DECISION
ON FUNCTIONS, TASKS, ENTITLEMENT, AND ORGANIZATIONAL STRUCTURE OF THE INFORMATION TECHNOLOGY DEPARTMENT AFFILIATED TO THE MINISTRY OF HEALTH
MINISTER OF HEALTH
Pursuant to the Government's Decree No. 36/2012/ND-CP dated April 18, 2012 on functions, tasks, entitlements and organizational structure of Ministries and ministerial agencies;
Pursuant to the Government's Decree No. 63/2012/ND-CP dated April 18, 2012 on functions, tasks, entitlements and organizational structure of the Ministry of Health;
At the request of the Director of the Information Technology Department (hereinafter referred to as ITD) and the Director of the Health Personnel Department affiliated to the Ministry of Health.
DECIDES:
Article 1. Positions and functions
1. ITD is an organization affiliated to the Ministry of Health, and meant to assist the Minister of Health in management of development and application of information technology to health care, organize the development and application of information technology to the operation of the affiliates of Ministry of Health.
2. ITD has a separate legal status, seal, account, and is situated in Hanoi.
Article 2. Tasks and entitlements
1. Request competent authorities to promulgate legislative documents, National Technical Regulations and Standards on the development and application of information technology to health care.
2. Request competent authorities approve 5-year, annual strategies and plans for development and application of information technology to health care.
3. Provide instructions on inspection and assessment of adherence to the legislative documents, strategies, policies, and plans for development and application of information technology to health care.
4. Provide instructions in development and application of information technology to the operation of health agencies and health units.
5. Provide instructions in assessing the projects and programs for development and application of information technology to the operation of the affiliates of the Ministry of Health.
6. Direct, manage, and organize the development and application of information technology to medical examination, treatment, defensive medicine, pharmacology, medical equipment, scientific research, training for health workforce, health statistics, and other activities.
7. Take charge and cooperate with relevant units in digitizing the medical procedures, provide uniform electronic forms for the whole health sector; organize the implementation of information technology application projects; provide information technology services serving health care.
8. Take charge of developing, managing, updating, protecting, and maintaining health database; provide instructions and inspect the development and use of specialist database of the affiliates of the Ministry of Health.
9. Provide instructions on maintaining and using the IT infrastructure serving the direction and operation of the affiliates of the Ministry of Health, ensure information confidentiality and network security.
10. Provide instructions on development, maintenance, upgrade, and updates of the website of the Ministry of Health, its affiliates, and Services of Health to develop deductible expenses; provide instructions on online provision of public administrative services and information in accordance with law.
11. Provide instructions on managing digital documents and signatures for the affiliates of the Ministry of Health in accordance with the laws on electronic transactions.
12. Cooperate with relevant units in developing a system of organization and workforce in charge of development and application of information technology to health care, providing training in information technology for officials and civil servants of health bodies.
13. Conduct scientific research into development and application of information technology to health care in accordance with the plans approved by competent authorities.
14. Take charge and cooperate with relevant units in international cooperation in application of information technology to health care.
15. Manage the officials, civil servants, finance, and allocated assets in accordance with law and regulations of the Minister of Health.
16. Other tasks and entitlements given by the Minister of Health.
Article 3. Organizational structure
1. The heads include the Director and Deputy Directors
The Director and Deputy Directors are appointed and dismissed by the Minister of Health in accordance with law.
The Director is responsible to the Minister of Health for the operation of ITD. The Deputy Directors are to assist the Director, fulfill the duties assigned by the Director, and are responsible to the Director for the fulfillment of their duties.
2. Organizational structure of ITD:
a) The head office;
b) Planning - Finance Division;
c) Electronic Health Management Division I;
d) Electronic Health Management Division II;
dd) IT Infrastructure Division;
e) In-line Service Division;
g) Affiliated units:
- Health Information Technology Center;
- Data Integration Center;
- Health Information Technology Magazine.
3. Mechanism:
a) ITD is leaded by its Director;
b) The functions, tasks, and entitlements of the head office and the divisions are decided by the Director in accordance with the functions, tasks, and entitlements of ITD given by the Ministry of Health. The relationships between the head office and the other Divisions are decided by the Director;
c) The designation and dismissal of managers of the head office and the Divisions must be conformable with law and regulations of the Ministry of Health;
d) The heads of ITD, the managers of its head office and Divisions are entitled to allowances as prescribed by law.
4. Payroll
The payroll of ITD is made in accordance with the laws on job positions and adjusted by the Minister of Health at the request of the Director.
5. The budget of ITD is funded by government budget and other lawful sources.
Article 4. Effect
This Decision takes effect on October 20, 2012.
This Decision supersedes the previous regulations of the Minister of Health on functions, tasks, and entitlements of the bodies and units related to the development and application of information technology to health care.
Article 5. Responsibility for implementation
The Chief of the Ministry Office, the Chief Inspector of the Ministry, the Directors of the Departments affiliated to the Ministry of Health, and the heads of relevant units are responsible for the implementation of this Decision./.
