Nhiệm vụ bảo vệ an ninh dầu khí là phòng ngừa, phát hiện, ngăn chặn và xử lý các hành vi sau:
1. Lợi dụng hoạt động dầu khí để xâm phạm an ninh quốc gia, xâm phạm chủ quyền, quyền chủ quyền của nước Cộng hoà xã hội chủ nghĩa Việt Nam.
2. Gián tiếp hoặc trực tiếp phá hoại cơ quan, doanh nghiệp dầu khí, các công trình, phương tiện, thiết bị dầu khí.
3. Xâm phạm các hoạt động dầu khí, gây thiệt hại tài sản Nhà nước, lợi ích quốc gia và lợi ích hợp pháp của tổ chức, cá nhân tiến hành hoạt động dầu khí.
4. Vi phạm bí mật Nhà nước trong hoạt động dầu khí.
5. Làm phương hại đến việc thực hiện chủ trương, chính sách, pháp luật phát triển ngành dầu khí
Điều 7.Trước khi tiến hành hoạt động dầu khí tại Việt Nam, mọi tổ chức, cá nhân phải xây dựng kế hoạch, phương án bảo vệ đối với các hoạt động dầu khí và công trình, phương tiện, thiết bị dầu khí theo quy định của Bộ Công an. Các kế hoạch và phương án bảo vệ phải được gửi cho Tổng công ty Dầu khí Việt Nam để phối hợp thực hiện.
Điều 8.1. Việc tuyển dụng người lao động vào làm việc cho Tổng công ty Dầu khí Việt Nam phải được thực hiện theo đúng quy định của pháp luật về lao động và các quy định khác của pháp luật có liên quan.
Đối với người nước ngoài, người Việt Nam định cư ở nước ngoài, trong hồ sơ tuyển dụng phải có lý lịch tư pháp. Sau khi được tuyển dụng, những cá nhân này phải hoạt động đúng mục đích nhập cảnh.
2. Tổng công ty Dầu khí Việt Nam có trách nhiệm phối hợp với cơ quan chức năng của Nhà nước trong việc quản lý hoạt động của người lao động nước ngoài, người Việt Nam định cư ở nước ngoài làm việc cho nhà thầu, văn phòng đại diện, doanh nghiệp dầu khí tại Việt Nam.
Điều 9.1. Nhà thầu dầu khí nước ngoài, doanh nghiệp dầu khí có vốn đầu tư nước ngoài, khi tuyển dụng lao động là người Việt Nam phải thực hiện đúng các quy định của pháp luật Việt Nam về lao động. Sau khi tuyển dụng, có thông báo và gửi bản sao hợp đồng lao động cho Tổng công ty Dầu khí Việt Nam.
2. Nhà thầu dầu khí nước ngoài, doanh nghiệp dầu khí có vốn đầu tư nước ngoài khi cử lao động là người Việt Nam đi công tác, học tập ở nước ngoài phải thông báo cho Tổng công ty Dầu khí Việt Nam về danh sách đoàn đi, chương trình công tác, học tập.
Điều 10.1. Người nước ngoài, người Việt Nam định cư ở nước ngoài làm việc cho các nhà thầu nước ngoài, doanh nghiệp dầu khí có vốn đầu tư nước ngoài tại Việt Nam phải tuân thủ pháp luật Việt Nam và các Điều ước quốc tế mà Việt Nam ký kết hoặc tham gia.
2. Tổng công ty Dầu khí Việt Nam được phép yêu cầu các nhà thầu nước ngoài, các doanh nghiệp dầu khí có vốn đầu tư nước ngoài chấm dứt hợp đồng lao động đối với người lao động khi phát hiện có chứng cứ vi phạm pháp luật Việt Nam.
Điều 11.Các thông tin thuộc phạm vi bí mật Nhà nước trong ngành dầu khí được chuyển đi bằng các phương tiện liên lạc vô tuyến, hữu tuyến hoặc bằng các phương tiện kỹ thuật khác đều phải được mã hoá theo quy định của Nhà nước về công tác cơ yếu.
Nghiêm cấm việc trao đổi hoặc đưa thông tin thuộc danh mục bí mật Nhà nước trong ngành dầu khí trên các phương tiện thông tin đại chúng.
Điều 12.Tổ chức, cá nhân tiến hành hoạt động dầu khí tại Việt Nam khi sử dụng hệ thống mạng thông tin máy tính kết nối với mạng Internet phục vụ hoạt động dầu khí, có trách nhiệm :
1. Chấp hành đúng quy định của Nhà nước về thiết lập, quản lý, sử dụng mạng Internet;
2. Chịu trách nhiệm trước pháp luật về nội dung thông tin được đưa vào, truyền đi từ hệ thống máy tính của mình;
3. Khi phát hiện các nguồn thông tin bất hợp pháp xâm nhập vào Việt Nam hoặc phát hiện các hành vi vi phạm pháp luật trong việc sử dụng Internet, phải báo ngay cho cơ quan chức năng Nhà nước để xử lý.
Article 6.- The tasks of protecting petroleum security are to prevent, detect, stop and handling the following acts:
1. Abusing petroleum activities to infringe upon the national security, the sovereignty and sovereignty rights of the Socialist Republic of Vietnam.
2. Indirectly or directly sabotaging petroleum agencies and/or enterprises, petroleum projects, means and equipment.
3. Infringing upon petroleum activities, causing damage to the State’s assets, the national interests and/or the legitimate interests of organizations and individuals conducting petroleum activities.
4. Disclosing the State’s secrets in petroleum activities.
5. Harming the implementation of undertakings, policies and legislation on the development of the petroleum sector.
Article 7.- Before starting petroleum activities in Vietnam, all organizations and individuals must draw up plans and schemes to protect petroleum activities as well as petroleum projects, means and equipment according to the regulations of the Ministry of Public Security. The protection plans and schemes must be forwarded to Vietnam Oil and Gas Corporation for coordinated implementation.
1. The recruitment of laborers to work for Vietnam Oil and Gas Corporation must strictly comply with the law provisions on labor and other relevant law provisions.
For foreigners and overseas Vietnamese, the recruitment dossiers must contain their judicial records. After being recruited, these individuals must operate in compliance with their entry purposes.
2. Vietnam Oil and Gas Corporation shall have to coordinate with the functional State bodies in managing activities of foreign laborers and overseas Vietnamese working for petroleum contractors, representative offices and enterprises in Vietnam.
1. Foreign petroleum contractors, foreign-invested petroleum enterprises, when recruiting Vietnamese laborers, must strictly comply with the Vietnamese law provisions on labor. They, after recruiting laborers, must send notices thereon together with the copies of the labor contracts to Vietnam Oil and Gas Corporation.
2. Foreign petroleum contractors, foreign-invested petroleum enterprises, when sending Vietnamese laborers to work or study abroad, must notify Vietnam Oil and Gas Corporation of the lists of the delegation members and the working or study programs.
1. Foreigners and overseas Vietnamese working for foreign contractors, or foreign-invested petroleum enterprises in Vietnam must strictly observe the Vietnamese laws and the international agreements which Vietnam has signed or acceded to.
2. Vietnam Oil and Gas Corporation may request foreign contractors and foreign-invested petroleum enterprises to terminate labor contracts with laborers when detecting evidences of violations of Vietnamese laws.
Article 11.- Information categorized as State secrets in the petroleum sector, when being transmitted by wired, wireless communications means or other technical means, must be encoded according to the State’s regulations on the cipher work.
To strictly prohibit the exchange or publication of information listed as State secrets in the petroleum sector on the mass media.
Article 12.- Organizations and individuals conducting petroleum activities in Vietnam, when using the computerized communication system connected with the Internet in service of petroleum activities, shall have the responsibility to:
1. Observe the State’s regulations on the establishment, management and use of the Internet;
2. Take responsibility before law for the information contents fed into or transmitted from their computer systems;
3. When detecting information of illegal sources infiltrating into Vietnam or law-breaking acts in the Internet use, immediately report them to the functional Sate bodies for handling.
