Quyền và nghĩa vụ của tổ chức, cá nhân đối với di sản văn hóa
Điều 14.

Tổ chức, cá nhân có các quyền và nghĩa vụ sau đây:

1. Sở hữu hợp pháp di sản văn hóa;

2. Tham quan, nghiên cứu di sản văn hóa;

3. Tôn trọng, bảo vệ và phát huy giá trị di sản văn hóa;

4. Thông báo kịp thời địa điểm phát hiện di vật, cổ vật, bảo vật quốc gia, di tích lịch sử - văn hóa, danh lam thắng cảnh; giao nộp di vật, cổ vật, bảo vật quốc gia do mình tìm được cho cơ quan nhà nước có thẩm quyền nơi gần nhất;

5. Ngăn chặn hoặc đề nghị cơ quan nhà nước có thẩm quyền ngăn chặn, xử lý kịp thời những hành vi phá hoại, chiếm đoạt, sử dụng trái phép di sản văn hóa.

Điều 15.

Tổ chức, cá nhân là chủ sở hữu di sản văn hóa có các quyền và nghĩa vụ sau đây:

1. Thực hiện các quy định tại Điều 14 của Luật này.

2. Thực hiện các biện pháp bảo vệ và phát huy giá trị di sản văn hóa; thông báo kịp thời cho cơ quan nhà nước có thẩm quyền trong trường hợp di sản văn hóa có nguy cơ bị làm sai lệch giá trị, bị hủy hoại, bị mất.

3. Gửi sưu tập di sản văn hóa phi vật thể, di vật, cổ vật, bảo vật quốc gia vào bảo tàng nhà nước hoặc cơ quan nhà nước có thẩm quyền trong trường hợp không đủ điều kiện và khả năng bảo vệ và phát huy giá trị.

4. Tạo điều kiện thuận lợi cho tổ chức, cá nhân tham quan, du lịch, nghiên cứu di sản văn hóa.

5. Thực hiện các quyền và nghĩa vụ khác theo quy định của pháp luật.

Điều 16.

Tổ chức, cá nhân quản lý trực tiếp di sản văn hóa có các quyền và nghĩa vụ sau đây:

1. Bảo vệ, giữ gìn di sản văn hóa.

2. Thực hiện các biện pháp phòng ngừa, ngăn chặn kịp thời các hành vi xâm hại di sản văn hóa.

3. Thông báo kịp thời cho chủ sở hữu hoặc cơ quan nhà nước có thẩm quyền nơi gần nhất khi di sản văn hóa bị mất hoặc có nguy cơ bị hủy hoại.

4. Tạo điều kiện thuận lợi cho tổ chức, cá nhân tham quan, du lịch, nghiên cứu di sản văn hóa.

5. Thực hiện các quyền và nghĩa vụ khác theo quy định của pháp luật.

Chapter 2.

RIGHTS AND OBLIGATIONS OF ORGANIZATIONS AND INDIVIDUALS TO CULTURAL HERITAGE

Article 14.

An organization or individual shall have the following rights and obligations:

1. Lawfully own cultural heritage;

2. Visit and study cultural heritage;

3. Respect, protect and promote the value of cultural heritage;

4. Promptly notify places where relics, antiquities and national treasures, historical-cultural monuments or scenic landscapes are discovered; and hand relics, antiquities and national treasures discovered by such organization or individual over to the nearest competent authorities;

5. Prevent or request the competent authorities to prevent or promptly handle acts of destruction, appropriation or illegal use of cultural heritage.

Article 15.

An organization or individual who is an owner of cultural heritage shall have the following rights and obligations:

1. Comply with regulations in Article 14 of this Law;

2. Adopt measures for protecting and promoting the value of cultural heritage; promptly report to the competent authorities in case cultural heritage is in danger of having its value falsified, being destroyed or lost;

3. Send collections of intangible cultural heritage, relics, antiquities and national treasures to the state museums or the competent authorities in case they lack conditions and capability to protect and promote the value thereof;

4. Create favorable conditions for organizations and individuals to visit, travel to and study cultural heritage;

5. Fulfill other obligations and rights as prescribed per the law.

Article 16.

An organization or individual who directly manages cultural heritage shall have the following rights and obligations:

1. Protect and preserve cultural heritage;

2. Adopt measures to promptly prevent or stop acts of infringing upon cultural heritage;

3. Promptly notify the owners or the nearest competent authorities when cultural heritage is lost or in danger of being destroyed;

4. Create favorable conditions for organizations and individuals to visit, travel to and study cultural heritage;

5. Fulfill other obligations and rights as prescribed per the law.
