Điều 61. Thanh tra, kiểm tra

1. Thanh tra chuyên ngành xây dựng thực hiện chức năng thanh tra chuyên ngành thoát nước đô thị và khu công nghiệp.

2. Thanh tra chuyên ngành môi trường thực hiện chức năng thanh tra chuyên ngành về bảo vệ môi trường trong hoạt động thoát nước.

3. Nội dung: thanh tra, kiểm tra việc chấp hành quy định của pháp luật về thoát nước; phát hiện, ngăn chặn, xử lý theo thẩm quyền và kiến nghị cơ quan có thẩm quyền xử lý các vi phạm pháp luật về thoát nước; kiến nghị các biện pháp bảo đảm thi hành pháp luật về thoát nước và bảo vệ môi trường.

4. Việc thanh tra hoạt động thoát nước thực hiện theo quy định của pháp luật về thanh tra.

Điều 62. Giải quyết khiếu nại, tố cáo

1. Tổ chức, cá nhân có quyền khiếu nại, tố cáo vi phạm pháp luật trong hoạt động thoát nước.

2. Việc giải quyết khiếu nại, tố cáo vi phạm pháp luật trong hoạt động thoát nước thực hiện theo quy định của pháp luật về khiếu nại, tố cáo.

3. Trong thời gian khiếu nại, tố cáo hoặc khởi kiện, tổ chức, cá nhân vẫn phải thi hành quyết định hành chính của cơ quan quản lý nhà nước có thẩm quyền về thoát nước. Khi có quyết định giải quyết khiếu nại, tố cáo về hoạt động thoát nước của cơ quan quản lý nhà nước có thẩm quyền hoặc quyết định của Toà án đã có hiệu lực thì thi hành theo các quyết định, bản án đó.

Điều 63. Xử lý vi phạm

1. Các tổ chức, cá nhân có trách nhiệm phát hiện, ngăn chặn và kiến nghị xử lý kịp thời những vi phạm pháp luật trong hoạt động thoát nước.

2. Tổ chức, cá nhân vi phạm các hành vi bị cấm trong hoạt động thoát nước được quy định tại Điều 11 Nghị định này thì tùy theo tính chất, mức độ vi phạm mà bị xử lý hành chính hoặc truy cứu trách nhiệm hình sự theo quy định của pháp luật.

3. Trường hợp các hành vi vi phạm pháp luật trong hoạt động thoát nước gây thiệt hại đến lợi ích của Nhà nước, quyền và lợi ích hợp pháp của các tổ chức, cá nhân thì đối tượng vi phạm phải bồi thường thiệt hại.

INSPECTION, EXAMINATION, AND HANDLING OF VIOLATIONS

Article 61.- Inspection, examination

1. The specialized construction inspectorate shall perform the specialized inspection of urban and industrial park water drainage.

2. The specialized environment inspectorate shall perform the specialized inspection of environmental protection in water drainage activities.

3. Contents: Inspecting and examining the observance of legal provisions on water drainage; detecting, preventing and handling according to its competence or proposing competent bodies to handle violations of the law on water drainage; proposing measures to ensure the enforcement of the law on water drainage and environmental protection.

4. The inspection of water drainage activities complies with the law on inspection.

Article 62.- Settlement of complaints and denunciations

1. Organizations and individuals may complain about or denounce law violations in water drainage activities.

2. Complaints and denunciations about law violations in water drainage activities shall be settled under the provisions of law on complaints and denunciations.

3. While making complaints, denunciations or lawsuits, organizations and individuals shall still execute administrative decisions of competent state management bodies in charge of water drainage. Upon the issue of decisions on settlement of complaints and denunciations about water drainage activities by competent state management bodies or effective court decisions, they shall comply witìi such decisions.

Article 63.- Handling of violations

1. Organizations and individuals have the responsibility to detect, prevent and propose to promptly handle law violations in water drainage activities.

2. Organizations and individuals that break the prohibitions in water drainage activities prescribed in Article 11 of this Decree shall, depending on the nature and severity of their violations, be administratively handled or examined for penal liability in accordance with law.

3. If law violations in water drainage activities cause damage to the interests of the State, legitimate rights and interests of organizations or individuals, the violators shall pay damages.
