Điều 17. Thanh tra, kiểm tra hoạt động kinh doanh vận tải bằng ôtô

1. Các Bộ, ngành và Ủy ban nhân dân cấp tỉnh chịu trách nhiệm tổ chức thanh tra, kiểm tra và xử lý các vi phạm theo thẩm quyền.

2. Nội dung kiểm tra, thanh tra bao gồm việc chấp hành quy định tại Nghị định này và các quy định pháp luật khác có liên quan tới vận tải đối với các hoạt động kinh doanh vận tải khách bằng ô tô theo quy định tại Điều 3 Nghị định này.

3. Việc tiến hành kiểm tra, thanh tra doanh nghiệp, hộ kinh doanh kinh doanh vận tải bằng ô tô phải tuân thủ các quy định của pháp luật hiện hành.

Điều 18. Khiếu nại, tố cáo

1. Tổ chức, cá nhân có quyền khiếu nại đối với người có thẩm quyền trong việc thực hiện các quy định của Nghị định này theo quy định của pháp luật về khiếu nại, tố cáo.

2. Cá nhân có quyền tố cáo với cơ quan nhà nước có thẩm quyền về những hành vi vi phạm các quy định của Nghị định này của các tổ chức, cá nhân khác; về hành vi trái pháp luật của người thuộc cơ quan quản lý nhà nước theo quy định của pháp luật về khiếu nại, tố cáo.

Điều 19. Khen thưởng và xử lý vi phạm

1. Tổ chức, cá nhân có thành tích trong việc thực hiện Nghị định này sẽ được khen thưởng theo quy định của pháp luật về thi đua khen thưởng.

2. Mọi hành vi vi phạm các quy định của Nghị định này thì tuỳ theo tính chất, mức độ vi phạm mà bị xử phạt hành chính hoặc truy cứu trách nhiệm hình sự; nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.

3. Người nào lợi dụng chức vụ, quyền hạn làm trái với những quy định của Nghị định này và các quy định khác của pháp luật có liên quan thì tuỳ theo tính chất, mức độ vi phạm mà bị xử lý kỷ luật hoặc truy cứu trách nhiệm hình sự, nếu gây thiệt hại thì phải bồi thường theo quy định của pháp luật.

EXAMINATION AND INSPECTION OF BUSINESS CONDITIONS, COMPLAINTS AND DENUNCIATIONS; COMMENDATION, AND HANDLING OF VIOLATIONS

Article 17.- Examination and inspection of automobile transport business activities

1. Ministries, branches and provincial-level People's Committees shall organize examination and inspection and handle violations according to their competence.

2. Subject to examination and inspection shall be the observance of this Decree and other provisions of law related to automobile transport business activities defined in Article 3 of this Decree.

3. The examination and inspection of enterprises and households conducting automobile transport business must comply with the current provisions of law.

Article 18.- Complaints and denunciations

1. Organizations and individuals may lodge complaints to competent persons about the implementation of this Decree in accordance with the law on complaints and denunciations.

2. Individuals may denounce to competent state agencies violations of this Decree committed by other organizations or individuals and law-breaking acts committed by persons of state management agencies in accordance with the law on complaints and denunciations.

Article 19.- Commendation, and handling of violations

1. Organizations and individuals that record achievements in the implementation of this Decree are entitled to commendation in accordance with the law on emulation and commendation.

2. All acts in violation of the provisions of this Decree shall, depending on their nature and severity, be administratively sanctioned or examined for penal liability; in case of damage, compensations must be paid according to the provisions of law.

3. Those who abuse their positions or powers to act in contravention of the provisions of this Decree and relevant provisions of law shall, depending on the nature and seriousness of their violations, be disciplined or examined for penal liability; if causing damage, they must pay compensations according to the provisions of law.
