Điều 26. Thủ tục xử phạt vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm

Thủ tục xử phạt vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm được thực hiện theo quy định tại Chương VI của Pháp lệnh Xử lý vi phạm hành chính ngày 02 tháng 7 năm 2002.

Điều 27. Cưỡng chế thi hành quyết định xử phạt vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm

Việc cưỡng chế thi hành quyết định xử phạt vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm được thực hiện theo quy định tại Điều 66 của Pháp lệnh Xử lý vi phạm hành chính ngày 02 tháng 7 năm 2002.

Điều 28. Xử phạt vi phạm hành chính đối với hành vi chống đối người thi hành công vụ trong lĩnh vực kinh doanh bảo hiểm

Việc xử phạt vi phạm hành chính đối với người có hành vi chống đối người thi hành công vụ trong lĩnh vực kinh doanh bảo hiểm được thực hiện theo quy định của pháp luật về xử phạt vi phạm hành chính trong lĩnh vực an ninh trật tự.

Điều 29. Khen thưởng và kỷ luật

1. Cá nhân, tổ chức có thành tích trong đấu tranh và phòng, chống vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm thì được xét khen thưởng theo quy định chung của Nhà nước.

2. Người có thẩm quyền xử lý vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm có hành vi che dấu hành vi vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm hoặc không chấp hành quy định về xử phạt vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm trong Nghị định này thì tùy theo tính chất, mức độ vi phạm sẽ bị xử lý kỷ luật hoặc truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.

Điều 30. Thời hiệu thi hành quyết định xử phạt

Quyết định xử phạt vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm hết hiệu lực thi hành sau 01 năm, kể từ ngày ra quyết định; trong trường hợp cá nhân, tổ chức bị xử phạt cố tình trốn tránh, trì hoãn thì không áp dụng thời hiệu quy định tại Điều này.

Điều 31. Khiếu nại và tố cáo

Việc khiếu nại, tố cáo và giải quyết khiếu nại, tố cáo đối với quyết định xử phạt vi phạm hành chính trong lĩnh vực kinh doanh bảo hiểm được thực hiện theo quy định của pháp luật về khiếu nại, tố cáo.

Chapter IV

SANCTIONING PROCEDURES, EXECUTING SANCTIONING DECISIONS AND COMPLAINTS

Article 26.- Procedures for sanctioning administrative violations in the field of insurance business

The procedures for sanctioning administrative violations in the field of insurance business shall comply with the provisions in Chapter VI of the Ordinance on Handling of Administrative Violations of July 2, 2002.

Article 27.- Coercive execution of decisions on sanctioning administrative violations in the field of insurance business

The coercive execution of decisions on sanctioning administrative violations in the field of insurance business shall comply with the provisions in Article 66 of the Ordinance on Handling of Administrative Violations of July 2, 2002.

Article 28.- Administratively sanctioning the acts of opposing persons performing official duties in the field of insurance business

The administrative sanctioning of persons who commit acts of opposing people who are performing their official duties in the field of insurance business shall comply with the law provisions on sanctioning administrative violations in the field of security and order.

Article 29.- Commendation and discipline

1. Individuals and organizations recording achievements in preventing and combating acts of administrative violations in the field of insurance business shall be considered for commendation/reward according to the general regulations of the State.

2. Persons competent to handle administrative violations in the field of insurance business, who commit acts of covering up administrative violations in the field of insurance business or failing to comply with the regulations on sanctioning administrative violations in the field of insurance business prescribed in this Decree, shall, depending on the nature and seriousness of their violations, be disciplined or examined for penal liability, and if causing damage, have to pay compensations therefor according to law provisions.

Article 30.- The statute of limitations for execution of sanctioning decisions

The decisions to sanction administrative violations in the field of insurance business shall be no longer valid after on year as from the date of their issuance; in cases where sanctioned individuals or organizations deliberately evade or delay the execution thereof, the statute of limitation prescribed in this Article shall not apply.

Article 31.- Complaints and denunciations

The complaints and denunciations against decisions on sanctioning administrative violations in the field of insurance business and the settlement thereof shall comply with the law provisions on complaints and denunciations.
