Nghị định này quy định chi tiết việc bảo vệ và phát huy giá trị di sản văn hóa phi vật thể; việc bảo vệ và phát huy giá trị di tích lịch sử - văn hóa, danh lam thắng cảnh; việc quản lý di vật, cổ vật, bảo vật quốc gia; tổ chức và hoạt động của bảo tàng; việc khen thưởng đối với tổ chức, cá nhân phát hiện và giao nộp di vật, cổ vật, bảo vật quốc gia.
Điều 2. Di sản văn hóa phi vật thể và di sản văn hóa vật thể1. Di sản văn hóa phi vật thể bao gồm:
a) Tiếng nói, chữ viết;
b) Ngữ văn dân gian;
c) Nghệ thuật trình diễn dân gian;
d) Tập quán xã hội và tín ngưỡng;
đ) Lễ hội truyền thống;
e) Nghề thủ công truyền thống;
d) Tri thức dân gian.
2. Di sản văn hóa vật thể bao gồm:
a) Di tích lịch sử - văn hóa, danh lam thắng cảnh (sau đây gọi là di tích);
b) Di vật, cổ vật, bảo vật quốc gia.
Điều 3. Chính sách của Nhà nước về bảo vệ và phát huy giá trị di sản văn hóa1. Xây dựng và thực hiện chương trình mục tiêu bảo tồn các di sản văn hóa tiêu biểu.
2. Khen thưởng tổ chức, cá nhân có thành tích trong việc bảo vệ và phát huy giá trị di sản văn hóa; xét tặng danh hiệu vinh dự nhà nước và thực hiện các chính sách ưu đãi về tinh thần và vật chất đối với nghệ nhân, nghệ sĩ nắm giữ và có công phổ biến nghệ thuật truyền thống, bí quyết nghề nghiệp có giá trị đặc biệt.
3. Nghiên cứu áp dụng thành tựu khoa học công nghệ vào các hoạt động sau đây:
a) Thăm dò, khai quật khảo cổ; bảo quản, tu bổ, tôn tạo và phát huy giá trị di tích;
b) Thẩm định, quản lý sưu tập, bảo quản hiện vật, chỉnh lý, đổi mới nội dung, hình thức trưng bày và hoạt động giáo dục của bảo tàng;
c) Sưu tầm, lưu giữ và phổ biến giá trị di sản văn hóa phi vật thể; thành lập ngân hàng dữ liệu về di sản văn hóa phi vật thể.
4. Đào tạo, bồi dưỡng đội ngũ cán bộ chuyên môn trong lĩnh vực bảo vệ và phát huy giá trị di sản văn hóa.
5. Khuyến khích và tạo điều kiện cho các tổ chức, cá nhân trong nước và nước ngoài đóng góp về tinh thần và vật chất hoặc trực tiếp tham gia các hoạt động bảo vệ và phát huy giá trị di sản văn hóa.
6. Mở rộng các hình thức hợp tác quốc tế trong lĩnh vực bảo vệ và phát huy giá trị di sản văn hóa; xây dựng và thực hiện các dự án hợp tác quốc tế theo quy định của pháp luật.
Điều 4. Những hành vi vi phạm làm sai lệch hoặc hủy hoại di sản văn hóa1. Những hành vi làm sai lệch di tích:
a) Làm thay đổi yếu tố gốc cấu thành di tích như đưa thêm, di dời, thay đổi hiện vật trong di tích hoặc tu bổ, phục hồi không đúng với yếu tố gốc cấu thành di tích và các hành vi khác khi chưa được phép của cơ quan nhà nước có thẩm quyền về văn hóa, thể thao và du lịch, tuyên truyền, giới thiệu sai lệch về nội dung và giá trị của di tích;
b) Làm thay đổi môi trường cảnh quan của di tích như chặt cây, phá đá, đào bới, xây dựng trái phép và các hành vi khác gây ảnh hưởng xấu đến di tích.
2. Những hành vi gây nguy cơ hủy hoại hoặc làm giảm giá trị di sản văn hóa phi vật thể:
a) Phổ biến và thực hành sai lệch nội dung di sản văn hóa phi vật thể;
b) Tùy tiện đưa những yếu tố mới không phù hợp làm giảm giá trị di sản văn hóa phi vật thể;
c) Lợi dụng việc tuyên truyền, phổ biến, trình diễn, truyền dạy di sản văn hóa phi vật thể để trục lợi và thực hiện các hành vi khác trái pháp luật.
3. Những trường hợp sau đây bị coi là đào bới trái phép địa điểm khảo cổ:
a) Tự ý đào bới, tìm kiếm di vật, cổ vật, bảo vật quốc gia trong khu vực bảo vệ di tích và địa điểm thuộc quy hoạch khảo cổ như di chỉ cư trú, mộ táng, công xưởng chế tác công cụ, thành lũy và các địa điểm khảo cổ khác;
b) Tự ý tìm kiếm, trục vớt các di vật, cổ vật, bảo vật quốc gia còn chìm đắm dưới nước.
Article 1. Scope of regulation
This Decree details the protection and promotion of the values of intangible cultural heritage; the protection and promotion of the values of historical-cultural relics and beauty spots: the management of vestiges, antiques and national precious objects; the organization and operation of museums; and commendation of organizations and individuals finding and handing over vestiges, antiques and national precious objects.
Article 2. Intangible cultural heritage and tangible cultural heritage
1. Intangible cultural heritage includes;
a/ Speech, script;
b/ Folk philology;
c/ Folk performing arts;
d/ Social customs and beliefs;
e/ Traditional festivals;
f/ Traditional craft;
g/ Folk knowledge.
2. Tangible cultural heritage includes:
a/ Historical-cultural relics and beauty spots (below referred to as relics);
b/ Vestiges, antiques and national precious objects.
Article 3. State policies for the protection and promotion of cultural heritage values.
1. To formulate and implement target programs on conservation of typical cultural heritage.
2. To commend organizations and individuals with achievements in the protection and promotion of cultural heritage values; to consider and confer state honorable titles and adopt spiritual and material incentives for craftsperson’s and artists who keep and popularize traditional arts and professional secrets of special value.
3. To study and apply scientific and technological achievements to the following activities:
a/ Archaeological exploration and excavation; conservation, upgrading, embellishment and promotion of the values of relics;
b/ Evaluation, management of collection, preservation of exhibits, adjustment and renovation of contents and forms of display and educational activities of museums;
c/ Collection, conservation and dissemination of the values of intangible cultural heritage; formation of a database bank for intangible cultural heritage.
4. To train and retrain professionals in the protection and promotion of cultural heritage values.
5. To encourage and create conditions for domestic and foreign organizations and individuals to make spiritual and material contributions to, or directly participate in7 the protection and promotion of cultural heritage values.
6. To expand international cooperation in the protection and promotion of cultural heritage values; to formulate and implement international cooperation projects under law.
Article 4. Violations misrepresenting or destroying cultural heritage
1. Acts of misrepresenting relics:
a/ Changing the original constituents of a relic such as adding to, removing or changing exhibits of a relic, or embellishing or restoring a relic at variance with its original constituents and other acts without permission of state agencies competent in culture, sports and tourism, incorrectly disseminating or introducing the contents and values of a relic;
b/ Changing the environment and landscape of a relic, such as tree felling, rock destruction, digging, illegal construction and other acts adversely affecting a relic.
2. Acts of threatening to destroy or reducing the values of intangible cultural heritage:
a/ Incorrectly disseminating or practicing the contents of intangible cultural heritage;
b/ Groundlessly adding inappropriate new elements to intangible cultural heritage, reducing its value;
c/ Making use of the propagation, dissemination and performance of and training in intangible cultural heritage for self-seeking purposes or committing other unlawful acts.
3. The following acts are regarded as illegally digging archaeological sites:
a/ Digging without permission to search for vestiges, antiques or national precious objects in relic protection zones or sites under archaeological planning such as relics of residence, tombs, tool making workshops, citadels and other archaeological sites;
b/ Searching and salvaging without permission underwater vestiges, antiques or national precious objects.
