CIRCULAR
AMENDING AND SUPPLEMENTING THE TRANSPORT MINISTRY'S CIRCULAR NO. 07/2010/TT-BGTVT OF FEBRUARY 11, 2010, PROVIDING FOR LOAD AND LIMIT SIZE OF ROADS; OPERATION OF OVERLOADED, OVERSIZED AND TRACK VEHICLES ON ROADS; TRANSPORTATION OF EXTRA-LONG AND EXTRA-HEAVY CARGOES; AND CARGO LOADING LIMITS OF ROAD VEHICLES FOR ROAD TRANSPORT
Pursuant lo the November 13, 2008 Law on Road Traffic;
Pursuant to the Government's Decree No. 51/ 2008/ND-CP of April 22, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;
The Minister of Transport amends and supplements Circular No. 07/2010/TT-BGTVT of February 11, 2010, providing for load and limit size of roads; operation of overloaded, oversized and track vehicles on roads; transportation of extra-long and extra-heavy cargoes; and cargo loading limits of road vehicles for road transport (below referred to as Circular No. 07/2010/TT-BGTVT), as follows:
Article 1. To amend and supplement a number of articles of Circular No. 07/2010/TT-BGTVT
1. Point b, Clause 2, Article 16 is amended and supplemented as follows:
"b/ For tractor-trailers;
- Having 3 axles and a gross vehicle weight ≤ 26 tons;
- Having 4 axles and a gross vehicle weight ≤ 34 tons;
- Having 5 axles and a gross vehicle weight ≤ 44 tons;
- Having 6 or more axles and a gross vehicle weight ≤48 tons."
2. Clause 3, Article 17 is amended and supplemented as follows:
"3. Special-use vehicles and container trucks: The maximum cargo fill height is 4.35 m, measured from the highest point of the road surface upward;"
3. Point b, Clause 3, Article 23 is amended and supplemented as follows:
"b/ The gross vehicle weight is smaller than the maximum vehicle weight allowable for road transport but the axle load exceeds by 1.15 times the maximum axle load allowable for road transport specified in Clause 1, Article 16 of Circular No. 07/2010/TT-BGTVT."
Article 2. Effect and organization of implementation
1. This Circular takes effect 45 days from the date of its signing. To annul Point b, Clause 2, Article 16; Clause 3. Article 17; and Point b, Clause 3, Article 23 of Circular No. 07/2010/TT-BGTVT.
2. The director of the office and the chief inspector of the Ministry, directors of departments; the director of the Vietnam Road Administration, directors of provincial-level Transport Departments, heads of concerned agencies and organizations and concerned individuals shall implement this Circular.
3. Any problems arising in the course of implementation of this Circular should be reported to the Ministry of Transport for study and additional guidance.
