TRỊ GIÁ TÍNH THUẾ ĐỐI VỚI HÀNG HOÁ NHẬP KHẨU
(Ban hành kèm theo Thông tư số 113/2005/TT-BTC ngày 15/12/2005 của Bộ Tài chính hướng dẫn thi hành thuế xuất khẩu, thuế nhập khẩu)
I. XÁC ĐỊNH TRỊ GIÁ TÍNH THUẾ THEO TRỊ GIÁ GIAO DỊCH:
Trị giá tính thuế của hàng hoá nhập khẩu trước hết phải được xác định theo trị giá giao dịch. Trị giá giao dịch là tổng số tiền người mua đã thực trả hay sẽ phải trả, trực tiếp hoặc gián tiếp cho người bán để mua hàng hoá nhập khẩu, sau khi đã cộng thêm và/hoặc trừ ra một số khoản điều chỉnh theo hướng dẫn tại Mục VII Phụ lục này.
1. Trị giá giao dịch được áp dụng với điều kiện:
1.1. Người mua không bị hạn chế quyền định đoạt hoặc sử dụng hàng hoá sau khi nhập khẩu, trừ các hạn chế dưới đây:
1.1.1. Hạn chế do pháp luật Việt Nam quy định, như: Các quy định về việc hàng hoá nhập khẩu phải dán nhãn mác bằng tiếng Việt, hàng hoá nhập khẩu có điều kiện, hoặc hàng hoá phải chịu một hình thức kiểm tra trước khi được thông quan, v.v.
1.1.2. Hạn chế về nơi tiêu thụ hàng hoá; hoặc
1.1.3. Hạn chế khác không ảnh hưởng đến trị giá của hàng hoá.
Những hạn chế này là một hoặc nhiều yếu tố có liên quan trực tiếp hay gián tiếp đến hàng hoá nhập khẩu, nhưng không làm tăng hoặc giảm giá thực thanh toán cho hàng hoá đó.
Ví dụ: Người bán yêu cầu người mua không được bán hoặc trưng bày hàng hoá nhập khẩu trước khi giới thiệu hàng hoá này ra thị trường.
1.2. Giá cả hoặc việc bán hàng không phụ thuộc vào những điều kiện hay các khoản thanh toán mà vì chúng không xác định được trị giá của hàng hoá cần xác định trị giá tính thuế.
Một số yếu tố ảnh hưởng đến trị giá của hàng hóa cần cân nhắc khi xác định trị giá giao dịch như:
- Người bán định giá hàng hoá nhập khẩu với điều kiện là người mua cũng sẽ mua một số lượng nhất định các hàng hoá khác nữa.
- Giá cả của hàng hoá nhập khẩu phụ thuộc vào giá của hàng hoá khác mà người nhập khẩu sẽ bán lại cho người xuất khẩu.
- Giá cả của hàng hoá nhập khẩu được xây dựng trên cơ sở một hình thức thanh toán không liên quan trực tiếp tới hàng hoá nhập khẩu, như: hàng hoá nhập khẩu là hàng bán thành phẩm do người bán cung cấp cho người mua với điều kiện là người bán sẽ nhận lại một số lượng thành phẩm nhất định làm từ các hàng hoá nhập khẩu bán thành phẩm đó.
Trường hợp việc mua bán hàng hoá hay giá cả của hàng hoá phụ thuộc vào một hay một số điều kiện nhưng người mua có tài liệu khách quan, hợp lệ để xác định mức độ ảnh hưởng bằng tiền của sự phụ thuộc đó thì vẫn được xem là đã đáp ứng điều kiện này. Khi xác định trị giá tính thuế phải cộng khoản tiền được giảm do ảnh hưởng của sự phụ thuộc đó vào trị giá giao dịch.
1.3. Sau khi bán lại, chuyển nhượng hoặc sử dụng hàng hoá nhập khẩu, người mua không phải trả thêm bất kỳ khoản tiền nào từ số tiền thu được do việc định đoạt hàng hoá nhập khẩu mang lại, không kể khoản phải cộng quy định tại điểm 2.6 Mục VII Phụ lục này.
1.4. Người mua và người bán không có mối quan hệ đặc biệt hoặc nếu có thì mối quan hệ đặc biệt đó không ảnh hưởng đến trị giá giao dịch. Việc xem xét ảnh hưởng của mối quan hệ đặc biệt đến trị giá giao dịch được hướng dẫn tại điểm 3 dưới đây.
2. Trị giá giao dịch bao gồm các khoản sau đây:
2.1. Giá mua ghi trên hoá đơn:
Trường hợp giá mua ghi trên hoá đơn có bao gồm các khoản giảm giá cho lô hàng nhập khẩu thì các khoản này được trừ ra để xác định trị giá tính thuế, với điều kiện việc giảm giá được lập thành văn bản trước khi xếp hàng lên phương tiện vận chuyển và có số liệu, chứng từ hợp pháp, hợp lệ để tách khoản giảm giá này ra khỏi giá hoá đơn và các chứng từ đó phải nộp cùng với tờ khai hải quan.
Các loại giảm giá bao gồm:
- Giảm giá theo cấp độ thương mại của giao dịch mua bán hàng hoá;
- Giảm giá theo số lượng hàng hoá mua bán;
- Giảm giá theo hình thức và thời gian thanh toán;
- Các loại giảm giá khác phù hợp với tập quán và thông lệ thương mại quốc tế.
2.2. Các khoản điều chỉnh theo hướng dẫn tại Mục VII Phụ lục này.
2.3. Các khoản tiền người mua phải trả nhưng chưa tính vào giá mua ghi trên hoá đơn, bao gồm:
- Tiền trả trước, tiền ứng trước, tiền đặt cọc cho việc sản xuất, mua bán, vận tải, bảo hiểm hàng hoá.
- Các khoản thanh toán gián tiếp cho người bán như khoản tiền mà người mua trả cho người thứ ba theo yêu cầu của người bán; khoản tiền được thanh toán bằng cách cấn trừ nợ.
3. Xác định ảnh hưởng của mối quan hệ đặc biệt đến trị giá giao dịch:
3.1. Trường hợp người mua và người bán có mối quan hệ đặc biệt nhưng không ảnh hưởng đến trị giá giao dịch thì người khai hải quan phải khai báo về việc này và xác định trị giá tính thuế theo trị giá giao dịch.
3.2. Trên cơ sở những thông tin có sẵn, trường hợp cơ quan hải quan có nghi ngờ cho rằng mối quan hệ đặc biệt có ảnh hưởng đến trị giá giao dịch thì phải thông báo ngay bằng văn bản cho người khai hải quan biết căn cứ nghi ngờ. Trong trường hợp đó, cơ quan hải quan tạo điều kiện để người khai hải quan giải trình và cung cấp thêm thông tin có liên quan nhằm làm rõ mối quan hệ đặc biệt giữa người mua và người bán không ảnh hưởng đến trị giá giao dịch của hàng hoá nhập khẩu, bằng cách chỉ ra:
3.2.1. Trị giá giao dịch đó xấp xỉ với một trong những trị giá dưới đây của lô hàng được xuất khẩu đến Việt Nam trong cùng ngày hoặc trong vòng 60 ngày (ngày theo lịch) trước hoặc sau ngày xuất khẩu lô hàng đang được xác định trị giá tính thuế:
- Trị giá tính thuế được xác định theo trị giá giao dịch của hàng hoá nhập khẩu giống hệt hay tương tự được bán cho người nhập khẩu khác không có mối quan hệ đặc biệt với người xuất khẩu (người bán);
- Trị giá tính thuế của hàng hoá nhập khẩu giống hệt hay tương tự được xác định theo trị giá khấu trừ quy định tại Mục IV Phụ lục này;
- Trị giá tính thuế của hàng hoá nhập khẩu giống hệt hay tương tự được xác định theo trị giá tính toán quy định tại Mục V Phụ lục này.
Nếu quá 30 ngày làm việc, kể từ ngày nhận được thông báo của cơ quan hải quan mà người khai hải quan không giải trình và cung cấp thêm thông tin có liên quan thì cơ quan hải quan thực hiện xác định trị giá tính thuế cho lô hàng nhập khẩu theo nguyên tắc và phương pháp xác định trị giá tính thuế quy định từ Mục I đến Mục VI Phụ lục này.
3.2.2. Những trị giá tính thuế trên đây chỉ nhằm mục đích so sánh và phải điều chỉnh trị giá tính thuế của hàng hoá nhập khẩu giống hệt, hàng hoá nhập khẩu tương tự về cùng điều kiện với hàng hoá nhập khẩu đang chứng minh:
- Điều chỉnh về cùng điều kiện mua bán.
Việc điều chỉnh trị giá tính thuế của hàng hoá nhập khẩu giống hệt, tương tự về cùng điều kiện mua bán với lô hàng đang chứng minh được thực hiện theo hướng dẫn tại điểm 2.2 Mục III Phụ lục này.
- Điều chỉnh các khoản phải cộng, phải trừ theo hướng dẫn tại Mục VII Phụ lục này.
4. Đối với hàng hoá nhập khẩu là phương tiện thông tin chứa các dữ liệu hoặc các hướng dẫn (sau đây gọi chung là phần mềm hoặc thông tin) thì trị giá tính thuế chỉ bao gồm trị giá của bản thân phương tiện thông tin, không bao gồm trị giá của các phần mềm hoặc thông tin mà nó chứa đựng (ví dụ: chương trình phần mềm, các chỉ dẫn mô tả chương trình thông tin số hoá) với điều kiện trên hóa đơn trị giá của phần mềm hoặc thông tin được tách biệt với trị giá của phương tiện thông tin.
Phương tiện thông tin nêu trên có thể là đĩa mềm, đĩa CD, CPU hoặc bất kỳ vật thể nào lưu giữ được thông tin, nhưng không bao gồm các bảng mạch tích hợp, mạch bán dẫn và các thiết bị tương tự hoặc các bộ phận gắn vào các bảng mạch hoặc thiết bị đó.
Hướng dẫn tại điểm này không áp dụng đối với việc nhập khẩu sản phẩm chứa đựng âm thanh, hình ảnh phim truyện hoặc hình ảnh video.
Nếu không xác định được trị giá tính thuế theo trị giá giao dịch hướng dẫn tại Mục I Phụ lục này thì trị giá tính thuế của hàng hoá nhập khẩu được xác định theo trị giá giao dịch của hàng hoá nhập khẩu giống hệt.
Phương pháp xác định trị giá tính thuế theo trị giá giao dịch của hàng hoá nhập khẩu giống hệt được thực hiện như hướng dẫn tại Mục III dưới đây, trong đó cụm từ “hàng hoá nhập khẩu tương tự” được thay thế bằng cụm từ “hàng hoá nhập khẩu giống hệt”.
1. Xác định trị giá tính thuế:
Nếu không xác định được trị giá tính thuế theo các phương pháp hướng dẫn tại Mục I và II Phụ lục này thì trị giá tính thuế của hàng hoá nhập khẩu được xác định theo trị giá giao dịch của hàng hoá nhập khẩu tương tự, với điều kiện hàng hoá nhập khẩu tương tự đã được cơ quan hải quan chấp nhận xác định trị giá tính thuế theo trị giá giao dịch, và có cùng các điều kiện mua bán, điều kiện về thời gian xuất khẩu với hàng hoá nhập khẩu đang xác định trị giá tính thuế theo hướng dẫn tại điểm 2 dưới đây.
Trường hợp không tìm được lô hàng nhập khẩu tương tự có cùng điều kiện mua bán với lô hàng nhập khẩu đang được xác định trị giá tính thuế thì lựa chọn lô hàng nhập khẩu tương tự khác về điều kiện mua bán, nhưng phải được điều chỉnh về cùng điều kiện mua bán.
2. Điều kiện lựa chọn lô hàng nhập khẩu tương tự: Lô hàng nhập khẩu tương tự được lựa chọn nếu đảm bảo các điều kiện sau:
2.1. Điều kiện về thời gian xuất khẩu:
Lô hàng nhập khẩu tương tự phải được xuất khẩu đến Việt Nam vào cùng ngày hoặc trong vòng 60 ngày theo lịch trước hoặc sau ngày xuất khẩu với hàng hoá nhập khẩu đang được xác định trị giá tính thuế.
2.2. Điều kiện mua bán:
2.2.1. Điều kiện về cấp độ thương mại và số lượng:
2.2.1.1. Lô hàng nhập khẩu tương tự phải có cùng điều kiện về cấp độ thương mại và số lượng với lô hàng nhập khẩu đang được xác định trị giá tính thuế.
2.2.1.2. Nếu không tìm được lô hàng nhập khẩu nêu tại điểm 2.2.1.1 thì lựa chọn lô hàng nhập khẩu có cùng cấp độ thương mại nhưng khác nhau về số lượng, sau đó điều chỉnh trị giá giao dịch của hàng hoá nhập khẩu tương tự về cùng số lượng với lô hàng đang xác định trị giá tính thuế.
2.2.1.3. Nếu không tìm được lô hàng nhập khẩu nêu tại điểm 2.2.1.1 và 2.2.1.2 thì lựa chọn lô hàng nhập khẩu khác nhau về cấp độ thương mại nhưng cùng số lượng, sau đó điều chỉnh trị giá giao dịch của lô hàng nhập khẩu tương tự về cùng cấp độ thương mại với lô hàng đang xác định trị giá tính thuế.
2.2.1.4. Nếu không tìm được lô hàng nhập khẩu nêu tại điểm 2.2.1.1, 2.2.1.2 và 2.2.1.3 thì lựa chọn lô hàng nhập khẩu khác nhau cả về cấp độ thương mại và số lượng, sau đó điều chỉnh trị giá giao dịch của lô hàng nhập khẩu tương tự về cùng cấp độ thương mại và số lượng với lô hàng đang xác định trị giá tính thuế.
2.2.2. Điều kiện về quãng đường và phương thức vận tải, bảo hiểm:
Lô hàng nhập khẩu tương tự có cùng quãng đường và phương thức vận tải, hoặc đã được điều chỉnh về cùng quãng đường và phương thức vận tải với lô hàng đang xác định trị giá.
Nếu có sự chênh lệch đáng kể về phí bảo hiểm thì điều chỉnh về cùng điều kiện bảo hiểm với lô hàng đang xác định trị giá tính thuế.
2.3. Khi áp dụng phương pháp xác định trị giá tính thuế theo trị giá giao dịch của hàng hoá nhập khẩu tương tự, nếu không tìm được hàng hoá nhập khẩu tương tự được sản xuất bởi cùng một người sản xuất hoặc người sản xuất khác được uỷ quyền thì mới xét đến hàng hoá được sản xuất bởi người sản xuất khác và phải có cùng xuất xứ.
2.4. Khi xác định trị giá tính thuế theo phương pháp này mà xác định được từ hai trị giá giao dịch của hàng hoá nhập khẩu tương tự trở lên thì sau khi đã điều chỉnh về cùng điều kiện mua bán với lô hàng đang xác định trị giá tính thuế, trị giá tính thuế là trị giá giao dịch thấp nhất.
Nếu trong thời gian làm thủ tục hải quan mà không đủ thông tin lựa chọn hàng nhập khẩu giống hệt hoặc tương tự với hàng hoá nhập khẩu đang xác định trị giá tính thuế thì không xác định trị giá tính thuế cho hàng hoá nhập khẩu theo hướng dẫn tại Mục II hoặc Mục III Phụ lục này mà phải chuyển sang phương pháp tiếp theo.
3. Chứng từ, tài liệu phải nộp:
3.1. Khi áp dụng phương pháp xác định trị giá tính thuế theo trị giá giao dịch của hàng hoá nhập khẩu tương tự, người khai hải quan phải nộp cho cơ quan hải quan bản sao có xác nhận sao y bản chính của doanh nghiệp các tài liệu sau:
- Tờ khai hải quan và tờ khai trị giá của hàng hoá nhập khẩu tương tự;
- Hợp đồng vận tải của hàng hoá nhập khẩu tương tự (nếu có sự điều chỉnh chi phí này);
- Hợp đồng bảo hiểm của hàng hoá nhập khẩu tương tự (nếu có sự điều chỉnh chi phí này);
- Hợp đồng thương mại; hoá đơn thương mại của hàng hoá nhập khẩu tương tự, các bảng giá bán hàng xuất khẩu của nhà sản xuất hoặc người bán hàng ở nước ngoài (nếu có sự điều chỉnh về số lượng, cấp độ thương mại);
- Các hồ sơ, chứng từ hợp pháp, hợp lệ khác cần thiết và liên quan đến việc xác định trị giá tính thuế (nếu cần thiết).
3.2. Đối với cơ quan hải quan khi áp dụng phương pháp xác định trị giá tính thuế theo trị giá giao dịch của hàng hoá nhập khẩu tương tự phải căn cứ vào các thông tin có sẵn tại cơ quan hải quan nơi xác định trị giá tính thuế và các tài liệu, chứng từ do người khai hải quan cung cấp để xác định trị giá tính thuế.
1. Xác định trị giá tính thuế:
Nếu không xác định được trị giá tính thuế theo các phương pháp hướng dẫn từ Mục I đến Mục III Phụ lục này thì trị giá tính thuế của hàng hoá nhập khẩu được xác định theo trị giá khấu trừ, căn cứ vào đơn giá bán hàng hoá nhập khẩu, hàng hoá nhập khẩu giống hệt hoặc hàng hoá nhập khẩu tương tự trên thị trường nội địa Việt Nam và trừ (-) các chi phí hợp lý, lợi nhuận thu được sau khi bán hàng nhập khẩu.
Phương pháp này không áp dụng đối với người mua hàng trong nước là người cung cấp các khoản trợ giúp nêu tại điểm 2.4.1 Mục VII Phụ lục này có liên quan đến hàng hoá được lựa chọn để xác định đơn giá bán.
2. Điều kiện lựa chọn đơn giá bán trên thị trường Việt Nam:
2.1. Đơn giá bán trên thị trường Việt Nam phải là đơn giá bán của chính hàng hoá nhập khẩu đang được xác định trị giá tính thuế, hàng hoá nhập khẩu giống hệt hoặc hàng hoá nhập khẩu tương tự, được bán nguyên trạng như khi nhập khẩu.
2.2. Đơn giá bán được lựa chọn là đơn giá tương ứng với lượng hàng hoá được bán ra với số lượng luỹ kế lớn nhất ở mức đủ để hình thành đơn giá; Hàng hoá được bán ra ngay sau khi nhập khẩu, nhưng không quá 90 ngày theo lịch sau ngày nhập khẩu của hàng hoá đang được xác định trị giá tính thuế; Người mua hàng trong nước và người bán không có mối quan hệ đặc biệt.
Ví dụ: Lô hàng A gồm nhiều mặt hàng trong đó mặt hàng B phải xác định trị giá tính thuế theo phương pháp khấu trừ. Lô hàng A được nhập khẩu vào ngày 1/1/2005. Một lô hàng trong đó có mặt hàng giống hệt với mặt hàng B nhập khẩu trước đó và được bán cho nhiều người mua trong nước theo các mức giá và thời điểm khác nhau như sau:

- Trong ví dụ trên, đơn giá bán được lựa chọn để khấu trừ là 800 đồng/chiếc, tương ứng với số lượng bán ra lớn nhất (450 chiếc), ở mức đủ để hình thành đơn giá. Đơn giá này thỏa mãn các điều kiện về lựa chọn đơn giá bán, đó là:
+ Có số lượng lũy kế lớn nhất (450 chiếc).
+ Thời gian bán là trong vòng 90 ngày kể từ ngày nhập khẩu.
3. Nguyên tắc khấu trừ:
Việc xác định các khoản khấu trừ phải dựa trên cơ sở các số liệu kế toán, chứng từ hợp pháp, hợp lệ có sẵn và được ghi chép, phản ánh theo các quy định, chuẩn mực của kế toán Việt Nam.
Các khoản được khấu trừ phải là những khoản nằm trong phạm vi được phép hạch toán vào giá vốn.
4. Các khoản được khấu trừ khỏi đơn giá bán hàng:
Các khoản được khấu trừ khỏi đơn giá bán hàng là những chi phí hợp lý và lợi nhuận thu được sau khi bán hàng trên thị trường Việt Nam, gồm các khoản sau:
4.1. Chi phí vận chuyển, phí bảo hiểm và chi phí cho các hoạt động khác liên quan đến việc vận chuyển hàng hoá sau khi nhập khẩu, cụ thể:
4.1.1. Chi phí vận chuyển, phí bảo hiểm và các chi phí khác liên quan đến việc vận chuyển hàng hoá phát sinh từ cửa khẩu nhập đầu tiên đến kho hàng của người nhập khẩu hoặc địa điểm giao hàng trong nội địa Việt Nam;
4.1.2. Chi phí vận chuyển, phí bảo hiểm và các chi phí khác liên quan đến việc vận chuyển từ kho hàng của người nhập khẩu trong nội địa Việt Nam đến địa điểm bán hàng, nếu người nhập khẩu phải chịu các khoản này.
4.2. Các khoản thuế, phí và lệ phí phải nộp tại Việt Nam khi nhập khẩu và bán hàng hoá nhập khẩu trên thị trường nội địa Việt Nam.
4.3. Hoa hồng hoặc chi phí chung và lợi nhuận liên quan đến các hoạt động bán hàng hoá nhập khẩu tại Việt Nam.
4.3.1. Trường hợp người nhập khẩu là đại lý bán hàng cho thương nhân nước ngoài thì khấu trừ khoản hoa hồng. Nếu trong khoản hoa hồng đã bao gồm các chi phí nêu tại điểm 4.1 và 4.2 trên đây thì không được khấu trừ thêm các khoản này.
4.3.2. Trường hợp nhập khẩu theo phương thức mua đứt bán đoạn thì khấu trừ các khoản chi phí chung và lợi nhuận: Chi phí chung và lợi nhuận phải được xem xét một cách tổng thể khi xác định trị giá khấu trừ.
Chi phí chung bao gồm các chi phí trực tiếp, chi phí gián tiếp phục vụ cho việc nhập khẩu và bán hàng hoá trên thị trường nội địa, như: chi phí về tiếp thị hàng hoá, chi phí về lưu giữ và bảo quản hàng hoá trước khi bán hàng, chi phí về các hoạt động quản lý phục vụ cho việc nhập khẩu và bán hàng, v.v. Việc phân bổ chi phí chung phải cho lô hàng nhập khẩu phải được thực hiện theo các quy định và chuẩn mực kế toán Việt Nam.
Lợi nhuận thu được sau khi bán hàng nhập khẩu được xác định căn cứ vào doanh thu bán hàng trừ chi phí chung và các chi phí nêu tại điểm 4.1 và 4.2 trên đây.
Căn cứ để xác định các khoản khấu trừ là số liệu được ghi chép và phản ánh trên chứng từ, sổ sách kế toán của người nhập khẩu, phù hợp với quy định, chuẩn mực của kế toán Việt Nam. Số liệu này phải tương ứng với những số liệu thu được từ những hoạt động mua bán hàng hoá nhập khẩu cùng phẩm cấp hoặc cùng chủng loại tại Việt Nam.
5. Đối với hàng hoá được bán không còn nguyên trạng như khi nhập khẩu:
5.1. Trường hợp không tìm được đơn giá bán của hàng hoá được bán nguyên trạng như khi nhập khẩu thì lấy đơn giá bán hàng hoá nhập khẩu đã qua quá trình gia công, chế biến thêm ở trong nước và trừ đi các chi phí gia công, chế biến làm tăng thêm giá trị của hàng hoá, với điều kiện có thể định lượng được các chi phí gia tăng do quá trình gia công, chế biến thêm ở trong nước và các chi phí đã nêu tại điểm 4. Trường hợp không tách được các chi phí gia tăng này khỏi giá bán, thì không áp dụng được phương pháp xác định trị giá tính thuế theo trị giá khấu trừ, và phải chuyển sang phương pháp tiếp theo.
5.2. Trường hợp sau khi gia công, chế biến mà hàng hoá nhập khẩu vẫn giữ nguyên được đặc điểm, tính chất, công dụng như khi nhập khẩu, nhưng chỉ còn là một bộ phận của hàng hoá được bán ra trên thị trường trong nước thì không được áp dụng trị giá khấu trừ để xác định trị giá tính thuế cho hàng hoá nhập khẩu.
5.3. Nếu sau khi gia công, chế biến mà hàng hoá nhập khẩu bị thay đổi đặc điểm, tính chất, công dụng và không còn nhận biết được hàng hoá nhập khẩu ban đầu thì không được áp dụng phương pháp này.
6. Chứng từ, tài liệu phải nộp:
Người khai hải quan hoặc người nhập khẩu phải nộp bản sao có xác nhận sao y bản chính của doanh nghiệp các chứng từ sau đây cùng với hồ sơ làm thủ tục hải quan:
6.1. Hoá đơn bán hàng do Bộ Tài chính phát hành hoặc cho phép sử dụng.
6.2. Hợp đồng đại lý bán hàng nếu người nhập khẩu là đại lý bán hàng của người xuất khẩu. Hợp đồng này phải quy định cụ thể khoản phí hoa hồng mà người đại lý được hưởng, các loại chi phí mà người đại lý phải trả.
6.3. Bản giải trình về doanh thu bán hàng và các khoản chi phí nêu tại điểm 4.
6.4. Tờ khai hải quan và tờ khai trị giá của lô hàng được lựa chọn để khấu trừ.
6.5. Các tài liệu cần thiết khác để kiểm tra, xác định trị giá tính thuế theo yêu cầu của cơ quan hải quan.
1. Nếu không xác định được trị giá tính thuế theo các phương pháp quy định từ Mục I đến Mục IV Phụ lục này thì trị giá tính thuế của hàng hoá nhập khẩu được xác định theo trị giá tính toán. Trị giá tính toán của hàng hoá nhập khẩu bao gồm các khoản sau:
1.1. Chi phí trực tiếp để sản xuất ra hàng hoá nhập khẩu: Giá thành hoặc trị giá của nguyên vật liệu, chi phí của quá trình sản xuất hoặc quá trình gia công khác được sử dụng vào sản xuất hàng nhập khẩu.
1.2. Chi phí chung và lợi nhuận phát sinh trong hoạt động bán hàng hoá cùng phẩm cấp hoặc cùng chủng loại với hàng hoá nhập khẩu đang xác định trị giá, được sản xuất ở nước xuất khẩu để bán hàng đến Việt Nam. Khoản lợi nhuận và chi phí chung phải được xem xét một cách tổng thể khi xác định trị giá tính toán.
Chi phí chung bao gồm tất cả các chi phí trực tiếp hay gián tiếp của quá trình sản xuất và bán để xuất khẩu hàng hoá, nhưng chưa được tính toán theo hướng dẫn nêu tại điểm 1.1 trên đây.
1.3. Các chi phí vận chuyển, bảo hiểm và các chi phí có liên quan đến việc vận chuyển hàng hoá nhập khẩu theo hướng dẫn tại điểm 2.7 và 2.8 Mục VII Phụ lục này.
2. Căn cứ để xác định trị giá tính toán là số liệu được ghi chép và phản ánh trên chứng từ, sổ sách kế toán của người sản xuất, phù hợp với quy định, chuẩn mực kế toán của nước sản xuất. Số liệu này phải tương ứng với những số liệu thu được từ những hoạt động sản xuất, mua bán hàng hoá nhập khẩu cùng phẩm cấp hoặc cùng chủng loại do người sản xuất tại nước xuất khẩu sản xuất ra để xuất khẩu đến Việt Nam.
3. Chứng từ, tài liệu phải nộp:
Người khai hải quan hoặc người nhập khẩu phải nộp bản sao có xác nhận sao y bản chính của các tài liệu, chứng từ sau, đồng thời xuất trình bản gốc để đối chiếu:
3.1. Bản giải trình của người sản xuất về các chi phí nêu tại điểm 1.1 và 1.2 trên đây, kèm theo bản sao có xác nhận của người sản xuất về các chứng từ, số liệu kế toán phù hợp với bản giải trình này;
3.2. Hoá đơn bán hàng của người sản xuất;
3.3. Chứng từ về các chi phí nêu tại điểm 1.3 trên đây.
Trường hợp không có đầy đủ các chứng từ nêu trên thì không xác định trị giá tính thuế theo hướng dẫn tại mục này và chuyển sang phương pháp tiếp theo.
1. Nếu không xác định được trị giá tính thuế theo các phương pháp hướng dẫn từ Mục I đến Mục V Phụ lục này thì trị giá tính thuế được xác định theo phương pháp suy luận, căn cứ vào các tài liệu, số liệu khách quan, có sẵn tại thời điểm xác định trị giá tính thuế.
Trị giá tính thuế theo phương pháp suy luận được xác định bằng cách áp dụng tuần tự và linh hoạt các phương pháp xác định trị giá tính thuế hướng dẫn từ Mục I đến Mục V Phụ lục này và dừng ngay tại phương pháp xác định được trị giá tính thuế, với điều kiện việc áp dụng như vậy không trái với các quy định tại điểm 2 dưới đây.
2. Khi xác định trị giá tính thuế theo phương pháp này, người khai hải quan và cơ quan hải quan không được sử dụng các trị giá dưới đây để xác định trị giá tính thuế:
2.1. Giá bán trên thị trường nội địa của mặt hàng cùng loại được sản xuất tại Việt Nam.
2.2. Giá bán hàng hoá ở thị trường nội địa nước xuất khẩu.
2.3. Giá bán hàng hoá để xuất khẩu đến nước khác.
2.4. Chi phí sản xuất hàng hoá, trừ các chi phí sản xuất hàng hoá được sử dụng trong phương pháp tính toán.
2.5. Giá tính thuế tối thiểu.
2.6. Các loại giá áp đặt hoặc giả định.
2.7. Sử dụng trị giá cao hơn trong hai trị giá thay thế để làm trị giá tính thuế.
3. Một số trường hợp vận dụng linh hoạt các phương pháp xác định trị giá tính thuế:
3.1. Vận dụng phương pháp xác định trị giá tính thuế theo trị giá giao dịch của hàng hoá nhập khẩu giống hệt hoặc hàng hoá nhập khẩu tương tự.
3.1.1. Nếu không có hàng hoá nhập khẩu giống hệt hoặc hàng hoá nhập khẩu tương tự được xuất khẩu đến Việt Nam vào cùng ngày hoặc trong vòng 60 ngày theo lịch trước hoặc sau ngày xuất khẩu của lô hàng nhập khẩu đang được xác định trị giá tính thuế thì lựa chọn những hàng hoá nhập khẩu giống hệt hoặc hàng hoá nhập khẩu tương tự được xuất khẩu trong khoảng thời gian dài hơn, nhưng không quá 90 ngày theo lịch trước hoặc sau ngày xuất khẩu của lô hàng đang được xác định trị giá tính thuế.
3.1.2. Nếu không có hàng hoá nhập khẩu giống hệt hoặc hàng hoá nhập khẩu tương tự có cùng xuất xứ thì lựa chọn hàng hoá nhập khẩu không cùng xuất xứ nhưng vẫn thoả mãn các điều kiện khác về hàng hoá nhập khẩu giống hệt, hàng hoá nhập khẩu tương tự.
3.2. Vận dụng phương pháp xác định trị giá tính thuế theo trị giá khấu trừ bằng một trong các cách sau đây:
3.2.1. Trong vòng 90 ngày theo lịch kể từ ngày nhập khẩu mà không xác định được đơn giá dùng để khấu trừ thì lựa chọn đơn giá được bán ra với số lượng lũy kế lớn nhất trong vòng 120 ngày theo lịch kể từ ngày nhập khẩu của lô hàng được lựa chọn để khấu trừ.
3.2.2. Nếu không có đơn giá bán lại của chính hàng hoá nhập khẩu hoặc hàng hoá nhập khẩu giống hệt hay hàng hoá nhập khẩu tương tự cho người không có quan hệ đặc biệt với người nhập khẩu thì lựa chọn đơn giá bán lại hàng hoá cho người mua có quan hệ đặc biệt, với điều kiện mối quan hệ đặc biệt không ảnh hưởng đến giá cả trong giao dịch mua bán.
3.3. Trị giá tính thuế của hàng hoá nhập khẩu được xác định bằng trị giá tính thuế của hàng hoá nhập khẩu giống hệt đã được xác định theo trị giá khấu trừ hoặc trị giá tính toán.
3.4. Trị giá tính thuế của hàng hoá nhập khẩu được xác định bằng trị giá tính thuế của hàng hoá nhập khẩu tương tự đã được xác định theo trị giá khấu trừ hoặc trị giá tính toán.
4. Ngoài các trường hợp nêu tại điểm 3 trên đây, người nhập khẩu có thể dựa vào các thông tin có sẵn, các tài liệu khách quan hợp pháp hợp lệ để vận dụng linh hoạt các phương pháp khác.
1. Nguyên tắc điều chỉnh.
1.1. Đối với các khoản phải cộng, chỉ điều chỉnh khi có các điều kiện sau:
- Các khoản này do người mua thanh toán và chưa được tính trong giá thực tế đã trả hay sẽ phải trả.
- Khoản phải cộng phải liên quan trực tiếp đến hàng hoá nhập khẩu.
- Trường hợp lô hàng nhập khẩu có các khoản phải cộng nhưng không có các số liệu khách quan để xác định trị giá tính thuế thì không xác định theo trị giá giao dịch và phải chuyển sang phương pháp tiếp theo.
1.2. Đối với các khoản được trừ, chỉ điều chỉnh khi có các số liệu, chứng từ hợp pháp, hợp lệ để tách khỏi giá bán và có sẵn tại thời điểm xác định trị giá tính thuế.
2. Các khoản phải cộng:
2.1. Tiền hoa hồng và phí môi giới, trừ hoa hồng mua hàng. Trường hợp các chi phí này bao gồm các khoản thuế phải nộp ở Việt Nam thì không phải cộng các khoản thuế đó vào trị giá tính thuế của hàng hoá nhập khẩu.
2.2. Chi phí bao bì được coi là đồng nhất với hàng hoá nhập khẩu, bao gồm giá mua bao bì, các chi phí khác liên quan đến việc mua bán và vận tải bao bì đến nơi đóng gói, bảo quản hàng hoá.
Các loại container, thùng chứa, giá đỡ được sử dụng như một phương tiện để đóng gói phục vụ chuyên chở hàng hoá, và sử dụng nhiều lần thì không được coi là bao bì gắn liền với hàng hoá nên không phải là khoản phải cộng về chi phí bao bì gắn liền với hàng hoá.
2.3. Chi phí đóng gói hàng hoá, bao gồm các khoản sau đây:
2.3.1. Chi phí về vật liệu đóng gói bao gồm giá mua vật liệu đóng gói và các chi phí khác liên quan đến việc mua bán và vận chuyển vật liệu đóng gói đến địa điểm thực hiện việc đóng gói.
2.3.2. Chi phí về nhân công đóng gói, bao gồm tiền thuê nhân công và các chi phí liên quan đến việc thuê nhân công đóng gói hàng hoá đang được xác định trị giá tính thuế.
Trường hợp, người mua phải chịu các chi phí về ăn ở, đi lại cho công nhân trong thời gian thực hiện việc đóng gói thì các chi phí này cũng thuộc về chi phí nhân công đóng gói.
2.4. Trị giá của hàng hoá, dịch vụ do người mua cung cấp cung cấp miễn phí hoặc giảm giá, được chuyển trực tiếp hoặc gián tiếp cho người sản xuất hoặc người bán hàng, để sản xuất và bán hàng hoá xuất khẩu đến Việt Nam (sau đây gọi là trị giá của khoản trợ giúp).
2.4.1. Các khoản trợ giúp bao gồm:
2.4.1.1. Nguyên liệu, bộ phận cấu thành, phụ tùng và các sản phẩm tương tự hợp thành hàng hoá nhập khẩu.
2.4.1.2. Nguyên liệu, vật liệu, nhiên liệu tiêu hao trong quá trình sản xuất hàng hoá nhập khẩu.
2.4.1.3. Công cụ, dụng cụ, khuôn rập, khuôn đúc, khuôn mẫu và các sản phẩm tương tự được sử dụng để sản xuất hàng hoá nhập khẩu.
2.4.1.4. Bản vẽ thiết kế, bản vẽ kỹ thuật, thiết kế mỹ thuật, kế hoạch triển khai, thiết kế thi công, thiết kế mẫu, sơ đồ, phác thảo và các sản phẩm dịch vụ tương tự được làm ra ở nước ngoài và cần thiết cho quá trình sản xuất hàng hoá nhập khẩu.
2.4.2. Xác định trị giá của khoản trợ giúp:
- Nếu hàng hoá, dịch vụ trợ giúp được mua của một người không có quan hệ đặc biệt để cung cấp cho người bán thì trị giá của khoản trợ giúp là giá mua hàng hoá, dịch vụ trợ giúp đó.
- Nếu hàng hoá, dịch vụ trợ giúp do người nhập khẩu hoặc người có quan hệ đặc biệt với người nhập khẩu sản xuất ra để cung cấp cho người bán thì trị giá của khoản trợ giúp là giá thành sản xuất hàng hoá, dịch vụ trợ giúp đó.
- Nếu các hàng hoá, dịch vụ trợ giúp được làm ra bởi cơ sở sản xuất của người mua đặt ở nước ngoài nhưng không có tài liệu, chứng từ để hạch toán riêng cho hàng hoá, dịch vụ trợ giúp đó thì trị giá của khoản trợ giúp được xác định bằng cách phân bổ tổng chi phí sản xuất trong cùng kỳ của cơ sở đó cho lượng hàng hoá, dịch vụ trợ giúp được sản xuất ra.
- Khoản trợ giúp do người mua thuê hoặc mượn thì trị giá của khoản trợ giúp là chi phí thuê, mượn.
- Khoản trợ giúp là hàng hoá đã qua sử dụng thì trị giá của khoản trợ giúp là giá trị còn lại của hàng hoá đó.
- Hàng hoá trợ giúp được người mua gia công, chế biến trước khi chuyển cho người bán để sử dụng vào sản xuất hàng hoá nhập khẩu thì phải cộng thêm phần giá trị tăng thêm do gia công, chế biến vào trị giá của khoản trợ giúp.
- Khoản trợ giúp được người mua bán giảm giá cho người xuất khẩu thì phải cộng thêm phần trị giá được giảm vào trị giá tính thuế.
- Trường hợp, sau khi sản xuất ra hàng hoá nhập khẩu còn thu được nguyên, vật liệu thừa, phế liệu từ các hàng hoá trợ giúp thì phần trị giá thu hồi được từ vật liệu thừa và phế liệu này được trừ ra khỏi trị giá của khoản trợ giúp, nếu có số liệu thể hiện trị giá của phế liệu hoặc nguyên, vật liệu thừa.
Trị giá các khoản trợ giúp được xác định bao gồm cả các chi phí liên quan đến việc mua bán, vận tải, bảo hiểm đến nơi sản xuất ra hàng hoá nhập khẩu.
2.4.3. Phân bổ trị giá khoản trợ giúp cho hàng hoá nhập khẩu.
2.4.3.1. Nguyên tắc phân bổ trị giá khoản trợ giúp.
- Trị giá các khoản trợ giúp phải được phân bổ hết cho hàng hoá nhập khẩu;
- Việc phân bổ phải lập thành các chứng từ hợp pháp, hợp lệ về việc phân bổ;
- Việc phân bổ phải tuân thủ các quy định, chuẩn mực kế toán của Việt Nam.
2.4.3.2. Phương pháp phân bổ trị giá khoản trợ giúp:
Người khai hải quan tự phân bổ các khoản trợ giúp cho hàng hoá nhập khẩu theo một trong các phương pháp sau:
- Phân bổ cho số hàng hoá nhập khẩu trong chuyến hàng nhập khẩu đầu tiên;
- Phân bổ theo số lượng đơn vị hàng hóa đã được sản xuất tính đến thời điểm nhập khẩu chuyến hàng đầu tiên;
- Phân bổ cho toàn bộ sản phẩm dự kiến được sản xuất ra theo thoả thuận mua bán giữa người mua và người bán (hoặc người sản xuất);
- Phân bổ theo nguyên tắc giảm dần hay tăng dần;
- Ngoài các phương pháp trên, người mua có thể sử dụng các phương pháp phân bổ khác, với điều kiện phải tuân thủ các quy định của pháp luật về chế độ kế toán và phải được lập thành chứng từ.
2.5. Tiền bản quyền, phí giấy phép:
2.5.1. Tiền bản quyền, phí giấy phép chỉ phải cộng vào giá thực tế đã thanh toán hoặc sẽ phải thanh toán cho hàng hoá nhập khẩu nếu đáp ứng các điều kiện sau:
2.5.1.1. Tiền bản quyền hoặc phí giấy phép phải được trả cho việc sử dụng các quyền sở hữu trí tuệ, liên quan trực tiếp đến hàng hoá nhập khẩu đang được xác định trị giá.
Trường hợp tiền bản quyền hoặc phí giấy phép phải trả không liên quan trực tiếp đến hàng hoá nhập khẩu thì không phải cộng vào khi xác định trị giá tính thuế.
Ví dụ: Một người nhập khẩu trả tiền bản quyền để được sử dụng quy trình sản xuất vải in hoa mờ cho người giữ bản quyền về quy trình đó. Sau đó, người này nhập khẩu thiết bị máy móc dùng để sản xuất ra loại vải đó từ một người xuất khẩu khác (không phải là người giữ bản quyền). Khoản tiền bản quyền này không phải cộng vào trị giá giao dịch của hàng hoá nhập khẩu vì khoản thanh toán này chỉ trả cho việc sử dụng quy trình sản xuất, chứ không phải trả cho bản thân hàng hoá nhập khẩu là máy móc thiết bị.
2.5.1.2. Tiền bản quyền và phí giấy phép phải do người mua trả trực tiếp hay gián tiếp. Việc trả tiền bản quyền và phí giấy phép phải là một điều kiện của việc mua bán hàng hoá nhập khẩu. Người mua hàng đồng ý trả tiền bản quyền, phí giấy phép như một phần trong hoạt động mua bán nhằm mục đích mua được hàng hoá nhập khẩu.
Người khai hải quan phải nộp cho cơ quan hải quan bản sao có đóng dấu sao y bản chính chứng từ, tài liệu thể hiện việc trả tiền bản quyền, phí giấy phép và văn bản cấp phép do người giữ bản quyền hoặc người giữ quyền cấp phép phát hành.
2.5.1.3. Tiền bản quyền và phí giấy phép chưa được tính trong giá bán của hàng hoá đang được xác định trị giá tính thuế.
2.5.2. Tiền bản quyền, phí giấy phép không phải cộng vào trị giá tính thuế trong các trường hợp sau:
2.5.2.1. Các khoản tiền người mua phải trả cho quyền tái sản xuất hàng hoá nhập khẩu hoặc sao chép các tác phẩm nghệ thuật tại Việt Nam.
2.5.2.2. Các khoản tiền người mua phải trả cho quyền phân phối hoặc bán lại hàng hoá nhập khẩu, nếu việc thanh toán này không phải là một điều kiện của việc bán hàng hoá nhập khẩu.
Trường hợp các khoản tiền trả cho quyền tái sản xuất, quyền phân phối hoặc bán lại hàng hoá nhập khẩu đã được tính trong giá bán hàng thì không được trừ ra khỏi trị giá tính thuế của hàng hoá nhập khẩu.
2.5.2.3. Trường hợp tiền bản quyền và phí giấy phép được tính một phần vào hàng hoá nhập khẩu, một phần căn cứ vào các yếu tố không liên quan đến hàng hoá nhập khẩu mà không phân định, tách biệt giữa hai yếu tố này hoặc không phân tách được đâu là tiền bản quyền theo thoả thuận tài chính giữa người mua và người bán thì không phải cộng tiền bản quyền và phí giấy phép vào trị giá tính thuế.
2.5.3. Căn cứ xác định tiền bản quyền, phí giấy phép:
2.5.3.1. Căn cứ xác định tiền bản quyền, phí giấy phép là các chứng từ thanh toán tiền bản quyền, phí giấy phép hoặc các chứng từ hợp pháp, hợp lệ khác thể hiện nghĩa vụ thanh toán các khoản này.
2.5.3.2. Trường hợp tiền bản quyền, phí giấy phép không xác định được tại thời điểm nhập khẩu do phụ thuộc vào doanh thu bán hàng sau nhập khẩu hay lý do khác được quy định cụ thể tại hợp đồng mua bán hàng hóa hoặc văn bản thỏa thuận riêng về việc trả tiền bản quyền, thì người khai hải quan phải khai báo và cam kết bằng văn bản về việc khai báo bổ sung về các chi phí này, để xác định trị giá tính thuế đầy đủ của lô hàng và thực hiện nghĩa vụ nộp thuế.
2.6. Các khoản tiền mà người nhập khẩu phải trả từ số tiền thu được sau khi định đoạt, sử dụng hàng hoá nhập khẩu được chuyển cho người bán dưới mọi hình thức.
Ví dụ: Người nhập khẩu phải trả khoản tiền theo một tỷ lệ nhất định tính trên doanh thu bán hàng, tiền cho thuê hàng hoá sau khi nhập khẩu.
Trường hợp tại thời điểm nhập khẩu chưa xác định được khoản phải cộng này, do phụ thuộc vào doanh thu bán hàng sau nhập khẩu hay lý do khác được quy định cụ thể tại hợp đồng mua bán hàng hóa hoặc văn bản thỏa thuận riêng, thì người khai hải quan phải khai báo và cam kết bằng văn bản về việc khai báo bổ sung về các chi phí này, để xác định trị giá tính thuế đầy đủ của lô hàng và thực hiện nghĩa vụ nộp thuế.
2.7. Chi phí vận chuyển và mọi chi phí khác có liên quan trực tiếp đến vận chuyển hàng nhập khẩu đến địa điểm nhập khẩu, như: chi phí bốc, dỡ, xếp và chuyển hàng, phụ phí tàu già, chi phí thuê các loại container, thùng chứa, giá đỡ được sử dụng như một phương tiện để đóng gói phục vụ chuyên chở hàng hoá, và sử dụng nhiều lần. Trị giá của khoản điều chỉnh này được xác định trên cơ sở hợp đồng vận chuyển hoặc các chứng từ, tài liệu liên quan đến vận chuyển hàng hoá.
2.7.1. Trường hợp lô hàng có nhiều loại hàng hoá khác nhau nhưng chứng từ vận chuyển không ghi chi tiết cho từng loại hàng hoá thì người khai hải quan tự phân bổ các chi phí này cho từng loại hàng hoá bằng cách sử dụng các phương pháp phân chia theo thứ tự ưu tiên sau đây:
- Phân bổ trên cơ sở biểu giá vận chuyển của người vận chuyển hàng hoá;
- Phân bổ theo trọng lượng hoặc thể tích của hàng hoá;
- Phân bổ theo tỷ lệ trị giá mua của từng loại hàng hoá trên tổng trị giá lô hàng.
2.7.2. Trường hợp giá mua chưa bao gồm chi phí vận chuyển nhưng người mua không có chứng từ hoặc chứng từ này không hợp pháp, hợp lệ thì không được áp dụng phương pháp xác định trị giá tính thuế theo trị giá giao dịch.
2.8. Chi phí bảo hiểm hàng hoá đến địa điểm nhập khẩu.
2.8.1. Trường hợp người nhập khẩu không mua bảo hiểm cho hàng hoá thì không phải cộng thêm chi phí này vào trị giá tính thuế.
2.8.2. Phí bảo hiểm mua cho cả lô hàng gồm nhiều loại hàng hoá khác nhau, nhưng chưa được ghi chi tiết cho từng loại hàng hóa, thì phân bổ theo trị giá của từng loại hàng hoá.
Các chi phí nêu tại điểm 2.7 và 2.8 trên đây nếu đã bao gồm thuế giá trị gia tăng phải nộp ở Việt Nam thì không phải cộng khoản thuế này vào trị giá tính thuế.
3. Các khoản được trừ:
Nếu các khoản sau đây đã nằm trong trị giá giao dịch và có các số liệu khách quan dựa trên các tài liệu, chứng từ hợp pháp, hợp lệ có sẵn tại thời điểm xác định trị giá tính thuế thì được trừ ra khi xác định trị giá tính thuế:
3.1. Chi phí cho những hoạt động phát sinh sau khi nhập khẩu hàng hoá, bao gồm các chi phí về xây dựng, kiến trúc, lắp đặt, bảo dưỡng hoặc trợ giúp kỹ thuật, tư vấn kỹ thuật, chi phí giám sát và các chi phí tương tự.
3.2. Chi phí vận chuyển, bảo hiểm trong nội địa Việt Nam. Trường hợp các chi phí này liên quan đến nhiều loại hàng hoá khác nhau thì phải phân bổ cho hàng hoá cần xác định trị giá tính thuế theo nguyên tắc nêu tại điểm 2.7 và 2.8 trên đây.
3.3. Các khoản thuế, phí, lệ phí phải nộp ở Việt Nam đã nằm trong giá mua hàng nhập khẩu. Trường hợp các khoản phí, lệ phí liên quan đến nhiều loại hàng hoá khác nhau mà không xác định trực tiếp được cho từng loại hàng hoá thì phân bổ theo tỷ lệ trị giá mua của từng loại hàng hoá trên tổng trị giá lô hàng.
3.4. Tiền lãi phải trả liên quan đến việc trả tiền mua hàng nhập khẩu, với điều kiện lãi suất phải trả phải được thể hiện dưới dạng văn bản và phù hợp với lãi suất tín dụng thông thường do các tổ chức tín dụng của nước xuất khẩu áp dụng tại thời điểm ký kết hợp đồng.
1. Đối với hàng hoá nhập khẩu đã được miễn thuế, xét miễn thuế nhưng sau đó sử dụng vào mục đích khác với mục đích đã được miễn thuế, xét miễn thuế thì phải kê khai nộp thuế. Trong đó, trị giá tính thuế nhập khẩu được xác định trên cơ sở giá trị sử dụng còn lại của hàng hoá, tính theo thời gian sử dụng và lưu lại tại Việt Nam (tính từ thời điểm nhập khẩu theo tờ khai hải quan đến thời điểm tính lại thuế) và được xác định cụ thể như sau:

2. Đối với hàng hoá nhập khẩu là hàng đi thuê mượn thì trị giá tính thuế là giá thực trả theo hợp đồng đã ký với nước ngoài, phù hợp với các chứng tù hợp pháp hợp lệ có liên quan đến việc đi thuê mượn hàng hoá.
3. Đối với hàng hoá nhập khẩu là hàng đem ra nước ngoài sửa chữa thì trị giá tính thuế là chi phí thực trả theo hợp đồng ký kết với phía nước ngoài, phù hợp với các chứng từ hợp pháp, hợp lệ liên quan đến việc sửa chữa hàng hoá.
4. Hàng bảo hành: Trường hợp hàng hoá nhập khẩu có bao gồm hàng hoá bảo hành, theo hợp đồng mua bán (kể cả trường hợp hàng gửi sau), thì trị giá tính thuế là trị giá thực trả cho hàng hoá nhập khẩu bao gồm cả trị giá của hàng hoá bảo hành. Trị giá, số lượng của hàng hoá bảo hành, điều kiện và thời hạn bảo hành phải được quy định cụ thể trên hợp đồng.
5. Hàng khuyến mại: Trường hợp hàng hoá nhập khẩu có bao gồm hàng hoá khuyến mại theo hợp đồng mua bán hàng hoá (kể cả trường hợp gửi sau), thì trị giá tính thuế được xác định như sau:
5.1. Trường hợp trị giá hàng khuyến mại được quy định cụ thể trên hợp đồng mua bán, nhưng không quá 10% trị giá hàng nhập khẩu, thì trị giá tính thuế của hàng hoá nhập khẩu (bao gồm cả hàng khuyến mại) là trị giá thực trả cho toàn bộ lô hàng nhập khẩu;
5.2. Trường hợp trị giá hàng khuyến mại không tách được khỏi trị giá hàng hoá nhập khẩu hoặc vượt quá 10% trị giá hàng nhập khẩu, thì trị giá tính thuế cho toàn bộ lô hàng nhập khẩu (trị giá tính thuế của hàng hoá nhập khẩu và trị giá tính thuế của hàng hoá khuyến mại) không được xác định theo trị giá giao dịch và phải chuyển sang phương pháp tiếp theo.
6. Hàng hoá nhập khẩu không có hợp đồng mua bán hàng hóa, như: Hàng hoá mua bán trao đổi của cư dân biên giới; Hàng hoá nhập khẩu của hành khách nhập cảnh, trong và ngoài tiêu chuẩn miễn thuế; Hàng hoá là quà biếu, quà tặng, trong và ngoài định mức miễn thuế; Hàng nhập khẩu của các doanh nghiệp cung cấp dịch vụ bưu chính, dịch vụ phát chuyển nhanh, thì trị giá tính thuế là trị giá thực trả do người khai hải quan khai báo.
7. Các trường hợp đặc thù khác:
7.1. Hàng hoá nhập khẩu thừa so với hợp đồng mua bán hàng hoá đã ký với phía nước ngoài:
7.1.1. Hàng nhập khẩu thừa là hàng giống hệt hoặc tương tự với hàng hoá nhập khẩu ghi trên hợp đồng: Trị giá tính thuế của hàng nhập khẩu thừa được xác định theo phương pháp xác định trị giá tính thuế của số hàng hoá nhập khẩu ghi trên hợp đồng.
7.1.2. Hàng nhập khẩu thừa là hàng hoá khác với hàng hoá nhập khẩu ghi trên hợp đồng, nếu được phép nhập khẩu thì trị giá tính thuế được xác định trên nguyên tắc áp dụng tuần tự các phương pháp xác định trị giá tính thuế theo hướng dẫn từ Mục II đến Mục VI Phụ lục này, không xác định theo phương pháp trị giá giao dịch.
7.2. Hàng hoá nhập khẩu chưa phù hợp so với hợp đồng mua bán hàng hoá đã ký với phía nước ngoài:
7.2.1. Hàng hoá nhập khẩu chưa phù hợp về qui cách, nếu được phép nhập khẩu, thì trị giá tính thuế là trị giá thực thanh toán cho hàng hoá nhập khẩu. Hàng hoá chưa phù hợp về quy cách được hiểu là hàng thực nhập có những khác biệt về mầu sắc, kích cỡ, kiểu dáng so với mô tả trong hợp đồng mua bán và những khác biệt đó không làm ảnh hưởng đến giá thực tế phải trả.
7.2.2. Hàng hoá nhập khẩu không đúng với hợp đồng mua bán, nếu được phép nhập khẩu, thì trị giá tính thuế được xác định trên nguyên tắc áp dụng tuần tự các phương pháp xác định trị giá tính thuế quy định Mục II đến Mục VI Phụ lục này, không xác định theo phương pháp trị giá giao dịch.
7.3. Hàng hoá nhập khẩu bị hư hỏng, tổn thất hoặc mất mát có lý do xác đáng trong quá trình vận chuyển, bốc xếp:
7.3.1. Đối với số hàng hoá không bị hư hỏng, tổn thất hoặc mất mát, thì trị giá tính thuế là trị giá thực trả cho hàng hoá nhập khẩu (phần không bị hư hỏng, tổn thất, mất mát).
7.3.2. Đối với phần hàng hoá bị hư hỏng, tổn thất thì trị giá tính thuế được tính theo trị giá tính thuế của số hàng nhập khẩu còn nguyên vẹn và được giảm phù hợp với mức độ tổn thất, hư hỏng hoặc mất mát, phù hợp với kết quả giám định và hồ sơ có liên quan.
7.4. Hàng hoá nhập khẩu để bù đắp cho các tổn thất nêu tại điểm 7.3 trên đây, thì trị giá tính thuế được xác định theo hướng dẫn từ Mục I đến Mục VI Phụ lục này.
1. Tại thời điểm đăng ký tờ khai hải quan, đối tượng nộp thuế chưa có đủ thông tin cần thiết cho việc xác định trị giá tính thuế, thì cơ quan hải quan sẽ chấp nhận cho thông quan hàng hoá nếu đối tượng nộp thuế nộp một khoản bảo đảm cho toàn bộ số thuế của lô hàng nhập khẩu.
Khoản bảo đảm được thực hiện dưới hình thức bảo lãnh, đặt tiền ký quỹ hoặc phương thức bảo đảm thích hợp khác.
2. Khoản bảo đảm được xác định như sau:
Trên cơ sở văn bản đề nghị của đối tượng nộp thuế, cơ quan hải quan nơi làm thủ tục hải quan, căn cứ vào các thông tin có sẵn và phương pháp xác định trị giá tính thuế đuợc hướng dẫn từ Mục II đến Mục VI Phụ lục này để xác định trị giá tính thuế làm căn cứ tính khoản bảo đảm và thông báo cho đối tượng nộp thuế biết bằng văn bản.
Trong thời hạn 30 ngày kể từ ngày thông quan hàng hoá, đối tượng nộp thuế phải khai báo bổ sung các thông tin cần thiết để xác định trị giá tính thuế cho lô hàng nhập khẩu và tự tính lại số thuế phải nộp theo đúng quy định. Quá thời hạn 30 ngày nêu trên mà đối tượng nộp thuế không khai báo bổ sung để xác định trị giá tính thuế thì cơ quan hải quan sẽ ấn định thuế và thông báo bằng văn bản để đối tượng nộp thuế biết và thực hiện.
Sau khi đối tượng nộp thuế nộp đủ thuế vào ngân sách nhà nước, cơ quan hải quan sẽ hoàn trả các khoản bảo đảm không phải bằng tiền hoặc hoàn trả số tiền đặt cọc thừa mà đối tượng nộp thuế đã nộp cho cơ quan hải quan.
THE DUTIABLE VALUE
OF IMPORTS
(Issued together with the Finance Ministry’s Circular No. 113/2005/TT-BTC of December 15, 2005, guiding the implementation of import tax and export tax)
I. DETERMINATION OF THE DUTIABLE VALUE ON THE BASIS OF THE TRANSACTION VALUE
The dutiable value of imported goods must be first of all determined on the basis of the transaction value. Transaction value is the total amount of money actually paid or payable by the buyer directly or indirectly to the seller for purchasing imported goods, after being adjusted with additions and/or deductions as guided in Section VII of this Appendix.
1. The transaction value shall be applied if all of the following conditions are met:
1.1. There must be no restrictions on the disposal and use of the goods after the importation, except for the following restrictions which:
1.1.1. Are imposed by Vietnamese law, such as provisions on compulsory sticking of Vietnamese-language labels on imported goods, goods subject to conditional import, or goods subject to a certain form of inspection before customs clearance, etc.
1.1.2. Are limited to the geographical areas where the goods can be sold; or
1.1.3. Do not affect the value of the goods.
These restrictions constitute one or more factors directly or indirectly related to imported goods but not increasing or reducing the price actually paid for such goods.
Example: The seller requests the buyer not to sell or display imported goods before marketing such goods.
1.2. The goods price or goods sale does not depend on conditions or payments for which a value of goods being valued cannot be determined.
Some factors affecting the value of goods which should be taken into consideration when determining the transaction value include:
- The seller establishes the price of the imported goods on the condition that the buyer will also buy other goods in certain quantities.
- The price of the imported goods depends on the price at which the importer will sell other goods to the exporter.
- The price of the imported goods is established on the basis of a form of payment extraneous to the imported goods, for example: the seller supplies imported goods which are semi-finished products to the buyer on the condition that the seller will receive back a certain quantity of finished products made of such imported semi-finished goods.
Where the goods sale and purchase or goods price depends on one or several conditions, but the buyer has objective and valid documents to determine the effect in monetary terms of such dependence, this condition is still considered being met. When determining the dutiable value, the money amount reduced due to the effect of such dependence must be added to the transaction value.
1.3. After re-selling, transferring or using imported goods, the buyer shall not have to additionally pay any part of the proceeds from the disposal of imported goods, excluding the addition to be made under the provisions of Point 2.6, Section VII of this Appendix.
1.4. The buyer and the seller have no special relationship or such relationship, if any, will not affect the transaction value. The consideration of the influence of such special relationship on the transaction value is guided at Point 3 below.
2. The transaction value consists of the following amounts:
2.1. The buying price shown on commercial invoices
Where the buying price shown on commercial invoices includes discounts for the imported goods lot, such discounts shall be deducted for determining the dutiable value on the condition that they are expressed in writing before the goods are loaded onto a means of transport, and lawful and valid data and vouchers are available for separating them from the invoiced price and submitted together with the customs declarations.
Principal discounts include:
- Discount based on the commercial level of goods sale and purchase transactions;
- Discount based on the quantity of bought or sold goods;
- Discount based on the form and time of payment;
- Other discounts conforming to international commercial customs and practices.
2.2. Adjustments guided in Section VII of this Appendix.
2.3. Amounts payable by the buyer but not yet included in the buying price shown on commercial invoices, including:
- Prepaid amount, advanced amount, deposit for the production, purchase, sale, transport and insurance of goods.
- Amounts indirectly paid to the seller, such as: amount paid by the buyer to a third party at the request of the seller; amount paid by way of debt clearing.
3. Determination of the influence of the special relationship on the transaction value:
3.1. Where the buyer and the seller have a special relationship which, however, does not affect the transaction value, the customs declarant shall have to declare this fact and determine the dutiable value on the basis of the transaction value.
3.2. Based on available information, if the customs office suspects that the special relationship affects the transaction value, it shall immediately notify the suspicion grounds in writing to the customs declarant. In this case, the customs office shall create conditions for the customs declarant to give explanations and additional relevant information to clarify that the special relationship between the buyer and the seller does not affect the transaction value of the imported goods, by proving that:
3.2.1. Such transaction value approximates to one of the following values of the imported goods lots exported to Vietnam on the same day or within 60 days (calendar days) before or after the date of exportation of the goods lot being valued:
- The dutiable value of identical or similar imported goods sold to other importers having no special relationship with the exporter (seller), determined on the basis of the transaction value;
- The dutiable value of identical or similar imported goods determined on the basis of the deductible value provided for in Section IV of this Appendix;
- The dutiable value of identical or similar imported goods determined on the basis of the computed value provided for in Section V of this Appendix.
Past 30 working days after the date of receipt of the notice of the customs office, if the customs declarant fails to give any explanation and additional relevant information, the customs office shall determine the dutiable value of the imported goods lot on the principles and by the method of dutiable value determination provided for in Sections from I to VI of this Appendix.
3.2.2. The aforesaid dutiable values shall be used for the comparison purpose only and the dutiable values of identical or similar imported goods must be adjusted to the same conditions as the imported goods being proved:
- Adjustment to the same sale and purchase conditions:
The adjustment of the dutiable value of identical or similar imported goods to the same sale and purchase conditions as the goods lots being proved shall comply with the guidance at Point 2.2, Section III of this Appendix.
- Adjustment by making additions or deductions under the guidance in Section VII of this Appendix.
4. For imported information equipment bearing data or instructions (hereinafter collectively referred to as software or information), their dutiable value shall include the value of information equipment only, excluding the value of software or information therein (for example, software programs, instructions describing digitized information programs), provided that these two values are separately shown in invoices.
The aforesaid information equipment may be floppy diskettes, CDs, CPUs or any information-storing objects other than integrated circuit boards, semi-conducting circuits and similar devices or parts attached thereto.
The guidance at this Point shall not apply to the import of products bearing sounds, feature movie or video images.
II. DETERMINATION OF THE DUTIABLE VALUE ON THE BASIS OF THE TRANSACTION VALUE OF IDENTICAL IMPORTED GOODS
If the dutiable value of imported goods cannot be determined on the basis of the transaction value as guided in Section I of this Appendix, it shall be determined on the basis of the transaction value of identical imported goods.
The method of determining the dutiable value on the basis of the transaction value of identical imported goods shall be implemented under the guidance in Section III below whereby the phrase “similar imported goods” are replaced by the phrase “identical imported goods.”
III. DETERMINATION OF THE DUTIABLE VALUE ON THE BASIS OF THE TRANSACTION VALUE OF SIMILAR IMPORTED GOODS:
1. Dutiable value determination:
If the dutiable value of imported goods cannot be determined on the basis of the methods guided in Section I and Section II of this Appendix, it shall be determined on the basis of the transaction value of similar imported goods on the condition that the dutiable value of such similar imported goods determined on the basis of the transaction value has been approved by the customs office, and such similar imported goods have the same sale and purchase conditions and condition of time of exportation as imported goods being valued under the guidance at Point 2 below:
Where similar imported goods lot having the same sale and purchase conditions as imported goods lot being valued cannot be found, a similar imported goods lot with different sale and purchase conditions may be chosen provided that it must be adjusted to the same sale and purchase conditions.
2. Conditions for choosing similar imported goods lots: A similar imported goods lot shall be chosen if meeting the following conditions:
2.1. Condition of time of exportation
A similar imported goods lot must be the one exported to Vietnam on the same day of exportation of the imported goods being valued or within 60 calendar days before or after that date.
2.2. Sale and purchase conditions:
2.2.1. Condition of commercial level and quantity
2.2.1.1. The similar imported goods lot must have the same condition of commercial level and quantity as the imported goods lot being valued.
2.2.1.2. If imported goods lot stated at Point 2.2.1.1 cannot be found, an imported goods lot at the same commercial level but in a different quantity shall be chosen, then the transaction value of similar imported goods shall be adjusted to the same quantity of the goods lot being valued.
2.2.1.3. If imported goods stated at Point 2.2.1.1 or Point 2.2.1.2 cannot be found, an imported goods lot at a different commercial level but in the same quantity shall be chosen, then the transaction value of such similar imported goods lot shall be adjusted to the same commercial level of the goods lot being valued.
2.2.1.4. If imported goods lot stated at Point 2.2.1.1, Point 2.2.1.2 or Point 2.2.1.3 cannot be found, an imported goods lot at a different commercial level and in a different quantity shall be chosen, then the transaction value of such similar imported goods lot shall be adjusted to the same commercial level and quantity of the goods lot being valued.
2.2.2. Condition of distance and mode of transportation and of insurance:
The similar imported goods lot has the same transport distance and mode, or has already been adjusted to the same transport distance or mode of the goods lot being valued.
If there exists a significant difference in insurance premium, the similar imported goods lot shall be adjusted to the same insurance term as the goods lot being valued.
2.3. When applying the method of determining the dutiable value on the basis of the transaction value of similar imported goods, if similar imported goods manufactured by the same manufacturer or authorized manufacturer cannot be found, goods manufactured by another manufacturer and of the same origin may be taken into consideration.
2.4. When determining the dutiable value on the basis of this method, if two or more transaction values of similar imported goods are determined after the similar imported goods lot is adjusted to the same commercial condition as the goods lot being valued, the dutiable value shall be the lowest transaction value.
While carrying out customs procedures, if information is not sufficient for choosing imported goods identical or similar to the imported goods being valued, the dutiable value of the imported goods shall not be determined under the guidance in Section II or Section III of this Appendix but must be determined by the next method.
3. Vouchers and documents to be submitted:
3.1. When applying the method of determining the dutiable value on the basis of the transaction value of similar imported goods, the customs declarants must submit to the customs offices the certified true copies of the following documents:
- The customs declaration and the declaration of the value of similar imported goods;
- The transport contract of similar imported goods (if the cost of transport is adjusted);
- The insurance policy of similar imported goods (if insurance premium is adjusted);
- The commercial contract; the commercial invoice of similar imported goods, exported goods price quotations of the foreign manufacturer or seller (if the quantity or commercial level is adjusted);
- Other lawful and valid dossiers and vouchers necessary for and related to the dutiable value determination (if necessary).
3.2. Customs offices, when applying the method of determining the dutiable value on the basis of the transaction value of similar imported goods, shall determine the dutiable value on the basis of the information available at the customs offices and documents and vouchers supplied by customs declarants.
IV. DETERMINATION OF THE DUTIABLE VALUE ON THE BASIS OF THE DEDUCTIBLE VALUE:
1. Dutiable value determination:
If the dutiable value of the imported goods cannot be determined by the methods guided in Section I to Section III of this Appendix, it shall be determined by the method of deductible value on the basis of the unit price at which imported goods, identical imported goods or similar imported goods are sold on the domestic market of Vietnam, less reasonable expenses and profit earned from the sale of the imported goods.
This method shall not apply to domestic buyers who provide assists mentioned at Point 2.4.1, Section VII of this Appendix, which are related to the goods chosen for the determination of the unit selling price.
2. Conditions for choosing the unit selling price on the Vietnamese market:
2.1. The unit selling price on the Vietnamese market must be that of the goods being valued, identical imported goods or similar imported goods at which the goods are sold in the condition as they were imported.
2.2. The unit selling price to be chosen is the unit price at which the goods are sold in the greatest aggregate quantity sufficient for serving as a basis for the establishment of the unit price provided that such goods are sold immediately after they are imported but within 90 calendar days after the date of importation of the goods being valued and the domestic buyer and the seller have no special relationship.
For example: Goods lot A consists of various goods items of which goods item B must have its dutiable value determined by the method of deductible value. Goods lot A was imported on January 1, 2005. Earlier, a goods lot consisting of a goods item identical to goods item B was imported and then sold to many domestic buyers at the following prices and times of sale:

- In the example above, the unit selling price chosen for deduction is VND 800/unit, corresponding to the greatest quantity of goods sold (450 units) at a level sufficient for the establishment of the unit price. This unit price satisfies the conditions for choosing the unit selling price, namely:
+ Having the greatest aggregate quantity (450 units).
+ The time of sale within 90 days after the date of importation.
3. Principles of deduction:
The determination of deductible amounts must be based on available lawful and valid accounting data and vouchers recorded and reflected according to Vietnam’s accounting regulations and standards.
Deductible amounts must be those permitted to be accounted into the cost price.
4. Amounts deductible from the unit selling price:
Amounts deductible from the unit selling price are reasonable expenses and profit earned from the sale of goods on the Vietnamese market, including:
4.1. Costs of transport and insurance and other costs associated with the transport of goods after the importation:
4.1.1. Costs of transport and insurance and other costs associated with the transport of goods incurred from the first border gate of importation to the goods storehouse of the importer or the place of goods delivery in inland Vietnam;
4.1.2. Costs of transport and insurance and other costs associated with the transport of goods incurred from the importer’s storehouse to the place of goods sale, if such expenses are paid by the importer.
4.2. Taxes, charges and fees payable in Vietnam upon the importation and sale of imported goods on the domestic market of Vietnam.
4.3. Commissions or general expenses and profit associated with the sale of imported goods in Vietnam.
4.3.1. Where the importer is a sale agent for the foreign trader, the commission he/she/it is entitled to enjoy shall be deducted. If such commission is inclusive of expenses specified at Points 4.1 and 4.2 above, these expenses must not be further deducted.
4.3.2. For import by mode of definite purchase and sale, general expenses and profit shall be deducted: General expenses and profit must be taken as a whole to determine the deductible value.
General expenses include direct expenses and indirect expenses in service of the importation and sale of goods on the domestic market, for instance: marketing expense, expense for storage and preservation of goods before sale, expenses for managerial activities in service of the importation and sale, etc. The apportionment of general expenses to the imported goods lot must comply with Vietnam’s accounting regulations and standards.
Profit earned from the sale of imported goods shall be determined on the basis of sale turnover less general expenses and expenses specified at Points 4.1 and 4.2 above.
The base for determining deductible amounts is data recorded and reflected on accounting vouchers and books of the importer in accordance with Vietnam’s accounting regulations and standards. These data must be consistent with data collected from activities of buying and selling imported goods of the same class or kind in Vietnam.
5. For goods sold not in the condition as imported.
5.1. Where the unit selling price at which goods are sold in the condition as imported cannot be found, the unit selling price of the imported goods which have been further processed in the country may be used, less expenses for the processing to add value to the goods, provided that expenses for such domestic processing and expenses mentioned at Point 4 are quantifiable. Where these processing expenses cannot be separated from the selling price, the dutiable value must not be determined by the method of deductible value but shall be determined by the next method.
5.2. Where after the processing, if the imported goods, though retaining their characteristics, nature and utility as when imported, have become components of the goods sold on the domestic market, the deductible value must not be used to determine the dutiable value of the imported goods.
5.3. After the processing, if the imported goods are changed in their characteristics, nature and utility to the extent that they cannot not be identified as they were before the processing, this method shall not be applicable.
6. Vouchers and documents to be submitted:
Customs declarants or importers must submit copies certified as true by the enterprises of the following documents together with the dossiers for customs clearance:
6.1. Sale invoice issued or permitted for use by the Finance Ministry.
6.2. Sale agency contract, if the importer is a sale agent for the exporter. This contract must specify the commission to be enjoyed by the agent and expenses to be paid by the agent.
6.3. Written explanation on the sale turnover and expenses stated at Point 4.
6.4. Customs declaration and declaration of the value of the goods lot chosen for deduction.
6.5. Other documents necessary for the checking and determination of the dutiable value at the request of the customs office.
V. DETERMINATION OF THE DUTIABLE VALUE ON THE BASIS OF THE COMPUTED VALUE:
1. If the dutiable value of imported goods cannot be determined on the basis of the methods guided in from Section I to Section IV of this Appendix, it shall be determined on the basis of the computed value. The computed value of imported goods shall consist of the following amounts:
1.1. Direct costs of production of the imported goods: Cost or value of materials, costs of other production or processing processes used for the production of the imported goods.
1.2. General expenses and profit arising from the sale of goods of the same class or kind as the imported goods being valued, which are manufactured in the country of exportation for sale to Vietnam. Profit and general expenses must be take as a whole to determine the computed value.
General expenses include all direct or indirect expenses of the production and sale for export of the goods which have not yet been calculated under the guidance at Point 1.1 above.
1.3. Costs of transport and insurance and other costs associated with the transport of the imported goods as guided at Points 2.7 and 2.8, Section VII of this Appendix.
2. The base for determining the computed value is data recorded and reflected on accounting vouchers and books of the manufacturer in accordance with the manufacturing country’s accounting regulations and standards. These data must be consistent with data collected from activities of producing and buying and selling imported goods of the same class or kind manufactured by manufacturers in the country of exportation for export to Vietnam.
3. Documents to be submitted
Customs declarants or importers must submit certified true copies of the following documents and evidences and concurrently produce their originals for comparison:
3.1. Written explanation of the manufacturer on expenses mentioned at Point 1.1 and 1.2 above, enclosed with the manufacturer’s certified true copies of accounting vouchers and data consistent with this explanation;
3.2. Sale invoice of the manufacturer;
3.3. Vouchers on expenses mentioned at Point 1.3 above.
Where the aforesaid vouchers are insufficient, the dutiable value shall not be determined under the guidance in this Section but must be determined by the next method.
VI. DETERMINATION OF THE DUTIABLE VALUE BY THE DEDUCTIVE METHOD:
1. If the dutiable value cannot be determined by the methods guided in Sections from I to V of this Appendix, it shall be determined by the deductive method, based on available objective documents and data at the time of determination of the dutiable value.
The dutiable value based on the deductive method shall be determined by applying flexibly in a sequential order the methods of dutiable value determination guided in Sections from I to V of this Appendix, immediately stopped at the method by which the dutiable value can be determined, provided that such application does not contravene the provisions of Point 2 below.
2. When determining the dutiable value by this method, customs declarants and customs offices must not use the following values:
2.1. The selling price on the Vietnamese market of the goods of the same kind made in Vietnam.
2.2. The selling price of the goods on the domestic market of the country of exportation.
2.3. The selling price of the goods for export to a third country.
2.4. Production costs of goods, except for those used in the computed value method.
2.5. Minimum dutiable prices.
2.6. Arbitrary or fictitious prices.
2.7. The higher transaction value of two alternative values.
3. Some cases of flexible application of the methods of dutiable value determination:
3.1. Application of the method of determining the dutiable value on the basis of the transaction value of identical imported goods or similar imported goods.
3.1.1. If identical imported goods or similar imported goods is exported to Vietnam on or within 60 calendar days before or after the date of exportation of the imported goods lot being valued cannot be found, identical imported goods or similar imported goods exported within a longer period may be chosen, provided that such period must not exceed 90 calendar days before or after the date of exportation of the imported goods lot being valued.
3.1.2. If identical imported goods or similar imported goods of the same origin cannot be found, imported goods of a different origin which still satisfy other conditions on identical or similar imported goods may be chosen.
3.2. Application of the method of determining the dutiable value on the basis of the deductible value in one of the following ways:
3.2.1. Within 90 calendar days after the date of importation, if the unit price used for deduction cannot be determined, the unit price of the chosen goods sold in the greatest quantity within 120 calendar days after the date of importation of such goods lot shall be chosen for deduction.
3.2.2. If no unit price of the imported goods or identical imported goods or similar imported goods sold to persons having no special relationship with the importer is available, the unit price of goods sold to buyers having special relationship shall be chosen, provided that such special relationship does not affect the price in the purchase-sale transaction.
3.3. The dutiable value of the imported goods shall be determined to equal the dutiable value of identical imported goods which has been determined on the basis of the deductible value or computed value.
3.4. The dutiable value of imported goods shall be determined to equal the dutiable value of similar imported goods which has been determined on the basis of the deductible value or computed value.
4. Apart from the cases stated at Point 3 above, importers may base themselves on available information and lawful and valid documents to apply other methods in a flexible way.
VII. ADJUSTMENTS:
1. Adjustment principles
1.1. Additions may be made only when the following conditions are met:
- Additions are paid by the buyer and not yet included in the actually paid or payable amount.
- Additions are directly related to the imported goods.
- Where the imported goods lot involves additions but there are no objective data for determining the dutiable value, this value shall not be determined on the basis of the transaction value but must be determined by the next method.
1.2. Deductions may be made only when lawful and valid data and vouchers for separating them from the selling price are available at the time of dutiable value determination.
2. Additions include:
2.1. Goods commissions and brokerage charges, excluding buying commissions. Where these amounts include taxes payable in Vietnam, such tax amounts must not be added into the dutiable value of the imported goods.
2.2. Expenses for packings which are treated as being one with the imported goods, including the following amounts: cost of packings, other costs associated with the purchase, sale and transport of packings to the site of goods packing and preservation.
Containers, tanks, racks of various kinds used as a multiple-use means of containing for goods transport shall not be considered packings which are treated as being one with goods. Therefore, they shall not constitute added expenses for packings which are treated as being one with goods.
2.3. Packing expenses, including the following amounts:
2.3.1. Expenses for packing materials, including cost of packing materials and other costs associated with the purchase, sale and transport of packing materials to the site of packing.
2.3.2. Expenses for packing labor, including labor cost and expenses associated with the hire of labor for packing goods being valued.
Where expenses for workers’ accommodation, meals and travel during the packing period are paid by the buyer, they shall also be expenses for packing labor.
2.4. The value of goods and services supplied by the buyer free or at reduced cost directly or indirectly to the manufacturer or the seller for the production and sale of exports to Vietnam (hereinafter called the value of assists).
2.4.1. Assists include:
2.4.1.1. Raw materials, components, parts and similar products constituting the imported goods.
2.4.1.2. Raw materials, materials and fuel consumed in the manufacture of the imported goods.
2.4.1.3. Tools, instruments, dies, molds, models and similar products used in the manufacture of the imported goods.
2.4.1.4. Engineering designs, technical drawings, art designs, development plans, working designs, model designs, plans or sketches and similar service products made in foreign countries and needed for the manufacture of the imported goods.
2.4.2. Determination of the value of assists:
- If assists being goods or services are bought from persons having no special relationship for supply to the seller, their value shall be the buying price of such goods or services.
- If assists being goods or services are produced by the importer or a person having special relationship with the importer for supply to the seller, their value shall be the production cost of such goods or services.
- If assists being goods or services are produced by a foreign-based production establishment of the buyer, but there are no documents and vouchers for separate accounting of assistance goods or services, their value shall be determined by apportioning the total production cost in a particular period of such establishment to the quantity of such goods or services produced.
- The value of assists leased or borrowed by the buyer shall be the rental or borrowing charge.
- The value of assists being used goods shall be the residual value of such goods.
- For assists being goods which the buyer have processed before transferring to the seller for use in the manufacture of the imported goods, the value added by the processing shall be included to the value of the assists.
- For assists sold at reduced prices by the buyer to the exporter, the reduced value must be added to the dutiable value.
- Where surplus materials and raw materials and scraps are obtained from the manufacture of goods assists into the imported goods, the value of such surplus materials and raw materials and scraps shall be deducted from the value of the assists if there are data reflecting the value of such surplus materials and raw materials and scraps.
The value of assists shall also include expenses associated with their purchase, sale, transport and insurance to the place of manufacture of the imported goods.
2.4.3. Apportionment of the value of assists to the imported goods
2.4.4.1. Principle for apportionment of the value of assists
- The value of assists must be fully apportioned to the imported goods.
- Lawful and valid documents and vouchers on the apportionment must be made.
- The apportionment must comply with Vietnam’s accounting regulations and standards.
2.4.3.2. Method of apportionment of the value of assists:
Customs declarants shall apportion by themselves assists to the imported goods by one of the following methods:
- Apportioning them to the quantity of the imported goods in the first import shipment.
- Apportioning then to the quantity of units of products manufactured up to the time of importation of the first shipment;
- Apportioning to the total quantity of products expected to be manufactured as agreed upon the buyer and seller (or the manufacturer);
- Apportioning on the principle of gradual decrease or increase;
Apart from the aforesaid methods, the buyer may use other methods of apportionment, which must comply with the provisions of law on the accounting regime and be documented.
2.5. Royalties and licensing fees
2.5.1. Royalties and licensing fees must be added to the price actually paid or payable to the imported goods if the following conditions are fully met:
2.5.1.1. Royalties or licensing fees must be paid for the use of intellectual property rights directly connected with the imported goods being valued.
Payable royalties or licensing fees not directly related to the imported goods must not be added for dutiable value determination.
For example: An importer paid a royalty for using the process of producing flowered fabric to the holder of copyright over this process. Then, this importer imports equipment and machines used for producing such fabric from another exporter (other than the copyright holder). This royalty must not be added to the transaction value of the imported goods because it was paid for the use of the producing process, not for the imported equipment and machines.
2.5.1.2. Royalties and licensing fees must be paid directly or indirectly by the buyer. The payment of royalties or licensing fees must constitute a condition of sale and purchase of the imported goods. The buyer agrees to pay royalties or licensing fees as part of the dealing in order to buy the imported goods.
Customs declarants must submit to the customs offices the certified true copies of the original vouchers or documents evidencing the payment of royalties or licensing fees as well as licensing documents issued by the copyright holders or licensing right holders.
2.5.1.3. Royalties and licensing fees are not yet included in the selling price of the goods being valued.
2.5.2. Royalties and licensing fees must not be added to the dutiable value in the following cases:
2.5.2.1. Amounts payable by the buyer for the right to reproduce the imported goods or copy art works in Vietnam.
2.5.2.2. Amounts payable by the buyer for the right to distribute or resell the imported goods and such payment does not constitute a condition of sale of the imported goods.
Where the amounts payable for the right to reproduce, the right to distribute or resell the imported goods have been included in the selling price, such amounts shall not be deducted from the dutiable value of the imported goods.
2.5.2.3. Where royalties and licensing fees are partially included in the imported goods and partially based on factors not related to the imported goods while it is impossible either to distinguish between these two parts or to sort out royalties under a financial agreement between the buyer and the seller, such royalties and licensing fees must not be added to the dutiable value.
2.5.3. Bases for determining royalties and licensing fees
2.5.3.1. Bases for determining royalties and licensing fees are vouchers on the payment of royalties and licensing fees or other lawful or valid documents reflecting the obligation to pay such amounts.
2.5.3.2. Where royalties and licensing fees cannot be determined at the time of importation for the reason that they depend on the post-importation sale turnover or for other reasons specified in the goods sale and purchase contract or a separate written agreement on the payment of royalties, customs declarants must declare this fact and make a written commitment to additionally declare these expenses for the purpose of determining the full dutiable value of the goods lot and performing the tax obligation.
2.6. Sums of money payable by the importer from proceeds from the disposal or use of the imported goods, which are transferred in any form to the seller.
For example: The importer must pay an amount in a certain percentage of the sale turnover or proceeds from the lease of the goods after the importation.
Where these additions cannot be determined at the time of importation because they depend on the post-importation sale turnover or for other reasons specified in the goods sale and purchase contract or a separate written agreement, customs declarants must declare this fact and make a written commitment to additionally declare these expenses for determining the full dutiable value of the goods lot and performing their tax obligation.
2.7. Transport cost and all other costs directly related to the transport of the imported goods to the place of importation, such as expenses for goods handling charges, old-ship surcharges, hiring of containers, tanks and racks used as a multiple-use means of containing for transport of goods. The value of these adjustments is determined on the basis of transport contracts or vouchers or documents related to the transport of goods.
2.7.1. In cases where a goods lot consists of different kinds of goods but each kind of goods is not specified in the bill of lading, the customs declarant shall apportion by himself/herself these costs to each kind of goods by using the apportionment methods in the following priority order:
- Apportionment on the basis of the freight table of the goods carrier.
- Apportionment on the basis of the weight or volume of goods.
- Apportionment according to the ratio of the purchase value of each kind of goods to the total value of the goods lot.
2.7.2. Where the buying price is exclusive of the cost of transport but the buyer has no voucher or has an unlawful or invalid voucher on this cost, the method of determining the dutiable value on the basis of the transaction value shall not be applicable.
2.8. Insurance for goods transported to the place of importation
2.8.1. Where the importer does not buy insurance for the goods, insurance must not be added to the dutiable value.
2.8.2. Insurance premium for the whole goods lot containing different kinds of goods which has not yet been itemized for each kind of goods shall be apportioned according to the value of each kind of goods.
If the costs specified at Points 2.7 and 2.8 above are inclusive of value added tax payable in Vietnam, such tax must not be added to the dutiable value.
3. Deductions:
If the following amounts are already included in the transaction value and there are objective data based on lawful and valid documents and vouchers available at the time of dutiable value determination, they shall be deducted for determining the dutiable value:
3.1. Expenses for activities arising after the importation of goods, including expenses for construction, architecture, installation, maintenance or technical assistance, technical consultancy, supervision and similar expenses.
3.2. Costs of transport and insurance in inland Vietnam. Where such costs are associated with different kinds of goods, they shall be apportioned to the goods being valued on the principles prescribed at Points 2.7 and 2.8 above.
3.3. Taxes, charges and fees payable in Vietnam already included in the buying price of the imported goods. Where charges and fees associated with many different kinds of goods cannot be determined directly for each kind of goods, they shall be apportioned according to the ratio of the purchasing value of each kind of goods to the total value of the goods lot.
3.4. Payable interests related to the payment for the imported goods, provided that payable interest rates are expressed in writing and consistent with common credit interest rates applied by credit institutions in the country of exportation at the time of signing of the contract.
VIII. DETERMINATION OF THE DUTIABLE VALUE OF THE IMPORTED GOODS IN SOME SPECIFIC CASES:
1. Imported goods which are used for purposes other than those for which they have been exempted from import tax or considered for import tax exemption must be declared for tax payment. In this case, the value for calculation of the import tax thereon shall be determined on the basis of the residual value of the goods, calculated on the basis of the duration of their use and stay in Vietnam, counting from the time of importation shown on the customs declaration to the time of taxation), specifically as follows:

2. For imported goods which are rented or borrowed goods, their dutiable value shall be the actually paid price under the contract signed with the foreign country and consistent with lawful and valid vouchers related to the rent or borrowing of the goods.
3. For imported goods which are goods brought overseas for repair, their dutiable value shall be the actually paid amount under the contract signed with the foreign country and consistent with lawful and valid vouchers related to the repair of the goods.
4. Warranty goods: Where the imported goods include warranty goods under the sale and purchase contract (including goods delivered later), their dutiable value shall be the value actually paid for the imported goods, inclusive of the value of warranty goods. The value and quantity of warranty goods, warranty conditions and duration must be specified in the contract.
5. Sale promotion goods: Where the imported goods include sale promotion goods under the goods sale and purchase contract (including goods delivered later), their dutiable value shall be determined as follows:
5.1. Where the value of sale promotion goods is specified in the sale and purchase contract but does not exceed 10% of the value of the imported goods, the dutiable value of the imported goods (including sale promotion goods) shall be the value actually paid for the whole imported goods lot.
5.2. Where the value of sale promotion goods cannot be separated from the value of the imported goods or exceeds 10% of the value of the imported goods, the dutiable value of the whole imported goods lot (including the value of the imported goods and the value of sale promotion goods) shall not be determined on the basis of the transaction value and the subsequent method must be tried.
6. For imported goods which have no sale and purchase contract, such as goods sold, purchase and exchanged by border residents; imported goods of passengers on entry, within and in excess of tax-free quotas; gifts and presents within and in excess of tax-free quotas; imported goods of postal service or express mail service-providing enterprises, their dutiable value shall be the actually paid value declared by customs declarants.
7. Other specific cases:
7.1. Goods imported in excess of the quantities stated in sale and purchase contracts signed with foreign parties:
7.1.1. For goods imported in excess of contractual quantities which are identical or similar to those stated in the contract: Their dutiable value shall be determined on the basis of the method by which the dutiable value of the quantity of the imported goods stated in the contract was determined.
7.1.2. For goods imported in excess of contract quantities which are different from those stated in the contract, if they are permitted for import, their dutiable value shall be determined on the principle of application in a sequential order of the methods of dutiable value determination guided in Sections from II to VI of this Appendix, but not by the transaction value method.
7.2. Imported goods inconsistent with sale and purchase contracts signed with foreign parties:
7.2.1. For imported goods which are inconsistent in specifications, if permitted for import, their dutiable value shall be the value actually paid for the imported goods. Goods inconsistent in specifications are understood as actually imported goods having differences in color, size and/or design from those described in the sale and purchase contract which do not affect the actually paid price.
7.2.2. For imported goods other than those stated in the sale and purchase contract, if permitted for import, their dutiable value shall be determined on the principle of application in a sequential order of the methods of dutiable value determination guided in Sections from II to VI of this Appendix, but not by the transaction value method.
7.3. Imported goods which are damaged or lost for plausible reasons in the process of transport, loading or unloading:
7.3.1. For the quantity of goods which are not damaged or lost, their dutiable value shall be the price actually paid for the imported goods (not damaged or lost).
7.3.2. For the quantity of damaged or lost goods, their dutiable value shall be the dutiable value of the quantity of unaffected imported goods, less amounts reduced corresponding to the extent of damage or loss as evidenced by the expertise result and relevant dossiers.
7.4. For imported goods for offsetting losses stated at Point 7.3 above, their dutiable value shall be determined under the guidance from Section I to Section VI of this Appendix.
IX. DETERMINATION OF THE DUTIABLE VALUE IN CASE OF DELAYED DETERMINATION:
1. At the time of registration of customs declarations, if taxpayers do not have sufficient information for the dutiable value determination and pay a security for the whole tax on the imported goods lots, customs offices shall accept to clear the goods lots concerned from customs procedures.
A security may take the form of guarantee, a deposit or another appropriate form.
2. Securities shall be determined as follows:
Customs offices that carry out customs procedures shall, at the written request of taxpayers, base themselves on available information and the methods of dutiable value determination guided in Sections from II to VI of this Appendix to determine the taxable value, serving as a basis for calculating securities and notify in writing taxpayers of such securities.
Within 30 days after the date of customs clearance for the goods, taxpayers must declare additional information necessary for determining the dutiable value of the imported goods lot and recalculate by themselves the payable tax according to regulations. Past this 30-day time limit, if they fail to do so, customs offices shall fix tax amounts and notify in writing taxpayers thereof for implementation.
After taxpayers have fully paid taxes into the state budget, customs offices shall refund securities in cash or overpaid security amounts which taxpayers have paid to them.-
