socio-economic development plannings and plans.
3. Agencies and organizations shall, within the scope of their respective tasks and powers, have to put planned norms for implementation of the population work into their operational, production and business development and/or service provision plans; periodically review and evaluate the implementation thereof.
Article 27.- Socialization of the population work
The State shall socialize the population work by mobilizing all agencies, organizations and individuals to actively take part therein. Agencies, organizations and individuals taking part in the population work shall enjoy rights and benefits from the population work.
Article 28.- Mobilization of resources for the population work
1. The State shall adopt policies and mechanisms to mobilize investment resources for the population work.
2. The population funds shall be set up at the central level and run by the State management agencies in charge of population.
3. The population funds shall be formed from the following sources: supports from the State budget, voluntary contributions from organizations and individuals inside and outside the country.
4. The mobilization and use of the population funds must comply with law provisions.
Article 29.- Implementation of the population education
1. Population education shall be provided at educational establishments within the national education system.
2. The Ministry of Education and Training shall coordinate with the Committee for Population, Families and Children in directing and elaborating programs and textbook contents on population suitable to each educational grade and level.
3. Schools and other educational establishments shall have to organize teaching and learning according to the prescribed programs and textbooks.
Article 30.- International cooperation in the population field
1. The State shall adopt policies and measures to expand international cooperation in the population field with other countries and international organizations on the basis of equality, respect for independence, sovereignty, mutual benefit and compliance with the law of each country and with international practices.
2. The scope of international cooperation covers:
a/ Formulating and implementing programs and projects in the population field;
b/ Participating in international organizations, signing and/or acceding to international agreements in the population field;
c/ Research into, application of sciences and transfer of modern technologies in the population field;
d/ Training, fostering, exchanging information and experiences in the population field;
3. The State shall encourage overseas Vietnamese, foreign organizations and individuals to participate in population activities.
4. International organizations and foreign associations engaged in the population work shall be allowed to operate in the territory of Vietnam according to the laws of Vietnam.
Article 31.- Enhancing the capability of the contingent of officials engaged in the population work
1. The State shall adopt policies to build, develop, and create conditions for enhancing the capability of, the contingent of officials engaged in the population work at all levels, attaching importance to full-time officials and population collaborators at the grassroots level.
2. The People’s Committees at all levels shall have to create favorable conditions for population officials, stabilize the contingent of full-time officials and population collaborators at the grassroots level, suitable to the socio-economic characteristics of each locality.
Article 32.- Scientific research into population
1. The State shall encourage and create favorable conditions for scientific research agencies, organizations and individuals to attach importance to research schemes to raise the population quality, especially in areas with exceptionally difficult socio-economic conditions and with difficult socio-economic conditions.
2. The State shall adopt policies to protect, popularize and apply the results of population researches to the socio-economic development programs and use them as a basis for making policies, plans and organizing the implementation of the population work.
3. Scientific research agencies and State management agencies in charge of population shall have to apply scientific and technological advances, raise the quality and efficiency of research schemes on population for application to the country’s actual socio-economic life.
Chapter V
STATE MANAGEMENT OVER POPULATION
Article 33.- Contents of the State management over population
The contents of the State management over population include:
1. Formulating, organizing and directing the implementation of, strategies, plannings, plans and measures to implement the population work;
2. Promulgating legal documents on population and organizing the implementation thereof;
3. Organizing and coordinating the implementation of the population work among State agencies, mass organizations, other organizations, and individuals participating in the population work;
4. Managing and providing professional guidance on the organization of the State management apparatus and officials in charge of population;
5. Organizing and managing the collection, processing, exploitation and archival of information and data on population; the population registration and the national database on population; periodical censuses;
6. Organizing and managing the training and fostering for officials and public employees engaged in the population work;
7. Organizing and managing the scientific research and application and technology transfer in the population field;
8. Organizing, managing and implementing the propagation and popularization of the population legislation among the people and mobilizing them to implement the population legislation;
9. Undertaking international cooperation in the population field;
10. Supervising, inspecting, settling complaints and denunciations, and handling violations of the population legislation.
Article 34.- State management agencies in charge of population
1. The Government shall perform the unified State management over population.
2. The Committee for Population, Families and Children shall be responsible to the Government for performing the State management over population.
3. The ministries and the ministerial-level agencies shall, within the scope of their respective tasks and powers, have to perform the State management over population according to the Government’s assignment.
4. The Government shall specify the organizations, functions, tasks and powers of the State management agencies in charge of population and the responsibilities of the ministries and ministerial-level agencies for coordinating with the Committee for Population, Families and Children in performing the State management over population.
5. The People’s Committees at all levels shall perform the State management over population in their respective localities according to the Government’s assignment.
Article 35.- Population registration and national database on population
1. The State shall organize, set up and manage the national database on population nationwide. The national database on population constitutes a national asset.
2. Agencies, organizations and individuals shall be obliged to supply full and accurate basic information on population, and be entitled to use information and data from the national database on population according to law provisions.
3. The setting up, management, exploitation, and supply of information from, the national database on population shall comply with law provisions.
4. The Government shall prescribe the process, procedures and contents for the population registration and national database on population.
Article 36.- Complaints and denunciations
Complaints about and denunciations against violations of the population legislation as well as the settlement thereof shall comply with the law provisions on complaints and denunciations.
Chapter VI
COMMENDATION AND HANDLING OF VIOLATIONS
Article 37.-
1. Agencies, organizations and individuals that make achievements in the population work shall be commended and/or rewarded according to law provisions.
2. Agencies, organizations and population communities shall apply measures to encourage, commend and/or reward individuals and families that well perform the population work.
Article 38.- Handling of violations
1. Those who violate the provisions of this Ordinance and other law provisions related to the population work shall, depending on the nature and seriousness of their violations, be disciplined, administratively sanctioned or examined for penal liability; if causing any damage, they must pay compensation therefore according to law provisions.

Those who abuse their positions and powers to violate the provisions of this Ordinance and other law provisions related to the population work shall, depending on the nature and seriousness of their violations, be disciplined or examined for penal liability; if causing any damage, they must pay compensation therefore according to law provisions.
Chapter VII
IMPLEMENTATION PROVISIONS
Article 39.- Effect of the Ordinance
This Ordinance takes effect as from May 1, 2003.
All previous provisions contrary to this Ordinance are hereby annulled.
Article 40.- Detailing and guiding of implementation
The Government shall detail and guide the implementation of this Ordinance.
