Quy định mới về phân bón không được lưu hành
Đây là một trong những nội dung nổi bật được quy định tại Nghị định 108/2017/NĐ-CP về quản lý phân bón vừa được Chính phủ ban hành.
Theo đó, tại Nghị định này đã quy định về phân bón không được công nhận lưu hành và phân bón bị huỷ bỏ quyết định công nhận lưu hành, cụ thể như sau:
- Những loại phân bón không được công nhận lưu hành do:
+ Có các yếu tố gây hại vượt mức cho phép theo quy định của pháp luật hiện hành;
+ Có bằng chứng khoa học về việc gây hại đến sức khoẻ con người và môi trường;
+ Trùng tên với các phân bón đã được công nhận lưu hành;
- Những loại phân bón đã có Quyết định công nhận lưu hành nhưng nay hủy bỏ quyết định đó do:
+ Có bằng chứng khoa học về việc gây hại đến sức khoẻ con người và môi trường;
+ Sử dụng các tài liệu hoặc cung cấp thông tin không đúng với phân bón đề nghị lưu hành;
+ Đã hết thời gian công bố lưu hành nhưng nay không công nhận lại;
Nghị định 108/2017/NĐ-CP có hiệu lực từ ngày 20/09/2017 và thay thế Nghị định 202/2013/NĐ-CP ngày 27/11/2013.

Điều 18. Điều kiện cấp Giấy chứng nhận đủ điều kiện sản xuất phân bón
1. Tổ chức, cá nhân sản xuất phân bón phải bảo đảm các điều kiện sau đây:
a) Tổ chức, cá nhân được thành lập theo quy định của pháp luật;
b) Có địa điểm sản xuất, diện tích nhà xưởng phù hợp với công suất của dây chuyền, máy móc thiết bị sản xuất phân bón;
c) Dây chuyền, máy móc thiết bị sản xuất từ khâu xử lý nguyên liệu đến sản phẩm cuối cùng đáp ứng quy trình công nghệ.
Các công đoạn, hệ thống bắt buộc phải sử dụng máy thiết bị được cơ giới hóa hoặc tự động hóa quy định tại Phụ lục IV ban hành kèm theo Nghị định này.
Máy móc thiết bị có yêu cầu nghiêm ngặt về an toàn và thiết bị đo lường thử nghiệm phải được kiểm định, hiệu chuẩn, hiệu chỉnh theo quy định của pháp luật;
d) Có khu vực chứa nguyên liệu và khu vực thành phẩm riêng biệt; có kệ hoặc bao lót để xếp đặt hàng;
đ) Có phòng thử nghiệm được công nhận hoặc có hợp đồng với tổ chức thử nghiệm được chỉ định để đánh giá các chỉ tiêu chất lượng phân bón do mình sản xuất;
e) Có hệ thống quản lý chất lượng phù hợp với ISO 9001 hoặc tương đương, đối với cơ sở mới thành lập, muộn nhất sau 01 năm kể từ ngày thành lập;
g) Người trực tiếp quản lý, điều hành sản xuất có trình độ đại học trở lên một trong các chuyên ngành về lĩnh vực trồng trọt, bảo vệ thực vật, nông hóa thổ nhưỡng, nông học, hóa học, sinh học.
2. Đối với các cơ sở chỉ hoạt động đóng gói phân bón thì không phải đáp ứng điều kiện quy định tại điểm đ, e khoản 1 Điều này.
Điều 19. Điều kiện cấp Giấy chứng nhận đủ điều kiện buôn bán phân bón1. Tổ chức, cá nhân buôn bán phân bón phải bảo đảm các điều kiện sau đây:
a) Tổ chức, cá nhân được đăng ký hoặc thành lập theo quy định của pháp luật;
b) Có cửa hàng buôn bán phân bón. Cửa hàng buôn bán phân bón phải có: Biển hiệu; sổ ghi chép việc mua, bán phân bón; bảng giá bán công khai từng loại phân bón niêm yết tại nơi dễ thấy, dễ đọc;
c) Có khu vực chứa phân bón; có kệ hoặc bao lót để xếp đặt hàng;
d) Người trực tiếp bán phân bón phải có Giấy chứng nhận bồi dưỡng chuyên môn về phân bón, trừ trường hợp đã có trình độ trung cấp trở lên một trong các chuyên ngành về lĩnh vực trồng trọt, bảo vệ thực vật, nông hóa thổ nhưỡng, nông học, hóa học, sinh học.
2. Trường hợp cơ sở buôn bán phân bón không có cửa hàng phải có đăng ký doanh nghiệp; có địa điểm giao dịch cố định, hợp pháp; có sổ ghi chép việc mua, bán phân bón và đáp ứng quy định tại điểm d khoản 1 Điều này.
Mục 2. HỒ SƠ, TRÌNH TỰ, THỦ TỤC, THẨM QUYỀN CẤP GIẤY CHỨNG NHẬN ĐỦ ĐIỀU KIỆN SẢN XUẤT, BUÔN BÁN PHÂN BÓNĐiều 20. Hồ sơ cấp Giấy chứng nhận đủ điều kiện sản xuất phân bón
1. Đơn đề nghị cấp Giấy chứng nhận đủ điều kiện sản xuất phân bón theo Mẫu số 12 tại Phụ lục I ban hành kèm theo Nghị định này.
2. Bản thuyết minh về điều kiện sản xuất phân bón theo Mẫu số 14 tại Phụ lục I ban hành kèm theo Nghị định này.
3. Bản sao hợp lệ phiếu kiểm định, hiệu chuẩn, hiệu chỉnh đối với máy thiết bị có yêu cầu nghiêm ngặt về an toàn và các thiết bị đo lường thử nghiệm.
4. Bản sao hợp lệ bằng tốt nghiệp đại học trở lên của người trực tiếp quản lý, điều hành sản xuất quy định tại điểm g khoản 1 Điều 18 Nghị định này.
5. Bản sao hợp lệ Quyết định phê duyệt báo cáo đánh giá tác động môi trường hoặc Quyết định phê duyệt đề án bảo vệ môi trường chi tiết hoặc Giấy xác nhận đăng ký Kế hoạch bảo vệ môi trường hoặc Cam kết bảo vệ môi trường theo quy định hiện hành.
6. Bản sao hợp lệ Giấy chứng nhận thẩm duyệt thiết kế về phòng cháy và chữa cháy hoặc phương án chữa cháy của cơ sở theo quy định hiện hành.
Điều 21. Hồ sơ cấp Giấy chứng nhận đủ điều kiện buôn bán phân bón1. Đơn đề nghị cấp Giấy chứng nhận đủ điều kiện buôn bán phân bón theo Mẫu số 13 tại Phụ lục I ban hành kèm theo Nghị định này.
2. Bản thuyết minh điều kiện buôn bán theo Mẫu số 15 tại Phụ lục I ban hành kèm theo Nghị định này.
3. Bản sao hợp lệ Giấy chứng nhận bồi dưỡng chuyên môn về phân bón hoặc bằng tốt nghiệp trung cấp trở lên của người trực tiếp buôn bán phân bón quy định tại điểm d khoản 1 Điều 19 Nghị định này.
Điều 22. Hồ sơ cấp lại Giấy chứng nhận đủ điều kiện sản xuất phân bón, Giấy chứng nhận đủ điều kiện buôn bán phân bón1. Trường hợp Giấy chứng nhận đủ điều kiện sản xuất phân bón hết hạn
Trước thời hạn 03 tháng kể từ ngày Giấy chứng nhận đủ điều kiện sản xuất phân bón hết hạn, tổ chức, cá nhân sản xuất phân bón có nhu cầu tiếp tục sản xuất phân bón phải nộp hồ sơ đề nghị cấp lại theo quy định tại Điều 20 Nghị định này.
2. Trường hợp Giấy chứng nhận đủ điều kiện sản xuất phân bón, Giấy chứng nhận đủ điều kiện buôn bán phân bón (sau đây gọi là Giấy chứng nhận) bị mất, hư hỏng, thay đổi nội dung thông tin ghi trên Giấy chứng nhận.
a) Đơn đề nghị cấp lại Giấy chứng nhận theo Mẫu số 12 hoặc Mẫu số 13 tại Phụ lục I ban hành kèm theo Nghị định này;
b) Bản sao hợp lệ một trong các giấy tờ sau:
Giấy chứng nhận đăng ký doanh nghiệp hoặc Giấy chứng nhận đầu tư hoặc Giấy chứng nhận đăng ký kinh doanh hoặc Giấy chứng nhận đăng ký hoạt động chi nhánh, văn phòng đại diện hoặc Giấy chứng nhận đăng ký địa điểm kinh doanh hoặc Giấy chứng nhận đăng ký hộ kinh doanh đã được sửa đổi (đối với trường hợp đề nghị điều chỉnh nội dung về đăng ký doanh nghiệp hoặc địa điểm hoặc thông tin liên quan đến tổ chức, cá nhân đăng ký);
Bản thuyết minh về điều kiện sản xuất phân bón theo Mẫu số 14 tại Phụ lục I ban hành kèm theo Nghị định này (đối với trường hợp đề nghị điều chỉnh về điều kiện hoạt động, công suất sản xuất);
Quyết định công nhận phân bón lưu hành tại Việt Nam hoặc hợp đồng chuyển nhượng quyền sở hữu hoặc chuyển giao phân bón từ tổ chức, cá nhân khác (đối với trường hợp đề nghị điều chỉnh bổ sung về loại phân bón sản xuất).
c) Bản chính Giấy chứng nhận đã được cấp (trừ trường hợp Giấy chứng nhận bị mất).
Điều 23. Trình tự, thủ tục cấp, cấp lại Giấy chứng nhận đủ điều kiện sản xuất phân bón, Giấy chứng nhận đủ điều kiện buôn bán phân bón1. Nộp hồ sơ
Tổ chức, cá nhân nộp 01 bộ hồ sơ theo một trong các hình thức trực tiếp hoặc qua đường bưu điện hoặc qua Cổng thông tin điện tử.
Trong thời hạn 03 ngày làm việc kể từ ngày tiếp nhận hồ sơ, nếu hồ sơ không hợp lệ phải thông báo cho tổ chức, cá nhân để bổ sung hồ sơ.
2. Thẩm định cấp, cấp lại Giấy chứng nhận
a) Trường hợp cấp Giấy chứng nhận, cấp lại khi Giấy chứng nhận đủ điều kiện sản xuất phân bón hết hạn
Trong thời hạn 20 ngày làm việc, kể từ ngày nhận đủ hồ sơ hợp lệ và kết quả thẩm định đáp ứng theo quy định tại Điều 18 của Nghị định này, cơ quan quản lý nhà nước có thẩm quyền cấp, cấp lại Giấy chứng nhận đủ điều kiện sản xuất phân bón.
Trong thời hạn 10 ngày làm việc, kể từ ngày nhận đủ hồ sơ hợp lệ và kết quả thẩm định đáp ứng theo quy định tại Điều 19 của Nghị định này, cơ quan quản lý nhà nước có thẩm quyền cấp Giấy chứng nhận đủ điều kiện buôn bán phân bón.
Cơ quan quản lý nhà nước có thẩm quyền cấp Giấy chứng nhận tổ chức kiểm tra thực tế tại cơ sở sản xuất hoặc cơ sở buôn bán phân bón trước khi cấp Giấy chứng nhận, cấp lại Giấy chứng nhận đủ điều kiện sản xuất phân bón. Biên bản kiểm tra theo Mẫu số 18 tại Phụ lục I ban hành kèm theo Nghị định này.
b) Trường hợp cấp lại Giấy chứng nhận bị mất, hư hỏng, thay đổi nội dung thông tin ghi trên Giấy chứng nhận
Trong thời hạn 05 ngày làm việc, kể từ ngày nhận đủ hồ sơ hợp lệ cơ quan quản lý nhà nước có thẩm quyền cấp lại Giấy chứng nhận.
Thời hạn của Giấy chứng nhận giữ nguyên thời hạn của Giấy chứng nhận đã cấp.
c) Trường hợp không cấp, cấp lại Giấy chứng nhận cơ quan quản lý nhà nước có thẩm quyền cấp có văn bản trả lời và nêu rõ lý do.
Điều 24. Thời hạn, thẩm quyền cấp Giấy chứng nhận đủ điều kiện sản xuất phân bón, Giấy chứng nhận đủ điều kiện buôn bán phân bón1. Thời hạn Giấy chứng nhận
Giấy chứng nhận đủ điều kiện sản xuất phân bón có thời hạn 05 năm.
2. Thẩm quyền cấp Giấy chứng nhận
a) Cục Bảo vệ thực vật là cơ quan quản lý nhà nước có thẩm quyền cấp Giấy chứng nhận đủ điều kiện sản xuất phân bón (trừ cơ sở chỉ hoạt động đóng gói phân bón) theo Mẫu số 16 tại Phụ lục I ban hành kèm theo Nghị định này;
b) Chi cục Trồng trọt và Bảo vệ thực vật là cơ quan quản lý nhà nước có thẩm quyền cấp Giấy chứng nhận đủ điều kiện sản xuất phân bón đối với cơ sở chỉ hoạt động đóng gói phân bón theo Mẫu số 16 tại Phụ lục I ban hành kèm theo Nghị định này, Giấy chứng nhận đủ điều kiện buôn bán phân bón theo Mẫu số 17 tại Phụ lục I ban hành kèm theo Nghị định này.
3. Cơ quan quản lý nhà nước có thẩm quyền cấp Giấy chứng nhận tổng hợp, công bố trên Cổng thông tin điện tử danh sách các tổ chức, cá nhân được cấp Giấy chứng nhận.
Điều 25. Thu hồi Giấy chứng nhận đủ điều kiện sản xuất phân bón, Giấy chứng nhận đủ điều kiện buôn bán phân bón1. Cơ sở sản xuất hoặc buôn bán phân bón bị thu hồi Giấy chứng nhận trong trường hợp sau đây:
a) Sử dụng tài liệu giả hoặc cung cấp thông tin trong tài liệu không đúng thực tế làm sai lệch bản chất của hồ sơ đề nghị cấp Giấy chứng nhận;
b) Sửa chữa, tẩy xóa làm sai lệch nội dung ghi trong Giấy chứng nhận.
2. Việc thu hồi Giấy chứng nhận quy định tại khoản 1 Điều này do cơ quan quản lý nhà nước có thẩm quyền cấp Giấy chứng nhận thực hiện.
3. Tổ chức, cá nhân bị thu hồi Giấy chứng nhận chỉ được xem xét tiếp nhận hồ sơ cấp Giấy chứng nhận sau 24 tháng kể từ ngày cơ quan quản lý nhà nước có thẩm quyền ban hành quyết định thu hồi.
PRODUCTION AND TRADING OF FERTILIZERS
SECTION 1. CONDITIONS FOR PRODUCTION AND TRADING OF FERTILIZERS
Article 18. Conditions for issuance of certificates of eligibility for production of fertilizers
1.Organizations and individuals producing fertilizers shall satisfy the following conditions:
a) Organizations and individuals are established in accordance with regulations of law.
b) The location and areas of their premises are conformable with the power of production lines, machinery and equipment;
c) Production lines, machinery and equipment from the stage of material processing to the stage of completion are conformable with technological processes.
Production stages and systems use equipment that is mechanized or automated as prescribed in Appendix IV of this Decree.
Machinery and equipment subject to strict requirements for safety and measuring equipment for testing are verified, calibrated and corrected in accordance with regulations of law;
d) Materials and finished products are stored in separate areas and there are shelves or pallets to set products;
dd) The organizations and individuals have their testing laboratories recognized or have contracts with testing organizations that are appointed to assess quality criteria of their fertilizers;
e) Their systems for quality management are conformable with ISO 9001 or equivalent standards. A new production establishment shall have its system for quality management within 01 year from the day on which it is established;
g) Their managers obtain bachelor’s degrees or higher degrees in the specialties related to farming, plant protection, soil argochemistry, agronomy, chemistry and biology.
2. The establishments that only package fertilizers are not required to satisfy the conditions prescribed in Points dd and e Clause 1 of this Article.
Article 19. Conditions for issuance of certificates of eligibility for trading of fertilizers
1. Organizations and individuals trading in fertilizers shall satisfy the following conditions:
a) They are registered or established in accordance with regulations of law.
b) They have stores for trading fertilizers. Their stores have signs; records on purchase and sale of fertilizers and price lists of each type of fertilizers published in at conspicuous and readable places;
c) They have areas for storage of fertilizers and shelves or ballets to set fertilizers;
d) People selling fertilizers obtain certificates of professional training in fertilizers, except for people who have obtain associate degrees or higher degrees related to farming, plant protection, agronomy, chemistry or biology.
2. A business establishment which trades in fertilizers without through any store shall obtain the enterprise registration certificate; have stable and legal places for transactions; have records on purchase and sale of fertilizers and satisfy the conditions prescribed in Point d Clause 1 of this Article.
Section 2. APPLICATIONS AND PROCEDURES FOR ISSUANCE OF CERTIFICATES OF ELIGIBILITY FOR PRODUCTION AND TRADING OF FERTILIZERS
Article 20. Applications for certificates of eligibility for production of fertilizers
1. An application forms for the certificates of eligibility for production of fertilizers using the specimen 12 prescribed in Appendix I of this Decree.
2. A description of eligibility for production of fertilizers using the specimen 14 prescribed in Appendix I of this Decree.
3. Valid copies of documents on verification, calibration and correction of machinery and equipment subject to strict requirements for safety and measuring equipment for testing
4. A copy of the bachelor’s degree or higher degree of the applicant’s manager as prescribed in Point g Clause 1 Article 18 of this Decree.
5. A valid copy of the decision on approving environmental impact assessment report (EIA report) or decision on approving detailed project on environmental protection or the written confirmation of registration of the plan for environmental protection or commitment on environmental protection as prescribed by applicable regulations of law.
6. A valid copy of the certificate of assessment of design or plan for fire prevention issued to the applicant in accordance with applicable regulations of law.
Article 21. Applications for certificates of eligibility for trading of fertilizers
1. An application form for the certificate of eligibility for trading of fertilizers using the specimen 13 prescribed in Appendix I of this Decree.
2. A description of eligibility for trading of fertilizers using the specimen 15 prescribed in Appendix I of this Decree.
3. A valid copy of the certificate of professional training in fertilizers or the associate degree or higher degree of the person trading in fertilizers as prescribed in Point d Clause 1 Article 19 of this Decree.
Article 22. Applications for reissuance of certificates of eligibility for production or trading of fertilizers
1. In the cases where certificates of eligibility for production of fertilizers have expired
At least 03 months before the day on which a certificate expires, the fertilizer producer that wishes to continue producing fertilizers shall submit an application for reissuance of the certificate of eligibility for production of fertilizers as prescribed in Article 20 of this Decree.
2. In the cases where certificates of eligibility for production or trading of fertilizers (hereinafter referred to as “certificates of eligibility”) are lost or damaged or have their contents changed, an application for reissuance of a certificate shall consist of:
a) An application form for reissuance of the certificate of eligibility using the specimen 12 or specimen 13 prescribed in Appendix I of this Decree.
b) A valid copy of one of the following documents:
The enterprise registration certificate, investment certificate or business registration certificate, operation registration certificate of the branch or representative office, certificate of business location or business registration certificate that has been amended in case of application for adjustments to contents of enterprise registration or business location or information related to the applicant;
The description of conditions for production of fertilizers using the specimen 14 prescribed in Appendix I of this Decree in case of application for adjustments to operating conditions or production capacity.
The decision on recognition of fertilizers traded in Vietnam or contract for transferring the ownership or fertilizers from other organizations or individuals to the applicant in case of application for addition to types of fertilizers.
c) An original copy of the issued certificates unless it is lost;
Article 23. Procedures for issuance or reissuance of certificates of eligibility
1.Submission of applications
An organization or individual shall submit an application in person, by post or through web portals.
Within 03 working days from the day on which the application is received, if it is not valid, a notification of completing the application will be sent to the applicant.
2. Verification in case of issuance and reissuance of certificates
a) Issuance of certificates or reissuance of certificates of eligibility for production of fertilizers in the cases where the issued certificates have expired
Within 20 days from the day on which the valid application and the results of verification showing that the conditions prescribed on Article 18 are satisfied are received, the competent authority shall issue or reissue the certificate for eligibility for production of fertilizers.
Within 10 days from the day on which the valid application and the results of verification showing that the conditions prescribed on Article 19 are satisfied are received, the competent authority shall issue the certificate of eligibility for trading of fertilizers.
Authorities having power to issue or reissue certificates of eligibility shall carry out site inspections at establishments producing or trading in fertilizers before issuing certificates or reissuing the certificates of eligibility for production of fertilizers. Inspection records shall be made according to the specimen 18 prescribed in Appendix I of this Decree.
b) Reissuance of certificates of eligibility in the case where the issued certificates are lost, damaged or have their contents changed
Within 5 working days from the day on which a valid application is received, the competent authority shall reissue the certificate of eligibility.
The expiry date of the new certificate of eligibility shall be the same as those of the issued certificate.
c) If the competent authority refuses to issue or reissue the certificate of eligibility, it shall send a written explanation to the applicant.
Article 24. Period of certificates and power to issue certificates
1. Periods of certificates
A certificate of eligibility for production of fertilizers shall be valid for 5 years.
2. Power to issue certificates
a) The Plant Protection Department has power to issue certificates of eligibility for production of fertilizers (except for establishments only packaging fertilizers) using the specimen 16 prescribed in Appendix I of this Decree.
b) Crop Cultivation and Plant Protection Sub departments have power to issue certificates of eligibility for production of fertilizers to applicants only packaging fertilizers using the specimen 16 prescribed in Appendix I of this Decree and certificates of eligibility for trading of fertilizers using the specimen 17 prescribed in Appendix I of this Decree.
3. Authorities having power to issue certificates of eligibility shall consolidate and publish lists of organizations and individuals obtaining certificates of eligibility on web portals.
Article 25. Revocation of certificates of eligibility
1. An establishment producing or trading fertilizers will have its certificate of eligibility revoked if:
a) It uses false documents or provides incorrect information, which distorts the nature of the application for the certificate of eligibility;
b) Erasing or repair of the certificate of eligibility falsifies its contents.
2. The certificates of eligibility prescribed in Clause 1 of this Article shall be revoked by the competent authority issuing them.
3. Organizations or individuals whose certificates of eligibility are revoked shall only have their applications for new certificates received after 24 months from the day on which competent authorities issue decisions on revocation of their certificates.
