Điều 139. Quy định chuyển tiếp

1. Các quy định của Luật này được áp dụng đối với người đã tham gia bảo hiểm xã hội từ trước ngày Luật này có hiệu lực.

2. Người đang hưởng lương hưu, trợ cấp mất sức lao động, tai nạn lao động, bệnh nghề nghiệp, tiền tuất hằng tháng và người bị đình chỉ hưởng bảo hiểm xã hội do vi phạm pháp luật trước ngày Luật này có hiệu lực thì vẫn thực hiện theo các quy định trước đây và được điều chỉnh mức hưởng theo quy định của pháp luật.

3. Người đang hưởng lương hưu, trợ cấp mất sức lao động, tai nạn lao động, bệnh nghề nghiệp hằng tháng trước ngày Luật này có hiệu lực thì khi chết được áp dụng chế độ tử tuất quy định tại Luật này.

4. Người lao động có thời gian làm việc trong khu vực nhà nước trước ngày 01 tháng 01 năm 1995 nếu chưa nhận trợ cấp thôi việc hoặc trợ cấp một lần, trợ cấp xuất ngũ, phục viên thì thời gian đó được tính là thời gian đã đóng bảo hiểm xã hội.

5. Hằng năm, Nhà nước chuyển từ ngân sách một khoản kinh phí vào quỹ bảo hiểm xã hội bắt buộc để bảo đảm trả đủ lương hưu, trợ cấp bảo hiểm xã hội đối với người hưởng lương hưu, trợ cấp bảo hiểm xã hội trước ngày 01 tháng 01 năm 1995; đóng bảo hiểm xã hội cho thời gian làm việc trước ngày 01 tháng 01 năm 1995 đối với người quy định tại khoản 4 Điều này.

6. Thời gian người lao động đóng bảo hiểm thất nghiệp theo quy định tại Luật này không được tính để hưởng trợ cấp mất việc làm hoặc trợ cấp thôi việc theo quy định của pháp luật về lao động, pháp luật về cán bộ, công chức.

Điều 140. Hiệu lực thi hành

1. Luật này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2007; riêng đối với bảo hiểm xã hội tự nguyện thì từ ngày 01 tháng 01 năm 2008, đối với bảo hiểm thất nghiệp thì từ ngày 01 tháng 01 năm 2009.

2. Những quy định trước đây trái với Luật này đều bị bãi bỏ.

Điều 141. Hướng dẫn thi hành

Chính phủ quy định chi tiết và hướng dẫn thi hành Luật này.

IMPLEMENTATION PROVISIONS

Article 139.- Transition provisions

1. The provisions of this Law apply to persons who have participated in the social insurance before this Law takes effect.

2. Persons who are enjoying retirement pensions, monthly working capacity loss allowances, labor accident or occupational disease allowances or survivorship allowances and persons suspended from enjoying social insurance due to their law offenses before this Law takes effect shall still comply with the previous regulations and are entitled to the adjustment of the enjoyment levels in accordance with law.

3. Persons who are enjoying retirement pensions, monthly working capacity loss allowances, labor accident or occupational disease allowances before this Law takes effect shall, upon their death, enjoy the survivorship allowance regime provided for by this Law.

4. If laborers who had worked in the state sector before January 1, 1995, for a given duration have not yet received the job severance allowance, lump-sum allowance or demobilization allowance, this duration shall be counted as the duration of social insurance premium payment.

5. Annually, the State shall transfer from the budget an amount into the compulsory social insurance fund to ensure full payment of retirement pensions and social insurance allowances to persons enjoying retirement pensions, social insurance allowances before January 1, 1995; and payment of social insurance premiums for the working duration before January 1, 1995, for persons specified in Clause 4 of this Article.

6. The duration for which laborers pay unemployment premiums under the provisions of this Law shall not be counted for enjoyment of job loss allowances or job severance allowances under the provisions of the labor law or the law on cadres and civil servants.

Article 140.- Implementation effect

1. This Law takes effect on January 1, 2007; particularly for voluntary social insurance, after January 1, 2008, and unemployment insurance, after January 1, 2009.

2. All provisions contrary to this Law are annulled.

Article 141.- Implementation guidance

The Government shall detail and guide the implementation of this Law.
