Mẫu Giấy báo tử tại bệnh viện áp dụng từ 01/2/2021
Bộ Y tế ban hành Thông tư 24/2020/TT-BYT quy định về Phiếu chẩn đoán nguyên nhân tử vong, cấp Giấy báo tử và thống kê tử vong tại cơ sở khám bệnh, chữa bệnh.
Theo đó, cơ sở khám, chữa bệnh ghi đầy đủ các nội dung theo mẫu Giấy báo tử sau khi xác định tình trạng người bệnh đã tử vong, người thân thích của người tử vong đọc và kiểm tra lại thông tin trước khi ký vào giấy.

Giấy báo tử được lập thành 2 bản, có giá trị pháp lý như nhau, 01 bản giao cho người thân thích của người tử vong và 01 bản lưu tại cơ sở khám, chữa bệnh.
Giấy báo tử sẽ được cấp lại nếu bị mất, rách, nát hoặc nhầm lẫn khi ghi chép Giấy báo tử.
Lưu ý:
- Giấy báo tử được xác định là “Tử vong khi đang trên đường đi cấp cứu” gồm 02 trường hợp:
+ Tử vong khi đang trên đường đến cơ sở khám, chữa bệnh.
+ Tử vong khi đang trên đường đi từ một cơ sở khám, chữa bệnh này đến cơ sở khám, chữa bệnh khác.
- Mẫu giấy báo tử do cơ sở khám bệnh, chữa bệnh phát hành trước ngày 01/2/2021 được tiếp tục sử dụng đến hết ngày 31/12/2021.
Thông tư 24/2020/TT-BYT có hiệu lực thi hành từ 01/2/2021.

QUY ĐỊNH VỀ PHIẾU CHẨN ĐOÁN NGUYÊN NHÂN TỬ VONG, CẤP GIẤY BÁO TỬ VÀ THỐNG KÊ TỬ VONG TẠI CƠ SỞ KHÁM BỆNH, CHỮA BỆNH
Căn cứ Nghị định số 75/2017/NĐ-CP ngày 20 tháng 6 năm 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;
Căn cứ Nghị định số 123/2015/NĐ-CP ngày 15 tháng 11 năm 2015 của Chính phủ quy định chi tiết một số điều và biện pháp thi hành Luật Hộ tịch;
Theo đề nghị của Vụ trưởng: Vụ Pháp chế; Vụ Kế hoạch - Tài chính;
Bộ trưởng Bộ Y tế ban hành Thông tư quy định về Phiếu chẩn đoán nguyên nhân tử vong, cấp Giấy báo tử và thống kê tử vong tại cơ sở khám bệnh, chữa bệnh như sau:
Thông tư này áp dụng đối với các cơ sở khám bệnh, chữa bệnh đã được cấp Giấy phép hoạt động theo quy định của Luật Khám bệnh, chữa bệnh; các cơ quan, tổ chức, cá nhân có liên quan đến Phiếu chẩn đoán nguyên nhân tử vong; cấp, cấp lại Giấy báo tử và báo cáo thống kê tử vong tại cơ sở khám bệnh, chữa bệnh.
Điều 3. Thẩm quyền ký Phiếu chẩn đoán nguyên nhân tử vong và cấp, cấp lại Giấy báo tử
Thủ trưởng, người chịu trách nhiệm chuyên môn kỹ thuật tại các cơ sở khám bệnh, chữa bệnh quy định tại Điều 2 Thông tư này có thẩm quyền ký Phiếu chẩn đoán nguyên nhân tử vong và cấp, cấp lại Giấy báo tử. Thủ trưởng, người chịu trách nhiệm chuyên môn kỹ thuật có thể Ủy quyền bằng văn bản cho người khác ký Phiếu chẩn đoán nguyên nhân tử vong và cấp, cấp lại Giấy báo tử. Người ủy quyền và người được ủy quyền phải chịu trách nhiệm trước pháp luật về việc ủy quyền và văn bản do mình ký.
Điều 4. Quy định về Phiếu chẩn đoán nguyên nhân tử vong
1. Phiếu chẩn đoán nguyên nhân tử vong chi sử dụng cho cơ quan y tế với mục đích thống kê, xây dựng kế hoạch, chính sách, nghiên cứu, phân tích cấu trúc dân cư, đánh giá công tác chăm sóc và cung cấp dịch vụ chăm sóc sức khỏe nhân dân.
2. Khi xác định tình trạng người bệnh đã tử vong bằng chết sinh học: ngừng thở, ngừng tim, cơ sở khám bệnh, chữa bệnh nơi người bệnh tử vong có trách nhiệm ghi đầy đủ các nội dung theo màu Phiếu chẩn đoán nguyên nhân tử vong quy định tại Phụ lục I ban hành kèm theo Thông tư này.
3. Phiếu chẩn đoán nguyên nhân tử vong tại cơ sở khám bệnh, chữa bệnh không cấp cho người thân thích của người tử vong mà được lưu cùng Bản kiểm thảo tử vong tại cơ sở khám bệnh, chữa bệnh; làm cơ sở báo cáo thống kê theo quy định của pháp luật.
Điều 5. Quy định về việc cấp, cấp lại Giấy báo tử
1. Cấp Giấy báo tử
Sau khi xác định tình trạng người bệnh đã tử vong, cơ sở khám bệnh, chữa bệnh có trách nhiệm ghi đầy đủ các nội dung theo mẫu Giấy báo tử quy định tại Phụ lục II ban hành kèm theo Thông tư này. Người thân thích của người tử vong theo quy định tại Khoản 19 Điều 3 Luật Hôn nhân và Gia đình có trách nhiệm đọc, kiểm tra lại thông tin trước khi ký. Giấy báo tử được làm thành 02 bản có giá trị pháp lý như nhau, 01 bản giao cho người thân thích của người tử vong để làm thủ tục khai tử và 01 bản lưu tại cơ sở khám bệnh, chữa bệnh;
2. Cấp lại Giấy báo tử
a) Trường hợp nhầm lẫn khi ghi chép Giấy báo tử:
Người thân thích của người tử vong làm Đơn đề nghị cấp lại Giấy báo tử theo quy định tại Phụ lục III ban hành kèm theo Thông tư này, kèm theo giấy tờ chứng minh nội dung nhầm lẫn gửi cơ sở khám bệnh, chữa bệnh nơi đã cấp Giấy báo tử lần đầu cho người tử vong. Trong thời hạn không quá 01 ngày làm việc kể từ khi nhận được các giấy tờ hợp lệ, cơ sở khám bệnh, chữa bệnh có trách nhiệm thu hồi Giấy báo tử có nhầm lẫn để hủy; đơn và giấy tờ chứng minh được lưu cùng với bệnh án đang lưu tại cơ sở khám bệnh, chữa bệnh. Giấy báo tử được cấp lại phải ghi rõ số, quyển số của Giấy báo tử cũ và đóng dấu “Cấp lại”. Trong trường hợp cần phải xác minh, thì thời hạn xác minh không quá 05 ngày làm việc.
Giấy tờ chứng minh nội dung nhầm lẫn: đối với trường hợp nhầm lẫn về họ, chữ đệm, tên người tử vong, ngày tháng năm sinh, quốc tịch, số hộ chiếu, số chứng minh nhân dân, số thẻ căn cước công dân, số định danh cá nhân của người tử vong thì gửi kèm bản phô tô một trong các giấy tờ chứng minh sự nhầm lẫn sau đây: hộ chiếu, chứng minh nhân dân, thẻ căn cước công dân hoặc giấy tờ khác có dán ảnh và thông tin cá nhân thể hiện nội dung nhầm lẫn do cơ quan có thẩm quyền cấp, còn giá trị sử dụng (sổ hộ khẩu, sổ tạm trú, giấy tờ chứng minh về nơi cư trú) và mang theo bản chính các giấy tờ chứng minh sự nhầm lẫn để đối chiếu.
b) Trường hợp mất, rách, nát Giấy báo tử:
Người thân thích của người tử vong phải làm Đơn đề nghị cấp lại Giấy báo tử quy định tại Phụ lục III ban hành kèm theo Thông tư này gửi cơ sở khám bệnh, chữa bệnh đã cấp Giấy báo tử lần đầu. Trong thời hạn tối đa là 01 ngày làm việc kể từ thời điểm nhận được Đơn đề nghị cấp lại Giấy báo tử, cơ sở khám bệnh, chữa bệnh có trách nhiệm thu hồi Giấy báo tử bị rách, nát; kiểm tra thông tin trong đơn và đối chiếu với bản Giấy báo tử lưu lại cơ sở khám bệnh, chữa bệnh đã cấp. Giấy báo tử được cấp lại phải ghi rõ số, quyển số của Giấy báo tử cũ và đóng dấu “Cấp lại”. Trong trường hợp cần phải xác minh, thì thời hạn xác minh không quá 05 ngày làm việc.
Điều 6. Mẫu Phiếu chẩn đoán nguyên nhân tử vong tại cơ sở khám bệnh, chữa bệnh, Giấy báo tử, Đơn đề nghị cấp lại Giấy báo tử
1. Ban hành kèm theo Thông tư này các Mẫu giấy sau đây:
a) Mẫu Phiếu chẩn đoán nguyên nhân tử vong tại cơ sở khám bệnh, chữa bệnh quy định tại Phụ lục I;
b) Mẫu Giấy báo tử tại cơ sở khám bệnh chữa bệnh quy định tại Phụ lục II;
c) Đơn đề nghị cấp lại Giấy báo tử quy định tại Phụ lục III.
2. Phiếu chẩn đoán nguyên nhân tử vong là khổ giấy A4 (210 x 297 mm). Được in và ghi các thông tin liên quan đến người tử vong. Phiếu chẩn đoán nguyên nhân tử vong sẽ được kèm theo và lưu cùng bệnh án của người tử vong tại cơ sở khám bệnh, chữa bệnh.
3. Giấy báo tử được in sắn và đóng thành sổ. Kích thước của Sổ Giấy báo tử là khổ giấy A4 (210 x 297 mm). Mỗi trang trong sổ được chia thành 02 phần có nội dung giống nhau để ghi các thông tin liên quan đến người tử vong. Liên thứ nhất được giao cho người thân thích của người tử vong, liên thứ 02 giữ lại cơ sở khám bệnh, chữa bệnh để lưu trữ thông tin. Trong trường hợp cơ sở khám bệnh, chữa bệnh đang sử dụng phần mềm quản lý thì không phải đóng thành sổ, nhưng phải bảo đảm in và cấp Giấy báo tử theo đúng mẫu quy định tại Thông tư này.
4. Bộ Y tế có trách nhiệm cung cấp mẫu Phiếu chẩn đoán nguyên nhân tử vong tại cơ sở khám bệnh, chữa bệnh, mẫu Giấy báo tử trên Cổng thông tin điện tử của Bộ Y tế. Cơ sở khám bệnh, chữa bệnh tự in ấn Phiếu chẩn đoán nguyên nhân tử vong và Giấy báo tử để sử dụng.
5. Cách ghi: Hướng dẫn cụ thể tại các Mẫu giấy ban hành kèm theo Thông tư này.
Điều 7. Báo cáo thống kê số liệu Phiếu chẩn đoán nguyên nhân tử vong và Giấy báo tử
1. Nội dung báo cáo thống kê về Phiếu chẩn đoán nguyên nhân tử vong tại cơ sở khám bệnh, chữa bệnh bao gồm: số lượng Phiếu chẩn đoán nguyên nhân tử vong của cơ sở khám bệnh, chữa bệnh; các khó khăn, vướng mắc khi thực hiện lập Phiếu chẩn đoán nguyên nhân tử vong. Các thông tin có trong Phiếu chẩn đoán nguyên nhân tử vong sẽ được báo cáo đồng thời cùng với báo cáo thống kê về cấp Giấy báo tử theo quy định tại Khoản 2 Điều này.
2. Việc báo cáo thống kê số liệu cấp Giấy báo tử được quy định tại Thông tư số 20/2019/TT-BYT ngày 31 tháng 7 năm 2019 của Bộ trưởng Bộ Y tế quy định về Hệ thống chỉ tiêu thống kê cơ bản ngành y tế và Thông tư số 37/2019/TT-BYT ngày 30 tháng 12 năm 2019 của Bộ trưởng Bộ Y tế quy định Chế độ báo cáo thống kê ngành y tế.
1. Cục Quản lý Khám, chữa bệnh chịu trách nhiệm xây dựng tài liệu chuyên môn, tập huấn, hướng dẫn các cơ sở khám bệnh, chữa bệnh quy định tại Điều 2 Thông tư này triển khai các hoạt động ghi Phiếu chẩn đoán nguyên nhân tử vong theo hướng dẫn của Tổ chức Y tế thế giới; xây dựng hệ thống quản lý thông tin nguyên nhân tử vong tại các cơ sở khám bệnh, chữa bệnh.
2. Vụ Kế hoạch - Tài chính chịu trách nhiệm hướng dẫn các cơ sở khám bệnh, chữa bệnh quy định tại Điều 2 Thông tư này báo cáo thống kê số liệu Phiếu chẩn đoán nguyên nhân tử vong và Giấy báo tử theo quy định về chế độ báo cáo thống kê ngành y tế.
3. Thủ trưởng các đơn vị thuộc và trực thuộc Bộ Y tế; Giám đốc Sở Y tế các tỉnh, thành phố trực thuộc trung ương, Thủ trưởng y tế ngành và các đơn vị liên quan căn cứ vào chức năng, nhiệm vụ được giao để chỉ đạo thực hiện các quy định tại Thông tư này.
Trong quá trình tổ chức thực hiện nếu có khó khăn, vướng mắc đề nghị các cơ quan, tổ chức, cá nhân phản ánh kịp thời về Bộ Y tế (Vụ Kế hoạch - Tài chính, Cục Quản lý Khám, chữa bệnh) để xem xét, giải quyết./.

CIRCULAR
MEDICAL CERTIFICATE OF CAUSE OF DEATH, DEATH CERTIFICATE AND MORTALITY STATISTICS IN MEDICAL EXAMINATION AND TREATMENT ESTABLISHMENTS
Pursuant to Decree No. 75/2017/ND-CP dated June 20, 2017 of Government on functions, tasks, powers, and organizational structure of Ministry of Health;
Pursuant to Decree No.123/2015/ND-CP dated November 15, 2015 of Government on elaborating to Law on Civil Status;
At the request of Director General of Department of Legal Affairs; Department of Planning – Finance;
Minister of Health promulgates Circular on medical certificate of cause of death, death certificate and mortality statistics in medical examination and treatment establishments:
Article 1. Scope
This Circular prescribes how to specify medical certificate of cause of death; issuance and reissuance of death certificate and mortality statistic reports in medical examination and treatment establishments.
Article 2. Regulated entities
This Circular applies to medical examination and treatment establishments licensed for operation according to Law on Medical Examination and Treatment; agencies, organizations and individuals related to medical certificate of cause of death; issuance and reissuance of death certificates and mortality statistic reports in medical examination and treatment establishments.
Article 3. Entitlement for signing medical certificate of cause of death and issuing, reissuing death certificate
Heads and individuals responsible for specialized and technical affairs in medical examination and treatment establishments specified under Article 2 of this Circular shall have the power to sign medical certificates of cause of death and issue, reissue death certificate. Heads and individuals responsible for specialized and technical affairs may authorize other individuals in writing to sign medical certificate of cause of death and issue, reissue death certificate. Authorizing individuals and authorized individuals must be legally responsible for authorization and signed documents.
Article 4. Regulations on medical certificate of cause of death
1. Medical certificate of cause of death shall only be used by medical agencies for producing statistical reports, developing, plans, policies, conducting research, analyzing population structures, assessing implementation and provision of healthcare services for the general public.
2. Upon identifying patients having a biological death: absent breathing or cardiac arrest, medical examination and treatment establishments where the patients decease are responsible for specifying all contents classified by color in medical certificate of cause of death under Annex I attached to this Circular.
3. Medical certificate of cause of death in medical examination and treatment establishments shall not be given to relatives of the deceased but stored together with patient mortality meeting minutes in medical examination and treatment establishments which serve as the basis for statistical reports as per the law.
Article 5. Regulations on issuance and reissuance of death certificate
1. Issuance of death certificate
After verifying death of patients, medical examination and treatment establishments are responsible for filling in death certificate according to Annex II attached to this Circular. Relatives of the deceased patients according to Clause 19 Article 3 of Law on Marriage and Family are responsible for reading and examining specified information before signing. Death certificates shall be made into 2 copies with equal legitimacy, 1 copy shall be given to relatives of the deceased patients for death declaration, 1 copy shall be stored at medical examination and treatment establishments;
2. Reissuance of death certificate
a) In case of errors when filling in death certificate:
Relatives of the deceased patients shall prepare application for reissuance of death certificate according to Annex III attached to this Circular together with documents proving errors in previously issued death certificates and submit to medical examination and treatment establishments that issued the original death certificates. Within 1 working day from the date on which adequate documents are received, medical examination and treatment establishments are responsible for recalling the erroneous death certificates for disposal; application and proving documents shall be kept with medical records stored at medical examination and treatment establishments. Reissued death certificates must specify number and book number of the original death certificates and mark the reissued death certificates as “Cấp lại” (Reissued). In case verification is required, verification must be conducted within 5 working days.
Documents proving errors: in case of errors in family name, middle name, first name, date of birth, nationality, passport number, ID number, Citizen Identity Card number or personal identification number of the deceased patients, attach copies of any of following documents: passport, ID card, Citizen Identity Card or other documents containing photos and personal information which proves the correct information issued by competent authorities and remains valid (family register, temporary residence registry, residence documents) and original copies of aforementioned documents for comparison.
b) In case of loss or damage of death certificates:
Relatives of the deceased patients shall prepare application for reissuance of death certificate according to Annex III attached to this Circular and submit to medical examination and treatment establishments that issued the original death certificates. Within 1 working day from the date on which application for reissuance of death certificates is received, medical examination and treatment establishments are responsible for recalling damaged death certificates, examining information in the application and comparing with the death certificates stored at medical examination and treatment establishments which have issued the death certificates. Reissued death certificates must specify number and serial number of the original death certificates and mark the reissued death certificates as “Cấp lại” (Reissued). In case verification is required, verification must be conducted within 5 working days.
Article 6. Forms of medical certificate of cause of death at medical examination and treatment establishments, death certificate and application for reissuance of death certificate
1. Following forms are attached to this Circular:
a) Form of medical certificate of cause of death at medical examination and treatment establishments is specified under Annex I;
b) Form of death certificates at medical examination and treatment establishments is specified under Annex II;
c) Application for reissuance of death certificate is specified under Annex III.
2. Medical certificate of cause of death shall be in A4 (210 x 297 mm) format. Printed and specifying information related to the deceased patients. Medical certificate of cause of death shall be attached and stored together with medical records of the deceased patients at medical examination and treatment establishments.
3. Death certificates shall be printed and compiled into books. Death certificates shall be in A4 (210 x 297 mm) format. Each page shall be separated into 2 equivalent sections to record information related to deceased patients. The first section shall be handed to relatives of deceased patients, the second section shall be kept at medical examination and treatment establishments. In case medical examination and treatment establishments are employing management software, they the establishments are not required to compile into books but are required to print and issue death certificates using form under this Circular.
4. Ministry of Health is responsible for providing form of medical certificate of cause of death at medical examination and treatment establishments and form of death certificates on website of Ministry of Health. Medical examination and treatment establishments shall print medical certificate of cause of death and death certificates for use.
5. Specific instructions are included in the forms attached to this Circular.
Article 7. Statistical reports on figures of medical certificate of cause of death and death certificates
1. Statistical reports on medical certificate of cause of death at medical examination and treatment establishments include: number of medical certificate of cause of death of medical examination and treatment establishments; difficulties that arise when producing medical certificate of cause of death. Information in medical certificate of cause of death shall be reported simultaneously with statistical reports on issuance of death certificates according to Clause 2 of this Article.
2. Preparation of statistical reports on figures of death certificates is specified under Circular No. 20/2019/TT-BYT dated July 31, 2019 of Minister of Health on basic statistical indicator system in medical sector and Circular No. 37/2019/TT-BYT dated December 30, 2019 of Minister of Health on statistical report regimes in medical sector.
Article 8. Entry into force
This Circular comes into force from January 2, 2021.
Article 9. Transition clauses
Death certificates issued by medical examination and treatment establishments before the effective date of this Circular shall remain valid until the end of December 31, 2021.
Article 10. Responsibility for implementation
1. Vietnam Administration of Medical Services is responsible for developing specialized documents, training and guiding medical examination and treatment establishments specified under article 2 of this Circular to fill in medical certificate of cause of death according to instruction of World Health Organization; developing management system for cause of death information at medical examination and treatment establishments.
2. the Department of Planning—Finance is responsible for guiding medical examination and treatment establishments specified under Article 2 of this Circular to produce statistical reports on figures of medical certificate of cause of death and death certificates according to regulations and law on statistical report regimes in medical sector.
3. Heads of entities affiliated to Ministry of Health; directors of Departments of Health of provinces and central-affiliated cities, heads of medical entities and relevant entities within their functions and tasks shall direct implementation of this Circular.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Health (Department of Planning - Finance, Vietnam Administration of Medical Services)./.
