Mức giá bán lẻ tại nhà thuốc trong khuôn viên bệnh viện
Ngày 08/5/2017, Chính phủ ban hành Nghị định 54/2017/NĐ-CP quy định chi tiết một số điều và biện pháp thi hành Luật dược.
Theo đó, giá bán lẻ tại cơ sở bán lẻ thuốc trong khuôn viên cơ sở khám, chữa bệnh được tính như sau:
Giá bán lẻ = Giá mua vào + Mức thặng số bán lẻ (%) x Giá mua vào
Trong đó, mức thặng số bán lẻ không được cao hơn mức thặng số bán lẻ tối đa (MTTĐ) như sau:
- Thuốc có giá mua tính trên đơn vị gói nhỏ nhất nhỏ hơn hoặc bằng 1000 đồng thì MTTĐ là 15%;
- Thuốc có giá mua tính trên đơn vị gói nhỏ nhất từ trên 1000 đồng đến 5000 đồng thì MTTĐ là 10%;
- Thuốc có giá mua tính trên đơn vị gói nhỏ nhất từ trên 5000 đồng đến 100.000 đồng thì MTTĐ là 7%;
- Thuốc có giá mua tính trên đơn vị gói nhỏ nhất từ trên 100.000 đồng đến 1.000.000 đồng thì MTTĐ là 5%;
- Thuốc có giá mua tính trên đơn vị gói nhỏ nhất từ trên 1.000.000 đồng thì MTTĐ là 2%.
Nghị định số 54/2017/NĐ-CP có hiệu lực từ ngày 01/7/2017.

Điều 93. Đối tượng và yêu cầu đăng ký lưu hành dược liệu, tá dược, vỏ nang
1. Dược liệu thuộc một trong các trường hợp sau đây phải đăng ký trước khi lưu hành tại Việt Nam:
a) Dược liệu thuộc Danh mục dược liệu độc;
b) Dược liệu lần đầu sử dụng làm thuốc tại Việt Nam;
c) Dược liệu dễ nhầm lẫn, dễ giả mạo;
d) Dược liệu chứa dược chất dễ bị ảnh hưởng về mặt chất lượng trong quá trình sản xuất, chế biến, lưu thông;
đ) Dược liệu thuộc Danh mục dược liệu nuôi trồng, thu hái trong nước đáp ứng yêu cầu về điều trị và khả năng cung cấp, giá hợp lý;
e) Bán thành phẩm dược liệu, trừ trường hợp các sản phẩm này do chính cơ sở sản xuất để sản xuất thuốc thành phẩm.
Bộ trưởng Bộ Y tế quy định cụ thể danh mục dược liệu phải đăng ký lưu hành.
2. Dược liệu không thuộc quy định tại khoản 1 Điều này phải công bố tiêu chuẩn theo quy định tại khoản 2 Điều 68 của Luật dược. Trường hợp cơ sở có nhu cầu đăng ký lưu hành thì thực hiện theo quy định tại Mục 1 Chương V của Nghị định này.
3. Tá dược dùng làm thuốc có tiêu chuẩn cơ sở do cơ sở sản xuất tá dược xây dựng mà không áp dụng hoặc không có trong dược điển Việt Nam, tiêu chuẩn, quy chuẩn quốc gia về thuốc hoặc không áp dụng dược điển nước ngoài tại Việt Nam theo quy định của Bộ trưởng Bộ Y tế phải đăng ký lưu hành, trừ trường hợp tá dược sử dụng để sản xuất thuốc đã được cấp giấy đăng ký lưu hành còn hiệu lực tại Việt Nam. Trường hợp cơ sở có nhu cầu đăng ký lưu hành thì thực hiện theo quy định tại Mục 1 Chương V của Nghị định này.
4. Vỏ nang dùng làm thuốc phải đăng ký lưu hành, trừ trường hợp vỏ nang sử dụng để sản xuất thuốc đã được cấp giấy đăng ký lưu hành còn hiệu lực tại Việt Nam. Trường hợp cơ sở có nhu cầu đăng ký lưu hành thì thực hiện theo quy định tại Mục 1 Chương V của Nghị định này.
5. Cơ sở được đứng tên đăng ký dược liệu, tá dược, vỏ nang bao gồm:
a) Cơ sở quy định tại khoản 3 Điều 54 của Luật dược;
b) Cơ sở quy định tại điểm c khoản 1 Điều 35 của Luật dược được đứng tên đăng ký dược liệu.
6. Hình thức đăng ký, quyền và trách nhiệm của cơ sở đăng ký dược liệu, tá dược, vỏ nang thực hiện theo quy định tại các Điều 55, 57 của Luật dược.
Điều 94. Thẩm quyền, hồ sơ, thủ tục, thời hạn cấp, gia hạn, thay đổi, bổ sung, thu hồi giấy đăng ký lưu hành dược liệu, tá dược, vỏ nangThẩm quyền, hồ sơ, thủ tục, thời hạn cấp, gia hạn, thay đổi, bổ sung, thu hồi giấy đăng ký lưu hành dược liệu, tá dược, vỏ nang thực hiện theo quy định tại các Điều 56, 58 của Luật dược, trừ thời hạn cấp và các quy định sau:
1. Đối với cơ sở nuôi trồng, thu hái dược liệu không có Giấy chứng nhận đủ điều kiện kinh doanh dược thì phải nộp bản sao có chứng thực Giấy chứng nhận đăng ký doanh nghiệp khi nộp hồ sơ đăng ký lưu hành dược liệu.
2. Thời hạn cấp giấy đăng ký lưu hành dược liệu, tá dược, vỏ nang là không quá 06 tháng kể từ ngày nhận đủ hồ sơ.
Mục 2. ĐÁNH GIÁ VIỆC ĐÁP ỨNG THỰC HÀNH TỐT SẢN XUẤT CỦA CƠ SỞ SẢN XUẤT THUỐC, NGUYÊN LIỆU LÀM THUỐC TẠI NƯỚC NGOÀI KHI ĐĂNG KÝ LƯU HÀNH TẠI VIỆT NAMĐiều 95. Các trường hợp nộp hồ sơ đề nghị đánh giá cơ sở sản xuất thuốc, nguyên liệu làm thuốc nước ngoài khi đăng ký lưu hành tại Việt Nam
1. Đối với thuốc, nguyên liệu làm thuốc chưa có giấy đăng ký lưu hành, cơ sở đăng ký khi nộp hồ sơ đề nghị cấp giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc nước ngoài phải nộp hồ sơ đề nghị đánh giá cơ sở sản xuất đáp ứng thực hành tốt sản xuất trong các trường hợp sau:
a) Cơ sở sản xuất nước ngoài lần đầu có thuốc đăng ký lưu hành tại Việt Nam;
b) Thuốc được sản xuất trên dây chuyền chưa được Bộ Y tế đánh giá;
c) Nguyên liệu làm thuốc là dược chất lần đầu được đăng ký lưu hành tại Việt Nam;
d) Cơ sở sản xuất nước ngoài lần đầu có dược liệu đăng ký lưu hành tại Việt Nam.
2. Đối với thuốc, nguyên liệu làm thuốc đã có giấy đăng ký lưu hành trước ngày Nghị định này có hiệu lực nhưng cơ sở sản xuất thuốc, nguyên liệu làm thuốc chưa được Bộ Y tế đánh giá, cơ sở đăng ký nộp hồ sơ đề nghị đánh giá cơ sở sản xuất đáp ứng thực hành tốt sản xuất trong các trường hợp sau:
a) Khi nộp hồ sơ đề nghị gia hạn giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc theo quy định tại khoản 4 Điều 55 của Luật dược;
b) Khi nộp hồ sơ đề nghị cấp giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc do thay đổi địa điểm của cơ sở sản xuất theo quy định tại điểm b hoặc c khoản 2 Điều 55 của Luật dược.
3. Trường hợp thuốc, nguyên liệu làm thuốc được sản xuất theo nhiều công đoạn sản xuất tại nhiều cơ sở sản xuất khác nhau, cơ sở đăng ký phải nộp hồ sơ đề nghị đánh giá đối với tất cả các cơ sở sản xuất tham gia vào sản xuất thuốc, nguyên liệu làm thuốc đó.
Điều 96. Hình thức đánh giá1. Thẩm định hồ sơ liên quan đến điều kiện sản xuất được áp dụng đối với cơ sở sản xuất không thuộc trường hợp quy định tại khoản 2 và điểm b khoản 3 Điều này.
2. Công nhận, thừa nhận kết quả thanh tra, kiểm tra của cơ quan quản lý nhà nước về dược đối với yêu cầu đáp ứng thực hành tốt sản xuất được áp dụng đối với các trường hợp sau:
a) Cơ sở sản xuất thuộc các nước được Bộ Y tế công bố tại danh mục các nước mà Việt Nam có ký điều ước quốc tế thừa nhận lẫn nhau về kết quả kiểm tra thực hành tốt sản xuất, trừ trường hợp quy định tại khoản 3 Điều này;
b) Cơ sở sản xuất thuộc các nước thành viên ICH, Australia và được một trong các cơ quan quản lý dược của Hoa Kỳ (US Food and Drug Administration, USFDA), các nước thuộc Liên minh Châu Âu (European Union, European Medicines Agency (EMA)), Australia (Therapeutic Goods Administration, TGA), Nhật Bản (Pharmaceuticals and Medical Devices Agency, PMDA) hoặc Canada (Health Canada) kiểm tra, đánh giá đáp ứng thực hành tốt sản xuất, trừ trường hợp quy định tại khoản 3 Điều này.
3. Kiểm tra tại cơ sở sản xuất được áp dụng đối với các trường hợp sau:
a) Cơ sở sản xuất có hồ sơ đăng ký thuốc, nguyên liệu làm thuốc có dấu hiệu sửa chữa hoặc có nghi ngờ về tính xác thực đối với thông tin, dữ liệu của hồ sơ;
b) Cơ sở sản xuất có thuốc vi phạm chất lượng mức độ 1 theo kết luận của Bộ Y tế;
c) Cơ sở sản xuất có hồ sơ đề nghị đánh giá điều kiện sản xuất được Bộ Y tế kết luận không đủ căn cứ chứng minh cơ sở sản xuất đó đáp ứng thực hành tốt sản xuất.
Điều 97. Nội dung đánh giá cơ sở sản xuất nước ngoài đáp ứng Thực hành tốt sản xuất1. Tài liệu làm căn cứ đánh giá:
a) Tiêu chuẩn thực hành tốt sản xuất thuốc, nguyên liệu làm thuốc theo quy định của Bộ trưởng Bộ Y tế;
b) Quy định về đăng ký, quản lý chất lượng thuốc, nguyên liệu làm thuốc hiện hành.
2. Nội dung đánh giá theo hình thức thẩm định hồ sơ liên quan đến điều kiện sản xuất:
a) Tính hợp pháp của giấy chứng nhận thực hành tốt sản xuất, giấy phép sản xuất hoặc báo cáo kiểm tra thực hành tốt sản xuất;
b) Tính phù hợp về phạm vi chứng nhận được ghi trên giấy chứng nhận thực hành tốt sản xuất hoặc báo cáo kiểm tra thực hành tốt sản xuất hoặc giấy phép sản xuất với dạng bào chế của thuốc, nguyên liệu làm thuốc đăng ký;
c) Tính phù hợp của điều kiện cơ sở nhà xưởng bao gồm sơ đồ bố trí nhà xưởng, dây chuyền sản xuất, vật liệu xây dựng, điều kiện môi trường sản xuất, bố trí đường di chuyển của nhân viên, của nguyên vật liệu, bán thành phẩm, thành phẩm, của trang thiết bị sản xuất, kiểm nghiệm, bảo quản thuốc, nguyên liệu làm thuốc;
d) Thiết lập và vận hành hệ thống quản lý chất lượng của cơ sở sản xuất;
đ) Đánh giá của cơ quan quản lý dược của nước sở tại hoặc cơ quan quản lý dược nước khác, những tồn tại được phát hiện và hoạt động khắc phục phòng ngừa của cơ sở sản xuất.
3. Nội dung đánh giá theo hình thức công nhận, thừa nhận lẫn nhau về kết quả thanh tra, kiểm tra thực hành tốt sản xuất của cơ quan quản lý dược nước ngoài:
a) Tính hợp pháp của Giấy chứng nhận Thực hành tốt sản xuất, giấy phép sản xuất hoặc báo cáo kiểm tra Thực hành tốt sản xuất;
b) Tính phù hợp về phạm vi chứng nhận được ghi trên Giấy chứng nhận Thực hành tốt sản xuất hoặc báo cáo kiểm tra Thực hành tốt sản xuất hoặc giấy phép sản xuất với dạng bào chế của thuốc, nguyên liệu làm thuốc đăng ký.
4. Nội dung đánh giá theo hình thức kiểm tra tại cơ sở sản xuất:
a) Tính hợp pháp của Giấy chứng nhận Thực hành tốt sản xuất, giấy phép sản xuất hoặc báo cáo kiểm tra Thực hành tốt sản xuất;
b) Hiện trạng cơ sở nhà xưởng bao gồm sơ đồ bố trí nhà xưởng, dây chuyền sản xuất, vật liệu xây dựng, điều kiện môi trường sản xuất, bố trí đường di chuyển của nhân viên, của nguyên vật liệu, bán thành phẩm, thành phẩm, của trang thiết bị sản xuất, kiểm nghiệm, bảo quản thuốc, nguyên liệu làm thuốc;
c) Quy trình sản xuất thực tế của dây chuyền sản xuất thuốc, nguyên liệu làm thuốc đăng ký;
d) Thiết lập và vận hành hệ thống quản lý chất lượng của cơ sở sản xuất;
đ) Tình trạng thực tế của việc áp dụng, đáp ứng thực hành tốt sản xuất trong toàn bộ hoạt động sản xuất, kiểm nghiệm, bảo quản thuốc, nguyên liệu làm thuốc tại cơ sở sản xuất.
Điều 98. Hồ sơ đề nghị đánh giá việc đáp ứng thực hành tốt sản xuất1. Đối với cơ sở sản xuất thuốc, nguyên liệu làm thuốc là dược chất thuộc trường hợp quy định tại khoản 2 Điều 96 của Nghị định này, hồ sơ đề nghị đánh giá cơ sở bao gồm:
a) Giấy chứng nhận thực hành tốt sản xuất hoặc báo cáo kiểm tra thực hành tốt sản xuất hoặc giấy phép sản xuất có đầy đủ thông tin về dạng bào chế của thuốc, nguyên liệu làm thuốc của cơ quan có thẩm quyền của nước sở tại cấp;
b) Hồ sơ tổng thể của cơ sở sản xuất theo hướng dẫn về hồ sơ tổng thể của cơ sở sản xuất của Liên minh Châu Âu (EU) hoặc của Hệ thống thanh tra dược phẩm quốc tế (PIC/S) hoặc của Tổ chức Y tế Thế giới.
2. Đối với cơ sở sản xuất thuốc, nguyên liệu làm thuốc là dược chất thuộc trường hợp quy định tại các khoản 1 và 3 Điều 96 của Nghị định này, hồ sơ đề nghị đánh giá bao gồm:
a) Giấy chứng nhận thực hành tốt sản xuất hoặc báo cáo kiểm tra thực hành tốt sản xuất hoặc giấy phép sản xuất có đầy đủ thông tin về dạng bào chế của thuốc, nguyên liệu làm thuốc của cơ quan có thẩm quyền của nước sở tại cấp; giấy chứng nhận thực hành tốt sản xuất hoặc báo cáo kiểm tra thực hành tốt sản xuất do cơ quan quản lý dược của nước thành viên của Liên minh Châu Âu (EU) hoặc Hệ thống thanh tra dược phẩm quốc tế (PIC/S) cấp (nếu có);
b) Hồ sơ tổng thể của cơ sở sản xuất theo hướng dẫn về hồ sơ tổng thể của cơ sở sản xuất của Liên minh Châu Âu (EU) hoặc của Hệ thống thanh tra dược phẩm quốc tế (PIC/S) hoặc của Tổ chức Y tế Thế giới;
c) Danh mục các đợt kiểm tra thực hành tốt sản xuất do cơ quan quản lý dược nước sở tại hoặc cơ quan quản lý dược nước khác đã tiến hành trong vòng 03 năm kể từ ngày nộp hồ sơ và báo cáo kiểm tra thực hành tốt sản xuất của đợt kiểm tra gần nhất có phạm vi kiểm tra bao gồm thuốc, nguyên liệu làm thuốc đăng ký hoặc dạng bào chế của thuốc đăng ký;
d) Danh mục các thuốc kèm dạng bào chế, nguyên liệu làm thuốc đã cung cấp hoặc dự định cung cấp vào Việt Nam;
đ) Quy trình xuất xưởng đối với thuốc, nguyên liệu làm thuốc dự kiến đăng ký lưu hành tại Việt Nam;
e) Báo cáo rà soát chất lượng định kỳ đối với trường hợp thuốc, nguyên liệu làm thuốc đăng ký lưu hành là thuốc, nguyên liệu làm thuốc dạng vô trùng.
3. Đối với cơ sở sản xuất nguyên liệu làm thuốc là tá dược, vỏ nang, hồ sơ đề nghị đánh giá cơ sở bao gồm:
a) Giấy chứng nhận thực hành tốt sản xuất hoặc báo cáo kiểm tra Thực hành tốt sản xuất hoặc giấy phép sản xuất có đầy đủ thông tin về nguyên liệu sản xuất do cơ quan có thẩm quyền của nước sở tại cấp đối với tá dược, vỏ nang;
b) Sổ tay chất lượng của cơ sở theo hướng dẫn tại tiêu chuẩn ISO (ISO/TR 10013:2001 hoặc bản cập nhật) hoặc hồ sơ tổng thể của cơ sở sản xuất theo hướng dẫn về hồ sơ tổng thể của cơ sở sản xuất của Liên minh Châu Âu (EU) hoặc của Hệ thống thanh tra dược phẩm quốc tế (PIC/S) hoặc của Tổ chức Y tế thế giới;
c) Cơ sở sản xuất nguyên liệu làm thuốc là tá dược, vỏ nang thuộc trường hợp quy định tại khoản 2 Điều 96 của Nghị định này chỉ nộp tài liệu quy định tại điểm a khoản này.
4. Đối với cơ sở sản xuất nguyên liệu làm thuốc là dược liệu, hồ sơ đề nghị đánh giá cơ sở bao gồm:
a) Giấy chứng nhận thực hành tốt sản xuất hoặc báo cáo kiểm tra thực hành tốt sản xuất;
b) Sổ tay chất lượng của cơ sở theo hướng dẫn tại tiêu chuẩn ISO (ISO/TR 10013:2001 hoặc bản cập nhật) hoặc Hồ sơ tổng thể của cơ sở sản xuất theo hướng dẫn về hồ sơ tổng thể của cơ sở sản xuất của Liên minh Châu Âu (EU) hoặc của Hệ thống thanh tra dược phẩm quốc tế (PIC/S) hoặc của Tổ chức Y tế Thế giới;
c) Danh mục các dược liệu đã cung cấp hoặc dự định cung cấp vào Việt Nam;
d) Tài liệu, thông tin về vùng trồng, khai thác dược liệu đã cung cấp hoặc dự định cung cấp vào Việt Nam;
đ) Cơ sở sản xuất nguyên liệu làm thuốc là dược liệu thuộc trường hợp quy định tại khoản 2 Điều 96 của Nghị định này chỉ nộp tài liệu quy định tại điểm a, c và d khoản này.
5. Yêu cầu đối với hồ sơ đề nghị đánh giá cơ sở sản xuất đáp ứng thực hành tốt sản xuất:
a) Hồ sơ đề nghị đánh giá cơ sở sản xuất làm thành 01 bộ bằng tiếng Anh hoặc tiếng Việt, trong đó các tài liệu trong hồ sơ được in rõ ràng, sắp xếp theo trình tự theo quy định tại các khoản 1, 2, 3 và 4 Điều này, giữa các phần có phân cách, có trang bìa và danh mục tài liệu;
b) Giấy chứng nhận thực hành tốt sản xuất, báo cáo kiểm tra thực hành tốt sản xuất theo quy định tại các khoản 1, 2, 3 và 4 Điều này, giấy phép sản xuất quy định tại khoản các 1, 2 và 3 Điều này phải là bản chính hoặc bản sao có chứng thực và còn hiệu lực tại thời điểm nộp hồ sơ. Trường hợp không ghi hiệu lực, các tài liệu này phải được cấp hoặc ban hành trong thời hạn không quá 03 năm kể từ ngày cấp.
Điều 99. Trình tự, thủ tục, thẩm quyền tiếp nhận hồ sơ và đánh giá cơ sở sản xuất1. Bộ Y tế tiếp nhận hồ sơ đề nghị đánh giá và tổ chức đánh giá việc đáp ứng thực hành tốt sản xuất của cơ sở sản xuất nước ngoài; lập báo cáo đánh giá và thông báo kết quả đánh giá việc đáp ứng thực hành tốt sản xuất của cơ sở sản xuất trong thời hạn như sau:
a) 30 ngày kể từ ngày nhận đủ hồ sơ đối với trường hợp đánh giá theo hình thức công nhận, thừa nhận kết quả thanh tra, kiểm tra của cơ quan quản lý nhà nước về dược đối với yêu cầu đáp ứng thực hành tốt sản xuất;
b) 60 ngày kể từ ngày nhận đủ hồ sơ đối với trường hợp đánh giá theo hình thức thẩm định hồ sơ liên quan đến điều kiện sản xuất;
c) 90 ngày kể từ ngày nhận đủ hồ sơ đối với trường hợp quy định tại điểm b khoản 3 Điều 96 của Nghị định này hoặc kể từ ngày thông báo kết quả thẩm định hồ sơ đăng ký thuốc hoặc hồ sơ đề nghị đánh giá cơ sở sản xuất đáp ứng thực hành tốt sản xuất và kế hoạch kiểm tra, đánh giá thực tế tại cơ sở sản xuất đối với trường hợp quy định tại các điểm a và c khoản 3 Điều 96 của Nghị định này.
2. Trường hợp cơ sở sản xuất đề nghị thay đổi kế hoạch đánh giá thực tế dự kiến, thời gian quy định tại điểm c khoản 1 Điều này được tính từ thời gian nhận được văn bản đề nghị của cơ sở sản xuất.
3. Trường hợp giấy chứng nhận thực hành tốt sản xuất hoặc giấy phép sản xuất hết hạn vào thời điểm thẩm định, báo cáo kiểm tra thực hành tốt sản xuất quá 03 năm kể từ ngày kiểm tra hoặc Hồ sơ tổng thể của cơ sở sản xuất không đầy đủ nội dung theo quy định, Bộ Y tế có văn bản yêu cầu cơ sở sản xuất bổ sung hồ sơ.
a) Cơ sở đăng ký nộp hồ sơ bổ sung trong thời hạn tối đa 90 ngày đối với hồ sơ tổng thể của cơ sở sản xuất; 06 tháng đối với Giấy chứng nhận thực hành tốt sản xuất hoặc giấy phép sản xuất hoặc báo cáo kiểm tra thực hành tốt sản xuất;
b) Trong thời hạn 30 ngày, kể từ ngày nhận được hồ sơ bổ sung, Bộ Y tế thông báo kết quả đánh giá.
4. Trong thời hạn 10 ngày làm việc, kể từ ngày có kết quả đánh giá, Bộ Y tế công bố thông tin về các cơ sở sản xuất đã được công nhận, đánh giá trên Cổng thông tin điện tử của đơn vị.
Điều 100. Trách nhiệm của cơ sở đăng ký thuốc, nguyên liệu làm thuốc nước ngoài trong việc kiểm tra, đánh giá thực hành tốt sản xuất của cơ sở sản xuất thuốc nước ngoài và các trường hợp ngừng nhận hồ sơ cấp, gia hạn giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc của cơ sở đăng ký, cơ sở sản xuất thuốc, nguyên liệu làm thuốc1. Trách nhiệm cụ thể của cơ sở đăng ký thuốc, nguyên liệu làm thuốc trong việc kiểm tra, đánh giá thực hành tốt sản xuất của cơ sở sản xuất nước ngoài:
a) Nộp hồ sơ đề nghị đánh giá cơ sở sản xuất thuốc, nguyên liệu làm thuốc đáp ứng thực hành tốt sản xuất theo quy định;
b) Chịu trách nhiệm về việc đảm bảo tính đầy đủ, chính xác của hồ sơ đăng ký đánh giá việc đáp ứng thực hành tốt sản xuất; cung cấp bổ sung các tài liệu chứng minh theo yêu cầu của Bộ Y tế;
c) Phối hợp với cơ sở sản xuất thuốc, nguyên liệu làm thuốc thực hiện các yêu cầu của Bộ Y tế về việc kiểm tra, đánh giá cơ sở sản xuất;
d) Báo cáo Bộ Y tế về cập nhật tình trạng đáp ứng thực hành tốt sản xuất của cơ sở sản xuất thuốc, nguyên liệu làm thuốc. Trường hợp cơ sở sản xuất bị thu hồi giấy phép sản xuất hoặc không đáp ứng thực hành tốt sản xuất thuốc, nguyên liệu làm thuốc ở nước sở tại, cơ sở phải thực hiện việc báo cáo trong thời hạn 15 ngày kể từ ngày có thông báo của cơ quan quản lý có thẩm quyền nước sở tại;
đ) Chịu trách nhiệm về chi phí cho việc đánh giá cơ sở sản xuất theo quy định của pháp luật.
2. Ngừng nhận hồ sơ cấp, gia hạn giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc khi cơ sở đăng ký, cơ sở sản xuất thuốc, nguyên liệu làm thuốc có một trong các hành vi vi phạm sau:
a) Các trường hợp bị thu hồi giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc quy định tại các điểm a, b, d, đ khoản 1 Điều 58 của Luật dược;
b) Sản xuất thuốc từ nguồn nguyên liệu không rõ nguồn gốc, xuất xứ, nguyên liệu làm thuốc đã hết hạn dùng;
c) Có từ 02 lô thuốc, nguyên liệu làm thuốc trở lên không đạt tiêu chuẩn chất lượng mức độ 2 hoặc có từ 03 lô thuốc, nguyên liệu làm thuốc trở lên không đạt tiêu chuẩn chất lượng trong vòng 01 năm theo kết luận của cơ quan nhà nước có thẩm quyền;
d) Cung cấp thông tin liên quan đến hồ sơ kỹ thuật mà không dựa trên cơ sở nghiên cứu hoặc sản xuất thực tế của cơ sở sản xuất;
đ) Không báo cáo Bộ Y tế trong thời hạn 15 ngày kể từ ngày có thông báo của cơ quan quản lý có thẩm quyền nước sở tại về việc cơ sở sản xuất bị thu hồi giấy phép sản xuất hoặc không đáp ứng thực hành tốt sản xuất thuốc, nguyên liệu làm thuốc;
e) Thay đổi, sửa chữa hạn dùng của thuốc, trừ trường hợp quy định tại khoản 3 Điều 61 của Luật dược;
g) Không báo cáo Bộ Y tế trong thời hạn 15 ngày kể từ ngày có thông báo của cơ quan quản lý có thẩm quyền trong trường hợp thuốc, nguyên liệu làm thuốc do cơ sở đăng ký bị thu hồi hoặc bị rút giấy đăng ký lưu hành ở bất kỳ nước nào trên thế giới;
h) Không thực hiện việc cập nhật thông tin thuốc trên nhãn, tờ hướng dẫn sử dụng hoặc tóm tắt đặc tính sản phẩm của thuốc đang lưu hành tại Việt Nam theo yêu cầu của Bộ Y tế.
3. Thời hạn tạm ngừng nhận hồ sơ cấp, gia hạn giấy đăng ký thuốc, nguyên liệu làm thuốc kể từ ngày ban hành văn bản thông báo hành vi vi phạm của cơ quan có thẩm quyền:
a) Từ 03 năm đến 05 năm đối với các trường hợp quy định tại điểm d khoản 1 Điều 58 của Luật dược;
b) Từ 01 năm đến 02 năm đối với các trường hợp quy định tại các điểm a, đ khoản 1 Điều 58 của Luật dược và các điểm b, c, d, đ, e khoản 2 Điều này;
c) Từ 06 tháng đến 01 năm đối với các trường hợp quy định tại điểm b khoản 1 Điều 58 của Luật dược và các điểm g, h khoản 2 Điều này.
4. Hồ sơ đề nghị cấp, gia hạn giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc của các cơ sở có hành vi vi phạm quy định tại điểm a, b, c, d, đ, e khoản 2 Điều này nộp trước ngày bị xử lý vi phạm sẽ không còn giá trị. Khi hết thời hạn tạm ngừng nhận hồ sơ quy định tại khoản 3 Điều này, cơ sở muốn đăng ký thuốc, nguyên liệu làm thuốc phải nộp hồ sơ theo quy định tại Luật dược.
MARKETING AUTHORIZATION OF HERBAL MATERIALS, EXCIPIENTS, CAPSULE SHELLS AND ASSESSMENT OF OVERSEAS DRUG MANUFACTURERS
Section 1. REGSITRATION OF HERBAL MATERIALS, EXCIPIENTS, CAPSULE SHELLS
Article 93. Herbal materials for which marketing authorization is mandatory and conditions for marketing authorization
1. Marketing authorization must be obtained for an herbal material in any of the following cases before it is marketed in Vietnam:
a) it is on the list of toxic herbal materials;
b) it is used as a medicinal material in Vietnam for the first time;
c) it is likely to cause confusion or subject to counterfeiting;
d) it contains an active ingredient whose quality is easily affected during its manufacture, processing or sale;
dd) it is on the list of herbal materials that can be domestically obtained with adequate quantity and at rational prices; or
e) it is a semi-finished herbal material unless it is meant to be processed into drugs by its manufacturer.
The Minister of Health shall compile the list of herbal materials for which marketing authorization is mandatory.
2. Applied standards of herbal materials other than those specified in Clause 1 of this Article shall be declared in accordance with Clause 2 Article 68 of the Law on Pharmacy. Procedures for marketing authorization are specified in Section 1 of Chapter V hereof.
3. In the cases where quality standards applied to an excipient that are established by the manufacturer are not included in Vietnam’s pharmacopoeia or any Vietnam’s pharmaceutical standards or any foreign pharmacopoeia specified by the Minister of Health, such excipient must be registered unless it is used for production of a drug that has an unexpired marketing authorization in Vietnam. Procedures for registration are specified in Section 1 of Chapter V hereof.
4. Capsule shells shall be registered unless they are used for production of a drug that has an unexpired marketing authorization in Vietnam. Procedures for registration are specified in Section 1 of Chapter V hereof.
5. The following entities may apply for registration of herbal materials, excipients or capsule shells:
a) The establishments specified in Clause 3 Article 54 of the Law on Pharmacy;
b) The establishments specified in Clause 1c Article 35 of the Law on Pharmacy that are permitted to apply for registration of herbal materials;
6. Registration method, rights and obligations of applicants for registration of herbal materials, excipients and capsule shells are specified in Article 55 and Article 57 of the Law on Pharmacy.
Article 94. Power, documents, procedures and deadline for issuing, renewing, adjusting and revoking the marketing authorization of herbal materials, excipients and capsule shells
The power, documents, procedures and deadline for issuing, renewing, adjusting and revoking the marketing authorization of herbal materials, excipients and capsule shells are specified in Article 56 and Article 58 of the Law on Pharmacy, with the following exceptions:
1. If the applicant is an herbal material collection facility without the Certificate of eligibility for pharmacy business, a certified true copy of the certificate of enterprise registration shall be included in the application.
2. The marketing authorization of herbal materials, excipients and capsule shells shall be issued within 06 months from the day on which the satisfactory application is received.
Section 2. INSPECTION OF FULFILLMENT OF GMP REQUIREMENTS BY OVERSEAS MANUFACTURERS OF DRUGS/MEDICINAL MATERIALS WHEN THEY APPLY FOR REGISTRATION IN VIETNAM
Article 95. Applying for inspection of overseas manufacturers of drugs/medicinal materials when they apply for registration in Vietnam
1. If a drug or medicinal material has not been granted a marketing authorization, the applicant shall submit an application for GMP inspection in addition to the application for the marketing authorization of the drug or medicinal material in the following cases:
a) The foreign manufacturer applies for drug granted marketing authorization in Vietnam for the first time;
b) The production line of the drug has not undergone inspection by the Ministry of Health;
c) The medicinal material is an active ingredient that granted marketing authorization in Vietnam for the first time;
d) The foreign manufacturer applies for herbal material marketing authorization in Vietnam for the first time.
2. If the marketing authorization of a drug or medicinal material is issued before the effective date of this Decree and its manufacturer has not undergone inspection by the Ministry of Health, an application GMP inspection shall be submitted when:
a) applying for renewal of the marketing authorization of the drug or medicinal material according to Clause 4 Article 55 of the Law on Pharmacy;
b) applying for issuance of the marketing authorization of the drug or medicinal material because of relocation of the factory according to Clause 2b or Clause 2c Article 55 of the Law on Pharmacy.
3. If the drug or medicinal material is manufactured by multiple factories, the applicant shall apply for inspection of all of the factories that participate in the production.
Article 96. Inspection methods
1. Inspection of documents about the manufacturing conditions shall be carried out in the cases specified in Clause 2 and Clause 3b of this Article.
2. The inspection result given by a pharmacy authority shall be recognized in the following cases:
a) The manufacturer is of a country that has agreement with Vietnam on mutual recognition of GMP inspections according to the list compiled by the Ministry of Health, except for the cases specified in Clause 3 of this Article;
b) The manufacturer is of a member state of ICH or Australia, undergoes GMP inspection and granted the certificate of GMP by either US Food and Drug Administration (USFDA), European Union, European Medicines Agency (EMA), Australia’s Therapeutic Goods Administration (TGA), Japan’s Pharmaceuticals and Medical Devices Agency (PMDA) or Health Canada, except for the cases specified in Clause 3 of this Article.
3. A site inspection shall be carried out when:
a) The application for registration of drug or medicinal material is suspected of falsification or inaccuracy;
b) The manufacturer commits a first-degree violation according to conclusion of the Ministry of Health;
c) The Ministry of Health concludes that documents submitted by the manufacturer are not sufficient for proving its fulfillment of GMP requirements.
Article 97. Inspection contents
1. Documents that are basis for inspection:
a) The GMP requirements applied to drugs and medicinal materials prescribed by the Minister of Health;
b) Effective regulations on registration of drugs and medicinal materials and quality control.
2. Document inspection contents:
a) Legitimacy of the certificate of GMP, the manufacturing license or the report on GMP inspection;
b) Suitability of the certificate of GMP, the manufacturing license or the report on GMP inspection for the dosage form of the registered drug or medicinal material;
c) Suitability of the factory, including the floor plan, production line, building materials, environmental conditions, movement of employees, materials, semi-finished products and finished products, movement of equipment for manufacturing, testing, storing drugs/medicinal materials;
d) Establishment and operation of the manufacturer’s quality control system;
dd) Comments of the pharmacy authority of the manufacturer’s home country or other countries; discovered weaknesses and remedies taken by the manufacturer.
3. Contents of inspection in the form of mutual recognition of GMP inspection by foreign pharmacy authorities:
a) Legitimacy of the certificate of GMP, the manufacturing license or the report on GMP inspection;
b) Suitability of the certificate of GMP, the manufacturing license or the report on GMP inspection for the dosage form of the registered drug or medicinal material.
4. Contents of site inspection:
a) Legitimacy of the certificate of GMP, the manufacturing license or the report on GMP inspection;
b) Conditions of the factory, including the floor plan, production line, building materials, environmental conditions, movement of employees, materials, semi-finished products and finished products, movement of equipment for manufacturing, testing, storing drugs/medicinal materials;
c) Operation of the production line for the drug or medicinal material registered;
d) Establishment and operation of the manufacturer’s quality control system;
dd) Application of GMP requirements to the production, testing, storage of drugs/medicinal materials by the manufacturer.
Article 98. Composition of the application for GMP inspection
1. The application for GMP inspection submitted by a manufacturer of drugs/medicinal materials that are active ingredients in any of the cases specified in Clause 2 Article 96 hereof consists of:
a) The certificate of GMP, the manufacturing license or the report on GMP inspection which contains sufficient information about the dosage form of the drug or medicinal material issued by a competent authority of the manufacturer’s home country;
b) The site master file (SMF) prepared by the manufacturer according to instructions of EU, Pharmaceutical Inspection Co-operation Scheme (PIC/S) or WHO.
2. The application for GMP inspection submitted by a manufacturer of drugs/medicinal materials that are active ingredients in any of the cases specified in Clause 1 and Clause 3 Article 96 hereof consists of:
a) The certificate of GMP, the manufacturing license or the report on GMP inspection which contains sufficient information about the dosage form of the drug or medicinal material issued by a competent authority of the manufacturer’s home country; the certificate of GMP or report on GMP inspection issued by the pharmacy authority of a member state of EU or PIC/S (if any);
b) The SMF prepared by the manufacturer according to instructions of EU, Pharmaceutical Inspection Co-operation Scheme (PIC/S) or WHO;
c) A list of GMP inspections carried out by pharmacy authorities of the manufacturer’s home country over the last 03 years before the application is submitted and the report on the latest GMP inspection that involves the registered drug or medicinal material or the dosage form thereof;
d) A list of drugs and dosage forms thereof and medicinal materials that have been exported or intended for export to Vietnam;
dd) Procedures for release of the drug or medicinal material to be registered in Vietnam;
e) A report on periodic quality inspection if the registered drug or medicinal material is in sterile form.
3. The application for GMP inspection submitted by a manufacturer of excipients or capsule shells consists of:
a) The certificate of GMP, the manufacturing license or the report on GMP inspection which contains sufficient information about the excipient of capsule shells issued by a competent authority of the manufacturer’s home country;
b) The quality manual according to ISO/TR 10013:2001 of updates thereof or the SMF prepared by the manufacturer according to instructions of EU, PIC/S or WHO;
c) A manufacturer of excipients or capsule shells specified in Clause 2 Article 96 hereof shall submit only documents specified in Point a of this Clause.
4. The application for GMP inspection submitted by a manufacturer of herbal materials consists of:
a) The certificate of GMP or the report on GMP inspection;
b) The quality handbook according to ISO/TR 10013:2001 of updates thereof or the SMF prepared by the manufacturer according to instructions of EU, PIC/S or WHO;
c) A list of herbal materials that have been exported or intended for export to Vietnam;
d) Documents about the area(s) where herbal materials have been exported or intended for export to Vietnam are obtained;
dd) A manufacturer of herbal materials specified in Clause 2 Article 96 hereof shall submit only documents specified in Points a, c and d of this Clause.
5. An application for GMP inspection shall satisfy the following requirements:
a) The application is written in English or Vietnam language; documents in the application are clearly printed and arranged in the order specified in Clause 1 through 4 of this Article, the parts are clearly separated; the application has covers and a list of documents;
b) The certificate of GMP and report on GMP inspection mentioned in Clause 1 through 4 of this Article and the manufacturing license mentioned in Clause 1 through 3 of this Article shall be original copies or certified true copies and have to be unexpired when the application is submitted. If the expiration date is not specified, it must be issued within the last 03 years from the day on which the application is submitted.
Article 99. Receipt of applications and time of inspection
1. The Ministry of Health shall receive applications for GMP inspection, carry out the inspections, prepare GMP inspection reports and notify the results:
a) within 30 days from the day on which the satisfactory application is received in case of mutual recognition of GMP inspection;
b) within 60 days from the day on which the satisfactory application is received in case of document inspection;
c) within 90 days from the day on which the satisfactory application is received in the case specified in Clause 3b Article 96 of this Decree or the date of notification of the result of verification of the application for drug registration or application for GMP inspection and the plan for site inspection in the cases specified in Clause 3a and Clause 3c Article 96 of this Decree.
2. If the applicant wishes to change the site inspection date, the time limit specified in Clause 1c of this Article shall begin when the applicant’s request is received.
3. If the certificate of GMP or the manufacturing license is expired on the inspection date or the report on GMP inspection was issued more than 03 years before the inspection date or the SMF does not contain sufficient information, the Ministry of Health shall request the applicant to complete the application.
a) The supplementary SMF shall be submitted within 90 days, the certificate of GMP, manufacturing license or GMP inspection report within 06 months;
b) The Ministry of Health shall notify the applicant of the result within 30 days from the day on which supplementary documents are received.
4. Within 10 working days from the day on which the result is available, the Ministry of Health shall publish information about the inspected and recognized manufacturers on its website.
Article 100. Responsibilities of applicants for registration of drugs/medicinal materials of foreign manufacturers in GMP inspection; cases in which applications for marketing authorization of drugs/medicinal materials are rejected
1. During the GMP inspection, the applicant for registration of a drug or medicinal material of a foreign manufacturer shall:
a) Submit the application for GMP inspection as prescribed;
b) Take responsibility for the adequacy and accuracy of documents in the application for GMP inspection; provide supporting documents requested by the Ministry of Health;
c) Cooperate with the manufacturer in complying with requests of the Ministry of Health;
d) Submit a report to the Ministry of Health on the manufacturer’s fulfillment of GMP requirements. In the cases where the manufacturing license is revoked or the manufacturer fails to fulfill GMP requirements in its home country, the applicant shall submit a report within 15 days from the day on which a notification is issued by a competent authority of the manufacturer’s home country;
d) Pay the cost of GMP inspection as prescribed by law.
2. The application for issuance or renewal of the certificate of drug/medicinal material registration shall be rejected if the applicant or the manufacturer commits any of the following violations:
a) Any of the violations that result in revocation of the certificate of drug/medicinal material registration specified in Points a, b, d, dd Clause 1 Article 58 of the Law on Pharmacy;
b) Materials of unknown origins or expired materials are used for drug production;
c) At least 02 batches of drug or medicinal material fail to meet Level 2 quality standards or at least 03 batches of drug or medicinal material fail to meet quality standards within 01 years according to conclusion given by a competent authority;
d) Information about technical documents is provided without research or production in reality;
dd) No report is submitted to the Ministry of Health within 15 days from the day on which a competent authority of the manufacturer’s home country issues a notification of revocation of the manufacturing license or the manufacturer’s failure to meet GMP requirements;
e) Shelf life of drug is falsified, except for the case specified in Clause 3 Article 61 of the Law on Pharmacy;
g) No report is submitted to the Ministry of Health within 15 days from the day on which a competent authority issues a notification that the registered drug or medicinal material is recalled or has the marketing authorization revoked in any country in the world;
h) Information about the drug on the label or package insert or summary of drug characteristics is not updated as requested by the Ministry of Health.
3. From the day on which the violation is notified by a competent authority, the applicant shall be suspended from submitting the application for issuance or renewal of the certificate of drug/medicinal material registration for:
a) 03 – 05 years in the cases specified in Clause 1d Article 58 of the Law on Pharmacy;
b) 01 – 02 years in the cases specified in Clause 1a and 1 dd Article 58 of the Law on Pharmacy and Points b, c, d, dd and e of Clause 2 of this Article;
c) 06 months – 01 year in the cases specified in Clause 1b Article 58 of the Law on Pharmacy, Clause 2g and Clause 2h of this Article.
4. Applications submitted by applicants that commit any of the violations specified in Points a, b, c, d, đ, e Clause 2 of this Article before the violations are dealt with will be invalidated. At the end of the periods specified in Clause 3 of this Article, the application may be submitted in accordance with the Law on Pharmacy.
