Điều 17. Trách nhiệm của Ủy ban nhân dân cấp tỉnh

1. Giao cho cơ quan chuyên môn hoặc thuê tổ chức có chức năng định giá, tư vấn về giá xác định giá các loại rừng theo quy định tại Nghị định này.

2. Tổ chức thẩm định giá các loại rừng, trình Hội đồng nhân dân cùng cấp thông qua và công bố công khai tại địa phương.

3. Kiểm tra, xử lý và giải quyết những vấn đề liên quan đến việc định giá các loại rừng thuộc thẩm quyền tại địa phương.

4. Theo dõi biến động giá chuyển nhượng, cho thuê trên thị trường hoặc giá giao dịch (giữa Nhà nước và chủ rừng) về quyền sử dụng rừng, quyền sở hữu rừng trồng trên thị trường; thường xuyên, tổ chức thống kê giá các loại rừng.

5. Quy định cụ thể hệ số "k" để làm cơ sở xác định tiền bồi thường đối với người có hành vi vi phạm pháp luật về bảo vệ và phát triển rừng gây thiệt hại cho Nhà nước theo quy định tại khoản 8 Điều 4 Nghị định này.

6. Kinh phí thực hiện xác định giá các loại rừng do ngân sách nhà nước đảm bảo.

Điều 18. Trách nhiệm của các Bộ, ngành

1. Bộ Nông nghiệp và Phát triển nông thôn chủ trì, phối hợp với Bộ Tài chính hướng dẫn thực hiện Nghị định này.

2. Bộ Nông nghiệp và Phát triển nông thôn phối hợp với các Bộ, ngành liên quan kiểm tra, giám sát, giải quyết vướng mắc phát sinh trong quá trình thực hiện Nghị định này.

Điều 19. Điều khoản thi hành

1. Nghị định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng Công báo.

2. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chịu trách nhiệm thi hành Nghị định này./.

ORGANIZATION OF IMPLEMENTATION

Article 17.- Responsibilities of provincial-level People’s Committees

1. To assign specialized agencies or hire organizations having the function of price determination and consultancy to determine the prices of forests of different types under the provisions of this Decree.

2. To organize the evaluation of prices of forests of different types, submit them to the People’s Councils of the same level for approval, and publicize them in their localities.

3. To check, handle and settle issues related to the determination of prices of forests of different types according to their competence.

4. To monitor fluctuations in the market transfer prices and rents or the prices of transactions (between the State and forest owners) of the forest use right or plantation forest ownership right; to regularly update information on prices of forests of different types.

5. To set specific coefficients “k” as a basis for determining compensation money payable by persons who commit acts in violation of the forest protection and development law, causing damage to the State, under the provisions of Clause 8, Article 4 of this Decree.

6. Funds for determining prices of forests of different types shall be ensured by the state budget.

Article 18.- Responsibilities of ministries and branches

1. The Ministry of Agriculture and Rural Development shall assume the prime responsibility for, and coordinate with the Ministry of Finance in, guiding the implementation of this Decree.

2. The Ministry of Agriculture and Rural Development shall coordinate with relevant ministries and branches in examining, supervising and settling any problems arising in the course of implementation of this Decree.

Article 19.- Implementation provisions

1. This Decree takes effect 15 days after its publication in “CONG BAO.”

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies and presidents of provincial-level People’s Committees shall implement this Decree.
