Đối tượng nộp thuế xuất khẩu, thuế nhập khẩu có trách nhiệm kê khai thuế ngay trên Tờ khai hải quan.
Thời điểm tính thuế xuất khẩu, thuế nhập khẩu là thời điểm đối tượng nộp thuế đăng ký Tờ khai hải quan với cơ quan hải quan. Thuế xuất khẩu, thuế nhập khẩu được tính theo thuế suất, trị giá tính thuế và tỷ giá tính thuế tại thời điểm tính thuế. Trường hợp đối tượng nộp thuế khai báo điện tử thì thời điểm tính thuế thực hiện theo quy định về thủ tục hải quan điện tử.
Hàng hóa xuất khẩu, nhập khẩu đăng ký Tờ khai hải quan một lần để xuất khẩu, nhập khẩu nhiều lần thì thuế xuất khẩu, thuế nhập khẩu được tính theo thuế suất, trị giá tính thuế và tỷ giá tính thuế theo ngày có hàng hóa xuất khẩu, nhập khẩu trên cơ sở số lượng từng mặt hàng thực tế xuất khẩu, nhập khẩu.
1. Thời hạn nộp thuế xuất khẩu:
Đối với hàng hóa xuất khẩu thì thời hạn nộp thuế là 30 (ba mươi) ngày, kể từ ngày đối tượng nộp thuế đăng ký Tờ khai hải quan.
2. Thời hạn nộp thuế nhập khẩu:
2.1. Đối với hàng hoá nhập khẩu là hàng tiêu dùng trong Danh mục hàng hoá do Bộ Thương mại công bố thì phải nộp xong thuế trước khi nhận hàng. Trừ các trường hợp sau:
2.1.1. Đối tượng nộp thuế có bảo lãnh về số tiền thuế phải nộp thì thời hạn nộp thuế là thời hạn bảo lãnh, nhưng không quá 30 ngày kể từ ngày đối tượng nộp thuế đăng ký Tờ khai hải quan. Hết thời hạn bảo lãnh mà đối tượng nộp thuế chưa nộp thuế xong thì tổ chức bảo lãnh có trách nhiệm nộp số tiền thuế và tiền phạt chậm nộp thuế (nếu có) thay cho đối tượng nộp thuế. Thời hạn chậm nộp thuế được tính từ ngày hết thời hạn bảo lãnh.
2.1.2. Hàng hoá tiêu dùng nhập khẩu phục vụ trực tiếp cho an ninh, quốc phòng, nghiên cứu khoa học và giáo dục đào tạo thuộc đối tượng được xét miễn thuế nhập khẩu thì thời hạn nộp thuế là 30 ngày kể từ ngày đối tượng nộp thuế đăng ký Tờ khai hải quan.
2.2. Thời hạn nộp thuế nhập khẩu đối với đối tượng nộp thuế chấp hành tốt pháp luật về thuế:
Đối tượng nộp thuế chấp hành tốt pháp luật về thuế là chủ hàng chấp hành tốt pháp luật hải quan và không còn nợ thuế quá hạn, không còn nợ tiền phạt chậm nộp thuế tại thời điểm đăng ký Tờ khai hải quan.
2.2.1. Hàng hóa nhập khẩu là vật tư, nguyên liệu để trực tiếp sản xuất hàng hóa xuất khẩu thì thời hạn nộp thuế là 275 (hai trăm bảy mươi lăm) ngày, kể từ ngày đối tượng nộp thuế đăng ký Tờ khai hải quan.
2.2.1.1. Điều kiện để được áp dụng thời hạn nộp thuế 275 ngày là đối tượng nộp thuế phải có bản đăng ký vật tư, nguyên liệu nhập khẩu để trực tiếp sản xuất hàng hoá xuất khẩu.
Đối với một số trường hợp đặc biệt do chu kỳ sản xuất, dự trữ vật tư, nguyên liệu phải kéo dài hơn 275 ngày thì thời hạn nộp thuế có thể dài hơn 275 ngày. Đối tượng nộp thuế có văn bản đề nghị gửi Cục Hải quan địa phương để báo cáo Tổng cục hải quan xem xét, quyết định từng trường hợp cụ thể.
2.2.1.2. Nếu quá thời hạn nộp thuế mà đối tượng nộp thuế mới xuất khẩu hoặc không xuất khẩu sản phẩm thì bị xử lý như sau:
- Đối với phần nguyên liệu, vật tư nhập khẩu để sử dụng vào sản xuất sản phẩm, nhưng sản phẩm không xuất khẩu thì tính phạt chậm nộp thuế kể từ ngày thứ 31 (tính từ ngày đăng ký Tờ khai hải quan) đến ngày nộp thuế;
- Đối với phần nguyên liệu, vật tư nhập khẩu đã sử dụng vào sản xuất sản phẩm và đã thực xuất khẩu ngoài thời hạn nộp thuế thì tính phạt chậm nộp thuế kể từ ngày quá thời hạn nộp thuế đến ngày thực xuất hoặc ngày nộp thuế (nếu nộp thuế trước ngày thực xuất).
Đối với trường hợp đối tượng nộp thuế được áp dụng thời hạn nộp thuế 275 ngày hoặc hơn 275 ngày nhưng không xuất khẩu sản phẩm hoặc xuất khẩu ngoài thời hạn nộp thuế, thì đối tượng nộp thuế phải nộp thuế (trường hợp xuất khẩu sản phẩm ngoài thời hạn nộp thuế thì phải nộp thuế khi hết thời hạn nộp thuế được áp dụng và được hoàn lại số thuế đã nộp khi sản phẩm thực tế xuất khẩu) và bị xử phạt như nêu trên.
2.2.2. Đối với hàng hóa kinh doanh theo phương thức tạm nhập, tái xuất hoặc tạm xuất, tái nhập thì thời hạn nộp thuế là 15 (mười lăm) ngày, kể từ ngày hết thời hạn tạm nhập, tái xuất hoặc tạm xuất, tái nhập (áp dụng cho cả trường hợp được phép gia hạn).
Trường hợp doanh nghiệp đã được áp dụng thời hạn nộp thuế của hàng hóa kinh doanh theo phương thức tạm nhập, tái xuất nhưng không xuất khẩu hoặc xuất khẩu ngoài thời hạn nộp thuế thì bị xử lý như sau:
- Hàng hóa không xuất khẩu thì tính phạt chậm nộp thuế kể từ ngày thứ 31 (tính từ ngày đăng ký Tờ khai hải quan) đến ngày nộp thuế;
- Hàng hóa đã thực xuất khẩu ngoài thời hạn nộp thuế thì tính phạt chậm nộp thuế kể từ ngày quá thời hạn nộp thuế đến ngày thực xuất hoặc ngày nộp thuế (nếu nộp thuế trước ngày thực xuất).
2.2.3. Đối với các trường hợp hàng hóa nhập khẩu khác (bao gồm cả hàng hoá là hàng tiêu dùng trong Danh mục hàng hoá do Bộ Thương mại công bố nhưng là vật tư, nguyên liệu nhập khẩu để trực tiếp dùng cho sản xuất) ngoài hai trường hợp nêu tại điểm 2.2.1 và 2.2.2 trên đây thì thời hạn nộp thuế là 30 ngày, kể từ ngày đối tượng nộp thuế đăng ký Tờ khai hải quan.
2.3. Thời hạn nộp thuế nhập khẩu đối với đối tượng nộp thuế chưa chấp hành tốt pháp luật về thuế:
2.3.1. Nếu được tổ chức tín dụng hoặc tổ chức khác hoạt động theo quy định của Luật các tổ chức tín dụng bảo lãnh về số tiền thuế phải nộp thì thời hạn nộp thuế thực hiện theo thời hạn bảo lãnh, nhưng không quá thời hạn quy định đối với từng trường hợp nêu tại điểm 2.2 Mục này. Hết thời hạn bảo lãnh trong trường hợp thời hạn bảo lãnh ngắn hơn thời hạn nộp thuế hoặc hết thời hạn nộp thuế trong trường hợp thời hạn bảo lãnh bằng hoặc dài hơn thời hạn nộp thuế mà đối tượng nộp thuế chưa nộp thuế xong thì tổ chức bảo lãnh có trách nhiệm nộp số tiền thuế và tiền phạt chậm nộp thuế (nếu có) thay cho đối tượng nộp thuế. Thời hạn chậm nộp thuế được tính từ ngày hết thời hạn bảo lãnh hoặc hết thời hạn nộp thuế theo quy định trên đây.
2.3.2. Nếu không được tổ chức tín dụng hoặc tổ chức khác hoạt động theo quy định của Luật các tổ chức tín dụng bảo lãnh về số tiền thuế phải nộp thì phải nộp xong thuế trước khi nhận hàng.
3. Thời hạn nộp thuế đối với hàng hoá xuất khẩu, nhập khẩu trong các trường hợp khác:
3.1. Hàng hoá xuất khẩu, nhập khẩu không có hợp đồng mua bán hàng hóa; hàng hoá xuất khẩu, nhập khẩu của cư dân biên giới thì phải nộp xong thuế trước khi xuất khẩu hàng hoá ra nước ngoài hoặc nhập khẩu hàng hoá vào Việt Nam.
3.2. Hàng hoá xuất khẩu, nhập khẩu còn trong sự giám sát của cơ quan hải quan, nhưng bị cơ quan Nhà nước có thẩm quyền tạm giữ để điều tra, chờ xử lý thì thời hạn nộp thuế đối với từng loại hàng hoá thực hiện theo quy định của Thông tư này và tính từ ngày cơ quan Nhà nước có thẩm quyền có văn bản cho phép giải toả hàng hoá đã tạm giữ.
3.3. Hàng hóa xuất khẩu, nhập khẩu đăng ký Tờ khai hải quan một lần để xuất khẩu, nhập khẩu nhiều lần thì thời hạn nộp thuế theo từng ngày hàng hóa thực tế xuất khẩu, nhập khẩu thực hiện theo quy định tại điểm 1 và 2 Mục này.
3.4. Đối với trường hợp phải có giám định về tiêu chuẩn kỹ thuật, chất lượng, số lượng, chủng loại để đảm bảo chính xác cho việc tính thuế (như xác định tên mặt hàng, mã số hàng hoá theo danh mục Biểu thuế, chất lượng, số lượng, tiêu chuẩn kỹ thuật, tình trạng cũ, mới của hàng hóa nhập khẩu...) thì đối tượng nộp thuế vẫn phải nộp thuế theo như khai báo tại thời điểm đăng ký Tờ khai hải quan với cơ quan hải quan; đồng thời cơ quan hải quan phải thông báo cho đối tượng nộp thuế biết lý do phải giám định và nếu kết quả giám định khác so với khai báo của đối tượng nộp thuế dẫn đến có thay đổi về số thuế phải nộp thì đối tượng nộp thuế phải nộp thuế theo kết quả giám định.
Các chi phí liên quan đến việc giám định sẽ do cơ quan hải quan chi trả trong trường hợp kết quả giám định khác với kết luận của cơ quan hải quan hoặc sẽ do đối tượng nộp thuế chi trả trong trường hợp kết quả giám định đúng với kết luận của cơ quan hải quan.
PART C
TAX DECLARATION, TAX PAYMENT
I. TAX DECLARATION: Payers of import tax or export tax shall have to declare tax right in customs declaration forms.
II. TIME OF TAX CALCULATION:
The time for calculating import tax or export tax shall be the date taxpayers register their customs declarations with customs offices. The import or export tax shall be calculated on the basis of the tax rate, dutiable value and tax calculation exchange rate at the time of tax calculation. Where a taxpayer makes electronic declaration, the time of tax calculation shall comply with regulations on e-customs procedures.
For imports or exports for which a single customs declaration form is registered for multiple importation or exportation, import or export tax shall be calculated according to the tax rate, dutiable value and tax calculation exchange rate applied on the date of importation or exportation on the basis of the actually imported or exported quantity of each goods item.
III. TAX PAYMENT TIME LIMIT
1. Export tax payment time limit:
For exports, it is 30 (thirty) days as from the date taxpayers register their customs declarations.
2. Import tax payment time limit:
2.1. For imported consumer goods on the list of consumer goods published by the Trade Ministry, tax must be paid before receipt of goods, except for the following cases:
2.1.1. Where taxpayers have their payable tax amounts guaranteed, the tax payment time limit shall be the guarantee duration, which, however, must not exceed 30 days as from the date taxpayers register their customs declarations.
Past the guarantee duration, if the taxpayer fails to completely pay the tax, the guarantor shall have to pay the tax and a fine for late payment (if any) on behalf of the taxpayer. The time of late payment of tax shall be counted from the date of expiration of the guarantee duration.
2.1.2. Where consumer goods are imported in direct service of security, defense, scientific research or education and training, and are entitled to consideration of import tax exemption, the tax payment time limit shall be 30 days, counting from the date taxpayers register their customs declarations.
2.2. Import tax payment time limit for taxpayers that have well observed tax laws:
Taxpayers that have well observed tax laws are goods owners that have well observed customs law and owed no overdue tax debts or fines for late tax payment at the time of registration of customs declarations.
2.2.1. For imported supplies or raw materials for direct use in production of goods for export, the tax payment time limit shall be 275 (two hundred seventy five) days, counting from the date taxpayers register their customs declarations.
2.2.1.1. The condition for application of the 275-day tax payment time limit is a written registration of supplies and/or raw materials imported for direct production of goods for export;
For some special cases where the supplies and raw materials-reserving cycle is longer than 275 days, the tax payment time limit may be longer than 275 days. Taxpayers shall submit their requests therefor to the General Department of Customs for consideration and decision on a case-by-case basis.
2.2.1.2. If taxpayers can only export their goods or cannot export their goods past the tax payment time limit, they shall be handled as follows:
- For the quantity of raw materials and supplies imported for use in the production of products which, however, are not exported, the late tax payment fine shall be calculated from the 31st day (counting from the date of registration of customs declarations) to the date of tax payment.
- For the quantity of imported raw materials and supplies already used in the production of products which are actually exported after the tax payment time limit, the late tax payment fine shall be calculated from the date following the expiration of the tax payment time limit to the date of actual exportation or the date of tax payment (if tax is paid before the date of actual exportation).
Where a taxpayer is entitled to the application of the tax payment time limit of 275 or more days but fails to export their products or export them after the tax payment time limit, the taxpayer must pay tax (for cases of exporting products after the tax payment time limit, the taxpayer must pay tax upon the expiration of the applicable tax payment time limit and shall get the paid tax amount refunded upon the actual exportation of products) and be fined as mentioned above.
2.2.2. Where goods are traded in the manner of temporary export for re-import or temporary import for re-export, the tax payment time limit shall be 15 (fifteen) days, counting from the date of expiration of the time limit for temporary export for re-import or temporary import for re-export (applicable also to cases of permitted extension).
Where an enterprise is entitled to the application of the tax payment limit for goods traded in the manner of temporary export for re-import or temporary import for re-export but fails to export its products or exports its products after the tax payment time limit, it shall be handed as follows:
- For failure to export products, the late tax payment fine shall be calculated from the 31st date (counting from the date of registration of customs declarations) to the date of tax payment;
- For exportation of goods after the tax payment time limit, the late tax payment fine shall be calculated from the date following the expiration of the tax payment time limit to the date of actual exportation or the date of tax payment (if tax is paid before the date of actual exportation).
2.2.3. For other cases of imported goods (including those on the list of consumer goods published by the Ministry of Trade but used as supplies or raw materials for production) other than the two cases specified at Points 2.2.1 and 2.2.2 above, the tax payment time limit shall be 30 days, counting from the date taxpayers register their customs declarations.
2.3. Tax payment limits for taxpayers failing to well observe tax laws:
2.3.1. If payable tax amounts are guaranteed by a credit institution or another organization operating under the Law on Credit Institutions, the tax payment time limit shall be the guarantee duration which must, however, not exceed the time limit specified for each case stated at Point 2.2 of this Section. Past the guarantee duration, in case the guarantee duration is shorter than the tax payment time limit, or past the tax payment time limit in case the guarantee duration is equal to or longer than the tax payment time limit, if a taxpayer fails to completely pay tax, the guarantor shall have to pay the tax and late tax payment fine (if any) on behalf of the taxpayer. The late payment period shall be counted from the date following the expiration of the guarantee duration or from the expiration of the tax payment time limit according to the aforesaid regulations.
2.3.2. If payable tax amounts are not guaranteed by a credit institution or another organization operating under the Law on Credit Institutions, taxpayers must pay tax in full before receipt of goods.
3. Tax payment time limits for imports or exports in other cases:
3.1. For goods imported or exported without goods sale and purchase contracts; goods imported or exported by border residents, tax must be completely paid before goods are exported abroad or imported into Vietnam.
3.2. Where imports or exports still under customs supervision are temporarily seized by a competent state agency for investigation and handling, the tax payment time limit for each kind of goods shall comply with the provisions of this Circular and be counted from the date the competent state agency issues a document permitting the release of the temporarily seized goods.
3.3. For imports or exports for which a single customs declaration is registered for multiple importation or exportation, the tax payment time limit for each date of actual importation or exportation of goods shall comply with the provisions of Points 1 and 2 of this Section.
3.4. Where technical standard, quality, quantity or kind expertise is required to ensure accurate tax calculation (such as determination of the appellation of the goods item and its code according to the import tax tariffs, the quality, quantity, technical standards, the condition of imported goods (old or new)…), taxpayers must still pay tax according to their declarations at the time of registration of customs declarations with customs offices; meanwhile, customs offices must notify taxpayers of the expertise reasons, and if the expertise results are different from taxpayers’ declarations, taxpayers must pay tax according to expertise results.
Expenses connected with the expertise shall be paid by customs offices in case expertise results are different from customs offices’ conclusions or by taxpayers in case expertise results are the same as customs offices’ conclusions.
