Thanh tra, kiểm tra và xử lý vi phạm
Điều 17. Thanh tra, kiểm tra

1. Thanh tra chuyên ngành tài nguyên và môi trường thực hiện chức năng thanh tra việc bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa.

2. Nội dung thanh tra, kiểm tra:

a) Thanh tra, kiểm tra việc chấp hành quy định nêu tại Nghị định này;

b) Phát hiện, ngăn chặn, xử lý theo thẩm quyền hoặc kiến nghị cơ quan có thẩm quyền xử lý các vi phạm pháp luật về bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa;

c) Kiến nghị các biện pháp bảo đảm thi hành pháp luật về bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa.

3. Việc thanh tra hoạt động bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa thực hiện theo quy định của pháp luật về thanh tra.

Điều 18. Giải quyết khiếu nại, tố cáo

1. Tổ chức, cá nhân có quyền khiếu nại, tố cáo hành vi vi phạm pháp luật trong hoạt động quản lý, bảo vệ, khai thác tổng hợp tài nguyên và môi trường hồ chứa.

2. Việc giải quyết khiếu nại, tố cáo hành vi vi phạm pháp luật trong hoạt động quản lý, bảo vệ, khai thác tổng hợp tài nguyên và môi trường hồ chứa thực hiện theo quy định của pháp luật về khiếu nại, tố cáo.

Điều 19. Xử lý vi phạm

1. Tổ chức, cá nhân có trách nhiệm phát hiện, ngăn chặn và kiến nghị xử lý kịp thời những hành vi vi phạm pháp luật trong hoạt động quản lý, bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa.

2. Tổ chức, cá nhân thiếu tinh thần trách nhiệm, lợi dụng chức vụ, quyền hạn, bao che cho các hành vi vi phạm pháp luật về quản lý, bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa; phá hoại, gây mất an toàn hồ chứa hoặc có hành vi vi phạm khác theo quy định của pháp luật thì tùy theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật, xử phạt hành chính hoặc bị truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.

INSPECTION, EXAMINATION, AND HANDLING OF VIOLATIONS

Article 17.- Inspection ana examination

1. Natural resources and environment inspectorates shall inspect the integrated protection and exploitation of reservoir resources and environment.

2. Inspection and examination cover:

a/ Inspecting and examining the observance of provisions of this Decree;

b/ Detecting, stopping and handling according to their competence or propose competent agencies to handle, violations of the law on integrated protection and exploitation of reservoirs:

c/ Proposing measures to ensure law enforcement related to integrated protection and exploitation of reservoir resources and environment.

3. Inspection of integrated protection and exploitation of reservoir resources and environment complies with the inspection law.

Article 18.- Settlement of complaints and denunciations

1. Organizations and individuals may lodge complaints or denunciations on acts of violation of the law on management, protection and integrated exploitation of reservoir resources and environment.

2. Settlement of complaints and denunciations on acts of violation of the law on management, protection and integrated exploitation of reservoir resources and environment complies with the law on complaints and denunciations.

Article 19.- Handling of violations

1. Organizations and individuals shall detect, stop and propose for prompt handling, acts of violation of the law on management, protection anc integrated exploitation of reservoir resources and environment.

2. Organizations and individuals that are irresponsible or abuse their positions and powers to cover acts of violations of the law on management, protection and integrated exploitation of reservoir resources and environment; or destroy reservoirs or cause reservoir unsafety or commit other acts of violation shall, depending on the nature and severity of their violation, be disciplined, administratively sanctioned or examined for penal liability; if causing damage, they shall pay compensation according to law.
