Tổ chức, cá nhân tiến hành hoạt động dầu khí tại Việt Nam có nghĩa vụ bảo đảm an toàn cho các hoạt động dầu khí, các công trình, phương tiện, thiết bị dầu khí theo quy định của Nghị định này, tuân thủ Quy chế quản lý an toàn trong các hoạt động dầu khí và các quy định có liên quan của pháp luật Việt Nam để bảo vệ an toàn tính mạng, sức khoẻ con người, bảo vệ tài sản và môi trường.
Điều 14.Tổ chức, cá nhân tiến hành hoạt động dầu khí tại Việt Nam có trách nhiệm:
1. Thiết lập, duy trì hệ thống quản lý công tác an toàn, bảo đảm kiểm soát hiệu quả các rủi ro trong suốt quá trình hoạt động từ khâu thiết kế, xây dựng, chạy thử, vận hành, khai thác và hủy bỏ công trình;
2. Thiết lập, duy trì hệ thống ứng cứu khẩn cấp và áp dụng các biện pháp ứng cứu cần thiết khi xảy ra cháy nổ, tai nạn, sự cố;
3. Lập kế hoạch ứng cứu khẩn cấp, phù hợp với hệ thống ứng cứu khẩn cấp quốc gia, tổ chức luyện tập thường xuyên và diễn tập định kỳ theo kế hoạch;
4. Thực hiện đầy đủ các kế hoạch về bảo vệ môi trường và các biện pháp để ngăn ngừa ô nhiễm và khắc phục hậu quả do sự cố ô nhiễm môi trường gây ra.
Điều 15.1. Người lao động khi làm việc tại các công trình, phương tiện, thiết bị dầu khí, phải được đào tạo, huấn luyện các kiến thức, kỹ năng an toàn phù hợp với quy định và đáp ứng cho công việc được giao; được trang bị đầy đủ các trang thiết bị về bảo hộ lao động.
2. Trong quá trình làm việc, người lao động phải tuân thủ các quy định về phòng cháy, chữa cháy và bảo vệ môi trường lao động; bảo vệ sức khoẻ, tính mạng và bảo vệ an toàn cho công trình, phương tiện, thiết bị dầu khí.
3. Khách đến làm việc, tham quan tại các cơ quan, doanh nghiệp dầu khí phải chấp hành nghiêm chỉnh các nội quy, quy định ra vào, làm việc, tham quan theo yêu cầu và hướng dẫn của cơ quan, doanh nghiệp dầu khí, nhằm bảo vệ an ninh, an toàn cho các hoạt động dầu khí, công trình, phương tiện, thiết bị dầu khí.
Điều 16.1. Tại các công sở, doanh nghiệp dầu khí và các công trình, phương tiện, thiết bị dầu khí, phải có lực lượng thích hợp để bảo vệ an toàn công sở, doanh nghiệp và các công trình, phương tiện, thiết bị; phòng chống cháy nổ, ngăn ngừa và ứng cứu sự cố.
2. Lực lượng bảo vệ và lực lượng an toàn phải có đủ điều kiện về phẩm chất, trình độ chuyên môn, nghiệp vụ và được trang bị phương tiện cần thiết, bảo đảm hoàn thành nhiệm vụ bảo vệ an ninh, an toàn dầu khí trong phạm vi trách nhiệm.
Điều 17.1. Các công trình dầu khí trên đất liền phải được thiết lập hành lang an toàn và phải có các hình thức phổ biến công khai các quy định về bảo vệ hành lang an toàn để mọi người nhận biết, chấp hành.
2. Trong hành lang an toàn, nghiêm cấm việc xây dựng các công trình, trồng cây lâu năm, sử dụng lửa trần, các thiết bị phát nhiệt, phát lửa và các hoạt động khác gây nguy hại cho công trình dầu khí.
3. Trường hợp cần sử dụng hành lang an toàn cho mục đích an ninh, quốc phòng hoặc các mục đích đặc biệt khác, phải được cơ quan nhà nước có thẩm quyền cho phép và phải có biện pháp bảo đảm an toàn cho công trình dầu khí.
4. Hành lang an toàn xung quanh các công trình dầu khí trên đất liền do cơ quan Nhà nước có thẩm quyền quy định trên cơ sở đề nghị của Tổng công ty Dầu khí Việt Nam.
Điều 18.1. Nghiêm cấm các tổ chức, cá nhân không có trách nhiệm, xâm nhập hoặc tiến hành các hoạt động dưới bất kỳ hình thức nào trong vùng an toàn của các công trình dầu khí biển, trừ trường hợp đặc biệt được Thủ tướng Chính phủ cho phép.
2. Khoảng cách vùng an toàn của các công trình dầu khí trên biển là 500m trở ra tính từ rìa ngoài cùng của công trình hoặc từ vị trí thả neo đối với các phương tiện nổi.
3. Trong phạm vi 2 hải lý tính từ rìa ngoài cùng của công trình dầu khí biển các phương tiện tàu, thuyền không có nhiệm vụ không được thả neo.
4. Tọa độ vùng an toàn xung quanh các hoạt động dầu khí, các công trình dầu khí trên biển do cơ quan đảm bảo hàng hải Việt Nam công bố trên cơ sở đề nghị của Tổng công ty Dầu khí Việt Nam.
Article 13.- Organizations and individuals conducting petroleum activities in Vietnam shall be obliged to ensure safety for petroleum activities as well as petroleum projects, means and equipment according to the provisions of this Decree, and to observe the Regulation on the safety management in petroleum activities as well as relevant law provisions of Vietnam in order to protect safely human lives and health, properties and the environment.
Article 14.- Organizations and individuals conducting petroleum activities in Vietnam shall have the responsibility to:
1. Establish and maintain the safety management system, ensure effective control of risks throughout the operation process from designing, construction, test running, operation, exploitation to dismantlement of projects;
2. Establish and maintain the emergency aid and rescue system and apply necessary aid and rescue measures when fires, explosions, accidents or incidents occur;
3. Work out emergency aid and rescue plans compatible with the national emergency aid and rescue system, organize regular training and periodical exercises according to the plans;
4. Implement all environmental protection plans and take measures to prevent pollution and overcome consequences caused by environmental pollution incidents.
1. Laborers expected to work at petroleum projects, with petroleum means and/or equipment must be provided with training in safety knowledge and skills according to regulations so that they can meet the requirements of the assigned jobs; be equipped with adequate labor safety equipment.
2. During the working process, laborers must strictly observe the regulations on fire prevention and fighting and labor environment protection; the protection of human health and lives and safety for petroleum projects, means and equipment.
3. People on working or sight-seeing visits at petroleum agencies or enterprises must strictly observe the internal rules and regulations on reception, working and sight-seeing according to the requirements and guidance of the petroleum agencies and enterprises, in order to protect security and safety for petroleum activities as well as petroleum projects, means and equipment.
1. At the petroleum offices, enterprises, projects, means and equipment, there must be appropriate forces to safely protect them, prevent and fight fires and explosions, and prevent and intercept incidents.
2. Security and safety forces must satisfy all conditions on professional qualities and qualifications and be equipped with necessary means in order to fulfill the tasks of protecting petroleum security and safety within their respective responsibilities.
1. For petroleum projects on the mainland, the safety corridors must be established and there must be forms of making public the regulations on the protection of the safety corridors so that everyone can know and comply with.
2. In the safety corridor, it is strictly forbidden to build projects, to plant perennial trees, burn fires, use heat- or fire-emitting devices and carry out other activities that may cause harm to petroleum projects.
3. Where it is necessary to use a safety corridor for security, defense or other special purposes, the permission of a competent State bodies must be obtained and measures to ensure safety for petroleum projects must be taken.
4. The safety corridors around petroleum projects on the mainland shall be prescribed by competent State bodies at the proposal of Vietnam Oil and Gas Corporation.
1. Organizations and individuals that have no responsibility are strictly forbidden to encroach upon, or carry out activities in any form in, the safety zone of offshore petroleum projects, except for special cases permitted by the Prime Minister.
2. The width of the safety zone of an offshore petroleum project is 500 m outwards calculated from the outermost edge of the project or from the anchoring position for floating means.
3. Within two nautical miles calculated from the outermost edge of an offshore petroleum project, means, boats and ships that have no responsibility must not be anchored.
4. The co-ordinates of the safety zones surrounding offshore petroleum activities or projects shall be announced by the Vietnamese maritime security authority at the proposal of Vietnam Oil and Gas Corporation.
