Thẩm quyền quy định về phí và lệ phí
Điều 8

Uỷ ban thường vụ Quốc hội ban hành Danh mục phí và lệ phí kèm theo Pháp lệnh này.

Điều 9

Chính phủ có thẩm quyền:

1- Quy định chi tiết Danh mục phí và lệ phí do Uỷ ban thường vụ Quốc hội ban hành;

2- Quy định chi tiết nguyên tắc xác định mức thu phí, lệ phí;

3- Quy định mức thu, chế độ thu, nộp, quản lý và sử dụng đối với một số phí, lệ phí quan trọng thực hiện trong cả nước; giao hoặc phân cấp thẩm quyền quy định mức thu, chế độ thu, nộp, quản lý và sử dụng đối với các phí, lệ phí khác;

4- Trình Uỷ ban thường vụ Quốc hội sửa đổi, bổ sung Danh mục phí và lệ phí.

Điều 10

Bộ Tài chính có thẩm quyền:

1- Soạn thảo các văn bản quy phạm pháp luật về phí và lệ phí để trình Chính phủ hoặc ban hành theo thẩm quyền;

2- Căn cứ vào quy định chi tiết của Chính phủ, quy định mức thu cụ thể đối với từng loại phí, lệ phí; hướng dẫn xác định mức thu phí, lệ phí cho các cơ quan được phân cấp quy định mức thu;

3- Quy định chế độ thu, nộp, quản lý và sử dụng đối với các phí, lệ phí thuộc thẩm quyền;

4- Hướng dẫn thực hiện chế độ thu, nộp, quản lý và sử dụng tiền phí, lệ phí thu được.

Điều 11

Hội đồng nhân dân tỉnh, thành phố trực thuộc trung ương quyết định thu phí, lệ phí được phân cấp do Uỷ ban nhân dân cùng cấp trình theo hướng dẫn của Bộ Tài chính.

Chapter II

COMPETENCE TO PRESCRIBE CHARGES AND FEES

Article 8.- The Standing Committee of the National Assembly promulgates the lists of charges and fees together with this Ordinance.

Article 9.- The Government has the competence to:

1. Specify the lists of charges and fees promulgated by the Standing Committee of the National Assembly;

2. Specify the principles for determination of charge and fee rates;

3. Prescribe the rates, the regime of collection, remittance, management and use of a number of importance charges and fees for nationwide implementation; assign or authorize the competence to prescribe the rates, the regime of collection, remittance, management and use of other charges and fees;

4. Submit to the Standing Committee of the National Assembly amendments and supplements to the lists of charges and fees.

Article 10.- The Ministry of Finance has the competence to:

1. Draft legal documents on charges and fees for submission to the Government for promulgation or promulgate them according to its competence;

2. Basing itself on the concrete stipulations of the Government, set the specific rates of each charge or fee, provide guidance on the determination of charge and fee rates for the agencies authorized to set such rates;

3. Prescribe the regime of collection, remittance, management and use of various charges and fees under its competence;

4 Guide the implementation of the regime of collection, remittance, management and use of collected charges and fees.

Article 11.- The People’s Councils of the provinces or centrally-run cities shall decide on the authorized collection of charges and fees, which is submitted by the People�s Committees of the same level under the guidance of the Ministry of Finance.
