1. Trong Công an nhân dân có các Cơ quan điều tra sau đây:
a) Cơ quan Cảnh sát điều tra Bộ Công an; Cơ quan Cảnh sát điều tra Công an tỉnh, thành phố trực thuộc trung ương (sau đây gọi chung là Cơ quan Cảnh sát điều tra Công an cấp tỉnh); Cơ quan Cảnh sát điều tra Công an huyện, quận, thị xã, thành phố thuộc tỉnh (sau đây gọi chung là Cơ quan Cảnh sát điều tra Công an cấp huyện);
b) Cơ quan An ninh điều tra Bộ Công an; Cơ quan An ninh điều tra Công an tỉnh, thành phố trực thuộc trung ương (sau đây gọi chung là Cơ quan An ninh điều tra Công an cấp tỉnh).
2. Trong Quân đội nhân dân có các Cơ quan điều tra sau đây:
a) Cơ quan điều tra hình sự Bộ Quốc phòng; Cơ quan điều tra hình sự quân khu và tương đương; Cơ quan điều tra hình sự khu vực;
b) Cơ quan An ninh điều tra Bộ Quốc phòng; Cơ quan An ninh điều tra quân khu và tương đương.
3. ở Viện kiểm sát nhân dân tối cao có các Cơ quan điều tra sau đây:
a) Cơ quan điều tra Viện kiểm sát nhân dân tối cao;
b) Cơ quan điều tra Viện kiểm sát quân sự trung ương.
4. Cơ quan điều tra có Thủ trưởng, Phó Thủ trưởng và Điều tra viên.
Cơ quan điều tra tiến hành điều tra tất cả các tội phạm, áp dụng mọi biện pháp do Bộ luật tố tụng hình sự quy định để xác định tội phạm và người đã thực hiện hành vi phạm tội, lập hồ sơ, đề nghị truy tố; tìm ra nguyên nhân, điều kiện phạm tội và yêu cầu các cơ quan, tổ chức hữu quan áp dụng các biện pháp khắc phục và ngăn ngừa.
1. Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển khi thực hiện nhiệm vụ trong lĩnh vực quản lý của mình mà phát hiện những hành vi phạm tội đến mức phải truy cứu trách nhiệm hình sự thì tiến hành các hoạt động điều tra theo quy định tại các điều 19, 20, 21 và 22 của Pháp lệnh này.
2. Các cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra trong khi làm nhiệm vụ của mình, nếu phát hiện sự việc có dấu hiệu tội phạm thì có quyền khởi tố vụ án, tiến hành những hoạt động điều tra ban đầu và chuyển hồ sơ cho Cơ quan điều tra có thẩm quyền theo quy định tại các điều 23, 24 và 25 của Pháp lệnh này.
1. Chỉ Cơ quan điều tra và các cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra quy định trong Pháp lệnh này mới được tiến hành điều tra các vụ án hình sự. Mọi hoạt động điều tra phải tuân theo quy định của Bộ luật tố tụng hình sự và Pháp lệnh này.
2. Hoạt động điều tra phải tôn trọng sự thật, tiến hành một cách khách quan, toàn diện và đầy đủ; phát hiện chính xác, nhanh chóng mọi hành vi phạm tội, làm rõ những chứng cứ xác định có tội và chứng cứ xác định vô tội, những tình tiết tăng nặng và tình tiết giảm nhẹ trách nhiệm hình sự của người có hành vi phạm tội, không để lọt tội phạm và không làm oan người vô tội.
3. Cơ quan điều tra cấp dưới chịu sự hướng dẫn, chỉ đạo nghiệp vụ của Cơ quan điều tra cấp trên.
Viện kiểm sát kiểm sát việc tuân theo pháp luật trong hoạt động điều tra nhằm bảo đảm hoạt động điều tra của Cơ quan điều tra, Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển, các cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra tuân thủ các quy định của Bộ luật tố tụng hình sự và Pháp lệnh này.
Viện kiểm sát phải phát hiện kịp thời và yêu cầu Cơ quan điều tra, Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển, cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra khắc phục vi phạm pháp luật trong hoạt động điều tra; cấp, thu hồi giấy chứng nhận người bào chữa đối với những vụ án do Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển và cơ quan khác của Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra thụ lý điều tra.
Cơ quan điều tra, Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển và cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra phải thực hiện những yêu cầu, quyết định của Viện kiểm sát theo quy định của Bộ luật tố tụng hình sự.
1. Tổ chức, công dân có quyền và nghĩa vụ phát hiện, tố giác hành vi phạm tội; có trách nhiệm thực hiện yêu cầu và tạo điều kiện để Cơ quan điều tra, Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển, cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra, Thủ trưởng, Phó Thủ trưởng Cơ quan điều tra, Điều tra viên, Thủ trưởng, Phó Thủ trưởng cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra thực hiện nhiệm vụ điều tra.
2. Trong phạm vi trách nhiệm của mình, cơ quan nhà nước phải thông báo ngay cho Cơ quan điều tra biết mọi hành vi phạm tội xảy ra trong cơ quan và trong lĩnh vực quản lý của mình; có quyền kiến nghị và gửi tài liệu có liên quan cho Cơ quan điều tra để xem xét khởi tố đối với người có hành vi phạm tội; có trách nhiệm thực hiện yêu cầu và tạo điều kiện để Cơ quan điều tra, Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển, cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra, Thủ trưởng, Phó Thủ trưởng Cơ quan điều tra, Điều tra viên, Thủ trưởng, Phó Thủ trưởng cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra thực hiện nhiệm vụ điều tra.
3. Trong phạm vi trách nhiệm của mình, Cơ quan điều tra phải xem xét, giải quyết tin báo, tố giác về tội phạm, kiến nghị khởi tố, thông báo kết quả giải quyết cho cơ quan, tổ chức đã báo tin, kiến nghị, người đã tố giác tội phạm biết và phải áp dụng các biện pháp cần thiết để bảo vệ người đã tố giác tội phạm.
Cơ quan nhà nước, Uỷ ban Mặt trận Tổ quốc Việt Nam và các tổ chức thành viên của Mặt trận, đại biểu dân cử có quyền giám sát hoạt động điều tra của Cơ quan điều tra, Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển, cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra, Thủ trưởng, Phó Thủ trưởng Cơ quan điều tra, Điều tra viên, Thủ trưởng, Phó Thủ trưởng cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra.
Trong trường hợp phát hiện có hành vi trái pháp luật trong hoạt động điều tra thì cơ quan nhà nước, đại biểu dân cử có quyền yêu cầu, Uỷ ban Mặt trận Tổ quốc Việt Nam, các tổ chức thành viên của Mặt trận có quyền kiến nghị với cơ quan có thẩm quyền xem xét, giải quyết theo quy định của Bộ luật tố tụng hình sự. Trong phạm vi trách nhiệm của mình, Cơ quan điều tra, Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển, cơ quan khác của Công an nhân dân, Quân đội nhân dân được giao nhiệm vụ tiến hành một số hoạt động điều tra phải xem xét, giải quyết và thông báo kết quả giải quyết cho cơ quan, người đã yêu cầu hoặc kiến nghị biết.
1. Tổ chức của Cơ quan Cảnh sát điều tra Bộ Công an gồm có Cục Cảnh sát điều tra tội phạm về trật tự xã hội, Cục Cảnh sát điều tra tội phạm về trật tự quản lý kinh tế và chức vụ, Cục Cảnh sát điều tra tội phạm về ma tuý và Văn phòng Cơ quan Cảnh sát điều tra.
2. Tổ chức của Cơ quan Cảnh sát điều tra Công an cấp tỉnh gồm có Phòng Cảnh sát điều tra tội phạm về trật tự xã hội, Phòng Cảnh sát điều tra tội phạm về trật tự quản lý kinh tế và chức vụ, Phòng Cảnh sát điều tra tội phạm về ma tuý và Văn phòng Cơ quan Cảnh sát điều tra.
3. Tổ chức của Cơ quan Cảnh sát điều tra Công an cấp huyện gồm có Đội Cảnh sát điều tra tội phạm về trật tự xã hội, Đội Cảnh sát điều tra tội phạm về trật tự quản lý kinh tế và chức vụ, Đội Cảnh sát điều tra tội phạm về ma tuý và bộ máy giúp việc Cơ quan Cảnh sát điều tra.
1. Tổ chức của Cơ quan An ninh điều tra Bộ Công an gồm có các phòng điều tra, phòng nghiệp vụ và Văn phòng Cơ quan An ninh điều tra.
2. Tổ chức của Cơ quan An ninh điều tra Công an cấp tỉnh gồm có các đội điều tra, đội nghiệp vụ và bộ máy giúp việc Cơ quan An ninh điều tra.
1. Cơ quan Cảnh sát điều tra Công an cấp huyện điều tra các vụ án hình sự về các tội phạm quy định tại các chương từ Chương XII đến Chương XXII của Bộ luật hình sự khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án nhân dân cấp huyện, trừ các tội phạm thuộc thẩm quyền điều tra của Cơ quan điều tra Viện kiểm sát nhân dân tối cao và Cơ quan An ninh điều tra trong Công an nhân dân.
2. Cơ quan Cảnh sát điều tra Công an cấp tỉnh điều tra các vụ án hình sự về các tội phạm quy định tại khoản 1 Điều này khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án nhân dân cấp tỉnh hoặc các tội phạm thuộc thẩm quyền điều tra của Cơ quan Cảnh sát điều tra Công an cấp huyện nhưng xét thấy cần trực tiếp điều tra.
3. Cơ quan Cảnh sát điều tra Bộ Công an điều tra các vụ án hình sự về những tội phạm đặc biệt nghiêm trọng, phức tạp thuộc thẩm quyền điều tra của Cơ quan Cảnh sát điều tra Công an cấp tỉnh nhưng xét thấy cần trực tiếp điều tra.
1. Cơ quan An ninh điều tra Công an cấp tỉnh điều tra các vụ án hình sự về các tội phạm quy định tại Chương XI, Chương XXIV và các tội phạm quy định tại các điều 180, 181, 221, 222, 223, 230, 231, 232, 236, 263, 264, 274 và 275 của Bộ luật hình sự khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án nhân dân cấp tỉnh.
2. Cơ quan An ninh điều tra Bộ Công an điều tra các vụ án hình sự về những tội phạm đặc biệt nghiêm trọng, phức tạp thuộc thẩm quyền điều tra của Cơ quan An ninh điều tra Công an cấp tỉnh quy định tại khoản 1 Điều này nhưng xét thấy cần trực tiếp điều tra.
1. Tổ chức của Cơ quan điều tra hình sự Bộ Quốc phòng gồm có các phòng điều tra, phòng nghiệp vụ và bộ máy giúp việc Cơ quan điều tra hình sự.
2. Tổ chức của Cơ quan điều tra hình sự quân khu và tương đương gồm có Ban điều tra và bộ máy giúp việc Cơ quan điều tra hình sự.
3. Tổ chức của Cơ quan điều tra hình sự khu vực gồm có bộ phận điều tra và bộ máy giúp việc Cơ quan điều tra hình sự.
4. Căn cứ vào nhiệm vụ và tổ chức của Quân đội trong từng thời kỳ, Chính phủ trình Uỷ ban thường vụ Quốc hội quyết định việc thành lập hoặc giải thể Cơ quan điều tra hình sự quân khu và tương đương, Cơ quan điều tra hình sự khu vực.
1. Tổ chức của Cơ quan An ninh điều tra Bộ Quốc phòng gồm có các phòng điều tra, phòng nghiệp vụ và bộ máy giúp việc Cơ quan An ninh điều tra.
2. Tổ chức của Cơ quan An ninh điều tra quân khu và tương đương gồm có Ban điều tra và bộ máy giúp việc Cơ quan An ninh điều tra.
3. Căn cứ vào nhiệm vụ và tổ chức của Quân đội trong từng thời kỳ, Chính phủ trình Uỷ ban thường vụ Quốc hội quyết định việc thành lập hoặc giải thể Cơ quan An ninh điều tra quân khu và tương đương.
1. Cơ quan điều tra hình sự khu vực điều tra các vụ án hình sự về các tội phạm quy định tại các chương từ Chương XII đến Chương XXIII của Bộ luật hình sự khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án quân sự khu vực, trừ các tội phạm thuộc thẩm quyền điều tra của Cơ quan điều tra Viện kiểm sát quân sự trung ương.
2. Cơ quan điều tra hình sự quân khu và tương đương điều tra các vụ án hình sự về các tội phạm quy định tại khoản 1 Điều này khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án quân sự quân khu và tương đương hoặc các tội phạm thuộc thẩm quyền điều tra của Cơ quan điều tra hình sự khu vực nhưng xét thấy cần trực tiếp điều tra.
3. Cơ quan điều tra hình sự Bộ Quốc phòng điều tra các vụ án hình sự về những tội phạm đặc biệt nghiêm trọng, phức tạp thuộc thẩm quyền điều tra của Cơ quan điều tra hình sự quân khu và tương đương nhưng xét thấy cần trực tiếp điều tra.
1. Cơ quan An ninh điều tra quân khu và tương đương điều tra các vụ án hình sự về các tội phạm quy định tại Chương XI và Chương XXIV của Bộ luật hình sự khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án quân sự quân khu và tương đương.
2. Cơ quan An ninh điều tra Bộ Quốc phòng điều tra các vụ án hình sự về những tội phạm đặc biệt nghiêm trọng, phức tạp thuộc thẩm quyền điều tra của Cơ quan An ninh điều tra quân khu và tương đương nhưng xét thấy cần trực tiếp điều tra.
1. Tổ chức của Cơ quan điều tra Viện kiểm sát nhân dân tối cao gồm có các phòng điều tra và bộ máy giúp việc Cơ quan điều tra.
2. Tổ chức của Cơ quan điều tra Viện kiểm sát quân sự trung ương gồm có bộ phận điều tra và bộ máy giúp việc Cơ quan điều tra.
1. Cơ quan điều tra Viện kiểm sát nhân dân tối cao điều tra các vụ án hình sự về một số loại tội xâm phạm hoạt động tư pháp mà người phạm tội là cán bộ thuộc các cơ quan tư pháp khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án nhân dân.
2. Cơ quan điều tra Viện kiểm sát quân sự trung ương điều tra các vụ án hình sự về các tội phạm quy định tại khoản 1 Điều này khi các tội phạm đó thuộc thẩm quyền xét xử của Toà án quân sự.
1. Bộ đội biên phòng khi thực hiện nhiệm vụ trong lĩnh vực quản lý của mình mà phát hiện tội phạm quy định tại Chương XI và các điều 119, 120, 153, 154, 172, 180, 181, 188, 192, 193, 194, 195, 196, 230, 232, 236, 263, 264, 273, 274 và 275 của Bộ luật hình sự xảy ra trong khu vực biên giới trên đất liền, bờ biển, hải đảo và trên các vùng biển do Bộ đội biên phòng quản lý thì Cục trưởng Cục trinh sát biên phòng, Chỉ huy trưởng Bộ đội biên phòng tỉnh, thành phố trực thuộc trung ương, Trưởng đồn biên phòng có quyền:
a) Đối với tội phạm ít nghiêm trọng trong trường hợp phạm tội quả tang, chứng cứ và lai lịch người phạm tội rõ ràng thì ra quyết định khởi tố vụ án, khám nghiệm hiện trường, khám xét, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, trưng cầu giám định khi cần thiết, khởi tố bị can, tiến hành các biện pháp điều tra khác theo quy định của Bộ luật tố tụng hình sự, kết thúc điều tra và chuyển hồ sơ vụ án cho Viện kiểm sát có thẩm quyền trong thời hạn hai mươi ngày, kể từ ngày ra quyết định khởi tố vụ án;
b) Đối với tội phạm nghiêm trọng, rất nghiêm trọng, đặc biệt nghiêm trọng hoặc tội phạm ít nghiêm trọng nhưng phức tạp thì ra quyết định khởi tố vụ án, khám nghiệm hiện trường, khám xét, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án; khi xét thấy cần ngăn chặn ngay người có hành vi phạm tội chạy trốn, tiêu hủy chứng cứ hoặc tiếp tục thực hiện tội phạm thì giải ngay người đó đến cơ quan Công an và xin ngay lệnh bắt khẩn cấp của cơ quan có thẩm quyền; chuyển hồ sơ vụ án cho Cơ quan điều tra có thẩm quyền trong thời hạn bảy ngày, kể từ ngày ra quyết định khởi tố vụ án;
c) áp dụng biện pháp ngăn chặn theo quy định của Bộ luật tố tụng hình sự.
2. Cục trưởng Cục trinh sát biên phòng, Chỉ huy trưởng Bộ đội biên phòng tỉnh, thành phố trực thuộc trung ương, Trưởng đồn biên phòng trực tiếp tổ chức và chỉ đạo các hoạt động điều tra, quyết định phân công hoặc thay đổi cấp phó trong việc điều tra vụ án hình sự, kiểm tra các hoạt động điều tra, quyết định thay đổi hoặc huỷ bỏ các quyết định không có căn cứ và trái pháp luật của cấp phó, giải quyết tố cáo theo quy định của Bộ luật tố tụng hình sự.
Khi Cục trưởng Cục trinh sát biên phòng, Chỉ huy trưởng Bộ đội biên phòng tỉnh, thành phố trực thuộc trung ương, Trưởng đồn biên phòng vắng mặt thì một cấp phó được uỷ nhiệm thực hiện các quyền hạn của cấp trưởng quy định tại khoản này và phải chịu trách nhiệm trước cấp trưởng về nhiệm vụ được giao.
3. Khi được phân công điều tra vụ án hình sự, Phó Cục trưởng Cục trinh sát biên phòng, Phó Chỉ huy trưởng Bộ đội biên phòng tỉnh, thành phố trực thuộc trung ương, Phó Trưởng đồn biên phòng có quyền áp dụng các biện pháp điều tra quy định tại khoản 1 Điều này.
4. Cục trưởng, Phó Cục trưởng Cục trinh sát biên phòng, Chỉ huy trưởng, Phó Chỉ huy trưởng Bộ đội biên phòng tỉnh, thành phố trực thuộc trung ương, Trưởng đồn, Phó Trưởng đồn biên phòng phải chịu trách nhiệm trước pháp luật về những hành vi và quyết định của mình.
1. Cơ quan Hải quan khi thực hiện nhiệm vụ trong lĩnh vực quản lý của mình mà phát hiện tội phạm quy định tại Điều 153 và Điều 154 của Bộ luật hình sự thì Cục trưởng Cục điều tra chống buôn lậu, Cục trưởng Cục kiểm tra sau thông quan, Cục trưởng Cục Hải quan tỉnh, liên tỉnh, thành phố trực thuộc trung ương, Chi cục trưởng Chi cục Hải quan cửa khẩu có quyền:
a) Đối với tội phạm ít nghiêm trọng trong trường hợp phạm tội quả tang, chứng cứ và lai lịch người phạm tội rõ ràng thì ra quyết định khởi tố vụ án, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, khám người, khám nơi oa trữ trong khu vực kiểm soát của Hải quan, trưng cầu giám định khi cần thiết, khởi tố bị can, tiến hành các biện pháp điều tra khác theo quy định của Bộ luật tố tụng hình sự, kết thúc điều tra và chuyển hồ sơ vụ án cho Viện kiểm sát có thẩm quyền trong thời hạn hai mươi ngày, kể từ ngày ra quyết định khởi tố vụ án;
b) Đối với tội phạm nghiêm trọng, rất nghiêm trọng, đặc biệt nghiêm trọng hoặc tội phạm ít nghiêm trọng nhưng phức tạp thì ra quyết định khởi tố vụ án, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, khám người, khám nơi oa trữ trong khu vực kiểm soát của Hải quan, chuyển hồ sơ vụ án cho Cơ quan điều tra có thẩm quyền trong thời hạn bảy ngày, kể từ ngày ra quyết định khởi tố vụ án.
2. Cục trưởng Cục điều tra chống buôn lậu, Cục trưởng Cục kiểm tra sau thông quan, Cục trưởng Cục Hải quan tỉnh, liên tỉnh, thành phố trực thuộc trung ương, Chi cục trưởng Chi cục Hải quan cửa khẩu trực tiếp tổ chức và chỉ đạo các hoạt động điều tra, quyết định phân công hoặc thay đổi cấp phó trong việc điều tra vụ án hình sự, kiểm tra các hoạt động điều tra, quyết định thay đổi hoặc huỷ bỏ các quyết định không có căn cứ và trái pháp luật của cấp phó, giải quyết tố cáo theo quy định của Bộ luật tố tụng hình sự.
Khi Cục trưởng Cục điều tra chống buôn lậu, Cục trưởng Cục kiểm tra sau thông quan, Cục trưởng Cục Hải quan tỉnh, liên tỉnh, thành phố trực thuộc trung ương, Chi cục trưởng Chi cục Hải quan cửa khẩu vắng mặt thì một cấp phó được uỷ nhiệm thực hiện các quyền hạn của cấp trưởng quy định tại khoản này và phải chịu trách nhiệm trước cấp trưởng về nhiệm vụ được giao.
3. Khi được phân công điều tra vụ án hình sự, Phó Cục trưởng Cục điều tra chống buôn lậu, Phó Cục trưởng Cục kiểm tra sau thông quan, Phó Cục trưởng Cục Hải quan tỉnh, liên tỉnh, thành phố trực thuộc trung ương, Phó Chi cục trưởng Chi cục Hải quan cửa khẩu có quyền áp dụng các biện pháp điều tra quy định tại khoản 1 Điều này.
4. Cục trưởng, Phó Cục trưởng Cục điều tra chống buôn lậu, Cục trưởng, Phó Cục trưởng Cục kiểm tra sau thông quan, Cục trưởng, Phó Cục trưởng Cục Hải quan tỉnh, liên tỉnh, thành phố trực thuộc trung ương, Chi cục trưởng, Phó Chi cục trưởng Chi cục Hải quan cửa khẩu phải chịu trách nhiệm trước pháp luật về những hành vi và quyết định của mình.
1. Cơ quan Kiểm lâm khi thực hiện nhiệm vụ trong lĩnh vực quản lý của mình mà phát hiện tội phạm quy định tại các điều 175, 189, 190, 191, 240 và 272 của Bộ luật hình sự thì Cục trưởng Cục Kiểm lâm, Chi cục trưởng Chi cục Kiểm lâm, Hạt trưởng Hạt Kiểm lâm, Hạt trưởng Hạt phúc kiểm lâm sản có quyền:
a) Đối với tội phạm ít nghiêm trọng trong trường hợp phạm tội quả tang, chứng cứ và lai lịch người phạm tội rõ ràng thì ra quyết định khởi tố vụ án, khám nghiệm hiện trường, khám xét, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, trưng cầu giám định khi cần thiết, khởi tố bị can, tiến hành các biện pháp điều tra khác theo quy định của Bộ luật tố tụng hình sự, kết thúc điều tra và chuyển hồ sơ vụ án cho Viện kiểm sát có thẩm quyền trong thời hạn hai mươi ngày, kể từ ngày ra quyết định khởi tố vụ án;
b) Đối với tội phạm nghiêm trọng, rất nghiêm trọng, đặc biệt nghiêm trọng hoặc tội phạm ít nghiêm trọng nhưng phức tạp thì ra quyết định khởi tố vụ án, khám nghiệm hiện trường, khám xét, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, chuyển hồ sơ vụ án cho Cơ quan điều tra có thẩm quyền trong thời hạn bảy ngày, kể từ ngày ra quyết định khởi tố vụ án.
2. Cục trưởng Cục Kiểm lâm, Chi cục trưởng Chi cục Kiểm lâm, Hạt trưởng Hạt Kiểm lâm, Hạt trưởng Hạt phúc kiểm lâm sản trực tiếp tổ chức và chỉ đạo các hoạt động điều tra, quyết định phân công hoặc thay đổi cấp phó trong việc điều tra vụ án hình sự, kiểm tra các hoạt động điều tra, quyết định thay đổi hoặc huỷ bỏ các quyết định không có căn cứ và trái pháp luật của cấp phó, giải quyết tố cáo theo quy định của Bộ luật tố tụng hình sự.
Khi Cục trưởng Cục Kiểm lâm, Chi cục trưởng Chi cục Kiểm lâm, Hạt trưởng Hạt Kiểm lâm, Hạt trưởng Hạt phúc kiểm lâm sản vắng mặt thì một cấp phó được uỷ nhiệm thực hiện các quyền hạn của cấp trưởng quy định tại khoản này và phải chịu trách nhiệm trước cấp trưởng về nhiệm vụ được giao.
3. Khi được phân công điều tra vụ án hình sự, Phó Cục trưởng Cục Kiểm lâm, Phó Chi Cục trưởng Chi cục Kiểm lâm, Phó Hạt trưởng Hạt phúc kiểm lâm sản có quyền áp dụng các biện pháp điều tra quy định tại khoản 1 Điều này.
4. Cục trưởng, Phó Cục trưởng Cục Kiểm lâm, Chi cục trưởng, Phó Chi Cục trưởng Chi cục Kiểm lâm, Hạt trưởng, Phó Hạt trưởng Hạt Kiểm lâm, Hạt trưởng, Phó Hạt trưởng Hạt phúc kiểm lâm sản phải chịu trách nhiệm trước pháp luật về những hành vi và quyết định của mình.
1. Các đơn vị thuộc lực lượng Cảnh sát biển khi thực hiện nhiệm vụ trong lĩnh vực quản lý của mình mà phát hiện tội phạm quy định tại Chương XI và các điều 153, 154, 172, 183, 188, 194, 195, 196, 212, 213, 221, 223, 230, 231, 232, 236, 238, 273 và 274 của Bộ luật hình sự xảy ra trên các vùng biển và thềm lục địa của nước Cộng hoà xã hội chủ nghĩa Việt Nam do lực lượng Cảnh sát biển quản lý thì Cục trưởng, Chỉ huy trưởng Vùng, Hải đoàn trưởng, Hải đội trưởng và Đội trưởng Cảnh sát biển có quyền:
a) Đối với tội phạm ít nghiêm trọng trong trường hợp phạm tội quả tang, chứng cứ và lai lịch người phạm tội rõ ràng thì ra quyết định khởi tố vụ án, khám nghiệm hiện trường, khám xét, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, trưng cầu giám định khi cần thiết, khởi tố bị can, tiến hành các biện pháp điều tra khác theo quy định của Bộ luật tố tụng hình sự, kết thúc điều tra và chuyển hồ sơ vụ án cho Viện kiểm sát có thẩm quyền trong thời hạn hai mươi ngày, kể từ ngày ra quyết định khởi tố vụ án;
b) Đối với tội phạm nghiêm trọng, rất nghiêm trọng, đặc biệt nghiêm trọng hoặc tội phạm ít nghiêm trọng nhưng phức tạp thì ra quyết định khởi tố vụ án, tiến hành khám nghiệm hiện trường, khám xét, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, chuyển hồ sơ vụ án cho Cơ quan điều tra có thẩm quyền trong thời hạn bảy ngày, kể từ ngày ra quyết định khởi tố vụ án;
c) áp dụng biện pháp ngăn chặn theo quy định của Bộ luật tố tụng hình sự.
2. Cục trưởng, Chỉ huy trưởng Vùng, Hải đoàn trưởng, Hải đội trưởng và Đội trưởng Cảnh sát biển trực tiếp tổ chức, chỉ đạo các hoạt động điều tra, quyết định phân công hoặc thay đổi cấp phó trong việc điều tra vụ án hình sự, kiểm tra các hoạt động điều tra, quyết định thay đổi hoặc huỷ bỏ các quyết định không có căn cứ và trái pháp luật của cấp phó, giải quyết tố cáo theo quy định của Bộ luật tố tụng hình sự.
Khi Cục trưởng, Chỉ huy trưởng Vùng, Hải đoàn trưởng, Hải đội trưởng và Đội trưởng Cảnh sát biển vắng mặt thì một cấp phó được uỷ nhiệm thực hiện các quyền hạn của cấp trưởng quy định tại khoản này và phải chịu trách nhiệm trước cấp trưởng về nhiệm vụ được giao.
3. Khi được phân công điều tra vụ án hình sự, Phó Cục trưởng, Phó Chỉ huy trưởng Vùng, Phó Hải đoàn trưởng, Phó Hải đội trưởng và Phó Đội trưởng Cảnh sát biển có quyền áp dụng các biện pháp điều tra quy định tại khoản 1 Điều này.
4. Cục trưởng, Phó Cục trưởng, Chỉ huy trưởng Vùng, Phó Chỉ huy trưởng Vùng, Hải đoàn trưởng, Phó Hải đoàn trưởng, Hải đội trưởng, Phó Hải đội trưởng, Đội trưởng và Phó Đội trưởng Cảnh sát biển phải chịu trách nhiệm trước pháp luật về những hành vi và quyết định của mình.
1. Cục Cảnh sát giao thông đường bộ - đường sắt, Cục Cảnh sát giao thông đường thuỷ, Cục Cảnh sát phòng cháy, chữa cháy, Cục Cảnh sát quản lý hành chính về trật tự xã hội, Cục Cảnh sát bảo vệ và hỗ trợ tư pháp, Phòng Cảnh sát giao thông đường bộ - đường sắt, Phòng Cảnh sát giao thông đường thuỷ, Phòng Cảnh sát phòng cháy, chữa cháy, Phòng Cảnh sát quản lý hành chính về trật tự xã hội, Phòng Cảnh sát bảo vệ và hỗ trợ tư pháp, Trại tạm giam, Trại giam trong khi làm nhiệm vụ của mình mà phát hiện sự việc có dấu hiệu tội phạm thuộc thẩm quyền điều tra của Cơ quan Cảnh sát điều tra quy định tại Điều 11 của Pháp lệnh này thì Cục trưởng Cục Cảnh sát giao thông đường bộ - đường sắt, Cục trưởng Cục Cảnh sát giao thông đường thuỷ, Cục trưởng Cục Cảnh sát phòng cháy, chữa cháy, Cục trưởng Cục Cảnh sát quản lý hành chính về trật tự xã hội, Cục trưởng Cục Cảnh sát bảo vệ và hỗ trợ tư pháp, Trưởng Phòng Cảnh sát giao thông đường bộ - đường sắt, Trưởng Phòng Cảnh sát giao thông đường thuỷ, Trưởng Phòng Cảnh sát phòng cháy, chữa cháy, Trưởng Phòng Cảnh sát quản lý hành chính về trật tự xã hội, Trưởng Phòng Cảnh sát bảo vệ và hỗ trợ tư pháp, Giám thị trại tạm giam, Giám thị trại giam ra quyết định khởi tố vụ án, lấy lời khai, khám nghiệm hiện trường, khám xét, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, chuyển hồ sơ vụ án cho Cơ quan Cảnh sát điều tra có thẩm quyền trong thời hạn bảy ngày, kể từ ngày ra quyết định khởi tố vụ án.
2. Cục trưởng, Trưởng phòng quy định tại khoản 1 Điều này, Giám thị trại tạm giam, Giám thị trại giam trực tiếp tổ chức và chỉ đạo các hoạt động điều tra, quyết định phân công hoặc thay đổi cấp phó trong việc điều tra vụ án hình sự, kiểm tra các hoạt động điều tra, quyết định thay đổi hoặc huỷ bỏ các quyết định không có căn cứ và trái pháp luật của cấp phó, giải quyết tố cáo theo quy định của Bộ luật tố tụng hình sự.
Khi Cục trưởng, Trưởng phòng, Giám thị trại tạm giam, Giám thị trại giam vắng mặt thì một cấp phó được uỷ nhiệm thực hiện các quyền hạn của cấp trưởng quy định tại khoản này và phải chịu trách nhiệm trước cấp trưởng về nhiệm vụ được giao.
3. Khi được phân công điều tra vụ án hình sự, Phó Cục trưởng, Phó Trưởng phòng, Phó Giám thị trại tạm giam, Phó Giám thị trại giam có quyền áp dụng các biện pháp điều tra quy định tại khoản 1 Điều này.
4. Cục trưởng, Phó Cục trưởng, Trưởng phòng, Phó Trưởng phòng, Giám thị, Phó Giám thị trại tạm giam, Giám thị, Phó Giám thị trại giam phải chịu trách nhiệm trước pháp luật về những hành vi và quyết định của mình.
1. Các cục An ninh, các phòng An ninh ở Công an cấp tỉnh trực tiếp đấu tranh phòng, chống các tội phạm quy định tại Điều 12 của Pháp lệnh này, trong khi làm nhiệm vụ của mình mà phát hiện sự việc có dấu hiệu tội phạm thì Cục trưởng, Trưởng phòng các phòng An ninh ở Công an cấp tỉnh ra quyết định khởi tố vụ án, lấy lời khai, khám nghiệm hiện trường, khám xét, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án; khi xét cần ngăn chặn ngay người có hành vi phạm tội chạy trốn, tiêu huỷ chứng cứ hoặc tiếp tục thực hiện tội phạm thì giải ngay người đó đến cơ quan Công an và xin ngay lệnh bắt khẩn cấp của cơ quan có thẩm quyền; trong thời hạn bảy ngày, kể từ ngày ra quyết định khởi tố vụ án phải chuyển hồ sơ vụ án cho Cơ quan An ninh điều tra có thẩm quyền.
Đội An ninh ở Công an cấp huyện trong khi làm nhiệm vụ của mình mà phát hiện sự việc có dấu hiệu tội phạm thuộc thẩm quyền điều tra của Cơ quan An ninh điều tra Công an cấp tỉnh thì tiến hành ngay việc truy bắt người có hành vi phạm tội chạy trốn, lấy lời khai, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án và báo ngay cho Cơ quan An ninh điều tra cấp tỉnh.
2. Cục trưởng, Trưởng phòng quy định tại khoản 1 Điều này trực tiếp tổ chức và chỉ đạo các hoạt động điều tra, quyết định phân công hoặc thay đổi cấp phó trong việc điều tra vụ án hình sự, kiểm tra các hoạt động điều tra, quyết định thay đổi hoặc huỷ bỏ các quyết định không có căn cứ và trái pháp luật của cấp phó, giải quyết tố cáo theo quy định của Bộ luật tố tụng hình sự.
Khi Cục trưởng, Trưởng phòng An ninh ở Công an cấp tỉnh vắng mặt thì một cấp phó được ủy nhiệm thực hiện các quyền hạn của cấp trưởng quy định tại khoản này và phải chịu trách nhiệm trước cấp trưởng về nhiệm vụ được giao.
3. Khi được phân công điều tra vụ án hình sự, Phó Cục trưởng, Phó Trưởng phòng An ninh ở Công an cấp tỉnh có quyền áp dụng các biện pháp điều tra quy định tại khoản 1 Điều này.
4. Cục trưởng, Phó Cục trưởng, Trưởng phòng, Phó Trưởng phòng An ninh ở Công an cấp tỉnh phải chịu trách nhiệm trước pháp luật về những hành vi và quyết định của mình.
1. Giám thị trại tạm giam, Giám thị trại giam trong khi làm nhiệm vụ của mình mà phát hiện sự việc có dấu hiệu tội phạm thuộc thẩm quyền điều tra của Cơ quan điều tra hình sự đến mức phải truy cứu trách nhiệm hình sự thì ra quyết định khởi tố vụ án, khám nghiệm hiện trường, lấy lời khai, khám xét, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan trực tiếp đến vụ án, chuyển hồ sơ vụ án cho Cơ quan điều tra hình sự có thẩm quyền trong thời hạn bảy ngày, kể từ ngày ra quyết định khởi tố vụ án.
Khi Giám thị trại tạm giam, Giám thị trại giam vắng mặt thì một cấp phó được ủy nhiệm thực hiện các quyền hạn của cấp trưởng quy định tại khoản này và phải chịu trách nhiệm trước cấp trưởng về nhiệm vụ được giao.
2. Thủ trưởng đơn vị độc lập cấp trung đoàn và tương đương khi phát hiện những hành vi phạm tội thuộc thẩm quyền điều tra của Cơ quan điều tra trong Quân đội nhân dân, xảy ra trong khu vực đóng quân của đơn vị thì có quyền lập biên bản phạm tội quả tang, lấy lời khai, khám xét, thu giữ, tạm giữ và bảo quản vật chứng, tài liệu liên quan đến vụ án, áp dụng biện pháp ngăn chặn theo quy định của Bộ luật tố tụng hình sự, chuyển ngay hồ sơ cho Cơ quan điều tra có thẩm quyền.
3. Giám thị trại tạm giam, Giám thị trại giam, Thủ trưởng đơn vị độc lập cấp trung đoàn và tương đương phải chịu trách nhiệm trước pháp luật về những hành vi và quyết định của mình.
1. Quan hệ giữa các Cơ quan điều tra với nhau, giữa Cơ quan điều tra với cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra, giữa các cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra với nhau là quan hệ phân công và phối hợp trong hoạt động điều tra.
Các yêu cầu bằng văn bản của Cơ quan điều tra phải được cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra nghiêm chỉnh thực hiện.
2. Đối với sự việc có dấu hiệu phạm tội mà chưa xác định rõ thẩm quyền điều tra thì Cơ quan điều tra nào phát hiện trước phải áp dụng ngay các biện pháp điều tra theo quy định của Bộ luật tố tụng hình sự; khi đã xác định được thẩm quyền điều tra thì chuyển vụ án cho Cơ quan điều tra có thẩm quyền theo quy định của Bộ luật tố tụng hình sự.
3. Cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra, sau khi khởi tố vụ án, áp dụng biện pháp ngăn chặn theo thẩm quyền phải gửi ngay các quyết định đó cho Viện kiểm sát và thông báo cho Cơ quan điều tra có thẩm quyền biết.
4. Các đơn vị Cảnh sát nhân dân, An ninh nhân dân, Kiểm soát quân sự có trách nhiệm hỗ trợ và thực hiện các yêu cầu của Thủ trưởng, Phó Thủ trưởng Cơ quan điều tra, Điều tra viên và của Thủ trưởng, Phó Thủ trưởng cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra trong hoạt động điều tra.
Khi cần thiết, Cơ quan điều tra có thể uỷ thác cho Cơ quan điều tra khác tiến hành một số hoạt động điều tra. Quyết định uỷ thác phải ghi rõ yêu cầu cụ thể. Cơ quan điều tra được uỷ thác có trách nhiệm thực hiện đầy đủ những việc được uỷ thác theo thời hạn mà Cơ quan điều tra uỷ thác yêu cầu.
Trong trường hợp Cơ quan điều tra được uỷ thác không thể thực hiện được từng phần hoặc toàn bộ những việc uỷ thác thì phải thông báo ngay bằng văn bản và nêu rõ lý do cho Cơ quan điều tra đã uỷ thác biết.
1. Khi có tranh chấp về thẩm quyền điều tra giữa các Cơ quan điều tra thì Viện trưởng Viện kiểm sát nhân dân cùng cấp nơi tội phạm xảy ra hoặc nơi phát hiện tội phạm quyết định.
2. Khi có tranh chấp về thẩm quyền điều tra giữa Bộ đội biên phòng, Hải quan, Kiểm lâm, lực lượng Cảnh sát biển thì Viện trưởng Viện kiểm sát có thẩm quyền nơi xảy ra vụ án quyết định.
Trong trường hợp cần thiết, Cơ quan điều tra có thẩm quyền có quyền yêu cầu cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra chuyển ngay hồ sơ vụ án để trực tiếp điều tra. Các yêu cầu của Cơ quan điều tra có giá trị bắt buộc thi hành đối với cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra.
1. Công dân Việt Nam trung thành với Tổ quốc và Hiến pháp nước Cộng hoà xã hội chủ nghĩa Việt Nam, có phẩm chất đạo đức tốt, liêm khiết và trung thực, có trình độ đại học an ninh, đại học cảnh sát hoặc đại học luật, có chứng chỉ nghiệp vụ điều tra, có thời gian làm công tác thực tiễn theo quy định của Pháp lệnh này, có sức khỏe bảo đảm hoàn thành nhiệm vụ được giao thì có thể được bổ nhiệm làm Điều tra viên.
Trong trường hợp do nhu cầu cán bộ, người có trình độ đại học các ngành khác có đủ các tiêu chuẩn nói trên và có chứng chỉ nghiệp vụ điều tra thì cũng có thể được bổ nhiệm làm Điều tra viên.
2. Điều tra viên có ba bậc là Điều tra viên sơ cấp, Điều tra viên trung cấp và Điều tra viên cao cấp:
a) Người có đủ tiêu chuẩn quy định tại khoản 1 Điều này, có thời gian làm công tác pháp luật từ bốn năm trở lên, là sỹ quan Công an, sỹ quan Quân đội tại ngũ, cán bộ Viện kiểm sát nhân dân, có khả năng điều tra các vụ án thuộc loại tội phạm ít nghiêm trọng, nghiêm trọng thì có thể được bổ nhiệm làm Điều tra viên sơ cấp;
b) Người có đủ tiêu chuẩn quy định tại khoản 1 Điều này và đã là Điều tra viên sơ cấp ít nhất là năm năm, có khả năng điều tra các vụ án thuộc loại tội phạm rất nghiêm trọng, đặc biệt nghiêm trọng và có khả năng hướng dẫn các hoạt động điều tra của Điều tra viên sơ cấp thì có thể được bổ nhiệm làm Điều tra viên trung cấp.
Trong trường hợp do nhu cầu cán bộ, người có đủ tiêu chuẩn quy định tại khoản 1 Điều này, có thời gian làm công tác pháp luật từ chín năm trở lên, có khả năng điều tra các vụ án thuộc loại tội phạm rất nghiêm trọng, đặc biệt nghiêm trọng và có khả năng hướng dẫn các hoạt động điều tra của Điều tra viên sơ cấp thì có thể được bổ nhiệm làm Điều tra viên trung cấp;
c) Người có đủ tiêu chuẩn quy định tại khoản 1 Điều này và đã là Điều tra viên trung cấp ít nhất là năm năm, có khả năng nghiên cứu, tổng hợp đề xuất biện pháp phòng, chống tội phạm, có khả năng điều tra các vụ án thuộc loại tội phạm rất nghiêm trọng, đặc biệt nghiêm trọng, phức tạp, có khả năng hướng dẫn các hoạt động điều tra của Điều tra viên sơ cấp, Điều tra viên trung cấp thì có thể được bổ nhiệm làm Điều tra viên cao cấp.
Trong trường hợp do nhu cầu cán bộ, người có đủ tiêu chuẩn quy định tại khoản 1 Điều này và đã có thời gian làm công tác pháp luật từ mười bốn năm trở lên, có khả năng nghiên cứu, tổng hợp đề xuất biện pháp phòng, chống tội phạm, có khả năng điều tra các vụ án thuộc loại tội phạm rất nghiêm trọng, đặc biệt nghiêm trọng, phức tạp, có khả năng hướng dẫn các hoạt động điều tra của Điều tra viên sơ cấp, Điều tra viên trung cấp thì có thể được bổ nhiệm làm Điều tra viên cao cấp.
3. Trong trường hợp đặc biệt, người được cơ quan, tổ chức có thẩm quyền điều động đến công tác tại Cơ quan điều tra, tuy chưa có chứng chỉ nghiệp vụ điều tra, chưa đủ thời gian quy định tại điểm b hoặc điểm c khoản 2 Điều này, nhưng có đủ các tiêu chuẩn khác được quy định tại khoản 1, điểm b hoặc điểm c khoản 2 Điều này thì cũng có thể được bổ nhiệm làm Điều tra viên trung cấp hoặc Điều tra viên cao cấp.
4. Nhiệm kỳ của Điều tra viên là năm năm kể từ ngày được bổ nhiệm.
1. Hội đồng tuyển chọn Điều tra viên cao cấp, Điều tra viên trung cấp và Điều tra viên sơ cấp trong Công an nhân dân:
a) Hội đồng tuyển chọn Điều tra viên cao cấp trong Công an nhân dân và Điều tra viên trung cấp, Điều tra viên sơ cấp ở các Cơ quan điều tra Bộ Công an gồm có Tổng cục trưởng Tổng cục Xây dựng lực lượng Công an nhân dân làm Chủ tịch, đại diện lãnh đạo Cơ quan Cảnh sát điều tra, Cơ quan An ninh điều tra, Cục tổ chức - cán bộ và Vụ pháp chế Bộ Công an là uỷ viên;
b) Hội đồng tuyển chọn Điều tra viên trung cấp, Điều tra viên sơ cấp ở các Cơ quan điều tra Công an cấp tỉnh và Cơ quan Cảnh sát điều tra Công an cấp huyện gồm có Giám đốc Công an cấp tỉnh làm Chủ tịch, đại diện lãnh đạo Cơ quan Cảnh sát điều tra, Cơ quan An ninh điều tra, Phòng tổ chức - cán bộ và Văn phòng Công an cấp tỉnh là uỷ viên;
c) Danh sách uỷ viên Hội đồng tuyển chọn Điều tra viên trong Công an nhân dân do Bộ trưởng Bộ Công an quyết định theo đề nghị của Chủ tịch Hội đồng tuyển chọn.
2. Hội đồng tuyển chọn Điều tra viên trong Quân đội nhân dân gồm có Chủ nhiệm Tổng cục Chính trị làm Chủ tịch, đại diện lãnh đạo Cơ quan điều tra hình sự, Cơ quan An ninh điều tra, Cục cán bộ và Vụ pháp chế Bộ Quốc phòng là uỷ viên.
Danh sách uỷ viên Hội đồng tuyển chọn Điều tra viên trong Quân đội nhân dân do Bộ trưởng Bộ Quốc phòng quyết định theo đề nghị của Chủ tịch Hội đồng tuyển chọn.
3. Hội đồng tuyển chọn Điều tra viên ở Viện kiểm sát nhân dân tối cao do một Phó Viện trưởng Viện kiểm sát nhân dân tối cao làm Chủ tịch, đại diện Uỷ ban kiểm sát Viện kiểm sát nhân dân tối cao, đại diện lãnh đạo Viện kiểm sát quân sự trung ương, Cơ quan điều tra và Vụ tổ chức - cán bộ Viện kiểm sát nhân dân tối cao là uỷ viên.
Viện trưởng Viện kiểm sát nhân dân tối cao chỉ định một Phó Viện trưởng Viện kiểm sát nhân dân tối cao làm Chủ tịch Hội đồng tuyển chọn. Danh sách uỷ viên Hội đồng tuyển chọn Điều tra viên ở Viện kiểm sát nhân dân tối cao do Viện trưởng Viện kiểm sát nhân dân tối cao quyết định theo đề nghị của Chủ tịch Hội đồng tuyển chọn.
Hội đồng tuyển chọn Điều tra viên có những nhiệm vụ, quyền hạn sau đây:
1. Tuyển chọn người đủ tiêu chuẩn làm Điều tra viên theo đề nghị của cơ quan về công tác tổ chức - cán bộ để Chủ tịch Hội đồng đề nghị Bộ trưởng Bộ Công an, Bộ trưởng Bộ Quốc phòng, Viện trưởng Viện kiểm sát nhân dân tối cao bổ nhiệm;
2. Xem xét những trường hợp Điều tra viên có thể được miễn nhiệm hoặc có thể bị cách chức theo quy định tại Điều 34 của Pháp lệnh này để Chủ tịch Hội đồng đề nghị Bộ trưởng Bộ Công an, Bộ trưởng Bộ Quốc phòng, Viện trưởng Viện kiểm sát nhân dân tối cao miễn nhiệm hoặc cách chức chức danh Điều tra viên.
Điều tra viên không được làm những việc sau đây:
1. Những việc mà pháp luật quy định cán bộ, công chức hoặc cán bộ, chiến sĩ lực lượng vũ trang nhân dân không được làm;
2. Tư vấn cho bị can, bị cáo, đương sự hoặc người tham gia tố tụng khác làm cho việc giải quyết vụ án không đúng quy định của pháp luật;
3. Can thiệp trái pháp luật vào việc giải quyết các vụ án hoặc lợi dụng ảnh hưởng của mình tác động đến người có trách nhiệm giải quyết vụ án;
4. Đem hồ sơ vụ án hoặc tài liệu trong hồ sơ vụ án ra khỏi cơ quan, nếu không vì nhiệm vụ được giao hoặc không được sự đồng ý của người có thẩm quyền;
5. Tiếp bị can, bị cáo, đương sự hoặc người tham gia tố tụng khác trong vụ án mà mình có thẩm quyền giải quyết ngoài nơi quy định.
1. Việc bổ nhiệm, miễn nhiệm, cách chức và cấp, thu hồi giấy chứng nhận Điều tra viên trong Công an nhân dân do Bộ trưởng Bộ Công an quyết định, trong Quân đội nhân dân do Bộ trưởng Bộ Quốc phòng quyết định, ở Viện kiểm sát nhân dân tối cao do Viện trưởng Viện kiểm sát nhân dân tối cao quyết định.
2. Điều tra viên đương nhiên được miễn nhiệm chức danh Điều tra viên khi nghỉ hưu, chuyển công tác khác.
Điều tra viên có thể được miễn nhiệm chức danh Điều tra viên vì lý do sức khoẻ, hoàn cảnh gia đình hoặc vì lý do khác mà xét thấy không thể bảo đảm hoàn thành nhiệm vụ được giao.
3. Điều tra viên đương nhiên bị mất chức danh Điều tra viên khi bị kết tội bằng bản án của Toà án đã có hiệu lực pháp luật hoặc bị kỷ luật bằng hình thức tước danh hiệu Công an nhân dân, tước quân hàm sỹ quan Quân đội nhân dân.
4. Tuỳ theo tính chất và mức độ vi phạm, Điều tra viên có thể bị cách chức chức danh Điều tra viên khi thuộc một trong các trường hợp sau đây:
a) Vi phạm trong công tác điều tra vụ án hình sự;
b) Vi phạm quy định tại Điều 33 của Pháp lệnh này;
c) Bị kỷ luật bằng hình thức cách chức chức vụ quản lý đang đảm nhiệm theo quy định của pháp luật về cán bộ, công chức;
d) Vi phạm về phẩm chất đạo đức;
đ) Có hành vi vi phạm pháp luật khác.
1. Những người là Điều tra viên cao cấp hoặc Điều tra viên trung cấp, có năng lực tổ chức, chỉ đạo hoạt động điều tra thì có thể được bổ nhiệm làm Thủ trưởng, Phó Thủ trưởng Cơ quan điều tra.
2. Việc bổ nhiệm, miễn nhiệm, cách chức và cấp, thu hồi giấy chứng nhận Thủ trưởng, Phó Thủ trưởng Cơ quan điều tra trong Công an nhân dân do Bộ trưởng Bộ Công an quyết định, trong Quân đội nhân dân do Bộ trưởng Bộ Quốc phòng quyết định, ở Viện kiểm sát nhân dân tối cao do Viện trưởng Viện kiểm sát nhân dân tối cao quyết định.
1. Điều tra viên được hưởng lương, phụ cấp và các chế độ, quyền lợi khác theo quy định của pháp luật.
2. Trong khi tiến hành hoạt động điều tra, Điều tra viên được ưu tiên mua vé đi lại bằng các phương tiện giao thông công cộng, được miễn phí cầu, phà, đường, miễn cước phí giao thông trong thành phố, thị xã.
Trong trường hợp cấp thiết, để ngăn chặn hành động phạm tội, đuổi bắt người phạm tội, cấp cứu người bị nạn, Điều tra viên được sử dụng phương tiện giao thông, thông tin liên lạc của cơ quan, tổ chức và cá nhân, kể cả những người điều khiển phương tiện ấy, trừ phương tiện của cơ quan đại diện ngoại giao, cơ quan lãnh sự nước ngoài, cơ quan đại diện của tổ chức quốc tế và của những người được hưởng quyền ưu đãi, miễn trừ ngoại giao hoặc lãnh sự và phải hoàn trả ngay khi tình huống cấp thiết không còn; trường hợp xảy ra thiệt hại thì Cơ quan điều tra có trách nhiệm bồi thường theo quy định của pháp luật.
1. Kinh phí bảo đảm hoạt động điều tra là một khoản trong ngân sách nhà nước.
Việc lập dự toán, quản lý, cấp, sử dụng và quyết toán kinh phí bảo đảm hoạt động điều tra được thực hiện theo pháp luật về ngân sách nhà nước.
2. Nhà nước ưu tiên đầu tư phát triển công nghệ thông tin và các phương tiện khác để bảo đảm cho các Cơ quan điều tra thực hiện tốt chức năng, nhiệm vụ của mình.
Pháp lệnh này thay thế Pháp lệnh tổ chức điều tra hình sự ngày 04 tháng 4 năm 1989.
Chính phủ, Viện kiểm sát nhân dân tối cao trong phạm vi nhiệm vụ, quyền hạn của mình có trách nhiệm quy định chi tiết và hướng dẫn thi hành Pháp lệnh này.

ON ORGANIZATION OF CRIMINAL INVESTIGATIONS
Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001 of the Xth National Assembly, its 10th session;
Pursuant to the Criminal Procedure Code;
This Ordinance prescribes the organizational apparatus and specific investigating competence of the investigating agencies; the specific tasks and powers in investigating activities of the Border Guard, the Customs, the Ranger, the Coast Guard and other agencies of the People's Police and the People's Army which are assigned to conduct a number of investigating activities.
Article 1.- Investigating agencies
1. The People's Police has the following investigating agencies:
a) The investigating police agency of the Ministry of Public Security; the investigating police agencies of the Police Departments of the provinces and centrally-run cities (hereinafter called collectively the investigating police agencies of the provincial-level Police Departments); the investigating police agencies of the Police Sections of rural districts, urban districts, provincial capitals, provincial cities (hereinafter called collectively the investigating police agencies of the district-level Police Sections);
b) The investigating security agency of the Ministry of Public Security; the investigating security agencies of the Police Departments of the provinces and centrally-run cities (hereinafter called collectively the investigating security agencies of the provincial-level Police Departments).
2. The People's Army has the following investigating bodies:
a) The criminal investigation agency of the Ministry of Defense; the criminal investigation agencies of military zones and the equivalent; the regional criminal investigation agencies;
b) The investigating security agency of the Ministry of Defense; the investigating security agencies of military zones and the equivalent.
3. The Supreme People's Procuracy has the following investigating agencies:
a) The investigating agency of the Supreme People's Procuracy;
b) The investigating agencies of the Central Military Procuracy.
4. The investigating agencies are composed of their heads, deputy-heads and investigators.
Article 2.- Agencies tasked to conduct a number of investigating activities
The agencies tasked to conduct a number of investigating activities include the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army, as defined in Articles 19, 20, 21, 22, 23, 24 and 25 of this Ordinance.
Article 3.- Tasks of the investigating agencies
The investigating agencies shall conduct investigation of all offenses, apply every measure prescribed by the Criminal Procedure Code in order to identify crimes and persons who have committed criminal acts, compile files, propose case institution; find the causes, conditions of committing crimes and request the concerned agencies and organizations to apply remedial and preventative measures.
Article 4.- Investigating tasks of the agencies tasked to conduct a number of investigating activities
1. The Border Guard, the Customs, the Ranger, the Coast Guard, if detecting criminal acts serious enough to be examined for penal liability while performing tasks in their respective management domains, shall conduct the investigating activities as provided for in Articles 19, 20, 21 and 22 of this Ordinance.
2. Other agencies of the People's Police, the People's Army, which are tasked to conduct a number of investigating activities, if detecting matters showing criminal signs while performing their tasks, shall be entitled to institute the cases, conduct initial investigating activities and transfer the files to the competent investigating bodies as provided for in Articles 23, 24 and 25 of this Ordinance.
Article 5.- Principles for investigating activities
1. Only the investigating bodies and agencies tasked to conduct a number of investigating activities, which are defined in this Ordinance, can investigate criminal cases. All investigating activities must comply with the provisions of the Criminal Procedure Code and this Ordinance.
2. Investigating activities must respect the truths, be carried out in an objective, comprehensive and adequate manner; accurately and promptly detect every criminal act, clarify evidences proving guilty and evidences proving not guilty, circumstances that aggravate and extenuate the penal liability of offenders without omitting criminals and doing injustice to innocent people.
3. The subordinate investigating agencies submit to the professional guidance and directions of the superior investigating agencies.
Article 6.- Responsibilities of the procuracies in investigating activities
The procuracies supervise the law observance in investigating activities in order to ensure that the investigating activities of the investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities comply with the provisions of the Criminal Procedure Code and this Ordinance.
The procuracies must detect in time and request the investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities to address law violations in investigating activities; grant and withdraw certificates of counsels for cases accepted for investigation by the Border Guard, the Customs, the Ranger, the Coast Guard or other agencies of the People's Army which are tasked to conduct a number of investigating activities.
The investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard and other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities must act upon the requests and decisions of the procuracies as provided for in the Criminal Procedure Code.
Article 7.- Responsibilities of agencies, organizations and citizens in investigating activities
1. Organizations and citizens have the right and obligation to detect and denounce criminal acts, have the responsibility to act upon the requests of, and create conditions for, the investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities, the heads and deputy-heads of investigating agencies, investigators, the heads and deputy-heads of agencies tasked to conduct a number of investigating activities to perform their investigating tasks.
2. Within the scope of their respective responsibilities, the State agencies must inform the investigating agencies of all criminal acts having happened in their offices and management domains; have the right to propose and send relevant documents to the investigating agencies for considering the institution of cases against offenders; have the responsibility to act upon the requests of, and create conditions for, the investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities, the heads and deputy-heads of investigating agencies, investigators, the heads and deputy-heads of agencies tasked to conduct a number of investigating activities to perform their investigating tasks.
3. Within the scope of their responsibilities, the investigating agencies must consider and handle reported information and denunciations on offenders, propose case institution, notify the handling results to agencies or organizations which have supplied the information or petitions and the persons who have denounced the offenders, and must apply necessary measures to protect the denouncers.
Article 8.- Supervision by agencies, organizations, people-elected deputies over investigating activities of the investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities
The state agencies, the Vietnam Fatherland Front Committees and member organizations of the Front, people-elected deputies have the rights to supervise the investigating activities of the investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities, the heads and deputy-heads of the investigating agencies, investigators, the heads and deputy-heads of agencies tasked to conduct a number of investigating activities.
In case of detecting illegal acts in investigating activities, the state agencies and people-elected deputies may request and the Vietnam Fatherland Front Committees and member organizations of the Front may propose the competent agencies to consider and handle them according to the provisions of the Criminal Procedure Code. Within the scope of their responsibilities, the investigating agencies, the Border Guard, the Customs, the Ranger, the Coast Guard, other agencies of the People's Police or the People's Army which are tasked to conduct a number of investigating activities must consider and settle them and notify the settlement results to the agencies and persons that have made the requests or proposals.
ORGANIZATION AND INVESTIGATING COMPETENCE OF INVESTIGATING AGENCIES
Section A. ORGANIZATION AND INVESTIGATING COMPETENCE OF INVESTIGATING AGENCIES IN THE PEOPLE'S POLICE
Article 9.- Organization of the investigating police agencies in the People's Police
1. The investigating police agency of the Ministry of Public Security is organized to comprise the Police Department for Investigation of Social Order- Related Crimes, the Police Department for Investigation of Crimes Related to Economic Management Order and to Positions, the Police Department for Investigation of Drug-Related Crimes, and its Office.
2. A provincial-level investigating police agemcu is organized to comprise the Police Section for Investigation of Social Order-Related Crimes, the Police Section for Investigation of Crimes Related to Economic Management Order and to Positions, the Police Section for Investigation of Drug-Related Crimes, and its office.
3. A district-level investigating police agency is organized to comprise the Police Team for Investigation of Social Order-Related Crimes, the Police Teams for Investigation of Crimes Related to Economic Management Order and to Positions, the Police Team for Investigation of Drug-Related Crimes, and its assisting apparatus.
Article 10.- Organization of the investigating security agencies in the People's Police
1. The investigating security agency of the Ministry of Public Security is organized to comprise investigating sections, operation teams, and its office.
2. A provincial-level investigating security agency is organized to comprise investigating teams, operation teams and its assisting apparatus.
Article 11.- Investigating competence of the investigating police agencies in the People's Police
1. The district-level investigating police agencies shall investigate criminal cases related to the crimes prescribed in Chapter XII thru Chapter XXII of the Penal Code when such crimes fall under the trial jurisdiction of the district-level people's courts, except for the crimes which fall under the investigating competence of the investigating agency of the Supreme People's Procuracy and the investigating security agency in the People's Police.
2. The investigating police agencies of the provincial-level Police Departments shall investigate criminal cases related to the crimes prescribed in Clause 1 of this Article when such crimes fall under the trial jurisdiction of the provincial-level people's courts or the crimes which fall under the investigating competence of the investigating police agencies of the district-level Police Sections when deeming it necessary to directly conduct the investigations.
3. The investigating police agency of the Ministry of Public Security shall investigate particularly serious and complicated crimes which fall under the investigating competence of the investigating police agencies of the provincial-level Police Departments when deeming it necessary to directly conduct the investigation.
Article 12.- Investigating competence of the investigating security agencies in the People's Police
1. The investigating security agencies of the provincial-level Police Departments shall conduct criminal investigations of the crimes prescribed in Chapter XI, Chapter XXIV and the crimes prescribed in Articles 180, 181, 221, 222, 223, 230, 231, 232, 236, 263, 264, 274 and 275 of the Penal Code when such crimes fall under the trial jurisdiction of the provincial-level people's courts.
2. The investigating security agency of the Ministry of Public Security shall investigate criminal cases related to particularly serious and complicated crimes which fall under the investigating competence of the investigating security agencies of the provincial-level Police Departments as provided for in Clause 1 of this Article when deeming it necessary to directly conduct the investigations.
Section B. ORGANIZATION AND INVESTIGATING COMPETENCE OF THE INVESTIGATING AGENCIES IN THE PEOPLE'S ARMY
Article 13.- Organization of the criminal investigation agencies in the People's Army
1. The criminal investigation agency of the Defense Ministry is organized to comprise investigating sections, operation sections, and its assisting apparatus.
2. A military-zone or equivalent-level criminal investigation agency is organized to comprise the investigation board and its assisting apparatus.
3. A regional criminal investigation agency is organized to be composed of the investigating section and its assisting apparatus.
4. Basing itself on the tasks and organization of the Army in each period, the Government shall submit to the National Assembly Standing Committee for decision the establishment or dissolution of military-zone or equivalent-level criminal investigation agencies, regional criminal investigation agencies.
Article 14.- Organization of the investigating security agencies in the People's Army
1. The investigating security agency of the Defense Ministry is organized to comprise investing sections, operation sections, and its assisting apparatus.
2. A military-zone or equivalent-level investigating security agency is organized to comprise the investigating board and its assisting apparatus.
3. Basing itself on the tasks and organization of the Army in each period, the Government shall submit to the National Assembly Standing Committee for decision the establishment or dissolution of military-zone or equivalent-level investigating security agencies.
Article 15.- Investigating competence of the criminal investigation agencies in the People's Army
1. The regional criminal investigation agencies shall investigate criminal cases related to the crimes prescribed in Chapter XII thru Chapter XXIII of the Penal Code when such crimes fall under the trial jurisdiction of the regional military courts, excluding crimes which fall under the investigating competence of the investigating agency of the Central Military Procuracy.
2. The military-zone or equivalent-level criminal investigation agencies shall investigate criminal cases related to the crimes prescribed in Clause 1 of this Article when such crimes fall under the trial jurisdiction of the military courts of military zones or the equivalent or the crimes which fall under the investigating competence of the regional criminal investigation agencies when deeming it necessary to directly conduct the investigations.
3. The criminal investigation agency of the Defense Ministry shall investigate criminal cases related to particularly serious or complicated crimes which fall under the investigating competence of the criminal investigation agencies of military zones or the equivalent when deeming it necessary to directly conduct the investigations.
Article 16.- Investigating competence of the investigating security agencies in the People's Army
1. The investigating security agencies of military zones or the equivalent shall investigate criminal cases related to the crimes prescribed in Chapter XI thru Chapter XXIV of the Penal Code when such crimes fall under the trial jurisdiction of the military courts of military zones or the equivalent.
2. The investigating security agency of the Defense Ministry shall investigate criminal cases related to particularly serious or complicated crimes which fall under the investigating competence of the investigating security agencies of military zones or the equivalent when deeming it necessary to directly conduct the investigations.
Section C. ORGANIZATION AND INVESTIGATING COMPETENCE OF THE INVESTIGATING AGENCY OF THE SUPREME PEOPLE'S PROCURACY
Article 17.- Organization of the investigating agency of the Supreme People's Procuracy
1. The investigating agency of the Supreme People's Procuracy is organized to comprise investigating sections and its assisting apparatus.
2. The investigating agency of the Central Military Procuracy is organized to comprise the investigating section and its assisting apparatus.
Article 18.- Investigating competence of the investigating agency of the Supreme People's Procuracy
1. The investigating agency of the Supreme People's Procuracy shall investigate criminal cases related to some types of crime of infringing upon judicial activities where the offenders are officials of judicial bodies when such crimes fall under the trial jurisdiction of the people's courts.
2. The investigating agency of the Central Military Procurary shall investigate the criminal cases prescribed in Clause 1 of this Article when such crimes fall under the trial jurisdiction of the military courts.
INVESTIGATING POWERS OF THE AGENCIES TASKED TO CONDUCT A NUMBER OF INVESTIGATING ACTIVITIES
Article 19.- Investigating powers of the Border Guard
1. If the Border Guard, when performing the tasks in its management domain, detect the crimes prescribed in Chapter XI and Articles 119, 120, 153, 154, 172, 180, 181, 188, 192, 193, 194, 195, 196, 230, 232, 236, 264, 273, 274 and 275 of the Penal Code committed in the land border areas, coasts, islands and sea areas managed by the Border Guard, the director of the Border Guard Reconnaissance Department, the provincial/municipal Border Guard commanders, the chiefs of border-guard stations shall have the powers:
a) For less serious crimes caught in the act with clear evidences and personal records of offenders, to issue decisions to institute the cases, examine the scenes, conduct searches, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, call for expertise when necessary, initiate criminal proceedings against the accused, take other investigating measures as provided for by the Criminal Procedure Code, complete the investigation and transfer the case files to the competent procuracies within twenty days as from the date of issuing decisions to institute the cases;
b) For serious, very serious, exceptionally serious crimes or less serious but complicated crimes, to issue decisions to institute the cases, examine the scenes, conduct searches, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases; when deeming it necessary to immediately prevent offenders from escape, destruction of exhibits or further commission of crimes, to immediately send such persons to police offices and ask for the urgent arrest warrants of the competent bodies; to transfer the case files to competent investigating agencies within seven days as from the date of issuing decisions to institute the cases;
c) To apply preventive measures according to the provisions of the Criminal Procedure Code.
2. The director of the Border Guard Reconnaissance Department, the provincial/municipal Border Guard commanders, the border-guard station chiefs shall directly organize and direct the investigating activities, decide to assign or replace their respective deputies in investigation of criminal cases, inspect the investigating activities, decide to change or annul groundless and illegal decisions of their deputies, settle denunciations according to the provisions of the Criminal Procedure Code.
When the director of the Border Guard Reconnaissance Department, the provincial/municipal Border Guard commanders or border-guard station chiefs are absent, one of their deputies shall be authorized to perform the their powers prescribed in this Clause and must bear responsibility before their heads for the assigned tasks.
3. When assigned to investigate criminal cases, the deputy-director of the Border Guard Reconnaissance Department, the provincial/municipal Border Guard deputy-commanders and the border-guard station deputy-chiefs may apply the investigating measures prescribed in Clause 1 of this Article.
4. The director and deputy-directors of the Border Guard Reconnaissance Department, the commanders and deputy-commanders of the provincial/municipal Border Guard, the chiefs and deputy-chiefs of the border-guard stations must be answerable before law for their acts and decisions.
Article 20.- Investigating powers of the Customs
1. If the Customs offices, when performing tasks in their management domain, detect the crimes prescribed in Articles 153 and 154 of the Penal Code, the director of the Smuggle Investigation Department, the director of the Post-Customs Clearance Inspection Department, the directors of the provincial/municipal Customs Departments, the heads of the border-gate Customs Sub-Departments shall have the powers:
a) For less serious crimes caught in the act with clear evidences and personal records of offenders, to issue decisions to institute the cases, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, to conduct body searches, search of storage places in the customs control areas, to call for expertise when necessary, to initiate criminal proceedings against the accused, take other investigating measures as provided for by the Criminal Procedure Code, to complete investigations and transfer the case files to the competent procuracies within twenty days as from the date of issuance of decisions to institute the cases;
b) For serious, very serious, exceptionally serious crimes or less serious but complicated crimes, to issue decisions to institute the cases, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, to conduct body searches, search of storage places in the areas controlled by the Customs, transfer the case files to the competent investigating agencies within seven days after the issuance of the decisions to institute the cases.
2. The director of the Smuggle Investigation Department, the director of the Post-Customs Clearance Inspection Department, the directors of the provincial/municipal Customs Departments, the heads of the border-gate Customs Sub-Departments shall directly organize and direct the investigating activities, decide to assign or replace their deputies in the investigation of criminal cases, inspect the investigating activities, decide to change or annul groundless and illegal decisions of their deputies, to settle denunciations according to the Criminal Procedure Code.
When the director of the Smuggle Investigation Department, the director of the Post-Customs Clearance Inspection Department, the directors of the provincial/municipal Customs Departments or the heads of the border-gate Customs Sub-Departments are absent, one of their deputies shall be authorized to perform their powers prescribed in this Clause and such deputies must take responsibility before their heads for the assigned tasks.
3. When assigned to investigate criminal cases, the deputy-directors of the Smuggle Investigation Department, the deputy-directors of the Post-Customs Clearance Department, the deputy-directors of the provincial/municipal Customs Departments, the deputy-heads of the border-gate Customs Sub-Departments may apply the investigating measures prescribed in Clause 1 of this Article.
4. The director and deputy-directors of the Smuggle Investigation Department, the director and deputy-directors of the Post-Customs Clearance Inspection Department, the directors and deputy-directors of the provincial/municipal Customs Departments, the heads and deputy-heads of the border-gate Customs Sub-Departments must be answerable before law for their acts and decisions.
Article 21.- Investigating powers of the Ranger
1. If the Ranger offices, when performing tasks in their management domain, detect the crimes prescribed in Articles 175, 189, 190, 191, 240 and 272 of the Penal Code, the director of the Ranger Department, the directors of the Ranger Sub-Departments, the heads of the Ranger Sections, the heads of Forest Products Inspection Sections shall have the powers:
a) For less serious crimes caught in the act with clear evidences and personal records of offenders, to issue decisions to institute the cases, examine the scenes, conduct searches, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, call for expertise when necessary, to initiate criminal proceedings against the accused, take other investigating measures as provided for by the Criminal Procedure Code, complete the investigations and transfer the case files to competent procuracies within twenty days after the issuance of decisions to institute the cases;
b) For serious, very serious, exceptionally serious crimes or less serious but complicated crimes, to issue decisions to institute the cases, examine the scenes, conduct searches, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, transfer the case files to competent investigating agencies within seven days after the issuance of decisions to institute the cases.
2. The director of the Ranger Department, the directors of Ranger Sub-Departments, the heads of the Ranger Sections, the heads of the Forest Products Inspection Sections shall directly organize and direct the investigating activities, decide to assign or replace their deputies in the investigation of criminal cases, to inspect the investigating activities, to decide to change or annul groundless or illegal decisions of their deputies, to settle denunciations according to the provisions of the Criminal Procedure Code.
When the director of the Ranger Department, the directors of the Ranger Sub-Departments, the heads of the Ranger Sections, the heads of the Forest Products Inspection Sections are absent, one of their deputies shall be authorized to perform their powers prescribed in this Clause and must bear responsibility to their heads for the assigned tasks.
3. When assigned to investigate criminal cases, the deputy-directors of the Ranger Department, the deputy-directors of the Ranger Sub-Departments, the deputy-heads of the Ranger Sections and the deputy-heads of the Forest Products Inspection Sections may apply the investigating measures prescribed in Clause 1 of this Article.
4. The director and deputy-directors of the Ranger Department, the directors and deputy-directors of the Ranger Sub-Departments, the heads and deputy-heads of the Ranger Sections, the heads and deputy-heads of the Forest Products Inspection Sections must be answerable before law for their acts and decisions.
Article 22.- Investigating powers of the Coast Guard force
1. If the Coast Guard units, when performing tasks in their management domain, detect the crimes prescribed in Chapter XI and Articles 153, 154, 172, 183, 188, 194, 195, 196, 212, 213, 221, 223, 230, 231, 232, 236, 238, 273 and 274 of the Penal Code committed in the sea areas and continental shelf of the Socialist Republic of Vietnam, which are managed by the Coast Guard, the director of the Department, the regional commanders, the fleet commanders, the flotilla commanders and the heads of Coast Guard teams shall have the powers:
a) For less serious crimes caught in the act with clear evidences and personal records of offenders, to issue decisions to institute the cases, examine the scenes, conduct searches, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, to call for expertise when necessary, to initiate criminal proceedings against the accused, take other investigating measures as provided for by the Criminal Procedure Code, complete the investigations and transfer the case files to competent procuracies within twenty days after the issuance of decisions to institute the cases;
b) For serious, very serious, exceptionally serious crimes or less serious but complicated crimes, to issue decisions to institute the cases, to examine the scenes, to conduct searches, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, transfer the case files to competent investigating bodies within seven days after the issuance of decisions to institute the cases;
c) To apply preventive measures as prescribed by the Criminal Procedure Code.
2. The director of the Department, the regional commanders, the fleet commanders, the flotilla commanders and leaders of the Coast Guard teams shall directly organize and direct the investigating activities, decide to assign or replace their deputies in the investigation of criminal cases, inspect the investigating activities, decide to change or annual groundless and illegal decisions of their deputies, settle denunciations under the provisions of the Criminal Procedure Code.
When the director of the Coast Guard Department, regional commanders, fleet commanders, flotilla commanders and Coast Guard team leaders are absent, they shall authorize one of their deputies to perform their powers prescribed in this Clause and such deputies must bear responsibility to their heads for the assigned tasks.
3. When assigned to investigate criminal cases, the deputy-directors of the Department, the regional deputy-commanders, the fleet deputy-commanders, the flotilla deputy-commanders and Coast Guard team deputy-leaders may apply the investigating measures prescribed in Clause 1 of this Article.
4. The director and deputy-directors of the Department, the regional commanders and deputy-commanders, the fleet commanders and deputy-commanders, the flotilla commanders and deputy-commanders, the Coast Guard team leaders and deputy-leaders must be answerable before law for their acts and decisions.
Article 23.- Investigating powers of other agencies of the police force in the People's Police, which are tasked to conduct a number of investigating activities
1. If the Road-Railway Traffic Police Department, the Waterway Traffic Police Department, the Fire-Fighting Police Department, the Police Department for Administrative Management of Social Order, the Guard and Judicial Assistance Police Department, the Road-Railway Traffic Police Sections, the Waterway Traffic Police Sections, the Fire-Fighting Police Sections, the police sections for administrative management of social order, the guard and judicial assistance police sections, the remand homes, the detention camps, while performing their respective tasks, detect signs of crimes falling under the investigating competence of the investigating police agencies prescribed in Article 11 of this Ordinance, the director of the Road-Railway Traffic Police Department, the director of the Waterway Traffic Police Department, the director of the Fire-Fighting Police Department, the director of the Police Department for Administrative Management of Social Order, the director of the Guard and Judicial Assistance Police Department, the heads of the Road-Railway Traffic Police Sections, the heads of the Waterway Traffic Police Sections, the heads of the Fire-Fighting Police Sections, the heads of the police sections for administrative management of social order, the heads of the police sections for guard and judicial assistance, the superintendents of remand homes, detention camps shall issue decisions to institute the cases, take testimonies, examine the scenes, conduct searches, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, transfer the case files to competent investigating police agencies within seven days after the issuance of decisions to institute the cases.
2. The Department directors and section directors prescribed in Clause 1 of this Article, the remand home superintendents, detention camp superintendents shall directly organize and direct the investigating activities, decide to assign or replace their deputies in the investigation of criminal cases, inspect the investigating activities, decide to change or annul groundless and illegal decisions of their deputies, settle denunciations according to the provisions of the Criminal Procedure Code.
When the Department directors, section heads, remand home superintendents, detention camp superintendents are absent, one of their deputies shall be authorized to perform the heads' powers prescribed in this Clause and such deputies shall bear responsibility to their heads for the assigned tasks.
3. When assigned to investigate criminal cases, the deputy-directors of the Departments, section deputy-heads, remand home deputy-superintendents, detention camp deputy-superintendents may apply the investigating measures prescribed in Clause 1 of this Article.
4. The Department directors and deputy directors, the section heads and deputy heads, the remand home superintendents and deputy-superintendents, the detention camp superintendents and deputy-superintendents must be answerable before law for their acts and decisions.
Article 24.- Investigating powers of other agencies of the security force in the People's Police, which are tasked to conduct a number of investigating activities
1. If security departments or security sections of the provincial-level Police Departments, which are directly engaged in the struggle to prevent and combat the crimes prescribed in Article 12 of this Ordinance, detect criminal signs while performing their tasks, the directors of such departments or the heads of such sections shall issue decisions to institute the cases, take testimonies, examine the scenes, conduct searches, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases; when deeming it necessary to immediately prevent offenders from escape, destruction of exhibits or further commission of crimes, they must immediately escort such persons to police offices and ask for the urgent arrest warrants of competent bodies; within seven days after the issuance of the decisions on case institution, they must transfer the case files to competent investigating security agencies.
If the security teams in the district-level police sections, while performing their tasks, detect signs of crimes falling under the investing competence of the investigating security agencies of the provincial-level Police Departments, they must immediately hunt for the escapees, take testimonies, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases and promptly report thereon to the provincial-level investigating security agencies.
2. The directors of the Departments, the heads of the sections, defined in Clause 1 of this Article, shall directly organize and direct the investigating activities, decide to assign or replace their deputies in the investigation of criminal cases, inspect the investigating activities, decide to replace or annul the groundless and illegal decisions of their deputies, settle denunciations under the provisions of the Criminal Procedure Code.
When the directors of the security departments, the heads of the security sections of the provincial-level Police Departments are absent, one of their deputies shall be authorized to perform the heads' powers specified in this Clause and must bear responsibility to their heads for the assigned tasks.
3. When assigned to investigate criminal cases, the deputy-directors of the security departments, the deputy-heads of the security sections of the provincial-level Police Departments may apply the investigating measures prescribed in Clause 1 of this Article.
4. The Department directors and deputy directors, the section heads and deputy heads must be answerable before law for their acts and decisions.
Article 25.- Investigating powers of other agencies in the People's Army, which are tasked to conduct a number of investigating activities
1. The remand home superintendents and the detention camp superintendents, if detecting while performing their tasks the signs of crimes which fall under the investigating competence of the criminal investigation agencies and are serious enough for penal liability examination, shall issue decisions to institute the cases, examine the scenes, take testimonies, conduct searches, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, transfer the case files to the competent criminal investigation agencies within seven days after the issuance of the decisions to institute the cases.
When the remand home superintendents or the detention camp superintendents are absent, one of their deputies shall be authorized to perform their heads' powers specified in this Clause and bear responsibility to their heads for the assigned tasks.
2. The commanders of independent regiment- or equivalent-level units, when detecting criminal acts which fall under the investigating competence of the investigating agencies in the People's Army and occur within the areas where their respective units are stationed, shall have the right to make records on crimes caught in the act, take testimonies, conduct searches, confiscate, temporarily seize and preserve exhibits, documents directly related to the cases, apply the preventive measures under the provisions of the Criminal Procedure Code, promptly transfer the case files to the competent investigating agencies.
3. The remand home superintendents, the detention camp superintendents, commanders of independent regiment- or equivalent-level units must be answerable before law for their acts and decisions.
RELATIONSHIP OF ASSIGNMENT AND COORDINATION IN INVESTIGATING ACTIVITIES
Article 26.- Relationships between investigating agencies, agencies tasked to conduct a number of investigating activities
1. The relations among investigating agencies, between investigating agencies and the agencies tasked to conduct a number of investigating activities or among agencies tasked to conduct a number of investigating activities are the relations of assignment and coordination in investigating activities.
The written requests of investigating agencies must be strictly implemented by agencies tasked to conduct a number of investigating activities.
2. For cases showing criminal signs, where the investigating competence is not yet identified, the investigating agencies which detect them first shall have to promptly apply the investigating measures under the provisions of the Criminal Procedure Code; when the investigating competence is identified, the cases shall be transferred to the competent investigating agencies as provided for by the Criminal Procedure Code.
3. Agencies tasked to conduct a number of investigating activities, after instituting the cases and applying the preventive measures according to their competence, must immediately send such decisions to the procuracies and notify the competent investigating agencies thereof.
4. The people's police, people's security or military police units shall have to provide supports and act upon requests of the heads, deputy-heads of investigating agencies, inspectors and the heads or deputy-heads of the agencies tasked to conduct a number of investigating activities in the investigating activities.
Article 27.- Investigation entrustment
When necessary, an investigating agency may entrust another investigating agency to conduct a number of investigating activities. An entrustment decision must clearly state the specific requirements. The entrusted investigating agency has the responsibility to fully perform the entrusted tasks within the time limit requested by the entrusting investigating agency.
In cases where the entrusted investigating agency cannot perform any or all of the entrusted tasks, they must immediately notify such in writing to the entrusting investigating agency and clearly state the reasons therefor.
Article 28.- Settlement of disputes over investigating competence
1. When there appear disputes over the investigating competence among the investigating agencies, the heads of the procuracies of the same level of the localities where the crimes are committed or where the crimes are detected shall decide.
2. When there appear disputes over the investigating competence among the Border Guard, the Customs, the Ranger, the Coast Guard, the heads of the competent procuracies of the localities where the cases occur shall decide.
In case of necessity, the competent investigating agencies shall have the right to request the agencies tasked to conduct a number of investigating activities to transfer the case files for their direct investigations. The investigating agencies' requests are binding on the agencies tasked to conduct a number of investigating activities.
CRITERIA, PROCEDURES FOR APPOINTMENT, REMOVAL FROM DUTY OF INVESTIGATORS
Investigators are persons appointed under law provisions to perform the tasks of investigating criminal cases.
Article 30.- Criteria of investigators
1. Vietnamese citizens who are loyal to the Fatherland and the Constitution of the Socialist Republic of Vietnam, have good virtues, are non-corrupted and honest, have security university, policy university or law university degree, investigating operation certificates, have the practical work duration prescribed by this Ordinance, have good health to ensure the performance of assigned tasks can be appointed to be investigators.
In cases where due to operation demands, persons having university degrees in other disciplines, satisfying the above criteria and possessing investigating operation certificates may also be appointed to be investigators.
2. The investigators are classified into three grades, being elementary investigators, intermediate investigators and senior investigators:
a) Those who satisfy the criteria prescribed in Clause 1 of this Article, have been engaged in law-related work for four years or more, are police officers or army officers in active service, people’s procuracy officials, capable of investigating cases involving less serious or serious offenses can be appointed to be elementary investigators;
b) Those who satisfy the criteria prescribed in Clause 1 of this Article, have worked as elementary investigators for at least five years, are capable of investigating cases involving very serious or exceptionally serious offenses and capable of guiding investigating activities of elementary investigators can be appointed to be intermediate investigators.
In case of personnel demands, the persons who satisfy the criteria prescribed in Clause 1 of this Article, have been engaged in law-related work for nine years or more, are capable of investigating cases involving very serious or exceptionally serious offenses and capable of guiding investigating activities of elementary investigators can be appointed to be intermediate investigators;
c) Those who satisfy the criteria prescribed in Clause 1 of this Article, have worked as intermediate investigators for at least five years, are capable of studying, synthesizing and proposing anti-crime measures, capable of investigating cases involving very serious, exceptionally serious, complicated offenses, capable of guiding investigating activities of elementary investigators and intermediate investigators can be appointed to be senior investigators.
In case of personnel demands, the persons who satisfy the criteria prescribed in Clause 1 of this Article, have been engaged in law-related work for fourteen years of more, are capable of studying, synthesizing and proposing anti-crime measures, capable of investigating cases involving very serious, exceptionally serious, complicated offenses, capable of guiding investigating activities of elementary investigators and intermediate investigators can be appointed to be senior investigators.
3. In special cases, the persons who are seconded by competent agencies or organizations to work at investigating agencies, though having not yet possessed the investigating operation certificates and having not yet got enough the time prescribed at Point b or Point c, Clause 2 of this Article, and satisfy all other criteria prescribed in Clause 1, Point b or Point c of Clause 2 of this Article can also be appointed to be intermediate investigators or senior investigators.
4. The investigators' term of office is five years counting from the date of their appointment.
Article 31.- Investigator selection councils
1. The councils for selection of senior investigators, intermediate investigators and elementary investigators in the People's Police:
a) The council for selection of senior investigators in the People's Police and intermediate investigators and elementary investigators in the investigating agencies of the Ministry of Public Security is composed of the general director of the General Department for Building the People's Police Force as its chairman, leading officials of the investigating police agency, the investigating security agency, the Organization and Personnel Department and the Legal Department of the Ministry of Public Security as its members.
b) The council for selection of intermediate investigators, elementary investigators in the investigating agencies of the provincial-level Police Departments and the investigating police agencies of the district-level Police Sections is composed of the director of the provincial-level Police Department as its chairman, the representatives of the leaderships of the investigating police agencies, the investigating security agencies, the organization and personnel section and the office of the provincial-level Police Department as its members;
c) The lists of members of the councils for selection of investigators in the People's Police shall be decided by the Minister of Public Security at the proposal of the council chairmen.
2. The council for selection of investigators in the People's Army is composed of the director of the General Political Department as its chairman, the representatives of the leaderships of the Criminal Investigation Agency, the Investigating Security Agency, the Personnel Department and the Legal Department of the Defense Ministry as its members.
The list of members of the council for selection of investigators in the People's Army shall be decided by the Defense Minister at the proposal of the selection council chairman.
3. The council for selection of investigators at the Supreme People's Procuracy shall be composed of a deputy-chairman of the Supreme People's Procuracy as its chairman, representatives of the Procurators' Committee of the Supreme People's Procuracy, the Central Military Procuracy, the investigating agency and the Organization-Personnel Department of the Supreme People's Procuracy as its members.
The chairman of the Supreme People's Procuracy shall appoint one of his/her deputies to act as chairman of the selection council. The list of members of the council for selection of investigators in the Supreme People's Procurary shall be decided by the chairman of the Supreme People's Procuracy at the proposal of the selection council chairman.
Article 32.- Tasks and powers of the investigator selection councils
The investigator selection councils shall have the following tasks and powers:
1. To select fully qualified persons for acting as investigators at the proposal of the organization-personnel offices so that the council chairmen shall propose the Minister of Public Security, the Defense Minister or the chairman of the Supreme People's Procuracy to appoint them;
2. To examine cases where investigators can be removed from office or dismissed under the provisions in Article 34 of this Ordinance so that the council chairmen shall propose the Minister of Public Security, the Defense Minister, the chairman of the Supreme People's Procuracy to remove from office or dismiss investigators.
Article 33.- Things must not be done by investigators
The investigators must not do the following things:
1. Things which State officials and employees, or people's armed force officers and combatants must not do as provided for by law:
2. Providing consultancy to the accused, defendants, involved parties or other procedure participants, thus making the settlement of cases contrary to law provisions;
3. Illegally interfering in the settlement of cases or abusing their influence to exert impacts on persons responsible for the settlement of the cases.
4. Bringing case files or documents in case files out of the offices if not for the assigned tasks or without the consents of the competent persons;
5. Receiving defendants, the accused, involved parties or other procedure participants in the cases which they have competence to settle, outside the prescribed places.
Article 34.- Appointment, removal from office, dismissal of investigators
1. The appointment, removal from office and dismissal of investigators as well as the grant and withdrawal of investigator's cards in the People's Police shall be decided by the Minister of Public Security, in the People's Army shall be decided by the Defense Minister, in the Supreme People's Procuracy shall be decided by its chairman.
2. Investigators shall be automatically relieved from the investigator's title when they retire or move to other jobs.
Investigators may be relieved from the investigator's title for health reason, family difficulties or other reasons for which they deem unable to fulfill their assigned tasks.
3. Investigators shall automatically lose their investigator's title when they are convicted with effective court judgments or disciplined in form of being deprived of the people's police title, of the people's army officer rank.
4. Depending on the nature and seriousness of their violations, investigators can be deprived of the investigator's title in one of the following cases:
a) Committing violations in investigation of criminal cases;
b) Violating the provisions of Article 33 of this Ordinance;
c) Being disciplined in form of being removed from their current managerial positions according to law provisions on State officials and employees;
d) Violating regulations on moral qualities;
e) Committing other acts of law offense.
Article 35.- Appointment, removal from duty, dismissal of heads, deputy-heads of investigating agencies
1. Senior investigators or intermediate investigators who are capable of organizing and/or directing the investigating activities can be appointed to be heads or deputy-heads of investigating agencies.
2. The appointment, removal from duty and dismissal, as well as the grant and withdrawal of certificates of the heads or deputy heads of investigating agencies in the People's Police shall be decided by the Minister of Public Security, in the People's Army shall be decided by the Defense Minister and in the Supreme People's Procuracy shall be decided by its chairman.
ENSURING ACTIVITIES OF INVESTIGATING AGENCIES
Article 36.- Regimes for investigators
1. Investigators shall enjoy salary, allowances and other regimes as well as interests as provided for by law.
2. While conducting investigations, the investigators shall be given priority in the purchase of tickets for travel on public transportation means, be exempt from bridge, ferry, road tolls, traffic charge in cities, provincial capitals.
In case of necessity to ward off criminal acts, chase after criminals, rescue victims, the investigators are entitled to use traffic, communications means of agencies, organizations and individuals, including operators of such means, excluding means of diplomatic representations, foreign consulates, representative offices of international organizations and of persons entitled to diplomatic or consular privileges and immunities and must immediately return the means when the emergency circumstances no longer exist; in case of causing damage, the investigating agencies shall have to pay compensations therefor according to law provisions.
Article 37.- Funds for investigating activities
1. Funds for investigating activities constitute an amount in the State budget.
The estimation, management, allocation, use and settlement of funds for investigating activities shall comply with the legislation on the State budget.
2. The State shall prioritize the investment in development of information technology and other means to ensure that the investigating agencies well perform their functions and tasks.
Article 38.- Implementation provisions
This Ordinance replaces the April 4, 1989 Ordinance on Organization of Criminal Investigations.
The Government and the Supreme People's Procuracy shall, within the scope of their tasks and powers, have to detail and guide the implementation of this Ordinance.
