Điều 18. Điều khoản chuyển tiếp

1. Bệnh viện, cơ sở y tế điều trị bệnh truyền nhiễm, nghĩa trang, bãi chôn lấp chất thải, cơ sở sản xuất hóa chất độc hại, cơ sở sản xuất, chế biến có nước thải nguy hại đang hoạt động trong hành lang bảo vệ nguồn nước không được mở rộng quy mô và phải có biện pháp kiểm soát, giám sát chặt chẽ chất lượng nước thải, chất thải trước khi thải ra đất, nguồn nước.

Đối với cơ sở đang hoạt động gây ô nhiễm nguồn nước phải có giải pháp để khắc phục trong thời hạn do Ủy ban nhân dân cấp tỉnh quy định (trường hợp cơ sở hoạt động trong hành lang bảo vệ nguồn nước nội tỉnh) hoặc do Bộ Tài nguyên và Môi trường quy định (trường hợp cơ sở hoạt động trong hành lang bảo vệ nguồn nước liên tỉnh, liên quốc gia). Trường hợp cơ sở không khắc phục được tình trạng gây ô nhiễm thì Ủy ban nhân dân cấp tỉnh, Bộ Tài nguyên và Môi trường trình Thủ tướng Chính phủ quyết định đình chỉ hoạt động hoặc di dời.

2. Đối với các hồ chứa thủy điện, thủy lợi đã nộp hồ sơ phương án cắm mốc hành lang bảo vệ trước ngày Nghị định này có hiệu lực thì tiếp tục thực hiện theo quy định của Nghị định số 112/2008/NĐ-CP ngày 20 tháng 10 năm 2008 về quản lý, bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa thủy điện, thủy lợi.

Điều 19. Hiệu lực thi hành

1. Nghị định này có hiệu lực thi hành kể từ ngày 01 tháng 7 năm 2015.

2. Bãi bỏ các quy định tại Khoản 1 Điều 3; Điều 6; Khoản 3, Khoản 4 và Khoản 5 Điều 8 của Nghị định số 112/2008/NĐ-CP ngày 20 tháng 10 năm 2008 về quản lý, bảo vệ, khai thác tổng hợp tài nguyên và môi trường các hồ chứa thủy điện, thủy lợi.

Điều 20. Trách nhiệm thi hành

1. Bộ Tài nguyên và Môi trường chịu trách nhiệm chủ trì, phối hợp với các Bộ, ngành liên quan hướng dẫn thi hành Nghị định này.

2. Các Bộ trưởng, Thủ trưởng cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương và tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./.

IMPLEMENTATION PROVISIONS

Article 18. Transitional provisions

1. Contagious disease hospitals and clinics, cemeteries, waste dumping sites, toxic chemical plants, and production and processing establishments discharging hazardous wastewater, which are operating in water source protection corridors, may not expand their scale and shall adopt measures to control and closely supervise the quality of wastewater and wastes before discharging them into soil and water sources.

The operating establishments which pollute water sources shall work out solutions to the situation within time limits prescribed by provincial-level People’s Committees (except establishments operating in intra-provincial water source protection corridors) or by the Ministry of Natural Resources and Environment (if establishments operate in inter-provincial or trans-national water source protection corridors). If the establishments are unable to remedy the pollution, the provincial-level People’s Committees and the Ministry of Natural Resources and Environment shall propose the Prime Minister to decide on suspension of their operation or on their relocation.

2. For hydroelectric and irrigation reservoirs for which the schemes on planting of protection corridor markers have been submitted before this Decree takes effect, Decree No. 112/2008/ND-CP of October 20, 2008, on integrated management, protection and exploitation of resources and environment of hydroelectric and irrigation reservoirs still applies.

Article 19. Effect

1. This Decree takes effect on July 1, 2015.

2. To annul the provisions of Clause 1 of Article 3; Article 6; Clauses 3, 4 and 5 of Article of Decree No. 112/2008/ND-CP of October 20, 2008, on integrated management, protection and exploitation of resources and environment of hydroelectric and irrigation reservoirs.

Article 20. Implementation responsibility

1. The Ministry of Natural Resources and Environment shall assume the prime responsibility for, and coordinate with related ministries and sectors in, guiding the implementation of this Decree.

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People’s Committees and related organizations and individuals shall implement this Decree.-
